Abstract:
This article examines the use of scholarship by the WTO Appellate Body. While it is not possible to say definitively how the Appellate Body views the legal status of scholarship in WTO dispute settlement, its use of scholarship will in practice determine its status. The article identifies three overall trends: the Appellate Body’s use of scholarship has declined, the Appellate Body uses scholarship mostly for matters of general international law (as opposed to WTO law), and the Appellate body has generally been careful in its use of scholarship. Possible explanations for these trends may include an increase in available precedents, the Appellate Body’s specialized role, criticism of the Appellate Body, and its members’ backgrounds.

Abstract:
Although the Arms Trade Treaty (ATT) has the potential to create an effective international legal framework for controlling the international arms trade, much depends on the subsequent development of its legal framework. This article therefore analyzes how the ATT, as a multilateral arms control treaty, can develop its own legal framework in accordance with international law and what role the organs established by it can play in that process. It will be shown that in its current form the ATT has significant shortcomings that may prevent it from achieving this goal, but there certainly is room for the lawful development of its norms, which will depend on amassing political will and the establishment of practice.

Abstract:
Illegal fishing in the Exclusive Economic Zones [EEZs] of developing coastal States is an urgent problem for the marine environment, global food security, and local economies. While past academic debate has predominantly focused on obligations of flag States to tackle so called IUU-fishing in the High Seas, the recent request for an advisory opinion submitted by the Sub-Regional Fisheries Commission to the International Tribunal for the Law of the Sea (ITLOS, Case No. 21) has drawn attention to the fisheries regime of the EEZ. This article argues that the primary responsibility for fisheries management in the EEZ rests on the coastal State and that, so far, flag States have no obligation under customary international law to exercise their jurisdiction and control over vessels flying their flag which fish in the EEZ of other States. The article first gives an account of coastal State regulatory and enforcement jurisdiction. It outlines recent developments of the law by drawing on the jurisprudence of the ITLOS, particularly the recent M/V “Virginia G” Case. Further, the article undertakes to identify potential flag State obligations to combat illegal fishing in the EEZ. To that end, it provides an in-depth analysis of relevant binding and non-binding legal instruments such as the 1982 UN Convention on the Law of the Sea, other multilateral treaties, bilateral fisheries treaties, and relevant soft-law instruments of the Food and Agriculture Organization of the United Nations. The article also discusses the relevance of principles of international environmental law. Next, the article analyzes the nature and scope of potential flag State obligations, qualifying them as obligations of due diligence. Finally, the article concludes that, de lege lata, no persuasive evidence of established flag State obligations exists. The author suggests that the situation should be remedied by a new, fully binding legal instrument.

Abstract:
Nuclear agreement between Iran and the P5+1 Group become a reality at the beginning of 2016, with the Iranian engagement on declaration and reduction of her nuclear capabilities, for a temporary period. Parallel to the agreement accomplishment, Iran has increased her power towards her geopolitical enlargement area in the Mesopotamia and Levant region. Iran´s resurgence has caused a conventional weapons´ proliferation, where ballistic missiles are the main stress´s source. At international level, Iran has achieved better business opportunities, although her economic evolution is still slow, mainly due internal power´s dynamics. At global order level, the agreement has brought main actors power´s redesign in Middle East and other global areas. Inside Iran, the agreement has reinforced institutional authority and at the same time it is opening up the way for hope and for a better future for the Iranian people.

Abstract:
A paradox in the study of violent radicalization is that while each of the empirical findings can be explained with multiple theories, very few theories can explain a relevant number of these findings simultaneously. This paper conducts a functional behavior assessment of violent radical behavior, investigating the factors responsible for its initial learning and subsequent maintenance. Specifically, a model of radicalization is proposed that can explain a wide range of observed phenomena, accommodate apparent exceptions, and obtain testable consequences. It also challenges some firmly rooted ideas, as the alleged existence of aggressive influence practices, or brainwashing. Finally, the model can also provide valuable predictions for subsequent research, such as those related to the reversibility of the process of radicalization.

In her opening statement at the United Nations (UN) High-Level Thematic Debate on Peace and Security, Nobel Peace laureate Leymah Gbowee used this definition to describe challenges faced by UN engagements in peace operations and peacebuilding. The 10-11 May meeting, called by the president of the UN General Assembly (UNGA) and themed In a world in risks: a new commitment for peace, provided a platform to reflect on current challenges to international peace and security. These focused, in particular, on responses to the 2015 reviews on peace operations, peacebuilding, and women, peace and security.

We all know that the UN secretariat has been walking on eggs with this issue of intelligence for years; doing it without saying it and without realizing it. But with peace operations involved in increasing complex and demanding situations and one senses that this “fog about intelligence” can no longer be sustainable. This report complements other earlier attempts to “demystify” that charged term of intelligence and to define what “intelligence” means in the UN context and its peace operations.

The renewed crisis in South Sudan is turning into a decisive test for the United Nations. There is a growing international outcry over reports that local forces raped and killed civilians almost in front of UN peacekeepers. The Security Council has struggled to persuade the South Sudanese government to accept the deployment of an additional 4,000 troops with a robust mandate to stabilize the capital, Juba. Having initially rejected the proposal, which has strong African support, President Salva Kiir now seems willing to at least consider the reinforcements. There are tensions in the Security Council over how to handle Kiir: the U.S. wants a tough line, but China and Russia insist on respect for that South Sudan’s sovereignty. Kiir and his advisers profoundly distrust the UN. According to a leaked South Sudanese document they believe that “The UN Secretary General [Ban Ki Moon] has constantly advanced negative views against the Government of the Republic of South Sudan and its leadership,” and even pursued a “regime change strategy.” This is unjust. A few outside analysts have advanced ambitious and probably unworkable plans to turn South Sudan into an international protectorate on the Kosovo model. But the UN is largely struggling to stay on top of the crisis and get aid to the suffering, rather than plotting to overthrow Kiir.

28351. The Challenges of Full Deployment of UN Peace Operations

he UN has always had problems deploying its largest, infantry-heavy missions. The 2015 Leaders’ Summit on Peacekeeping and this week’s 2016 UN Peacekeeping Defence Ministerial in London are Member State driven initiatives to do better. Broader participation in contributing to missions is a key part of rapid deployment as well as reaching full strength. A Global Peace Operations Review analysis of data from UN peacekeeping operations over the last 25 years indicates that modern UN peacekeeping missions, on average, take just over ten months to reach their peak deployment. In Africa, where countries on the continent are often left to the take the lead, average time to deploy is worse -- almost twelve months to reach peak deployment. In fact, the average non-African mission in our analysis reached peak deployment in less than seven months, the fastest of any grouping.

or years, the UN Secretariat said caveats were not allowed in peacekeeping operations. Mentioning them was a kind of “taboo”. They existed on the ground but were rarely acknowledged at the political level in New York. But when operations faced a crisis and troops needed to take more risks than usual, the hitherto hidden restrictions quickly appeared, creating obvious command and control issues. Unfortunately, with peacekeeping operations now facing increasingly challenging environments, contingents refusing to follow orders, or waiting for their national authorities to confirm or countermand orders received from the UN mission’s authorities, has become the norm rather than the exception. Should we condemn this or understand the reasons why UN missions are facing such situations? It is time to stop lamenting that caveats exist and try to better learn how to manage them.

28353. Challenges for Human Rights Sections of UN Peace Operations

When António Guterres succeeds Ban Ki-moon as UN Secretary-General, many problems will be waiting for him, including challenges to the fundamental values underpinning UN peacekeeping. Uncooperative host governments and shifting conflict environments, including asymmetrical threats and violent extremism, are testing blue helmets on the ground. Recent adaptations of peacekeeping practice are also bringing into question the role of civilian components in UN peace operations, notably the human rights sections. The growing use of offensive mandates to quash negative forces and ensure protection of civilians has sometimes made the UN a party to the conflict and has cast doubt on the civilian staff’s protection under international humanitarian law. Recommendations by the High-level Independent Panel on Peace Operations (HIPPO) on the primacy of politics also bring into question the principles of impartiality and transparency that lie at the core of credible human rights monitoring. How can UN peace operations ensure robust protection of civilians and broker political solutions while maintaining a transparent and impartial human rights agenda? At its conception, peacekeeping was formed around three core tenets, often referred to as the ‘principles of peacekeeping’. These included the requirement of consent from the parties, impartiality and non-use of force, except in self-defense. For the most part, they have stood the test of time since Secretary-General Dag Hammarskjöld defined them while devising the UN Emergency Force (UNEF) in Suez in 1956. However, in recent years UN peacekeeping has departed from these principles as operational environments have become less permissive and in key theaters there has been less or little peace to keep. Consent has proven less reliable in conflict areas where governments or non-state armed groups deny access to peacekeepers, like in Sudan, South Sudan or Mali. Impartiality has become questionable for missions specifically deployed to support a host state Government, sometimes against non-state armed groups opposing national authorities. Since exceptions to the non-use of force principle include the defense of the mandate, as outlined by the Capstone Doctrine, and as mandates now prioritize the protection of civilians by all necessary means for most UN missions, peacekeepers are increasingly called upon to use force against potential perpetrators of violence. Current concepts of operations and rules of engagement have made it clear that blue helmets are authorized to use force to protect civilians from imminent threat of physical violence by any party. More generally, the posture of modern peace operations has adapted by the adoption of robust mandates. In some theatres, special military units with offensive directives were authorized, such as the Force Intervention Brigade (FIB) initially deployed in 2013 in eastern DRC to neutralize armed groups, or the soon-to-be-deployed Regional Protection Force in South Sudan, mandated to engage any actor preparing attacks.

any practitioners believe that peacekeeping has become an increasingly dangerous undertaking in recent years. My research paper “Has UN Peacekeeping Become More Deadly? Analyzing Trends in UN Fatalities”, tries to get at the heart of this question. It examines trends in fatalities using a new dataset compiled by the Department of Peacekeeping Operations (DPKO). The dataset accounts for monthly fatalities by type of fatality (accident, malicious act, illness, and other causes), nationality of the deceased as well as personnel type for each UN operation worldwide during the time period of 1948 - June 2015. To assess trends, the paper merges this monthly fatality data with monthly deployment data and calculates fatality ratios (i.e., fatalities rates relative to deployment levels) by national contingent, mission, and globally (i.e., all UN missions combined). This is a novelty. All previous studies have worked with yearly deployment averages. As a result, the analysis of fatality trends presented in this paper constitutes the most detailed study of this phenomenon thus far.

28355. Towards a Continental Strategy for Countering Violent Extremism in Africa

Violent Extremism is now recognized as a growing threat to peace and security in Africa, as exemplified by the recent terrorist attacks in Garissa, Abidjan, and Ouagadougou. While much of the policy discussion on Countering Violent Extremism (CVE) focuses on the return of radicalized foreign fighters to the West, less attention is directed to those foreign fighters who may eventually return from Iraq, Syria, and Libya to other areas of North Africa, the Maghreb, and the Horn of Africa. Tunisia is one of the world’s largest contributors to the Islamic State in terms of foreign fighters, with smaller contributions from Algeria, Morocco, Libya, Sudan and Somalia. Issues concerning the return of foreign fighters to Africa are particularly salient not only because these individuals may return to their communities, but also because they may link up with other extremist armed groups present across the continent. These include groups affiliated to either al-Qaeda or the Islamic State, such as Boko Haram, al-Shabaab, and al-Qaeda in the Islamic Maghreb (AQIM). Attempts to counter violent extremism began in Europe in the 1980s with the advent of programs to dissuade and disengage right-wing extremists in Norway, Sweden and Germany. Although no common definition exists, since that time CVE has come to be associated with a range of measures designed to prevent and reverse the radicalization of individuals and groups, and to forestall the participation of these groups and “lone wolves” in acts of terrorism. Given that CVE is preventative and reactive, different CVE strategies are necessary for different stages of the radicalization continuum, including for individuals and communities with no exposure to extremist networks, those with some exposure, and those already radicalized. The latter is often associated with attempts to shift extremists towards acceptance of more moderate ideologies and is known as “deradicalization.” In some ways, CVE is difficult to distinguish from conventional counter-terrorism, which often includes traditional military measures and the sharing of intelligence between nation states. However, because conventional counter-terrorism does not address the root causes prompting radicalization, policy interventions under the rubric of CVE have more recently been designed to focus attention on the grassroots factors, which may render certain individuals more susceptible to radicalization than others. Social exclusion, poverty, and a lack of education are often named as typical contenders in this regard, although CVE practitioners generally acknowledge that no single causal pathway to radicalization can be identified. Reflecting these general trends, this essay charts the development of African Union policy, from its roots in conventional counter-terrorism, to efforts to devise a continental strategy for CVE in Africa. It also outlines a number of policy measures, which any such continental strategy should take into account.

XVIIth century and next periods were the years of the expansion of commercial capitalism by means of shipping trade. The activity of west in Mediterranean trade along the line a series of developments which constricted the Ottoman domination. At the beginning of the XIXth century, it was seen the expansion in foreign trade and financial dependence conjunction with the process of integration with western economies. In this process, the western countries experienced the significant improvements in the ship technology and sea transporting. The steamships moved to a new phase the superiority of western capitalism. The Ottoman State tried to develop the resistance by reforms in this new process. It was intended to improve the water resources of Anatolia and also to prevent damage to agricultural lands in accordance with the Tanzimat reforms. It was realised the public services in order to get benefit of the rivers to contribute to the national economy. The river transporting failed mostly. The old shipping technology was dependent on the wind directions. It could be done the transportation on the rivers such as Euphrates, Tigris, Nile and Danube. The shipping company of Sakarya river was aborted attempt in Ottoman territory. It was given the concession for this initiative that was started towards the end of Abdulaziz I (1861-1876) period but it was not ready for operating activities in the legal term. This study is the subject of this unfinished experiment.

In an era of unexpected shifts in the Middle East and North Africa (MENA) region and the challenges stemmed from these shifting dynamics, the question is whether the new socio-political atmosphere is sustainable in the medium to long-run in spite of politically questionable achievements? In order to address this question, some historical insight along with an elaboration on the concept of “domino theory” could be of some use. Did the “domino effect” of the Arab Spring work in the opposite direction and a “reverse domino effect” turn the picture upside down with authoritarian rulers acquiring power once and for all and eliminating oppositional groups as it is seen from several cases already? From Lenin to Eisenhower, the analogy of “dominoes” and their “fall”, referring to the potential chain reaction following a major political and/or military action / development, found their place in policymaking, and indeed, continued to do so even though direct reference to those terms became less and less popular. However, historical experience implies that despite the popularity of these concepts, dominoes might not fall one after another. Rather, the “next dominoes” can strengthen their position in order to avoid the fate of the last one. Either those regimes would face an irresistible wave of “reverse domino effect” or the fall of some “dominoes” would even help them act more cautiously in order to consolidate what they achieved, one thing is clear; Turkey has the potential and intention to be one of the key players to have an influence over the future and sustainability of the “tectonic shift” we witnessed, better known as “the Arab Spring”. At the same time, unsurprisingly, Turkey is also one of the countries that has been and will be affected by its possible U-turn, too.

Abstract:
This article echoes the now recurring calls to broaden the conceptualization of social movements. Moving away from classic definitions, the author suggests that certain elements of protest activity can be better understood through an examination of its actors in their most ordinary and daily social relations as opposed to the exceptional moments when they face political power. This study is based on a series of inquiries conducted since 2009 in various South African urban areas with active militants affiliated with organizations shaping the agenda on social discontent. More specifically, this article draws attention to how these collectives develop ties with their most immediate social environment, that is in impoverished, working-class neighborhoods.

This paper is based on interviews held with Istanbul waste collectors who cross the city to collect recyclable waste. Bound in some sense to garbage, these waste collectors are cast to the edges of the city and to the margins of society. Their working and living spaces are both degraded and threatened by encroaching urban renovation projects and real-estate developments; associated waste-management reforms do not recognize the work of waste collectors as legitimate and therefore exclude these “poor”, “dirty, and “archaic” waste collectors. Through an analysis of small and discrete practices of resistance of waste collectors, namely by continuing to collect waste despite its illegal status as well as through mobilization efforts to become organized as “waste workers”, this article argues that far from being passive, these waste collectors resist against exclusion and elaborate a justificatory discourse to defend their role in society.

First, the article examines the inscription of researchers into European security politics not only as a limit to research, but as a method of access and analysis. The article looks particularly at the identification of researchers as “experts” by EU practitioners, and at expertise as method. The second line of investigation and reflection concerns the limits inherent to the way in which critical scholarship on security has appropriated the “social life of methods” discussion. The article argues that this is an opportunity to engage with methods in relation to concrete research endeavors, rather than to stage a theoretical discussion on methods.
