Abstract:
Iran has good strategic reasons to seek political accommodation with its Arab Gulf neighbors, to reach an agreement with the P5+1 over its nuclear programs, and to put an end to decades of tension with the US and other Western countries. It is as vulnerable-or more vulnerable-to any interruption in the flow of maritime traffic in the Gulf region as its neighbors, and cannot match the combination of US, UK, British, and Arab Gulf countries in any sustained military conflict.

This paper looks at the trade policy landscape of the EU and the wider Europe, with a focus on issues arising from the signature on 27 June 2014 of Deep and Comprehensive Free Trade Agreements (DCFTAs) between the EU and three East European countries (Georgia, Moldova and Ukraine), and actual or prospective issues relating to the customs union of Belarus, Russia and Kazakhstan (BRK), and the Eurasian Economic Union whose founding treaty was signed on 29 May 2014. While the contrived collision between these projects has tragically induced Russia to break all the established international security norms by waging war against Ukraine , the present paper deals essentially with trade policy issues . The huge expansion of intercontinental free trade area negotiation s currently underway, in which the EU is an active participant alongside much of the Americas and Asia, stands in contrast with Russia's choice to restrict itself to the Eurasian Economic Union, which is only a marginal extension of its own economy. Alone among the major economies in the world, Russia does not seek to integrate economically with any major economic bloc, which should be a matter of serious concern for Moscow. Within the wider Europe, the EU's DCFTAs with Ukraine, Moldova and Georgia are a major new development, but Russia now threatens trade sanctions against Ukraine in particular, the economic case for which seems unfounded and whose unilateral application would also impair the customs union. The Belarus-Russia-Kazakhstan customs union itself poses several issues of compatibility with the rules of the WTO, which in turn are viewed by the EU as an impediment to discussing possible free trade scenarios with the customs union, although currently there are far more fundamental political impediments to any consideration of such ideas. Nonetheless this paper looks at various long-term scenarios, if only as a reminder that there could be much better alternatives to the present context of conflict around Ukraine.

In October 2013, Prime Minister Stephen Harper announced that the Government of Canada had reached a "political agreement" with the European Union on the Comprehensive Economic and Trade Agreement (CETA). The timing of Mr. Harper's statement was not coincidental. Evidence suggests that talks between Canada and the European Union are actually continuing several months after his announcement, if only on technical elements. Nonetheless, it seems the Government of Canada wanted to signal that a successful end to Canada-EU talks was in sight, just as talks between the United States and the European Union were getting under way towards the Trans-Atlantic Trade and Investment Partnership (TTIP). The Canadian government did not want to risk a redirection of European energies away from the Canadian negotiation toward their American counterparts.

39506. What Drove the Mid-2000s' Explosiveness in Alternative Energy Stock Prices? Evidence from US, European and Global Indices

Abstract:
Soaring prices in European alternative energy stocks and their subsequent tumble have attracted attention from both investors and academics. This paper extends recent research to an international setting and analyzes whether the explosive price behaviour of the mid-2000s was driven by rising crude oil prices and an overall bullish market sentiment. Inflation-adjusted US alternative energy stock prices do not exhibit signs of explosiveness. By contrast, we find strong evidence of explosive price behaviour for European and global sector indices, even after controlling for a set of explanatory variables. Interestingly, while the sector indices plunged with the outbreak of the global financial crisis, idiosyncratic components continued to rise and did not start to decline until after world equity markets had already begun to recover in 2009. This finding suggests a substantial revaluation of alternative energy stock prices in light of intensifying sector competition and shrinking sales margins, and casts some doubts on the existence of a speculative bubble. Nevertheless, this paper observes temporary episodes of explosiveness between 2005 and 2007 followed by rapid collapses, indicating the presence of some irrational exuberance among investors.

Abstract:
Sub-Saharan Africa (SSA) is facing high rates of urbanization and increasing food insecurity. The informal food economy addresses food insecurity by providing access to affordable food and significant employment opportunities to the urban poor in SSA. The Committee on World Food Security should recognize the informal food economy as a critical governance issue. Different policy approaches need to be taken into account to address the diverse needs of the informal food economy, including the needs of "survivalist" traders, larger constrained enterprises and female vendors. Municipalities in SSA often have restricted budgets, which hinder their ability to appropriately govern and support the local informal food economy. Increases in municipal budgets to align with food security needs in urban Africa should be considered as decentralization continues across SSA.

Over the last decade, tremendous progress has been made in the prevention, care and treatment of HIV/AIDS, TB and malaria globally. The international community has played a key role in this progress and remains committed to the fight, but as implementing countries' economies grow, they are progressively graduating from international support. This could leave national governments, especially health ministers, uncertain about the future of financing available for their national health programs. Without sufficient resources from both domestic and international resources, there is a risk of resurgence of these diseases. If these trends continue, there may not be a "grand convergence" in health by 2035, resulting in enormous economic and social costs.

Abstract:
An estimated one-third of girls around the globe become brides before the age of eighteen and one in nine do so before the age of fifteen. In recent decades, the issue of child marriage has grown in profile and priority for many policymakers. The Elders, a group of global leaders including former United Nations (UN) secretary-general Kofi Anna n and former U.S. president Jimmy Carter, have taken on the issue and opted to use their platform to speak out against the practice, as have other prominent international organizations. The UN estimated that in 2011, nearly seventy million women ages twenty to twenty-four had married before they turned eighteen. If current trends continue without pause, in the next ten years, more than 140 million girls will be married before their eighteenth birthdays. In order to design interventions that can scale to match the level of the challenge, it is critical to understand the drivers of child marriage and the factors that can curb it.

39512. Southeast Asia's Regression From Democracy and Its Implications

Between the late 1980s and the late 2000s, many countries in Southeast Asia were viewed, by global democracy analysts and Southeast Asians themselves, as leading examples of democratization in the developing world. By the late 2000s, Thailand, Malaysia, Indonesia, the Philippines, and Singapore all were ranked as "free" or "partly free" by the monitoring organization Freedom House, while Cambodia and, perhaps most surprisingly, Myanmar had both taken sizable steps toward democracy as well. Yet since the late 2000s, Southeast Asia's democratization has stalled and, in some of the region's most economically and strategically important nations, gone into reverse. Over the past ten years, Thailand has undergone a rapid and severe regression from democracy and is now ruled by a junta. Malaysia's democratic institutions and culture have regressed as well, with the long-ruling Barisan Nasional (BN) coalition cracking down on dissent and trying to destroy what had been an emerging, and increasingly stable, two-party system. Singapore's transition toward contested politics has stalled. In Cambodia and Myanmar, hopes for dramatic democratic change have fizzled. Only the Philippines and Indonesia have stayed on track, but even in these two countries democratic consolidation is threatened by the persistence of graft, public distrust of democratic institutions, and continued meddling in politics by militaries.

For decades, child marriage has been viewed as an unfortunate but inevitable social ill. Few policy-makers have considered its eradication feasible given how entrenched the practice is across the globe: one in three girls worldwide marry before the age of eighteen and one in nine girls marry before the age of fifteen. The United Nations (UN) estimates that if current trends continue, in the next decade 142 million girls globally will become brides before they turn eighteen. The implications are dire: research shows that child marriage both reinforces poverty and makes it harder to escape. The practice has curtailed advancement on Millennium Development Goals Four and Five-which call for a two-thirds reduction in the under-five mortality rate and a three-fourths reduction in maternal deaths by 2015, respectively-and has undermined the goal of achieving universal primary education.

The significant gains that Afghan women and girls have made since the 2001 U.S.-led military invasion and overthrow of the Taliban are endangered. Presidential elections and possible peace efforts with the Taliban raise uncertainties about whether the future leadership in Afghanistan will protect gender equality. Further, President Barack Obama's plan to completely draw down U.S. troops in the country by the end of 2016 risks withdrawing critical security protection, which has provided Afghan women and girls with increased safety and opportunities to participate in education, employment, the health system, politics, and civil society. With these political and security transitions underway, the United States should act now, in coordination with Afghanistan and its partners, to cement and extend the gains and prevent reversal.

Electoral reform in the early 1990s ended single-party dominance in Japan and promised an era of new politics in which political parties would alternate control of the government. In the two decades that followed, Japan's foreign and domestic policy priorities were subjected to greater scrutiny and debate as Japan, like so many other nations around the globe, sought to reorient itself in a new post-Cold War world. The U.S.-Japan alliance that anchored Japan's postwar foreign policy was not immune to these domestic political reforms. For half a century, the conservative Liberal Democratic Party (LDP) prided itself on managing the relationship with Washington. But its ouster in 2009 by the reformist Democratic Party of Japan (DPJ) led many to expect that even Japan's alliance with the United States would be subject to serious review.

39516. How to Make Fuel Subsidy Reform Succeed

Fossil fuel subsidies are a global scourge. They distort markets, strain government budgets, encourage overconsumption, foster corruption, and harm the environment while doing little to remedy inequality or stimulate development. Yet despite compelling arguments for reform, fossil fuel subsidies remain deeply entrenched. Citizens have yet to be convinced that fuel subsidies can and should be replaced with more efficient poverty alleviation programs. As a result, governments refrain from phasing out fuel subsidies for fear of triggering a public backlash, and even civil unrest. To bolster the prospects for subsidy reform, the United States should support the creation of a new public-private partnership within the World Bank, the Global Subsidy Elimination Campaign (GSEC), to work with governments to execute country-specific communication programs that would build the case for fossil fuel subsidy reform among citizens. The GSEC would start with pilot programs in select countries, and on the basis of these efforts, expand its work to other countries interested in fuel subsidy reform. If the GSEC help s generate just a 5 percent reduction in the more than half a trillion dollars that governments now spend on fossil fuel subsidies, it would free up billions of dollars for more effective anti-poverty initiatives.

39517. Designing a Global Coalition of Medicines Regulators

Globalization has transformed the marketplace for medicines in recent decades, giving rise to new threats including the poor traceability of global supply chains, counterfeit and substandard medicines, and antibacterial resistance. Aware that public drug authorities must cooperate to meet the emerging challenges of modern medicines regulation, the U.S. Food and Drug Administration (FDA) has been discussing with counterpart agencies abroad creating a"global coalition of regulators." Yet a coalition alone is not enough; the devil, as always, will be in the details. In pursuit of this goal, the FDA and partner medicines regulatory agencies should design a coalition with five distinct features: narrow scope, to promote realistic goals; flexibility, to adapt to future circumstances; selective membership, to maximize like mindedness, particularly in the early stages; nongovernmental (NGO) participation, to leverage the capacities of both NGOs and for-profit corporations; and institutional partnerships, to orchestrate the activities of other regulatory organizations.

39518. Gender equality and land administration: the case of Zambia

Abstract:
Land, and in particular agricultural land, is central to livelhoods in rural Zambia. Zambia is characterised by a dual legal system of customary and statutory law and by dual land tenure, with state land and customary land. A first wave of socialist-oriented reforms took place after independence in 1964, which abolished previously existing freehold land in favour of leasehold. Subsequent changes in government policies under the influence of structural adjustment programmes and a new government in 1991 paved the way for a market-driven land reform. The 1995 Lands Act introduced the privatization of land in Zambia and provided for the conversion of customary into state land, with the hope of attracting investors. However, the Act has been unevenly implemented, at least in rural areas, in part due to problems plaguing the land administration institutions and their work, in part due to opposition to the main tenets of the Act from chiefs, the population and civil society. Civil society, with donor support, calls for more attention towards women's precarious situations with regard to access to and ownership of land under customary tenure, but it still expresses a desire for customary tenure to remain. However, civil society also recognizes that customary practices are often also discriminatory towards women who depend on male relatives for access to land.

Ghana has been implementing a land administration reform since 1999. The Land Administration Project (LAP), an ambitious programme supported by donors, aims to strenghten land administration institutions and increase land holders' security of tenure on both state and customary land. This working paper reviews the literature on this land reform process, with a focus on issues related to gender. At first absent from the 1999 Land Policy, gender concerns were later incorporated into the project and a gender strategy was developed in 2009, with the goal to mainstream gender in land-related agencies and activities. Although donors have contributed to the gender strategy, the inclusion of gender equality has not been at the forefront of their priorities.

ISAF's withdrawal from Afghanistan in 2014 will directly impact the wider region. Not only is there a risk of instability spilling over to Central Asia, but the drawdown will also accelerate the ongoing shift in the balance of power in Central Asia towards China. Should a spillover occur, the burden will mainly fall on Russia and China. Russia will, however, only continue playing the dominant role in the security of the former Soviet Central Asia (FSCA) until China takes on responsibility for the security of its direct sphere of influence or "dingwei". Russia's Near Abroad, however, overlaps both with the EU's Eastern Neighbourhood in Europe and China's dingwei in Central Asia and the Far East. It is, therefore, necessary to approach Russian reactions to these encroachments on its historical spheres of influence in a single context, taking into account the interrelationship between these three.

When President Obama delivered his address to the Australian Parliament in 2011 affirming his strategic decision that the United States will play a larger role in shaping the Asia Pacific region and its future—what came to be called the rebalance—few observers outside Brunei Darussalam might have anticipated that Brunei would emerge as an essential partner for the United States in the effort to get the rebalance right. But that is what happened. The United States worked closely with Brunei, especially in the context of Brunei's role as the 2013 Chair of the Association of Southeast Asian Nations (ASEAN), to develop innovative projects to promote comprehensive American regional engagement. Two important examples of initiatives to broaden US regional engagement were the Brunei-US English Language Enrichment Project for ASEAN and the US-Asia Pacific Comprehensive Energy Partnership. As these projects were being implemented, Brunei's effective Chairmanship of ASEAN helped lower the temperature in the region on the South China Sea and promote broad regional military-to-military cooperation, particularly through a Brunei-hosted Humanitarian Assistance/ Disaster Relief and Military Medicine exercise that brought together 18 nations, including the United States and China. The rebalance also includes a commercial side, and US companies have enjoyed increased success in Brunei. Looking ahead, the opportunities for trade should multiply once the Trans-Pacific Partnership (TPP) negotiations, in which Brunei and the United States are among the twelve parties, come to a successful conclusion.

Much of what you read nowadays about Honduras feeds the perception of a country plagued by violence, corruption, poverty, impunity, and human rights abuses. Honduras is indeed confronting very serious challenges in security, fiscal management, governance, job creation, and justice sector reform. However, this is only one side of the coin and masks a lesser-known reality that provides reason for optimism. Despite the considerable challenges Honduras faces, the US government has dedicated partners both in the Honduran government and in other sectors of society who have contributed to successful, sustainable initiatives, including the Central America Regional Security Initiative, that make a difference in the quality of Honduran citizens' lives and advance mutual interests. There is indeed hope for the future of Honduras.

Abstract:
Today the term 'data mining' is used in both academic and non-academic circles, though the practice is neither novel nor new. This paper looks at the data collection mission led by John Anderson on behalf of the British East India Company in 1823, and considers if it is possible to collect data in a purely objective, neutral manner. Though John Anderson was careful in his writing, and sought to communicate his findings in a dry, objective fashion, his own subject-position as a functionary working for the East India Company stands out in his account of the mission to Sumatra. This paper argues that the process of data collection is seldom ever a truly neutral enterprise, and that in the framing of the object of analysis, the cultural and socio-economic subject-position of the researcher/analyst is always present, rendering it impossible for there to ever be a truly objective work of research/analysis. In this respect an appraisal of Anderson's work today is also relevant for contemporary scholars who may likewise attempt an 'objective' approach to their work, and it reminds us that the method often constructs the object under scrutiny.

Abstract:
The economics literature generally finds a positive, but small, gain in income to native-born populations from immigrants and potentially large gains in world incomes. But immigrants can also impact a recipient nation's institutions. A growing empirical literature supports the importance of strong private property rights, a rule of law, and an environment of economic freedom for promoting long run prosperity. Although the literature on the impact of economic freedom on various social and economic outcomes is quite large, comparatively little work has tried to explain economic freedom as a dependent variable. This paper empirically examines how immigration impacts a region's policies and institutions. We find small but positive increases in institutional quality as a result of immigration.

The United States currently maintains formal diplomatic relations with all but five United Nations member-states. In addition to these five countries, there are states—including Venezuela—with which U.S. relations continue to be strained. In most such relationships, cooperation across societies is challenging, hampered by seemingly insurmountable political differences between governments. When official cooperation at the higher levels of government proves infeasible, it is often in the interest of both countries to pursue alternative, more informal approaches, sometimes referred to as "Track II diplomacy" Such forms of diplomacy allow for exchanges of people and ideas to build confidence between the two sides. Was Abraham Lincoln, as most Americans believe, a defender of individual rights, a foe of slavery, and a savior of the American republic—one of history's great heroes of liberty? Or was he a tyrant who turned his back on essential founding principles of America, cynically instigated the bloody Civil War to expand federal power, and paved the way for the modern regulatory-entitlement state? In the face of widespread popular support for Lincoln (note, for example, the success of the 2012 Steven Spielberg film about him) and his perennially high reputation among academics, certain libertarians and conservatives have promoted the view that Lincoln was a totalitarian who paved the way for out-of-control government in the 20th century. Those critics are wrong. Contrary to their volumes of misinformation and smears—criticisms that are historically inaccurate and morally unjust—Lincoln, despite his flaws, was a heroic defender of liberty and of the essential principles of America's founding. Getting Lincoln right matters. It matters that we know what motivated Lincoln—and what motivated his Confederate enemies. It matters that we understand the core principles on which America was founded—and the ways in which Lincoln expanded the application of those principles. It matters that modern advocates of liberty properly understand and articulate Lincoln's legacy—rather than leave his legacy to be distorted by antigovernment libertarians (and their allies among conservatives), leviathan-supporting “progressives,” and racist neo-Confederates. My purpose here is not to present a full biographical sketch of Lincoln, nor to detail all types of criticisms made against him. Rather, my goal is to present sufficient information about Lincoln and his historical context to answer a certain brand of his critics, typified by Ron Paul, formerly a congressman from Texas and a contender for the Republican Party's presidential nomination in 2008 and 2012. Paul and his ilk characterize Lincoln's engagement of the Civil War as a “senseless” and cynical power grab designed to wipe out the “original intent of the republic.” Such claims are untrue and unjust, as we will see by weighing them in relation to historical facts. Toward that end, let us begin with a brief survey of claims by Lincoln's detractors. The revision of Lincoln and his legacy began in earnest soon after the Civil War, but, at the time, it was relegated to the intellectual swamp of Confederate memoirs and polemics. What was once the purview of a defeated and demoralized rump and of early anarchists such as Lysander Spooner has picked up steam within the modern libertarian movement. In the early 20th century, the acerbic newspaperman and social critic H. L. Mencken seriously suggested that the Confederates fought for “self-determination” and “the right of their people to govern themselves.” He claimed that a Confederate victory would have meant refuge from a northern enclave of “Babbitts,” the attainment of a place “to drink the sound red wine . . . and breathe the free air.” Mencken's musings were but a symptom of a broader change in how many Americans came to view the Civil War. The conflict was no longer “the War of the Rebellion,” but “the War between the States.” The Confederate cause was no longer an essentially vile attempt to preserve slavery, but an honorable attempt to preserve autonomous government. Not coincidentally, during this period, Confederate sympathizers built monuments to the Confederacy throughout the South, and D. W. Griffith's openly racist silent film The Birth of a Nation presented revisionist Civil War history and contributed to the rebirth of the Ku Klux Klan. Sometimes Confederate sympathizers claimed that the Civil War was not really about slavery; other times they claimed that slavery was a glorious institution the South sought to preserve. More recently, Murray N. Rothbard—widely regarded as the godfather of the modern libertarian movement (and someone who saw Mencken as an early libertarian)5—characterized the Civil War as the fountainhead of the modern regulatory state: The Civil War, in addition to its unprecedented bloodshed and devastation, was used by the triumphal and virtually one-party Republican regime to drive through its statist, formerly Whig, program: national governmental power, protective tariff, subsidies to big business, inflationary paper money, resumed control of the federal government over banking, large-scale internal improvements, high excise taxes, and, during the war, conscription and an income tax. Furthermore, the states came to lose their previous right of secession and other states' powers as opposed to federal governmental powers. The Democratic party resumed its libertarian ways after the war, but it now had to face a far longer and more difficult road to arrive at liberty than it had before. Thomas DiLorenzo, a colleague of Rothbard's until Rothbard's death in 1995, penned two books responsible for much of today's libertarian and conservative antagonism toward Lincoln: The Real Lincoln: A New Look at Abraham Lincoln, His Agenda, and an Unnecessary War (2002) and Lincoln Unmasked: What You're Not Supposed to Know About Dishonest Abe (2006). (Both DiLorenzo and Ron Paul are senior fellows of the Ludwig von Mises Institute, an organization that, while bearing the name of the great Austrian economist von Mises, is more closely aligned with Rothbard's anarchist views.) Largely through his influence on popular economist Walter E. Williams, who wrote the foreword to DiLorenzo's 2002 book, DiLorenzo has reached a relatively wide audience of libertarians and conservatives. Williams is known to many as a genial guest host for The Rush Limbaugh Show, a fellow of the Hoover Institute, and a distinguished professor of economics at George Mason University. He gave his imprimatur to DiLorenzo's work, thereby elevating what might otherwise have been a peculiar book from the depths of Rothbard's libertarian, paleoconservative, neo-Confederate intellectual backwater to a nationally known and provocative piece of severe Lincoln revisionism. What are the essential criticisms leveled against Lincoln by such writers as Mencken and DiLorenzo? The most important of these criticisms can be grouped into four categories. First, these critics claim, Lincoln eviscerated the right of secession supposedly at the heart of the American Revolution. Second, say the critics, Lincoln did not truly care about slavery; he invoked it only to mask his real reasons for pursuing war—to expand the power of the federal government. Anyway, the critics add, slavery would have ended without a Civil War. Third, argue the critics, Lincoln subverted the free market with his mercantilist policies, thereby laying the groundwork for the big-government Progressives to follow. Fourth, Lincoln supposedly prosecuted the war tyrannically; in DiLorenzo's absurd hyperbole, Lincoln was a “totalitarian” who constructed an “omnipotent” state. Let us look at each of these criticisms in greater detail—and put them to rest—starting with the claim that Lincoln spurned the fundamental principles of the founding by opposing secession.

Author's note: This essay is an edited version of a lecture I've delivered to various Objectivist community groups. It assumes some understanding of and agreement with the philosophy of Objectivism. That we live only once is not speculation. This is it. This life is all we have. This fact, however, is not cause for despair; it is cause for action. To quote a favorite ad, “It's not that life's too short, it's just that you're dead for so long.” Our time in life is substantial—we might live to eighty, ninety, or even a hundred years old—and we can do a great deal in the decades we have. But we are going to die. And when we do, that's it. We're done. So: What to do? As rational egoists—as people who know that the moral purpose of life is to maximize our personal happiness—we want to fill our days and years with accomplishments and joy. We want to wake up every morning and pursue our values with vigor. We want to thrive in a career we love, in romance, in our recreational pursuits, in our friendships, and so on. In short, we want to make our lives the best they can be. That's easy to say. And, in a sense, it's easy to do: Just think rationally and act accordingly. In another sense, however, it is the single most difficult thing in the world. Making our life the best it can be is the only project that requires the harmonious use of all of our resources and capacities—physical and mental, personal and social—toward a highly complex goal for the span of our entire life. No other project comes even close to this in terms of its demands. In fact, all of our other egoistic endeavors are subsumed under this one. Whether we are performing brain surgery, or composing a symphony, or building a semiconductor company, or raising children, or learning to hang glide—all such endeavors are only projects within the broader goal of making the most of our life. Everything we do is but an aspect of this grand, all-encompassing goal. To achieve the greatest happiness possible, we have to unify all of our choices, values, and goals into a single harmonious whole. This requires a great deal of thinking, selecting, planning, prioritizing, coordinating, reviewing, reevaluating, and so on. At every turn, we must gain or apply the necessary knowledge, use our best judgment, and act accordingly—with respect to the full context of our values and goals. This is a huge subject, and, in keeping with the opening point, we have limited time. So I want to be clear about the scope of my talk. My goal tonight is to indicate the nature and importance of purpose (and related matters) in good living. My overarching point is that understanding and upholding the concept, value, and principle of purpose is essential to making your life the best it can be. What is a purpose?

Timothy Sandefur is a principal attorney at the Pacific Legal Foundation who focuses on economic liberty. Recently I had the opportunity to interview him about his new book on the Declaration of Independence, his work at the Foundation, and related matters. —Ari Armstrong Ari Armstrong: Thank you for taking the time to share your thoughts with us. Timothy Sandefur: Thanks for having me. AA: Your book, The Conscience of the Constitution: The Declaration of Independence and the Right to Liberty, was published early this year. How would you summarize its central arguments? TS: I argue that individual liberty is the central value, the conscience, of the Constitution. The Constitution says in its very first sentence that liberty is a “blessing.” But it doesn't say the same thing about democracy or about government in general. That is because the authors of the Constitution were building on a foundation of political philosophy, and that philosophy is articulated in the Declaration of Independence—that we are all properly equal before the law and have inalienable rights that no just government may infringe. This principle is the guidepost—the conscience—that helps us to guide our constitutional course. Or it would be the guidepost, if 20th-century thinkers had not abandoned the principles of the Declaration and replaced them with the ideas that government action is presumptively legitimate and that individual rights are just privileges the government gives to us when it chooses to. That shift is how our constitutional understanding has gone awry, and it's a leading reason why so much of the legal profession is unable to understand the document they're interpreting. The result is that our constitutional law has bizarre blind spots and contradictions. The “public use” clause was essentially erased in the infamous Kelo eminent domain case. The privileges or immunities clause was essentially erased in the 1870s in the Slaughterhouse Cases. The due process clause has been radically curtailed. These trends are a consequence of lawyers, judges, and law professors typically prioritizing democracy over liberty as a central constitutional value. So the “conscience” I refer to is a voice in our constitutional order telling us when we do something wrong. That voice is the Declaration of Independence. That's why I defend the idea of “substantive due process” [defined below]—something both conservatives and liberals have rejected nowadays. And it's why I don't buy arguments for “judicial restraint”—which usually seem to mean that when the legislature violates the Constitution, the courts should just look the other way—again, to prioritize democracy over liberty. AA: You argue that early American lawyers and political leaders understood the Declaration of Independence as an important interpretive guide to the Constitution. How was that understanding lost in American law?

Seven Pleasures: Essays on Ordinary Happiness, by Willard Spiegelman. New York: Picador, 2009. 208 pp. $16 (paperback). In Seven Pleasures: Essays on Ordinary Happiness, Willard Spiegelman asks: “In adulthood, what should—what does—one read? No longer having the luxury of youthful promiscuity, knowing that the clock ticks, that every choice of something eliminates something else, what should you do?” (p. 49). Spiegelman suggests rereading “those books that gave pleasure in the past.” He adds: A photographic memory is not necessarily a blessing; there's a charm in forgetting, so if you're not cursed with perfect recall, you'll have the joy of discovering some things as though for the first time, while others will hit you with the refreshing rush of repetition. As an older version of the person you've always been, you can have things two ways at once: something old, something new; something recalled, something revealed. (p. 49) Although Spiegelman does not directly advise going back to what one loves and extracting still more pleasure from it, or learning to convert a declining memory into a source of enjoyment, he nevertheless provides example after example of himself doing just such things. Whereas other books about happiness tell readers how to become happy, in Seven Pleasures Spiegelman simply discusses the activities that have made him happy and shows how he has learned to deeply enjoy his life.

So Good They Can't Ignore You: Why Skills Trump Passion in the Quest for Work You Love, by Cal Newport. New York: Business Plus, 2012. 304 pp. $26 (hardcover). In So Good They Can't Ignore You: Why Skills Trump Passion in the Quest for Work You Love, Cal Newport challenges (among other things) the idea that “the key to occupational happiness is to first figure out what you're passionate about and then find a job that matches this passion” (p. 4). This is a widespread idea with the full backing of American pop culture and of many successful people. But is it true? Newport doesn't think so, and, in arguing that it is not, he observes (for starters) that passions rarely match up with specific jobs. In a 2002 study he cites, for example, 539 Canadian university students were asked if they had passions and, if so, what they were. Eighty-four percent replied that they did have passions, but the top five listed were dance, hockey, skiing, reading, and swimming. Newport sums up this list by concluding what the students themselves likely have found out by now—that “these passions don't have much to offer when it comes to choosing a job” (p. 14). Newport also observes that passions take time to develop. Here he cites a paper by Amy Wrzesniewski, published in the Journal of Research in Personality, that explores the differences between a job, a career, and a calling. A job, in Wrzesniewski's formulation, is a way to pay the bills, a career is a path toward increasingly better work, and a calling is work that's an important part of your life and a vital part of your identity.

We're trying to expose you to ideas, and the big ideas are not simply those of capitalism versus socialism, right versus left. Within the broader liberty movement, there is a diversity of views on a whole range of issues. Just within the libertarian movement, there are all kinds of public debates. Within the Objectivist movement, there are all kinds of debates. And between libertarians and Objectivists, there are some very important, fundamental differences. What we'd like to do today is flesh out one of the big differences between libertarians and Objectivists. I don't think I need to introduce our two combatants today: Max Borders, from FEE, and editor of The Freeman; and Craig Biddle, editor of The Objective Standard. So we have the editors of two major liberty-oriented publications. I know Max and Craig have a lot that they agree on, and we're going to find out what they disagree about. And we're going to conduct this, of course, not as a cage fight, but as a civil discourse among friends. Here's the format: Craig and Max will each be given fifteen minutes for opening remarks, then they will each get five minutes to either respond or make follow-up comments, and then they'll get another five minutes each to respond or make further comments. Donna Hassler is executive director of Chesterwood, the former summer home and studio of Daniel Chester French (1850–1931), a renowned and prolific American sculptor of public monuments best known for the sculpture of Lincoln at the Lincoln Memorial. Located in Stockbridge, Massachusetts, Chesterwood is a historic site of the National Trust for Historic Preservation, a privately funded nonprofit. I recently spoke with Hassler about French's life and work, Chesterwood, and the value of public art. —Joseph Kellard Joseph Kellard: Donna, thank you for taking time to speak with me about this great sculptor. I love the works of Daniel Chester French, and I've photographed many of them, so it's a real treat for me to chat about him and his work with such an expert on the subject. Donna Hassler: You're welcome. JK: French was quite prolific, producing more than one hundred monuments, memorials and other works. What would you say are some of the distinctive features and themes of his art? DH: Daniel Chester French was an American Beaux-Arts sculptor. Trained in Florence and later Paris, he was inspired by the ideal beauty of Greco-Roman art and architecture early in his career. In fact, he didn't even stay around for the unveiling of the Minute Man sculpture in Concord, Massachusetts, in 1874, because he had accepted an invitation from Ned Powers, the son of the prominent American neoclassical sculptor Hiram Powers, to stay with his family in Florence and study sculpture with another American artist, Thomas Ball. The artist looked to nature in modeling his figurative works but improved upon her in the classical tradition. Allegory and symbolism also played a more important role in his sculpture, especially when he memorialized individuals without portraying them in a realistic manner. JK: French's most celebrated sculptures are Abraham Lincoln at the Lincoln Memorial and The Minuteman in Concord, Massachusetts; many of our readers have seen and enjoyed these. Which of his lesser-known works do you think deserve special attention, and why?

Reviewed by Ari Armstrong Imagine a future in which humans rove the galaxy in starships; colonize the moon, distant planets, and space stations; and radically expand their knowledge of the universe. Star Trek: First Contact invites us to imagine just such a future, and it does so in the context of a nail-biting action story pitting the “next generation” crew of the Federation ship Enterprise against mankind's most frightening foes of their fictional universe: the collectivist Borg, who rasp, through cybernetic implants, “Resistance is futile.” Although each of the four films involving The Next Generation (the crew led by Captain Jean Luc Picard) has its merits, First Contact rises above the rest in its storytelling. In the film, the Borg first attack Earth and then send a probe back to their past (our future) to hinder mankind's development and make Earth easy prey for the Borg. What is the singular event the Borg hopes to stop? It is the first human space flight involving “warp” (faster than light) travel, something that (in the world of Star Trek) takes place on April 4, 2063. That the pivotal event of the film is a major technological advancement says a lot about the spirit of the franchise. The crew of Enterprise follow the Borg probe back in time, leading to a twofold story: In Montana, part of the crew help an inventor of 2063 repair his warp ship damaged by the Borg, while on Enterprise (orbiting Earth) the rest of the crew battle a Borg takeover.

The Dictionary of Human Form, by Ted Seth Jacobs. Santa Fe: Mariposa Press, 2011. 819 pp. $150. Reviewed by Daniel Wahl Ted Seth Jacobs painted The Open Window—one of the most beautiful paintings of the twentieth century. He taught Jacob Collins and Tony Ryder—two of the realist movement's most influential teachers. And he has written three books on art—Drawing What the Eye Sees, Light for the Artist, and The Dictionary of Human Form. This last is his latest, and it is arguably one of the greatest books of art instruction ever written. In fact, with more than twenty-five hundred drawings and diagrams on the structure of human form, no other book comes close to being as detailed and as comprehensive. Most books about how to render the human form focus on anatomy. But Jacobs, who has a unique view on this issue (and many others), does not think the study of anatomy is necessary or helpful for artists. He says, for example: Anatomy gives a picture of the skeletal system, of where muscles originate and insert, and their names and functions. I have talked with doctors and biologists, and both have assured me that the appearance of muscles in a dead dissected body is entirely different from that of a living subject. Perhaps that is why, most often, muscles drawn in anatomy books resemble skinny, attenuated, paramecium forms. (p. 10) And: I have not seen all the extant anatomy books for artists, but I have never seen one with what I would consider a mastery of drawing. Anatomy is more applicable to scientific disciplines than to the needs of the artist. Most commonly lacking in anatomy books and courses, is the sense of the special three-dimensional shapes of forms on the surface of the body. (p. 10) And: If you know anatomy as thoroughly as a doctor, but don't know structure, you will not be able to draw correctly. If you don't know any anatomy, but thoroughly understand structure, you will be able to learn to draw like an old master. (p. 1) The Dictionary of Human Form is thus not at all about anatomy; its focus is structure. Jacobs defines structure, most broadly, as “the way in which living organic forms are organized” (p. 7). He then explains why studying the structure of the body is of value to artists.

Reviewed by Daniel Wahl Roger Kimball begins The Rape of the Masters: How Political Correctness Sabotages Art by asking why we teach and study art history. “It is a question,” he says, “that elicits a complicated answer.” To learn about art, yes, but also to learn about the cultural setting in which art unfolds; in addition, to learn about—what to call it? “Evolution” is not quite right, neither is “progress.” Possibly “development”: to learn about the development of art, then, about how over the course of history artists “solved problems”—for example, the problem of modeling three-dimensional space on an essentially two-dimensional plane. Those are some of the answers, or some parts of the answer, most of us would give. There are others. We teach and study art history—as we teach and study literary history or political history or the history of science—partly to familiarize ourselves with humanity's adventure in time. We expect an educated person in the West to remember what happened in 1066, to know the plot of Hamlet, to understand (sort of) the law of gravity, to recognize Mona Lisa, Botticelli's Birth of Venus, or Manet's Bar at the Folies-Bergère. These are aspects of a huge common inheritance, episodes that alternately bask in and cast illuminations and shadows, the interlocking illuminations and shadows that delineate mankind's conjuring with the world. All this might be described as the dough, the ambient body of culture. The yeast is supplied by direct acquaintance with the subject of study: the poem or novel or play, the mental itinerary a Galileo or Newton traveled, the actual work of art on the wall. In the case of art history, the raison d'être—the ultimate motive—is supplied by a direct visual encounter with great works of art. Everything else is prolegomenon or afterthought: scaffolding to support the main event, which is not so much learning about art as it is experiencing art first hand. Or so one would have thought. What has happened to the main event? (pp. 1–2) As Kimball makes clear, the main event has changed.

Your space suit, not to mention your body, was punctured by an antenna blown loose by a raging sandstorm. Luckily, although the blow knocked you unconscious, the blood from your wound helped seal the hole, so you didn't die from lack of oxygen. Now that you're awake and moving again, you realize an unfortunate fact: Your entire crew, reasonably thinking you died and facing the dangerous storm, took off in the MAV (Mars Ascent Vehicle) and left you behind. You are now totally alone on a planet hostile to life. Your food supplies are running low, and you have no obvious way to communicate with Earth, much less to get home. What do you do? If you're Mark Watney, the main character of Andy Weir's near-futuristic, science fiction novel The Martian, you carefully think about what you need to do to stay alive and get rescued, and then you methodically do it. Watney's training as a botanist and a mechanical engineer gives him the skills he needs to survive; and his fierce desire to live, his fortitude, and his quirky sense of humor give him the strength of will to do it. Fortunately, Watney's own mission and various other missions to Mars have left a number of important tools at his disposal. He has a reasonably well-stocked Hab (basically, a giant pressurized tent), some solar cells, several functional space suits, two functional rovers, duct tape, glue, and various other machines and items. Oh, and he has some live potatoes, which his crew was supposed to have cooked for Thanksgiving dinner. Don't forget the potatoes! They become crucially important in Watney's efforts to survive. The story revolves around Watney coming up with clever ways to keep sucking air and consuming calories, then figuring out how to travel some two thousand miles across the cold Martian landscape to the site of a future Mars landing.

As of June 2014, twelve Syrian chemical weapon production facilities remain structurally intact, even as United Nations weapon inspectors, under the auspices of the Hague-based Organization for the Prohibition of Chemical Weapons (OPCW) struggle to negotiate with Bashar al Asad over an estimated100 tons of Priority 1 and Priority 2 chemicals still remaining in Syria, representing approximately eight percent of the total declared material. While Syria was identified decades ago as possessing the largest chemical weapons stockpile in the Middle East, its government has largely denied the existence of its biological weapons programs, dismissing any reference to them as "purely speculative."

Abstract:
A few months prior to the Lebanese parliamentary elections of 1992, Nabih Berri, leader of the Amal movement, was asked to describe his main accomplishment. He answered that his most significant achievement was the abolishment of the feudalism within the Shi'a community. In his answer, Berri referred to the weakening of the feudal families which had ruled the sect for many years. The-se families, called the zu'ama (singular za'im), were not unique to the Shi'a, but were, and still are, characteristic of Lebanese politics as a whole. Unlike families of other sects, the Shi'a families were pushed aside by the sect's clergy, especially by Musa al-Sadr who established the "Movement of the Deprived" and then the Amal movement, which resisted the zu'amas influence.

Since newspapers first arrived in the Middle East, around the beginning of the 19th century, newspapers have played important roles in the life of Arab residents. Although many newspapers do not allow space for discussion and do not investigate governmental injustices, they provide valuable information that affects a large public, reinforce cultural values and instill a rich intellectual heritage . In recent years, these newspapers, like many newspapers in the West, have experience a decline in revenues and have seen new media bite into their share of popularity. This is particularly notable in light of the events of the " Arab Spring . The adoption of the Geneva Accord between Iran and the P5+1 (the US, UK, France, Russia, China plus Germany) to resolve issues related to Iran's nuclear program on November 24, 2013, brought about a series of debates in political circles. In many ways, it could be considered a historic event with international and regional implications and also ushered in a new chapter in Iran-U.S. relations. At the international level, it could have a great impact on the ways in which world affairs are managed. In fact, it was a victory for diplomacy, multilateralism and a thrust towards a multi-polar international system after more than a decade of unilateralism and military interventionist policies with all its catastrophic consequences. At the regional level, by fostering new alignments, it may have a positive impact on current problems; be it elimination of weapons of mass destruction or countering terrorism and extremism that is now expanding beyond the region. The Accord in Geneva also fosters hope for solid and productive relations between Iran and the U.S. after more than three decades of estrangement. Considering that a new geostrategic situation is unfolding in the region, this article tries to answer the questions related to its international and regional implications, as well as its impact on the very delicate issue of Iran-U.S. relations. At the end, some of the major challenges that lay ahead in the implementation of the Accord are examined.

National interest often forms the core of bilateral ties between states. No matter how much idealism is peddled to explain the unassailability of the State's bilateral relations, the national interests and related diplomatic preferences spawn abrasion in these ties. The change of leadership is a consequence of elections results in a national reassessment of foreign policy. This paper attempts to highlight Pakistan's foreign policy dilemma regarding the walking of a tightrope between Tehran and Riyadh. It is argued that the balancing act of Islamabad in this triad is further complicated in the aftermath of 2013 general elections in Pakistan. What impact has the Syrian crisis had on Iran-Turkey political relations? Some analysts argue that divergence in Iranian and Turkish outlooks and roles played in the Syrian crisis have adversely affected their bilateral relationship. But the authors believe that in spite of the conflict in Iran's interests and Turkish policies towards Syria, their broader relations in other areas–security and economy-have prevented the rupture of political relations. In this regards, after the nature of the Syrian crisis is briefly described, Turkish foreign policy strategy in the Middle East will be explained. Then, Turkish-Syrian relations prior to the outbreak of the crisis will be analyzed followed by a discussion of Iranian and Turkish foreign policies towards the Syrian crisis and their impact on their mutual relations. The authors will conclude that although the Syrian political crisis has given rise to certain tensions and adverse consequences in their political relations, their bilateral ties have persisted as manifested in high-ranking diplomatic meetings between their political authorities and in ongoing deliberations on important regional issues.

One of the most important tools utilized by states to maximize their impact in foreign affairs is public diplomacy and to this extent, public diplomacy is considered a source of soft power. The robust use of public diplomacy can enhance and reinforce the soft power of countries. Central Asia is among the regions that have an ever increasing relevance to regional and international affairs in the aftermath of the collapse of the Soviet Union, and is currently considered a critical subsystem for our country. The foreign policy of the Islamic Republic of Iran towards this region is, on one hand, built on the foundation of converging factors in political, economic, and cultural arenas and looking towards opportunities for influence and cooperation. On the other hand, considering the divergent components, it also faces challenges and threats, the sum of which continues to effect the orientation of Iranian foreign policy towards the region. This article will study Iranian public diplomacy in this region and examine the opportunities and challenges, as well as, provide and proper model for a successful public diplomacy in the region of Central Asia, while taking into account the Islamic Republic of Iran's tools and potential.

Diplomatic relationship between Iran and the United Kingdom is one of the most heated debates in the foreign policy of the Islamic Republic. The pros and cons of these relations have always been subject to argument and controversy among politicians and academics. This article seeks to analyze diplomatic ties between the Islamic Republic of Iran and the United Kingdom, applying the cost-benefit analysis method. In this relationship, the costs and benefits are discussed in three situations including the maintenance, downgrading, and rupture of diplomatic relations. The main question answered by the authors is how diplomatic relations between the Islamic Republic of Iran and the United Kingdom can be analyzed according to the cost-benefit analysis method, and what costs and benefits can be brought about for Iran in case of the rupture, downgrading or maintenance of diplomatic relations with Britain. The final conclusion of this research suggests that under the current circumstances, downgrading diplomatic relations with the United Kingdom can lead to fewer costs and further benefits for the Islamic Republic of Iran in comparison to the other two options.

The region of the Persian Gulf can be seen as a heartland under the geopolitical influence of which the Arab-Iranian relations are shaped. As one the world's primary and most significant source of fossil-energy exports, the Persian Gulf cobbles together the eight countries of the region in a geopolitical panorama, in which they enjoy similarities in economic and strategic life, as well as security concerns. As well, the challenges of maritime political geography seem to be quite dependent on an established set of standards and agreements in order to remain on solid grounds. Currently, these challenges manifest themselves in four major categories, with substantial geopolitical consequences between the Iranians and the Arabs of the region, and the complexity of their relationships. These include: Religious Controversies, which concern the sectarian geopolitics, propagated under Jordan-Israeli concoction of "Shiite Crescent", Territorial Contentions; with its major controversy over the naming of the Persian Gulf. This article examines the process of territorial conflicts, proceedings and eventually the settlements over the maritime areas of the Persian Gulf in the past five decades. The arrangement of the maritime political geography in the Persian Gulf is a fitting example of former disputes over the border and boundaries within the maritime regions of the world.

In light of the persistence of discourses of atrocity in the post-Holocaust era, and with the resurgence of talk of evil that followed 11 September 2001, it is clear that the idea of evil still possesses a powerful hold upon the modern imagination. Yet, the inter-play of evil and the political imagination–in particular, how different images of evil have shaped the discourses and practices of international politics–remains neglected. This article suggests that evil is depicted through three contending images within international politics–evil as individualistic, as statist and as systemic–and their corresponding forms of collective imagination–the juridical, the humanitarian and the political. It argues further that the dominance of the juridical and, to a lesser extent, the humanitarian imagination obscures our ability to imagine and respond to political evils of structural or systemic violence. Drawing on the example of global poverty, this article contends that the ability to portray and critically judge systemic evils in international politics today depends upon enriching our narratives about indefensible atrocities and reimagining our shared political responsibilities for them.

This article seeks to analyse the shift away from the moral certainties of the Cold War epoch and of humanitarian interventions in the 1990s, to suggest that 'evil' plays a very different role in politics and international relations today. In current constructions of the world – as much more global, complex and non-linear – the past certainties of liberal internationalism appear to be a symptom of problematic moral hubris. Rather than the transcendental moral certainties of good and evil, globalization and complexity seem to suggest a more immanent perspective of emergent causality, eliciting a reflexive ethics of continual work on 'good' public modes of being. In which case, 'evil' is no longer considered to be an exception but becomes normalized as an ethical learning resource. The 2011 case of the mass killings by Norwegian Anders Breivik will be highlighted as an example of this process. This article suggests that this 'democratization' of evil is problematic in articulating evil as a revealed or emergent truth in the world that requires social and personal self-reflexivity, thereby suborning moral choice to onto-ethical necessity.

The identification and naming of an 'enemy' is an age-old element within foreign policy and (domestic) security policy discourses. It serves to stabilize speakers' benign conceptions of the self, to structure threat perceptions of 'the world outside' and to legitimate ultimately violent policy options. This article compares the notions of 'rogue' and 'evil' in order to analyse the political implications of such a use of derogative actor categories. The notion of 'rogue states' has played an important role in the security strategies of the US presidents Clinton and in particular George W. Bush and alludes to criminal law. 'Evil' has been a much older, religiously loaded concept and has been invoked in politics for describing the inconceivable, monstrous violence and destruction. While many liberal critics argue that one should abandon the metaphysical category of evil and dispose of the stigmatizing category of the 'rogue', this article concludes with the suggestion that a self-reflexive use of these categories can be instructive: It can make 'us' – the very modern secular liberals – think about ourselves, about responsibility and moral standards as well as about the fundamental ambivalence of our actions.

Liberal discourse should have a hard time looking for 'evil' in international relations. Standing on the pillar of rationalism and humanitarianism, there seems to be little space for the morally and emotionally charged notion of evil to enter considerations. Yet, the liberal belief in the freedom of will implies that humans are capable of turning against the advice of reason and opt for evil behavior and underlying principles. This possibility is epitomized by Kant's construction of the 'evil enemy'. Since 'evil' appears sporadically in international relations, with Hitler's Germany as prototype, its existence in the real world of international relations cannot be ruled out a priori. Designating an 'other' as evil is thus a discursive possibility. The practice to turn this possibility into reality is conceptualized here as 'evilization' in analogy to 'securitization'. There is strong variance among liberal democracies in applying this practice, ranging from 'pacifism' to 'militancy', which often leads to dire consequences. Deriving the principles of fallibility and prudence from liberal reasoning, this article concludes with the proposition that 'liberal pacifism' is the preferable option in most conceivable circumstances, but that the possibility of confronting political evil is rare, but existing.

This article examines how evil has been conceptualised in the discipline of international relations and contributes to a body of critical literature that treats evil as a legitimacy bestowing label. By drawing on securitisation theory, it suggests developing a performative approach to evil as an alternative to descriptive and normative approaches. It is argued that such an approach would not only be valuable for understanding the effects of naming and grading evil, but also fulfils three additional functions. First, it facilitates a shift away from applying intention as the primary measure for determining matters of guilt and condemnation. Second, it challenges the privileged position of the powerful when appointing particular phenomena/adversaries as evil. Finally, it provides an analytical starting point for understanding conflict constellations where different parameters of legitimacy seem to clash. This last function requires particular sensitivity towards the audience and the cultural context of 'evilising' moves.

This article explores how the violence against Afghan civilians carried out by the Taliban and US 'rogue' soldiers has been accounted for as the product of, respectively, collective evil and individual pathology. These two seemingly contending explanations, it is argued, are part of the same strategy of depoliticization, which aims to provide support and legitimacy for the US-led war in Afghanistan. The article discusses how the genealogy of the discourse of collective evil surrounding the Taliban can be traced to an Orientalist political theodicy, which frames the Taliban as 'children of a lesser God' – that is, as fanatical puppets at the mercy of a violent God – and how the discourse of individual pathology surrounding the unsanctioned violence of US soldiers is instrumental to exempt military and civilian leadership from collusion and responsibility. The article challenges this latter narrative of individual blame by discussing how killing, torture and desecration of bodies are at the heart of warfare. Hence, it is concluded, the language of collective evil and individual pathology are part of the same strategy of depoliticization, which aims to silence political contestation and conceal the dehumanizing aspect of war, its structural production of violence, and the complex and dispersed nature of responsibility.

The 1961 Single Convention on Narcotic Drugs is unique among UN conventions for the appearance of the term 'evil' in the document. Among all the possible wrongdoing and bad things that exist in the world, it is slightly counterintuitive that drugs are the only one to be labelled as 'evil' in international law. Adopting a 'conceptual politics' approach, the article will examine how drugs came to be identified in this manner, with a specific focus on the drafting of the 1961 Single Convention. The latter part of the article focuses on the contemporary relevance of this framing, considering how it contributes towards a much more restrictive environment in which serious change to the drug prohibition regime has proven to be a very difficult task. For those seeking reform it is not enough to demonstrate that the system does not work, they also must successfully challenge the idea of drugs as something evil and a threat to humanity. In concluding it is suggested that by returning to the Single Convention, one finds not only the language of 'evil', but also a more flexible position that allowed for revising the way drugs are dealt with. To bring about change in drugs prohibition regime, reformers will need to recover this more open and balanced approach to understanding drugs.

Iran's imminent rise to nuclear power status raises reasonable fears about the Middle East stability. Having examined the discursive exchange of Mutual Assured Evilness (MAE) by Iran and Israel, some political commentators and decision makers express doubts over the workability of nuclear stability. That is because they question whether these countries can overcome their mutual hatred and find the requisite instrumental rationality for nuclear stability. Their fears are exacerbated when they regard Iran as a religious country and hence supposedly incapable of rational behavior. However, the discourse of evil is not only indicative of hatred. Evil it seems is a conceptual relic encased in religious metaphysics. It is a datum that enables us to expose the religious layers that exist alongside secularism. Israel's hyperbolic use of the term evil resonates as strongly as it does because of the religious metaphysics that coexists with Israel's supposedly secular belief system. Therefore, in some ways, Israeli society may be closer to Iranian society than Israelis generally allow themselves to believe and all the while the two societies are locked in a dance of hatred and fear, fueled, among other things, by MAE.

As Charles Tilly famously argued, 'War made the state, and the state made war'. This symbiosis between the state and its ability to wage war has long been synonymous with statehood itself, and what it means to be independent within the international state system. It is an idea that has underpinned realist accounts of international relations and remains widely accepted, despite changing norms and closer dependencies between states. Indeed, in the context of the Scottish independence debate Malcolm Chalmers has argued that: 'Having independent armed forces is at the heart of what it means to be a sovereign country.' This raises the question whether the Scottish government's favoured cooperative approach to defence would undermine Scotland's new-found sovereignty at the very time that it seeks its own independent voice in international affairs.

When NATO heads of state and government convene in Newport, Wales, in September 2014, it will be their first meeting in the UK since the London summit of July 1990. A quarter of a century ago, NATO was reborn. The London Declaration on a Transformed Alliance was NATO's keynote statement of renewed purpose, issued in 1990 as the Cold War was drawing to a close. In it we find the beginnings of the tasks which would come to define the alliance in the post- Cold War period, along with an appreciation of a fundamentally altered strategic landscape. Europe had 'entered a new, promising era', one in which it was thought the continent's tragic cycle of war and peace might well be over. The 2014 summit communiqué is unlikely to reflect such optimism, but what it surely needs to do is to recapture the spirit of enterprise that NATO has on occasion been able to articulate in demanding times.

Counter-poaching operations in South Africa's so-called 'rhino wars' have seen increasing use of kinetic strategies and tactics. It can be argued that this follows the country's historical tendency to react to threats with confrontation in the first instance rather than negotiation, as leaders invoke images of 'backs-to-the-wall' isolation. During the apartheid period the National Party strongly promoted patriotism and self-sacrifice, portraying South Africa as facing 'total onslaught'; today, the rhetoric of 'rhino wars' is often framed in similar terms, not least because the person leading the rhinoceros counter-poaching campaign, Major General Johan Jooste (retired), was himself heavily involved in the 'apartheid wars' in the latter half of the twentieth century.

Conserving biodiversity is a central environmental concern, and conservationists increasingly talk in terms of a 'war' to save species. International campaigns present a specific image: that parks agencies and conservation NGOs are engaged in a continual battle to protect wildlife from armies of highly organized criminal poachers who are financially motivated. The war to save biodiversity is presented as a legitimate war to save critically endangered species such as rhinos, tigers, gorillas and elephants. This is a significant shift in approach since the late 1990s, when community-based natural resource management (CBNRM) and participatory techniques were at their peak. Since the early 2000s there has been a re-evaluation of a renewed interest in fortress conservation models to protect wildlife, including by military means. Yet, as Lunstrum notes, there is a dearth of research on 'green militarization', a process by which military approaches and values are increasingly embedded in conservation practice.

Shortages of food, water and non-renewable energy sources can trigger nefarious activities involving organized criminal networks, transnational corporations and governments at varying political levels. Illegal and excessive fishing, sidestep - ping of regulations on disposal of hazardous waste, water and land theft, fraudulent manipulation of alternative energy subsidies and policies, and transference of toxicity and contaminated products across national borders are driven by a variety of motivations and involve a wide range of actors. Warfare is a uniquely human endeavour, and has been central to human culture and civilization for many thousands of years. Early forms of intergroup conflict were conducted by our hominid ancestors over one million years ago, while the development of larger-scale, organized conflict is recorded by early civilizations in Mesopotamia and China almost 5,000 years ago. The impetuses for warfare, being a complex mix of genetics, psychology, culture, politics, technology and resource availability, are unlikely to disappear in the future, as long as our species survives. Though the nature of warfare is changing, from its most devastating twentieth- century form of industrial 'total' warfare to the geographically and politically complex 'everywhere war' that is beginning to define conflict in the twenty-first century, violent conflict is certain to remain a defining part of the human story.

The Democratic Republic of Congo (DRC) is endowed with a wealth of natural resources, and the presence of high-value minerals such as coltan and diamonds is well known. The country is also endowed with a wealth of biodiversity, although the value of this is often overlooked. The DRC ranks fifth in terms of the most biodiverse countries in the world; it is home to a plethora of endemic species of both flora and fauna and contains the second largest rainforest in the world, smaller only than the Amazon. This range of flora and fauna has suffered enormously from the effects of armed conflict in the country over the past two decades, and many wildlife populations have been decimated. In spite of destruction through conflict, key populations and ecosystems still remain and they are crucial for the country's development and the world's fight against climate change.

On 21 September 2013, fighters from the Harakat Al-Shabaab Mujahideen (Movement of the Warrior Youth) attacked the Westgate Mall in Nairobi, Kenya, killing 67 people and wounding over 200 others. According to Kenya's parliamentary inquiry into the attack, it was conducted by four gunmen (three Somali nationals and a Norwegian citizen of Somali origin), all of whom died in the subsequent four-day siege. The inquiry, by the Joint Committee on Administration and National Security and Defence and Foreign Relations, listed Westgate as the 28th terrorist attack in the country since Kenyan forces intervened in Somalia in October 2011. It concluded that a confluence of factors had left Kenya particularly vulnerable to such attacks: its porous border with Somalia; endemic corruption and poor levels of preparedness among its security officials; youth radicalization (with over 500 Kenyan youths recruited into Al-Shabaab), the proliferation of small arms and light weapons; and the influx of more than 600,000 Somali refugees into Kenya. Overall, the inquiry lamented that despite relevant general information about an impending terror attack on such a target, there had been a 'nationwide systemic failure' on the part of numerous government departments, confusion among government agencies in responding to the attack, and disgraceful looting of premises within the mall by some Kenyan soldiers and police.

The project of international development is in a period of transition. The various dimensions of this transition are relatively clear, the outcome much less so. The first aim of this article is to outline and suggest some explanations for what we take to be the main dimensions of this transition. These are changes in development thinking, particularly with regard to the role of the state; changing donor priorities around 'big' and 'small' development; the changing donor landscape and a new age of choice for developing countries; and changing aid relationships that create greater autonomy for developing countries. We suggest that such changes are linked together in ways that are leading to some quite substantial shifts in the policies and practices of international development. The second aim of this article is to signal some of the important questions and debates that arise when we take notice of these shifts. First, there are explanatory questions related to how we capture the dynamics involved in these areas of change and their relations with one another. Second, there are questions about what the new demands will be for developing country governments and aid donors in this new environment. Third, and related, there are questions about what lessons we might draw from past experiences, in the sense that for some of the ideas and practices we see assuming a new significance in the contemporary period, there are at least parallels in the past. Finally, there are questions about the future trajectory of this transition, where it is taking us, and whether it will be sustained and amplified in the future.

The world was different in 2002 when Henry Kissinger published a book entitled Does America need a foreign policy?, and Le Monde came out in support of the United States after the terrorist attacks of 11 September 2001 by proclaiming: 'We are all American.' In many ways, this was the high point of the American global era—the era of unipolar American power. In 2014 the world has moved on. The United States is still the leading global power with unique capabilities and responsibilities for global leadership. But other states—particularly in Asia and the non-western developing world—are on the rise. The world is more fragmented and decentralized. States are rising and falling. The terms of global governance are more contested and uncertain. This article addresses the foreign policy of Japan and the choices that Japan faces in this shifting global context.

The vulnerable in international society is the latest in a series of books by Ian Clark exploring different aspects of international society, following Legitimacy in international society (OUP, 2005) and Hegemony in international society (OUP, 2011). The two earlier books—along with his co-authored Special responsibilities: global problems and American power (with Mlada Bukovansky, Robyn Eckersley, Christian Reus-Smit and Nicholas Wheeler; CUP, 2012)—are largely concerned with the ways in which international society reproduces itself and manages Great Power relations; The vulnerable in international society shifts the focus towards the other end of the food chain, towards those who are without power. The thesis is that the vulnerable are not simply ill served by international society, by definition insufficiently protected by it, but in a wider sense actually created by international society—the risks they face may sometimes be 'natural', but equally they may actually be a by-product of the way in which international society works. Just as international society confers legitimacy on its members, so it may also create vulnerability. The vulnerable are a socially crafted category and international society is involved in that crafting process, as well as being involved in measures taken to cope with the consequences of this process.

Abstract:
That nuclear negotiations between Iran and the P5+1 (China, France, Russia, the UK, U.S. and Germany) were extended beyond the 20 July 2014 deadline was neither unexpected nor unwelcome. The parties ha d made enough headway to justify the extension, which was envisioned in the Joint Plan of Action (JPOA) that was signed in November 2013 and came into force in January, but given the political and technical complexity, they remain far apart on fundamental issues. Unless they learn the lessons of the last six months and change their approach for the next four, they will lose the opportunity for a resolution not just by the new 24 November deadline but for the foreseeable future. Both sides need to retreat from maximalist positions, particularly on Iran's enrichment program. Tehran should postpone plans for industrial- scale enrichment and accept greater constraints on the number of its centrifuges in return for P5+1 flexibility on the qualitative growth of its enrichment capacity through research and development.

International law emerged as a professional academic specialization in a 19th century European context of wide-ranging public debates about the nature and cultural significance of science. Ever since, the status of international law as an academic discipline has been intimately connected with the capacity of international lawyers to demonstrate that our discipline is properly scientific. Yet the ideals of science upon which international lawyers have drawn in seeking to demonstrate the scientific nature of our work have not remained static. This article explores how those shifting ideals of science have shaped the concerns, questions, methods, and theories adopted by professional legal scholars in different times and places, including the 19th century Cambridge of Whewell, the 20th century Vienna of Kelsen, the post-war New Haven of McDougal and Lasswell, and the globally networked university of the 21st century. In returning to the historical debates out of which today's highly stylized versions of positivist and policy-oriented international law emerged, the article shows that while scholars of international law have shared a commitment to scientific values of rationality, progress, and objectivity, they have understood those commitments as requiring different forms of conduct, different means of producing knowledge, and different relations to the state.

39595. Social Capital in the Arbitration Market

Scholars have often assessed and criticized the group of international arbitration professionals, some characterizing this group as a dense 'white, male' group. Faced with limited access and data, however, this critique has not been informed by a robust empirical component. Relying on all the appointments made in proceedings under ICSID between 1972 and February 2014, interviews with arbitration professionals, and an original database created for this project, this article is the first to assess the social structure of investor–state arbitrators. Using network analytics, a long-standing but recently popularized methodology for understanding social groups, the article maps the group of professionals by relying on formal appointments to tribunals. The subsequent analysis of this form of operationalizing the social group reveals who are the 'grand old men' (and formidable women) or 'power-brokers' that dominate the arbitration profession. The article argues, based on the evidence presented, that, among other factors, in addition to good timing and imperfect information, the structure of the process of appointment, and a risk averse culture, key arbitrators may benefit from heuristic biases, or the limited cognitive scope of lawyers making such appointments.

There is a tendency in international legal discourse to tell the story of international law as a story of progress. 'Progress' is a concept which is tied to the process of secularization and Western 18th and 19th century philosophy. It still inspires the debate on international law – despite all setbacks in 'real history'. This article argues that progress narratives in the inter-national legal discourse are constructed by – more or less subtle – argumentative techniques. It highlights four such techniques – four 'bundles of arguments' – which play a key role: ascending periodization, proving increasing value-orientation of international law, detection of positive trends, and paradigm shift-talk. The article offers an explanation of why the pro-gress argument often succeeds in international legal discourse.

39597. Crafting the Nuclear Regime Complex (1950–1975): Dynamics of Harmonization of Opaque Treaty Rules

In recent years, international lawyers have increasingly debated the normative consequences of the 'fragmentation' of international law. More rarely have they studied empirically how tensions between overlapping systems of rules emerge, how conflicts are harmonized, and with what effects. This article explains such dynamics in the case of the nuclear non-proliferation regime (NPR) complex. Based on original archival fieldwork conducted in the private papers of American and European diplomats in the early Cold War, it shows how Western states solved the tensions that existed between contradictory commitments contracted in the European Atomic Energy Community (Euratom) Treaty and the Nuclear Non-proliferation Treaty in 1968 (NPT). To lessen the tensions between regional and global orders, the Euratom control rules were used as a source of inspiration for the new rules used to monitor compliance with the NPT at the global level. In retrospect, this outcome was puzzling, as the Euratom Treaty was not originally concerned with non-proliferation issues. That the knowledge of the original intentions behind Euratom was lost to the policymakers who negotiated the NPT thus had grave consequences in the future. This case shows the importance of studying the concrete knowledge of international legal rules that gets transmitted across generations of policymakers in order to understand how regime complexity evolves.

39598. The Tower of Babel: Human Rights and the Paradox of Language

Key human rights instruments and leading scholars argue that minority language rights should be treated as human rights, both because language is constitutive of an individual's cultural identity and because linguistic pluralism increases diversity. These treaties and academics assign the value of linguistic pluralism in diversity. But, as this article demonstrates, major human rights courts and quasi-judicial institutions are not, in fact, prepared to force states to swallow the dramatic costs entailed by a true diversity-protecting regime. Outside narrow exceptions or a path dependent national-political compromise, these enforcement bodies continuously allow the state actively to incentivize assimilation into the dominant culture and language of the majority. The minority can still maintain its distinct language, but only at its own cost. The slippage between the promise of rights and their actual interpretation carries some important political and economic benefits, but the resulting legal outcome does not provide the robust protection of diversity to which lip service is paid. Importantly, the assimilationist nature of the jurisprudence is not indifferent to human rights. However, instead of advancing maximal linguistic diversity as a pre-eminent norm, the regime that is applied by judicial bodies supports a different set of human rights: those protecting linguistic minorities from discrimination, and promoting equal access of the group to market and political institutions. The result is a tension between two human rights values: pluralism and equality.

39599. Petitioning the International: A 'Pre-history' of Self-determination

Conventionally, self-determination is understood to have evolved in a linear progression from a political principle during World War I into an international right after World War II. The history of the right to self-determination before 1945 is thus part of 'pre-history'. This article explores that 'pre-history' and finds the conventional linear narrative unconvincing. During the first three decades of the 20th century and in particular during the interwar period, non-Western lawyers, politicians, and activists articulated international law claims to support the demand for self-government. In this process, they appropriated and transformed the international law discourse. Removing the legal obstacles that prevented self-government beyond the West – that is, by eliminating the standard of civilization – interwar semi-peripherals made possible the emergence of a right to self-determination later, when the international political context changed after the second post-war reconstruction of international law.

We deal in EJIL with the world we live in – often with its worst and most violent patholo-gies, often with its most promising signs of hope for a better world. But, inevitably, since our vehicle is scholarship, we reify this world. Roaming Charges is designed not just to offer a moment of aesthetic relief, but to remind us of the ultimate subject of our schol-arly reflections: we alternate between photos of places – the world we live in – and photos of people – who we are, the human condition. We eschew the direct programmatic photo-graph: people shot up; the ravages of pollution and all other manner of photojournalism. 'Roaming', 'Charges', and those irritating 'Roaming Charges' – was chosen because of the multiple and at times conflicting meanings, feelings and associations the words, jointly and severally, evoke and which we hope to capture in our choice of photo-graphs. As we roam around the world we aim for images which charge us: please and challenge, even irritate, at the same time. We seek photos which have some ambiguity, are edgy and relate in an indirect way, both to the current circumstance but also to that which is, like human dignity, permanent and enduring.
