Abstract:
The Public International Law & Policy Group’s (PILPG) Ceasefire Drafter’s Handbook is a guide intended to effectively supplement the activities of negotiators and drafters of ceasefire agreements. This Handbook draws from PILPG’s experience in ceasefire negotiations, as well as state practice and comparative analysis of over 200 ceasefire agreements from Africa, Asia, Europe, the Middle East, and Latin America. As part of the ceasefires practice area, PILPG also provides negotiation simulations, strategic memoranda, training modules, and negotiation and drafting assistance to pro bono clients. For more information about PILPG’s ceasefires work, please visit www.pilpg.org. This Handbook includes an Introduction to Ceasefires and an Annotated Ceasefire Template. The Introduction to Ceasefires provides information on the core elements of ceasefires, the effects of asymmetry on ceasefire agreements, the role of third parties, and the legality of ceasefire agreements. The Annotated Ceasefire Template describes core provisions and provides sample language for drafters to incorporate into ceasefire agreements. Although each template section offers drafters a guiding framework, it may be necessary to reshape the provisions to address the nuances of each situation. This Handbook’s comparative provisions and sample language are included to provide options from existing ceasefires to assist the drafter. A full-text database of all the agreements cited in the footnotes can be found on PILPG’s ceasefire database at www.pilpg.org/ceasefire-database/. There are three Annexes to the handbook. Annex A provides a map of geographic ceasefire elements, Annex B provides a sample chart of assembly areas, and Annex C provides a sample timeline of implementation activities.

5552. Rhythms and Cycles in Happiness

Abstract:
This study analyses time-dependent rhythms in happiness in three aspects. We show that the Sunday neurosis exists exclusively for men with a medium level of education and both men and women with high levels of education. Men with high levels of education may even experience a weekend neurosis. This study is the first to test for intra-monthly rhythms and to demonstrate that men with a lower educational background may suffer from negative effects on happiness towards the end of the month, potentially due to liquidity problems. The study is also the first to demonstrate that – even when controlling for health and income effects – happiness exhibits seasonal effects over the annual period, depending on gender and education.

5553. Green Transformation towards Sustainable Development?

Both the concept of sustainable development (SD) and the new green transformation concepts (GTC) aim for the integration of environmental protection and development. Previous comparative research on these GTC is not based on theoretically founded crite- ria that are related to the established development paradigm of SD. The study closes this research gap by providing a conceptual comparison of different GTC versions as pub- lished by UNEP, the OECD, and the German Advisory Council on Global Change (WBGU). The analysis reveals that GTC concepts are indeed based on central goals and principles of SD. Unlike the concept of SD, the GTC acknowledges planetary boundaries as limits to growth. However, the more economy-focused concepts of UNEP and the OECD do not only disregard important social goals but also concerns of intergenerational equity and the globality principle of SD. In contrast, the WBGU focuses on civil society participation and both intra- and intergenerational equity by aiming for decisive institu- tional changes. It is shown that this GTC partly extends beyond the scope of SD and thus could mark an important step with regard to the further development of the concept.

5554. A Theory of Rollover Risk, Sudden Stops, and Foreign Reserves

Abstract:
Emerging economies, unlike advanced economies, have accumulated large foreign reserve holdings. We argue that this policy is an optimal response to an increase in foreign debt rollover risk. In our model, reserves play a key role in reducing debt rollover crises ("sudden stops"), akin to the role of bank reserves in preventing bank runs. We find that a small, unexpected, and permanent increase in rollover risk accounts for the outburst of sudden stops in the late 1990s, the subsequent increase in foreign reserves holdings, and the salient resilience of emerging economies to sudden stops ever since. Finally, we show that a policy of pooling reserves can substantially reduce the reserves needed by emerging economies.

Abstract:
This paper analyzes the job-to-job transitions of workers in the United States. I propose a new method of correcting the time-aggregation bias. The bias-corrected series from 1996 to 2011 reveals a procyclical pattern of job-to-job transition and a large decline since the beginning of the 2000s. I construct a model of on-the-job search and explore the implications of this phenomenon. The calibrated model shows that the decline in the reallocation of workers through job-to-job transitions has had a substantial effect on total factor productivity (TFP). From 2009 to 2011, the model accounts for about 0.5%-0.7% annual decline in TFP.

Abstract:
A key feature of the 2007 financial crisis is that for some classes of securities trade has practically ceased. And where trade has occurred, it appears that market prices are well below their intrinsic values. This seems especially true for those securities where the payoff streams are particularly complex, for example, structured finance ABS CDOs. One explanation for this is that information about these securities' intrinsic values since the crisis has been asymmetric, with current holders having better information than potential buyers. We first characterize the information asymmetries that were present in the structured finance ABS CDO market. Because many of the CDO dealers had partially or fully integrated the pipeline from mortgage originations through CDO issuance, they had informational advantages over potential buyers that could well have disrupted trading in CDOs as the crisis took hold in August of 2007. Using a "workhorse" model for pricing securities under asymmetric information and a novel dataset for the intrinsic values of ABS CDOs, we show how the resulting adverse selection problem could explain why the bulk of these securities either trade at significant discounts to their intrinsic values or do not trade at all.

Abstract:
We empirically examine financial institutions' motivations to take systematic bad-tail risk in the form of sponsorship of credit-arbitrage asset-backed commercial paper vehicles. A run on debt issued by such vehicles played a key role in causing and propagating the liquidity crisis that began in the summer of 2007. We find evidence consistent with important roles for both owner-manager agency problems and government-induced distortions, especially government control or ownership of banks.

Abstract:
We provide a first in-depth look at robust estimation of integrated quarticity (IQ) based on high frequency data. IQ is the key ingredient enabling inference about volatility and the presence of jumps in financial time series and is thus of considerable interest in applications. We document the significant empirical challenges for IQ estimation posed by commonly encountered data imperfections and set forth three complementary approaches for improving IQ based inference. First, we show that many common deviations from the jump diffusive null can be dealt with by a novel filtering scheme that generalizes truncation of individual returns to truncation of arbitrary functionals on return blocks. Second, we propose a new family of efficient robust neighborhood truncation (RNT) estimators for integrated power variation based on order statistics of a set of unbiased local power variation estimators on a block of returns. Third, we find that ratio-based inference, originally proposed in this context by Barndorff-Nielsen and Shephard (2002), has desirable robustness properties in the face of regularly occurring data imperfections and thus is well suited for empirical applications. We confirm that the proposed filtering scheme and the RNT estimators perform well in our extensive simulation designs and in an application to the individual Dow Jones 30 stocks.

Abstract:
A large public finance literature argues that taxable income elasticities are a sufficient statistic for the social welfare consequences of taxation. We develop calibrations that show such deadweight loss calculations are overestimates proportional to the quantitative significance of heterogeneity in amenities across job matches. In particular, the endogenous supply of amenities can substantially exacerbate this overestimation in both static and dynamic environments. Given the possibility of gradual migration of workers into more amenity-focused job matches in response to tax increases, welfare calculations based on long-run taxable income elasticities can be more misleading than those based on short-run elasticities.

Abstract:
Using Bayesian methods, we estimate a nonlinear general equilibrium model where occasionally binding collateral constraints on housing wealth drive an asymmetry in the link between housing prices and economic activity. The estimated model shows that, as collateral constraints became slack during the housing boom of 2001-2006, expanding housing wealth made a small contribution to consumption growth. By contrast, the housing collapse that followed tightened the constraints and sharply exacerbated the recession of 2007-2009. The empirical relevance of this asymmetry is corroborated by evidence from state- and MSA-level data.

Abstract:
Using a sample of about 90,000 observations from 38 countries over the 2001-2012 period, we provide three novel findings regarding say on pay (SoP) laws. First, we find robust evidence that SoP laws reduce CEO pay growth rates at firms. Second, such laws decrease the portion of total top management pay captured by CEOs. Firm values are higher following SoP laws in part because of this reduction in managerial pay inequality. Third, mandatory SoP laws only affect the CEO pay growth rates whereas advisory SoP laws influence various aspects of executive pay policies. These results are robust to instrumental variable estimation and nearest neighbor matching methods.

Abstract:
This paper uses a panel structural vector autoregressive (VAR) model to investigate the extent to which global financial conditions, i.e., a global risk-free interest rate and global financial risk, and country spreads contribute to macroeconomic fluctuations in emerging countries. The main findings are: (1) Global financial risk shocks explain about 20 percent of movements both in the country spread and in the aggregate activity in emerging economies. (2) The contribution of global risk-free interest rate shocks to macroeconomic fluctuations in emerging economies is negligible. Its role, which was emphasized in the literature, is taken up by global financial risk shocks. (3) Country spread shocks explain about 15 percent of the business cycles in emerging economies. (4) Interdependence between economic activity and the country spread is a key mechanism through which global financial shocks are transmitted to emerging economies.

Abstract:
We study the source and consequences of sluggish export dynamics in emerging markets following large devaluations. We document two main features of exports that are puzzling for standard trade models. First, given the change in relative prices, exports tend to grow gradually following a devaluation. Second, high interest rates tend to suppress exports. To address these features of export dynamics, we embed a model of endogenous export participation due to sunk and per period export costs into an otherwise standard small open economy. In response to shocks to productivity, the interest rate, and the discount factor, we find the model can capture the salient features of export dynamics documented. At the aggregate level, the features giving rise to sluggish exports lead to more gradual net export reversals, sharper contractions and recoveries in output, and endogenous stagnation in labor productivity.

Abstract:
We develop and estimate a general equilibrium model that accounts for key business cycle properties of macroeconomic aggregates, including labor market variables. In sharp contrast to leading New Keynesian models, wages are not subject to exogenous nominal rigidities. Instead we derive wage inertia from our specification of how firms and workers interact when negotiating wages. Our model outperforms the standard Diamond-Mortensen-Pissarides model both statistically and in terms of the plausibility of the estimated structural parameter values. Our model also outperforms an estimated sticky wage model.

This paper studies firms' usage of interest rate swaps to manage risk in a model economy driven by aggregate productivity shocks, inflation shocks, and counter-cyclical idiosyncratic productivity risk. Consistent with empirical evidence, firms in the model are fixed-rate payers, and swap positions are negatively correlated with the term spread. In the model, swaps affect firms' investment decisions and debt pricing very moderately, and the availability of swaps generates only small economic gains for the typical firm.

Abstract:
In this paper I explore the role of portfolio diversification in explaining the distribution of foreign investment across countries. I capture the portfolio diversification motive by a measure of country-specific riskiness, "covariance risk", which I construct as how countries' growth rates covary with the stochastic discount factor of a representative international investor. My key new empirical finding is a strong and significant correlation between this new measure of country riskiness and foreign investment allocations. Less risky countries, i.e. countries whose growth rates are more highly correlated with the investor's stochastic discount factor, receive larger investment shares than more risky countries. I interpret this result as evidence that investors do take into account diversification opportunities, not only for portfolio investment decisions, but also for foreign direct investment decisions. My empirical results confirm the theoretical predictions of standard portfolio allocation models.

Abstract:
Do governments default on debt denominated in their own currency? We introduce a new measure of sovereign credit risk, the local currency credit spread, defined as the spread of local currency bonds over the synthetic local currency risk-free rate constructed using cross currency swaps. We find that local currency credit spreads are positive and sizable. Compared with credit spreads on foreign currency denominated debt, local currency credit spreads have lower means, lower cross-country correlations, and are less sensitive to global risk factors. Global risk aversion and liquidity factors can explain more time variation in these credit spread differentials than macroeconomic fundamentals.

Abstract:
This paper focuses on regulatory challenges posed by the two interconnected structures of the global financial system – the economy of tax havens (or offshore financial centres), and the shadow banking system. The financial crisis of 2007-09 has revealed that tax havens structures and shadow banking entities play a central role in the practise of financial institutions reliant on financial innovation. Thriving on complexity, opaque networks and driven by arbitrage, the two phenomena pose tremendous challenges to national and international regulators aiming to restore the financial cycle in the recessionary environment. In this paper, we analyse ‘the state of play’ and the current plans for the governance of tax havens, offshore finance and the shadow banking industry. We find that although offshore financial centres and shadow banking are outside the scope of academic economics, they have attracted a lot of attention on the part of financial researchers and regulators. Along with other macro-prudential and system risk concerns, the regulation, or governance of these ‘black holes’ of the global economy is increasingly assuming a central place on the agenda of financial regulators. In what follows, we explore the reasons behind this development.

Abstract:
Present social movements, as “Occupy Wall Street” or the Spanish “Indignados”, claim that politicians work for an economic elite, the 1%, that drives the world economic policies. In this paper we show through econometric analysis that these movements are accurate: politicians in OECD countries maximize the happiness of the economic elite. In 2009 center-right parties maximized the happiness of the 100th-98th richest percentile and center-left parties the 100th-95th richest percentile. The situation has evolved from the seventies when politicians represented, approximately, the median voter.

Abstract:
Fund managers play an important role in increasing efficiency and stability in financial markets. But research also indicates that fund management in certain circumstances may contribute to the buildup of systemic risk and severity of financial crises. The global financial crisis provided a number of new experiences on the contribution of fund managers to systemic risk. In this article, we focus on these lessons from the crisis. We distinguish between three sources of systemic risk in the financial system that may arise from fund management: insufficient credit risk transfer to fund managers; runs on funds that cause sudden reductions in funding to banks and other financial entities; and contagion through business ties between fund managers and their sponsors. Our discussion relates to the current intense debate on the role the so-called shadow banking system played in the global financial crisis. Several regulatory initiatives have been launched or suggested to reduce the systemic risk arising from non-bank financial entities, and we briefly discuss the likely impact of these on the sources of systemic risk outlined in the article.

5571. Privatized Returns and Socialized Risks: CEO Incentives, Securitization Accounting and the Financial Crisis

Abstract:
The paper investigates the role of CEO¶s equit\ and risk incentives in boosting securitization in the financial industry and in motivating executives to reduce the perceived risk while betting on it. Using a sample of US financial institutions over the period 2003-2009 we document that CEOs with high equity incentives have systematically engaged in securitization transactions to a larger extent than CEOs with low incentives. We also show that CEOs with high equity and risk-related incentives have engaged in the securitization of risky loans and have used securitization for transferring risks to outside investors. Finally, we show that executives incentivized on risk have provided outside investors with low quality disclosure about losses recorded on securitized loans thus contributing to increase the opacity of securitization transactions undertaken. Overall, we interpret our results as evidence that CEOs have foreseen in securitizations under US GAAP an opportunity for hiding risks while bearing them and generating profits and cash flows because of the risks. Our results are robust to several model specifications as well as to endogeneity concerns.

Abstract:
The paper argues that the European financial system in the years following the great financial crisis started in 2007 has become increasingly fragile. Minsky’s notion of fragility, on which it is based, is related to history, policy and institutions. In the current European environment, fragility depends on the rise of shadow banks’ assets, the expansion of derivatives and the changes in financial regulation. All these elements have jointly triggered several feedback loops. In Minsky’s opinion, policies should have the scope of thwarting self-enforcing feedback loops. Yet the policies that have been implemented so far seem to have produced the opposite effects. They have created new feedback loops that nurture fragility again. This outcome, however, is not surprising for policies may change initial conditions and have unintended consequences, as Minsky has taught us since a long time.

The 2007-9 period saw an unprecedented crisis emerge in global financial markets with the collapse of several large western financial institutions, and the nearest moment of systemic crisis yet witnessed in the globalized financial system. The crisis has thus provoked a significant questioning of market theories, and in particular understandings of market within orthodox neoclassical economics. Within the social sciences, a significant element of this response has built on a growing heterodox socioeconomic literature which is heavily critical of hegemonic conceptions of the market within economics. However, whilst a small body of work in economic geography has begun to engage with this literature, geographical thinking has not directly sought to conceptualise the nature and significance of market spatiality. Utilizing a cultural economy approach, this paper therefore argues that economic geographical theories need to foreground the concept of market rather than treat markets as a ‘component’ of wider processes. It further contends that the concept of the ‘market’ needs to be reconceptualised in a way that captures the spatialities of markets and the difference that space makes to market behaviours and outcomes. Drawing on the growing heterodox socioeconomic literature on markets, it thus proposes a practice-oriented ‘socio-spatial approach’ for framing conceptions of market spatiality, arguing that such a spatial epistemology opens up a range of theoretical possibilities for further contesting hegemonic neoclassical theories of the market beyond current socioeconomic critiques. It seeks to illustrate the utility of such a framework through a case study analysis of the limitations inherent in existing policy practices surrounding the early phase of the recent global financial crisis.

Since this lecture is part of a series dedicated to water, I will try to give a complete flavour of this natural resource. Water has also been called amrit in Indian mythology and is seen in many cultures as the nectar, or elixir of life. Earlier, when there were few large cities or industries, people were poor and their requirements were modest. Yet while the demand for water has risen in the recent past, it is important to bear in mind that since the time the earth was created, the total amount of water has remained almost the same except during the last few years when climate change has brought about certain variations, but little perceptible change, in the total amount of water available for human and ecological use. We all know that sufficient water is not available for producing enough and quality food for all of humankind. Presently, there are about 6.5 billion people on the planet and we grew by almost twice during the last fifty years. The present world population is expected to further double in the next fifty years. The big question, therefore, is whether there shall be sufficient water to grow enough food for all of us in the future.

The nuclear Nonproliferation Treaty (NPT) has long been a critical bulwark against the spread of nuclear weapons. Although preventing the production and accumulation of fissile material is an important part of this effort, the NPT does not explicitly regulate the production, use, and disposition of highly enriched uranium (HEU) for naval nuclear reactors. This exclusion poses a growing risk to achieving the nonproliferation goals of the treaty. While seeking to advance prospects for a fissile material cutoff treaty, the United States is continuing to design naval reactors for the world’s largest nuclear submarine fleet that are powered with weapons-grade uranium. While proclaiming its renunciation of any nuclear weapons ambitions, Brazil plans to build six nuclear submarines powered by uranium fuel that may be close to weapons grade. Neither the International Atomic Energy Agency (IAEA) nor important NPT member states have fully confronted the proliferation implications of excluding naval reactor fuel from safeguards. The IAEA and NPT members should take steps to minimize the use of HEU for any reason—a goal they declared just this month at a nuclear security conference in Vienna.

The findings on 99 countries are premised on 15 fundamental characteristics of software piracy based on income-levels (high-income, lower-middle-income, uppermiddle-income and low-income), legal-origins (English common-law, French civil-law, German civil-law and, Scandinavian civil-law) and, regional proximity (South Asia, Europe & Central Asia, East Asia & the Pacific, Middle East & North Africa, Latin America & the Caribbean and, Sub-Saharan Africa). Using Kauffman, Kraay, and Mastruzzi governance indicators, this article analyzes the impact of formal institutions on the knowledge economy- by assessing how the enforcement of Intellectual Property Rights (IPRs) through good governance mechanisms affects the knowledge economy. The article also employs the World Bank’s four components of the knowledge economy index characteristic of its knowledge for development (K4D) framework. We estimate panel data models for 22 Middle East & North African and Sub-Sahara African countries over the period 1996-2010. The results show that for this group of countries the enforcement of IPR laws (treaties), although necessary, is not a sufficient condition for a knowledge economy. The results also suggest that other factors are more likely to determine the knowledge economies of these nations. Overall these findings have important implications for both policy and further research.

Abstract:
This paper uses inter-country panel data obtained during the period 1990–2010 to examine how the occurrence of natural disasters has affected corruption within the public sector. There are a number of new findings from this study. (1) Disaster with the large amount of damage increase corruption not only for developing countries but also for developed countries. (2) The effect of disasters is greater in developed countries than in developing countries. (3) In the developed countries, frequency of occurrence of disaster plays important role on increasing corruption. This suggests that foreseeable disasters increase corruption. In developed countries, people have an incentive to live within disaster-prone areas to seek compensation.

Abstract:
We study the role of alternative intertemporal preference representations in a model of economic growth, stock pollutant and endogenous risk of catastrophic collapse. We contrast the traditional “discounted utility” model, which assumes risk neutrality with respect to intertemporal utility, with a multiplicative choice model that displays risk aversion in that dimension. First, we show that both representations of preferences can rationalize the same “business as usual” economy for a given interest rate and no pollution externality. Second, once we introduce a collapse risk whose hazard rate is a function of the pollution stock, multiplicative preferences recommend a much more stringent policy response. An illustration in the context of climate change indicates that switching to the multiplicative preference representation has a similar effect, in terms of policy recommendations, as scaling up the schedule of the hazard rate by a factor of 100.

This paper studies the knowledge spillovers generated by renewable energy technologies, unraveling the technological fields that benefit from knowledge developed in storage, solar, wind, marine, hydropower, geothermal, waste and biomass energy technologies. Using citation data of patents in renewable technologies at 17 European countries over the 1978-2006 period, the analysis examines the relative importance of knowledge flows within the same specific technological field (intra-technology spillovers), to other technologies in the field of power-generation (inter-technology spillovers), and to technologies unrelated to power-generation (external-technology spillovers). The results show significant differences across various renewable technologies. While wind technologies mainly find applications within their own technological field, a large share of innovations in solar energy and storage technologies find applications outside the field of power generation, suggesting that solar technologies are more general and, therefore, may have a higher value for society. Finally, the knowledge from waste and biomass technologies is mainly exploited by fossil-fuel power-generating technologies. The paper discusses the implications of these results for the design of R&D policies for renewable energy innovation.

Abstract:
The Pillars of Peace is a new conceptual framework for understanding and describing the factors that create peaceful societies. This framework defines the national characteristics which are most closely associated with peace and has been derived from a process of statistical analysis. It stands as one of the few holistic and quantitative based studies to isolate the positive factors which sustain and reinforce peaceful societies. The attitudes, institutions and structures associated with peace are also associated with many other aspects that are considered desirable, such as a strong business environment, gender equality and high levels of human capital; consequently, the Pillars of Peace can be seen as describing the optimal environment for human potential to flourish. Peace can be viewed through the lens of both negative and positive peace. Negative peace, which is the absence of violence or fear of violence, is used as the definition of peace to create the Global Peace Index (GPI), while positive peace can be defined as the attitudes, institutions and structures that, when strengthened, lead to a more peaceful society. The Pillars of Peace provides a framework for assessing the positive peace factors that create peaceful societies. The taxonomy also forms an ideal base for measuring a society’s potential for peace. These positive peace factors can also be used to assess how supportive the underlying environment is towards development, as they are positively associated with developmental outcomes and therefore the fulfillment of human potential. The Pillars of Peace provides the ideal benchmark against which to measure the performance of the broader aspects of social development and a country’s overall resilience when confronted with social upheaval. In constructing the Pillars of Peace over 900 different indices, datasets and attitudinal surveys were analysed in conjunction with current thinking about what drives peace, resilience and conflict. In order to ensure the development of a holistic framework, both a multidisciplinary and ‘systems approach’ was applied to the concept of peace, drawing on a range of recent research.

Although Hirschman’s exit–voice theoretical model has been applied to labor markets, research up to now has not tested one of its most important features: the impact of job quality on exit–voice strategies. Hirschman’s model of consumer behavior explains that those individuals unsatisfied with a product’s quality are more likely to “voice,” whereas those more concerned with its price are more likely to “exit.” A rationale for this tradeoff is based on information: first, information on the price of alternative options is much more accessible than information on quality; second, voice produces more information than exit and favors opportunities for specific improvements. We transpose Hirschman’s assumptions to labor markets and use the French SalSa survey and DADS, declaration by employers on social data, to examine the conditions under which French employees are more likely to exit, and the conditions under which they are more likely to voice. Our results support the Hirschmanian hypothesis. A deterioration by one unit in our working-conditions index increases the probability of participation in collective action by 5 percentage points. An increase in log hourly wage by one unit decreases the probability of quitting by 5 percentage points.

Do female supervisors promote greater wage equality between men and women? Although female supervisors might want to promote greater equality, might they also lack power, not only to implement this policy, but also to improve the wages of both male and female subordinates? Based on the SalSa and COI surveys, we show that female supervisors do seem to reduce the wage gap between men and women. However, the subordinates of female supervisors also receive lower wages. This phenomenon could be related to selection bias : women become supervisors more easily in sectors, jobs, and departments that are less valued and where wages are lower. Even when adding controls for measurable selection effects, employees with a female supervisor earn 2.5% to 4% less than those with a male supervisor. Although the phenomenon still needs additional confirmation, the wage gap between women and men does seem wider when employees are men (–5% to –10%) than when they are women (0% to –3%). When the supervisor is a woman, the gender gap significantly reduces: from 30% to 85%. Interpreting this phenomenon is still in its infancy. We put forward four lines of interpretation: the unobserved differences between male and female managerial positions; the effect of individual characteristics correlated with the supervisor’s gender; differences between male and female dispositions to negotiation and competition; and, finally, discriminatory corporate behavior towards female demands.

5585. Direct Social Expenditures: A Monitoring Guide for Civil Society Organizations

This paper provides civil society organizations with different strategies to obtain and analyze detailed information on direct social expenditures (DSE) by companies. It also provides civil society with useful lessons on advancing the transparency agenda in this area. The World Bank defines corporate social responsibility (CSR) as “companies’ commitment to contribute to sustainable economic development by working with employees, their families, the local community and society at large to improve their quality of life in a way that is beneficial for business and also for development.” Extractive industries engage in CSR because their activities are considered among the most environmentally and socially disruptive and it is critically important for them to secure their “social licenses to operate.” As part of their CSR extractive companies invest significant amounts of resources to undertake social development programs; in 2001, oil, gas and mining companies disbursed more than $500 million in community development programs. These expenditures can have a large impact on small local economies. When poorly conceived and implemented, they can lead to corruption and undermine government authorities and institutions. In addition, these resources are obtained on the basis of concessions of oil, gas and minerals that belong to citizens. Companies receive fiscal concessions or incentives from the social activities undertaken in the countries where they operate. All these reasons make it imperative that civil society organizations monitor DSE to ensure they are spent effectively. Companies can employ different mechanisms to disburse DSE. These could be a function of program objectives and other contextual factors. A company might implement different mechanisms in different countries. It could use public or private disbursement channels, or a combination of both. CSOs need to understand these mechanisms and their pros and cons in order to monitor them. The paper studies the experience of two CSOs—Grupo Propuesta Ciudadana (GPC) in Peru and Instituto Brasileiro de Análises Sociais e Econômicas (IBASE) in Brazil—that successfully made extractive companies disclose information on their expenditures and have since monitored and evaluated the impact of these expenditures. Both CSOs created transparency indices and performed social audits to rigorously assess and rank company performance and undertake evidence-based policy advocacy. GPC successfully obtained information from more than 30 companies on $900 billion worth of social expenditures, and IBASE convinced over 300 private companies to disclose their social audits. The paper also explores experiences of countries that have negotiated including direct social expenditures in the disclosure requirements of the Extractive Industries Transparency Initiative (EITI). Despite progress in companies disclosing relevant data in recent years, transparency of direct social expenditures is more the exception than the norm. Companies should improve their reporting by providing detailed information about the types of projects funded, the objective of such projects, the amounts disbursed, and the persons responsible for allocating these resources. Contracts that include social expenditure obligations should be available for public consumption.

This paper discusses challenges and approaches in managing resource revenues at the subnational level. Subnational resource-rich governments face distinct challenges in managing revenues from volatile, exhaustible resources. These include: unpredictable and discretionary resource revenue transfers between national and subnational governments, which can undermine development planning; resource revenue volatility which can lead to wasteful spending, poor quality investments; over the longer term, the finite nature of oil, gas and mineral revenues can lead to a long period of economic growth followed by a depression; and difficulty in scaling up public investment efficiently when experiencing a revenue windfall. To address revenue volatility, subnational governments can “smooth” expenditures by delinking revenues from expenditures. When revenues are unexpectedly high, governments can run a surplus, to be saved or used to pay down public debt. When revenues are unexpectedly low, they can draw on those savings or borrow. To prevent long-term booms and busts, governments can also save a portion of resource revenues for future generations, as well as invest in the local economy to generate future growth. Fiscal rules can underpin these policies, constraining government spending decisions and compelling government bodies to adopt a long-term perspective on public finances. Development planning can help prepare resource-rich regions for life after their oil, gas or minerals have been depleted. Planning helps prevent shortsighted reactions to temporary ebbs and flows in oil or mineral revenues, helps define the role of the resource sector in development, and lays the groundwork for a thriving post-extractive economy.

Local content is the processes of building such economic capital at the national and subnational level, and meeting set public policy objectives. This paper offers guidance on designing and implementing local content initiatives in the oil, gas and mining sectors to ensure economic sustainability within producing regions. It aims to answer the question of how national and subnational governments, industry and civil society can maximize local benefits through partnerships among governments, companies and civil society organizations (CSOs). Governments should set clear targets based on which companies should make commitments and publish transparent reports on results. CSOs can then analyze the results and monitor progress of local content initiatives.

As governments have sought to monitor digital communications for security purposes, the “backdoor” paradigm has become the predominant approach. Strictly speaking, backdoors refer to special methods of bypassing normal authentication procedures to secretly access computing systems. But here the concept is used in a broader sense to describe a range of policies and practices whereby governments compel, or otherwise get the cooperation of, private sector companies to provide access to data they control. The backdoor paradigm is not only a concern for political reasons, particularly for civil liberties, it is also bad for digital security and foreign policy. Law enforcement and intelligence agencies should instead seek to work within the information-rich world of Big Data that surrounds us with any access to private communications made exceptional and strictly controlled by lawful procedures and oversight mechanisms.

This paper reviews recent debates in peace and conflict studies on the theoretical and empiri- cal integration of spatial categories. We examine three notable strands of research. The first consists of studies that analyze the influence of topography, borders, and resource availability on the occurrence of international and intra-state war. The second strand comprises recent studies in civil war research focusing on territory and territorial control. The third strand is the debate on so-called environmental conflicts. We argue that most studies in all three fields are limited to the analysis of allegedly external material influences on violent conflict, failing to take into account the social and political meaning of physical materiality. We examine how recent research methodologically deals with interrelated scales (local, national, global). We argue that an analysis of the relationship between space and conflict should encompass both the materiality of space and its social meaning, and that these two aspects find themselves in a mutually constitutive relationship. Spatial theory therefore provides a useful approach.

Unlike what Hobbesian theories argue, the provision of governance is not necessarily undermined by a lack of statehood. Empirical findings show that – contrary to many voices in current debates on weak, failing, or failed states – various (non-state) actors provide governance even when statehood is limited. This paper addresses the puzzle of how to account for cases where governance exists although the state cannot or does not provide it. Transferring insights from political sociology to the analysis of such “gov- ernance without the state,” the paper holds that the way societies manage their affairs critically depends on social conditions, which are captured here following social capital theory. Working toward a political sociology of “governance without a state,” this paper links social capital, resulting in interpersonal trust, to social coordination underlying the provision of governance. In this context, governance is interpreted as a collective action game (“governance game”), in which socially embedded (collective) actors are seen as players whose behavior (in particular their decisions to cooperate) depends critically on their social capital endowments. The main argument is that specific types of social capital endowments facilitate – and, thus, explain – specific modes of social coordination in areas of limited statehood. Explorative in nature, con- ceptual and theoretical arguments will be developed that offer new perspectives to explain the variance and mechanisms of governance outside the OECD world.

This report focuses on the roles that third parties should play during a dialogue facilitation process. The high number of negotiations launched and peace agreements reached during 2012 confirms the trend observed during the last decades that the most common form of conflict termination is through negotiated settlements. However, according to the 2012 figures, about 40% of the negotiation process faced serious difficulties or did not achieve any results. Considering that the literature has shown a high correlation between the participation of third parties and peace talks’ success rates, one obvious explanation for the high percentage of peace negotiations that are unable to properly move forward could be the absence of third parties. Another factor could be linked to the performance of third parties when they do participate in dialogue processes. Some of the most frequent causes of crisis in negotiations are the warring parties’ lack of confidence in the facilitating third party. Therefore this report addresses the functions that third parties can perform in a peace process. It defines key concepts, summarises the most important features of peace negotiations in 2012 and addresses the roles of third parties in dialogues to end violence.

This expert analysis note describes an emerging approach to regulating illicit flows of goods to and from conflict zones. The approach, based on norms of national and international law defining business due diligence, is well suited for dilemmas posed by war economies. Due diligence offers the possibility of excluding goods from global flows if they are produced through human rights abuse or used for conflict financing, while at the same time it can limit harm to livelihoods and avoid the wholesale criminalisation of informal economies. To that end, further inter-governmental policy coordination is needed to define conflict financing under international law and to elaborate an effective regulatory strategy.

The links between the presence of peacekeepers and the sexual exploitation and abuse of women have been documented across peace support operations (PSOs). This expert analysis critically analyses the United Nations secretary general’s Bulletin on Special Measures for Protection from Sexual Exploitation and Sexual Abuse, which was promulgated in 2003 to address the problem of sexual exploitation and abuse in the context of PSOs. The expert analysis is concerned with the broad definition of sexual exploitation provided by the bulletin, which includes most sexual relationships and prostitution. It concludes that the bulletin’s definition of sexual exploitation is over inclusive in its “strong discouragement” of sexual relationships and prohibition of prostitution regardless of consent, age and fair remuneration. It argues that, as currently formulated, the bulletin undermines women’s agency and sexual autonomy, and blurs important distinctions between consensual sex and sexual offences. The bulletin thus relies on and perpetuates negative gender stereotypes and imperial hierarchies and, consequently, encourages stigma and discrimination. It casts women as victims and peacekeepers as sexual predators who cannot treat women as equals.

A special session of the United Nations General Assembly made headlines last week with a disheartening announcement – 2.4 million people today, across the globe, are victims of human trafficking. Of those, 80 percent are being forced into sexual slavery, and 17 percent are enslaved into forced labor. Even the statistic of 2.4 million people does not truly reflect the impact that this phenomenon has; the number only represents the souls caught up at any given time, but does not track those who escaped their living nightmares and found freedom. According to the United Nations Office on Drugs and Crime, human trafficking is “the acquisition of people by improper means such as force, fraud, or deception, with the aim of exploiting them.” Some prefer to dispense with the seemingly whitewashed term and refer to the practice as modern-day slavery. No country is unaffected. Because of the way traffickers transport their “goods,” the human cargo often follows the same shipping lines as illegal drugs. It is one of the world’s most lucrative forms of organized crime, creating a draw for cartels seeking to diversify as well as for individual pimps on the street. Women make up nearly two-thirds of the world’s trafficked persons, and it is shockingly easy to sell these women for sex. Madrid police began an investigation last month into a prostitution ring, in which the pimps violently forced the women into sex slavery. The victims were chained to pipes and beaten into submission, and if they tried to escape or failed to pay their pimps, bar codes were tattooed onto their wrists.

5598. Filling the Values Vacuum: The Role of Western Business in Emerging Markets

Dubai markets itself as the place where “the developed world and the emerging world meet”. Judging by the diversity amongst the almost 500,000 visitors to the Dubai Mall one recent April Saturday, the label appears to fit. Teeming with Asians, Indians, Eastern and Western Europeans, West Africans, neighbors from the Gulf and even a few Americans, the mostly under-30 crowds displayed the commercial frenzy that has been in short supply in the West in recent years. Exploring the ground level of the Mall, just across from the famous Dubai fountains and the 163-story Burj Khalifa, I was delighted to discover that the most popular and packed restaurant concept did not showcase a Mediterranean, Italian, or French moniker but a uniquely American one—Texas Roadhouse. Hand-cut steaks, Texas-size rib combos, and country dinners filled patron’s plates while the line-dancing wait staff that propelled this Kentucky-based chain to popularity in the U.S. a few years ago delighted hungry customers this April afternoon. As growth, urbanization, and megacity development proceed in Asia, Latin America, the former Soviet states, the Middle East and even Africa, Western consumer and retail brands are being met with surprisingly robust popularity. At the recent Gulf Food show not far from the Dubai Mall, a medium-sized U.S. company was awarded “World’s Best New Halal Food”. There is an immensely important lesson here: as Western governments curb spending on foreign aid, development assistance and commercial programs, a “values vacuum” is developing into which institutions, cultures and governments are stepping to promote their own ideologies and cultural values, or lack thereof. Already the largest trading partner in many South American countries, China built and paid for a $105 million soccer stadium in Costa Rica, but only after government officials waived the country’s tough labor laws. Russian companies are gobbling up natural resources in Africa as well as energy, infrastructure and telecommunications assets in Ukraine and Kazakhstan. With influence from Venezuela and its ally Iran, the newly formed “Community of Latin American and Caribbean States” proudly excludes America and Canada.

We hear a lot of talk about millennials, those 50 million Americans aged 18 - 29 who have entered our society with a bang. Like most past generations in their younger days, this group is idealistic, leans liberal and is excited about the future. Where millennials differ most from the generations who came before them is in their prodigious use of social media. According to Pew, 75 percent of millennials participate in social networking, and more than 20 percent have uploaded video of themselves to the web. It is that expressive nature of the generation, and their willingness to share in so public a venue, that defines the group. This idealism, combined with the expressive instincts of millennials, can have a profound impact on public policy. Take the Kony 2012 movement as an example. In March 2012, Invisible Children released a short film about Joseph Kony and his Lord's Resistance Army that urged its mostly young viewers to get involved in its publicity campaign. Within a few months, the video attracted more than 100 million views on YouTube and Vimeo, generated tremendous traditional media coverage and inspired the U.S. Senate to pass a resolution and the African Union to deploy troops, an unprecedented response to a fairly obscure issue in a remote part of the world. Of course, Joseph Kony has been a menace in Central Africa for more than a quarter-century and was indicted for war crimes by the Hague in 2005. But it took a simple, inspiring video plugged into social media to get millennials inspired and active. This is the central challenge for activists and leaders who wish to persuade millennials to adopt a similar response on other issues. By their very nature, foreign policy issues are nuanced and almost impossibly complex. The public in general, and millennials in particular, do not, as a group, have the patience to sift through every wrinkle and dependency. The age of the white paper or long-form reporting feature is largely over, replaced by the simple infographic or video-based story. It takes real talent, creativity and even a little bravery (just browse through the withering criticism aimed at Invisible Children to see why) to isolate the basic elements of an issue and express them in an interesting and compelling visual format with enough emotion and energy to inspire a supportive response. But this is the talent we must increasingly cultivate and celebrate in public affairs circles if we want the millennial public to get involved.
