Abstract:: How does the 2020–2022 civil war in Ethiopia contribute to our understanding of the Responsibility to Protect (R2P) doctrine? This study seeks to revisit the debate over the effectiveness of the R2P doctrine in the wake of increased intrastate conflicts. The objective is to assess the dilemma that arises with the implementation of R2P when governments are involved in the conflict and the international community is reluctant or unable to intervene. The study adopts the systematic review approach (PRISMA) to identify the shortcomings, trends, and debates around R2P. It uses the Ethiopian civil war to contribute further to the existing body of literature. The paper finds that, indeed, the R2P doctrine is facing serious challenges with its implementation. It shows that when governments fail to acknowledge the other actors as legitimate combatants and instead describe them as terrorist groups, it becomes difficult to uphold the R2P doctrine. The paper also identifies a lack of leadership and coordinated efforts at regional and international levels as contributing factors, which further undermine the effectiveness of R2P. The paper concludes that the Ethiopian civil war exposes serious shortcomings in the R2P doctrine that need to be reviewed and reformed urgently. It proposes the adoption of a systems-thinking approach that can streamline the actors and processes of response during civil wars.

2. Two Years Of Repression: Mapping Taliban Violence Targeting Civilians in Afghanistan

Abstract:: On 17 August 2021, two days after the fall of Kabul, the Taliban held a press conference promising amnesty for former government officials, respect for women’s rights, and freedom of the press.1 Nearly two years later, it is clear that the Taliban has upheld none of these promises, instead conducting a violent campaign of repression. Since the takeover, the Taliban has targeted former government and security officials, carried out collective punishments in areas where anti-Taliban groups have emerged, and imposed ultraconservative societal restrictions – especially on women and journalists – aimed at maintaining control. ACLED records over 1,000 incidents of violence targeting civilians by the Taliban between the fall of Kabul on 15 August 2021 and 30 June 2023, accounting for 62% of all attacks on civilians in the country. This places the Taliban regime in Afghanistan2 among the world’s top government or de facto state perpetrators of violence targeting civilians domestically since August 2021, behind only the military junta in Myanmar. As Taliban rule reaches the two-year mark, this report examines patterns of violence targeting civilians under the regime, with particular attention to the top four most targeted groups: former government and security officials, prisoners, women, and journalists. Taken together, the Taliban’s retaliatory attacks, use of collective punishment, and broad crackdown on women and the press reveal the scale and severity of repression ongoing in Afghanistan. In particular, this report analyzes the continued targeting of former government and security officials, as well as violence against civilians in the country’s northeast, where armed anti-Taliban groups have been active. Both former officials and resistance forces are subject to violence when detained by the Taliban, accounting for a large number of incidents of prisoner abuse recorded by ACLED. Moreover, this report highlights persistent violence against women who oppose a return to the “gender apartheid” of past Taliban rule.3 Women have responded to increased restrictions on their daily lives by holding protests against Taliban policies, with demonstrations featuring women4 nearly doubling in 2022 compared to 2021. Finally, the report concludes with an accounting of attacks on journalists, who remain among the most targeted groups in the Taliban’s Afghanistan – creating further challenges for documenting violence in the country under the new regime.

3. Holding the Islamic Republic of Iran accountable for atrocity crimes

Abstract:: With little to no prospect for accountability within Iran’s domestic courts, victims and survivors of serious violations of international law are turning toward an increasing number of foreign jurisdictions—most commonly in Europe and North America, but also in Latin America, Africa, and other regions—to pursue justice for human rights violations carried out by the Islamic Republic of Iran. Under the principle of universal jurisdiction, certain domestic justice systems allow prosecutions in national courts for crimes committed abroad, regardless of the victim’s or perpetrator’s nationality. Universal jurisdiction stems from the concept that certain crimes are of such gravity that they harm the international community as a whole, so national courts outside the country where the violations took place may prosecute them to protect the international order. Although the crimes subject to universal jurisdiction provisions differ by state, they generally include crimes against humanity, torture, war crimes, and genocide. Limitations on universal jurisdiction also vary between states, however, as do the processes for filing complaints and procedures for investigations, trials, and appeals. As was shown by the trial and conviction of Hamid Noury in Sweden for his involvement in the massacre of Iranian political prisoners in 1988, national prosecutions of international crimes can be a fruitful avenue to justice for victims of the Islamic Republic. To this end, the Atlantic Council’s Strategic Litigation Project has compiled a guide to aid practitioners and independent investigators in navigating the legal systems of European states with the highest likelihood of prosecuting Iranian human rights violators. Focusing on five states—France, Germany, the Netherlands, Sweden, and Switzerland—this manual outlines the crimes and violations subject to universal jurisdiction, best practices for investigating and documenting crimes, and processes for requesting investigations and participating in prosecutions as a victim, witness, or NGO. For information that is beyond the scope of this manual, the annex includes printed resources to consult and organizations to contact for additional assistance.

5. The Return of the Foreign Fighters and Their Families to Their Homeland: Existing Practices and Considerations Regarding Security and Human Rights

Abstract:: The creation of Islamic State of Iraq and Syria (ISIS) has attracted an unprecedented flow of thousands of people from more than 100 countries all over the world to join their cause. After the fall of the so-called caliphate, the countries involved have to deal with the aftermath of the conflict and the future threat of the resurgence of ISIS or other terrorist groups. The people who volunteered and joined ISIS might pose a security threat in the future. This paper aims to examine the different approaches that countries have taken regarding the return of foreign fighters (FFs) and their families who joined ISIS to their homeland. This is a multidimensional and complex matter since it has legal, moral, and political implications, and therefore the decisions in this regard are never unanimous, nor do they come without criticism and opposition. On the one hand, it would be easier to just leave the FFs and their families there, prosecute them there and incarcerate them there. It would also be easier to collect evidence and to have testimonies of the witnesses and the survivors, and also it would keep the potential security threat away from their homeland. However, this would only be beneficial for the countries of origin and in the short term as it wouldn‘t solve the problem of radicalization. In fact, it might fuel it even more, and the proximity of the ISIS member in prisons or in camps could benefit them to rebuild their network and plan future attacks. Moreover, leaving them there would be against all human rights norms regarding the death penalty, fair trial, torture, rights of the child, and more. On the other hand, the return of the fighters and their families could indeed pose a danger to the security of the homeland. Not all of the returnees have committed punishable crimes and for those who have, very often there is not enough admissible evidence to the national courts. In fact, in the case of women and children, the countries are more reluctant to their return because they might have not taken part in the atrocities but that does not mean that they are innocent and bear no responsibility. Complicated is also the case of children and teenagers, some of whom have taken part in the atrocities willingly or unwillingly, some were brought by their families, some traveled alone in order to join ISIS, and some were born under ISIS control and risk statelessness.

La Prevención del Extremismo Violento (PEV) es una estrategia en el marco de Naciones Unidas enfocada a fortalecer el respeto de los derechos humanos. La PEV aborda el extremismo violento que conduce al terrorismo desde el enfoque de la prevención y de los derechos humanos. Lo más relevante de esta perspectiva es su innovación para garantizar la seguridad como derecho humano. Es más, la PEVsurge como respuesta a las políticas de seguridad antiterroristas que se consideran insuficientes para erradicar este fenómeno. Las medidas de acción de la PEV, por tanto, van más allá de lo que en sentido estricto se conoce como política securitaria. La educación y la cultura tiene así una función importante en la PEV, como también ponen de relieve las políticas de la UNESCO. El análisis que se desarrolla expone una propuesta de espacio dialógico que aplica la medida de educación, cultura y sensibilización a través de la literatura. Se reflexiona así, a partir del diálogo con Vida y destino de Vasili Grossman, sobre el extremismo violento y los derechos humanos.

Abstract:: Armed conflict is a perennial problem that has plagued Africa for decades, resulting in flagrant human rights abuse. The central problem this paper seeks to address is identifying the laws establishing institutions and agencies for protecting human rights in Africa and examining how well-adapted these institutions are to protect human rights in times of armed conflict in Africa. This research employs the doctrinal research method, which entails an examination of the relevant primary sources of the law as laid down in the statutes and treaties and interpreted by the courts as well as secondary source materials, including journal articles, reports, and other relevant sources materials. It is contended that though human rights institutions were not established with the goal of interventions in times of armed conflict to protect human rights, they can be adapted to meet this challenge to stem the tide of gross human rights violations during armed conflicts. The paper concludes by recommending the expansion in the practice of the mandate of these human rights institutions to accommodate mechanisms for the protection of human rights in times of armed conflicts.

8. Pursuing justice for international crimes in Ukraine: A patchwork of multi-level and long-running efforts

Abstract:: The Russian aggression against Ukraine has triggered debates and initiatives on how to address crimes under international law committed in and against Ukraine, including war crimes and the crime of aggression. A single institution capable of dealing with all international crimes is nonetheless lacking. Tens of thousands of alleged war crimes have been reported and documented, part of which the Ukrainian courts themselves are handling. The massive caseload requires international assistance, in addition to which the ICC is also investigating alleged war crimes. The international community is divided in regard to the investigation and prosecution of the crime of aggression. As the ICC lacks jurisdiction with respect to this crime in this particular situation, European states are advancing a special ad hoc tribunal. Nonetheless, the majority of countries globally, particularly in the Global South, find it hard to support the initiative. The discussion on the best way to proceed with regard to addressing the crime of aggression committed by Russia is ongoing. Many problematic issues are being debated, ranging from political desirability to the issue of head of state immunities.

Abstract:: Despite the mounting evidence of the most serious of human rights violations being conducted by Russian forces on Ukrainian soil, the EU has chosen not to use its new Magnitsky Act to blacklist the perpetrators and their commanders. Instead, the EU has preferred to respond to Russia’s ‘dumb’ bombs with increasingly ‘dumb’ sanctions. This Brief explains why, after decades of work to smarten up its restrictive measures, the politicisation of human rights sanctions and the high threshold of evidentiary standards make it very hard for the Council to rely on evidence gathered from transition countries where the justice sector is still vulnerable to widespread corruption and political cronyism.

10. Is There Life in the Desert? Russian Civil Society After the Full-Scale Invasion of Ukraine

Abstract:: By the end of 2021, all leading independent NGOs and individual human rights activists had been completely suppressed, and all issues deemed inconvenient for the Kremlin had been removed from the agenda of those still operating. This report focuses on the state of Russian civil society at the outset of Russia’s full-scale military invasion of Ukraine, as well as on how it was affected by the war and what are the prospects for its development in the future. Since Vladimir Putin came to power, Russia has been moving along the path of creating a fully state-controlled civil society in which the political potential of independent civil activism would be completely undermined. To achieve this goal, the Kremlin pro-actively advanced its network of government-organised non-governmental organisations (GONGOs) while simultaneously limiting foreign funding for NGOs. Those who did not abide by the Kremlin’s rules were systematically discriminated against and persecuted under the so-called “foreign agent” laws. Meanwhile, local authorities have stopped all formal and informal interaction with “politicised” civil actors. Russia’s invasion of Ukraine added further impetus to these trends and strengthened the Kremlin’s resolve to root out any sources of potential defiance. The independent professional NGOs that remained were in a deep crisis. Since February 2022, they have switched to survival mode. In all likelihood, they will either be co-opted by the state through a centralised system of financial support or cease to exist in the near future. The niches that they have left – including in the field of human rights advocacy – are being quickly filled by GONGOs. With their colossal resources, wider media access, and connections in the government, GONGOs are able to attract more young people to join their ranks. In many regions, even the scanty of organised independent civic activism that existed before the war was neither there nor likely to re-emerge in the coming years. In Russia, the level of involvement in NGOs has always been low and the population at large indifferent to the problems of civil society. Therefore, one should be wary of inflated expectations when contemplating the future of Russian civil activism. Even if Putin’s regime collapses, one can hardly anticipate a quick transition towards a truly independent and vibrant civil society. The study was conducted on the basis of interviews with representatives of independent NGOs from various regions who, as of February 2022, were based in Russia. The geography of this survey was expanded as much as possible to make the study more reliable and better reflect the content of the processes underway in the country. This analysis also shows that representatives from Moscow, large provincial cities, and the North Caucasus differ significantly in their perception of the current situation with civil society, whereas their visions for the future diverge considerably. A profound lack of communication among them only amplifies the divisions and fragmentations in Russia’s civil society. The situation in the North Caucasus is of particular note. Albeit being severely weakened, local independent NGOs and activists are – in contrast with the rest of Russia – more disapproving of the war unleashed by Russia against Ukraine but more optimistic about the future of their home regions. They pin their hopes on the revival of indigenous languages and cultures with the help of diasporas abroad and the emergence of civil society.

Abstract:: La militarización y el combate como herramienta casi exclusiva contra la violencia y la inseguridad ha sido el paradigma de profundo calado en Honduras y la mayor parte de la región, lo que implica la solución a los problemas de inseguridad en clave de guerra. Este conflicto asimétrico entre los grupos criminales y los Estados se recrudeció a raíz de la Guerra contra las Drogas iniciada por el presidente mexicano Calderón, y no es sino la continuación de las diversas guerras contra ya ensayadas en Centroamérica bajo inspiración de los EEUU. Con la llegada al poder de la presidenta hondureña, Xiomara Castro, se advertía un cambio en relación a las políticas de seguridad que no se enfocaran exclusivamente en la mano dura, sino que abordara la reforma integral del Estado priorizando la lucha contra la corrupción y la impunidad, así como la mejora de la calidad de la democracia. Una ola de populismo punitivo recorre la región, pero la mejora en los niveles de inseguridad en Honduras no será sostenible mediante el uso exclusivo de la fuerza ni estados de excepción.

13. Against All Odds: Supporting Civil Society and Human Rights in Taliban-Controlled Afghanistan

Abstract:: Eighteen months after taking power, the Taliban is intensifying its repression of Afghan civil society and cracking down on the rights and freedoms of all Afghans, especially those of women and girls. The Taliban’s harsh approach to governing the country is repressing millions of people and fueling civil unrest, promoting extremism, and laying the foundation for the reemergence of a terrorist hotbed that will almost undoubtedly become a threat to global peace and security in the years to come. Humanitarian needs in Afghanistan remain immense, and the country will require large amounts of international aid for the foreseeable future to avoid famine and other health challenges. Twenty-three million Afghans (or nearly 60 percent of the population) currently require food assistance, and unusually cold winter temperatures this year have caused further hardship and death. The Taliban’s December 2022 order barring Afghan women from working for nongovernmental organizations led some international humanitarian organizations to suspend operations, complicating aid distribution, especially to women-headed families. The abolition of democratic institutions—the Parliament, judiciary, free press—and key government ministries and departments charged with protecting human rights demonstrates that the Taliban is adhering to the same extremist policies that marked their first stint in power from 1996 to 2001. The Taliban rules by fear and intimidation; torture, kidnapping, illegal detention, and extra-judicial killings are part of daily life in Afghanistan. The Taliban’s rollback of women’s rights has been swift and comprehensive. Among the most devastating anti-female policies, which will have far-reaching negative impacts on Afghanistan’s social and economic development and relations with the world, are the edicts forbidding girls from attending secondary school or university. Women and girls in today’s Afghanistan also are prohibited from accessing parks or gyms, leaving home without a male companion, and working outside the home—except in the health sector—and have been publicly flogged for not adhering to the strict behavioral edicts. Women demonstrators have been arbitrarily jailed and subject to torture and death.

14. Instead of Politicizing Afghanistan, Stand Up for Women and Girls

Abstract:: Ahuman rights calamity is unfolding in Afghanistan. In its latest move to repress half of the country’s population, the Taliban mandated that Afghan women can no longer work for the United Nations Assistance Mission in Afghanistan (UNAMA). The United Nations (U.N.) condemned the Taliban for forcing the international organization to make an “appalling choice” between continuing its operations without employing Afghan women, which would violate the U.N. charter, or withdrawing from the country, which would deepen the humanitarian crisis.1 Following a U.N.-led international meeting in Doha in early May, U.N. Secretary General António Guterres signaled that the U.N. would likely continue operating in Afghanistan despite the harsh Taliban edict.2 This follows several other outrageous Taliban edicts, including keeping girls out of secondary school and young women from attending university; preventing women from leaving their homes without a male companion; and prohibiting women from going to parks or gyms or holding jobs, except in the health sector.3 Yet rather than stand up for Afghan women and girls in the face of such repressive policies, American leaders—Republicans and Democrats alike—are busy in a blame game about which political party is responsible for the U.S. failure in Afghanistan. Republican congressional leaders have held hearings on Afghanistan that focus on the Biden administration’s poor handling of the August 2021 withdrawal but largely ignore what is happening to women and girls in the country. One exception to Republican leaders’ inaction on the plight of Afghan women was Congressman Mike McCaul’s chairing of a roundtable on the issue that featured remarks by former Afghan Ambassador Roya Rahmani.4 For its part, the Biden administration recently published a review of the Afghan withdrawal that laid blame on the Trump administration for the Biden administration’s own failures.5 For instance, the Biden administration chose to bind itself to the Trump-era Doha deal made between the United States and the Taliban that called for U.S. troop withdrawal by May 2021. The Biden administration could have delayed a troop withdrawal and negotiated a harder bargain with the Taliban. The administration would better serve American interests by focusing on implementing policies that support women and girls, like conditioning engagement with the Taliban on the reopening of schools and universities to women.

16. WHY DO MASS EXPULSIONS STILL HAPPEN?

Abstract:: January 30, 2023 marks 100 years since the signing of the Lausanne Convention—a treaty codifying the compulsory “population exchange” between Greece and Turkey. An estimated 1.5 million people were forcibly expelled from their homes: over one million Greek Orthodox Christians from the Ottoman Empire and 500,000 Muslims from Greece. This population exchange was not the first such agreement, but it was the first compulsory exchange. Turkish nationals of the Greek Orthodox religion and Muslim Greek nationals did not have the option to remain. Further, Greek and Muslim refugees who had fled the Ottoman Empire and Greece, respectively, were not allowed to return to their homes. Only small populations in Istanbul and Western Thrace were exempted from the treaty.

Abstract:: Law is where power announces its victories. In other words, law generally, and international law in particular, have little independent potency to shape social and political realities. That principle is well-demonstrated in the case of Israel/Palestine, where law has exercised little impact on the ground, other than to legitimate Israel’s domination and dispossession of the Palestinians among certain audiences. Can that dynamic be altered, such that Palestinian rights can be vindicated by law? Possibly, by treating international law as one kind of discourse that is persuasive in certain contexts and in certain fora, from which Palestinian voices cannot afford to be absent. It follows, however, that legal discourse is not a substitute for other forms of struggle, and is likely capable of no more than a subordinate role in a broader movement for Palestinian rights.

18. Rethinking the EU’s Approach to Women’s Rights in Iran

Abstract:: After the death of twenty-two-year-old Mahsa (Jina) Amini in the custody of Iran’s morality police on September 16, 2022, protests quickly spread throughout the country under the slogan of “Woman, Life, Freedom.” Amini’s death galvanized a movement that connects women’s individual freedom to choose their dress code to the systemic social, political, and economic grievances of a larger population that is demanding fundamental change. In claiming the realization of their basic rights, Iranians are revolting against a system that not only oppresses women and peaceful dissent but also continues to fail to meet citizens’ needs. This fight, which has attracted global solidarity, highlights the core message that when women’s rights are marginalized to nonexistence, human rights for all are at risk. The protests have taken place amid mounting repression of organized peaceful activism, a continuing deterioration of Iranians’ basic rights, and a host of economic ills, including rising inequality, increasing poverty, worsening living conditions, skyrocketing food prices, raging inflation, and rising unemployment. Three years of the coronavirus pandemic as well as decades-long comprehensive economic and financial sanctions have gravely added to the socioeconomic calamity. On top of this economic insecurity, precarious and perilous working conditions had already sparked increasing protests in Iran in recent years, resulting in the government’s harsh crackdown on human rights activists and civil society as well as further infringements on rights, including internet shutdowns, even before current events. Repression and the deterioration of Iran’s socioeconomic conditions have aggravated the situation for women in particular. Especially in recent years leading up to the current protests, this trend has hindered Iranian women’s ability to mobilize, protest, and achieve the full realization of their rights. Those who experience intersecting discrimination because of their minority background or social status are impacted even more if they live in rural areas, which are less developed than urban ones, or in areas on Iran’s border, which the state views predominantly through a security lens. The international response to Iran’s very poor human rights record and current protests, however, has lacked a holistic approach that considers women’s key role as agents of change and encompasses civil and political as well as social and economic rights as integral components of women’s rights. In fact, women’s rights and gender equality are not only goals in themselves but also enable the realization of fundamental rights of other marginalized groups, such as children and minorities. Moreover, women’s rights and gender equality are the strongest indicators of and preconditions for sustainable and peaceful societies, both internally and externally. Yet, the European Union’s (EU’s) current approach to Iran does not account for this reality. Over the past years, the EU’s policy toward the country has focused on negotiations to revive the Joint Comprehensive Plan of Action (JCPOA) after Washington’s withdrawal from the deal in 2018. The current situation in Iran urgently highlights the need for a policy framework that responds to the government’s repression and gross human rights violations and, equally, considers the disastrous socioeconomic situation in the country, which is a key obstacle to the public’s ability to organize to realize its rights. Given the importance of economic precarity and socioeconomic inequality in the current revolt, the EU should adopt policies that can support the protesters’ rights and demands in the short term while considering a revised long-term approach centered on empowering Iranians in their efforts to create long-lasting democratic change.

Abstract:: Iran was rocked by mass demonstrations triggered by the September 2022 death of Mahsa Amini — a young Kurdish woman — while in the custody of the Guidance Patrol (also known as the ‘morality police’) for allegedly violating the hijab dress code. Protests over the mandatory hijab rule soon coalesced around a wide range of grievances with the regime, with participants demanding protections for civil, political, and human rights and calling for an end to the Islamic Republic. Although street demonstrations have subsided for the time being, how the protest movement will evolve — and how it will impact the stability of the Islamic Republic — remains an open question. This report explores potential answers to this question by examining notable trends and implications of the wave of demonstrations that unfolded in the country between September and December 2022. It argues that several emerging aspects of the nationwide movement may pose a long-term challenge to the regime. The demonstrations following Amini’s death were not only unique in regard to their geographical spread and longevity, but also in the way they brought together different segments of society with both distinct and overlapping grievances. Moreover, amid a harsh crackdown by Iranian authorities, engagement in violence by demonstrators has trended upward: between mid-September and December 2022, ACLED records the highest number of violent demonstration events for any round of nationwide demonstrations in Iran since the beginning of data collection in 2016. The increased use of Molotov cocktails and the killing of dozens of security personnel are among the most significant trends in demonstration violence observed in the latest round of events. The demonstrations did not reach a critical mass necessary to pose an immediate threat to the survival of the regime. Yet, this latest round in a sequence of increasingly violent demonstrations is indicative of growing resentment in Iranian society against the ruling elites and a willingness to express it forcefully despite severe repression. As the regime refuses to reform, the growing frequency and intensity of demonstrations suggests that the government will find itself in an increasingly unstable domestic position and increasingly isolated in the international arena.

Abstract:: This comparative study examines strategies used by local actors to facilitate the operationalization of reparations for victims of widespread human rights violations, while highlighting the synergies between these efforts and sustainable development. The study is based on the fieldwork of ICTJ and its partners in four contexts—Colombia, The Gambia, Tunisia, and Uganda. These countries represent a range of different situations, where the progress made, challenges faced, and overall political and institutional contexts vary significantly. Nonetheless, comparison of the approaches used across the cases offers valuable insights for those working in these and other contexts. In The Gambia, the truth commission and legislation for reparations have created expectations among victims, but a program has yet to be implemented. In Uganda, the legal and policy framework for reparations exists, but there is no enabling legislation or mechanism to provide them as a result of stalled political will. In Tunisia, the truth commission recommended reparations, but the political and economic situation make operationalization unlikely. In Colombia, challenges faced by reparations have informed the design of restorative sanctions that include reparative projects but are yet to be implemented. The major insights gained from this comparative study relate to the specific ways in which reparations can contribute to individual and community well-being and development; innovative and effective approaches to ensuring victims and communities receive reparations and support, including through collective action, engagement with government, and grassroots initiatives; the integration of victims’ needs and priorities into development policies and models; and the reparative elements of complementary accountability and reform measures that are participatory, address corruption and marginalization, and contribute to gender justice and equality. The report offers practical guidance and policy recommendations for advancing reparations as an integral element of broader societal efforts to facilitate inclusion, justice, peace, and development.

27. Prior Rebel Experience Of Leaders And Its Influence On Physical Integrity Rights

Abstract:: Previous research shows that leaders’ prior experiences influence their policy decisions. The existing human rights literature focuses mainly on country-level factors, such as economic development, regime type and the conflict situations to explain violations of rights. This research contributes to a flourishing literature on leaders’ role in upholding rights by theorizing why and how the prior experiences of leaders affect the propensity to violate physical integrity rights. It is argued in this article that leaders with a rebel experience, and who have experienced victory in rebellion are less likely to respect human rights, while those who have suffered defeat are more likely to do so. Both types of leaders have demonstrated a willingness to take risks, but in the former case, victory reinforces their belief in taking risks, leading them to keep risk-taking, whereas in the latter, defeat teaches leaders to become more risk averse. Infringing on human rights is indeed risky, potentially leading to negative consequences such as a damaged reputation, accountability, and social upheaval. The empirical analysis of the research demonstrates that having a rebel background alone does not inherently influence a leader’s behavior regarding human rights; what matters is the outcome of the rebellion. The probability of showing respect for rights decreases when a rebellion is won, while it increases when there has been a previous loss in rebellion. The article highlights the importance of using leaders, rather than just states, as a unit of analysis to explain why certain countries commit human rights violations.

Abstract:: As Secretary of State Antony Blinken prepares to visit Cairo on January 29-30, Egypt’s economy has been busy plummeting to new lows. Part of the blame can be laid on the twin shocks of the COVID-19 pandemic and the Ukraine war, which disproportionately affected the country due to its heavy reliance on threatened resources such as wheat and tourism revenue from Russia and Ukraine. Yet the bulk of its struggles can be attributed to Cairo’s broad economic mismanagement under President Abdul Fattah al-Sisi, which has included everything from currency manipulation to misplaced spending priorities, wasteful megaprojects, and undue state and military control over the economy. Since March 2022, Egypt’s currency has lost half its value and now stands at 30 pounds to the U.S. dollar—a drop spurred by the flight of dollars and the IMF’s requirement to adopt a flexible exchange rate. As a result, official inflation reached nearly 22% in December, fifteen points higher than it was at the end of 2021. Shortages are now frequent, and prices for basic goods have soared by nearly 40%. The rising cost of essential bread in particular will be difficult to maintain much longer. Meanwhile, the debt-to-GDP ratio has risen to 95%, with a record $100 billion in loan payments due over the next four years. Egypt’s 2022-23 budget allocates over 50% to debt servicing and loan repayments, and this sky-high figure will only increase further over time because the loans are dollar-denominated.

Abstract:: When the U.S. State Department issued its annual Country Reports on Human Rights Practices last week, the document’s assessment of Lebanon’s track record in 2022 stood out for its significant elisions. Although the comprehensive nature of these reports generally makes them a valuable tool for accountability, their diplomatically sensitive content is sometimes colored by an administration’s perceived exigencies regarding a given bilateral relationship. The fact that Lebanon’s report largely avoids some of the country’s more controversial human rights issues therefore seems more than coincidental. Whatever the case, the omissions are a missed opportunity for facilitating just the type of accountability Lebanon needs to pry itself out of its current morass.

Abstract:: Three months ago, the most far-right government in the history of Israel was sworn in by the Knesset under the leadership of Benjamin Netanyahu. Notably, Itamar Ben-Gvir, the Kahanist leader of Jewish Power and former convict for racist incitement, has been appointed the head of the newly created Ministry of National Security.[1] Additionally, Bezalel Smotrich, leader of the settler-based Religious Zionism party, has been given major control over the administration of the occupied West Bank as the head of the Finance Ministry.[2] The new government has spurred a nationwide mobilisation in Israel, as many criticise the proposed judicial reform aimed at curtailing the Supreme Court’s power to exercise judicial review of legislation, giving the government control over judicial appointments and granting the Knesset the power to override the Court’s rulings. After weeks of protests – mainly attended by secular liberal Jewish Israelis[3] – the reform has been put on hold as part of a coalition agreement which includes the establishment of a National Guard led by Itamar Ben-Gvir and tasked with handling “Arab unrest”, thus anticipating even more state-sanctioned violence on Palestinians.[4] In fact, the number of Palestinians killed in 2023 is already set to surpass last year’s data, with at least 95 deaths since January.[5] This record in violence has been characterised by near-daily raids carried out by the Israeli military across the occupied West Bank, particularly in Jenin, Nablus and Jericho, aiming at curbing the resurgence of Palestinian armed resistance to the occupation.[6] In the same time span, at least 16 Israelis have been killed.[7]

Abstract:: Transitional justice in Iraq is a record of squandered opportunities and compromised institutions. Over five decades, Iraqi society has endured human rights abuses on a wide scale, perpetrated by state and non-state actors. The post 2003 era offered a chance to heal wounds and promote national recovery by adopting policies of transparent judicial accountability, equitable reparations, truth-telling and documentation, and national reconciliation to repair the torn social fabric. Instead, in the immediate aftermath of the war of 2003, a victor’s justice prevailed, which deformed the principles of transitional justice and undermined its mechanisms through rampant sectarianism, clientelism and corruption, leading to new abuses, increased strife and deepening social fissures. Twenty years into the new political order, Iraqi policy-makers must reconsider their policies and reform their mechanisms to achieve social cohesion, or risk further social fragmentation and conflict.

38. Shaking Hands with Saied’s Tunisia: The Paradoxes and Trade-offs Facing the EU

Abstract:: Over the last year, Tunisia has become a key priority for the European Union and its member states, Italy in particular. The main reason for this increased attention is the growing number of unauthorised arrivals of migrants and asylum-seekers leaving the North African country and reaching Italy from mid-2022 on. Tunisia was the point of embarkation for over 60 per cent of almost 90,000 irregular arrivals registered in Italy in the first seven months of 2023.[1] This is a departure from an established trend of Libya being the main departure point in the Central Mediterranean.[2] To make sense of these new mobility patterns, one also needs to take into account the profound economic crisis and the increasing pace of authoritarianism in Tunisia. Abstract:: The sexual integrity of women means their right to own and have full control over their bodies without any form of violence or coercion. Kosovo, like many countries in the world, has faced significant challenges in ensuring and fully respecting the sexual integrity of women. One of the most frequent forms of violation of the sexual integrity of women is sexual violence: sexual harassment, sexual assault, and rape. According to the database of the QIKA organization, from 2019 to 2022, 257 women reported that they were sexually assaulted and another 231 reported sexual harassment to the Kosovo Police. Violation of sexual integrity in Kosovo has not excluded even minor girls, where we recall the case of the rape of an 11-year-old girl by a group of 5 adult men in August, 2022. The recent data from the Information System of the Kosovo Police is a sobering reminder of the gravity of this situation: from January to May 2023, there have been 42 committed and 4 attempted rape cases. As Kosovo progresses towards enhanced national development and global integration, addressing sexual violence becomes crucial not just for individual well-being, but also as a fundamental matter of human rights, gender equality, public safety, and social cohesion.

40. Community Health Workers as Rights Defenders: Exploring the Collective Identity of the Mitanins of Chhattisgarh, India

Abstract:: This Working Paper discusses the Mitanin program, a state-run community health worker program in Chhattisgarh state, India. It is based on a year-long reflection and action research exercise by the implementing organization, the State Health Resource Centre (SHRC). It argues that the collective identity of these community health workers (Mitanins) is central to their work defending the social and economic rights of their community. Collective identity often plays an important role in social movements for people’s economic and political rights. However, government-funded workers rarely get involved in such movements. The authors wanted to understand whether collective identity plays a role in driving the multi-issue activism of community health workers. A composite definition of this collective identity emerged from the research. Throughout the interviews and discussions, the Mitanins described their collective identity as a sense of solidarity that all Mitanins share with the community they serve and belong to, and a feeling of sisterhood with other women and each other. It is the shared experience of being a group of empowered women with a common mission who must use their knowledge and compassion to support the people they serve. The value system underpinning their mission dictates that people should not be denied their rights. The Mitanins’ collective identity is layered; they are not merely frontline health workers, but women who care deeply about their community. They are problem-solvers, activists, and community leaders. Their collective action and collective identity as women leaders in solidarity with the community is mutually reinforcing, and has enabled them to undertake multi-issue activism and transform themselves into frontline rights defenders. The authors conducted a state-wide survey along with focus group discussions and in-depth interviews. The survey (n=558) aimed to establish what proportion of Mitanins are involved in multi-issue activism. It found that in the preceding three years, 84 percent had taken rights-based action in at least one of three domains: food security and nutrition (68 percent); healthcare (56 percent); and gender-based violence (21 percent). They refer to these actions as ‘rights-based’ because they involve negotiation and confrontation with local elites and government officials, as well as writing formal complaints to government officials. Other than rights-based actions, Mitanins also provide information to community members about their rights and entitlements to health programs, food security, and nutrition under government programs—information that is often not readily accessible to poor people in India. This paper analyzes the patterns of autonomous collective action through discussion, interviews, and the rights-based songs and slogans written by Mitanins. The authors argue that the Mitanins’ collective identity was formed due to two main factors: the program’s movement-building approach; and the degree of autonomy enjoyed by Mitanins. The movement-building approach nurtured the activist tendencies of Mitanins, and the voluntary nature of their work allowed them to retain their autonomy vis-à-vis the health system bureaucracy

41. Local Voices, Global Action: Transnational Organizing in Apparel Supply Chains

Abstract:: This working paper discusses transnational organizing in apparel supply chains. It learns from labor rights advocates in the global South who are building social movements, advocating for national reforms, and promoting new forms of accountability in the apparel industry. In particular, the paper examines how the Bangladesh Center for Worker Solidarity (BCWS) and Cambodia’s Center for Alliance of Labor and Human Rights (CENTRAL) have each played a critical role in advancing new agreements and monitoring their implementation. They have increasingly influenced and become leaders in the Clean Clothes Campaign Network. Based on multiple interviews with CENTRAL’s Tola Moeun and BCWS’s Kalpona Akter, the paper traces how they have worked with international allies to expose flaws in supply chain monitoring in the apparel industry. It discusses how they worked with independent trade unions to build grassroots campaigns that often preceded or inspired international campaigns. At the same time as Moeun and Akter came under threat for their national advocacy, they engaged international allies and became experts on trade policy and global supply chains. They are now not only leading proponents of enforceable, multiparty agreements between multinational corporations (MNCs) and independent trade unions, but also advocates for more effective mandatory human rights due diligence laws (MHRDD). Balancing this international advocacy with organizing for national policy reforms is a strategy made all the more necessary by the context of shrinking civic space in Bangladesh and Cambodia. Many companies are seeking to strengthen their human rights due diligence in supplier countries and to engage stakeholders in that process. At this time, the perspectives and experience of BCWS and CENTRAL help identify what is needed to advance more worker-centered approaches. Three sets of lessons emerge about what is needed to sustain transnational supply chain advocacy movements. Firstly, movement-building and trust are vital ingredients in effective supply chain advocacy. Secondly, it is important for human rights due diligence processes to take into account risks to worker rights. Thirdly, strengthening worker voice in global supply chains requires more effective scrutiny and regulation of MNCs.

Abstract:: On 1 November 2022, Israelis will cast their votes to elect a new parliament for the 25th time since 1948. Between 1949 and 2019 (70 years), Israelis went to the polls 20 times. Each parliamentary assembly (Knesset) averaged 3.5 years. But between 2019 and 2022, Israelis voted four times. Each parliamentary assembly averaged only nine months. This brief examines some of the causes of Israel’s political turmoil and assesses whether it matters for two issues of European concern: Israel’s status as ‘democratic’ ally and the occupation of Palestine. Despite their evident shortcomings with regard to Israeli Arabs and Palestinians, we do not expect the Israeli elections of November 2022 to downgrade the country’s allied status across European capitals. Neither do we anticipate the Israeli elections to moderate the country’s policy of annexation in the West Bank and East Jerusalem. Our analysis suggests instead that future Israeli governments will maintain majoritarian Jewish rule and expects it to be propelled by a more unapologetic and repressive ethno-nationalism. This will lead Israel further down the path of exclusionary governance and large-scale human rights violations that risks backfiring in the long term. It will also further erode the moral credibility of the European Union, including the Netherlands, in the areas of human rights and accountability.

These workshops aim to strengthen the abilities of young activists from the global South to achieve a greater impact in their human rights work and to reach a wider audience through new forms of narration. This book is just one of the many outcomes of the 2018 workshop. The talented and committed authors of this volume—all contributors to previous editions as well—hail from countries as diverse as Brazil, Ghana, Russia, and Venezuela. They came together again in 2018 to think about the intersection between research and activism and what it holds for the future of human rights. That is why our selection process for the 2018 workshop participants sought to ensure that two people from each cohort were working from a transnational perspective. The specific goal of this particular workshop was to reflect on the future of human rights, for we sensed that we were at a crossroads. With the recent rise in populist authoritarian governments, the global increase in inequality, and the worsening climate crisis, a number of thought leaders have wondered whether we have reached “the endtimes of human rights” (Hopgood 2013). We thus wished to use this workshop as an opportunity to respond to some of the most frequent criticisms of the efficacy and legitimacy of the human rights movement by drawing on historical and empirical arguments and responding to the reflections of Kathryn Sikkink—one of the workshop’s instructors—in her book Evidence for Hope (2017). Human rights defenders and activists are working in a world that is constantly changing. It’s a more multipolar world; powerful voices have emerged from the global South, which has reshaped the way that human rights work is being done across the globe. Furthermore, the Arab Spring and other social mobilizations that have since taken place have put the spotlight on civil society’s ability to act and its convening 12 Jessica Corredor-Villamil authority. Nonetheless, despite the fairly positive outlook for civil society participation and the emergence of new voices, it is necessary to review the strategies that we have been using thus far and explore how to make them more effective. This book is extremely relevant today, three years after the workshop, as we are living in a transformative time. The COVID-19 pandemic has had unprecedented socioeconomic and political impacts, including increases in inequality, unemployment, states’ abuses of their emergency powers, and the concentration of presidential power. Moreover, social networks have played a critical role in the sociopolitical arena, not only in light of their capacity to massively mobilize but also due to their propensity to foster political polarization and the use of misinformation for political ends. Thus, although we face a different context from the one in 2018, this volume serves as a guide of sorts to help us reconsider the effectiveness of our strategies as a human rights movement as we look toward the challenges being posed by the third century of this decade. The contributors to this book question traditional methods and explore new ways and visions of advancing human rights in the troubled context in which we live. Do the struggles of small-scale miners in Ghana, the use of strategic litigation in Lebanon, and the recognition of the rights of nature in India represent evidence for hope? Or is the opposite true, and, as shown in the chapters on martial law in the Philippines, the treatment of wastewater in Argentina, and in the internal conflict in Yemen, human rights have failed to deliver on their promises?

Abstract:: Since the seizure of Kabul on 15 August 2021, the Taliban have been consolidating power by recreating the Islamic Emirate of Afghanistan of the 1990s. Abstract:: Social media platforms such as Facebook can be effective in spreading positive awareness of gender equality and women’s rights; however, those who oppose these beliefs also use the same platform as a medium for spreading their ideologies. This paper aimed to examine the backlash faced by women public figures who are active on social media and shared content about Gender-based violence, along with the actors behind it. The study also looked into two controversial national events which raised discussions on sexual harassment and violence against women and the effectiveness of the Digital Security Act (DSA) 2018 and other relevant laws and policies used to counter these sorts of violence. A qualitative approach was followed with an analysis of the Facebook accounts related to the case studies and some quantitative data was collected through CrowdTangle software. The study showed that all female public figures faced a backlash mostly from men and boys with some comments from women. While they sought a remedy, DSA did not play a strong role. Women’s rights issues such as women’s education, employment, and domestic violence are seen as liberal feminism while issues like consent, divorce, single parenthood, sexuality, and gender diversity are considered more radical issues.

Abstract:: In the past several years, there has been a much-discussed rise in strain on multilateralism. However, there have been few efforts to quantifiably assess the state of the multilateral system. This Multilateralism Index (MI) report is the first known attempt to do so. It focuses on developments in the system over the past decade, providing a snapshot of its relative strength in 2020 compared to 2010. It seeks to answer questions including: What is the state of the multilateral system? What is working? What is not? And how has the multilateral system changed over time? The MI examines five domains of multilateral coordination: Peace and Security, Human Rights, Environment, Public Health, and Trade. Each domain is evaluated across three dimensions: Participation, Performance, and Inclusivity. Analysis of sixty-five indicators across these domains and dimensions reveals several trends in multilateral cooperation over the past decade: Participation scores for Human Rights, Public Health, and Trade have improved, while the scores for Peace and Security and Environment have deteriorated. Performance scores have deteriorated in four out of five domains. Inclusivity scores have improved across all five domains. These trends shed light on the nature of the crisis of multilateralism. Rather than decreased international cooperation and widespread exit from multilateral institutions, we are seeing a battle over the nature and purpose of the multilateral system—not decay, but transformation. The MI provides a basis for tracking this transformation and informing decision making on the future of multilateralism.

Abstract:: As part of its primary role of promoting the values of democracy, justice, human rights, and dialogue among Palestinian youth, Pal-Think for Strategic Studies has conducted the “Civic Education 2” project funded by the National Endowment for Democracy (NED) for the second consecutive year. The project’s goal is to amplify Palestinian young men and women’s skills and background on democracy and human rights issues. This book marks the conclusion of the theoretical and practical training program that empowered 25 youth to conduct awareness-raising meetings and discuss their issues in radio interviews. Afterward, the participants prepared five research papers that addressed various issues from a youth perspective in an analytical way and in line with the IMRaD format. Finally, Pal-Think would like to thank everyone who contributed to producing this youth-centered, informative effort, whether through reading or discussing the papers. Abstract:: Oscar was born in an illegal prostitution center where his mother was a sex worker (we are not certain if she worked there voluntarily). Oscar was first prostituted at age four, serving up to six “clients” daily at the same center where his mother worked. Both he and his mother were constant victims of rape and physical violence. This was the environment in which he was raised. In recent decades, according to a Reinserta study, violence against children in Mexico has intensi7ed nationwide.1 From 2006 to 2018, there were 325,699 homicides, according to data from Mexico’s National Institute of Statistics and Geography (INEGI). Of these victims, 23,420 were men under the age of 19, a little over 7 percent of the total, and 6,022 were women under the age of 19, about 2 percent of the total.2 Children represent a particularly vulnerable group, as they are immersed in practices that violate their human rights and make it impossible for them to develop physically and psychologically in an adequate manner and according to their age. They experience physical violence, sexual abuse, domestic violence, and other forms of violence that are normalized from an early age.

Sin desdeñar un enfoque de este tenor (especialmente, si es un enfoque desde el prisma de la seguridad humana), se entiende que la securitización de la lucha contra la pobreza no es demasiado útil para abordarlos problemas que genera y potenciar el desarrollo. Se aboga por orientar la centralidad político-jurídica de la lucha contra la pobreza desde su comprensión como un asunto de interés público global, al que el planteamiento programático de los ODS y el Derecho internacional de los derechos humanos ofrecen una base regulatoria sólida (sin perjuicio de las dificultades reales de llevar a cabo este programa y ejecutar las normas jurídicas internacionales sobre derechos humanos). Asimismo, no se ha querido dejar de lado la importancia colateral, pero propia, de la desigualdad.

El análisis de la arquitectura global de gobernanza existente, y de las propuestas para su remodelación, demuestra que existen numerosos aspectos que aún no se encuentran lo suficientemente desarrollados, lo que produce el riesgo de exacerbar las desigualdades y perpetuar las discriminaciones. La regulación de las actividades de las empresas multinacionales para anticipar y mitigar los impactos negativos sobre los derechos humanos que se derivan de las mismas y para que rindan cuentas por posibles daños, se presenta como elemento esencial en este contexto. Igualmente se precisa la adopción de acuerdos internacionales que se apliquen con carácter general a aquellas tecnologías que, por su propia naturaleza, tienen el potencial de poner en riesgo la paz y la seguridad internacionales. Este proceso debe perseguir el objetivo de ofrecer igualdad de oportunidades a los ciudadanos, la protección de los valores compartidos entre los Estados y, en definitiva, el bien común de la humanidad.

Abstract:: On 3 August 2014, fighters from the Islamic State in Iraq and al-Sham (ISIS) attacked the Yazidi minority of Sinjar in Kurdistan-Iraq. The Yazidi community was the main target of ISIS fighters, including Yazidi women. The ISIS group has committed violence against Yazidi women in several ways. This study aims to show the crimes committed by the group ISIS against Yazidi women and to highlight the problem of violence against women in war through recent living examples, such as women in the ISIS war between 2014-2017. The second part of this study identifies the legal deficiencies related to the regulations that guarantee the protection of women's rights in Iraq. Through a content analysis approach, qualitative methodologies are used. Also, based on a thematic analysis of semi-structured interviews, this paper found that the Yazidi women and girls have been subjected to the most heinous crimes involving international crimes. Furthermore, despite various legal provisions in Iraqi laws and the constitution relating to protecting women's rights, these laws have several legal deficiencies. The Iraqi legal authority has not attempted to guarantee sufficient protection for women's rights in armed conflicts.

64. Political and Media Analysis on the Tigray Conflict in Ethiopia

Abstract:: This study reviews patterns of domestic and international media reporting and the role of disinformation, misinformation, and media bias in the Tigray conflict, which has been raging since November 2020. Since its outbreak, the conflict has evolved through four broad phases. Throughout these phases, the conflict was characterised by egregious violations of international human rights law, international humanitarian law and international refugee law. To analyse the role of the media in the conflict, this study reviewed local and international media, conducted interviews with local and international journalists and analysts, and consulted secondary literature. Patterns of reporting by international and local media exhibited fairly significant levels of divergence in the issues that were selected for reporting and how they were reported during these four phases of the conflict. The study found significant levels of disinformation, misinformation, and biased reporting that clouded accounts of the conflict and encouraged debates over highly contested issues. International media largely disregarded the role that the TPLF played in provoking the federal government to take military action, at times neglecting to mention the TPLF attack on the Ethiopian Northern Command and occasionally even accusing Prime Minister Ahmed Abiy of ordering a wanton attack on Tigray. International journalists either partially or completely ignored the historical context of the conflict. On the other hand, domestic Ethiopian media largely disregarded the violations that were committed by the federal government and were overly focussed on debunking the claims that were made by the TPLF. Overall, the study found a systematic pattern of local media biased towards the narrative of the federal government, whereas the international media were generally biased towards the narrative of the TPLF. As a result, the voice of the people who suffered the brunt of the fighting became the “casualty” of misinformation, disinformation and biased reporting.

Abstract:: The US-Africa Leaders Summit—which included delegates from forty-nine countries and the African Union—was held in Washington, D.C., from Dec. 13–15, 2022. The summit focused on deepening and expanding the US-Africa partnership and giving voice to Africans in meeting current global challenges. The summit addressed substantive issues like climate change, food security, and human rights, without dwelling on America’s concern about Chinese or Russian influence on the continent. While specific details remain to be worked out, the three most important deliverables of the summit were: US support for the African Union to become a member of the G-20; a promise of $55 billion in aid to Africa over the next three years; and a commitment from President Joe Biden to visit Africa in 2023.

67. Fragmentation nation: How Europeans can help end the conflict in Yemen

Abstract:: For eight years, Yemen has suffered a civil war, whose conduct has been exacerbated by outside powers, principally Saudi Arabia and the UAE on one side, while Iran has supported the other. Yemen is a politically, socially, geographically, and religiously fragmented country, including within the two broad areas controlled by the internationally recognised government and the Houthis respectively. Saudi Arabia and the UAE may soon decrease their military interference in Yemen – but their exit could expose divisions in both government and Houthi areas. Yemen was poor before the conflict, but a corrupt war economy has now taken hold, strengthening an array of local power holders, while the Yemeni people slip into ever-deeper destitution. Short-term measures introduced with the support of the international community have failed to stabilise the situation. Europeans should take a longer-term approach to Yemen. They should promote the country’s cause in their diplomacy with Gulf Arab states and make a commitment to economic support, a values-based approach, and an emphasis on human rights in Yemen.

Abstract:: An Intergovernmental Working Group is established by the Human Rights Council to adopt a treaty on Business and Human Rights. According to the draft treaty the enforcement mechanism relies on a treaty body working through a reporting-based mechanism. In this article the enforcement mechanism of the treaty is analysed through the progressive model of accountability presented by Gupta and Van Asselt. It also takes further the analysis based on the progressive model by Nadia Bernaz of the enforceability measures adopted within the treaty. The enforceability of the treaty is further discussed in this article and a relative enforcement mechanism is proposed. The proposal includes structural changes within the treaty body and inclusion of the role of non-state entities for more efficient enforcement.

Abstract:: The United States provides generous aid to developing countries around the world. However, one of the conditions for aid giving is to first make sure that the receiving country is not involved in human rights violations. In this respect the US has also passed legislation in 1970s that clearly forbids aid, both economic and military, to a country involved in human rights violations. While such legislation is in place, the actual practice of aid giving often ignores the human rights violations. In this article, we focus on the US aid giving to Egypt and explore whether the US took into consideration the aspect of human rights violation by the latter. Examining US economic and military aid to Egypt over an extended period of several decades covering various regimes including that of President Sisi, we conclude that the US has consistently ignored the aspect of human rights violations as the country is vital for safeguarding US foreign policy goals in the region.

Abstract:: A new report from the United Nations finds that China may have committed crimes against humanity in Xinjiang and that human rights violations are ongoing. The abuse flows from China’s “Strike Hard” campaign, executed to counter separatism and extremism, subjecting Uyghurs and other Turkic minorities to mass detentions, forced labor and sterilizations, cultural suppression, and surveillance. The report comes months after the 2022 Beijing Winter Olympics, before which some governments sympathetic to the Uyghurs’ plight staged diplomatic boycotts, to little avail. The UN report, much like the Olympic boycotts, will change few minds. What does it take to generate intergovernmental consensus around broad-scale human rights violations? Such convergence, even upon opposition to egregious human rights abuse, is rare and difficult to achieve. This is because violating governments are skilled at subverting international human rights norms and onlooking states have many reasons to avoid acting. Abusive practices might be reframed as responsible policy, or covered up. Meanwhile, supposedly compliant governments contend with a panoply of bilateral interests, some incompatible with international norms.

Abstract:: On 30 March 2022, the Foreign Affairs Committee of the UK Parliament launched an inquiry into states’ use of private military contractors (PMC), drawing particular attention to the prominent Russian PMC known as the Wagner Group (UK Parliament, 30 March 2022). The decision to launch the inquiry came as Wagner Group forces deployed to Ukraine, and a series of reports emerged implicating Wagner mercenaries in human rights violations in Mali. This was only one of the latest efforts to investigate the Wagner Group’s activities. Past initiatives came amid heightened international concern over Wagner Group operations in the Central African Republic (CAR). Multiple UN bodies have previously tabled concerns or opened investigations into alleged abuses perpetrated by Wagner mercenaries (UN Security Council, 25 June 2021; UN Info, 31 March 2021). In June 2021, the UN Panel of Experts on CAR tabled reports of “indiscriminate killings” and violence against civilians at the hands of “Russian instructors” to the UN Security Council (UN Security Council, 25 June 2021). The UN peacekeeping mission in CAR (MINUSCA) and Rwandan special forces have also expressed concerns about joint operations with Wagner over alleged human rights violations (UN Info, 31 March 2021; Corbeau News, 13 June 2021). Moreover, the European Union (EU) imposed sanctions on the Wagner Group and Wagner-linked individuals in December 2021 (European Council, 13 December 2021). In light of growing concerns about Wagner’s activities in Mali and their deployment in Ukraine, this report analyzes ACLED data on the group’s engagement in political violence in recent years. It focuses on civilian targeting by the Wagner Group in CAR and Mali, where they have operated alongside state forces since 2018 and 2021, respectively. Abstract:: The death of Mahsa Amini in the custody of Iran’s so-called morality police sparked protests that continue to spread across the country, posing the most serious challenge to Tehran’s theocratic dictatorship in years. The demonstrations have focused on opposing the compulsory wearing of the hijab, but Iranians are also venting anger at a regime that has lost legitimacy after decades of political repression, economic mismanagement, and systemic corruption. Policymakers in the United States are rightly focused on constraining Iran’s nuclear program and state sponsorship of terrorism. Abstract:: Migration policies have divided the world in two groups: the walled world of Western countries and the rest. The EU system of migration control is the most extensive, given that Europe is surrounded by a series of regions with high migration potential. Migration restrictions do not enhance and may serve to reduce the opportunities of the worse-off and, as such, are at odds with international fairness. Negative externalities from richer to poorer countries, triggered by migration policies themselves or monetary or climate policies, make migration restrictions even more unfair. The growth of the migration control system ends up threatening human rights within Western countries. It is necessary to explore all possible ways to reverse migration restrictions and promote more open migration policies.

Abstract:: On September 2–3, 2021, a workshop was held at ELIAMEP at which participants discussed their prospective contributions to a collective volume with the working title “Legal Mobilisation for Minority Rights in Central and South-eastern Europe (CSEE)”. The contributions tracked rights-claiming by three large groups of minorities in areas historically ruled by the multicultural Austro-Hungarian monarchy and the Ottoman empire: Hungarian minorities living around their kin-state, Roma across CSEE, and Muslims in the Balkans, including Turks, Muslims, Albanians, and Bosniaks. The edited volume will be the first systemic study of minority-rights activism in its political and geographic context, with a focus on how ethnic minorities use law in practice. Rather than focusing on high-visibility international litigation, which is dominant in the extant scholarship, the volume tracks legal action from the national and local level up, assessing the impact of legal mobilization in terms of social change, not simply legal success.

Abstract:: During the administration of the former Yugoslavia, the Albanian population of Kosovo was denied the basic right to education. Albanian students, although they were numerically in the majority at the University of Pristina, did not even enjoy the basic rights to education in the Albanian language, despite the fact that this university was Albanian and was founded by Albanians more than 20 years ago. This situation pushed Albanians to organise themselves to defend their freedoms and rights, especially in the field of education. The student protests of October 1997, organised in a spirit of cooperation between students, civil society and teachers, became one of the many factors that brought the treatment of the Albanian people under Slobodan Milosevic's regime to the attention of the world.

Abstract:: Despite a solid legal framework, Serbia’s fight against cyber attacks and crime progresses slowly due to the chronic lack of qualified staff, as well as the politicized priorities of the competent institutions. This is one of the conclusions of the latest publication on the cybersecurity context in Serbia. Official statistics indicate an increasing trend in the number of cyber attacks and cybercrime cases in Serbia. About 26 million significant cyber attacks on information and communication technology (ICT) systems occurred in 2020 – the most common of which involved attempted intrusions into ICT systems and unauthorized data collection. Serbian citizens also witnessed massive violations of their right to privacy and personal data during the pandemic, as well as an increase in the number of attacks against human rights defenders and political dissidents in the digital and physical space. In late 2021, the idea of using biometric surveillance to counter terrorism and organized crime was reintroduced. However, due to the rapid backsliding of democracy and the rule of law, citizens fear that the new face recognition technologies will be directed against them, rather than against criminals and potential terrorists. Since the beginning of 2022, there have been several attempts to commit internet fraud and steal the identities and data of users of the Raiffeisen Bank and the Post of Serbia. In the most recent incident, a hacker attacked the country’s cadastre and shared electronic reports about bombs planted in various public and private institutions, causing widespread concern in society and temporarily disabling the day-to-day work of the institutions affected. Threats to journalists via social networks have also become more frequent. Cyber attacks are now a part of daily life in Serbia, and threats posed by the internet and social networks are likely to intensify and become more complicated in the future. It is therefore important for state authorities to be prepared to respond to any challenge, risk, or threat quickly and effectively, while respecting human rights and the rule of law. The Belgrade Centre for Security Policy addresses the topic of cybercrime from the perspective of human rights and the rule of law. In this context, the centre conducted a baseline analysis and 22 interviews with governmental and non-governmental stakeholders in Serbia, from mid-January to end March 2022, to assess the level of legal and institutional development of the competent authorities in the area of information and cyber security, as well as the challenges facing cybersecurity and human rights in the country. This publication is part of the larger report that focuses on mapping cybersecurity-related human rights opportunities and challenges, and represents an area that is under-explored in the region. There are six chapters in total, one for each economy in the Western Balkans. Each begins with essential conceptual background information regarding the cybersecurity and human rights contexts of each economy. They then each explore four core thematic issues: cybersecurity and the right to privacy, cybersecurity and freedom of expression, cybersecurity and freedom of peaceful assembly (and, where relevant, freedom of association), and cybersecurity and anti-discrimination. Finally, they present ways forward, with concrete recommendations for stakeholders. The study as a whole aims to offer recommendations for the inclusion of human rights standards in cybersecurity governance and for better implementation of cybersecurity norms within the human rights frameworks of the Western Balkans region.

Abstract:: Europe and the United States share an interest in promoting human rights in China but often struggle to affect change in this regard. Because of ineffective approaches and low political commitment, human rights are a marginalized issue in transatlantic China policy and an afterthought to commercial interests. European and US policymakers have attempted to compartmentalize their approach to China, keeping human rights separate from commercial and other interests. This does little to advance human rights, and it only seems to encourage more assertive and coercive behavior by China. During the last few years, the Western assumption that trade and foreign capital would transform China into a more open and democratic society has been replaced by a disillusioned realization that its rise as a superpower is reshaping the international order. Under President Xi Jinping, China has evolved from its previous position as rule-taker and status quo-keeper at the UN to become an assertive rule-maker and international norm entrepreneur. Its vulnerability to external pressure has declined while its power to exert pressure and economic coercion on others has increased. China no longer presents its political and economic model merely as different from but as superior to that of the liberal democracies in the West. For several years now, European and US policymakers have declared an “end of naivety” in relation to China. After years of debating how to make the EU more resilient and robust, Russia’s invasion of Ukraine has “given birth to geopolitical Europe,” in the words of its chief diplomat, Josep Borrell. It remains to be seen whether this moment of clarity will translate into a more principled defense of human rights and investment in democratic resilience. For this to happen, there needs to be a broader reckoning with how Western countries for decades mishandled the authoritarian challenge to the international order, often because they were pursuing stronger economic ties with the same governments they now see as systemic rivals.

Abstract:: LGBTQ+ rights are gaining attention in national and international political discourse and policymaking. Despite recent progress, complex challenges still stand in the way of establishing human rights for LGBTQ+ communities around the world. One such challenge is the uneven progress towards LGBTQ+ rights caused by conflicts between progressive policy and conservative norms, which poses a threat to the progress that has been made and may lead to worsening conditions for LGBTQ+ people. Within the context of Latin America and Cuba specifically, this paper explores whether progressive policy alone is sufficient for enabling change, and the relationship between policy and norms: does policy shift with norms? Or do norms shift with policy? With a unique history and culture, and some of the strongest pro-LGBTQ+ policies in the region, Cuba provides an opportunity to examine these questions and provides critical insights for literature that is otherwise underdeveloped.

Abstract:: Forced and coerced sterilizations, far from being a relic of the past, remain a widespread and troubling practice throughout the world. In the Americas, numerous countries have been accused of carrying out state-sponsored campaigns of forced sterilizations against indigenous, Afro-descendant, poor, and/or intellectually disabled women, in what amounts to an appalling act of violence and targeted erasure of marginalized communities. While international jurisprudence on forced sterilizations is limited, the Inter-American Human Rights System has been at the forefront of confronting this issue of reproductive justice. Through an analysis of two landmark cases at the Inter-American Court of Human Rights, this paper explores the strides that have been made and the gaps that remain for survivors of forced sterilization to receive justice.

Abstract:: One of the world’s most serious humanitarian crises is taking place in Afghanistan and it is largely the result of flawed assumptions of Western policy following the Taliban’s seizure of power. The West’s suspension of development aid has led to the collapse of the economy and to hunger for millions of Afghans. Instead of forcing the Taliban to respect human rights, the actions will have the opposite effect—a humanitarian catastrophe, mass migration, and a failed state. The European Union may soon face these effects directly, so it should take steps to resume development cooperation and avert the worst-case scenario.

Abstract:: For over three decades, the United States and the international community has been attempting to engage North Korea diplomatically, aiming for the complete, verifiable, irreversible denuclearization of North Korea. The Kim family regime has been committing crimes against humanity, but human rights concerns have been discounted by U.S. and other negotiators, fearing they would be an obstacle to a negotiated solution to the grave military and security challenges Pyongyang poses. North Korea has breached each and every one of the international obligations it has assumed, from imembership in the Treaty of Non-Proliferation of Nuclear Weapons to the 1994 Geneva Agreed Framework to the Six Party Talks to the 2012 Leap Day Agreement. While its negotiating counterparts have neglected human rights concerns in multilateral and bilateral talks, North Korea has continued to develop and test its nuclear and ballistic missile programs. It is time for a new paradigm, that brings human rights into the conversation, in a bilateral or multilateral setting.

Abstract:: While the Universal Declaration of Human Rights recognizes the agency, dignity and rights of the individual, North Korea’s collectivist notion of freedoms are conditioned to preserve and perpetuate the Kim regime, resulting in the denial of human rights for North Koreans. Pyongyang’s defensive outbursts and angry rhetoric in defense of its distorted definition of sovereignty has deeply affected South Korea’s policy approach over the issue of North Korean human rights. Sensitive to Pyongyang’s feelings, South Korea’s progressive camp prefers to engage with North Korea in the wishful hopes that relations will gradually improve. The conservative camp at times uses the Kim regime’s sensitivity to dial up pressure on issues such as denuclearization. Progressives are willing to concede aid and benefits up front to get to inter-Korean engagement while conservatives make these concessions conditional. Neither approach has alleviated the brutal denial of human rights in North Korea. This paper explores South Korea’s “wicked problem” of partisan treatment of North Korean human rights through careful examination of present and past administrations and concludes with recommendations for a middle ground safe enough so that neither progressives nor conservatives feel they have strayed too far outside of the partisan boundaries of their respective camps

Abstract:: In his 2020 Call to Action on Human Rights, UN Secretary-General António Guterres committed to developing an “Agenda for Protection.” The agenda provides an opportunity for the UN to reaffirm that the protection of crisis-affected populations is fundamental to its purpose and values. To be effective it should address the lessons learned from previous efforts to bring about a system-wide approach to protection, particularly the Human Rights up Front initiative. Critically, it should address the systemic and structural shortcomings of the UN to effectively respond to protection crises by providing strategic coherence to the fragmented ways in which the different UN entities contribute to protection. This policy paper analyzes the policy, strategic, and operational priorities for the forthcoming Agenda for Protection. It focuses on how the UN system can reform the way it addresses protection crises while remaining mindful that its role is heavily influenced by member states. It argues that without a transformative and comprehensive approach that brings together the fragmented ways the different UN entities contribute to protection, the Agenda for Protection is likely to suffer the same fate as previous unsuccessful efforts, further undermining the organization’s credibility. The paper concludes by providing several recommendations for the UN to consider as it drafts the Agenda for Protection: Establishing a clear vision statement and a commitment to protect; Setting out a common framework of protection measures to be implemented; Designating and resourcing a system-wide lead entity on protection; Outlining procedures to scale up the response in the event of a protection crisis; Developing an implementation plan and accountability framework; and Consolidating the reporting of protection results.

91. Natural Disasters and Women’s Rights in Vietnam

Abstract:: The majority of Vietnamese people live in rural areas and are dependent on agriculture, an industry in which men play a dominant role and is heavily impacted by natural disasters and climate change. Vietnam is also characterized to have high gender inequality and violence against women. Trung Xuan Hoang, a research fellow at the Vietnam Academy of Social Sciences, explores the relationship between natural disasters and women’s empowerment. Through empirical research, he explains that factors that increase women’s power and control or resources, such as participation in labor, access to microcredit, education, and ownership of immovable property, increase women’s empowerment. Data suggest that increased natural disasters cause a fall in agricultural income. The author argues that as a result, men’s influence vis-a-vis women’s in domestic decision-making decreases, meaning that natural disasters increase women’s household power in Vietnam.

Abstract:: In this issue briefing, Dr. Hun Joon Kim, professor of Political Science and International Relations at Korea University, provides an overview and analysis of the ADRN’s Working Paper Series on Transitional Justice and Reconciliation in Asia. He finds that in Sri Lanka, Korea, and Taiwan, past instances of human rights violations were complex and unique; perpetrators, international dynamics, and the inevitable “politicization” of justice efforts have each created unique obstacles to and nuances in the pursuit of justice. Kim argues, however, that a few conclusions can be drawn from the three cases: first, that the trend in Asia is towards justice and away from impunity; second, that the transitional justice process is gradual, winding, and cannot be solved in one fell swoop; and third, that transitional justice is not simply a state-led process-the pursuit of reconciliation involves the entire nation: government, civil society, and civilians.

93. Cultivating friendly forces: The Chinese Communist Party’s influence operations in the Xinjiang Diaspora

Abstract:: The Chinese Communist Party (CCP) has committed well-documented and large-scale human rights abuses against the Uyghurs and other indigenous minorities in the Xinjiang Uyghur Autonomous Region (XUAR) that amount to crimes against humanity. Through its complex united front system, the CCP is actively monitoring members of the diaspora, including Uyghurs, creating databases of actionable intelligence, and mobilising community organisations in the diaspora to counter international criticism of its repressive policies in Xinjiang while promoting its own policies and interests abroad. These organisations are powerful resources in Beijing’s ongoing efforts to reshape the global narrative on Xinjiang, influence political elites abroad, and ultimately control the Chinese diaspora, but they’re also poorly understood. These organisations purport to represent and speak on behalf of ‘Xinjiang’ and its indigenous peoples. They subsume Uyghur and other minority cultures and identities under a nebulous yet hegemonic ‘Chineseness’, which is defined by and connected to the Han-dominated CCP. In reality, these organisations and their leaders play important roles in muting alternative and independent voices from the community while amplifying CCP messaging and spreading disinformation. They exploit the openness of democratic and multicultural countries while assisting the CCP and its proxies to surveil and even persecute members of the Xinjiang diaspora community or individuals who are critical of the CCP’s Xinjiang policies. Like united front work more broadly, the activities of these groups and their links to the Chinese Government are often overlooked and can be difficult to parse. While human rights abuses in Xinjiang are being exposed internationally, the mechanisms and tactics developed by united front agencies to co-opt overseas Xinjiang-related community groups have gone largely unnoticed. Our research demonstrates how these groups can sow distrust and fear in the community, mislead politicians, journalists and the public, influence government policies, cloud our assessment of the situation in Xinjiang, and disguise the CCP’s interference in foreign countries.

Abstract:: The Chinese Communist Party (CCP) is using technology to enforce transnational digital repression and influence unwitting audiences beyond China’s territory. This includes using increasingly sophisticated online tactics to deny, distract from and deter revelations or claims of human rights abuses, including the arbitrary detention, mass sterilisation and cultural degradation of minorities in Xinjiang. Instead of improving its treatment of Uyghurs and other Turkic minorities, the CCP is responding to critiques of its current actions against human rights by coordinating its state propaganda apparatus, security agencies and public relations industry to silence and shape Xinjiang narratives at home and abroad. Central to the CCP’s efforts is the exploitation of US-based social media and content platforms. CCP online public diplomacy is bolstered by covert and coercive campaigns that impose costs and seek to constrain international entities—be they states, corporations or individuals—from offering evidence-based critiques of the party-state’s record on human rights in Xinjiang and Hong Kong and other sensitive issues. This asymmetric access to US-based social media platforms allows the CCP to continue testing online tactics, measuring responses and improving its influence and interference capabilities, in both overt and covert ways, across a spectrum of topics. The impact of these operations isn’t widely understood, and the international community has failed to adequately respond to the global challenges posed by the CCP’s rapidly evolving propaganda and disinformation operations. This report seeks to increase awareness about this problem based on publicly available information.

95. The Security Ghost of the January 25th Revolution in al-Sisi Regime’s Policy toward Gaza

Abstract:: This study argues that al-Sisi regime has been haunted by the January 25 uprisings as a potential recurrent threat to the state survival during the formulation of national and foreign politics. In the aim of boosting its international legitimacy before Western allies, especially the US, the regime has capitalized on political instabilities in Gaza as a means to ensure its security grip on power without incurring foreign allies’ critics for human rights violations. How did al-Sisi regime mobilize Gaza as a means for bolstering its international credibility before Western bailers and shunning off the January 25 security ghost? In answering this question, this study refers to haunted politics in foreign policy-making as an informative perspective about the impact of traumatic events on ruling regimes’ interpretation of incidents, convocation of memories, recreation of meanings, and subjugation of citizens. Unlike Mubarak’s limited support for the Palestinian cause and Morsi’s exclusive ties with Hamas, al-Sisi adopted a balanced approach toward Gaza in the aim of counterbalancing the US reservations over the regime’s human rights violations since 2013.

Abstract:: InDecember 2021, the UN Human Rights Committee(‘HRC’)published its views in a ground-breaking case (Communication No2918/2016),1finding that the Netherlands had violated a child’s right to a nationality by registeringthem as having‘unknown nationality’in theircivil records. The HRCreasoned that, in so doing, the Netherlands hinderedthe child’s access to international protection as a stateless child.This was the first time that the HRChas ruled on the right of a child to acquire a nationality under art 24(3) of the International Covenant on Civil and Political Rights(‘ICCPR’).FACTSThe case revolved arounda petition by DZ, a child born in Utrecht in 2010 to a Chinese mother. In 2004, she was trafficked to the Netherlands as a minorbut managed to escape her traffickers at the Schiphol Airport in Amsterdam. She then applied for asylum, but her application was unsuccessful. In 2006, DZ’s mother was forced into prostitution. Two years later, she broke out of her captivity and reported the situation to the police, which gave her the right to a temporary status while the investigation was undergoing. Abstract:: EU Member states can be divided on China, even on issues such as human rights. Often singled out as an agent of division is the Hungarian government of prime minister Viktor Orbán. Hungarian dissent begs the question: how can the EU move forward on China given Hungary’s strategy of obstructive dissent? European cooperation ought not wait for unanimity, nor should it rely on value-politics: member states should play the power game to circumvent or break lingering impasses. Member States should support setting up a 27+1 Forum as the main platform for European China-policy, form a leading group tackling strategic corruption and corrosive capital, and initiative a track 1.5 dialogue on China with Germany and the Visegrád Countries.

Abstract:: For the United States to be “committed to a world in which human rights are protected, their defenders are celebrated, and those who commit human rights abuses are held accountable” requires more than rhetorical flourishes.1 To achieve the goal of protecting and promoting human rights, the United States must embrace a more restrained security posture together with a persistent diplomatic strategy that prioritizes engagement ahead of confrontation. Military force and economic coercion are the wrong tools for advancing human rights. As the cases of Iraq and Libya demonstrate, preventive or humanitarian wars have critically impaired human rights. Similarly, comprehensive sanctions regimes have imposed severe human rights costs while achieving few U.S. foreign policy goals, if any, in targeted countries. The United States should therefore incorporate the following policy approaches in the service of human rights: • Right-size its expectations of what American power can achieve to protect and advance human rights abroad. On balance, exaggerated and unrealistic confidence in American power has hurt rather than helped the cause of human rights. • Serve as a public advocate of human rights in multilateral settings, engaging with international institutions to pressure allies and adversaries alike on their human rights records. At the same time, the United States should raise human rights concerns directly in its bilateral dealings when abuses come to light, using private diplomacy to highlight specific issues or changes that are priorities. • Do much more to support the protection and promotion of human rights in areas under its direct control or influence. This would include, at a minimum, halting human rights abuses committed by the U.S. in its own counterterrorism operations, freezing military aid when U.S. arms are implicated in targeting civilians, building on the recent openness to Ukrainian refugees by strengthening and expanding U.S. asylum and refugee resettlement programs globally, and greatly increasing delivery of humanitarian aid, in the form of funding as well as medical and food assistance, to civilian populations deprived of their socioeconomic rights due to conflict, climate change, and the global food crisis.
