54441. Beyond Rule of Law Orthodoxy: The Legal Empowerment Alternative

Abstract:
The international aid field of law and development focuses too much on law, lawyers, and state institutions, and too little on development, the poor, and civil society. In fact, it is doubtful whether “rule of law orthodoxy,” the dominant paradigm pursued by many international agencies, should be the central means for integrating law and development. As most prominently practiced by multilateral development banks, this “top-down,” state-centered approach concentrates on law reform and government institutions, particularly judiciaries, to build business-friendly legal systems that presumably spur poverty alleviation. Other development organizations use the rule of law (ROL) orthodoxy's state-centered approach to promote such additional goals as good governance and public safety. The problems with the paradigm are not these economic and political goals, per se, but rather its questionable assumptions, unproven impact, and insufficient attention to the legal needs of the disadvantaged.

ATTENTION TO TRADE-RELATED TECHNICAL ASSISTANCE and capacity building (TCB) has surged as people from all walks of life explore how the global trade regime can be structured to better promote equitable, sustainable human development. TCB strengthens developing countries' human, physical, and institutional capacities to participate in trade negotiations, implement trade commitments, and benefit from integration into the global trading system. Given the Bush administration's goal to “ignite a new era of global economic growth through free markets and free trade,” capacity building has become an important component of U.S. bilateral, regional, and multilateral trade negotiations.

Although a policy of coercive regime change has been applied in Iraq, in most of the region the administration is pursuing a more gradualist model of political change that emphasizes diplomatic pressure and democracy-related aid.

Abstract:
This chapter examines North Korea's plutonium infrastructure and production capabilities, as well as how a freeze over that capability might be reconstituted and verified if an agreement to do so can be reached. The chapter, which also discusses several issues related to the possible final elimination of North Korea's nuclear capability—a stated goal of U.S. policy—does not prejudge what form a freeze might take, how it might be negotiated, or by what bodies it might be implemented. This chapter is meant to provide a broad view of what hurdles anyone trying to reestablish a freeze might encounter and what uncertainties might remain under such a freeze.

Abstract:
No American administration has talked more about democracy in the Middle East than the Bush administration. The president and his advisors have spoken optimistically about a post-Saddam democracy in Iraq, one that might eventually become a veritable light to other Arab nations. This grand vision assumes that sooner or later, advocates of democracy throughout the Middle East will demand the same freedoms and rights that Iraqis are now claiming. Yet, however inspiring this vision appears, the actual reform plan that the administration has thus far set out is unlikely to produce radical changes in the Arab world. Regardless of how dramatic the change in Baghdad is, when it comes to our friends in Egypt, Jordan, Kuwait, Morocco, and Yemen, the administration's reform plan points to evolution rather than revolution.

Abstract:
A diverse group of development and trade liberalization advocates agree that reduction of agricultural protection and subsidization in the world's wealthy countries is necessary to strengthen both international growth opportunities and the global trade regime. According to the consensus reached among participants attending a conference cosponsored by the Carnegie Endowment for International Peace and the Cordell Hull Institute, WTO Doha Round negotiations on agriculture should compel policy changes in industrialized countries to limit trade-distorting domestic subsidies for agricultural products, lower tariffs, increase market access, and eliminate export subsidies. In response to temporary hardships caused by an overall reduction in agriculture support, governments should have the flexibility to adopt temporary or limited domestic, and perhaps international, compensatory policies. Significant differences in perspective and policy prescriptions were expressed by conference participants about the appropriate speed and scope of agricultural liberalization in developing countries, especially if progress is not made toward reduced support for agriculture in developed countries.

Since early last year, the Bush administration has paid unaccustomed attention to the issue of democracy in the Middle East. Following September 11, many U. S. officials have worried that the authoritarianism of most Arab regimes has bred frustration in their countries, and this frustration has in turn favored the growth of terrorist organizations. U.S. discussions about the need for democracy in the Middle East have triggered a strong negative reaction by Arab commentators and journalists, including in discussions of democracy in the Arab press. However, very little of this writing has dealt with the problem of democracy in the real sense—that is, with the issue of how Arab governments relate to their citizens now and how they should relate to their citizens in the future. Instead, Arab commentators have treated democracy as a foreign policy issue, asking why the United States is suddenly discussing democracy in the Arab world and what true intentions it is trying to hide behind the smoke screen of democracy talk. The debate in the Arab press reveals some of the obstacles that the United States faces as it attempts to define its new pro-democracy role in the Middle East.

Abstract:
Although the current rule-of-law promotion field is still expanding as it approaches the end of its second decade, it still faces a lack of knowledge at many levels of conception, operation, and evaluation. There is a surprising amount of uncertainty, for example, about the twin rationales of rule-of-law promotion—that promoting the rule of law will contribute to economic development and democratization. There is also uncertainty about what the essence of the rule of law actually is—whether it primarily resides in certain institutional configurations or in more diffuse normative structures. Rule-of-law promoters are also short of knowledge about how the rule of law develops in societies and how such development can be stimulated beyond simplistic efforts to copy institutional forms. And the question of what kinds of larger societal effects will result from specific changes in rule-of-law institutions is also still open. Although aid institutions engaged in rule-of-law assistance do attempt some—lessons learned—exercises, many of the lessons produced are superficial and even those are often not really learned. Several substantial obstacles to greater knowledge accumulation in this field persist, including the complexity of the task of promoting the rule of law, the particularity of legal systems, the unwillingness of aid organizations to invest sufficient resources in evaluations, and the tendency of both academics and lawyers not to pursue systematic empirical research on rule-of-law aid programs. Whether rule-of-law aid is on the path to becoming a well-grounded field of international assistance remains uncertain.

American televisions are filled with war rooms, countdowns, deadlines, and showdowns with Iraq. The almost minute by minute coverage distorts public understanding of how inspections work and creates a false sense of the inevitability of war. No decision has in fact been made. Within the administration some indeed intend the buildup as the prelude to war while for others it presents the credible threat of war that is necessary to compel Iraq's disarmament through inspections.

The failure of past foreign aid programs has given rise to a new consensus on how to make foreign aid effective. According to the new approach, aid that goes into poor countries that have good policies and institutions is highly effective at promoting growth and reducing poverty. Disbursing aid to countries that have good policies contrasts with the traditional practice of providing aid to countries irrespective of the quality of their policies or providing aid to promote policy reforms. President George Bush's proposed foreign aid initiative, the Millennium Challenge Account, is based on the selective approach to foreign assistance, as are, in large part, the World Bank's calls to double foreign aid flows worldwide.

The International Monetary Fund has proposed a universal bankruptcy tribunal to deal with sovereign debt restructuring. But does the international financial system really need such a mechanism? There has been little demand by sovereign borrowers or their creditors for a universal bankruptcy law, and few countries have had to enter into debt restructuring procedures. The absence of such a law does not appear to have created chaotic conditions even in those cases.

China's economy is four times the size of Taiwan's and apparently growing at a faster rate; that economic disparity between China and Taiwan could eventually lead to a military disparity as well. Nonetheless, even an informal U.S. security guarantee for Taiwan against nuclear-armed China is ill-advised. Taiwan is not strategically essential to America's national security. Moreover, China has significant incentives to avoid attacking Taiwan. Perhaps the most crucial is that hostile behavior toward Taiwan would jeopardize China's increasing economic linkage with the United States and other key countries.
