1. Parliamentary Elections in Sri Lanka During COVID-19

Sri Lanka’s most recent parliamentary election was held Aug. 5, 2020, after two postponements due to the COVID-19 pandemic. At the district level, 196 members were elected through a proportional representation (PR) system, and 29 were appointed through a national list. Former President Mahinda Rajapaksa was sworn in as prime minister Aug. 9 after his party, the Sri Lanka Podujana Peramuna (SLPP), secured 59 percent of the popular vote and 145 seats in Parliament. Overall, election observers commended the Election Commission of Sri Lanka’s (ECSL) efforts in conducting safe elections during the pandemic. Despite this success, challenges in election implementation also underscored changes that the ECSL should consider to ensure high level of participation and electoral integrity in future electoral cycles during crisis situations. To assess adaptive measures taken by the ECSL, challenges and key lessons learned, the International Foundation for Electoral Systems (IFES) published Parliamentary Elections in Sri Lanka During COVID-19: Case Study on Crisis Management in Elections, which includes in-depth literature reviews from various sources, examination of the Sri Lankan national legal framework, assessments of international and national election observer reports, examination of public health guidelines issued by the Ministry of Health in Sri Lanka (MOH) and regulations and guidelines issued by the ECSL for voters, poll workers and other stakeholders. IFES gathered information based on the firsthand experience of providing technical support to the ECSL on a series of election operation efforts in the 2020 electoral period. The paper informed the identification of good practices implemented by the ECSL during the 2020 parliamentary election and lessons learned for future elections during times of crises.

Abstract:
Sri Lanka has taken some positive steps to address significant gaps in women’s electoral representation and achieve greater gender equality. One such step is the introduction of a quota at the local government level, and a new electoral system with a quota at the provincial level. However, women in Sri Lanka continue to face serious barriers to political representation, and the country ranks among the lowest in the world for the percentage of women in national legislatures. For example, the most recent parliamentary elections in 2020 resulted in just over 5 percent of elected women representatives in Parliament. This persistent underrepresentation of women combined with other recent trends — such as negative impacts of the global COVID-19 pandemic that further exacerbated gender inequalities — underscore the need for targeted action. To help inform stakeholders’ efforts to sustainably promote women’s political leadership and participation in Sri Lanka, the International Foundation for Electoral Systems (IFES) published a research paper, Women’s Political Representation in Sri Lanka: Electoral System Analysis and Recommendations, which analyzes the current standing of women’s representation and the main reasons behind the underrepresentation of women in politics, and offers recommendations for how to address the underlying and persistent barriers.

Abstract:
Based on international standards and good practices adopted worldwide, the International Foundation for Electoral Systems (IFES) applies its Technical Election Assessment Mission (TEAM) methodology to assess electoral environments. Using the TEAM model in Serbia, IFES assessed core areas of the electoral process — analyzing both the legal and regulatory framework and implementation practices — to provide technical support and recommendations for stakeholders and interested parties to strengthen electoral transparency and integrity. The report’s analysis and recommendations are designed to be addressed through the election reform process and relevant institutions, but also with tailored interventions facilitated by IFES, such as training, capacity building, civic awareness-raising and advocacy.

Abstract:
Conflict and violence monitoring and early warning systems can save lives. Gender-sensitive indicators help provide nuanced and complete contextual information to strengthen the systems’ predictive capacity, but their integration has been infrequent and inconsistent. Overlooking gender in early warning risks ignoring gender norms or behaviors that contribute to violence. It further risks formulating policies and responses that do not account for the differential needs and experiences of women, men, girls and boys. Simply put, we must integrate gender in early warning systems, and the alternative is dangerous.

Contentious elections are a stress test for governments. Trust is hard won, easily lost and very difficult to restore. Election audits can enhance voters’ confidence in the results, if they are grounded in the law and performed by well-trained officials, and follow a predictable, transparent and observable process. A new guide from the International Foundation for Electoral Systems (IFES) focuses on the risk-limiting audit (RLA), a type of post-election tabulation audit that relies on statistical evidence to confirm that the election outcome is correct. Compared to other types of audits, RLAs can be more effective and efficient. The U.S. has been the primary laboratory for RLA testing, with more than 60 piloted and 10 states currently requiring or allowing them. A long-time partner of election administrators around the world, IFES is dedicated to expanding the range of tools available to reinforce confidence in the electoral process and ensure that outcomes reflect the will of the voters. Risk-Limiting Audits: A Guide for Global Use considers how RLAs could have global application and utility – particularly to build trust in election results. The guide provides a basic framework for testing RLAs in diverse contexts by outlining foundational prerequisites and operational, legal and regulatory considerations. IFES will continue to refine and expand on this primer as new findings emerge.

8. Electoral Rights of Environmentally Displaced Persons

Abstract:
Environmental disasters such as fires, droughts, floods, hurricanes and rising sea levels displace more and more people each year. According to the University of Oxford, the scale of displacement related to climate change is difficult to forecast but has been “estimated at between 50 and 200 million people by 2050, mostly in developing countries.” Climate change, other environmental crises and migration resulting from environmental displacement increase the likelihood of insecurity and conflict – and put democratic rights at risk. A new paper from the International Foundation for Electoral Systems, Electoral Rights of Environmentally Displaced Persons, examines these questions and provides recommendations for election management bodies, governments, international organizations, political parties, the media, civil society organizations and displaced persons. Environmental challenges can exacerbate pre-existing vulnerabilities, including marginalization due to race, gender, disability and other identity factors. Widely ratified international treaties and resolutions obligate the state to provide accessible electoral processes, including special measures for women, persons with disabilities, youth, Indigenous peoples and racial and other minorities who may be at increased risk of marginalization. They also are critical agents to address the consequences of climate change. Electoral Rights of Environmentally Displaced Persons emphasizes how environmental challenges can exacerbate pre-existing vulnerabilities, including marginalization due to race, gender, disability and other identity factors. Displaced persons are key stakeholders. Those most affected by environmental problems need to be able to vote, run for office and engage with candidates and elected representatives to influence agendas, challenge policies and hold governments accountable. Political participation is particularly important in integrating them into their new environments to avoid conflict with host communities. Displaced persons can also bring skills, insights and talents that benefit their new communities.

Abstract:
The Democratic Republic of the Congo’s (DRC) 2018-19 elections were followed by the country’s first peaceful and democratic transfer of executive power. However, the elections – particularly their results management – were widely criticized. While voters appear to have ultimately accepted the results, lingering uncertainty could depress future voter turnout and undermine the current government’s authority. This post-electoral period offers an unprecedented opportunity to initiate broad electoral reforms to shore up the credibility of future elections. A white paper from the International Foundation for Electoral Systems (IFES) analyzes the DRC context and finds that the government or Parliament could initiate the reform process. IFES then highlights comparative examples of electoral reform from Kenya, Senegal, Nigeria and Côte d’Ivoire and presents considerations and recommendations for the DRC. Given that truly inclusive, sustainable and holistic electoral reform could take years to complete, the process should begin now to ensure more credible, transparent elections in 2023 and beyond.

Preventing Government Corruption in Crises, the fifth paper in the International Foundation for Electoral Systems’ (IFES) COVID-19 Briefing Series, looks closely at this question and offers guidance for democracy and governance practitioners, policymakers and supporters. Corruption undermines the efficiency and efficacy of government, which, in the short term, can derail the response to a public emergency. It also drives distrust in democratic institutions, including legislatures, executive agencies and courts. As a result, corruption by bad actors in public office – whether for personal or political gain – has the potential to damage the credibility and integrity of governments long after the immediate crisis has passed. The long-term ill effects of political corruption must not be ignored, given the potential for state capture and the entrenchment of incumbent regimes. This risk is especially concerning as many elections have been postponed and modified as a result of the health crisis, subverting the ultimate accountability measure for governments. The unprecedented volume of funds being deployed to address the COVID-19 crisis and bolster economies creates new opportunities for exploitation and undermining of accountability mechanisms in several key areas.

Preserving Independent and Accountable Institutions, the final paper in the International Foundation for Electoral Systems’ (IFES) COVID-19 Briefing Series, looks closely at this question and offers guidance for independent institutions as well as legislatures, executive agencies, special task forces and the international community. While their role is not always acknowledged directly, independent institutions that undergird the democratic process — anti-corruption agencies, human rights institutions, supreme audit institutions and election management bodies, among others — have important roles to play in responding to all of the challenges presented in this series. When functioning properly, they can ensure safe, secure and trustworthy elections; bolster government transparency and information integrity; protect political rights; provide checks on government; and ensure the continuation of democratic processes during a crisis. When they lack the independence, resources or accountability mechanisms to be effective, they may be unable to play this essential role, now or over the longer term of crisis recovery. While these independent institutions usually operate in complex and often politicized environments, by design, they have faced unique challenges during the pandemic that impact their autonomy and accountability.

The COVID-19 pandemic has reinvigorated debate around alternative voting methods. A growing number of democracies successfully operate distance voting, in which ballots are delivered to voters’ home and voters then return ballots by mail or in person. The most effective administrations have scaled up operations over several electoral cycles, incrementally calibrating and perfecting capacity and safeguards. However, COVID-19 has suddenly increased demand for this complex election service. Election authorities, voters and politicians should therefore be cognizant of the risks and rewards associated with rapidly scaling up distance voting. After decades of power centralized in the executive, the Maldives’ 2008 Constitution introduced separation of powers and created “independent institutions to monitor the three branches of power and safeguard human rights.” The Election Commission, Anti-Corruption Commission and other independent institutions must have sufficient autonomy to operate effectively and carry out their mandates without susceptibility to undue influence. However, they are not immune from corruption, poor leadership or partisan behavior, and still require oversight to ensure accountability. Finding the correct balance between accountability and autonomy can be challenging, but it is essential to ensure that the institutions appropriately fulfill their mandates. In response to a request from Parliament, the International Foundation for Electoral Systems (IFES) conducted an extensive literature review, analyzed comparative practices and consulted stakeholders to develop a set of recommendations for effective parliamentary oversight of independent institutions. The resulting paper, Parliamentary Oversight of Constitutional Bodies in the Maldives, explores how parliamentary tools and mechanisms can be effectively tailored to provide the appropriate level of oversight. The paper has recommendations and lessons that are broadly applicable outside the Maldivian context, and helped inspire the development of IFES’ Autonomy and Accountability Framework. Because constitutional bodies have a unique role to play in bolstering good governance, any improvement to their performance will improve the quality of democracy as a whole and help prevent corruption, improve service delivery and increase transparency and rule of law. IFES’ Autonomy and Accountability Framework helps countries achieve this in practice.

17. Abuse of State Resources Research and Assessment Framework

Abstract:
The International Foundation for Electoral Systems (IFES) recently concluded a two-year Technical Leadership project examining the abuse of state resources (ASR) in election campaigns. This research initiative, led by the Center for Applied Research and Learning and funded by the United States Agency for International Development under the Global Elections and Political Transitions mechanism, focused on ASR (sometimes referred to as administrative resources) for the purpose of gaining an electoral advantage. The Abuse of State Resources Research and Assessment Framework: Guidelines for the Democracy and Governance Community of Practice is an abbreviated companion document to the complete Abuse of State Resources Research and Assessment Framework developed in this effort. Both documents are based on in-depth, comparative analysis of laws and regulations that target ASR in election campaigns and the effectiveness of these provisions in deterring or remedying these abuses. In many countries, uses of state resources during electoral periods are not sufficiently regulated and enforcement of violations is weak or nonexistent due to deficits of political will or limited capacity of oversight institutions. As highlighted in an IFES publication, individuals and parties in power may capitalize on these gaps to marshal public goods – including state personnel, state funds and physical assets, and official government communications – in service of political campaigns. Beyond undermining electoral competitiveness, another often-overlooked component of this abuse of power is the role elections play in cycles of entrenched corruption. Not only do abuses during the campaign period undermine competitiveness by conferring an unfair electoral advantage, they threaten the appropriate distribution of government services and do long-term damage to the legitimacy of governance institutions. This is because abuses do not stop after parties use the assistance of the state apparatus to win elections; corrupt politicians subsequently use their access to levers of the state to enrich themselves and distribute perks to supporters. The cycle of government personnel, media, and other resources being used in service of political campaigns is then likely to continue. This ASR assessment tool focuses on legal and regulatory provisions specific to ASR, but it also delves into some other common areas of abuse (for example, government procurement and contracting, public works spending around elections, campaign finance, and vote buying). These guidelines were designed for use by international and domestic civil society actors, implementers, and advocates to evaluate the effectiveness of the ASR legal framework in a given country and develop additional tools for monitoring and advocacy. This shorter version of the tool will help these groups identify priority issues and vulnerabilities that they can use in developing their strategy for monitoring, addressing, and/or advocating for measures to mitigate ASR. Findings could also point to specific recommendations for improving transparency and enforcement surrounding ASR, including enhanced training programs, strengthened regulatory provisions, investments in investigative journalism, and increased transparency in public procurement.

18. Lebanon’s 2017 Parliamentary Election Law

A new Lebanese government was established in December 2016 and enacted a new election law in 2017. The new law will be in force for parliamentary elections scheduled to be held on May 6, 2018, the first since June 2009. The law’s passage is a significant achievement when considering the fragmented, complex and shifting nature of Lebanon’s politics, which is dominated by two major political and electoral alliances and overlaid by regional rivalries. The new law, however, is not likely to change the political landscape or bring an end to confessionalism in politics, which remains the overall goal in the country’s Constitution. Mechanisms for election dispute resolution (EDR) must increasingly withstand new forms of sophisticated political and electoral manipulation, most recently illustrated by the Cambridge Analytica whistleblower claims, but previously highlighted by the International Foundation for Electoral Systems (IFES) as a growing concern around the globe. Hence, the right to receive an effective remedy in the elections context, through the efficient and transparent administration of justice, has become even more fundamental. This involves both the protection of procedural justice (for individuals involved in an election dispute or accused of a violation) and the advancement of open justice (for the public at large, which has a stake in the legitimacy of the election process and outcome). This new IFES research paper, Elections on Trial: The Effective Management of Election Disputes and Violations, outlines the fundamental principles for procedural justice and open justice in election cases. Significant attention is often paid to the independence and impartiality of judges or arbiters making decisions on election cases, while the mechanisms through which these cases are managed and publicized are often overlooked. To address this knowledge gap, IFES conducted preliminary comparative desk research on the case management of election dispute resolution in six countries: Mexico, Tunisia, Kenya, Macedonia, Kosovo, and the Philippines, to better understand how case management processes and platforms can help translate established procedure into actual practice. This research was made possible by the generous support of the American people through the United States Agency for International Development under the Global Elections and Political Transitions Program. Institutions dealing with election disputes and violations face enormous challenges as election litigation increases, and as political actors find new ways to undermine the process or to simply ignore laws and rules in place. It can be an extremely difficult task to balance all the different components of procedural justice and open justice in a way that ultimately ensures a just and transparent process for all litigants. The paper presents comparative information illustrating these principles in practice, discusses case management tools and techniques, and provides recommendations for election management and EDR bodies seeking to strengthen the processes and platforms through which elections disputes and violations are resolved.

20. New Report on Abuse of State Resources Assessment in Bosnia and Herzegovina

This report details findings from an Abuse of State Resources Assessment conducted by the International Foundation for Electoral Systems (IFES) in Bosnia and Herzegovina (BiH). As part of a two-year research effort, IFES recently developed a detailed methodology for evaluating a country’s legal framework related to the abuse of state resources (ASR) in elections. Using this methodology, the report draws on detailed desk research as well as a field research mission to BiH in November 2017. Findings are focused on ASR legal provisions, oversight institutions, and enforcement mechanisms. To the extent possible, the report evaluates both the state (national) level of BiH and the entities of the Federation of BiH and Republika Srpska. While in BiH, the team conducted 15 interviews in Sarajevo and Banja Luka with a range of stakeholders. Assessment participants were confident that public awareness of ASR was high. There was general agreement, however, that – more than two decades after the conclusion of a devastating war – the public is largely resigned to accepting such misuses in exchange for peace. The 1995 Dayton Accords that ended the war created a uniquely complex political and electoral structure for the country that remains in place today. This structure creates additional challenges to preventing ASR in campaigns, as ethnic divisions in society are replicated in the political system. Voting blocs are considered pre-determined, so parties representing a particular set of ethnic interests cater to their own constituencies at the expense of broad or programmatic-based coalition building. There is a limited “opposition” willing to advocate against ASR, as essentially all political actors are both beneficiaries and victims of the abuse. This report focuses on three principles for detecting, deterring, and remedying ASR abuses in a manner commensurate with international standards. Principle 1 evaluates the legal framework for addressing three potential avenues for ASR: state personnel, state funds and physical resources, and official government communications. Principle 2 of this report focuses on oversight of the ASR legal framework by independent institutions. Principle 3 of the ASR methodology analyzes the effective enforcement of sanctions and penalties. This report also delves into key contextual features that impact ASR: the public service framework, campaign finance mechanisms, civil society oversight and advocacy, media environment and public information, and public procurement. An overall environment of impunity for perpetrators of the misuse of state resources during elections is further enabled by a variety of factors external to the legal and administrative system, which are explored in this section of the report. The remainder of the report offers a detailed recommendations list and a brief overview of the ASR assessment methodology, as well as an in-depth analysis on each of the areas described above. Based on this analysis, recommendations have been made to strengthen the legal framework with an emphasis on the rights and responsibilities of civil servants, explicitly regulating the use of state funds and other resources, strengthening mandates of oversight and enforcement bodies, creating incentives for improved enforcement, and strengthening weaknesses in the enabling environment that impact ASR.

ccording to the World Health Organization, one out of every seven people in the world has a disability, yet citizens with disabilities remain underrepresented in political life as voters, election observers, candidates and election officials. Mainstream observer groups often do not hire people with disabilities to serve as observers and only include basic, if any, questions on access for people with disabilities in their checklists. To ensure election observations account for the various barriers that women and men with disabilities encounter, the International Foundation for Electoral Systems (IFES), along with disabled person’s organization (DPO) partners around the world, has developed an Election Access Observation Toolkit. IFES’ Election Access Observation Toolkit provides a methodology for conducting standalone observations on accessibility, as well as questions for mainstream observer groups to incorporate disability inclusion into their missions. Drawing upon IFES’ experience conducting dozens of election access observations in countries around the world and international and regional standards for inclusive elections, the Election Access Observation Toolkit provides DPOs and election observer groups with the background and tools to effectively incorporate a disability rights perspective into domestic and international observation missions. The toolkit, supported by the Australian Department of Foreign Affairs and Trade, United States Agency for International Development and Global Affairs Canada, gathers lessons learned from election access observations conducted by IFES and DPOs in a wide range of country contexts, including Indonesia, Haiti and Kosovo.

In a new publication, the International Foundation for Electoral Systems (IFES) outlines strategies for election management bodies (EMBs) to strengthen their technology and procedures to resist vulnerabilities, by following what we have termed a Holistic Exposure and Adaptation Testing (HEAT) process. While no electoral process or technology is infallible, the HEAT process aims to secure automated or digitalized electoral processes – as far as possible – against unanticipated threats, illicit incursions, system failures, or unfounded legal challenges. As the name suggests, the HEAT process focuses on the types of exposure an EMB may face when implementing different types of technology systems (technology, human, political, legal and procedural exposure). This process encourages a more holistic assessment of what could go wrong in data and technology management and allows the EMB to identify strategies to reduce or eliminate different types of exposure in a systematic manner. Because the HEAT process seeks to provide a holistic approach to cybersecurity in elections, we have drawn lessons from international principles, election cybersecurity case studies, risk-mitigation methodologies and technology-related election court judgments. The proposed process is also guided by international best practices on data management and cybersecurity, as well as transparency, open data and privacy.

The high-profile annulment of the 2017 Kenyan presidential election surprised many election watchers in Africa and across the globe. All elections suffer from challenges and irregularities, to varying degrees of seriousness, including poll worker error, acts of God, and violence, without these challenges necessarily changing the outcome of the vote or leading to a full annulment. A decision to annul elections is one that should not be taken lightly as it can have serious consequences for democracy. Repeat elections impose unexpected costs on state budgets and candidates; the normal operation of legislatures and governments may be disrupted while a revote is organized; candidates may refuse to participate in the fresh elections, leading to a political crisis; and repeat elections may themselves be subject to irregularities. Most concerning, however, is the potential for bad actors to use annulment of results (under the guise of ensuring “secure elections” or as redress for “widespread irregularities”) as a tool to thwart the will of voters. This raises important questions: When are elections considered good enough? And what is needed to make a determination whether to validate or annul an election? The answer to these questions is not straightforward, and different jurisdictions have taken different approaches. In some contexts, there may be a readily quantifiable number of votes affected by one or more irregularities. In other cases, however, such as voter intimidation, cyberattacks, or electoral disinformation, determining the impact of an irregularity on an election will be difficult or impossible. With that difficulty in mind, it is critically important for jurisdictions to have clear and pre-determined rules governing when annulment is available as a remedy, both to ensure that annulment is available if needed, but also so that annulment is not misused to frustrate the will of the voters. A new International Foundation for Electoral Systems research paper outlines various legal approaches to election annulments, explores different grounds for annulment, and outlines procedural considerations for courts and adjudicators when determining whether to annul an election result, drawing on international principles and global jurisprudence.

The International Foundation for Electoral Systems (IFES) recognizes that violence against women in elections is a threat to the integrity of the electoral process – it can affect women’s participation as voters, candidates, election officials, activists, and political party leaders, and it undermines the free, fair, and inclusive democratic process. In an effort to better understand and address the ways in which electoral violence creates a barrier to women’s participation, IFES has developed the Violence Against Women in Elections (VAWIE) Framework to specifically identify and address the unique issues related to gender-based election violence. Through analysis and program implementation focused on increasing women’s participation and leadership in democracy assistance, the VAWIE Framework makes narratives of violence against women in elections in their homes, political arenas and public spaces more visible. This is part of IFES’ overall approach to electoral security, which is human-centered, in line with IFES' mission to support citizens' right to participate in free and fair elections, allows for a more holistic approach to security that covers all phases and activities of the electoral process and adheres to international standards and norms governing elections.

First Universal Democratic Elections in Independent Georgia offers a detailed overview of the first national democratic elections conducted in the Republic of Georgia in 1919. These elections served as an acknowledgement of Georgia's independence, which gave it autonomy for the next three years. The book portrays the spirit of multiculturalism being practiced in the lead up to and during the elections, through the development of campaign materials in several languages, such as Georgian, Farsi, Armenian and Russian, as well as allocating special quotas. It also reflects on how various ethnic groups were encouraged to represent their respective communities, with the participation of the Greek’s Democratic Party in elections offered as an example. The first democratic elections proved to be successful in creating gender parity for women and men of Georgia. Other impressive aspects of these elections were how well structured reimbursement procedures were developed for parties and other procedures were conducted professionally, practicing the principles of equality, accessibility and accountability. The book enables readers to get an insight into how Georgia’s newly established government tried to embark on an endeavor to build a democratic state, which would ensure prosperity and equality for its people. It also sheds a light on how advanced Georgian state bodies were in the first half of the 20th century, as the country strived for independence and development while being surrounded by the Russian and Ottoman empires. Representation and engagement of women and ethnic minority groups also serves as a best practice for that period. The book offers a wide range of visual materials, which provide a better understanding of processes and circumstances of not just elections, but the general political situation in the country and contains documentary materials and historical photos.

The right to an effective remedy is well established in international law, and stems from the fundamental rights of political participation and universal suffrage. It is the violation of these rights – intentional or otherwise – that necessitates a remedy to restore them. Election experts from the International Foundation for Electoral Systems (IFES) were invited to contribute four chapters to a publication of the American Bar Association’s (ABA) Standing Committee on Election Law, entitled International Election Remedies, published in November 2016. In “Measuring Effective Remedies for Fraud and Administrative Malpractice,” Senior Legal Specialist Katherine Ellena and Center for Applied Research and Learning Director Chad Vickery take on the difficult task of addressing what are effective remedies where fraud and malpractice affect the election. They emphasize the need for electoral remedies that protect the integrity of the process and electoral rights. In "Voter Registration," Michael Yard, a former chief of party in Kenya and Uganda, explains that registration of eligible voters is one of the most time-consuming activities undertaken by many electoral management bodies. To further explore this critical component of election administration, Yard explains the difference among passive, man¬datory and optional registration systems. IFES Indonesia Chief of Party David Ennis and former U.S. Elections Adviser Cameron Quinn describe in “Voting and Election Day” the balance between due process and the need for timeliness in addressing problems on Election Day.

This assessment served as the pilot test of the Abuse of State Resources Research and Assessment Framework assessment methodology, which was researched, developed, and peer-reviewed under the Global Elections and Political Transitions mechanism supported by the United States Agency for International Development. The International Foundation for Electoral Systems (IFES) and Democracy International (DI) have released a new joint white paper that identifies best practices for election audits in developing democracies. Election audits, which are increasingly used as a means of settling disputes about electoral results, are often conducted as ad hoc processes without clearly defined standards and procedures. In this collaborative effort, IFES and DI put forth recommendations to guide electoral management bodies in preparing for election audits. As the international community continues to support electoral processes in developing democracies around the world, it is critical to come to consensus on standards that should be applied both to assess the need for an election audit and to conduct such an audit. This white paper is the first effort at building that consensus. Elections in developing and post-conflict environments can offer countries a path to democracy and their citizens the prospect of a better life. The peaceful and credible resolution of electoral disputes is of special importance in these contexts, where legal frameworks for elections are sometimes ambiguous, the rule of law may be weak, and allegations of fraud are commonplace and frequently legitimate. Drawing on their extensive involvement in several recent election audits in developing democracies, IFES and DI seek to define the most important considerations for audits, based on the premise that they should be used only in limited circumstances and according to clearly defined and predetermined frameworks. Ad hoc audit processes, conducted absent a clear regulatory framework, can weaken the credibility of election outcomes and undermine the ability of new democracies to provide effective governance and to hold elected officials accountable to their citizens.

33. Nigeria Post-Election Survey

The mood in Nigeria is extremely upbeat following the peaceful conduct of the 2015 general elections, which led to the first democratic transfer of power in the country’s history. The International Foundation for Electoral Systems (IFES) conducted pre- and post-election surveys in Nigeria focusing on perceptions of electoral integrity, opinions of election administration, and satisfaction with Nigerian democracy. Knowledge Perception InfographicFrom the December 2014 pre-election survey to the July 2015 post-election survey, satisfaction with democracy more than doubled with a 56 percent majority expressing satisfaction with the way democracy works in Nigeria, up by 30 percentage points in the pre-election phase (26%). Similarly, while only 23 percent of respondents in the pre-election phase believed Nigeria is a full democracy or a democracy with minor problems, 51 percent now believe Nigeria is a full democracy (18%) or a democracy with minor problems (33%), marking a net increase of 28 percentage points. Perception Integrity InfographicNearly three-quarters of Nigerians believe that both election integrity and the organization of the elections were better in the 2015 than in the previous polls in 2011. And while the survey indicated voters had to wait for several hours to get accredited and vote on Election Day, overall, 83 percent of voters assessed their voting experience to be good or very good. Indeed, confidence in the Independent National Electoral Commission (INEC) also registered a sharp increase by 16 percentage points, moving from 68 percent in pre-election levels to an overwhelming 85 percent after the elections. From December 2014 to July 2015, public awareness of the INEC and its Chairman at the time of the elections, Professor Attahiru Jega, increased by 16 percent and 25 percent, respectively.

34. Analysis of the Status of Women in Burundi’s Political and Electoral Processes

Burundi is one of few countries in the world to have adopted a gender quota for its legislature in an effort to promote the inclusion and participation of women in the political process. As such, it presents an informative case study on the impact a gender quota can have as a catalyst for more progressive and inclusive governance. Given the International Foundation for Electoral System’s (IFES) commitment to gender equality and women’s participation in electoral processes and government, a thorough analysis demonstrating the effectiveness of quotas is a vital effort that aids IFES in supporting their use as a tool for democratic progress. As detailed in IFES’ Analysis of the Status of Women in Burundi’s Political and Electoral Processes, gender quotas in Burundi, which have their origin in the 2000 Arusha Peace and Reconciliation Agreement that marked the end of a long and bloody civil war and have been encoded in Burundi’s Constitution and Electoral Code, have led to significant increases in the number of women participating in government, which is an important initial step in ensuring meaningful participation of all members of society. Perhaps the greatest indicator of success of the gender quota policy in Burundi is the high rate of women’s representation in the legislature. In the 2010 elections, 31% of National Assembly members and 46% of senators were women. Most remarkable is the fact that provisions to ensure quota requirements, which are set at 30% minimum, did not have to be invoked in order to reach these figures. In contrast, the 30% quota was only reached after seats were added in the 2005 elections. Four years prior to that, before provisions ensuring a minimum of 30% of women’s representation in the legislature had been adopted, less than 20% of seats in both the National Assembly and the Senate were filled by women. This marked improvement from election to election is strong evidence for the efficacy of gender quotas in the Burundian context.

35. Money and Elections in the Maldives

The International Foundation for Electoral System’s (IFES) in close cooperation with national experts from Commerce, Development and Environment Consulting, conducted a nation-wide survey to measure the prevalence of vote buying in the Maldives during the March 2014 parliamentary elections. This is the first systematic study of its kind conducted in the Maldives and it provides statistical data on vote buying, campaign finance and other election-related issues. It reveals that 37% of the voters have personally witnessed attempts at vote buying. In addition, the Maldivian public is highly cynical of the way in which political parties and candidates spend their campaign funds. At the same time there is very strong public support for campaign finance reforms and, in particular, for combating vote buying. The methodology and sample were designed to be nationally representative with a +/- 3 percent margin of error. The report will be shared with the government, the parliament, the Election Commission, civil society, political parties and others. IFES is currently providing technical support to the Electoral Reform Working Group to formulate amendments to electoral legislation, and remains committed to supporting Maldivian institutions in improving the electoral process.
