10101. Controlling Foreigners, Passengers, Citizens : Surveillance and Counterterrorism

Abstract:
Recent years witnessed calls for the intensification of surveillance and the monitoring of people globally. This article will examine this intensification of surveillance in the European Union, by analysing legislation requiring carriers to transmit to immigration authorities passenger data, an agreement between the Community and the US on the transfer of passenger name records (PNR) to US authorities, and EU plans to introduce biometrics in passports and visas and enhance the interoperability of EU databases (such as SIS and VIS). These developments, justified by a 'war on terror' discourse, widen the net of surveillance and raise a number of questions regarding legitimacy, democracy and the protection of fundamental rights in the EU. They also appear to be at odds with the concept of the EU as a borderless area. The article will address these issues by analysing the negotiations, content and implications of these initiatives. Ces dernières années les demandes d'intensification de la surveillance et des contrôles du mouvement des personnes au niveau mondial se sont développées. Cet article examine cette intensification de la surveillance au sein de l'UE en analysant la législation obligeant les transporteurs à fournir les données personnelles des passagers aux services d'immigration, un accord entre l'UE et les Etats-Unis sur le transfert des « passenger name records » (PNR) aux autorités américaines, et les plans européens d'introduction de données biométriques aux passeports et visas et d'amélioration de l'interopérabilité des bases de données européennes (SIS et VIS notamment). Ces développements, justifiés par un discours de « guerre au terrorisme », élargissent le réseau de la surveillance et soulèvent un certain nombre de questions sur la légitimité, la démocratie, et la protection des droits fondamentaux dans l'UE. Ils apparaissent également en décalage avec le concept de l'UE comme espace sans frontières. Ce texte abordera ces questions en analysant les négociations, le contenu et les implications de telles initiatives.

Abstract:
In the current context of the "global war against terrorism", the doctrines of national security are being extended to the whole of the world. They are one of the dimensions of the new dynamics of exception putting security in the forefront as the most central value, thus relegating liberty and justice to past times. Through the presentation of the research initiated by three teams of the European programme ELISE (European Liberty and Security), this new issue of Cultures Conflits tries to shed new light on these security dynamics. It tries to rearticulate the relations between practices of exception and logics of enmity and suspicion. This issue replaces the current focus on the analysis of the 9/11 attacks and the finding of an easily accessible explanation by a focus on the understanding of antiterrorist policies and of their consequences on social cohesion. Thus the contributions of this issue shed new and more critical light on these political “responses” that lead some to present as “new” what is not. They show that by adopting a very broad definition of emergency, these responses transform suspicion into a “certainty” and this “certainty” into a proof of guiltiness.

Abstract:
In France as in Brazil, violence and its modes of usage are thesubject of vivid and intense debates. The acts of violence inquestion have, however, little in common. The authors of this newissue of Cultures Conflits propose to examine the terms of thesedebates that feature and combine in complex shapes myths of nationaldemocracies, media representations, and the (in)abilities of thestate to effectively regulate the social sphere. These Franco-Brazilian dialogues on violence and democracy are part of a largercultural exchange linking since long Latin America and Europe - as Glauber Rocha and Roberto Rossellini remind us. An asymetricexchange, if any, marked by the feeling of being perpetually trappedin an unfinished development. At the beginning of this third millennium, we are witnessing the end of an era marked by the hegemony of European Christianity and the globalization of a deterritorialized and decentered Christianity. Evangelical Pentecostalism and the Catholic Charismatic Renovation Movement are examples of this type of individual salvation spiritualism in Latin America. This article illustrates how these movements base their success on their ritual pragmatism with regard to personal crisis situations and the image of a near and accessible God. Moreover, the success of these movements is because of the adjustment to new conditions of the global market, the adaptation to the new processes of citizenship typical of modern democracies, and the satisfaction of spiritual and affective needs in a context of intense shifts trying to create new identities to reestablish the social framework of society.

In the present report, the focus is placed on the European Union (EU) and its security policy. It commences with some context-setting, i.e. with clarifying the EU's place in the global and European security “architecture” and its relations with the United Nations, the OSCE and NATO, finding the latter to be more controversial than suggested by official declarations. It then proceeds with the analysis of the EU, finding its main contribution to regional security to be related to what the EU is and represents rather than to what it is andre presents rather than to what it is does. An analysis of the latter, i.e. the directly security-related institutions and activities of the EU under the auspices of the CFSP (Common Foreign and Security Policy) and the ESDP (European Security and Defence Policy) is also provided as well as an account of the “neighbourhood” programmes of the EU.

Abstract:
Terrorism and immigration stemming from the Southern Mediterranean have made it to the top of the European security agenda since 11 September 2001. This paper analyses the European Neighbourhood Policy in the light of European security perceptions. It suggests that the reason why the EU has difficulties in coming up with a coherent policy towards the Southern neighbours are due to fact that the EU and its member states are in an immense internal and external crisis of identity. This crisis has been further aggravated after the French and Dutch 'no' to the European Constitution. The paper makes the argument that the tension between modernity and post-modernity, between the European model of export of universalism and the increasing tendency to close the borders towards the 'others' further aggravates the identity crisis. The paper concludes that these tensions are increasing thus making it still more difficult for the EU to behave as an exporter of European values.

10108. A Special Part of Europe: Nation, State and Religion among Orthodox Slavs

Abstract:
The paper studies how nation, state and religion – in particular: churches – are related among Orthodox South Slavs: Bulgarians, Serbs, Macedonians and Montenegrins. The close relations between (self-conceived) nations and churches go back to the Ottoman Empire, and seem to have been strengthened by the conflicts in Former Yugoslavia since 1990. The close relation between state and nation go back to how the Ottoman empire was dissolved and have also been strengthened by the same conflicts, even though all states proclaim themselves as non- discriminatory in this respect. The close relation between church and state also has long historical roots, but is more ambiguous today, with elements of competition as well as cooperation – and the latter is seen by many as having gone too far under communism. It is notable that where there are attempts to stabilise a separate identity – in Macedonia and Montenegro – establishing separate churches is a part of this on par with defining separate languages, rewriting history, etc. and the churches are seen as important national symbols even among quite secularised groups; and the same is true for the resistance against separation from the Serbian Orthodox Church.

10109. The U.S. and Transatlantic Relations: On the Difference between Dominance and Hegemony

Abstract:
It is important to distinguish hegemony from dominance, as various authors like Machiavelli, Gramsci, and Nye have argued. This distinction allows one to appreciate that the first Bush Administration attempted to be a dominant power rather than a hegemonic one. A long list of assertions of essentially unilateral dominant power projections is actually buttressed by two pillars: primary of hard power but also American exceptionalism. By comparison to Europe, the George W. Bush version of American exceptionalism emphasizes traditional and absolute U.S. state sovereignty, a corresponding depreciation of international law and organization, parochialism, and non-muscular multilateralism. Because of all this the U.S. is largely responsible for the crisis in Atlanticism. The Europeans, however, have made their own contributions to this crisis. The crisis needs to be resolved, as the management of various international problems requires trans-Atlantic cooperation. Fortunately there are signs of movement toward this cooperation, although the signals are mixed on the U.S. side.

The European Centre for Minority Issues (ECMI) and the Romanian Department of Inter-Ethnic Relations (DRI) organized the third event of the Improving Inter-Ethnic Relations through Enhanced Minority Governance Project on 16–17 March 2005 in Sinaia, Romania. The head and both deputy heads of the DRI attended the roundtable along with numerous members of the human rights/minority rights NGO community. Additionally, some members of national minority organizations attended. The fundamental purpose of the meeting was to provide civil society an opportunity to discuss the draft law with representatives of the Romanian Government and to offer suggestions to improve the draft. It was noted that this was the first time that civil society organizations national minorities have been able to have a forum to discuss a draft law before it was presented to parliament. This report seeks to provide an account of the discussions that took place during this meeting.

ECMI and the DRI organized the second event of the “Improving Inter-ethnic Relations through Enhanced Minority Governance” project on 17–19 March 2005 in Sinaia, Romania. The head and both deputy heads of the DRI attended the roundtable along with national minority members of the Romanian Parliament and representatives of the national minority organizations represented on the Council of National Minorities. There were two fundamental purposes for the meeting. One was to provide the group with background information on the three major issues that will feature in the draft law on the status of national minorities, namely: defining a national minority; the status of national minority organizations under Romanian law; and cultural autonomy. The second purpose was to facilitate dialogue between the national minorities and the government concerning these main issues to be addressed in the draft law, so as to allow the government to hear the concerns and wishes of the national minority groups. It was noted that this was the first time that national minorities have been able to have a forum to discuss a draft law before it was presented to parliament. This report seeks to provide an account of the presentations and discussions that took place during this meeting, including some of the theories and practicalities of differing forms of definition, laws concerning NGOs and political parties, and models of cultural autonomy used in European states.

Abstract:
ECMI organized the first event of the “Improving Inter-Ethnic Relations through Enhanced Minority Governance” project on 3 February 2005 in Bucharest, Romania. The deputy prime minister, the head of the Department for Inter-ethnic Relations and four members of parliament attended the meeting. ECMI and two experts met with the group in the Government Building to discuss the issues surrounding cultural autonomy and the draft law on the status of national minorities. The purpose of the meeting was to provide the government with information concerning the issue of cultural autonomy for the draft law on the status of national minorities, which is currently being drafted by the Hungarian Democratic Union from Romania (UDMR) and the other 18 national minority parties represented in the Chamber of Deputies. This report seeks to provide an account of the presentations and discussions that took place during this meeting, including the theory and practicalities of cultural autonomy and the model of cultural autonomy used in Estonia.

10115. National Minority 'Regions' in the Enlarged European Union: Mobilizing for Third Level Politics?

Abstract:
The Laeken Declaration adopted by the European Council in December 2001 recognized, for the first time in European Union (EU) history, regions as potential co-architects of a new and more democratic EU. The Laeken Declaration also initiated the Convention to draft a new Constitution for Europe. The Constitution was negotiated during the Intergovernmental Conference and presented to the citizens of Europe in June 2004. On 29 October 2004, it was signed by heads of states and governments and sent to parliaments for ratifications and referenda. The Constitution provisions an expansion of the principle of subsidiarity affording greater influence to European citizens residing in self-administering and self-governing regions. Article III-270 of the Constitution will empower the Committee of the Regions (CoR) to petition the European Court of Justice (ECJ) on policy matters violating the principle of subsidiarity as laid out in the Constitution. This could become a substantial empowerment of European regions. Although most national minorities do not constitute designated European regions and the Constitution may not be ratified anytime in the near future, the envisaged empowerment of the CoR may nevertheless contribute to a redefinition of the national minority political space. With some of the new members and accession states representing 'regions' of strong national minority identities, the EU may be facing new challenges of integrating diversity. The influence of national minorities in the decision-making processes may therefore assume relevance in the enlarged EU.

10117. The EU in Moldova - settling conflicts in the neighbourhood

A key objective of the European Union is to have a stable, secure, prosperous and democratic neighbourhood. Failing an offer of accession to close neighbours in the medium term, the EU should and can offer stronger CFSP engagement. Contributing to conflict resolution in the neighbourhood is key to the achievement of EU objectives. However, the conflict resolution dimension of the ENP is under-developed. It is time for the EU to focus on the conflicts in its immediate neighbourhood. Promoting the security aspect of ENP can start with the Transnistrian conflict in Moldova. This conflict is the closest geographically to the EU; at the same time, it is the most 'solvable.' The conflict features high on the agenda of EU-Russia and EU-Ukraine relations. A settlement of the conflict in Transnistria would attenuate the soft security challenges the EU faces on its eastern border. Settlement would also assuage an irritant in EU-Russia relations, and set a positive precedent in building the EU-Russia common space for external security. It would also be an example of positive cooperation with Ukraine under ENP. The focus of EU policy should be to alter the context in which the conflict is situated and sustained, rather than hoping for an early agreement on the status of Transnistria. The primary objective should be to increase Moldova's 'attractiveness' while decreasing the benefits of maintaining the current status quo. The Transnistrian separatist project is to a large degree based on false economic arguments for independence. Undermining these claims will be central to efforts to reunify the country. The EU has already appointed an EU Special Representative for Moldova and is expected to launch an EU Border Assistance Mission to Moldova and Ukraine that would monitor the border between the two countries, including the section controlled by the secessionist authorities of Transnistria. EU border monitoring is necessary, but is not a sustainable long-term solution. The EU should help Moldova strengthen its own capacity to control the Transnistrian section of the border by launching an EU Police Mission to Moldova. Building a sustainable context for the resolution of the conflict in Transnistria can be achieved through greater support to Moldova's Europeanisation and implementation of the ENP Action Plan, more active support to democracy inside Transnistria and greater engagement with Ukraine under CFSP.

With the European Union's enlargement eastwards and southwards, its neighbourhood now stretches from the Balkans to the south Caucasus, and from Russia to the southern Mediterranean. The EU's eastern and southern neighbourhood is composed of areas which, to a greater or lesser extent, have serious deficits in security, development and democracy. There are many types of security problems, ranging from weak states and rampant international crime to spoilers in post-conflict reconstruction and unpredictable authoritarian leaders who pursue regime security often at the expense of national or regional security. In terms of socio-economic development, most of the countries in the EU's neighbourhood are fragile, often struggling with the effects of black market economies and cronyism, and burdened by bloated defence and security sectors that escape any accountability. As regards political systems, the EU's neighbourhood is composed of regime types ranging from new but weak democracies to regimes with authoritarian features and limited political participation.

Abstract:
In a famous speech to the United Nations General Assembly on 23 September 2003, UN Secretary-General Kofi Annan launched a reflection process on the future of the organisation. He pointed out: we have come to a fork in the road. This may be a moment no less decisive than 1945 itself, when the United Nations was founded. At that time, a group of far-sighted leaders, led and inspired by President Franklin D. Roosevelt, were determined to make the second half of the twentieth century different from the first half. They saw that the human race had only one world to live in, and that unless it managed its affairs prudently, all human beings may perish. So they drew up rules to govern international behaviour, and founded a network of institutions, with the United Nations at its centre, in which the peoples of the world could work together for the common good. Now we must decide whether it is possible to continue on the basis agreed then, or whether radical changes are needed.

1. On 8th December 2003, the Council mandated that the EU's military rapid response capability should be further developed. Separately, UK, France and Germany have considered how the Union can contribute further to conflict prevention, peacekeeping and peace enforcement operations in close co-operation with the United Nations (UN). Together, we have proposed that the EU should aim to build upon the precedent set by Operation ARTEMIS in the DRC by developing a number of battle-group size forces available to undertake autonomous operations at short notice, principally in response to requests from the UN. These forces should be capable of operating under a Chapter VII mandate. 2. This paper aims to set out in more detail the battle-groups (BG) concept, to establish its context within the ongoing development of EU rapid response and EU-UN co-operation, and to propose a process of consultation (including with the UN) and implementation.

Since the invention of the wheel, technical innovations have driven the history of mankind. Some of them have been particularly important and have changed profoundly the way societies work and individuals live. The Internet is a perfect example of such an innovation. Based on common protocols to send electronic messages and identify machines, it has opened up a new area of communication and information, enabling us to transfer vast amounts of digital data for a great variety of applications within fractions of a second around the globe. Moving into the new domain of cyberspace, the Internet has overcome the barriers of distance and time, and is therefore rightly considered to be the symbol of globalisation.

The Cold War is finally ending in Europe and the shape of a new order is visible. Certainly, its institutional structure is different from that of the bipolar era or even the transition years of the 1990s. The North Atlantic Treaty Organisation (NATO) is assuming a more global profile and less direct responsibility in Europe itself. This occasional paper of the Geneva Center for Democratic Control of Armed Forces attempts to consider defence procurement in its modern political – military setting. Since the fall of the Berlin Wall most European countries no longer regard the defence of their territory and independence as the overriding priority it had during the Cold War. The role of military forces has changed considerably. Collective defence focused on reliable capabilities of 'forces in being' and effective mobilisation and, in the case of NATO, on integrated planning and command structures. Today, the protection of national territory has a new dimension in the face of terrorist at tacks, and in the case of the US, by the programme for missile defence. Everywhere the link between external and internal security has become closer.

While there is a wide consensus today on the basic principles of democratic policing there is no blueprint of international standards of policing or internationally accepted organisational scheme to which a police in transition looking for guidance could simply seek to conform. Beyond many differences originating from history and political regimes, what exists instead - and can serve as guidance - are best policing practices as well as trends in organising a police service. In fact, as I would like to argue, Western police are experiencing dramatic changes since two decades, changes that affect the organization and the practices profoundly. Police services are indeed reorganized using the conceptual framework of “processes and services” rather than the traditional silos of exclusive competencies between various police branches. Starting from services such as local security, rapid intervention, crowd control and the fight against serious, complex and organized criminality, the architecture of police forces is being remodelled by reformers. Judiciary competencies have ceased to be the basis of a rigid division between the judiciary police and the uniformed police, but, as we will see below, the uniformed police are tasked today with new competencies as a result of a process-oriented reorganisation. This led to a 180 degree shift in the policing architecture: once conceived vertically in hermetic silos of competencies, services are conceptualized more horizontally, process-oriented, cross-cutting competencies.

This chapter pursues developments of Danish civil-military relations to identify changes in the degree of military influence. Two case studies are put forward. The first case deals with long-term change processes in the field of civil-military relations. In this case study, four major areas are investigated: the personnel composition of the Danish defence, its expenditures per capita, its organisational structure, and military participation in defence commissions. Changes in all four areas are pursued over the last-half century revealing increased military influence in Danish civil-military relations. A striking indicator of this development is the case of top military disobedience in 2001, which constitutes the second case study entitled 'Military disobedience of the Danish defence commander'. The consequences of the major military influence for three actors: 'politicians', 'media', and the 'armed forces' are discussed and it is argued that neither of them gains from the increased military influence, not even the professional soldiers. The reported extreme of military behaviour contrasts many examples of military respectful democratic decision-making. Reasons for the military disobedience may be explained by the distinction 'to have' or 'to exercise' democratic control, where the former is the proper type of democratic control of the armed forces and not the latter as wrongfully perceived by the former Danish Joint Chief of Staff (JCS).

Transposition research provides an excellent opportunity to bring new data to bear on two of the most dominant theoretical approaches to European Union studies: rational choice institutionalism and sociological institutionalism. Yet the goal of comparable testing is hampered by the underspecified nature of the sociological perspective. This paper takes some steps towards identifying and operationalising a sociological explanation of the transposition of EU directives. Examining an array of alternatives, we single out an approach that focuses on the transmission of norms as a way to explain transposition delay and content changes, and on persuasion to help explain norm change over time. To probe the validity of our explanation, we apply it to a case study of the transposition of two anti-discrimination directives from 2000 in Slovakia. In short, our paper aims to move forward the search for a testable sociological framework in EU studies, while offering an operational approach to studying the process of transposing EU directives.

The unequal access of interest organizations to the EU institutions is often associated with biased European politics. Nonetheless, systematic accounts of interest group access are rare. Rooted in the organizational theory of resource dependencies and drawing on a survey of 800 EU and national business associations, the article presents a broad conception of European political exchange to explain the contact patterns. Ordinal regressions indicate that three dimensions shape these patterns–organizational characteristics, sectoral-economic features, and national modes of interest intermediation. Nonetheless, EU interest intermediation displays only very few general traits–these are the division of labor among EU and national associations, the economic clout, the financial resources and the expertise of interest groups as well as their political mobilization when they face of EU regulation. Else, the interaction patterns vary along the EU institutions and their levels of decision-making underscoring the importance of the institutional opportunity structure.

The failure of the Raffarin Government to respect the Stability and Growth Pact (Stability Pact, SP), its call for the Pact's reconceptualisation, reform of the management of the Euro-zone's monetary policy and EU-level reflation should be seen not as a significant change in French policy on 'gouvernement économique' (that is, EU-level economic governance (GE) but as a reassertion of long standing but contradictory French preferences. French policy-makers have been caught in a dilemma with regard to the construction of the Economic dimension of EMU between two strong preferences: on the one hand the supranational consequences of a dirigiste approach to macro-economic policy and, on the other hand, a Gaullist reflex to retain sovereignty as much as possible and to insist upon intergovernmentalism in EU-level macroeconomic policy-making. The 'price stability' function of GE as embodied by the Maastricht Treaty rules on convergence and the SP has been consistently marginalized in the discourse of French governments of both the Right and Left. Rather EG has been presented in five overlapping ways which can all be seen in terms of the paradox of the French pursuit of both reinforced macroeconomic policy coordination at the EU level yet also national margin of manoeuvre through intergovernmental policy making. Crucially, this paradox also explains the lack of clarity and inconsistency in French pronouncements on GE. Most elements of the 2002 Commission and Ecofin SP reform proposals and the precise elements of the Pact reform finally agreed in March 2005 met with French approval given that they render the SP more flexible allowing greater margin of manoeuvre in the development and implementation of the Broad Economic Policy Guidelines (BEPG) and the application of the Excessive Deficit Procedure (EDP), thus better meeting French intergovernmentalist preferences on EG but undermining the coordination of national macroeconomic policies that could contribute to an effective policy mix with the ECB's monetary policy.

Process tracing is in, acquiring near buzz-word status in certain circles. Europeanists do it; IR scholars do it – all with the goal of bringing theory closer to what really goes on in the world. This makes our scholarship more policy relevant and increases the reliability of our findings - non-trivial advantages, for sure. Yet, such benefits do not come without costs. In particular, proponents of process tracing should be wary of losing sight of the big picture, be aware of the method's significant data requirements, and recognize certain epistemological traps inherent in its application.

This article presents some key research questions and discusses some advancements and controversies in the field of implementation studies in the European Union. In addition to calling for the further development of reliable quantitative indicators, the article suggests three issues worth considering. First, research could benefit from paying increased attention to the processes shaping the goals and aspirations in European implementation. Second, we should increase attention to the interplay between different explanatory mechanisms and in particular to the crucial roles of ambiguities and domestic capabilities. Finally, we should increase our interest into the study of outcomes and goal achievements, and thereby also offer critical and refreshing views on the dynamics of the actual European integration, as well as link this branch of research to the general research on legitimacy and democracy in Europe.

This study offers an organisation theory approach that claims that the differentiated organisational constellation of the European Union contributes to a differentiated Europeanisation of domestic core-executives. It is argued that the European Commission mainly activates the lower echelons of the domestic government hierarchies, notably professional experts within sector ministries and agencies. Furthermore, the European Commission arguably weakens domestic politico-administrative leadership, the Foreign Office and the Prime Ministers Office. By contrast, the Council of Ministers arguably strengthens domestic politico-administrative leadership, the Foreign Office and the Prime Ministers Office. A comparative analysis of the decision-making processes within the central administrations of Norway and Sweden is offered. Based on a rich body of survey and interview data this analysis reveals that multi-level interaction of administrative systems between the European Commission and the Norwegian and Swedish central administrations occur largely outside the control of the domestic politico-administrative leadership, Prime Ministers Office and Foreign Office. In Sweden this tendency is to some extent counterbalanced by the inter-sectorally interlocking effect of the Council of Ministers.

International cooperation rests on state preferences with regard to the substantive scope, geographical range, and institutional depth of issue-specific devices to over-come collective action problems. Substantive broadening, geographical widening, and institutional deepening are the elixir of life of the European Union. As is familiar from international cooperation more in general, and not only from European integration, this rests upon a complex process of bargaining among states, each of which has its particular preferences. This paper explores two hypotheses about the relationship be-tween preferences on broadening, widening, and deepening. The first hypothesis as-sumes that the relationship is characterized by a virtuous cycle, while the second hy-pothesis assumes that there are tradeoffs rather than synergies. By looking at a sample of 24 distinct case studies from a specific policy field, namely international coopera-tion against drugs, the paper shows that, at least in this particular policy field, state preferences follow a synergetic pattern of broadening, widening, and deepening.

Since its inception in 1995, more than 330 disputes have been raised under the WTO Dispute Settlement System. The major players in world trade–the EU and the USA–are also the busiest users of this instrument. After looking at links between economic integration and WTO involvement and a survey of the actual transatlantic WTO trade disputes, the welfare implications of the four most prominent trade disputes between the EU and the USA ("mini trade wars") are analyzed with GTAP5: the Hormones, the Bananas, the FSC and the Steel cases. The economic analysis reveals that the level of suspension of concessions hardly coincides with the level of nullification or impairment (expressed in lost trade effects) if one considers the overall welfare implications of retaliation with tariffs. The idea of "rebalancing" retaliation is a myth. Tariffs are a very bad instrument of retaliation. Maybe a mechanism of direct transfers or financial compensation would be better.

This article aims to develop a coherent explanation of the impact of the EU on Turkey's politics between 1987 (the year Turkey applied for EU membership) and 2004, providing a more profound analysis of Turkish political transformation within the framework of its relations with the EU. It integrates Moravcsiks' work on the human rights regime in post-war Europe with Risse's theory on communicative action in world politics to provide an alternative explanatory framework for recent political transformation in Turkey. It will be argued that the main dynamics driving recent democratisation in Turkey were its newfound location within the European human rights regime—a result of having been granted the right to individual petition to the European Court of Human Rights just before its 1987 membership application—and the increasing power of European argument as an alternative way of resolving domestic political conflicts in Turkey.

This paper reports newly collected empirical data sets on explicitly contested voting at ministerial level in the Council of Ministers of the European Union. These data sets cover the period 1994-2004, with more detail for the years 1998-2004. They provide us with rather steady patterns of explicitly contested voting across the period in terms of: proportions of decisions taken where contested voting was recorded; the different levels of contestation by country; and the issue areas in which explicit voting occurred more often. The data sets draw on the material available on the Council's own website, but they have been supplemented by hand-collected data, in particular as regards issue areas and types of decision. Once arranged appropriately the data sets will be posted on the web, so that other researchers can have access to the material. The initial analysis of the data is reported in the second edition of Hayes-Renshaw and Wallace, The Council of Ministers, Palgrave, forthcoming, Chapter 10. The data show that explicit voting on agreed decisions at ministerial level is rather rare, that in nearly half the roll calls dissent is expressed only by singleton member states, that nearly half the cases concern 'technical' decisions on agriculture and fisheries, and that Germany more often votes 'no' or abstains than any other member state. The data confirm that ministers generally endorse collective decisions by consensus, even on the 70% or so cases where they could activate qualified majority voting (QMV). To the extent that voting takes place in these latter cases, it occurs implicitly rather than explicitly, operates mostly at the level of officials rather than ministers, and is not recorded systematically in publicly accessible form. These patterns are consistent with earlier accounts based on qualitative interview evidence.

Germany's unique institutions of a 'unitary federal state', long considered part of the country's post-war success story, are now generally perceived as a 'joint decision trap' impeding effective policy responses to new economic and demographic challenges at both levels of government. Nevertheless, a high powered bi-cameral Commission set up in Autumn 2003 failed to reach agreement on constitutional reforms. The paper analyses the misguided procedural and substantive choices that explain the failure of reform, and it discusses the possibility of asymmetric constitutional solutions that might enhance the capacity for autonomous action at both levels.

The recent period of Europe an integration has witnessed the attempt by elites to formalise the long-standing trend towards a constitutionalisation of the European Union. The paper asks whether this process of constitutionalisation, together with a twin process of territorialisation – the development of the EU as bounded political space – can be seen as a move towards state- building at the European level. In order to address these issues, the paper assesses in turn the significance and the impact each of the two processes may have on the 'remaking' of Europe. In this context, the EU's Nordic Dimension, the debate surrounding the Turkish application for EU membership and the evolving Neighbour Policy of the Union are looked at in more detail. By way of conclusion this paper argues that the discourses – rather than the decisions – which have dominated the integration process in recent years, mark something of a departure from the previous 'post-Westphalian' path of European integration, and instead point towards a more statist conception of the Europe an Union. It remains to be seen to what extent these discourses will subsequently have ramifications in normative, institutional and policy-terms, and what resistance to the choices implicit in these discourses will have to confront.

Language minorities can be found as evidence of unfinished nation-building in relatively closed territorial settlements all over contemporary Europe. From a comparative perspective, different paths of accommodating linguistic diversity can be followed resulting in very dissimilar regimes of legal, political and cultural recognition. In recent years, standardisation of minority protection has taken place, with a new emphasis on the values of linguistic diversity, non-discrimination and tolerance. As will be argued, the expanding rights of language minorities must be understood in relation to a re-structuration of nation-states in Europe and a re-evaluation of difference in the course of European integration. The confrontation with internal diversity and the confrontation with a Europe of deep diversity are closely interlinked setting the conditions for the unfolding of a new politics of recognition towards language minorities. This changing minority-majority relationship and the related processes of Europeanization of opportunity structures for the political and cultural mobilisation of language minorities shall be analysed with reference to specific case studies from Germany, France and Spain.
