36521. Renewed Non-discrimination and Equality Promises for National Minorities in Europe

Abstract:
One of the founding principles of the European Union is the recognition that every individual is of equal value. On top of this, the 2000 Race Directive reaffirms the principle of equal treatment between persons irrespective of racial or ethnic origin. Discrimination and inequality are nevertheless still major problems for vulnerable ethnic and national minorities in Europe, as the results of the most recent EU MIDI-survey describes. Bearing in mind the principle of equality, it is not surprising that two new equality concepts arrived at the Council of Europe and EU level in the last years: 'The new commitment to equality and non-discrimination' and 'full and effective equality.' In a communication Note from July 2008, the European Commission expressed its desire for this 'renewed commitment to non-discrimination and equal opportunity,' which proposes a shift from formal equality to a more substantive equality approach. In this paper, we will consider whether this statement is an exemplary expression of an assumed development in the EU, namely that of broadening and strengthening equality and non-discrimination legislation and, furthermore, whether a possible development from formal to substantive equality is also effectively taking place. We analysed whether this trend is only visible in the European Commission or also present within other players in the non-discrimination and equality field. We then sought to understand whether this trend is visible in theory as well as practice. This paper furthermore analyzes whether this trend enlarges the protection scope against discrimination for national minorities, or if this equality manifestation truly supports national minorities to be recognized as equals with the majority.

The European Union's (EU) strategy for recovery from the economic crisis that began at the end of the first decade of the 2000s is organized around three priorities: smart growth, sustainable growth, and inclusive growth (European Commission 2010: 9). While the three types of growth are presented as mutually reinforcing, explicit attention to minorities in general and to Roma in particular comes only under the heading of inclusive growth, defined as "empowering people through high levels of employment, investing in skills, fighting poverty and modernising labour markets, training and social protection systems so as to help people anticipate and manage change, and build a cohesive society" (European Commission 2010: 17). As part of the "European Platform against Poverty" planned in the area of inclusive growth, the European Commission (EC) calls on Member States "[t]o define and implement measures addressing the specific circumstances of groups at particular risk (such as one-parentamilies, elderly women, minorities, Roma, people with a disability and the homeless" as a means of "rais[ing] awareness and recognis[ing] the fundamental rights of people experiencing poverty and social exclusion, enabling them to live in dignity and take an active part in society" (European Commission 2010: 19).

At the 17 th Conference of the States Parties to the Chemical Weapons Convention (CWC) held in November 2012, the subject generating the most debate concerned the place of non-governmental organisations (NGOs) in CWC meetings and whether their role should be rather passive (i.e. 'attend') or be characterised by more active involvement (i.e. 'participate'). The latter option would allow them to address States Parties at meetings or organise side events within (rather than outside) the conference building. Addressing one of the core functions of the disarmament treaty, Libya, Russia and the United States reported in detail on progress and issues affecting the destruction of their respective chemical weapon (CW) stockpiles. Despite the fact that all three countries had missed the ultimate destruction deadline of April 2012, no state raised its flag to comment, question or protest about the delays. When the negotiators of the CWC concluded their business in September 1992 and decided to forward the treaty text to the UN General Assembly (UNGA) for assent, missing the destruction deadlines was universally viewed as one of the worst possible breaches of the CWC. In practice, a robust verification regime combined with permanent in - formation sharing, voluntary transparency beyond the requirements in the Convention, and dialogue over the years yielded commonly approved decisions to extend the destruction deadlines with strict monitoring and reporting requirements. Confident that the holders of the three largest declared CW stockpiles have no malicious intent, States Parties can continue with the implementation of all dimensions of the CWC without recriminations or deadlock.

The People's Republic of China has long been a very visible actor in international politics. With 1.4 billion inhabitants, it is the most populous country in the world, with a land mass of 9.6 million square kilometers bordering 14 states in East, South, and Central Asia. China has a long Pacific coastline, along which it claims vast areas of the South China Sea. A nuclear power since 1964, the People's Republic of China has the largest armed forces in the world, numbering approximately 2.3 million soldiers. China has been a permanent member of the UN Security Council since 1971; for many years, it has figured prominently in all decision making processes with global impact.

The U.S. government interferes with the market for foreign laborers by restricting the number and mix of immigrants and setting tight quantitative limits on foreign-born guest workers. This has created a mismatch between the demand for foreign workers from U.S. businesses and their supply, directly leading to the illegal immigration situation we confront today. The current system inefficiently limits the gains that our economy could achieve from employing larger numbers of foreign workers, and it disproportionately harms small U.S. businesses. The economic fears associated with increased guest workers or immigrants are unfounded. The current Senate immigration reform proposal would be a marginal improvement but does not go far enough. Red Card, an alternative guest worker proposal, would better coordinate labor markets. Ultimately, an immigration market free from government limitations and interference would be the most efficient solution.

However, it is still too early to draw form conclusions on the outcomes of the transitional processes and remarkable challenges lay ahead for Southern Mediterranean countries. Economy, security, and social and political polarisation are among the most pressing priorities.

The conference organized jointly by the Finnish Institute of International Affairs, the Tampere Peace Research Institute and the EuroMeSCo research network sought to contextualize the on-going transition processes in the Arab world and to share Nordic experiences and models of democratic governance with countries in transition. To this end the conference considered the potential role of the “Nordic model” as a template and comparator for change in the Arab world and reflected on possible avenues of dialogue and cooperation between the Nordic and Arab countries. The conference also highlighted the need for greater attention and analysis of the problems and issues involved in regional transition processes amongst Nordic countries.

The regime of Bashar al-Assad in Syria has been demonstrating a relatively high level of tenacity amid the proxy war raging in the country for over two years now. Indeed, the authoritarian regime in Tunisia folded up in two weeks; the Mubarak regime in Egypt, in slightly over four weeks; the Colonel Qaddafi regime collapsed after six months of NATO strikes. Russian expert Prof. Edouard Ozhiganov has offered a methodologically exact comment: “Any political regime can be described as stable to the extent to which it can neutralize inside and outside pressure using its own resources and instruments.”

Teaching America’s military history is an important civic duty because “We the People” are responsible for the common defense and therefore should know something about it. At the Foreign Policy Research Institute (FPRI), we encourage teachers to integrate military history into the history that they already teach, and we think they can do so without personal military experience, just as they teach about so many other aspects of American life. Starting in 2006, FPRI teamed up with the First Division Museum at Cantigny to offer the first Teaching Military History Institute for Teachers. This history institute series built upon and expanded the proven FPRI model that has been in operation since 1992. The concept is simple: assemble an audience of dedicated secondary school teachers, bring in first tier scholars of varied perspectives to address them on substantive military topics, and stimulate their interaction over a weekend at the world class setting of the First Division Museum. Omitted are the pedagogical lessons that can be learned back at one’s school. Teachers earn continuing education credits for attendance and are encouraged to develop lesson plans to incorporate knowledge from these weekends into their teaching. Since 2006, nearly 300 teachers have gone through one or more of these Institutes. This volume is a selection of materials presented at the eight Teaching Military History Institutes held since 2006. This e-book can be used as a resource by teachers, students, and the public to expand their understanding of how the U.S. military has helped to shape American history—not only on the battlefield but also socially, politically, economically, and technologically. We believe that our common defense will be better if the public is familiar with our military history. We hope that users and readers will enjoy this collection and use it to further that purpose.

36534. 21st Century Cultures of War: Advantage Them

In the inaugural launch of the FPRI’s new e-publication, The Philadelphia Papers, the anthropologist Anna Simons of the Defense Analysis department at the Naval Postgraduate School, and member of the Orbis Board of Editors, provocatively assesses cultures of war in the 21st century. She cautions that while the United States military increasingly dazzles in the technological realm, we remain at a marked disadvantage when it comes to social relations, chronically underestimating the sophistication of adversaries and allies in the (non-East Asian) non-West. This asymmetry, to include who is willing to do what to whom, puts our soldiers, diplomats, and intelligence communities at a distinct disadvantage. She argues that the U.S. needs to take this into account as it rethinks how to wage war, never mind whether to become involved in the kinds of ambiguous political-military conflicts we have engaged in over the past decade. Indeed, without a greater appreciation for the social and anti-social skills of likely future adversaries, current problems plaguing our military -– from PTSD through questionable generalship -- will only worsen over time.

Few observers foresaw the Arab Spring, but it should not have surprised anyone that the Islamist movements - the most organized movements in the Arab world - became the main beneficiaries of the turmoil that ensued. Islamism, in its gradualist and pragmatic approach embodied by the Muslim Brotherhood and its offshoots worldwide, seems ready to reap the rewards of its three decades-old decision to abandon violence and focus on grassroots activities. This monumental change has created many concerns among liberals, religious minorities and, more generally, all non-Islamists in the countries where Islamists have won. In addition, Arab states ruled by non-Islamist regimes have expressed concern. The former worry that Islamist ideology - even in its more contemporary, pragmatic form - remains deeply divisive and anti-democratic, often at odds with their values and interests. The latter believe that on foreign policy issues, most of the positions of various Brotherhood-inspired parties are on a collision course with the policies of established regimes in the region.

The United Nations produced the Millennium Declaration in September 2000, recognizing a collective responsibility to work toward “a more peaceful, prosperous and just world.” The eight Millennium Development Goals (MDGs) reaffirmed this vision and launched an ambitious global partnership for development. The MDGs set specific targets for 2015, using numerical indicators to measure progress. The United Nations is now formulating post-2015 goals to succeed the current MDGs. Wehrey investigates the roots of the Shi'a-Sunni divide now dominating the Persian Gulf's political landscape. Middle East experts, scholars, and laymen were equally caught off guard by the startling political upheaval that rippled through the Arab world like a contagious disease in early 2011. While the situation is still in flux and one cannot draw conclusions as to what will ultimately emerge, the unexpected nature of these Arab uprisings has certainly provoked debate around some of the existing assumptions about the domestic politics of the region. Over the years, a robust body of scholarship has developed focusing on the durability of authoritarian rule in the Middle East, and the remarkable resilience of the regimes in power. Much of this analysis has been based on the rigorous study of the patterns of socio-political behavior in the Middle East, both at the regional level of analysis as well as that of individual states, and, in particular, on the carefully crafted “ruling bargains” between regimes and their citizens.
