Abstract:: THe RAPID DeVeLOPMeNT of the nuclear industry in the 20th cen- tury, the widespread use of radioactive isotopes in medicine and in mili- tary programs, the usage of nuclear submarines, as well as the operation of radiochemical plants, factories, nuclear power plants, and scientific research centers all around the world are accompanied by a constant accu- mulation of radioactive waste (RW) and spent nuclear fuel (SF). Mishandling of RW and SF could possibly inflict significant damage on the whole planet, not merely a single nation. Thus, the question of plac- ing RW and SF in storage is the main component of an environmental issue shared by the whole planet due to the use of nuclear energy. Disposal of RW is a touchy issue for any nation that has a nuclear industry. Handling RW and SF – i.e., obtaining them, ensuring safe and final safe isolation (disposal), transportation, warehousing, and storage – all require specific legal regulation and control, on the part of both the state and the international community via international organizations. What is most crucial are the actions of specific individuals, companies, transnational corporations (TNCs), state corporations and state entities, and international organizations (eURATOM, IAeA, UN, CIS), as well as laws and juridical acts on the national level and international treaties.

Abstract:: In 2019, the 38th Commandant of the Marine Corps released his planning guidance that laid out the strategic focus and future direction of the Marine Corps. General David H. Berger’s intent for the following four years concurred with the analysis of the previous Commandant and the necessary alignment of the Corps with the National Defense Strategy for the future needs of the Fleet by focusing on five areas: force design, warfighting, education and training, core values, and command and leadership. General Berger cogently noted that the coming decade will be characterized by conflict, crisis, and rapid change—just as every decade preceding it. And despite our best efforts, history demonstrates that we will fail to accurately predict every conflict; will be surprised by an unforeseen crisis; and may be late to fully grasp the implications of rapid change around us. Berger’s primary concern is that the Marine Corps is not fully prepared— equipped, trained, or organized—to support the naval force. To that end, force design became the priority for Marine Corps efforts to fulfill its role for the Fleet as prescribed by the U.S. Congress. The level of change required to integrate the Corps of the future with the naval forces of today would not happen overnight and certainly not without a great deal of growing pains to ensure the Corps is equipped and prepared for the future security environment. When Force Design 2030 was released in March 2020, the Marine Corps was prepared to make the force-wide changes necessary to partner with the Navy and serve as the country’s naval expeditionary force. Our current force design, optimized for large-scale amphibious forcible entry and sustained operations ashore, has persisted unchanged in its essential inspiration since the 1950s. It has changed in details of equipment and doctrine as technology has advanced toward greater range and lethality of weapon systems. In light of unrelenting increases in the range, accuracy, and lethality of modern weapons; the rise of revisionist powers with the technical acumen and economic heft to integrate those weapons and other technologies for direct or indirect confrontation with the U.S.; and the persistence of rogue regimes possessing enough of those attributes to threaten United States interests, I am convinced that the defining attributes of our current force design are no longer what the nation requires of the Marine Corps. Berger’s plan pointed to specific areas of change required to make force design a reality: the size, capacity, and capability of the Corps. In an austere fiscal environment, the Marines must assess their current capabilities to achieve a smaller footprint with broader reach—do more with less. As the reality of COVID-19 and the 2020 U.S. presidential election have so poignantly reminded us all, these tasks cannot and should not rest on any single shoulder and any response should be well considered and intended to benefit the greater good. This issue of the Journal of Advanced Military Studies (JAMS) will address elements of the Commandant’s Planning Guidance, particularly the concept of naval integration and what it means for the Services, especially the Marine Corps. Our authors look to the past for relevant examples of military successes and failures of integration, but they also discuss how future warfare will play out based on these concepts. The authors explore the topic from a variety of perspectives, including those for and against, and they offer analyses of past and current attempts and what naval integration may mean for the future of the Corps. The following articles present the capabilities that will be required to shift from a traditional power projection model to a persistent forward presence and how the Marine Corps can exploit its positional advantage while defending critical regions. Our first author, Dr. Matthew J. Flynn, presents a historical approach to the topic in his article “The Unity of the Operational Art: Napoleon and Naval Integration.” Flynn’s research calls for greater coordination between the sea and land domains to improve U.S. national security. His article draws parallels between Napoleon Bonaparte’s defeat and the importance of naval integration for military success: “Napoleon’s fate reveals a great deal about naval integration and how it explains France’s defeat and, most importantly, that there is but one operational art—not one for land and one for sea.” Our second author, Andrew Rhodes, also relies on a historical example with his discussion of the salient lessons that can be learned from the Sino-Japanese War. Rhodes encourages professional military educators and planners who are developing future operational concepts to look beyond simply retelling history and consider how the legacy of this conflict might shape Chinese operational choices. He reinforces From the Editors 9 Vol. 11, No. 2 the concept that military history is not simply a resource for answering concerns about future conflict, but it encourages us to ask better questions about the role of the sea Services and how they can handle uncertainty when preparing for the future. Lieutenant Colonel Michael F. Manning’s “Sea Control: Feasible, Acceptable, Suitable, or Simply Imperative” offers a historical review of early twentieth century Japanese naval battles as a framework to model possible future contests for control of the maritime domain. Manning believes that control of the maritime domain is a prerequisite for assured access and sets the condition for successful Joint operations. Manning believes that “nations not only have to compete with their enemy’s major air and naval capabilities but must also defend against land-based airpower; missiles; torpedoes; short-range, antisurface warfare assets; and coastal mines.” Colonel Scott Erdelatz (Ret) and his team of coauthors focused on an old approach for a new era of naval integration that acknowledges the long-term threat posed by China but also considers how much of what we know as the Marine Corps should be retained to fulfill other missions. Erdelatz et al. also analyze how radical integration might incur significant risk for the Marine Corps if long-term force structure decisions are based on still-evolving concepts and unproven technologies. Major Michael Kohler’s article, “The Joint Force Maritime Component Command and the Marine Corps: Integrate to Win the Black Sea Fight,” discusses how most current Marine and Navy integration takes place at the Service-chief level and primarily focuses on the Pacific. Kohler, however, believes that naval integration is also an important component of a successful defense against Russian expansion in the Black Sea region. Dr. John T. Kuehn shifts the focus to carriers and amphibious operations with his article “Carriers and Amphibs: Shibboleths of Sea Power.” Dr. Kuehn argues that aircraft carriers and Amphibious Ready Groups (ARGs) with an embarked Marine Expeditionary Unit represent shibboleths of seapower that conflate a deeper understanding of where the U.S. Fleet belongs now and where it needs to go in the future to face the challenges of the twenty-first century. Major B. A. Friedman’s article, “First to Fight: Advanced Force Operations and the Future of the Marine Corps,” then circles back to the traditional Marine Corps stance as always first to fight and the need for advanced force operations in the Corps of the future. Steven A. Yeadon’s article, “The Problems Facing United States Marine Corps Amphibious Assault,” rounds out the current perspective with a review of issues the Marine Corps has faced with amphibious assaults. Yeadon offers actionable information on current limitations and vulnerabilities of U.S. amphibious forces to chart a way forward for a robust forcible entry capability from the sea. Ludlow’s article, “Losing the Initiative in the First Island Chain: How Organizational Inefficiencies Can Yield Mismatched Arsenals,” presents what may be considered a losing proposition of initiatives in China’s First Island Chain; however, strategic gaps in capabilities have emerged that could dramatically impact the ability to execute an island-defense strategy. The final article by Lieutenant Colonels Terje Bruøygard and Jørn Qviller, “Marine Corps Force Design 2030 and Implications for Allies and Partners: Case Norway,” offers a larger discussion of Force Design 2030 and its future implications for American allies with a case study on Norway. The authors encourage the Department of Defense to consider greater interoperability between and among Services and allies, including increased communication with allies on changes happening at the Service and national level of the U.S. armed forces. The remainder of the journal rounds out with a review essay and a selection of book reviews that continues our focus on naval integration, but it also highlights continuing challenges in national security and international relations. The coming year will be busy for the JAMS editors as we work to provide journal issues on a diverse range of topics relevant to the study of militaries and defense.

Abstract:: In 2010, MCU Press published the first issue of this journal, formerly known as Marine Corps University Journal, to serve as the bridge between the military Services and the professional military educators, strategists, and historians within the greater Department of Defense community. During the ensuing years, the press and the journal have evolved to offer innovative and active content that continues to serve as a forum for interdisciplinary discussion of national security and international relations issues and how they impact the Department of Defense, the Department of the Navy, and the U.S. Marine Corps. Now, 10 years later, we see the need to evolve and offer a wider base for those conversations to take place. To celebrate this 10-year anniversary and to reflect the journal’s change in focus over time, the journal has been renamed the Journal of Advanced Military Studies (JAMS) to honor the constant innovation of our content, our authors, and the topics we present to our readers. JAMS will continue to offer readers thematic, biannual issues that encourage and continue the debates happening across Marine Corps University, the Services, and the Department of Defense. It is no coincidence then that this issue of JAMS focuses on innovation and the future of warfare. Each of the articles presented offers the readers a deep dive into a historical, current, or forward-looking perspective on innovation and the military Services. As with any discussion of the military and abstract concepts such as innovation, we must first set the parameters of our discussion. For many readers, the term innovation evokes thoughts of technology, shiny gadgets, and artificial intelligence. While innovation is not necessarily synonymous with technology, it is certainly a challenge to say what in fact it is—a thing, a concept, an action, the people involved, or all of the above. The experts may not agree on what innovation is, but they can agree that it requires change or transformation to be successful. Sun Tzu’s The Art of War compares the nature of warfare to that of water for “just as water retains no constant shape, so in warfare there are no constant conditions.” More contemporary agents of innovation include military theorists such as Earl H. Ellis, John R. Boyd, Michael D. Wyly, and John F. Schmitt. Lieutenant Colonel Earl Ellis’s work on Advanced Base Operations in Micronesia (Operation Plan 712) in 1921 clearly demonstrated his ability to forecast the future needs for amphibious warfare in the Pacific two decades prior to World War II. Though most readers will recognize former Air Force colonel John R. Boyd for his observe-orient-decide-act (OODA) decision-making loop, his more innovative work may well be seen in the energy maneuverability (E-M) theory, a mathematical study of fighter aviation. Then-major Wyly was tasked with reforming the Marine Corps concept of maneuver warfare in the wake of the Vietnam War. The work of Wyly, Boyd, and William S. Lind would serve as the foundation for Warfighting, Marine Corp Doctrinal Publication (MCDP) 1, that was later formally written by then-captain John Schmitt, along with several other doctrinal publications, including Ground Combat Operations, Campaigning, Command and Control, Planning, Expeditionary Operations, and a revision of Warfighting. The articles in this issue of JAMS continue the discussion fostered by these innovative pathfinders. Our introductory section from the Brute Krulak Center for Innovation and Creativity discusses the conception and creation of the center and some of its most innovative programs, including the award-winning Destination Unknown graphic novel and the center’s first essay contest, the U.S. Marine Corps Postmortem, and offers insight from Marine Corps leaders who consider both success and failure as critical measures for the strength of an organization. For example, Lieutenant General Loretta E. Reynolds contemplates how the Corps “must find a way to manage today’s risks while constantly readying ourselves for the emerging challenges of the future fight.”

Abstract:: Immigration policy has taken centre stage in the social sciences over the past 20 years. Despite the proliferation of articles and books in this field, very little attention has been paid to immigration policy as foreign policy. It is domestic policy that prevails in the literature, most notably about the effects of immigration on destination societies. This article distinguishes the domestic and foreign policy aspects of immigration policy, acknowledging as it does so that foreign policy is virtually always an expression of national self-interest. It concludes with observations on the realist and idealist/liberal approaches to international relations theory including with respect to the recently adopted United Nations Global Compact for Safe, Orderly, and Regular Migration and the United Nations Global Compact on Refugees. Its purpose is to draw attention to this neglected aspect of immigration policy and to encourage others to explore it in greater detail, from the perspectives of both individual states and the world’s international institutions.

Abstract:: The Dead Sea, the lowest point on Earth, is one of the natural wonders of the world. Rich in minerals and salt, the lake has attracted visitors for millennia, and the economic value of its mineral riches has been important to both the local Palestinian population and to every colonial power that has ruled the area. Today, Israel exercises total control over the Dead Sea, the northern basin of which lies in the occupied Palestinian territories. Israeli settlements and international businesses, aided by state-funded initiatives, have established a profitable tourism sector and extractive industries based on the Dead Sea’s natural resources, while Palestinians remain effectively excluded from pursuing such opportunities. Qumran National Park, private beach resorts, and the cosmetics company AHAVA, among others, reap enormous profits from settlements in the Dead Sea area, benefiting from Israel’s occupation and unlawful policies and helping to drive a self-serving narrative of the area’s history.

Abstract:: This article examines the relationship of the Palestine Liberation Organization (PLO) to the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) during the 1970s, the period when the PLO reached the zenith of its power in Palestinian refugee camps throughout the Levant. Based on archival United Nations (UN) and UNRWA documents, as well as the PLO’s own communications and publications, the article argues that the organization approached its relationship with UNRWA as part of a broader strategy to gain international legitimacy at the UN. That approach resulted in a complex set of tensions, specifically over which of the two institutions truly served and represented Palestinian refugees. In exploring these tensions, this article also demonstrates how the “question of Palestine” was in many ways an international issue.

Abstract:: This is the second installment of a two-part article on the recently released secret testimony to the Peel Commission. Part I ( JPS 49, no. 1) showed how the secret testimony deepens our understanding of the structural exclusion of the Palestinians from the Mandate state. Part II now focuses on what the secret testimony reveals about the Peel Commission’s eventual decision to recommend partition. It turns out that Zionist leaders were less central to this decision than scholars have previously assumed, and that second-tier British colonial officials played a key role in the commissioners’ partition recommendation. British decision-making over the partition of Palestine was shaped not only by a broad ambition to put into practice global-imperial theories about representative government and the protection of minorities; it also stemmed from a cold-eyed self-interest in rehabilitating the British reputation for efficient colonial governance—by terminating, in as deliberate a manner as possible, a slack and compromised Mandatory administration.

1612. Delegitimizing Solidarity: Israel Smears Palestine Advocacy as Anti-Semitic

Abstract:: In response to growing Palestine solidarity activism globally—and particularly in countries that have been traditional allies of Israel—the Israeli government has launched a well-resourced campaign to undermine such efforts. A key element of this campaign consists in equating Palestine advocacy; the Boycott, Divestment, Sanctions (BDS) movement; and anti-Zionism with anti-Semitism. The concerted effort to delegitimize solidarity with the Palestinians is taking place even as genuine anti-Semitism is on the rise, thanks to the resurgent white nationalism of the Far Right in Europe and North America—political forces that Israel is harnessing to help shield from scrutiny and accountability its apartheid policies toward Palestinians, both citizens of the state as well as those under military rule. In its efforts to conflate anti-Zionism with anti- Semitism, the Israeli government is assisted by non-state organizations that nonetheless enjoy close ties with the state and its agencies.

Abstract:: This introductory essay contextualizes the special collection of papers on the pandemic and seeks to map the terrain of extant public health research on Palestine and the Palestinians. In addition, it is a contribution in Palestine studies to a nascent yet propulsive conversation that has been accelerated by Covid-19 on the erasure of structures of violence, including those of settler colonialism and racial capitalism, within the discipline of epidemiology. Using public health as an analytic, this essay asks us to consider foundational questions that have long been sidelined in the public health discourse on Palestine, including the implications for health and health research of eliding ongoing settler colonialism. Rather than ignoring and reproducing their violence, this essay seeks to tackle these questions head-on in an attempt to imagine a future public health research agenda that centers health, and not simply survivability, for all Palestinians.

1614. Responding to Precarity: Beddawi Camp in the Era of Covid-19

Abstract:: How are refugees responding to protect themselves and others in the midst of the Covid-19 pandemic? How do these responses relate to diverse local, national, and international structures of inequality and marginalization? Drawing on the case of Beddawi camp in North Lebanon, I argue that local responses—such as sharing information via print and social media, raising funds for and preparing iftar baskets during Ramadan, and distributing food and sanitation products to help people practice social distancing—demonstrate how camp residents have worked individually and collectively to find ways to care for Palestinian, Syrian, Iraqi, Kurdish, and Lebanese residents alike, thereby transcending a focus on nationality- based identity markers. However, state, municipal, international, and media reports pointing to Syrian refugees as having imported the virus into Beddawi camp place such local modes of solidarity and mutuality at risk. This article thus highlights the importance of considering how refugee-refugee assistance initiatives relate simultaneously to: the politics of the self and the other, politically produced precarity, and multi-scalar systems that undermine the potential for solidarity in times of overlapping precarities.

1615. Covid-19 Fault Lines: Palestinian Physicians in Israel

Abstract:: This essay explores representations of Palestinian physicians in the Israeli health-care system during the Covid-19 pandemic and the dynamics that have played out in that system during the public health emergency from the perspective of a Palestinian physician. It argues that the health-care system, an essential pillar and infrastructural foundation of the settler-colonial project, is naively imagined as an apolitical, neutral sphere. As the site of a metaphorical battlefield against Covid-19, it has been window-dressed as an arena for brotherhood between Israeli Palestinians and Jews, and fantasized about as a gateway to political gain or equality for the Palestinian citizens of Israel (PCIs). Throughout the process, settler militarism, settler symbols, and settler domination have continued to be normalized.

1616. Covid-19 and the Necroeconomy of Palestinian Labor in Israel

Abstract:: The situation of West Bank Palestinians working in Israel has highlighted a number of parallels with the conditions of global labor employed in essential sectors during the Covid-19 pandemic. Under capitalism, the compulsion to work, ostensibly to cultivate life, comes at the risk of being exposed to death, but is preferred over immiseration caused by unemployment. The pandemic has merely amplified existing structural features of such employment. For Palestinian workers, with the risk of infection in Israel being significantly higher, the perilous conditions experienced by Palestinian labor have turned the preservation of life enabled by such employment more firmly into the production of death. The Palestinian Authority (PA), too, faces a conundrum: to balance the economic benefits it derives from Palestinian disposability in the Israeli labor market with public health considerations limiting such employment. This essay argues that the Covid-19 pandemic lays fully bare the necroeconomy produced by the intersection of settler colonialism and capitalism, which also forms the bedrock of the necropolitical order in the West Bank.

Abstract:: This essay explores the challenges and opportunities that the Covid-19 pandemic has afforded Israel as it broadens its settler-colonial objectives internally, in Gaza, and elsewhere. In particular, it sheds light on the heightened militaristic and economic approaches taken by Israel to further entrench its siege of Palestinians in Gaza and to export increasingly advanced technologies of surveillance and state control long deployed against the Palestinian people. This investigation thus offers an opportunity to probe settler colonialism’s strategic opportunism in the face of the historic pandemic.

Abstract:: The Covid-19 pandemic has laid bare the devastating and disproportionate effects of structures of violence that produce vulnerability in communities of color globally, including with respect to mental health-care provision. While coping and resilience are dominant mainstream frameworks to understand mental health in crisis—both in Palestine and elsewhere—the three contributors to this roundtable were asked to offer a rejoinder to that approach. They reflect on the pandemic as an opportunity to revisit how we understand and advocate for critical approaches to mental health in Palestine in the midst of prolonged crisis.

Abstract:: This paper examines Mahmoud Darwish’s exploration of the political, geographical, existential, and metaphysical dimensions of displacement, banishment, and statelessness in his 2005 lyrical epic “Exile.” The paper offers an analysis of Darwish’s treatment of dialectic, heteroglossia, the juxtaposition of the national and the existential, and conflicting temporalities, as well as political uncertainty and metaphysical fear. With particular reference to the paradoxical portrayal of space in “Exile”—the juxtaposition of the near and far, real and illusory, localized and dispersed—I also examine the ways in which Palestinian identity, as narrated in this poem, is destabilized and dispersed by what Michel Foucault calls “heterotopic space.”

Abstract:: Fatah leaders routinely accuse Hamas of plotting to establish an “emirate” in the Gaza Strip. Gaza is in fact turning into a statelet separate from the West Bank, but it is Israeli policies that are driving the “Gaza is Palestine” option with a series of measures that have been implemented since the early 1990s to sever Gaza from the West Bank. This development has intensified under the administration of U.S. president Donald Trump. In the White House’s vision for Middle East peace, which turns the West Bank into a series of isolated Bantustans enveloped by Israeli territory and shorn of Jerusalem, the Gaza Strip becomes the centerpiece of any future Palestinian entity. The international community, laser focused on avoiding another war in Gaza, has prioritized the humanitarian over the political crisis, furthering the excision of the Palestinian territory. As aid flows directly into Gaza, bypassing Ramallah, and Israel and Hamas negotiate a long-term ceasefire, the Palestinian Authority (PA) finds itself increasingly marginalized.

Abstract:: This study aims to reveal the situation of small-scale family businesses that are looking for a market in Western and North African countries and want to realize their growth strategies in this region, and to develop solutions for their growth problems. For this purpose, the market development stages of the selected ABC Company were evaluated within the scope of action research. One of the researchers worked in the company within the scope of UPEP (Üniversiteden Pazar Elçiliğine Projesi -From University to the Market Ambassador Project) in the field to conduct action research, while the other researcher supervised the process academically. Inherent in action research is an approach to find a solution to the problem of the unit that is the subject of the research. The researchers analyzed the market search and development strategies of the company subject to the research and seek solutions for their growth problems. As a result of the research, it is concluded that the example ABC Company, which wants to be effective in these markets, will follow the stage model while opening up to international markets, and will be more effective in terms of penetration into the market. The literature that this result is suitable for small-scale family businesses that are in search of similar support has been supported.

Abstract:: Balkanlardaki birçok farklı unsuru bünyesinde barındıran Bosna Hersek, bu karmaşık yapı nedeniyle bazı sıkıntılı süreçler geçirmiştir. Yirminci yüzyılın son döneminde en büyük trajediler arasında sayılan Sırplar ile Boşnaklar arasındaki savaş bölgede birçok yıkım ve tahribata sebep olmuştur. Bosna’da Uluslararası hukukun diplomatik yöntemler, uluslararası örgütlerin ve uluslararası yargının müdahalesi vasıtasıyla tüm imkanlarının kullanıldığı görülmektedir. Ancak bu imkanların çatışmaları engellemedeki başarısı tartışmalı olmuştur. Bu çalışma, söz konusu methotların hangi düzeyde etkide bulunduğu sorunsallaştırmaktadır. Uluslararası hukukun eksik uygulanışının meydana getirdiği büyük sorunların gösterilmesi çalışmanın amacını oluşturmaktadır.

Abstract:: Bu çalışmanın amacı 2018-2019 yılları için mevduat bankalarının finansal performansının Entropi ve Mairca (Multi Attributive İdeal-Real Comparative Analysis) yöntemlerinin ortak kullanımı hesaplanıp sıralanmasıdır. Bu minvalde Türkiye genelinde yüz ve üzeri şubesi olan on üç adet mevduat bankası çalışma kapsamına dahil edilmiştir. Çalışmada, analiz için kullanılan, Toplam Aktifler, Toplam Kredi ve Alacaklar, Toplam Mevduatlar, Toplam Özkaynaklar, Şube Sayısı ve Personel Sayısı kriterleri kullanılarak mevduat bankalarının finansal performansları hesaplanmıştır. Yapılan analiz sonucunda 2018-2019 yılları için en iyi finansal performansa sahip mevduat bankası T.C. Ziraat Bankası, en kötü finansal performansa sahip mevduat bankası ise Şeker Bank olarak tespit edilmiştir. | The purpose of this study is to calculate and use the joint use of CRITIC and Mairca (Multi Attributive Ideal-Real Comparative Analysis) methods of deposit banks for 2018-2019. In this manner, and over a hundred branches throughout Turkey with thirteen commercial banks were included in the study. In the study, the financial performances of deposit banks were calculated using the Total Assets, Total Loans and Receivables, Total Deposits, Total Equity, Number of Branches and Number of Employees used for analysis. According to the analysis results, Ziraat Bank is the best bank in 2018. The best bank in 2019 is Ak Bank. The worst bank in 2018-2019 is Deniz Bank

For this reason, since the path of competitiveness through technological differentiation in industrialization provides a wider and innovative field of research, it reveals the result of a new phase of organization and industrial technology that is beginning to change our relationship with industry, society and human interaction in the business world at present standards. The main target of this study is to reveal the effects of Industry 4.0 on the Maritime sector using with the explanation of the historical development and conceptual framework of today's high technology industry 4.0 and its expectations in maritime sector in the light of the relevant literature. The whole worldwide maritime applications and their reflections on all fields are also the scope of this study. A qualitative descriptive analysis method was conducted to determine the current situation of Maritime Sector which is including Industry 4.0 processes. The findings of this study are Marine-related organizations should be reshaped to meet the needs of the future. Measures and regulations related to the increasing environmental protection sensitivity in the world will directly affect almost every area of the sector. Also, the developing technologies, increasing customer demand and intense competition; it will make the recently introduced Industry 4.0 implementation inevitable.

1625. Do Private Sector Short-term External Debt Have Impact on Credit Default Swap Premiums In Turkey? An Analysis with Asymmetric Threshold Cointegration Approach

Abstract:: A country’s capacity to pay short-term external debt, which reflects the fiscal strenght of an economy against adverse shocks, is significantly taken into consideration by international investors in their decision making process. It has been seen that Turkey has experienced a gradually increasing private sector short-term external debt especially in the last twenty-year period. The objective of this study is to investigate the long-run relationship between private sector short-term external debt and CDS (credit default swap) premiums in Turkey for the period of 2000:Q4-2017:Q4 by using asymmetric threshold autoregressive (TAR) and momentum threshold autoregressive (M-TAR) procedures of Enders and Siklos (2001). The results indicate that CDS premiums and private sector short-term external debt in Turkey are cointegrated. After finding cointegration, the null hypothesis of symmetric adjustment is tested against the alternative of asymmetric adjustment and the evidence of symmetric adjustment is found, suggesting that the relationship between the private sector short-term external debt and CDS premiums has the same effect in expansion and contraction periods.

Abstract:: There are contradicting arguments in the literature examining the influence of foreign investment on economic growth in Sub Saharan Africa. Some researchers claim that high level of volatility, rising current account deficit, lack of developed financial markets and low quality of regulatory framework would generate economic losses for developing countries in Sub Saharan Africa when they liberalized their capital flows. However, some studies focus on growth enhancing effect of foreign investment to be a remedy for low capacity of accumulated savings in Sub Saharan Africa. The current study brings new evidence about the role of foreign portfolio investment and foreign direct investment on economic growth for countries in Sub Saharan Africa. Due to the endogenenity issue, we have used panel VAR methodology to estimate three simultaneous equations system. By analyzing 25 Sub Saharan African countries over the 1990-2016 period, we found that foreign direct investment and foreign portfolio investment are complements and they have positive significant impacts on economic growth.

İç denetimin kuruma değer katabilmesi konusunda iç denetçilerin mesleki yeterliliği, karakteri ve motivasyonu çok önemlidir. İç denetçilerin temel ürünleri olan raporlamalar ile raporun içerisinde yer alan bulguların ve önerilerin yeterliliği, her ne kadar analizlere dayansa da iç denetçinin yargı ve kanaatlerinin bir sonucudur. Motivasyonu yüksek olan bir iç denetçi, daha doğru bulgular tespit edebilecek, daha uygulanabilir ve yerinde öneriler sunabilecek ve kuruma daha fazla değer katacaktır. Bu çalışmada, iç denetçilerin kariyer yolu incelenerek 2020 yılı mart ayında Bakanlıklarda görevli iç denetim birim başkanları ile yapılan yarı yapılandırılmış mülakatlar sonucunda iç denetçilerin motivasyonları üzerinde etkili olan hususlara değinilmiştir. Sonuç olarak; teşkilat kararnamesinde iç denetim biriminin yer almaması, iç denetim birim başkanlarının statüsü, iç denetimin kurumdaki yeri, yönetici desteği, iç denetçilerin kariyer yolu, kültürel yapı, teftiş kurullarının yapısı ve ilişkisi, ilk iç denetçilerin müfettiş veya kontrolör kökenli olmaları başlıkları altında toplanan konuların iç denetçilerin motivasyonu üzerinde etkili olduğu değerlendirilmiştir.

Abstract:: Dünya nüfusu hızla yaşlanmaktadır. 2019 yılı itibariyle dünyadaki yaşlı nüfus oranı %9,3’tür. Türkiye ise %9,1’lik yaşlı nüfus oranı ile dünya ortalamasına yaklaşmış durumdadır. TÜİK projeksiyonlarına göre Türkiye’de yaşlı nüfus oranının 2023 yılında %10,2’ye, 2030 yılında %12,9’a, 2040 yılında %16,3’e, 2060 yılında %22,6’ya, 2080 yılında ise %25,6’ya yükseleceği öngörülmektedir. Bu nüfus projeksiyonu hızla yaşlanan nüfusa yönelik sosyal politikaların önemini ortaya çıkarmaktadır. Bu bağlamda yaşlı nüfusa yönelik sosyal sigorta, sosyal yardım ve sosyal hizmet politikalarına duyulan ihtiyaç artmaktadır. Bu çalışmada hızla yaşlanan Türkiye nüfusuna dikkat çekilerek, Türkiye’de yaşlılara yönelik uygulanan güncel sosyal politikaların kapsamı hakkında bilgi verilmektedir.

Abstract:: İşsizlik bütün toplumların üstesinden gelmeye çalıştığı öncelikli ve önemli bir sorundur. İşsizlik, bir taraftan ülke ekonomisinin âtıl kapasitede çalışıyor olmasını göstermesi diğer taraftan da psikolojik, sosyal, ekonomik ve politik yönler barındırıyor olması bakımından çok boyutlu bir kavramdır. Bu nedenle işsizlik ve etkileri çok farklı disiplinlerce sürekli incelenmektedir. Çalışma kapsamında, finansal liberalizasyon sonrasında Türkiye’de ekonomik büyümenin işsizlik türleri üzerindeki etkisi Okun Yasası ve istihdamsız büyüme hipotezi merkezinde incelenmektedir. Veriler Dünya Bankası veri tabanından derlenmiştir ve 1988-2018 yıllarını kapsamaktadır. İşsizlik oranları olarak; toplam, erkek, kadın, genç, genç-erkek ve genç-kadın verileri ele alınmaktadır. Değişkenler arasındaki nedensellik ilişkisi Hatemi-J ve E. Roca tarafından geliştirilen asimetrik nedensellik testiyle incelenmektedir. Elde edilen sonuçlara göre; içsel ve dışsal nedenlerden kaynaklanan ekonomik şoklar işsizlik serilerinde yapısal kırılmalara neden olmakta ve da histeri etkisinin ortaya çıkmasını sağlamaktadır. Değişkenler arasında asimetrik ilişki vardır. Ekonomik büyümenin artması, genel, genç ve kadın işsizlik oranlarında azalmaya neden olmaktadır ve Okun Yasası bu seriler için geçerlidir. Ekonomik büyümeden genel erkek ve genç erkek işsizlik oranları için istihdamsız büyüme yaklaşımı öne çıkmaktadır. Sonuç olarak; -diğer şeyler sabitken- Türkiye’nin bir taraftan histeri etkisini gidermek diğer taraftan da işsizlik oranlarını düşürmek için ekonomik büyümeyi destekleyici mahiyetteki makroekonomik politikalara yönelmesi gerektiği düşünülmektedir. | Unemployment is a preferential and important problem for all societies to overcome. Unemployment causes loss in the economic potential and in addition to this, unemployment has psychological, social, economic, and political aspects, so the problem becomes multidimensional. In this study, the effect of economic growth on the types of unemployment is examined in the scope of Okun's Law and Jobless Growth hypothesis. The data was compiled from the World Bank database and covers the years 1988-2018. As unemployment rates; total, male, female, youth, young-male, and young-female data are taken. After unit root tests, the causality relationship between the variables is examined with the asymmetric causality test developed by Hatemi-J and E. Roca. According to the results obtained; internal and external economic shocks cause structural breaks and so hysteresis effect becomes valid on the unemployment series. There is an asymmetrical relationship between the variables. Economic growth causes a decrease in general, youth, and female unemployment rates and Okun's Law is valid to these series. The Jobless growth approach applies for relations from economic growth to general-male and young-male unemployment rates. As a result; Turkey may/should apply macroeconomic policies focused on economic growth in order to eliminate hysteresis effect and reduce unemployment rates.

1630. Başkanlık Sistemi Üzerine: Cumhurbaşkanlığı Sisteminin Zayıf Halkası Parlamento

Abstract:: Türkiye, 2017 yılında, 1876 yılından beri uygulamada olan Parlamenter hükümet sistemine son vererek, Başkanlık sistemine geçti. Uzun süreden beri yaşanan politik, ekonomik ve toplumsal sorunlar, Başkanlık sistemine geçişin gerekçesi olarak sunuldu. Parlamenter sistemden Başkanlık sistemine geçiş sürecinde, yeterli olmasa da, konu tartışıldı. Birçok konuda olduğu gibi bu konuda da baskın iki görüş ortaya çıktı. Başkanlık sisteminden yana olanlar, genellikle Türkiye’de yürürlükteki Parlamenter sistemin sonuçları üzerinden konuya yaklaştılar. Parlamenter sistemden yana olanlar ise Başkanlık sisteminin özellikle Latin Amerika’daki uygulamaları üzerinden konuyu ele aldılar. Artık Türkiye, Başkanlık sistemine geçtiğine göre yapılması gereken, Başkanlık sisteminin zayıf noktalarına ve yürürlükteki Cumhurbaşkanlığının eksiklerine odaklanmaktır. Böylece yürürlükteki sistem, daha güçlü hale gelebilir ve sistemden kaynaklanan sorunlar bir nebze olsun giderilebilir. Bu bağlamada çalışmada, hükümet sistemlerinin doğuşu, aralarındaki farklar, yaygınlıkları ele alındıktan sonra Başkanlık sisteminin zayıf noktaları ortaya konularak yürürlükteki Cumhurbaşkanlığı sisteminin eksiklikleri üzerinde durulmuştur. Buna göre, daha önceki Hükümet sistemi gibi, yeni Hükümet sisteminin de zayıf halkası yasama organıdır. Bu bağlamda Türkiye, yasama organını güçlendirilerek, muhtemel sorunların üstesinden gelebilir.

Abstract:: Özet Bu çalışmada “kirli eller” kavramı siyaset felsefesinin en çok tartışılan konularından biri olan siyaset-ahlak ilişkisi çerçevesinde ele alınacaktır. Bu amaçla öncelikle deontolojik ve teleolojik ahlak anlayışlarına değinilecek daha sonra kirli eller kavramı örnekler üzerinden analiz edilecektir. Weber’in sorumluluk ahlakı dediği şeyin kirli eller kavramına benzerliği gösterilecek; kirli ellerin siyaset ahlak geriliminde bir orta yol olduğu Walzer’ın görüşleri bağlamında temellendirilecektir. Sonuç olarak Kavramın siyaset ve ahlak arasındaki gerilimi azaltan bir yönünün olduğu; ne deontolojik ne de teleolojik bakış açısı içinde değerlendirilemeyeceği gösterilecektir.

Abstract:: Monetary instability poses a threat to free societies. Indeed, currency instability, banking crises, soaring inflation, sovereign debt defaults, and economic booms and busts all have a common source: monetary instability. Furthermore, all these ills induced by monetary instability bring with them calls for policy changes, many of which threaten free societies. One who understood this simple fact was Karl Schiller, who was the German Finance Minister from 1966 until 1972. Schiller’s mantra was clear and uncompromising: “Stability is not everything, but without stability, everything is nothing” (Marsh 1992: 30). Well, Schiller’s mantra is my mantra. I offer three regime changes that would enhance the stability in what Jacques de Larosière (2014) has asserted is an international monetary “anti-system.” First, the U.S. dollar and the euro should be formally, loosely linked together. Second, most central banks in developing countries should be mothballed and replaced by currency boards. Third, private currency boards should be permitted to enter the international monetary sphere.

1633. The Effect of War on Economic Growth

Abstract:: With the collapse of the Soviet Union, it was thought that major wars had become obsolete (Mueller 1989) and perhaps regional conflicts might be brought under control (Cederman, Gleditsch, and Wucherpfennig 2017). But, while the level of violence declined, the number of wars in the world appears to have reached a new steady state. A world that was once organized by East-West rivalry is now characterized by ethno-religious conflicts, as well as by spontaneously arising transnational terrorist organizations and criminal gangs. For various reasons, economists have become interested in investigating the causes and effects of war and other armed conflict (e.g., Coyne and Mathers 2011). This article uses a consistent measurement of these forms of violence across space and time to conduct a rigorous quantitative analysis of the effect of war on economic growth.

1634. Tariffs and Monetary Policy: A Toxic Mix

Abstract:: The ratcheting up of tariffs and the Fed’s discretionary conduct of monetary policy are a toxic mix for economic performance. Escalating tariffs and President Trump’s erratic and unpredictable trade policy and threats are harming global economic performance, distorting monetary policy, and undermining the Fed’s credibility and independence. President Trump’s objectives to force China to open access to its markets for international trade, reduce capital controls, modify unfair treatment of intellectual property, and address cybersecurity issues and other U.S. national security issues are laudable goals with sizable benefits. However, the costs of escalating tariffs are mounting, and the tactic of relying exclusively on barriers to trade and protectionism is misguided and potentially dangerous. The economic costs to the United States so far have been relatively modest, dampening exports, industrial production, and business investment. However, the tariffs and policy uncertainties have had a significantly larger impact on China, accentuating its structural economic slowdown, and are disrupting and distorting global supply chains. This is harming other nations that have significant exposure to international trade and investment overseas, particularly Japan, South Korea, and Germany. As a result, global trade volumes and industrial production are falling. Weaker global growth is reflected in a combination of a reduction in aggregate demand and constraints on aggregate supply.

1635. The U.S.-China Trade War: Is There an End in Sight?

Abstract:: Donald Trump was a trade “hawk” long before he became president. In the late 1980s, he went on the Oprah Winfrey show and complained about Japan “beating the hell out of this country” on trade (Real Clear Politics 2019). As president, he has continued with the same rhetoric, using it against a wide range of U.S. trading partners, and he has followed it up with action (often in the form of tariffs). While many countries have found themselves threatened by Trump’s aggressive trade policy, his main focus has been China. As a result, the United States and China have been engaged in an escalating tariff, trade, and national security conflict since July 2018, when the first set of U.S. tariffs on China went into effect and China retaliated with tariffs of its own. In this article, we explore the U.S.-China economic conflict, from its origins to the trade war as it stands today. We then offer our thoughts on where this conflict is heading and when it might end.

Abstract:: The BRICS is a group of countries formed by Brazil, Russia, India, China and South Africa that began to operate formally in 2009 as a legitimate, efficient and durable agent of governance in the world order (ACHARYA 2016: 1-27). Scholars all over the world –many of them cited here in this article –have painted the image of the BRICS as an ‘economic colossus’, assuming an underdeveloped intra-bloc cooperation restricted to economic issues. Nonetheless, from an economic starting point, the BRICS has evolved in the last years expanding its cooperation capabilities to a huge array of issues that encapsulates innovation and sensitivity.

Abstract:: The grouping of the BRICS countries is controversial in several ways. First, because its origins do not have a political foundation: Brazil, Russia, India and China were first put together as an acronym created in the financial market (O’NEILL, 2001) and this was eventually transposed onto the political world. The group’s advocates have argued that the geopolitical initiative that followed made sense because it brought together countries of continental proportions, large economies, with huge domestic markets –an argument that falls apart with the inclusion of South Africa in 2010. In addition, there is the issue of the disproportionate economic power between China and the other members of the bloc. Moreover, many argue that there are few common interests between the economies, which have such diverse productive structures, and therefore it would be unlikely that they could form a cohesive group (see STUENKEL, 2013, pp. 620-621 for a review of criticisms of the group).

Abstract:: The first decade of the 21st century gave way to a series of international political-economic dynamics with the potential to reorganize global power (IKENBERRY, 2018; KITCHEN; COX, 2019; MAHBUBANI, 2009; MEARSHEIMER, 2018, 2019). Among the changes, one common reference is the rise of the BRICS –Brazil, Russia, India, China, and South Africa –and, consequently, their performance for demanding reforms of the global governance system (COOPER, 2016; HURRELL, 2018; ROBERTS; ARMIJO; KATADA, 2018; STUENKEL, 2017). The emerging economies have invested in consolidating their new status by acting in different branches of global governance, demanding changes and policies to see a reasonable parity between their economic weight and ability to participate as real decision-makers. In this context, international regimes are a crucial dimension to consider.

Abstract:: After two decades of intense debate about the determinants of economic development, with authors examining the variables that characterize geography, institutions and international trade, BRICS countries were left behind. Thus, in order to fill this gap, this paper uses econometrics of panel data to analyze the economic performance of these developing nations. Mainstream economists have run into serious problems to deal with these particular determinants within the traditional endogenous growth model, and they have not come up with an agreement, so they keep trying to figure out who is the “winner of this competition”. Empirical evidence shows that there is not a unique explanatorydeterminant, and recognizing which of them can provide the best understandingdepends on the particularities of each case (ROS, 2013).Examining BRICS as a group of countries demonstrates that these specific developing nations share some remarkable features. They are rapidly-growing nations with a vast amount of land and growing participation in international trade. So, empirical tests are feasible and desirable in order to understand their recent development. However, they are also different in many aspects, mostly in terms of institutional characteristics. Thus, our goal is to find out if the econometrics of panel data can shed some light on this ongoing debate.

Abstract:: Attracting international students is an important way to promote the internationalization of one country’s higher education, and to enhance youth and education exchanges between countries. As the biggest developing country in world, China has attachedimportance to the international students education in China since 2010 so as to improve the quality of China’s higher education and promote its internationalization. What’s striking is that in September of 2010, for the first time, the Ministry of Education of the People’s Republic of Chinafrom the perspective of national strategymapped out a plan targeting the international students educationin China, and releasedStudy in China Program, which was designed to “promote the communication and cooperation between China and other countries in education, promptthe sustainable and healthy development of the international students education in China and improve the internationalization of Chineseeducation”. Abstract:: Leaders often believe that states that demonstrate disloyalty toward an ally will acquire a reputation for disloyalty, and thus damage other alliances. But in some circumstances, excessive loyalty to one ally can damage—perhaps even destroy—other alliances. The First Taiwan Strait Crisis (1954–55) shows that alliance interdependence is governed not by a reputation for loyalty, but by assessments of allied reliability.

Abstract:: The U.S. military’s prevailing norms of military professionalism are poorly suited to meet today’s civil-military challenges. These norms, based on Samuel Huntington's objective civilian control model, argue that the military should operate in a sphere separate from the civilian domain of policymaking and decisions about the use of force. Yet, these norms also undermine the military’s nonpartisan and apolitical ethos, weaken civilian leaders' control of military activity, and undercut the country’s strategic effectiveness in armed conflict.

Abstract:: The 1994 Agreed Framework called for North Korea to dismantle its plutonium-production complex in exchange for civilian light water reactors (LWRs) and the promise of political normalization with the United States. Today, scholars look back at the Agreed Framework as a U.S. offer of “carrots” to bribe the regime, but this framing overlooks the credibility challenges of normalization and the distinctive technical challenges of building LWRs in North Korea. Political and technical analysis reveals how the LWR project helped build credibility for the political changes promised in the Agreed Framework.

Abstract:: In early 2017, the Chinese Communist Party changed its internal security strategy in Xinjiang, escalating collective detention, ideological re-education, and pressure on Uyghur diaspora networks. Abstract:: From civil strife in Syria to the war in Yemen to US-Iran tensions, Shi'a groups are emerging as major players on the geopolitical landscape. The 200 million Shi'as around the world comprise 15–20 percent of all Muslims, yet little is understood about their culture, historical legacy, and political dynamics. Shi’as are the majority sect in Iran, Iraq, Azerbaijan, and Bahrain, and comprise substantial minority groups in Africa, South and Central Asia, and countries throughout the Middle East. Last fall, the Weatherhead Center launched the Project on Shi’ism and Global Affairs to support advanced research on the diverse manifestations of Shi’ism, and to encourage rigorous scholarship on the political dynamics of its role in the Middle East. The project supports scholarship that increases understanding of the intersection between religion and politics in Islam by engaging political scientists, historians, policy makers, religious leaders, and other specializations at the WCFIA. It was a busy first year, replete with talks on important events in Islamic history, the geopolitics of Iraq, the US-Iran confrontation, and more. The project launched the online platform Visions, which offers advanced commentary on all aspects of Shi’a thought, politics, and society. Additionally, project members have travelled to Baghdad and Erbil in Iraq for field work and academic conferences, as well as to the United Kingdom to present research and conduct outreach. Team members have also travelled to various cities across the United States to give presentations and interactive workshops—including to Muslim-American communities in Dearborn, Michigan (home to the largest Arab-American population in North America) and Orlando, Florida—on the topic of religious pluralism, youth activism, Islamic thought, and civil society. Directed by Payam Mohseni, lecturer at Harvard University, the project is funded in part by a grant from the Henry Luce Foundation. We asked Payam Mohseni and project chairs Melani Cammett and Ali Asani about the motivations behind the Project on Shi’ism and Global Affairs.

Abstract:: For decades, the Graduate Student Associate (GSA) Program has sat, literally and figuratively, at the heart of the Weatherhead Center. Established in the late 1960s, the program now comprises some twenty-five doctoral students from nearly a dozen different departments and programs across Harvard. Students appointed as Weatherhead GSAs get office space, research funding, and membership in a diverse community of like-minded scholars. While they work across different disciplines and deploy an array of research methodologies, they all share an interest in the core research areas of the Weatherhead Center and an open-minded approach to scholarly inquiry and exchange. If the GSA program sits at the heart of the Center, at the heart of the program itself is the long-running Friday lunch seminar. Every Friday we would gather in the Bowie-Vernon Room, the Center’s main seminar space, to catch up, share great food, and hear and discuss the work of one of the GSAs. Presentations have ranged from testing out potential dissertation topics to mock job talks and everything in between. Over the years, many GSAs have testified to how profoundly the program influenced their lives, helping to shape their intellectual trajectories and launching lifelong friendships. For a program with such emphasis on community, the recent campus lockdown presented a special challenge. Since mid-March, students have been unable to use their offices, and the Friday lunches have moved online. And while important things were lost in this transition—not least the freestyle socializing that began each gathering and the famous, Clare Putnam-curated lunch buffets—the intellectual exchanges have remained as fascinating and robust as ever. Of course, the insights that GSAs produce go far beyond these gatherings, and many have been contributing to the wide-ranging public conversation about the current crisis. The following short selections, focused on the question of the pandemic’s impact on China through an international lens, is yet more evidence that our GSAs remain as brilliant and as engaged as ever.

1648. International Peace Efforts in the Syrian Civil War: The ‘Inevitable’ Failure?

Abstract:: The purpose of this article is to assess international negotiation efforts towards ending the civil war in Syria. Although many peace events have been organised since the beginning of the civil war, the existing literature has paid little attention to the impact of international peace efforts in ending the Syrian war. The article aims to close this gap by assessing major peace efforts between 2011 and 2019; The Arab League Peace Plan, the United Nations peace initiatives, and the Geneva, Vienna and Astana peace talks. It analyses these efforts through official reports and documents published by the UN, US, Republic of Turkey, UN Security Council, and members of peace initiatives. These documents are complemented by newspaper articles showing the official views of the regional and global actors as well as the key agents of the conflict. Therefore, the article reveals the reasons for the failure of these conflict resolution efforts. The Syrian government’s reluctance to end the conflict in a non-violent way, the armed groups’ dream of territorial gains and regional and global powers’ involvement in the conflict prevented the solution of the conflict. It utilises official negotiations and ripeness approaches to investigate the insights and contents of peace efforts. The article argues that the regional and global powers have acted as facilitators instead of mediators in the peace talks. It finds that even though these peace events are viewed as official negotiations, they are only pre-negotiation efforts.

Abstract:: This manuscript aims to assess Palestinian street art’s effectiveness as a resistance tool and political instrument in the struggle waged against Israel. It concludes by employing Bourdieu’s concept of symbolic power that Palestinian street art is an effective instrument on account of its ability to instill in Palestinian collective consciousness as a sense of resistance. By utilizing Mouffe’s definition of politics as being a constant struggle between hegemonic and counter hegemonic forces, this work also holds that street art serves Palestinians as a means to reaffirm their political existence and develop an alternative political imagination against the Israeli-imposed reality. This manuscript also broaches the oft-discussed issue of visual diversity in Palestinian street art scene and concludes that eclectic content may serve as a contributive force, if the counter hegemonic character of Palestinian street art is adhered to.

Abstract:: Qatar, a young and tiny Gulf State, realized a remarkable transformation through an immense economic development between 1995 and 2013, and emerged as an active and influential actor at the international stage, receiving worldwide attention and scholarly interests. However, in the post-Arab Spring context, Qatar became the linchpin of a regional crisis as a consequence of the emerging political clash among the Gulf Cooperation Council (GCC) States. This paper analyzes Qatar’s distinctive policies throughout its rise (1995-2013) and the recent period of the regional crisis within the framework of leadership conception. It is argued that the leadership factor played a key role in transforming both the auspicious circumstances of the previous term and the challenging circumstances of the recent term into great advantages to promote Qatar’s autonomy. Through this perspective, it is aimed to address why and how Qatar differs from other small Gulf States, and how this affected Qatar’s emerging as a rising power and as a major party to the regional crisis.

1651. “Nomads” and “Mountaineers”: A Historical Survey of Turk/Turkmen – Kurd Interrelations

Abstract:: Following Turkey’s recent military operation in Syria (Operation Peace Spring), “Turks” and “Kurds” have widely been dichotomized by the Western media outlets and political circles. US President Donald Trump even claimed that “Turks” and “Kurds” have been fighting for hundreds of years, and that they are “natural enemies.” However, the complex historical relationship of “Turks” and “Kurds,” as a loosely connected social totality prior to the age of nationalism, refutes such sloppy and feeble contentions. This work presents an identity-driven historical survey of Turkish/Turkmen societies’ and polities’ interrelations with Kurdish collectivities until the emergence of modern nationhood and nationalism. In doing so, this article provides an ideational and narrational context feeding the Turkish government’s contemporary relationship with the Kurds of the Middle East. The major complication in journalistic and academic literature is rooted in the lack or omission of historical background informing current policy choices influenced by how relevant actors historically perceive each other. Abstract:: This study aims to expose the ways in which leading officials of the Committee of Union and Progress (the CUP) interpreted, internalized, and questioned the conditions of their mission in Arab lands during World War I (WWI). It builds on the memoirs of Falih Rıfkı, aide-de-camp of Commander-in-Chief Cemal Pasha, and Halide Edip, an ardent supporter of the social and educational reforms of the CUP government. Both written after the war, these memoirs reflect not only nostalgia and regret but also the complicated relationship between Turkish officials and Arabs on the eve of their breakup from one another as citizens of the Ottoman State. The study also questions the orthodox argument that the Turkist and anti-Arabic ideology of the CUP government in general and Cemal Pasha’s wartime crusade against Arab nationalists in particular triggered the emergence of Arab nationalism. By contemplating the memoirs of CUP members in Arab lands, this study argues that Falih Rıfkı, Cemal Pasha, and Halide Edip tried to understand the region and its people in order to create a mutual future for Turks and Arabs within the Ottoman Empire.

Abstract:: In 2013, Egypt’s first democratically elected president Mohammed Morsi was overthrown by a military coup. Since then the country has undergone serious setbacks in terms of democracy, individual freedoms, and social justice. Egypt’s failed revolution and the military coup could not be thought independently from the role of external actors - either directly or indirectly involved in this process. Despite their political rhetoric emphasizing democracy promotion and political reforms, both the US and the EU failed to pursue consistent and contributory policies in promoting democratic transition in Egypt out of fear that the electoral victory of Islamist groups would harm their interests in the region. On the other hand, the Gulf Monarchies played a pivotal role in the entrenchment of the military rule by providing financial and political support to the military-backed government as a shield against the democratically elected government in Egypt. This article investigates how the policies adopted by Egypt’s key allies, the European Union, the US and the Gulf Monarchies, impacted the trajectory of Egypt’s political transition in the face of the January 25 revolution and 2013 military coup. The main thesis of the article is that the policies pursued by external actors created a political environment unfavorable for democratic change in Egypt.

1655. Building a Safety Net: Explaining the Strength of Ex-Military Networks

Abstract:: The disarmament, demobilization, and reintegration of ex-combatants has become an integral part of peacebuilding. Although the main purpose of such interventions is to dissolve the military structures of armed groups, there is growing evidence that ex-combatant networks often remain intact. We investigate why such structures continue to thrive. We argue that ex-military networks are stronger when ex-commanders have weak links to elite patronage systems. Ex-combatants who are unable to rely on their former superiors for economic assistance must instead build denser ties to each other to gain access to a social safety net. To assess our argument, we conduct a comparative social network analysis (SNA) of two ex-military networks in Liberia. This innovative approach helps us uncover previously overlooked, but central, dynamics related to ex-combatant groups. We thereby show that SNA provides a range of underutilized tools and exact definitions that can increase our understanding of ex-military networks.

Abstract:: This article focuses on the problematic nexus migration-security, which calls into question classical philosophical-legal and political categories (State, law, territory) dating back to the origins of the modernity. The analysis of Hobbes’ and Grotius’ insights allows to grasp the distance between the modern framework and the post-modern scenarios. The contemporary complex societies are characterized by fundamental socio-legal transitions, in particular as regards the notion of “privacy”, and by the progressive implementation of a new model of law and politics relations that is closely connected to the crucial role played by technology. In the light of this horizon, the migration issue, and its relations with the political phenomenon called “populism”, should be fundamentally understood in a cultural perspective even before its immediate sociological, political and legal projections.

1658. Can Religious Human Rights Discourses Help Integrating Muslim Migrant Communities Across Europe?

Abstract:: The perception of Islam as antithetical to European human rights values is widespread in Europe. Such perceptions complicate the task of integrating Muslim minorities across Europe. While incrementing respect to human rights norms among migrant communities is an important element of any integration policy, this goal should not be perused by forcing migrant communities to adhere to human rights norms based on purely secular grounds. The drafting history of the Universal Declaration of Human Rights is the ultimate proof that human rights can be justified from different political, philosophical and religious perspectives. While European States cannot compromise their commitment to human rights, even in relation to migrant communities, still, they must allow other narratives on the importance and the meaning of human rights to emerge. Muslim migrant communities must be allowed to engage in intra-group religion-based dialogues to reevaluate their stance on human rights and to debate their meaning. After being given the opportunity to engage in internal debates on the significance of human rights, Muslim migrant communities should also be engaged in cross-cultural dialogues with the rest of community to generate a wider agreement on the meaning and the application of human rights. This two-fold strategy is consistent with the principle of subsidiarity, which suggests that for human rights be effective they must be seen as legitimate by all those small groups that are close to the individual. Such legitimacy cannot be imposed from the outside, it must emerge from within these small groups. However, for these intra-group and cross-cultural dialogues to succeed, the separation of religion and State cannot be understood as the complete exclusion of religion from the public sphere. Individuals of different philosophical or religious convictions must have an equal access to public debates on the centrality of human rights in the European legal order.

1659. Enhancing the Protection of the Environment in Relation to Armed Conflicts – the Draft Principles of the International Law Commission and Beyond

Abstract:: n 2011, the UN International Law Commission (ILC) took up the topic Protection of the Environment in Relation to Armed Conflicts.1 The decision was triggered by a joint report issued by the UN Environment Programme and the Environmental Law Institute in 2009 recommending the ILC to “[...] examine the existing international law for protecting the environment during armed conflicts [...] [including] how it can be clarified, codified and expanded [...]”.2 Since the inclusion of the item on the ILC’s agenda, the Commission has published five reports3 by the two special rapporteurs, Dr. Marie Jacobsson (2011-2016) and Dr. Marja Lehto (2017-). In 2019, the plenary adopted 28 Draft Principles on first reading.4 The ILC has touched on highly controversial issues such as reprisals,5 corporate liability,6 indigenous peoples’ rights,7 among others. Nevertheless, it was clear from the beginning that the ILC would not be able to exhaustively deal with the topic for two main reasons. First, the Commission has a limited mandate that is restricted to “[...] initiate studies and make recommendations for the purpose of [...] encouraging the progressive development of international law and its codification [...]”.8 Enhanced legal protection of the environment, as one of the purposes of the Draft Principles,9 must therefore be based on existing customary international law and its progressive development. The Commission decided to also include recommendations to account for the uncertain legal status of some of the Draft Principles.10 Second, some related issues touch upon controversial and political matters, as mentioned earlier. Consequently, the ILC has been reluctant to include some of these issues in its workflow.11 Therefore, the adoption of the Draft Principles should be regarded as a starting point for shaping and developing the legal framework for environmental protection in relation to armed conflicts. As a part of that process, Hamburg University and Lund University organized an international workshop in March 2019 in Hamburg. Several members of the ILC, including two special rapporteurs, academic legal experts, and practitioners, attended the workshop to discuss the Draft Principles. The discussion also focused on some issues not covered by the ILC, such as the implications for gender and climate security. The engaging dialogue in Hamburg has inspired the publication of this Special Issue of the Goettingen Journal of International Law (GoJIL) to ensure that the outcomes and ideas of the workshop reach a wider audience. It has also contributed to maintaining the momentum of this topical area of international law by inviting contributions from researchers not present during the workshop in Hamburg.12

1660. Reflections on the Legality of Attacks Against the Natural Environment by Way of Reprisals

Abstract:: The paper examines the concept of belligerent reprisals and assesses the legality of attacking the environment by way of reprisals. The law of belligerent reprisals, which is linked to the principle of reciprocity, allows one belligerent State unlawfully injured by another to react by means of what under normal circumstances would constitute a violation of the jus in bello, so as to induce the violating State to comply with the law. The instances of lawful recourse to reprisals have been considerably limited, since their application is either explicitly prohibited against certain protected persons and objects, including against the natural environment, or is subject to stringent conditions according to customary International Humanitarian Law (IHL). Despite its narrowing scope, the doctrine of reprisals remains a valid concept under the existing legal framework. For one, the state of affairs under customary international law with respect to reprisals directed at civilian objects (including against parts of the environment), subject to certain rigorous conditions, remains unclear. To complicate matters even further, any proposition on the status of reprisals in the context of a non-international armed conflict (NIAC) is shrouded in controversy, as there is no relevant treaty provision. In this regard, the present author endorses the approach espoused in the International Committee of the Red Cross (ICRC) Study on Customary IHL, namely to altogether prohibit resort to reprisals in the context of a NIAC. Turning to the status of reprisals against the natural environment under customary IHL, it is argued that a prohibition of attacks against the natural environment by way of reprisals is in the process of formation with respect to the use of weapons other than nuclear ones. All things considered, the International Law Commission (ILC) was confronted with an uncomfortable situation in the context of its work on the ‘Protection of the Environment in Relation to Armed Conflicts’. By sticking to the verbatim reproduction of Article 55(2) of Additional Protocol I, the ILC chose the proper course of action, since any other formulation would not only undercut a significant treaty provision, but might also result in the normative standard of conduct being lowered.

1661. Protecting Protected Areas in Bello: Learning From Institutional Design and Conflict Resilience in the Greater Virunga and Kidepo Landscapes

Abstract:: It has often been cited that major armed conflicts (>1,000 casualties) afflicted two-thirds (23) of the world’s recognized biodiversity hotspots between 1950 and 2000.1 In 2011, the International Law Commission (ILC) included in its long-term work program Protection of the Environment in Relation to Armed Conflict.2 This led to the adoption of twenty-eight Draft Principles, including designation of protected zones where attacks against the environment are prohibited during armed conflict.3 Protected zone designations apply to places of major environmental and cultural importance, requiring that they “[...] shall be protected against any attack, as long as it does not contain a military objective.”4 Most research on armed conflict and protected areas has focused on impacts to wildlife and less on how to protect these natural habitats from the ravages of armed conflict.5 This article highlights some of the gaps in the ILC Draft Principles towards protecting protected zones in bello. It uses transboundary protected areas (TBPAs) formalized through multilateral agreements to illustrate challenges on the ground. TBPAs are internationally designated “[...] protected areas that are ecologically connected across one or more international boundaries [...]” and sometimes even established for their promotion of peace (i.e., Parks for Peace).6 There is little legal research on how to design TBPA agreements for conflict resilience, conflict sensitivity, and ultimately positive peace.7 The research draws from two case studies in Africa’s Great Rift Valley: the Greater Virunga Landscape (GVL) between the Democratic Republic of the Congo (DRC), Rwanda, and Uganda, and the Kidepo Landscape, which forms part of the broader Landscapes for Peace initiative between South Sudan and Uganda. Both suffer from armed conflicts of various types and present two of the only TBPAs in the world that have incorporated environmental peacebuilding into their transboundary agreements.8 The case studies illustrate different approaches to TBPA design and the pros and cons of each modality in the context of conflict resilience and conflict sensitivity. This guides us on how to better protect protected areas in bello, ensuring that protected zones endure on the ground and not just in principle.

1662. Through the Looking Glass: Corporate Actors and Environmental Harm Beyond the ILC

Abstract:: Corporate activities take place in a variety of social contexts, including in countries affected by armed conflict. Whether corporations are physically present in these regions or merely do business with partners from conflict zones, there is an increased risk that their activities contribute to egregious human rights abuses or serious environmental harm. This is especially so for corporations active in or relying on the extractives sector. It is against this background that the ILC included two principles addressing corporate responsibility for environmental harm in its Draft Principles on the protection of the environment in relation to armed conflict. Both principles explicitly call on the home States of these corporations to give effect to their complementary role in regulating and enforcing corporate social responsibility. Draft Principle 10 addresses the responsibility of home States to regulate multinational corporations under the heading of “corporate due diligence”, while Draft Principle 11 addresses the responsibility of home States to hold multinational corporations liable for environmental damage caused in conflict zones. The current contribution engages with the potential normative foundations underpinning extraterritorial responsibilities for the home States of multinational corporations with respect to the prevention and remediation of environmental harm in conflict zones, focusing on international humanitarian law and international human rights law. It concludes that the Draft Principles are certainly indicative of the direction in which the law is evolving, but that no firm obligations beyond treaty law can be discerned as of yet. It was therefore a wise decision to phrase the respective Draft Principles as recommendations instead of obligations. At the same time, there are sufficient indications to conclude that it seems a matter of time before it is accepted that States have distinct obligations under customary international law for which their responsibility may be engaged. It is argued that the ILC Draft Principles provide an important impetus to these developments, not in the least because they provide a reference to States regarding the state-of-the-art and guidance for future action.

Abstract:: In July 2019, the International Law Commission (ILC) provisionally adopted, on first reading, a series of draft principles on the protection of the environment in relation to armed conflict (the Draft Principles). The role of businesses in armed conflict is addressed in Draft Principle 10 and Draft Principle 11. The latter, in particular, requires States to implement appropriate measures to ensure that corporations operating in or from their territories can be held accountable for environmental harm in the context of armed conflict. The inclusion of those two Draft Principles reflects increasingly vocal calls for corporate accountability, which has been the focus of the growing field of Business and Human Rights (BHR), an umbrella term encompassing a variety of legal regimes from tort law to criminal law. This contribution will look at the link between businesses, the environment, and armed conflict. Using the newly adopted Draft Principle 11 as a starting point, it explores three major liability regimes through which businesses could be held accountable for damage to the environment in armed conflict: State responsibility, international criminal law, and transnational tort litigation. Using case studies, the article discusses some of the challenges associated with each of those regimes, before concluding that the cross-fertilization phenomenon observed in this article (between public/private law, domestic/international level, and across various jurisdictions) is making BHR an increasingly salient discipline and useful tool in the fight against impunity for corporate environmental harm in armed conflict.

Abstract:: The existing treaty law on the protection of the natural environment during armed conflicts is less than adequate. Treaty provisions relating to international armed conflicts are limited to the prohibition of damage of an extreme kind and scale that has not occurred so far and may hardly be expected from the conduct of hostilities unless nuclear weapons would be used. Even in such a scenario, States possessing nuclear weapons have explicitly objected to the applicability of that treaty law. For internal wars, no pertinent treaty provisions exist in the law of armed conflict. Yet multilateral environmental agreements concluded in peacetime stand as an alternative approach to enhance environmental protection during war. As a civilian object, the environment may not be targeted nor attacked in an armed conflict, but this does not exclude collateral damage, nor does this principle as such offer specific standards for proportionality in attacks. In an effort to close these apparent gaps of treaty law, the present contribution looks into other sources of international law that could be used. In this context, the author revisits the role of the famous Martens Clause in the interplay of international humanitarian law, international environmental law, and human rights law. The role of the Clause in closing gaps caused by the indeterminacy of treaty law is reviewed and customary rules, general principles, and best practices are considered to this effect. For the protection of the natural environment during armed conflicts, the Martens Clause may, indeed, be used as a door opener to facilitate the creation and application of uncodified principles and rules. Particular standards for proportionality in attacks can be derived from the Martens Clause. Pertinent soft law instruments need to be developed in international practical cooperation and by academia. Yet it deserves further study to explore whether, and to what extent, the Martens Clause, which was adopted in the law of armed conflict, may also apply in post-conflict peacebuilding as a case of interaction between the jus in bello and the jus post bellum, at least as far as the protection of the natural environment is concerned.

Abstract:: The protection of the environment in relation to armed conflict, in particular during armed conflict is a complex problem as it involves at least two different fields of international law, the law of armed conflict (international humanitarian law) and international environmental law. Their mutual relationship is a delicate issue. International humanitarian law is not necessarily lex specialis. Three principles deserve particular attention in this connection: as to general international environmental law, the principle of prevention and the precautionary principle, as to international humanitarian law the duty to take precautions. The terms prevention and precaution are used in different contexts in environmental law (both national and international) and in the law of armed conflict. The duty, imposed by international humanitarian law, to take precautions has much in common with, but must be distinguished from, the precautionary approach of general environmental law. This paper shows what these principles mean and how they relate to each other. It answers the question to what extent the rules based on these concepts are effective in restraining environmental damage being caused by military activities. The application of these principles in peace and war serves intergenerational equity and is thus an important element of sustainable development.

Abstract:: In the development of this work, a presentation has been made of the current conditions that can be found in the migratory process and that have the possibility of giving rise to the appearance of the so-called Ulysses Syndrome or Limit Stress Syndrome, in the immigrant population. In this article, special reference is made to the conditions that can be found today in our country, quantitative data are offered that can form a very approximate idea of the enormous magnitude and importance of this migratory phenomenon. Next, a description of the characteristics of the so-called Ulysses Syndrome or Immigrant Syndrome with Chronic and Multiple Stress has been made. In the development of this work, these main characteristics have been shown, with special emphasis on the appearance of a mourning process and on the stress that Ulysses Syndrome can entail. Likewise, the different areas of personal functioning that may be impaired in immigrants and their similarity to a process of mourning (with the possibility of up to seven different types of mourning) have been commented, mainly due to the different personal issues and the different social factors that immigrants leave in their various countries of origin. Next, the symptoms of Ulysses Syndrome are described and the different areas of involvement of people suffering from this disorder are also described. Lastly, a brief reference is made to the possible therapeutic intervention in people affected by the problems described, both if they are in an adult age or if they are in a young infantile age. Abstract:: The problem caused by the growing migratory pressure has caused the European Union (EU) one of its most significant crisis of late. A crisis without precedent. Existing asylum and migration policies have not been able to give the necessary and adequate response due to the serious pre-existing migratory problem. A large number of infringement procedures have also been opened against European Union Member States due to this situation, some of them still are still unresolved and submitted to the Court of Justice of the European Union (CJEU). This article analyzes EU's active policies on migration and asylum from a descriptive point of view as a starting point for the study of the implementation problems of these regulations in the wake of the governance crisis caused by the massive entry of immigrants in 2015 as a consequence of the war in Syria and the massive exodus of its refugees. In addition, the crucial role of the EU Council in this matter is studied through the analysis of its growing role and its active intervention policies against migration problems. The EU legislation is also analyzed as well as the United Nations rules on the matter through the study of the conventions on transnational organized crime and human trafficking. The article finally reviews the infringement procedures on the matter, taking as a comparative basis the reports on compliance with EU law from the last two years, concluding with the need to reformulate the aforementioned policies and the degree of member states' involvement, so as to create a common front against the problem analyzed in this article and its future development.

Abstract:: The end of the Cold War has given way to an impressive tranformation of the security concept, which has experienced an incredible expansion over the last few decades. This expansion has also gone hand by hand with the emergence of new concepts which might allow better analysis in this realm. The human security concept stands out among such new concepts as a result of its analytical value, in spite of all the criticism it has received. One of the questions which has become securitized in the context of the mentioned expansion of the security concept is migration. However, even if migrations have been approached too frequently from a traditional security concept based on the state and its sovereignty, the human seecurity concepts seems a much better tool for the analysis of this reality and its causes. In this sense, we cannot forget that people become migrants or refugees because they see questioned their personal security. Likewise, we have to pay attention to the extent to which, the host states and, particularly, their societies, may see their political, economic and societal security in danger. Therefore, the analysis should pay attention to the security challenges of both, host societies and migrants and refugees. Besides, only an analysis on the basis of the human security concept will allow us to come up with an accurate response to the question of migratory and refugee flows, this is a response which pays attention to some key aspects such as conflict prevention and management an growth and development promotion in the countries of origin of migrants and refugees, always in cooperation with those countries themselves. Such un analysis will show the indivisible nature of security and the fact that the security of host societies and that of migrants and refugees, far from being incompatible, go hand by hand.

Abstract:: The growing numbers of vulnerable migrants seeking shelter and refuge in the United States and Europe are finding increased racism and xenophobia as well as renewed efforts by humanitarian volunteers to offer them aid, sanctuary, and protection. This article sets forth a typology to better understand the motivations of volunteers working to help migrants in need of humanitarian assistance. Why do people go out of their way to offer humanitarian aid to someone they do not know and, in some cases, they will never meet? What are the drivers of altruistic behavior of humanitarian volunteers in the face of rising injustice, nationalism, and xenophobia? In answer to these questions, we offer a typology centered on empathic concern, differentiating secular/faith-based motivations, and deontological/moral-virtue motivations, with particular behaviors in each of the four resulting categories: the Missionary Type, the Good Samaritan Type, the Do Gooder Type, and the Activist Type. We also suggest four additional self-centered (non-altruistic, or not-other-centered) types (Militant, Crusader, Martyr, and Humanitarian Tourist). The nuances offered by this typology can help organizations working with migrants and refugees better understand and channel the enthusiasm of their volunteers and better meet the needs of the vulnerable populations they serve. This is especially important at a time when migration is being criminalized and when humanitarian aid is deemed unpatriotic, if not outright illegal. In the face of increased nationalistic and xenophobic messages surrounding migration, we need to articulate the altruistic humanitarian motivations of volunteers in the context of migration aid. Our typology may also be used to understand altruistic behaviors in other contexts such as disaster relief, community organization and activism, international adoptions, or organ donations to strangers, among others, in which altruistic empathic concern can be an important motivation driving people to act for the well-being of distant others.

Abstract:: Drawing on qualitative interviews that are complemented by the analysis of government policy documents, this study examines statelessness in Ghana. It addresses a range of policy, legal, institutional, administrative, and other politico-socioeconomic matters attendant to the concept. The study defines statelessness in its strict legal sense. It recognizes populations at risk of statelessness that may be restricted from benefiting from the protection and privileges of their host state. Persons identified by the study as stateless or at risk of statelessness include persons from traditionally nomadic migratory communities, former refugees, persons residing in border communities, members of Zongo communities, trafficked persons, and those affected by gaps in previous constitutions. The study also identifies the consequences of statelessness, including lack of access to healthcare, education, justice, and work. The study offers several recommendations to prevent and reduce statelessness in Ghana.

1680. Reverse Migration to Mexico Led to US Undocumented Population Decline: 2010 to 2018

Abstract:: This report presents estimates of the undocumented population residing in the United States in 2018, highlighting demographic changes since 2010. The Center for Migration Studies of New York (CMS) compiled these estimates based primarily on information collected in the US Census Bureau’s American Community Survey (ACS). The annual CMS estimates of undocumented residents for 2010 to 2018 include all the detailed characteristics collected in the ACS. [1] A summary of the CMS estimation procedures, as well as a discussion of the plausibility of the estimates, is provided in the Appendix. The total undocumented population in the United States continued to decline in 2018, primarily because large numbers of undocumented residents returned to Mexico. From 2010 to 2018, a total of 2.6 million Mexican nationals left the US undocumented population; [2] about 1.1 million, or 45 percent of them, returned to Mexico voluntarily. The decline in the US undocumented population from Mexico since 2010 contributed to declines in the undocumented population in many states. Major findings include the following: The total US undocumented population was 10.6 million in 2018, a decline of about 80,000 from 2017, and a drop of 1.2 million, or 10 percent, since 2010. Since 2010, about two-thirds of new arrivals have overstayed temporary visas and one-third entered illegally across the border. The undocumented population from Mexico fell from 6.6 million in 2010 to 5.1 million in 2018, a decline of 1.5 million, or 23 percent. Total arrivals in the US undocumented population from El Salvador, Guatemala, and Honduras — despite high numbers of Border Patrol apprehensions of these populations in recent years — remained at about the same level in 2018 as in the previous four years. [3] The total undocumented population in California was 2.3 million in 2018, a decline of about 600,000 compared to 2.9 million in 2010. The number from Mexico residing in the state dropped by 605,000 from 2010 to 2018. The undocumented population in New York State fell by 230,000, or 25 percent, from 2010 to 2018. Declines were largest for Jamaica (−51 percent), Trinidad and Tobago (−50 percent), Ecuador (−44 percent), and Mexico (−34 percent). The results shown here reinforce the view that improving social and economic conditions in sending countries would not only reduce pressure at the border but also likely cause a large decline in the undocumented population. Two countries had especially large population changes — in different directions — in the 2010 to 2018 period. The population from Poland dropped steadily, from 93,000 to 39,000, while the population from Venezuela increased from 65,000 to 172,000. Almost all the increase from Venezuela occurred after 2014.

1681. Not for Adults Only: Toward a Child’s Lens in Migration Policies in Asia

Abstract:: Having experienced substantial international migration since the 1970s, countries in East, South, and Southeast Asia have developed laws, institutions, policies, and programs to govern various aspects of international migration. Children, however, who comprise a significant share of the world’s international migrants, have not received as much policy attention as adults. Children are part of the region’s international migration experience (e.g., children left behind in the countries of origin when their parents migrate for work, children as migrants, and children as members of multicultural families). This article provides an overview of the challenges faced by children as migration actors, and the policy responses and programs that select countries in the region have developed to address children’s experiences and concerns. The Global Compact for Safe, Orderly and Regular Migration and the Global Compact on Refugees, which many Asian countries have endorsed, set forth objectives, commitments, and actions, informed by the principle of promoting the best interests of the child and child protection, which specifically address the needs of children. These include actions to promote universal birth registration, enhance access to education and health and social services regardless of migrant and legal status, and otherwise create inclusive and socially cohesive societies. Most countries in Asia have yet to meet these standards. Endorsing the two compacts was a first step. The good practices that have been implemented in a number of countries provide a template for how to translate these objectives into action and how to ensure that the full protection and best interests of migrant children, the left-behind children of migrant workers, and those who are part of multicultural families remain a priority.

1682. What’s Wrong with Temporary Protected Status and How to Fix It: Exploring a Complementary Protection Regime

Abstract:: Temporary Protected Status (TPS) became part of the US protection regime in 1990 to expand protection beyond what had been available under the US Refugee Act of 1980, which had limited asylum to those who met the refugee definition from the United Nations’ 1951 Refugee Convention. The TPS statute authorized the attorney general to designate foreign countries for TPS based on armed conflict, environmental disasters, and other extraordinary and temporary conditions that prevent designated nationals from returning in safety. While providing blanket protection that very likely has saved lives, TPS has nonetheless proven to be a blunt instrument that has frustrated advocates on both sides of the larger immigration debate. This article evaluates the purpose and effectiveness of the TPS statute and identifies inadequacies in the TPS regime and related protection gaps in the US asylum system. It argues that TPS has not proven to be an effective mechanism for the United States to protect foreigners from generalized conditions of danger in their home countries. It calls for changing the US protection regime to make it more responsive to the risks many asylum seekers actually face by creating a broader “complementary protection” standard and a more effective procedure for assessing individual protection claims, while reserving “temporary protection” for rare situations of mass influx that overwhelm the government’s capacity to process individual asylum claims. The article looks at alternative models for complementary protection from other jurisdictions, and shows how the US asylum and TPS system (in contrast to most other jurisdictions) fails to provide a mechanism for protecting arriving asylum seekers who do not qualify as refugees but who nevertheless would be at real risk of serious harm based on cruel, inhuman, or degrading treatment or punishment or because of situations of violence or other exceptional circumstances, including natural or human-made disasters or other serious events that disturb public order, that would threaten their lives or personal security. The article proposes that the United States adopt an individualized complementary protection standard for arriving asylum seekers who are not able to meet the 1951 Refugee Convention standard but who would face a serious threat to life or physical integrity if returned because of a real risk of (1) cruel, inhuman, or degrading treatment or punishment; (2) violence; or (3) exceptional situations, for which there is no adequate domestic remedy.

1683. The Use of Executive Orders and Proclamations to Create Immigration Policy: Trump in Historical Perspective

Abstract:: This article examines presidential immigration policy making through executive orders (EOs) and proclamations. Donald Trump’s overall volume of EOs has been remarkably similar to that of other presidents, while his number of proclamations has been relatively high. His immigration-related EOs and proclamations, however, diverge from those of his predecessors in several ways. Of the 56 immigration-related EOs and 64 proclamations issued since 1945, Trump has issued 10 and nine, respectively. Overall, about 1 percent of all EOs and proclamations during this period have been immigration related, compared to 8 percent of Trump’s EOs and 2.4 percent of Trump’s proclamations. In a sharp departure from previous presidents, a greater share of his EOs and proclamations have been substantive policy-making documents intended to restrict admissions of legal immigrants and increase enforcement along the border and in the interior of the United States. This article explores Trump’s unorthodox use of executive tools to make immigration policy, circumventing Congress and even members of his own administration. It recommends that: Congress should hold oversight hearings and should consider revoking or modifying EOs and proclamations that have been issued pursuant to the authority provided to the president by Congress, as opposed to those based on the executive’s constitutional authority. Advocacy organizations should continue to challenge the president’s executive actions, the insufficient process and consultation leading to them, their statutory or constitutional justification, and their impact. Congress should take an inventory of the immigration authorities it has delegated, both explicitly and implicitly, to the executive branch and determine when this authority can and should be limited. Congress should pass legislation to update and reform the US immigration system, and thus clarify its intentions regarding US immigration law, policy, and executive authority in this area.

1684. Building Blocks and Challenges for the Implementation of the Global Compact on Refugees in Africa

Abstract:: Forced displacement continues to be a major challenge to human security across the globe. According to the United Nations High Commissioner for Refugees (UNHCR), the global population of forcibly displaced people increased by 2.3 million people in 2018, and by the end of the year, more than 70 million individuals were forcibly displaced worldwide (UNHCR 2019a). UNHCR also estimated that, in 2018, 13.6 million people were newly displaced as a result of conflicts and droughts (ibid.). Building on the predicament of global sustainability and the 2030 agenda for sustainable development, the Global Compact on Refugees (GCR) is a framework based on four strategic objectives: to (1) ease pressures on host countries, (2) enhance refugee self-reliance, (3) expand access to third-country solutions, and (4) support conditions in countries of origin for return in safety and dignity (UNHCR 2018; UN General Assembly 2019). The GCR urges the international community to respond comprehensively and innovatively to the plight of refugees, and to make a paradigm shift in global humanitarian aid to emphasize refugee self-reliance and livelihoods. One of the risks of such a nonbinding and thin agreement, however, is that the GCR will give rise to a bureaucratic process that “does not come even close to dependably addressing the operational deficits of the refugee regime” (Hathaway 2019, 594). This article looks closely at the prospects for the GCR in sub-Saharan Africa based on the need to shift from a humanitarian system of “care and maintenance” to comprehensive and effective development responses to refugee crises. It also discusses some of these experiences and best practices to promote a resilience-based development approach. It recognizes that development initiatives implemented or still to be implemented under the normative framework of the GCR and the Comprehensive Refugee Response Framework (CRRF) are subject to a multiyear planning and implementation cycle. Therefore, this article does not intend to evaluate their efficacy or measure progress under the GCR, but rather to identify key challenges and to highlight achievements and promising initiatives in sub-Saharan Africa. It particularly focuses on implementation and rollout of the CRRF in Chad, Djibouti, Ethiopia, Kenya, Rwanda, Somalia, Uganda, and Zambia in Africa.

Abstract:: In light of the science and evidence on hazards and climate risk, and the scale and breadth of large-scale disasters witnessed around the world, it is time for states and other actors to begin developing national and local frameworks on planned relocation. While planned relocations have had a poor record in terms of their socioeconomic effects, it is precisely for these reasons that proactive action is necessary. Planned relocation has the potential to save lives and assets, and consequently to safeguard or augment the human security of populations living in areas at high risk for disasters and the effects of climate change. Among the challenges hampering better outcomes for people, however, are the lack of national and local frameworks, community-driven decision making, and sufficient lead times to plan and implement appropriate interventions that promote human security. Relocation of populations is referenced in global frameworks on disaster risk reduction (DRR) and climate change adaptation (CCA) because it is a tool that will become increasingly important as a preventive and responsive measure to reduce the risks of disasters and displacement. This article recommends that national and local DRR and CCA strategies and development plans begin to incorporate planned relocation among the options under consideration to protect people and their human security. It argues that planning for relocations is an expression of a government’s responsibility to protect the human security of its people.

Abstract:: This paper provides a gender analysis of the 2018-2019 Sudanese Revolution, its goals and outcomes, and the strategies employed by protestors and state security forces. To do so, it sheds a light on how protesters drew on, emphasized, and mobilized along gendered identities. It pays particular attention to the part women played in mobilization efforts in the revolution and historic (dis)continuities of their role in mass mobilization. An analysis of protest spaces brings to light the way gender roles were practiced and negotiated within the movement. Examining the state’s response to the demonstrations, the paper highlights state forces’ gender-specific strategies to intimidate protesters and their practice of sexual violence. Lastly, the analysis turns to the first months of political transition. Women’s important roles in the revolution and their challenging of traditional gender roles have not yet translated into equal political representation in the transition, although some of their human rights demands have been met. The paper concludes by urging the Sudanese interim government to include the grievances and perspectives of women and marginalized groups in the negotiation of the country’s future both at the negotiation table and in the transitional legislative body.

Abstract:: Women make up more than 80 percent of North Korean migrants to South Korea. This paper provides a gendered analysis of their migration and offers recommendations to address the systematic oppression and abuse of North Korean migrant women and girls. Gendered human rights abuses and societal shifts in gender roles due to famine contributed to women leaving in record numbers. On the journey, often via China, women face human trafficking fueled by China’s skewed sex ratios, sexual violence, and the threat of extradition back to North Korea where defectors are imprisoned, tortured, or killed. Even those who successfully complete the journey suffer from post-traumatic stress disorder, discrimination, and difficulty adjusting into South Korean society. Interventions and policies must acknowledge the gendered dimension of migration to effectively address the harm North Korean women and girls experience.

Abstract:: Ukrainian surrogacy companies now hold over a quarter of the global surrogacy market since a series of human rights violations caused India, Thailand, and Nepal to close their borders. Similar violations are occurring in Ukraine, including the abandonment and trafficking of children and the abuse of surrogates. The Ukrainian government is not taking action, despite concerns expressed by both lawmakers and surrogates that the industry engages in unethical practices. This paper proposes that the Hague Conference’s Experts’ Group on the Parentage/Surrogacy Project spearhead international ratification of a holistic series of policies focused on protecting women and children from exploitation.

Abstract:: Despite growing consensus that climate change is real, manmade, and pernicious, the U.S. Congress has failed to update old laws – to say nothing of passing new ones – that might mitigate the crisis. State governments have attempted to fill the void, with California setting de facto national policy using powers delegated under the 1970 Clean Air Act (CAA). The Trump administration’s 2019 bid to revoke these powers rejects the process of “iterative federalism” and leads one to believe Trump’s agenda is both vindictive in nature and impervious to broad support for environmental regulation. Yet this support (even in electorally pivotal states like Pennsylvania) proves a weak motivating factor next to the needs of vulnerable constituencies, notably autoworkers. Trump’s agenda is rationally set by his need to attract support in states like Michigan where votes are precious and regulatory exposure is high. Long a means for the federal government to enjoy environmental progress at a safe political distance, the “California carve-out” seems to have exhausted its utility with the Trump administration, which deems all environmental regulation anathema to growth and the happiness of its base. Trump’s rationale is best understood using Conditional Pandering Theory (CPT), which predicts that presidents with middling approval numbers are apt to be led by the public as Election Day draws near and policy outcomes can be delayed. In the case of emissions, policy outcomes are immaterial so long as targeted marginal voters deliver the president a second term.

1690. The Accuracy Of Proxy Means Tests For Immigrant Populations: A Case Study In Colombia

Abstract:: This paper examines the accuracy of proxy means tests (PMTs) for identifying low-income households among migrant and refugee populations. Specifically, it develops a PMT model based on Colombia’s SISBEN system, and evaluates its ability to identify poverty among recent and established Venezuelan migrants and refugees. It finds that these groups have significantly higher rates of exclusion errors relative to native Colombians, which could prevent them from accessing valuable social services. These findings are robust to a number of specifications, and the issue is not resolved by simply including immigration status within the model. Additionally, occupational downgrading is identified as the most likely mechanism for this effect, as Venezuelan migrants and refugees in Colombia generally have lower returns to education when compared with native Colombians. These results should inspire caution when choosing to use PMTs for targeting, and it is recommended that all policymakers evaluate the accuracy of their PMTs for vulnerable subpopulations prior to implementation.

Abstract:: The Global North’s growing demand for fresh pineapple has created a system that is disproportionately profitable for companies and consumers in those countries to the detriment of people living and working in the Global South. Since the mid-1980s the Pineapple Development Corporation (PINDECO), a subsidiary of U.S.-based Del Monte, has established a monopoly over fresh pineapple exports in southern Costa Rica. We conducted pilot research in the municipalities of Buenos Aires and San Isidro del General in 2019, where the majority of PINDECO’s production takes place. PINDECO and the Costa Rican state claim pineapple production is beneficial to national development through its contribution to Costa Rican gross domestic product and employment opportunities, but our research and recent data reveal that in pineapple producing areas in the southwest, poverty levels remain high with worsening water and food security despite PINDECO’s large profit margins. There are numerous human and environmental health concerns linked to pineapple monocropping. Intensive pesticide use often utilizes chemicals that are banned or restricted in the countries they are imported from. PINDECO has been able to evade responsibility for environmental damages and social welfare obligations to employees while maintaining a largely positive public image through a lax regulatory environment and extensive subcontracting structure. This article connects regional socioeconomic issues to the intricate power dynamics and collusion between industry and state. The findings suggest that Costa Rica is not as environmentally conscious and sustainable as its public image portrays, with pockets of profit-driven industries taking precedence over community well-being and environmental sustainability.

Abstract:: As the unparalleled ability of big data to capture and process real-time information signals a revolution in public administration, countries around the world have begun to explore the application of the technology to government functions. At the forefront of these efforts is China, which is planning to launch the social credit system (SCS), a data-powered project to monitor, assess, and shape the behavior of all citizens and enterprises. This new frontier of digital surveillance raises questions about how the United States will incorporate data technology into its own politics and economy. This article argues that the U.S. needs a comprehensive nationwide data protection framework that places limits on surveillance by both private business and the government. Without drawing its own baseline for personal data protection, the United States risks missing the already narrowing opportunity to define its balance between democracy, security, and growth.

Abstract:: Artificial intelligence (AI) will soon be at the center of the international development field. Amidst this transformation, there is insufficient consideration from the international development sector and the growing AI and ethics field of the unique ethical issues AI initiatives face in the development context. This paper argues that the multiple stakeholder layers in international development projects, as well as the role of third-party AI vendors, results in particular ethical concerns related to fairness and inclusion, transparency, explainability and accountability, data limitations, and privacy and security. It concludes with a series of principles that build on the information communication technology for development (ICT4D) community’s Principles for Digital Development to guide international development funders and implementers in the responsible, ethical implementation of AI initiatives.

1694. Echoes of Abstention: Russian Policy in Libya and Implications for Regional Stability

Abstract:: Russia’s abstention from UNSCR 1973, which allowed a no-fly zone in Libya and ultimately led to the collapse of the Qadhafi regime, has resounded across both Russian foreign policy and the security environment of the Near East. Competing theories claim the abstention was either a carefully-planned strategy or a tactical miscalculation, but the result—Russian rejection of regime decapitation and Western distaste for further intervention—is easily observed. In addition to tangible military and political benefits, the chaotic and unsustainable Libyan status quo bolsters Russia’s political capital by discrediting that of the West. Although Russia is unlikely to intervene kinetically in Libya, it can passively destabilize the country at almost no cost, stymying Western efforts to end the crisis. Only by recognizing and accommodating Russia’s interests in Libya can the West negotiate a lasting settlement for Libya and secure vital U.S. interests in the region.

1695. Effect of “Just Cause” Eviction Ordinances on Eviction in Four California Cities

Abstract:: The Eviction Lab’s recently released dataset of evictions in the United States provides rich opportunities for exploring the effect of state and local policies on eviction rates. Just cause eviction ordinances—local laws that outline what constitutes grounds for eviction—have gained traction as a policy solution for addressing the eviction crisis. This paper analyzes the relationship between just cause eviction ordinances and eviction rates and eviction filing rates in four California cities. A difference-in-differences matched case model suggests that there is a statistically significant, large, and negative difference between eviction rates and eviction filing rates before and after the passage of just cause eviction ordinances in the four treatment cities, as compared to the difference in these rates before and after the passage of just cause eviction ordinances in matched control cities. Cities that implemented just cause eviction laws experienced lower eviction, by 0.808 percentage points, and eviction filing rates, by 0.780 percentage points, than those that did not.

1696. Pirates, Boat People, and Bystanders: Contradictions at the Marine Bedrock of the International Human Rights Regime

Abstract:: This paper explores the high seas as a critical space for the formulation and development of international human rights law in two inter-related areas: anti-piracy campaigns and rescue of the so-called “boat people.” While the high seas have been instrumental in promoting inter-state cooperation and coordination, I argue that they have also laid bare the limits of states’ nominal commitments to rights protection. Using historical case studies of the Vietnam crisis, Haiti arrivals to the United States, and the current marine policies of Australia, I show that states too often willfully neglect their human rights obligations. In doing so, these states might succeed in protecting their short-term interests, but undermine the foundations of international human rights regimes in the long run.

1697. Naming Terror: Impact of Proscription on Negotiations with Non-State Armed Groups

Abstract:: This article explores what impact terrorist blacklists have on negotiated solutions to armed conflicts involving listed non-state armed groups. Even though conflicts that involve non-state armed groups do not usually end through these groups’ military defeat, governments around the globe tend to adopt hard-security approaches with regard to inner-state conflicts. Especially when groups resort to terrorist tactics, governments tend to be reluctant to engage peacefully with these actors and instead commonly rely on terrorist blacklists in order to delegitimize and restrict groups’ activities. While these blacklists are effective in criminalizing the operations of these groups, they can also severely impede peaceful dialogue and thus negatively impact the resolution of conflicts. Especially the work of NGOs and third-party peace practitioners is greatly constrained by criminalizing any form of interaction with listed groups. Additionally, in the absence of a universal definition of what constitutes a terrorist group, lists vary from country to country and the criteria for groups and individuals to get listed are often extremely vague. Furthermore, most lists fail to re-evaluate the proscribed groups on a regular basis and delisting procedures lack transparency. This article finds that blacklists severely disincentivize peaceful engagement with non-state armed groups and thus calls for a revision of contemporary proscription regimes in order to shift the focus of counterterrorism approaches towards viewing peaceful dialogue as a first option and not a last resort.

Abstract:: A fundamental aspect of economic inequality, highlighted by Thomas Piketty’s Capital in the Twenty-first Century, is the unequal distribution of capital ownership (wealth). This not only undermines the welfare of individuals with low wealth, but exacerbates the distributional consequences of a declining labor share of income. However, policy responses to wealth inequality remain underdeveloped. This paper considers how policies that increase the private savings of low- and middle-income individuals can complement more traditional taxation and redistribution approaches. As a case study, it explores the distributional effects of Australia’s superannuation system, a private retirement savings scheme that sets a compulsory minimum savings rate for all employees. Superannuation has contributed to a more equal distribution of wealth in Australia, particularly by offsetting declines in other kinds of wealth among those at the low end of the distribution. However, loopholes have also allowed high-income individuals to use the system to save in a low-tax environment. Further work is needed to investigate the effects of compulsory savings rates on those with very low incomes.

1700. A Study and Analysis of the Treatment of Mexican Unaccompanied Minors by Customs and Border Protection

Abstract:: The routine human rights abuses and due process violations of unaccompanied alien children (UAC) by US Customs and Border Protection (CBP) have contributed to a mounting humanitarian and legal crisis along the US–Mexico border. In the United States, the treatment of UAC is governed by laws, policies, and standards drawn from the Flores Settlement, the Trafficking Victims Protection Reauthorization Act (TVPRA), and CBP procedures and directives, which are intended to ensure UAC’s protection, well-being, and ability to pursue relief from removal, such as asylum. As nongovernmental organizations and human rights groups have documented, however, CBP has repeatedly violated these legal standards and policies, and subjected UAC to abuses and rights violations. This article draws from surveys of 97 recently deported Mexican UAC, which examine their experiences with US immigration authorities. The study finds that Mexican UAC are detained in subpar conditions, are routinely not screened for fear of return to their home countries or for human trafficking, and are not sufficiently informed about the deportation process. The article recommends that CBP should take immediate steps to improve the treatment of UAC, that CBP and other entities responsible for the care of UAC be monitored to ensure their compliance with US law and policy, and that Mexican UAC be afforded the same procedures and protection under the TVPRA as UAC from noncontiguous states.
