Abstract:
Intrinsic in the concept of international justice for violations of international humanitarian law is the requirement of cooperation by states and, to a large extent, regional bodies with the International Criminal Court (ICC). Unlike domestic courts, the ICC is not endowed with law enforcement power nor could such power be imputed to it as part of its functions. It is against this background that the on-going crisis of corporation between the ICC and the African Union (AU) following the indictment of Sudanese President Omar al-Bashir for international crime portends a far reaching implication for the administration of international criminal accountability. As part of a broader diagnosis of the reasons for the AU's opposition, this paper, while discussing armed conflicts in Africa, which provides the fillip for gross human rights violations in the region, exposes the contributions of the West. It concludes that an effective enforcement of international justice in the region must include an inquiry into the role of international actors and Western powers in promoting and exacerbating the situation.

Africa has been ravaged by armed conflicts and/or oppressive regimes for decades. During those conflicts or oppressive regimes, heinous crimes such as genocide, war crimes and crimes against humanity have been committed and made millions of victims. Among these, only a handful number saw some justice. This was possible essentially because the international community took a vigorous stance against the impunity of war criminals and genocidaires by creating international judicial mechanisms, such as the International Criminal Court (ICC), to deal with it. Also, some individual African States have prosecuted international crimes within their municipal courts as well as some western States based on the universal jurisdiction principle. This article analyses the African contribution to the building of the international criminal justice system. It also addresses the African objections against the ICC intervention in Africa and the use of the universal jurisdiction criticized as a form of imperialism and neo-colonialism disguised in a judicial form. It concludes by exploring the feasibility of an African Criminal Court.

Professor Henry Steiner et al in the book International Human Rights in Context: Law, Politics, Morals: Texts and Materials described the African System as the “newest, least developed or effective.....most distinctive and most controversial”. However the African Charter on Human and Peoples' Rights even though in its infancy has managed to be an effective international human rights instrument according to the findings of the study conducted by Professor Obiora Okafor in his book The African Human Rights System, Activist Forces And International Institutions. The book is a testamentary evidence of some of the achievements of this system through the African Charter on Human and Peoples' Rights. The African continent is faced with a number of regional obstacles but Okafor has contributed his well researched work to scholarship by documenting some of the critical issues in the area of international human rights which cannot be found anywhere else. The book can also serve as casebook on African.

Abstract:
Over the past several years, Americans have become more aware and more vocal regarding the number of illegal aliens who have taken up residence in the United States. While this issue—and a resolution of this issue—is still being debated, many have questioned why current enforcement efforts are so lax. The focus of this paper is on the government agency responsible for the enforcement of our immigration laws, and in particular how the actions of this agency are influenced by political interests. This paper fills a gap in the literature-to-date by examining the enforcement of immigration laws within the interior of the nation. While other studies put border enforcement efforts in a political framework, this analysis is the first, to the authors' knowledge, to place interior enforcement within the interest-group theory of government framework. Our findings indicate that pressure groups shape the pattern of enforcement that emerges. Despite polls that indicate a majority of Americans favoring stricter enforcement, government enforcement agencies charged with this responsibility apparently succumb to the wishes of those that matter most politically.

In this paper we compare insurance regulatory frameworks in the United States (US) and European Union (EU), focusing primarily on solvency, but also considering product and price regulation, as well as other elements of consumer protection. This comparison highlights the use of more fluid and principles-based approaches in the EU as it is developing under Solvency II, while the US continues to focus essentially on static, rules-based regulation. The discussion further notes evidence suggesting that the EU approach is more successful in promoting a financially solid insurance sector.

50407. Keys to Economics of Global Warming: A Critique of the Dismal Theorem

M. L. Weitzman in his paper "On Modeling and Interpreting the Economics of Catastrophic Climate Change" argues that a standard cost-benefit analysis cannot be used as a tool for climate change policy since the problem of climate change possesses a large irresolvable uncertainty. I critique his analysis on two grounds: 1) key issues in the economics of global warming and 2) the claim on catastrophe. I point out that the fundamental economics of global warming is to provide a public good that is spatially global and temporally lasting, for several centuries, by a globally coordinated effort. The fundamental issue is how to cooperate on a global scale to regulate greenhouse gases given the divergent needs and preferences of individuals, businesses, countries, and even future generations. I argue that Weitzman misinterprets climate science by assuming that all scenarios are equally likely and that there will be no policy intervention to control greenhouse gases. In addition, he focuses on long-term climate predictions. Finally, impact studies do not support catastrophic outcomes from climate change within this century.

50408. A Report on the Patrol Special Police and Community Safety in San Francisco

This paper provides an analysis of one of the longest established private police groups in America, the San Francisco Patrol Special Police (PSP). Dating back to the days of the Gold Rush, the PSP are a collection of independent companies that the city charter authorizes to patrol different neighborhoods at the request of private clients. A survey was conducted to investigate why private parties pay the PSP rather than simply relying on government police. The results indicate that the PSP play an important role in providing safety that citizens cannot obtain if they rely solely on the San Francisco Police Department's safety services. However, despite these evident benefits, the PSP face some challenging political and regulatory obstacles. This article finds evidence that members of the San Francisco Police Department (SFPD) have been using regulations to restrict competition and effectively take over business using the force of law. This report documents some of the expenses these practices cost taxpayers and offers some suggestions for regulatory reform.

India is currently the top place of origin international students studying at U.S. colleges and universities. Over the past decade, the number of Indian students in the U.S. has increased more than 175 percent, from just under 37,500 students in 1998/99 to over 103,000 in 2008/09. India has, in fact, been the leading place of origin since 2001/02, when it surpassed China. Since 2007/08, students from India have comprised over 15% of all international students in the United States.

A key contention of the transitional justice movement is that the more comprehensive and vigorous the effort to bring justice to a departed authoritarian regime the better the democratizing outcome will be. This essay challenges this view with empirical evidence from the Iberian Peninsula. In Portugal, a sweeping policy of purges intended to cleanse the state and society of the authoritarian past nearly derailed the transition to democracy by descending into a veritable witch-hunt. In Spain, by contrast, letting bygones be bygones, became a foundation for democratic consolidation. These counter-intuitive examples suggest that there is no pre-ordained outcome to transitional justice, and that confronting an evil past is neither a requirement nor a pre-condition for democratization. This is primarily because the principal factors driving the impulse toward justice against the old regime are political rather than ethical or moral. In Portugal, the rise of transitional justice mirrored the anarchic politics of the revolution that lunched the transition to democracy. In Spain, the absence of transitional justice reflected the pragmatism of a democratic transition anchored on compromise and consensus.

The economic crisis of 2008–09 is the second major crisis in just over a decade that Asia has endured. Unlike the Asian crisis of 1997–98, however, the current crisis originated mainly in the West. Asia's excessive reliance on net exports as the principal driver of economic growth since the 1997–98 crisis rendered it especially vulnerable to external shocks, and most Asian countries have paid dearly. The more open the economy, the more vulnerable it is to such shocks. The newly industrialized Asian economies (Singapore, Hong Kong, South Korea, and Taiwan), which are among the most open and dynamic in the world, are expected to contract by about 6 percent in 2009.

This study finds that North Korea's nuclear test and the imposition of UN Security Council sanctions have had no perceptible effect on trade with its two largest partners, China and South Korea. Before North Korea conducted an underground nuclear test, it was widely believed that such an event would have cataclysmic diplomatic ramifications. However, beginning with visual inspection of data and ending with time-series models, no evidence is found to support the notion that these events have had any effect on North Korea's trade with its two principal partners.

Beginning in 1949, China considered, and dealt with, so-called Uyghur separatism and the quest for Eastern Turkestan (Xinjiang) independence as a domestic problem. Since the early 1990s, however, Beijing has begun to recognize the international aspects of this problem and to deal with its external manifestations. This new policy has affected China's relations with Turkey, which has ideologically inspired Uyghur nationalism, offered sanctuary to Uyghur refugees, and provided moral and material support to Eastern Turkestan movements, organizations, and activities.

Vietnam is among the countries worst affected by the adverse effects of climate change, especially in coastal and low-land regions. Already an average of one million Vietnamese are affected annually by disasters including flooding in the Mekong Delta region. Abstract:
Recent reforms of the Association of Southeast Asian Nations (ASEAN) are viewed by liberal institutionalists and constructivists as triggering a fundamental transformation of the ASEAN Way, the embodiment of the association's established, strictly intergovernmental cooperation norms. This article questions such reasoning, if it is causally linked to expectations of a greater deepening of ASEAN cooperation. Based on recent rationalist theorizing and Snyder's 'nationalist elite persuasion' hypothesis, the article argues that the causal relationships between democracy and regional integration are more complex than assumed in Eurocentric integration theories. By examining foreign policy debates in the Indonesian legislature, the article shows that foreign policymaking has become much more democratic and pluralistic since the end of President Suharto's New Order regime. However, as case studies of foreign policy issues suggest, democratic norms have often been localized by a neo-nationalist agenda that hamstrings the deepening of regional integration.

The increasingly multi-faceted engagement of China in Africa is part of China's growing global reach. Chinese diplomats strive to promote an image of a peacefully rising power, whereas Chinese businessmen seek natural resources and export markets. As a result, those responsible for Chinese foreign policy strategic thinking struggle to accommodate the needs of this diverse group of actors in Africa, well aware that as a major power, Beijing is expected to address international crisis. In Washington and Brussels, China is criticized for its support of despotic African regimes and its aid programs 'with no strings attached'. In Sudan, in particular, China's credibility as a responsible nation is questioned. This article provides a concise overview of China's evolving diplomacy toward Africa, highlighting the Sino-Sudan relationship, with the aim of shedding light on the drivers and constraints on Beijing's motives and actions on the African continent. The article assesses some of the implications of Beijing's policy choices in Africa for its international relations.

China has become Taiwan's most important export and investment destination. This phenomenon is puzzling to realism as concerns for security externalities should discourage commerce between adversaries. Liberalism also has difficulty in accounting for this phenomenon because an absence of facilitative institutions should discourage commerce across the Taiwan Strait. This paper applies recent theoretical development on credible communication to this seemingly baffling situation. Whereas it has been suggested that commercial ties enable states to signal resolve short of military demonstration, I argue that these ties can also be used to credibly communicate reassurance and commitment to peaceful cooperation.

China–Japan relations are frequently analyzed either in the light of disputes about different interpretations of history, the consequence of a strategic power shift in the Asia-Pacific resulting from the rise of China or as a conflict between Chinese and Japanese national identities. This paper argues that bilateral relations should be assessed on the basis of a comprehensive approach. It concludes that the current state of bilateral relations can be understood as the result of identity crises of the political systems in Beijing and Tokyo. Owing to the rapidly changing environment in East Asia and their inherent conservative natures, both political systems' perceptions and policies lag behind present realities. This renders it difficult for them to effectively address important domestic and international problems and consequently affects bilateral relations negatively as it complicates the accurate redefinition of the representation of 'self' and 'other' with regard to foreign relations.

In contemporary East Asia, political rivalry between China and Japan is often discussed. However, little has been done to systematically analyze the bilateral relationship and possible conflict escalation. In this paper, I employ the multiple-hierarchy model of regional politics offered by power transition theorists, in order to examine the recent Sino– Japanese relationship. After examining the effect of the factors suggested by the theory, I conclude that China's rise does not pose immediate destabilizing effects on regional security because the relative rise of China's capability is at best moderate. I also argue that the dyadic relationship has been pacified by several factors such as interest similarity and defense-dominant geography, in spite of China's overall rise. Finally, I offer some policy recommendations suggested by the theory-driven analysis.

It is rather commonplace to compare Japan and Germany in daily life. Both the countries are economic powers and had similar historical developments in the twentieth century. However, it is rather difficult to draw successful academic comparisons between Japan and Germany. Sorry States is certainly one of the rare comparative analyses of the two countries. This book highlights the remembrance and reconciliation in modern international relations. Japan's unapologetic remembrance of its history and the Korean distrust of Japan are in contrast to (West) Germany's often-praised contrition and reconciliation with France.

After Political Culture in Asia and Europe (2006), this is the second volume by these authors exploring the results of a survey conducted in 18 countries of Western Europe and East and Southeast Asia in the year 2000. Examining the views of approximately 1,000 respondents in each country, they use factor analysis to group countries according to their citizens' perceptions of the state. In particular, they scrutinize the respondents' identification with the nation-state, support for political and administrative authorities, and satisfaction with life. Based on factor loadings, they divide the countries into six types.

Bribery and corruption remain endemic problems in many countries, weakening governance and posing a major impediment to development. Anti-corruption hotlines provide a key channel for governments to receive complaints from individuals who have come into contact with or been victims of corruption. Increasingly, hotlines are being valued as a channel for citizen redress and as a barometer of the success of government anti-corruption efforts. They provide for broad feedback to governments from civil society on how well policies and institutions are working, where breakdowns occur and where responses are needed. As a service, hotlines are similar to community audits and legal advice centres in offering a means to cross-check whether campaign pledges and government promises are producing results. In 1997, the member states of the Organisation for Economic Cooperation and Development (OECD) adopted the OECD Convention on Combating Bribery of Foreign Public Officials in International Business Transactions (the OECD Convention). The adoption of the Convention was a landmark event in the fight against international corruption representing a collective commitment to ban foreign bribery by the governments of the leading industrialised states - countries accounting for the majority of global exports and foreign investment. Because most major multinational companies are based in OECD Convention countries, the Convention was hailed as the key to overcoming the damaging effects of foreign bribery on democratic institutions, development programmes and business competition. The Convention now has 38 parties. It requires parties to make it an offence to “intentionally offer, promise or give any undue pecuniary or other advantage, whether directly or through intermediaries, to a foreign public official, for that official or for a third party, in order that the official act or refrain from acting in relation to the performance of official duties, in order to obtain or retain business or other improper advantage in the conduct of international business.”

At the 3 November 2009 SNL-LLNL-CSIS workshop, participants identified a number of key technical challenges and opportunities associated with Congress and the Obama Administration's new U.S. nuclear agenda. One of the main factors that led directly to the present status quo in Cyprus tends to be forgotten. This was the extraordinary display of timidity on the part of Great Britain in the 1960s when confronted with determined Greek Cypriot attempts to make Cyprus Greek. And, needless to say, the subsequent forceful division of the island by Turkey in 1974 should always be seen in this earlier context: not, that is, as some kind of unforeseeable interruption in the island's natural and peaceful progression towards its Hellenic 'redemption'; least of all as the result of a brutal and arbitrary interference in a sovereign state on the part of a 'foreign power', both of which notions still circulate among many Greeks and their political sympathisers.

This Note focuses on the relationship between L-20 ( L for Leaders) or G-20 type meetings and more formal reforms , particularly of the IMF. It should NOT be read as a proposed agenda for the April meeting of the L-20+, but as an input into the agenda of global reform that constitutes the context of the London and other international meetings. I do believe that given the massive and immediate threat posed by the unfolding worldwide economic crisis, the April meeting should focus on (i) the global size and coordination of the fiscal stimulus and macroeconomic policies worldwide (ii) immediate coordination as needed in the dramatic actions required with regard to the banking system in many major economies and, (iii) financial support to the developing countries experiencing a massive decline in export revenues, capital flows and remittances. The London meeting will be the first and very important start of a series of meetings in 2009, including the Spring and Fall meetings of the IMF/World Bank, which constitute an opportunity to build a global economic governance system that can manage the recovery from the current crisis, build globally coordinated financial sector regulation and reflect the realities of the 21st century.

The question of Iran “ going nuclear” is of global concern. Iran has up to now used devious methods to violate the Non-Proliferation Treaty and has indeed misled the world community. The Obama Administration is concerned about these developments as much as the previous Bush Administration was. However, President Obama's approach to nuclear weapons in general and talks with Iran have been different both in essence and form. Another matter of concern has been the attitude of Israel and the manner in which the US has tried to handle the Israeli dossier towards Iran. The October 1st negotiations with Iran have been considered constructive by the West. These negotiations will take time and probably prove to be difficult. Turkey's attitude towards a “nuclear” Iran seems to be ambivalent in recent times, whereby while Turkey does not want a nuclear Iran, it seems to be pointing a finger to nuclear Israel.

For many years successive governments in Turkey have ignored an even denied the existence of Kurds in Turkey. What would have been possible in the past by recognizing cultural rights has now been a problem whereby an operation seems to be needed. Two common and important mistakes of governments: one is to say Kurds are primary citizens of this country as if there are secondary citizens! The second is “end the terror and we will recognize some rights”. Basic rights cannot be negotiated. This second mistake has led Öcalan to announce his own road map paralel to the Governments. Negotiating with hostile entities is very difficult and needs public consensus. Turkey, unlike Britain and Spain does not have public consensus. The best way was and is to follow EU's democratisation road map.

This article explores the actual and potential effects of recent European legal judgments on ongoing reunification negotiations in Cyprus. In particular, we argue that the European Union's failure to formulate a policy regarding the position of Turkish Cypriots in Europe has had increasingly negative consequences both for negotiations between the island's leaders and for relations between the Turkish Cypriot and Greek Cypriot communities. The EU has chosen to ignore the suspension of constitutional order in the Republic of Cyprus, in the process refusing to acknowledge the legal and political effects of the RoC's EU entry on Turkish Cypriots. We use a recent European Court of Justice judgment to illustrate the substantive effects of this hands-off approach, showing how the political use of transnational courts threatens to undermine what many have called the island's “last chance” at reunification.
