701. Attacks on Hospitals from Syria to Ukraine: Improving Prevention and Accountability Mechanisms

Abstract:: When Russia invaded Ukraine on February 24, 2022, it soon began implementing one of its frequent—and criminal—tactics that it had already been using in its military intervention in Syria: bombing healthcare and medical facilities. Syrian government forces first began targeting health workers in Syria in 2011 at the start of the Syria crisis, and Russia joined them in targeting the healthcare system upon its official entrance to the conflict in 2015. Over the course of the conflict, over 90 percent of 601 recorded attacks on medical facilities were attributable to either Syrian or Russian forces. In Ukraine, Russia has reportedly perpetrated more than 200 attacks on healthcare facilities and ambulances since the start of the invasion. The well-documented pattern of targeted attacks on healthcare in Syria and Ukraine undermines long-established and hard-won provisions under international humanitarian law intended to protect civilians during conflict. Despite the scale of the problem, which extends beyond Syria and Ukraine, there has been no prominent criminal prosecution of any alleged perpetrators of attacks on healthcare in any conflict, no establishment of a UN mandate dedicated to this issue, and no task force created by national governments specifically aimed at prevention of and accountability for these crimes. The international community’s failure to compel meaningful action to stop the criminal practice of targeting healthcare in conflict after conflict has resulted in continued deaths of health workers and civilian populations. In a new issue brief by the Atlantic Council Strategic Litigation Project‘s Elise Baker and Gissou Nia, the two propose recommendations to UN bodies, the World Health Organization, national governments and other institutions and decision makers for concrete actions to prevent future attacks and advance accountability for past ones.

702. Time for Fresh Thinking on Northern Ireland and Brexit

Abstract:: The Good Friday / Belfast Agreement became, with considerable efforts over several years from so many involved, a broadly accepted if never fully stable political framework for Northern Ireland. A year after implementation, the prospect of the Northern Ireland Protocol delivering similar results is diminishing. Instead, there is a risk it entrenches divisions in which all sides believe others, not themselves, must be the ones to compromise most. Such divisions around the Protocol have spread beyond the land and sea borders of Northern Ireland, increasingly overshadowing relationships between the UK and the EU, and the UK and the US. These are not in any of their wider interests. Talk of trade wars in Europe cannot strengthen any economy, while the UK’s diplomatic relationships with the US remain strained. Finding unity on huge questions like Russia-Ukraine becomes harder against this backdrop. To varying degrees, all of the parties involved in the Northern Ireland Protocol discussions were involved in reaching the 1998 Agreement that ended the 30-year period known as ‘the troubles’. Drawing on the lessons from that time and the arrangements they put in place, there is a need for a new political process, outside of technical discussions on trade matters within the Protocol. A new shared endeavour is needed to resolve what otherwise threatens to be a long and damaging Northern Ireland and Brexit stalemate.

703. The EU Digital Markets Act: Assessing the Quality of Regulation

Abstract:: The proposed Digital Markets Act (DMA) is an opportunity to prevent and remedy anti-competitive conduct by large digital platforms. If the Act is designed in an adequate manner to target specific problems, it can improve the contestability of platform services markets and markets that rely substantially on digital services. However, the DMA takes a novel approach to regulation, and novelty in concepts and regulatory requirements can lead to outcomes that later have to be corrected. Fortunately, the EU is not alone in experimenting with new regulations that specifically target the market power of large digital platforms. There is a great scope for policymakers to learn from similar frameworks in Europe and the United States. In this study, we compare key parts of the DMA proposal with similar legislation implemented or proposed in Germany, the United Kingdom and the United States –– in light of established principles for good regulatory design. We analyse the structure and quality of these regulations, not if they go in a certain ideological, political or commercial direction. We find that there are some areas where the EU could learn from other proposals to make the DMA more fit for purpose, and avoid unintended consequences on Europe’s economy.

704. Mirror, Mirror on the Wall, Who Has the Fairest Clauses of Us All? Stress-testing the Application of Mirror Clauses to Pesticides

Abstract:: In less than six months, ‘mirror clauses’ have taken EU trade policy by storm. To inject ‘reciprocity’ in trading terms, the French Presidency of the Council is proposing that imported food and feed be produced under the exact same sanitary, phytosanitary, welfare and environmental standards as those imposed on domestic products within the European Union. The international trade rulebook is both complex and yet relatively straightforward in ensuring that process and production methods applied to imports respond to legitimate justifications and do not result in a disguised barrier to trade. The European Union may learn from the United States’ playbook to ensure that mirror clauses are negotiated with trading partners bilaterally, rather than imposed on them unilaterally. As part of its Farm to Fork strategy, the European Commission has announced two pesticides reduction targets to be attained by 2030, and it is in this framework that questions relating to plant health and international trade have been gaining traction. With pesticides targets set to raise costs for European farmers and productivity levels likely compromised, there are genuine concerns that domestic products will be competitively undercut by imports produced ‘less sustainably’. To grasp the complexity of mirror clauses applied to the phytosanitary sphere, understanding how the European Food Safety Agency authorises and bans active molecules and bio solutions is vital. Appreciating the daily efforts of national customs agents in checking imports for pesticides residues, and coordinating efforts of Member States on rejected food and feed imports that do not meet EU requirements, is also paramount. There are warranted societal justifications to impose measures to protect humans, animals, plants and ecosystems. To remain legitimate under international law however, mirror clauses should be ‘stress-tested’ to avoid being applied as a means to gain competitiveness. Countries are unequal when it comes to the risk of pests and climate change is already intensifying their distribution with potentially dramatic impact for global food security. When it comes to protecting plant health, regional conditions must be considered to not only avoid inconsistency with WTO rules but also to ensure that mirror clauses do not result in a practical ban on imports from developing countries impacting livelihoods worldwide.

705. Should the EU Pursue a Strategic Ginseng Policy? Trade Dependency in the Brave New World of Geopolitics

Abstract:: Political leaders all over the world are calling for strategic autonomy. The removal of critical trade dependencies has become a guiding principle in most policy proposals, including the EU’s new industrial strategy. In making these decisions, it is important for policymakers to understand the reasons behind why shortages of critical goods and technologies have emerged in the first place. The instruments that new policies cerate should respond to real problems, not invented ones. For instance, if shortages are due to temporary mismatches of supply and demand, most of them will be fixed without the need of any policy intervention. On the other hand, shortages can also be engineered by countries using their dominance in the production of certain goods to coerce other countries. As the EU experienced first-hand after the Russian war on Ukraine in 2022, the concentration of market power in the production of any product carries geopolitical risks. For that purpose, it is crucial to understand the nature of trade dependencies. This policy brief presents indicators and a conceptual framework to measure trade dependency. The framework consists of two indicators: the first measures the share of EU imports from outside the EU over EU production proxied as the sum of imports and exports, while the second indicator considers the market concentration using the Herfindahl-Hirschman index (HHI). It then applies this framework to EU trade with the rest of the world in 2020 and elaborates on the product categories and partner countries behind these dependencies. From a total of more than 9,000 product categories, there were only 233 products that could be classified as dependent within our framework. In terms of values, they represented 1.5% of EU total imports or €50 billion. The major suppliers of these products to the EU were China, United States, Russia, and the United Kingdom. Imports of hydrocarbons from Russia are part of this list of trade dependencies, but so are many other goods which are not of strategic importance. A policy intervention should be tailored to the specific product and the specific export country. Given the small size of the EU imports in which the EU can be considered dependent, it is not advisable to base Europe’s new industrial policy on a general fear of dependency and apply new policies in many sectors. Many of these products are easy to substitute and the economy can function without them. For the select few products where dependency is an economic concern, our paper explores different measures that the EU can put in place to lower trade dependency and how this dependency can be reduced through international trade.

706. Processing Trade and Global Supply Chains: Towards a Resilient “GVC 2.0” Approach

Abstract:: In the current global context marked by economic fragility, growing uncertainty and geopolitical conflicts, ensuring the smooth functioning of global supply chains becomes more important than ever. Supply shortages, higher freight costs, higher commodity prices and strong demand increase will trigger inflationary pressures for all economic sectors dependent on global value chains (GVCs). As part of global efforts to enhance the resilience of GVCs, this paper makes the case for a broader discussion about the untapped potential of processing trade, a relatively unknown trade facilitation option available in many countries around the world. Processing trade has been credited with stimulating China’s participation in GVCs, in combination with foreign direct investment (FDI) attraction and industrial upgrading. However, processing trade is not just a Chinese phenomenon. In the EU, significant trade flows (over 200 billion euros in 2021 alone) benefitted from a double-digit trade cost reduction, thanks to the EU processing trade provisions. Different types of processing trade arrangements exist in over 70 countries worldwide (including in the EU), as a way to facilitate the integration of developing countries in global production chains. However, these unilateral schemes have different requirements and co-exist without any attempt to facilitate their inter-operability along complex global supply chains. This paper argues that there is a pressing need for a global reflection on how best to promote a better integration between these national processing trade schemes. One option is to promote a “GVC 2.0” approach that offers key recommendations and best practices for processing trade along GVCs. Such a coordinated “GVC 2.0” trade facilitation initiative would not only make GVCs more resilient for countries that depend on global sourcing for their critical economic activities, but it will also reduce the inflationary effect generated by the unnecessary trade costs associated with GVC activities.

707. How Russia Fights

Abstract:: Until this year’s renewed aggression on Ukraine, over-reliance on catchy labels such as “hy- brid war” has led many observers and deci- sion-makers to under-appreciate (if not disregard com- pletely) one undeniable fact: that over the last 20 years, the Kremlin has achieved its key strategic goals mainly through kinetic military means. Notwithstanding a weak tactical performance, Rus- sia won the 2008 “August war” against Georgia in only five days and successfully imposed its own regional set- tlement. In 2014, the annexation of Crimea, while sup- ported by the promotion of favourable socio-political conditions, was carried out and secured militarily; even more so in the Donbas campaign, where Russian propa- ganda suffered from serious limitations. Finally, the role of the Russian military in Syria beginning in 2015 was evident, albeit frequently reduced solely to the use of the Aerospace Forces. Notably, and besides obvious differences linked with the specifics of each theatre, the military interventions that Russia has conducted since 2008 display a consistent modus operandi. An analysis of these experiences can help illuminate what Russia is doing today and might do in the future, thus enabling NATO to fine-tune its posture on the Eastern flank. This Policy Brief draws on an expanded research project regarding Russia’s approach to war, as well as on a wealth of Russian-language military essays and commentary – deliberately highlighting the way the Russian military thinks of and practises war on its own terms.

708. Rethinking NATO engagement in the Western Balkans

Abstract:: Recently NATO Secretary General Jens Stolten- berg recognized Bosnia and Herzegovina (BiH) as a possible frontier for Russian activities fol- lowing Russia’s invasion of Ukraine.1 These activities, best illustrated by the threat from the Russian ambas- sador to Sarajevo of a Ukrainian scenario should BiH seek NATO membership, raises an important question: why is BiH of particular importance to the Euro-At- lantic Alliance? First, the Western Balkans is unfinished business for NATO and for countries in the region that have recognized NATO integration as a strategic goal. Second, other actors, primarily Russia and China, have established interests that compete with NATO’s en- gagement in the Western Balkans. Third, the interests of these external actors undermine Euro-Atlantic se- curity on the eastern flank. As a result, there are bene- fits for NATO in increasing cooperation with BiH and the Western Balkans in order to prevent the possible return of conflict to the region.

Abstract:: Following Russia’s recent invasion of Ukraine, numerous Western policy-makers and analysts have interpreted the Alliance’s cohesiveness and prompt response as evidence of its value in protecting the transatlantic community of liberal-democracy. NA- TO’s Allies, the argument goes, have clearly demon- strated their shared determination to protect allied ter- ritory and core liberal-democratic values, re-affirming the Alliance’s unshaken commitment to the principle of collective defence. But can this momentum be sus- tained? While the Ukraine crisis has triggered initial prac- tices of unity, it has also highlighted – and rendered more complex – difficult questions, tensions and nor- mative dilemmas for NATO. This policy brief exam- ines some of the key challenges that NATO is likely to face in protecting the transatlantic security commu- nity in the unstable, post-February 2022 environment. What is particularly important to understand is that some of those challenges concern key norms and val- ues around which NATO defines itself. There are no simple answers to the political questions facing the security community – but there are steps that can be taken to put the Allies in a stronger position to ad- dress them.

710. Is Russia a threat in emerging and disruptive technologies?

Abstract:: jor stakeholders, including the United States, China, and Russia, is of paramount impor- tance to the transatlantic community. The Russian authorities, including Vladimir Putin, perceive gaining or losing ground in this rapidly advancing technolog- ical competition in existential terms: either a nation will successfully ride the wave, or it will be crushed by it. Emerging and disruptive technologies (EDTs), and their mutual convergence, are increasingly regarded as sources of strategic and operational advantages in fu- ture warfare. They create a new set of conditions and potentially consequential defence applications that may increase Russia’s – and other key actors’ – military ad- vantage over competitors. Accordingly, EDTs may al- ter the trajectory and character of future warfare and human involvement in it. Stakes seem high for both national and international security, with a likely impact on deterrence, arms control, and strategic stability, as well as the distribution of power in the international system, along with Russia’s share of it. One of the key objectives during Putin’s presiden- cy has been to rebuild the country’s military capacity. A large-scale modernization programme launched in 2008 has focused on strengthening the nuclear arse- nal and reducing the conventional inferiority that took hold in the military organization during its post-Cold War decay. The Russian authorities have been con- cerned, however, that it would take too long to catch up with the West’s military development. Conversely, EDTs promised a rapid, non-linear way to close the capability gap. As a result, Russia has been systemati- cally expanding its pursuit of cutting-edge military and dual-use technologies. This Policy Brief explores Russia’s technological eco- system with examples of the major programmes and strategies that have been prioritized to pursue excel- lence in EDTs. It examines constraints that affect EDT development, including the impact of the invasion of Ukraine, and considers what possible implications Rus- sian EDT development may entail for NATO.

711. The war in Ukraine and the future of Russia-China relations

Abstract:: The China-US rivalry, observed since late 2017, has pushed Moscow and Beijing closer togeth- er, but it has not transformed their relation- ship. One reason is the persistent cautiousness of both states, another is Moscow’s lack of capabilities to offer genuine support to China in such areas as the econo- my, trade or technology. The official rhetoric, boasting about the relationship being “better than an alliance”, in reality hides real obstacles to a more substantial co- operation. The first “post-pandemic” in-person meeting be- tween Vladimir Putin and Xi Jinping on 4 February 2022 seemed to have opened the new era in Sino-Rus- sian relations. The joint communication was unusually ideologised, with both states claiming their democratic traditions. China offered support for Russia’s “legiti- mate security concerns” in Europe and opposed fur- ther NATO enlargement. Russia reciprocated by sup- porting China in Asia. The slogans of the relationship having “no limits” or no “red lines” dominated the post-summit narratives. Russia’s war against Ukraine has pushed the Si- no-Russian relationship into uncharted waters. Mos- cow’s failure to secure a quick victory has put Beijing in an uncomfortable position. The future direction of Sino-Russian cooperation will depend heavily on the length of the Russia-Ukraine conflict and the ultimate decision of Beijing as to what extent (if at all) to prop up Russia economically. Regardless of whether Beijing decides to assist Mos- cow in bypassing Western sanctions, the unravelling of the Sino-Russian relationship is highly implausible. We can expect either China’s explicit economic support for Russia or the maintenance of close political ties without economic support. In the first scenario, Russia’s dependence on China would increase dramat- ically, diminishing Moscow’s room for manoeuvre in foreign policy and ultimately turning Russia into Chi- na’s asset in the latter’s global rivalry with the US. In the second scenario, Russia would remain an autono- mous actor, pursuing close political cooperation and normative anti-Western convergence with China, but increasingly isolated and weakened economically. It is only domestic political change in Russia, the end of Vladimir Putin’s personal rule in particular, that would provide Moscow with an opportunity to reassess the relationship with China.

713. The Dos and Don'ts of Strategy Making

Abstract:: The Strategic Concept is NATO’s most import- ant document after the Washington Treaty. It identifies the foundational elements of the Al- liance: it defines NATO’s strategic goals, the key risks and threats the Alliance faces, and designs a strategy of how to overcome those challenges. Since its in- ception, NATO has adopted six Strategic Concepts. The latest one was published in 2010. Given the ex- traordinary events of the last decade if not months, including Russian aggression in Ukraine and China’s increasingly assertive posturing in the Asia Pacific, a new NATO Strategic Concept is urgently needed and will be presented at the 2022 Madrid Summit. In this context, it is worth asking: how do we design good strategy? What are the main building blocks of strat- egy? How can NATO most efficiently integrate the variety of tools at its disposal into a coherent, cohe- sive whole? Practitioners and academics have over the years identified best practices in strategy design along with some common mistakes.1 This Policy Brief sum- marizes their most important findings.

714. Lessons from NATO’s intervention in Afghanistan

Abstract:: AFter US troops began withdrawing from Afghanistan on 1 May 2021, the Taliban launched an offensive to take back control of the country. By August, the militants had retaken con- trol of most (administrative) districts and President Ashraf Ghani and other key officials fled the country. NATO Allies rushed to close nearly all of the military and civilian infrastructure they had built since 2001, and hastily set up air bridges to evacuate their citizens and personnel from Kabul. Most of this was done by the member states while NATO as an organization mainly stood on the fringes. Critics have focused on these events to call for an evaluation of this hasty and uncoordinated withdraw- al, and of the entire Afghan intervention more gener- ally. Among others the NATO Parliamentary Assem- bly called upon member governments and parliaments of the North Atlantic Alliance not only to “conduct a thorough, clear-eyed, and comprehensive assessment of the Alliance’s 20-year engagement in Afghanistan”, but also demanded to incorporate these lessons into “NATO’s New Strategic Concept”.1 This Policy Brief aims to contribute to the lessons learned analysis that will be central to discussions at the NATO Summit this coming June in Spain. We of- fer eight findings and recommendations, based on a four-year long study of the effectiveness of the Af- ghan intervention.2

715. The rise of China and NATO’s new Strategic Concept

Abstract:: China’s rise is shaking up international power relations and is calling into question Western ideas of regional and global order. NATO, too, is confronted with the necessity of dealing with the challenges posed by China. This has been reflected in various NATO statements since 2019. According to Secretary General Jens Stoltenberg, “China does not share our values” and “uses modern technology, so- cial media [and] facial recognition, to monitor, to do surveillance of their own population in a way we have never seen before”. “All of this makes it important for NATO to strengthen our policy when it comes to China”, he added.1 NATO Allies only paid attention to the significance of the People’s Republic on their security policy com- paratively late. For a long time, the dominant view was that the Alliance and Beijing were pursuing a num- ber of common interests, e.g. in the areas of crisis management, counter-piracy and in the countering of the proliferation of weapons of mass destruction.2 Only China’s rise on the international scene and the resulting rivalry with the US in recent years have led to Beijing’s foreign policy to appear on the Alliance’s agenda.

716. NATO and the Women, Peace and Security Agenda

Abstract:: Council Resolution 1325 in 2000. This was the first effort to link women to the peace and security processes, including affirming their central role in pre- vention and resolution of conflicts. Resolution 1325 stressed the importance of equal participation, urging states to ensure women are given an opportunity for full involvement in peacebuilding, security and polic- ing. It also called on all parties to protect women and girls from sexual abuse during or in the aftermath of armed conflict, and address their special needs during repatriation, resettlement, and rehabilitation. While the WPS agenda was initially UN-led, since 2000, its relevance to achieving sustainable peace has gradually been acknowledged by a number of international or- ganizations, including NATO. Numerous studies have appeared in the past two decades to assess WPS commitments in internation- al organizations and states, by identifying gaps and celebrating achievements. At the same time, until re- cently, NATO was arguably absent from the gender discourse, and attempts to engage with female per- spectives within the Alliance have mostly remained fragmented. In part, this was because of the pacifist stance of the feminist scholarship and an argument that military organizations are mainly governed by masculine norms.1 This Policy Brief aims at examining best practices andgaps in incorporating a gender perspective among NATO Allies and partners, focusing on women in the security sector. It provides a set of recommendations regarding the WPS agenda, taking into account the current security threats facing Allies and partners.2

Abstract:: For the second time in less than a year, Russian troops have gathered on Ukraine’s border in alarming numbers raising concerns of a possible invasion. In the meantime, Russia is posing conditions that are unacceptable to the West. Unless NATO, allies and Partners respond appropriately, the chain of events that Russia has initiated could inadvertently trigger a conventional war between Ukraine and Russia. If this were to happen, there is the real risk that some allies could be drawn into the conflict. This underscores the need for the Alliance, in tandem with the EU, national governments, and the private sector, to deepen coop- eration and respond in a timely, unified and coordi- nated fashion. At the same time, it is more important than ever that NATO, allies, and Partners understand Russia’s intentions. This raises the need for a return to regular and sustained dialogue with Russia. The right response for NATO will depend on changing circum- stances – namely Russia’s actions, the progress of di- plomacy, and the Alliance’s collective will to support Ukraine.

Abstract:: The August 2021 Afghan debacle offers NATO a moment for serious reflection about its role in the world. Some are drawing the conclusion that NATO should not engage in out-of-area opera- tions in the future and should instead focus on its core function of defending Euro-Atlantic territory from at- tack by foreign states, while dealing with the terrorist threat through long distance strikes using drones. But NATO members should draw a different conclusion, namely that in this globalised interconnected world, no one is safe from the complex combination of dangers that include war and violence, climate disasters, forced migration, pandemics or extreme poverty. It is no lon- ger possible, if it ever was, to insulate one part of the world from what happens elsewhere. What is needed is not retrenchment but rethinking and redirecting of NATO’s role. In this Policy Brief, I put forward the idea of a global strategy based on human security. Human security is understood as the security of individuals and the com- munities in which they live, in the context of multiple economic, environmental, health and physical threats, as opposed to the security of states and borders from the threat of foreign attack. Human security offers an alternative way to address “forever wars” whether we are talking about conflicts in different parts of the world, the so-called war on terror, or the geo-political competition with Russia and China. Human security implies that the security of Afghans or Chinese is just as important as the security of Americans or Europe- ans.

719. Decarbonisation of the energy system

Abstract:: Three quarters of the European Union’s greenhouse gas emissions stem from burning coal, oil and natural gas to produce energy services, including heating for buildings, transportation and operation of machinery. The transition to climate neutrality means these services must be provided without associated emissions. It is not possible today to determine tomorrow’s optimal clean energy system, largely because the cost, limitations and capability developments of competing technologies cannot be predicted. Energy systems with widely diverging shares of ‘green fuels’, in the form of electricity, hydrogen and synthetic hydrocarbons, remain conceivable. We find the overall cost of these systems to be of the same order of magnitude, but they involve larger investments at different stages of value chains. A large share of synthetic hydrocarbons would require more investment outside the EU, but less in domestic infrastructure and demand-side appliances, while electrification requires large investment in domestic infrastructure and appliances. Current projections show an overall cost advantage for direct electrification, but projections will evolve and critical players may push hard for alternative fuels. Policy will thus play a major role in shaping this balance. Political decisions should, first, push out carbon-emitting technology, primarily through carbon pricing. The more credible and predictable this strategy is over the coming decades, the smoother will be both divestment from brown technologies and investment in green technologies. Second, policy needs to help ensure that enough climate-neutral alternatives are available in time. Clear public support should be given to three system decisions about which we are sufficiently confident: the massive roll-out of renewable electricity generation; the electrification of significant shares of final energy consumption; and rapid phase-out of coal from electricity generation. For energy services where no dominant system has yet emerged, policy should forcefully explore different solutions by supporting technological and regulatory experimentation. Given the size and urgency of the transition, the current knowledge infrastructure in Europe is insufficient. Data on the current and projected state of the energy system remains inconsistent, either published in different places or not at all. This impedes the societal discussion. The transition to climate neutrality in Europe and elsewhere will be unnecessarily expensive without a knowledge infrastructure that allows society to learn which technologies, systems, and polices work best under which circumstances.

720. Does Europe need a Health Union?

Abstract:: Health outcomes in the European Union are good by international standards, even compared to other developed economies, and improved continuously before COVID-19. This reflects the alignment of the objectives of improving health and wellbeing with the overall socio-economic objective of prosperity, and suggests that a radical overhaul of EU health policy is not needed. However, the EU could benefit from closer integration in some areas and be more effective in delivering a high level of health protection. Action could be taken in the following areas: The European Commission’s November 2020 Health Union package to increase resilience to cross-border health threats is ambitious, in particular with the establishment of the Health Emergency Response Authority, which extends the scope of cooperation in health emergencies. The EU should pursue further the Health Union approach to address cross-border externalities and enhance health security. It could, for instance, do more to tackle anti-microbial resistance, or define minimum requirements for the resilience of health systems. For non-communicable diseases, the EU should tap the economies of scale of research and knowledge organised at EU level, and put in place systems for the surveillance of non-communicable diseases and consolidation of scientific knowledge. This could be achieved through an extension to non-communicable diseases of the European Centre for Disease Prevention and Control mandate. The ‘Health in all Policies’ principle is a key channel to deliver good health outcomes at EU level. EU scientific agencies provide health risk assessments in a number of areas, but the EU should better organise, coordinate and consolidate the scientific knowledge that underpins health-protection measures in sectoral legislation, and should more systematically apply better regulation rules to the health impacts of EU policies. The EU should support the digital transformation of health systems and set high targets for the European Health Data Space initiative, which is a critical infrastructure for the future of health research, regulation and policymaking. Several non-health EU policy objectives (cohesion policies, European Pillar of Social rights, economic governance) are linked to the performance of health systems. A common understanding on how to measure this performance would inform these policies in a consistent way. Moreover favourable health outcomes in the EU have not reduced health inequalities, which remain high between and within EU countries. Monitoring of health inequalities, including those related to access to and quality of healthcare, should be improved as an initial step.

721. Better pensions for the European Union’s self-employed

Abstract:: Self-employed workers are taking on a larger role in the European economy, particularly workers who operate as independent contractors rather than as small-business owners with their own workforce. Becoming self-employed offers flexibility and entrepreneurial potential, but can limit access to state-sponsored pension schemes. We assess the current state of pension policy across the European Union and take a more detailed look at five countries to see how independent workers are treated compared with their traditionally employed counterparts. We consider how policymakers might adjust or even overhaul their pension offerings to improve opportunities for the self-employed, while being mindful of the broader policy context in areas like innovation and overall tax burdens. In assessing policy options, it is useful to determine whether government, companies or individuals will be primarily responsible for paying for better pensions, and we structure our suggestions accordingly. Governments can make programmes more widely available, more consistent for all types of work and easier to understand and take part in. Companies can be encouraged to make pension contributions for all their workers, not just those they hire full-time. Individuals can be encouraged to set aside more for retirement with tax incentives, benefits flexibility and other policy measures. Access to pensions for low-income, more vulnerable self-employed workers should be considered separately from access for higher-paid workers. The current system does not facilitate this and indeed inhibits it in jurisdictions where a minimum income is required to join self-employment pension schemes.

722. Beating burnout: identifying bad jobs and improving job quality

Abstract:: While European-wide information on burnout is scarce, national statistics show that stress-related absenteeism is on the rise, generating significant costs for firms and welfare states, while reducing worker wellbeing. Although manifested at the individual level, burnout is an occupational phenomenon, predicted most clearly by imbalances in job content (high workloads and low autonomy) and the social environment at work – two under-explored aspects of job quality. While the economy and society as a whole would benefit from a healthier workforce, market failures drive job quality below an optimal level, necessitating attention from policymakers. Measuring and intervening in job content is not straightforward, however, and has not been a main policy domain in Europe. Policy frameworks and interventions therefore tend to focus on other areas of job quality, such as the physical and contractual working conditions. To manage the burnout epidemic and mitigate the impact of the changing nature of work, job-quality policy needs to focus on the job-content aspects as well. Wellbeing outcomes of low job quality, such as burnout, need to be monitored at European level and can serve to evaluate the effectiveness of policy interventions in job quality.

723. How to make the EU Energy Platform an effective emergency tool

Abstract:: Uncertainty about the supply of Russian natural gas is causing extremely high and volatile European gas and electricity prices. European Union countries may struggle to import sufficient volumes of natural gas at reasonable prices. During the summer, the imperatives are to fill storage sites sufficiently in a coordinated manner and to organise sufficient import volumes to replace a substantial share of gas that might no longer come from Russia. Coordination is essential to ensure that disruptions during difficult winter months do not lead to a break-up of the EU internal gas market with potentially serious political repercussions. One part of the EU response is establishment of an EU Energy Platform for the purchase of gas, LNG and hydrogen. This aims to pool demand to leverage the bloc’s economic clout, international outreach to reliable partners and efficient use of existing infrastructure. EU leaders have backed the plan but it has not yet been translated into a feasible scheme. The platform should be developed into an effective emergency tool to safeguard gas supply in case Russian flows stop. We detail two complementary proposals to achieve this. First, there should be EU-wide auctioning of remuneration for filling storage sites in specific regions. Companies would remain responsible for all stages of the value chain, benefitting from remuneration and in return offering the market operator some control over how this gas is released during winter months. Second, EU demand for additional LNG quantities, and the sourcing of this on international markets, should be coordinated through a platform, creating a transparent market for these volumes. These mechanisms would resolve the prevention paradox and prevent free-riding. If EU countries buy gas jointly, they will find it much easier to let markets allocate scarce volumes across borders in case of a complete stop to Russian supplies. . This would reduce the risk of energy market fragmentation, as well as the subsequent energy security, economic and political impacts of a shock that would hit member states very differently.

724. An analysis of central bank decision-making

Abstract:: The process by which central banks take decisions has evolved over the years, with a tendency towards independence and decisions taken by committees rather than individuals. Monetary policy committees can be set up formally in different ways, traditionally falling into one of two categories: individualistic or collegial. Individualistic committees reach decisions by voting and publish the votes of each of their members, while in collegial committees, decisions are typically reached collectively. The European Central Bank is an example of the latter, while the Bank of England follows an individualistic approach. Focusing on decision-making, a relevant question is whether the formal set-up in practice leads to different ways of deliberating and reaching monetary policy decisions. We look at decisions taken by the Bank of England, the Federal Reserve and the European Central Bank over more than 20 years to evaluate how different the decision-making process is in these three central banks. The results indicate that, irrespective of the committee type, their approach to consensus building when they take decisions is similar. The three central banks seem to value reaching decisions by unanimity, both on interest rates – the prime monetary policy instrument by definition – and on asset purchases. Decisions to tighten monetary policy are more often taken unanimously than decisions to ease monetary policy. When maintaining policy unchanged, decisions are usually backed by most committee members.

725. Legal options for a green golden rule in the European Union’s fiscal framework

Abstract:: Achieving the European Union’s climate goals and decoupling from Russian energy will require a massive increase in green public spending, which will be difficult when EU fiscal rules requiring fiscal consolidation are reinstated. The two major proposals to address the conflicting goals of fiscal consolidation and increased green public investment needs are a possible new European climate investment fund and a green golden rule. The latter would exclude any increase in net green public investment from the fiscal indicators used to measure compliance with fiscal rules, for countries with sound public finances. An EU climate fund and a well-designed green golden rule would be equivalent in terms of project selection, implementation and control procedures. If the climate fund does not involve redistribution across member states, then the treatment of related spending and consequent borrowing in national fiscal indicators and in the EU’s fiscal framework would be the same. New regulations would be needed to set up both the climate fund and the green golden rule. Special legislation would be needed to exempt the subsequent climate expenditures from EU fiscal rules in both cases. A climate fund financed by EU borrowing with redistributive effects across countries would likely result in the exclusion of the fund’s activities from national fiscal indicators and EU fiscal rules without any legislative changes. There are question marks about the desirability and political feasibility of redistribution across the EU for climate purposes. An EU climate fund, irrespective of whether or not it involves redistribution, would mainly benefit southern and eastern EU countries. An instrument is needed to foster green public investment in western and northern EU countries as well. The green golden rule would be such an instrument. While there are some pragmatic options to mimic a green golden rule in the current EU fiscal framework, such as amending the so-called ‘investment clause’ and adjusting the medium-term objective for the structural balance, ultimately, elements of the 2011 Six-Pack legislation and the 2012 Treaty on Stability, Coordination and Governance should be revised to include a green golden rules.

726. Why the Ukraine crisis should push the UK and EU into a tighter embrace on security policy

Abstract:: One of the costs of Brexit is the weakened ability of both the UK and the EU to shape a strong joint response to Russia’s threats to pan-European security. In the standoff over Ukraine, the need for close cross-Channel cooperation is particularly acute for any effective sanctions package negotiated with the US. Yet, post-Brexit relations between the UK and the EU are currently governed by a narrow Trade and Cooperation Agreement (TCA) which does not include a designated chapter on political dialogue and that, barring a handful of exceptions, does not contain any provisions on cooperation on foreign and security matters. Fortunately, the preparatory work undertaken to reach the bilateral accord contains the answer to the question on how trust between the parties can be regained through procedural means. This policy brief highlights the embers of the Brexit bonfire that might be raked up to rekindle the flame of dialogue and cooperation between the UK and the EU in foreign affairs and security policy.

Abstract:: Taking their fate into their own hands, EU heads of state and government endorsed the Strategic Compass on 24 March 2022, a roadmap for becoming a stronger security and defence actor. The shared threat assessment, a first in the history of the EU, is a positive development. Rewritten over the last month to emphasise the impact of Russia’s war of aggression against Ukraine, the Strategic Compass reveals a newfound consensus among EU Member States on the danger Russia poses, but also a lack of strategic foresight. This raises the question of whether the final document might contain shortcomings regarding the threat posed by China and the importance of the Indo-Pacific. As such, the document essentially characterises the EU’s security and defence actorness as that of a regional – not a global – power. Divided into four baskets, ‘Act’, ‘Secure’, ‘Invest’, and ‘Partner’, the Strategic Compass appears at times bogged down in policy details rather than answering the tough questions that might reveal an overarching vision for EU security and defence. However, if the measures outlined in the document are reinforced by more effective implementation and duly complemented by NATO’s forthcoming Strategic Concept, then the EU may yet appear more credible in the eyes of others and ultimately, the Strategic Compass will have been ink well spent.

729. A pillar of stability in an unstable world

Abstract:: The rising centrality of the Indo-Pacific is self-evident. What remains to be defined is the potential role the EU could play, notably as a security actor. Given capacity constraints, the EU’s objectives in the region should focus on credibility and on safeguarding shared interests – for example securing sea lines of communication, an objective also shared by Japan. Hard power remains the preferred language in the Indo-Pacific region. Australia unceremoniously dumping the French contract over US nuclear technology in the AUKUS affair, as well as India’s reluctance to take a position against Russia, a major provider of defence equipment, over its full-blown invasion of Ukraine demonstrate that being able to speak the language of power in a credible and reliable way takes precedence. While the EU will unlikely become a defence security provider à la the United States, it is now clear that it must evolve its global stance. The adoption of the EU Indo-Pacific Strategy and cross-references to it in the EU’s Strategic Compass represent an important milestone for bolstering its security and defence posture. The EU would do well to support its efforts to be a more credible security and defence actor in the Indo-Pacific by upgrading relations with its strategic partners, Japan in primis. Further operational, capabilities development, and industrial cooperation with Japan must be considered and reinforced by triangulation with other strategic partners in the region.

Abstract:: This paper responds to Moldova’s request of 3 March 2022 to accede to membership of the European Union. The European Council meeting at Versailles on 10-11 March endorsed the Council’s invitation to the European Commission to produce an Opinion on this request. The present paper gives our opinion on the position that we would like to see the Commission take, namely that the EU should extend candidate status to Moldova. Progress in implementing the Association Agreement and Deep and Comprehensive Free Trade Area between the EU and Moldova means that there is already a substantial degree of preparedness for the accession process. While Moldova has an important reform agenda to sustain, especially on the judiciary and rule of law, its democratic electoral processes have been of impressive quality since 2020. There is good coherence between the presidency, government and parliament on the reform and European integration agendas. Moldova’s common history, border and partly overlapping citizenship with EU Member State Romania is also relevant. With Russia’s ongoing aggression in Ukraine, Moldova is next at risk on account of political, economic and security vulnerabilities. Recent explosions in Transnistria point to the possibility of this separatist region being instrumentalised by Russia to destabilise Moldova. These factors further underline the case for comprehensive EU support and the need for geostrategic clarity, which should be framed by an EU decision to extend candidate status to Moldova.

Abstract:: The Commission’s three Opinions on the membership applications of Ukraine, Moldova and Georgia, if endorsed by the European Council as seems likely on 23-24 June, will mark a geopolitical turning point for Europe, bringing the three eastern European states into the EU’s enlargement process, albeit with a less advanced formulation for the time being for Georgia than for Ukraine and Moldova. A broad geopolitical advance is favourably viewed by most EU citizens and its main international partners. The European Council’s agenda is of even wider importance, with discussions due to take place on both possible reform of the existing enlargement process and the ideas advanced by Presidents Macron and Michel for a new form of political community that would aim to embrace the whole of Europe (except of course for Russia and Belarus).

Abstract:: Russia’s war on Ukraine has raised serious questions about European security, but it has also led to much greater transatlantic unity. This Policy Insights paper argues that the war on Ukraine has given rise to a new consensus among large parts of NATO and the EU to reinvest in collective security. Charting the progress made by both NATO and the EU, this paper looks at how transatlantic partners are addressing questions related to the so-called need to balance between Europe and the Indo-Pacific, EU strategic autonomy and the implementation of NATO’s Strategic Concept and the EU’s Strategic Compass, as well as the conclusions of the NATO Madrid Summit. It finds that there are several areas for enhanced EU-NATO cooperation, but issues pertaining to future US elections, defence industrial policy and NATO’s force posture could sorely undermine transatlantic unity.

734. Will the European Political Community actually be useful?

Abstract:: On 6 October 2022 there will be an inaugural EU meeting at summit level, with the EU’s close neighbours also invited, to debate security and stability as part of a budding European Political Community (EPC), as proposed by President Macron with support from President Michel. However, the future functions of the EPC have only been sketched in very preliminary and summary terms, which this CEPS Explainer seeks to explore in more detail. We identify several categories: foreign policy and strategic security, and EU internal policies, consisting of energy security and climate change, economic cooperation and mobility. While foreign policy and security issues are obviously prioritised in official statements, so far in the context of Russia’s war against Ukraine, there are serious limitations over how effective this is likely to be (almost all of the EU’s most powerful allies are outside Europe). The other suggested functions link closely to the EU’s competences and resources, and these do offer scope for more solid and consensual cooperation. Overall, the EPC’s organisation and functions should be designed with all these possibilities in mind, especially serving to complement and not displace the EU’s enlargement processes.

Abstract:: At the crossroads of industrial policy and the Common Security and Defence Policy (CSDP), the European Union’s (EU) defence initiatives are accelerating with the political backing of both the EU institutions and key Member States. Russia’s war in Ukraine has played a seminal role in the introduction of taboo-breaking proposals to strengthen EU defence capabilities. In order to be effective, the EU must adopt the mantra of ‘inclusive integration’, recognising that increased cooperation amongst Member States, candidate countries, and like-minded partners makes the Union stronger. Policy actions under this mantra should thus aim to complete the regulatory framework of the European Defence Technological and Industrial Base, continue providing the right incentives for joint capabilities development, address the needs of Member State armed forces, maintain the EU’s technological cutting edge and guarantee continued political momentum.

Abstract:: Eight months after the Russian invasion of Ukraine, the US has spent almost three times as much in ‘lethal aid’ to the Ukrainian armed forces than the EU institutions and Member States combined. Beyond the headline figures presented in well-known indices, data are hard to come by in a disaggregated manner. This lack of transparency is problematic both from a public accountability perspective as well as from efforts to ensure greater complementarity in Member States’ support for the needs identified by Ukraine. Therefore, integrating publicly available sources into a more refined dataset of the weapons systems and military-related support promised by Member States to Ukraine is of utmost importance. This CEPS Policy Brief aims to complement the existing narrative regarding the lagging military aid concretely delivered by the EU Member States in comparison to the aid sent by the US and the UK, and to offer possible solutions on where – and how – the EU can plug the shortfalls.

Abstract:: We note with great concern the worsening situation in the ongoing conflict between the Russian Federation and Ukraine. The annexation of areas currently controlled by Russian military will exacerbate tensions as Ukraine seems determined to recover the occupied regions and is supported by several NATO countries. The situation is quite complex as armed hostilities continue unabated, and opposing security perceptions by the parties involved do not appear easily reconcilable. Despite the fact that prospects for a ceasefire look dim under this current situation, a ceasefire is a necessary step towards stopping this dangerous conflict which, while it is heavily affecting Ukraine, is also a very destabilizing element that threatens international security.

Abstract:: On 1 January, France took over the presidency of the Council of the European Union for six months. The exercise, which mainly consists of leading meetings of European ministers, is also an opportunity for the country temporarily in charge to convey its priorities and even a political vision for Europe. In this respect, the French Presidency comes at a particular time for the European Union, for France and for its President, Emmanuel Macron. Hard hit by the pandemic, the European Union is both emerging from the crisis and adapting to the global changes accelerated by the crisis. France, for its part, is preparing for a major political event, the presidential election in April, followed by the legislative elections in June. For Emmanuel Macron, the French Presidency of the Council will bring to a close a presidential term of office that has focused strongly on European issues, almost five years after his speech at the Sorbonne.

Abstract:: Russian actions in Ukraine since 2014, and the tensions to which they have led, obscure the legal aspects of these attacks thereby opening the way to propaganda and approximations. To contribute to a better understanding of what is at stake, this contribution is limited to the legal aspects of an otherwise eminently political issue. This in fact heralds a spectacular break in the international order and a violation of commitments and treaties signed by a member of the Security Council of the United Nations that have not been witnessed since the Second World War[1].For a long time, Russian diplomacy was attached to the strict and formal respect of the rules of international law, sometimes "clinging" to them in a bid to resist the demands made by the different populations. Even during the succession of the USSR, this constant was respected. However, the actions in Crimea and Donbass since 2014 have marked the abandonment of this formalism, while the Kremlin's diplomacy is promoting the need to conclude new treaties with the United States and European states so that Russia can endorse its claims.

Abstract:: “Europe’s hour has come”, said a Luxembourg minister in 1991 at the beginning of the Yugoslav wars. The context seemed favourable: an initially peripheral crisis, a relative lack of interest on the part of Russia, a green light from the United States which was even encouraging invention by the Western European Union (WEU), the majority of whose activities were taken over by the European Security and Defence Policy (ESDP), and later by the Common Security and Defence Policy (CSDP). America's 'pet project' at the time was not yet Asia, but rather the management of the decay of the Soviet world, without much interest in the Western Balkans. In response, some Europeans 'held back' and feared an unfavourable division of tasks: 'noble' collective defence missions reserved for NATO and peacekeeping missions, considered 'subordinate', for Europe. Strategic prescience! Four years later, we had witnessed the bombing of civilians, the siege of Sarajevo, broken ceasefires, failed mediations and Srebreniça. We had experienced the humiliations inflicted on a UN force (UNPROFOR) that had a timid mandate and overly restrictive rules of engagement. The British and French were in the field this time round, but not the Germans. The Dayton Peace Agreement, which only France calls "the Dayton-Paris agreement" (a formal concession by Bill Clinton to Jacques Chirac) was largely a Pax Americana. In the American camp, Richard Holbrooke had pulled the strings and decided everything, by ruthlessly relegating the European leaders, including Carl Bildt, Jacques Blot and Pauline Neville-Jones[1].

Abstract:: The carbon border adjustment mechanism (CBAM), the fight to prevent illegal foreign subsidies, the ban on trade in deforestation products, the due diligence obligation imposed on European companies, the anti-coercion regulation, the reciprocity instrument in public procurement, the foreign investment screening regulation, not to mention the set of exceptional trade measures implemented in the context of the Covid-19 pandemic and the invasion of Ukraine; there is a long list of decisions adopted and under discussion that mark the European Union's determination to decide alone on the regulation of trade between itself and the rest of the world. This European "neo-unilateralism" is certainly based on a logic that is not entirely new - the defence of the Union's interests through trade policy or trade regulation instruments - but it also presents singular features and reflects political choices that prevail, more than in the past, over strict mercantile considerations. It is a vehicle for promoting the European Union's strategic autonomy in a multilateral system that is in the process of collapsing and an international order that has been hit by crises.

Abstract:: With all eyes on the next Russian move in Ukraine, the notion of European strategic autonomy is experiencing a revival. At first glance, this seems overdue given that talks between Washington and Moscow bypass Brussels entirely. But beyond a limited use for the concept to help mitigate vulnerabilities resulting from dependencies and credibly malign actors that can exploit them, the notion remains surplus to requirements. Broad use of the term ‘EU strategic autonomy’, as is in vogue, risks giving populism and nationalism an unnecessary impulse. It also risks unmooring the EU from its collaborative and compromise-oriented essence because it depicts the world outside the EU as a swamp where danger lurks behind every tree. If EU Member States want a more assertive and capable set of institutions that act on their behalf, they should just get on with their unfinished business – the Single European Market, industrial/digital policy, fiscal transfers and defence/security policy.

Abstract:: Unlike many of its neighbours, Kenya is progressing towards universal electrification from 100% renewable sources as set out by the country’s Vision 2030 Agenda. This feat, however, does not mean that there are not areas for improvement of its energy profile, especially around grid resilience, energy access and mitigating fluctuating supply and volatile prices. The EU stands poised to help this strengthening, not only due to the bloc’s leading presence in the Kenyan energy transition, but also because of growing geopolitical competition in Africa. Abstract:: EU Member states can be divided on China, even on issues such as human rights. Often singled out as an agent of division is the Hungarian government of prime minister Viktor Orbán. Hungarian dissent begs the question: how can the EU move forward on China given Hungary’s strategy of obstructive dissent? European cooperation ought not wait for unanimity, nor should it rely on value-politics: member states should play the power game to circumvent or break lingering impasses. Abstract:: The EU is not always united and visible in foreign policy. This policy brief argues it could make more use of leading groups of member states under the coordination of the High Representative and European External Action Service (EEAS), the type of strategic thinking that guided the development of the Strategic Compass, and a Team Europe approach to a wider range of international activities, going beyond development cooperation. One idea would be to formulate a European Council Forum on Economic Security and Sanction policy. The Netherlands could contribute proactively, for instance by advocating for a strategic conversation on the topic of economic power at the level of the European Council.

757. The Dutch position on Kosovo’s visa liberalisation process: Light at the end of the tunnel?

Abstract:: Kosovo remains the last country in the Western Balkans that has not yet attained EU visa liberalisation which would allow its citizens to travel freely to the EU for up to 90 days. In spite of a 2018 positive assessment from the European Commission on the fulfilment of the formal benchmarks, the Netherlands, as well as several other EU member states, have remained opposed to date, citing rule of law concerns. The status quo has resulted in a politicisation of the process and rising frustrations. Unpacking the different positions is essential in order to identify action points for breaking the deadlock on both the Dutch and the Kosovar side. This policy brief therefore assesses the Dutch position on the visa liberalisation process, as well as how that position is perceived in Kosovo. It does so through an analysis of government documents and interviews with policy makers, politicians and civil society representatives. The brief shows how the Dutch narrative is slowly changing, arguing that even if divergences in narratives remain, visa liberalisation could take place towards the end of 2022. It articulates recommendations for both Kosovo and the Netherlands to capitalise on the current momentum.

Abstract:: Around 442,000 people have so far fled Ukraine – not just to the EU, but also to neighbors like Moldova. This is a humanitarian issue, and should not be conflated with “migrant instrumentalization” (MI), whereby a state pushes people across a border to coerce the EU to change position. Yet Russia is likely to employ MI in this way, especially if it moves deep into Western Ukraine. Drawing on an in-depth study, we show how the EU can meet this specific threat.

Abstract:: Despite Russia’s violent rejection of a NATO-centric Europe, the United States should still pursue its vision of a continent that will one day be “peaceful, whole, and free.” The alternative is a blood-soaked division of the continent, constantly prone to escalation into a direct conflict with Russia. The United States needs to adopt a different approach to achieving its vision, as follows: • The path to peace must begin with settling the conflict in Ukraine, and the key to a settlement is securing Ukraine’s independence as a neutral state outside NATO. • If Europe is to be whole, NATO cannot serve as its overarching security arm. NATO should focus on defense of its existing members, not expanding its ranks or operating out of area, including against China. • Over time, our goal should be evolution toward a U.N. Security Council-type arrangement in Europe that includes both NATO and non-NATO members. The price of admission for Russia must be good faith compliance with the terms of a settlement in Ukraine. • If Europe is to be free, we must recognize that a stable security environment in Europe is a prerequisite for the ex-Soviet states gradually becoming more liberal. The best means of ensuring that Europe is free is by revitalizing democracy within the West itself.

Abstract:: Ammunition diverted from legal to illicit markets is a central concern in small arms control, but its impact is understudied. A new Briefing Paper from the Small Arms Survey and the UN Office for Disarmament Affairs explores how authorities can go about better monitoring the role it plays in violent crime. Extracting Evidence: Opportunities and Obstacles in Assessing the Gendered Impacts of Diverted Ammunition unpacks the challenges involved in trying to assess the true costs of ammunition diverted from official stockpiles. The study describes contextual background, notes the limitations of ammunition profiling research to date, and presents findings from a pilot case study on ammunition profiling in Kosovo* as well as insights from ammunition marking policy in Brazil. It finds that authorities struggle to identify what materiel among seized ammunition has been diverted from official stockpiles, which in turn prevents the ability to truly assess the impact it has on men, women, boys, and girls. The study identifies measures for overcoming such monitoring challenges, including special marking practices for state-destined ammunition, headstamp data collection guidelines, and information sharing protocols between relevant agencies for ammunition recovered from crime scenes.

Abstract:: The war in Ukraine could mark a watershed for European security. There has been much talk that European governments are divided over the conflict, but European citizens seem remarkably united around three key ideas. Firstly, they believe it is likely that there will be another Russian invasion of Ukraine. Secondly, they see this as a problem not only for Ukraine but for European security generally. Thirdly, they want Europe to respond to the crisis, with majorities supporting a response from NATO and the EU in particular. Europeans disagree on which are the most pressing threats linked to the crisis and on the price their countries should pay to defend Ukraine: people in Poland, Romania, and Sweden are much more willing to make sacrifices than those in France and Germany. The crisis will likely test Europeans’ readiness to defend the European security order.

775. Health of nations: How Europe can fight future pandemics

Abstract:: As the crisis phase of covid-19 recedes, there is a chance to improve international cooperation on global health – but also a danger that competing reform proposals will lead to inaction. The EU can best support reform of pandemic preparedness and response if it takes account of the concerns of different global powers. The union should combine a push for reform of and increased funding for the WHO with support for a new fund for health emergencies, overseen by a representative group of countries. The EU should promote a new global compact on health, matching countries’ commitment to surveillance and reporting of pathogens with support for stronger healthcare systems and greater equity in the allocation of countermeasures. The EU-Africa relationship offers a chance to pioneer such an approach, but the EU will need to go further in this than it has so far. The EU should promote African vaccine manufacturing, including by pressing European pharmaceutical companies to transfer knowledge and technology to Africa.

Abstract:: Italy’s new far-right government has been widely perceived as the potential weak spot of the anti-Kremlin European front following Russia’s invasion of Ukraine: traditionally pro-Putin politicians such as Matteo Salvini and Silvio Berlusconi are back in power. Yet, after Mario Draghi’s hawkish Euro-Atlantic government fell in July and Giorgia Meloni was looking forward to a probable victory, she immediately sided with the European Union and the North Atlantic Treaty Organization in a firm condemnation of Russia. Putin’s Friends? The Complex Balance Inside Italy’s Far-Right Government Coalition Download 0.66 Mo Key takeways: Italy’s good relations with Putin’s Russia have not been the prerogative of a specific party. Political, economic and energy ties developed significantly with center-left and center-right governments alike. In line with most far-right parties in the EU, Salvini’s Northern League and Meloni’s Brothers of Italy developed an appreciation for Putin’s neo-conservative regime while criticizing the EU and NATO for damaging Italy’s entente with Moscow. A potential reconciliation with Moscow goes against Italy’s national interest at this point. Russia accounts for only 1.5% of Italy’s exports against its Western partners’80%. Besides, the EU’s interconnected gas market requires a coordinated plan to overcome the energy crisis. Finally, the reconquest of Kherson by Ukraine in November makes support for the Kremlin political suicide. Meloni’s sudden pro-NATO shift has taken much of her electorate by surprise, while support for Ukraine is low in the country. Coalition allies Salvini and Berlusconi are ready to take advantage of this gap to weaken Meloni’s leadership. This is typical of Italy’s fragile parliamentary democracy. To avoid further disappointing her electorate, Meloni is rapidly satisfying other demands of theirs, on issues such as migration, family values and tax policies.

777. The impact of EU sanctions on Belarus will be limited

Abstract:: The current Belarusian crisis was set off by a disputed presidential election on 9 August 2020, which gave Alexander Lukashenko his sixth term in office. Once again, the EU’s capacity for leadership was put to the test. When faced with the escalating post-election crisis in Belarus, the EU acted relatively fast, and after attempts to establish a dialogue failed, first sanctions followed in October 2020. The sanctions policy sent a signal to the Belarusian regime that EU member states can reach a common agreement. However, according to regional experts, the sanctions should have been broader and implemented earlier to show support for Belarusian society. Tougher sanctions were introduced when a Ryanair flight was forced to land in Minsk in May 2021. The extended sanctions package that followed increased the targeting of financial assets and state companies that are important contributors to the Belarusian state’s budget. Broader personal and sectoral sanctions hit Belarusian national industry and Alexander Lukashenko’s immediate political circles. In response, he has engineered a migration crisis on the EU’s external border in Poland, Lithuania and Latvia that is destabilising the security situation in the region. The effectiveness of the new sanctions remains limited, as even those high state officials who have been targeted generally do not travel extensively or hold assets abroad. Moreover, while some of the sectoral sanctions are particularly aggravating to, for example, Belarusian transportation and logistics sectors (e.g., banning air carriers such as Belavia), they have sometimes targeted companies that do not have very strong trading links with the West, but that cooperate extensively with Russia (e.g., the production of machines for exports to the east). There are also numerous loopholes in the sanction’s regime (e.g., exceptions made for imports of potash fertilizers) that undermine its effectiveness and have been blamed on certain lobby groups in Europe connected to businesses that trade with the Belarusian regime. Furthermore, loopholes seem to have been left in place intentionally to leave room for future dialogue with Belarus.

Abstract:: Historically, Danish decisions have not always put Greenlandic interests first. Although defense policy is formally under Danish jurisdiction, decisions only have the legitimacy necessary if Greenland participates in the decision-making processes. Because in Greenland, military activities and installations interfere intimately with civic society. Increased rivalry between the great powers in the Arctic produces challenging issues for the constitutional community consisting of Greenland, the Faroe Islands and Denmark. Denmark and Greenland must make the role they each want to play in the international community clear and rethink the responsibilities and coordination procedures of the community. Otherwise, Greenland and Denmark risk contributing to increased tension in the Arctic – and Greenland risks missing out on potential gains from the growing attention from the great powers.

Abstract:: Geopolitical competition in Africa is here to stay, and the question for the EU is not if but how to position itself in this global competition. In the case of the Red Sea region, the EU should support regional initiatives to build effective regional maritime governance and promote global public goods such as maritime security and the blue economy. Under the Presidency of Ursula von der Leyen, the European Commission has branded itself a ‘Geopolitical Commission’. With regard to geopolitics, the Red Sea has for years been seen as a primary focus of action, a point the European Council stressed in July 2021, when it identified the region as a ‘geostrategic priority’. In 2018, the Council of the European Union adopted conclusions on the Horn of Africa and the Red Sea, finding that there was ‘renewed geopolitical competition on both shores of the Red Sea’. The EU further stressed that ‘at stake are the preservation of the security of the Bab el Mandeb maritime route through which a significant proportion of trade to and from Europe passes; the harnessing of irregular migration flows; the containment of terrorist threats; and the prevention of instability in the EU’s wider neighbourhood’.

Hence, it has become even more urgent to understand how all these changes have impacted the posting of workers as well as propose solutions to facilitate workers and companies in this adaptation path. That is key if we are to safeguard an important instrument of the European single market. This is exactly the merit of this article and its two co-authors: offering a first and clear account of the characteristics of posting of workers during the pandemic, identifying the main challenges faced by Member States, EU institutions and businesses, while also identifying some potential future developments, despite the climate of great uncertainty surrounding us.

Abstract:: According to official statistics, the African continent has been relatively spared by the Covid-19 pandemic compared to Europe, America and Asia. The factors behind the low incidence of coronavirus in Africa are not fully understood. According to the WHO, the African continent has benefited from certain structural factors such as the limited international connectivity of most African countries, with the exception of some regional "hubs" such as Johannesburg, Casablanca, Addis Ababa and Nairobi. Incidentally, the most 'connected' African countries such as Morocco and South Africa have incurred the highest prevalence rates of Covid-19, which may lend credence to this explanation.

Abstract:: On 18 December 2020, the European Commission welcomed the political agreement reached between the European Parliament and the Member States allocating €79.5 billion to a new Neighbourhood, Development Cooperation and International Cooperation Instrument (NDCI) for the period 2021- 2027. Since its creation, the European Union has been a major player in public aid granted by rich countries to developing countries. The European Development Fund (EDF) was launched by the Treaty of Rome in 1957 and for decades provided aid to the former colonies in Africa, the Caribbean and the Pacific (ACP). The eleventh EDF, covering the period 2014- 2020 with a budget of €30.5 billion, will be replaced by the NDICI (Neighbourhood, Development and International Cooperation Instrument). The Union and its Member States are the world's largest donor of official development assistance. Their contribution of €74.4 billion in 2018 represents more than half of the OECD countries’ Official Development Assistance ($150 billion in 2018).

789. Labor Market Impact of Immigration in the European Union

Abstract:: Immigration is one of the factors often considered as the causes of Brexit. Researchers find evidences that regions with more immigrants from the new member states of the European Union (EU hereinafter) in eastern Europe tended to vote more in favor of Brexit in the 2016 referendum. Similar relations between the size of immigrant population and anti-immigration attitudes or far-right voting are found in other richer EU member states. A common explanation for this relation is the concern that immigrants negatively affect the outcome in the host labor market. Immigration is drawing attention in Korea too. Although immigrants' share in population is still substantially smaller in Korea than in the EU, its increase is noticeable. Also, certain industries in Korea are known to be already heavily reliant on immigrant labor. Recently, as entry into the country was tightened due to the COVID-19 pandemic, firms and farms are reported to have faced a disruption in production. This trend of increasing presence of immigrants in population and in the labor market, vis-à-vis the low fertility rate and rapid aging in Korea, is raising interest and concern on the socioeconomic impact of immigration. To offer some reference for the debates related to immigration in Korea, KIEP researchers (Joe et al. 2020 and Joe and Moon 2021) look at the EU, where immigrants' presence was much higher from much earlier on, and where the greater heterogeneity among the immigrants allows for richer analyses. This World Economy Brief presents some of their findings that are salient for Korea.

790. China’s FDI in Europe and Europe’s Policy Response

Abstract:: China’s investment in the European Union (EU) increased significantly during the European financial crisis, but has been on the decline in recent years. The surge of Chinese investment has raised concerns and demands for analysis on the negative effects it could have on the EU companies and industries. In this context, the present study aims to analyze the main characteristics of Chinese investment and M&A in Europe, major policy issues between the two sides, the EU’s policy responses, and prospects of Chinese future investment in Eu-rope, going on to draw important lessons for Korea. To summarize the main characteristics of China's investment in Europe, the study found that the EU's share of China's overseas direct investment has continued to increase until recently. Second, investment in the Central and Eastern European Countries (CEECs) is gradually increasing, although it is still insignificant compared to the top five destinations in the EU: Netherlands, Sweden, Germany, Luxembourg and France. Third, China's investment in the EU is being made in pursuit of innovation in manufacturing and to acquire high-tech technologies. When it comes to China's M&A in Europe, the study found that the proportion of indirect China's M&As (via third countries (e.g. Hong Kong) or Chinese subsidiaries already established in Europe) was relatively higher than direct ones. Empirical factor analysis of investment also shows that China's investment in the EU is strongly motivated by the pursuit of strategic assets. Other factors such as institutional-level and regulatory variables are found to have no significant impact, or have an effect contrary to expectations. This suggests that China's investment in the EU is based on the Chinese government's growth strategy, and accompanies an element of national capitalism Today, It is highly expected that the COVID-19 pandemic will have a reorganizing effect on the global value chain (GVC) and Foreign investment regulation in the high-tech sector motivated by national security is emerging as a global issue as the US and the EU are tightening their control. As Korean companies are not free from the risk of falling under such regulations, a thorough and careful response is required. And for the Korean government, it is necessary to prepare legal and institutional measures regulating foreign investment in reference to the US and the EU.

791. The Good, the Bad and the Ugly: Taking Stock of Europe’s New Trade Policy Strategy

Abstract:: This Policy Brief takes stock of the EU Trade Policy Review – the Commission’s proposed strategy for trade. Despite appearances, the Review doesn’t come close to its billing as a strategy for the new geopolitics of trade. In fact, the Review is weak on key geopolitical developments and rather gives the impression that the EU doesn’t have an ambition to shape outcomes. Obviously, the Review is anchored in Europe’s general economic climate: defensiveness on globalization, competition and digitalization. It follows that Europe is getting increasingly detached from world developments. There are several good parts in the Review. The Commission wants to revive and reform the World Trade Organisation, and it’s clear about what factors that have made the Geneva-based trade body dysfunctional. The Review also acknowledges that the EU will seek a closer alliance with the United States and use that for constructive purposes. Finally, it is welcome that the Commission proposes some new instruments for dealing with market distortions caused by foreign subsidies and protectionism in government procurement. All these initiatives can achieve good outcomes. However, they all require that Europe makes changes in its own policies and positions. The bad parts in the Review are Europe’s weak agenda for getting better market access in the growth regions in the world and its continued passivity on matters related to China. Europe’s main trade-policy challenge in the next decade is to ensure that businesses and consumers in Europe get better integrated with a world-market dynamism that predominantly will come from the Asian region. Absent a realistic and medium-term strategy for dealing with challenges connected to the rise of China, Europe will have difficulties getting the EU-China Comprehensive Agreement on Investment approved. Europe needs an actionable agenda for addressing bilateral frictions with China and problems that occur outside bilateral trade. Finally, the ugly part of the trade strategy are all the commercial policies in the EU – with strong effects on trade – that aren’t recognized or only casually mentioned in the Review. The latter category includes the ambition to introduce an autonomous carbon border tax on imports. Such a policy comes at a high political and economic cost, and the measure’s effect on reducing global carbon emissions is at best very negligible.

792. Combating Unsafe Products: How to Improve Europe’s Safety Gate Alerts

Abstract:: The European Union has built a one-stop-shop for its member state regulators to post product safety notifications – Safety Gate (European Commission 2021d). Constructed on top of the Rapid Alert System for Dangerous Non-Food Products, or RAPEX, the Safety Gate web portal is designed to make public the “quick exchange of information” between 31 European countries and the European Commission “about measures taken against dangerous non-food products.” While Safety Gate represents a significant achievement, our research revealed areas for improvement to increase its utility for manufacturers, marketplaces and consumers. Many product notifications published on the website lack details required to facilitate speedy removals and recalls. The study graded eight essential criteria for a total of 918 Safety Gate notifications published over eight months in 2020. The average notification score was a respectable 70 out of 100, but over 98% of the notifications omitted at least one key criterion. Only 14 notifications included all the information to enable efficient and accurate product identification.

793. “Too Big to Care” or “Too Big to Share”: The Digital Services Act and the Consequences of Reforming Intermediary Liability Rules

Abstract:: This paper reviews the Digital Services Act (DSA), a package of new rules for platforms proposed by the European Commission late last year. The paper takes stock of current and future situations for rules on content moderation and takedowns, and discusses how the DSA addresses the balance between the desired culture of openness online, on the one hand, and more pressures to take down not just illegal but harmful and objectionable content, on the other hand. The DSA introduces a few new transparency rules that follow previous codes of conduct: they are straightforward and desirable. However, it also brings in new know-your-customer rules and exacerbate the ambiguity surrounding the definition of illegal content. These types of rules will most likely have the effect that platforms will minimize risk even more by taking down more content that is legal. Moreover, there is a risk that the DSA will create new access barriers to platforms – with the result of making it difficult for smaller sellers to engage in contracts on platforms. New regulatory demands to monitor and address “systemic risks” will likely have the same effect: platforms will reduce their exposure to penalty risks by taking down and denying access for content that is legal but associated with risks. The DSA’s differentiation between large platforms and very large platforms is disingenuous and contradicts the purpose of many DSA rules. Obviously, exposing some platforms to harder rules will lead to content offshoring – a trend that is already big. Objectionable content – not to mention illegal content – will move from some platforms to others and lead extremists and others to build online environments where there is much mess content moderation. Furthermore, the new regulatory risks that come with being a very large platform will likely become an incentive for some large platforms to stay large – and not become very large. While the DSA is often billed as a package of regulations that will reduce the power of big platforms, it is more likely to lead to the exact opposite. Very large platforms have all the resources needed to comply with the new regulation while many other platforms don’t. As a result, the incumbency advantages of very large platforms are likely to get stronger.

794. What is Wrong with the German Economy? The Case for Openness to Technology and Human Capital

Abstract:: Advanced economies like Germany need to focus more on attracting foreign high-skilled labour and become better at importing foreign technology and business models. This might not sit well with current thinking of economic sovereignty in Berlin, but it is a necessary step for improving technology-penetration, competitiveness and productivity. Supply of high-skilled labour is getting more difficult to obtain and the cost of generating and adopting new ideas is increasing. Policymakers need to create the right conditions to open their markets to foreign technology and high-skilled labour. But openness alone is only a necessary condition – not a sufficient one. Policymakers also need to focus on creating the right environment domestically to attract a specialised and highly-skilled labour force, despite fierce competition from around the globe. The crucial question is to what extent companies make use of innovation capacities that can be obtained from international recruitment. Our analysis focuses on what German policymakers can do to increase openness for, and its attractiveness to, the high-skilled labour. Germany’s policy framework should focus on public policy initiatives aimed at increasing the incentives and removing obstacles for firms to attract the global high-skilled labour force. To stay attractive, Germany’s policies should also target issues of bottleneck regulation to facilitate field-testing new technologies and to support innovation sandbox processes of companies. And German policies should focus on the regulatory environment, notably the type of regulations that policymakers pursue. Many current regulations in Germany do not sufficiently allow for experimentation of technologies and ideas.

795. Digital Futures for Europe

Abstract:: There isn’t one model for success in the digital future; there are many. Europe is now debating what policies that could help to power entrepreneurship and growth in Europe’s economy, and some are arguing that Europe should make itself technologically sovereign – independent from the big platforms from the US. This is not the right approach – partly because there cannot be just one model applied in Europe if it is to become more successful in technology and competitiveness. This briefing paper argues that is far more important for Europe to create a better environment for companies to experiment and discover with new business models, and to learn from the past platform success while they do so. That requires a much greater space for entrepreneurship and that the EU and national governments stay away from excessive regulations that strain new business growth. Europe can be a powerful region that shapes rules and standards globally – “the Brussels effect”. But that isn’t the future for Europe if it ensnares entrepreneurs in red tape – “the Brussels defect”.

796. Covid-19 and the Danger of Self-sufficiency: How Europe’s Pandemic Resilience was Helped by an Open Economy

Abstract:: During the Covid-19 pandemic, Europe has benefitted strongly from being an open economy that can access goods and services from other parts of the world. Paradoxically, some politicians in Europe think that dependence on foreign supplies reduced the resilience of our economy – and argue that Europe now should wean itself off its dependence on other economies. In this Policy Brief, it is argued that self-sufficiency or less economic openness is a dangerous direction of policy. It would make Europe less resilient and less capable of responding to the next emergency. It is key that people, firms and governments can get supplies from other parts of the world. It is diversification, not concentration of production, that will make Europe more resilient when the next emergency hit. We don’t know where the next crisis will come from. Nature will throw nasty surprises at us, and we will make stupid mistakes, some of which will have devastating consequences. What we do know, though, is that we stand a better chance to fight the next emergency if we get richer and improve our technology. The best policy for resilience is one that encourages specialisation and innovation – and, when the emergency hit, allow for people to improvise in search for solutions. For that to happen, we need openness to goods, services and technology from abroad.

797. The EU Green Deal and Its Industrial and Political Significance

Abstract:: The European Green Deal, the flagship initiative of the incumbent European Commission, aims to cut greenhouse gas (GHG) emissions to 55% by 2030 (from the current target of cutting 40% of 1990 levels) by overhauling fiscal, trading and regulatory regimes. Brussels is well-placed to deliver the interregional distribution or the minutiae of technical regulations that this challenge calls for. Energy diversification is also central to EU competitiveness and strategic autonomy. But this initiative is not costless: its official impact assessment points to a GDP loss of additional -0.3 to -0.7%, by 2030, relative to the previous level of ambition. The full loss could be up to -2.5%. These costs are also unevenly, and the inability to cushion asymmetrical shocks have nearly torn the Union apart in the past. A carbon-neutral Europe could also make losers out of today’s winners among stakeholders and give the EU a significantly different industrial structure, forcing over-exporting Northern Europe into reforms that are probably overdue. Most importantly, the gap between the financing needed and the financing available is unprecedented. The success of the European Green Deal and a cost-efficient transition hinge on the rapid and effective mobilisation of investments – as the diffusion period for new energy-related technology is 40-50 years. Therefore, a smart climate policy does not just distribute costs and investments between different groups, but also over time: The investments are needed now, if we are to reap their benefits before 2050.

In the first in a series of TRANSITION 2021 memos examining policy challenges across the Middle East, esteemed diplomat and policymaker Dennis Ross provides an innovative approach to reengaging Iran in nuclear diplomacy. Ross explains: “If regime change is not a realistic or advisable goal, the objective must be one of changing the Islamic Republic’s behavior. For example, subsidies to renewable energy are defended because renewable energy limits carbon emissions. When a major economy subsidizes extensively, however, its trading partners are drawn into the game, with losses all around. As the prisoner’s dilemma suggests, a better outcome would entail mutual restraint. But the goal of mutual restraint is no less difficult in international trade than it is in international arms control. Both the European Union and the US federal system try, in different ways, to regulate industrial subsidies. Hufbauer examines efforts to contain unjustifiable subsidies and proposes modest improvements, bearing in mind that as countries struggle to overcome the global economic downturn resulting from the COVID-19 pandemic, there is little appetite for restoring a free market economy—one in which firms compete with minimum government assistance or regulation. Selective upgrading of the rulebook may nevertheless be possible.

800. At the Nexus of Participation and Protection: Protection-Related Barriers to Women’s Participation in Northern Ireland

Abstract:: The protection of women in armed conflict and their participation in peace and security activities are central pillars of the women, peace, and security (WPS) agenda. Overall, however, the WPS agenda has overlooked the relationship between participation and protection. This perpetuates a false binary between the participation of women as leaders with agency and the protection of women as victims of conflict. It also misses the gendered, context-specific, and conflict-related protection risks that accompany women’s participation. Finally, it overlooks the critical link between the harms women experience and their low levels of representation. This paper considers the intersection between women’s participation and protection in the context of Northern Ireland. While often assumed to be free of “global policy” concerns such as WPS, Northern Ireland starkly illustrates the intrinsic connections and tensions between women’s leadership and protection in conflict and post-conflict situations. After providing an overview of these connections and tensions more broadly, this paper examines the participation and protection of women in Northern Ireland since the 1998 Good Friday Agreement. It draws from twenty-five semi-structured interviews with women in leadership positions in Northern Ireland. The paper concludes that gender inequalities and gendered insecurities intersect with sectarianism, the legacy of violence, and political crises arising from power-sharing arrangements under the peace agreement. These, in turn, intersect with emerging technologies such as social media to stymy women’s participation across all areas of post-conflict political life. While these findings underscore the continued relevance of the WPS agenda, they also signify that deeper engagement with gendered protection issues is required if the agenda is to substantively advance women’s equality and participation in the longer term.
