1. The Return of the Foreign Fighters and Their Families to Their Homeland: Existing Practices and Considerations Regarding Security and Human Rights

Abstract:
The creation of Islamic State of Iraq and Syria (ISIS) has attracted an unprecedented flow of thousands of people from more than 100 countries all over the world to join their cause. After the fall of the so-called caliphate, the countries involved have to deal with the aftermath of the conflict and the future threat of the resurgence of ISIS or other terrorist groups. The people who volunteered and joined ISIS might pose a security threat in the future. This paper aims to examine the different approaches that countries have taken regarding the return of foreign fighters (FFs) and their families who joined ISIS to their homeland. This is a multidimensional and complex matter since it has legal, moral, and political implications, and therefore the decisions in this regard are never unanimous, nor do they come without criticism and opposition. On the one hand, it would be easier to just leave the FFs and their families there, prosecute them there and incarcerate them there. It would also be easier to collect evidence and to have testimonies of the witnesses and the survivors, and also it would keep the potential security threat away from their homeland. However, this would only be beneficial for the countries of origin and in the short term as it wouldn‘t solve the problem of radicalization. In fact, it might fuel it even more, and the proximity of the ISIS member in prisons or in camps could benefit them to rebuild their network and plan future attacks. Moreover, leaving them there would be against all human rights norms regarding the death penalty, fair trial, torture, rights of the child, and more. On the other hand, the return of the fighters and their families could indeed pose a danger to the security of the homeland. Not all of the returnees have committed punishable crimes and for those who have, very often there is not enough admissible evidence to the national courts. In fact, in the case of women and children, the countries are more reluctant to their return because they might have not taken part in the atrocities but that does not mean that they are innocent and bear no responsibility. Complicated is also the case of children and teenagers, some of whom have taken part in the atrocities willingly or unwillingly, some were brought by their families, some traveled alone in order to join ISIS, and some were born under ISIS control and risk statelessness.

Syria is home to one of the world’s most complex conflicts. The chaos caused by the Syrian regime and its allies — within Syria, across the Middle East, and beyond — poses immediate and enduring threats. Considering its foreign policy promise to defend democracy and human rights, the Biden administration does not have the luxury of ignoring what happens in Syria. Accepting that there are fewer options for the United States today than there were ten years ago does not mean normalizing the Assad regime or turning a blind eye to Russian and Iranian efforts to tip the balance of power in the region. In a new issue brief from the Atlantic Council’s Syria program, “What Choices Remain for the United States in Syria?,” Nate Rosenblatt and Jomana Qaddour describe the challenges the United States faces in Syria, including Russia’s attempt to expand the UN Strategic Framework as well the struggle to keep the UN humanitarian border crossings open in northern Syria. The memo then lays out the three potential strategies in Syria: one prioritizing the withdrawal of US forces, a second protecting humanitarian access and ensuring progress on limited, critical files, and a third maintaining US support for, as well as coordination with, partners to dial up the pressure on the Syrian government and its allies. The paper ultimately argues that the Biden administration should seize this opportunity to establish a clear strategy in Syria by aligning its defense, development, and diplomatic capabilities with those of its global allies and partners to shape a better outcome in Syria.

Since the fall of Baghuz city in North East of Syria in March 2019, thousands of women, children and former IS fighters have been imprisoned in either camps or prisons. Following the Turkish military operation in October 2019, the security conditions have deteriorated, resulting in fewer guards as well as more instability and vulnerability for all those imprisoned. The worsening living conditions, the absence of adequate medical care and lack of access to education endanger the future of the children imprisoned in the camp. Moreover, the influence of the Muhajirats remains constant as a means for the spreading of propaganda inside and outside the camps.

On Wednesday 9 October 2019, Turkey launched a cross-border operation in Northern Syria. Turkey justified its actions as a response to an ‘imminent terrorist threat’ from Kurdish-led forces. Its operation was directed at pushing back these groups from its border and creating a ‘safe zone’ in Syria where up to two million Syrian refugees can be resettled. On June 17, the long-awaited Caesar Syria Civilian Protection Act came into force, imposing the most comprehensive set of sanctions against Syria’s Assad regime to date. Aimed principally at preventing further war crimes by preventing any foreign investment into the Syrian regime, the sanctions will almost certainly have a consequential impact on Syria’s politics and economy. As the act comes into force, Syria is already beset by a spiraling economic crisis, the effects of which have generated unusually defiant and persistent anti-regime protests in the Druze-majority governorate of Suwayda and rising levels of discontent within regime-held territories. Southern Syria faces an expanding insurgency, ISIS is slowly resurging in the central desert, Turkey is doubling down on a permanent presence in the northwest and for now, U.S. troops appear to be staying. How will the Caesar Act’s sanctions be enforced and with what goals in mind? What effect are they likely to have within today’s context? Does a policy of escalating pressure on the Assad regime promise diplomatic progress or humanitarian suffering?

To win the Cold War, President Ronald Reagan did something for which he is never credited: he dramatically increased the budget of the United States Information Agency, the public diplomacy arm of our struggle against communism. Senegal, in September of 1999, was about to hold a presidential election. Because of USIA's long history of promoting journalism in Senegal, the embassy decided to work in partnership with the local Print, Radio and Television Journalists Federation to hold a series of workshops on the role of journalists in covering elections. USIA was uniquely organized to promote democratic development through the long term support of human rights organizations, journalism, programs that helped build the rule of law, educational programs that encouraged the acceptance of diversity in society and, perhaps most importantly, through partnering with and supporting local opinion leaders to help them promote democratic values that stand in opposition to ideologies hostile to the West.

Abstract:
Along with Turkey’s changing refugee policy from the Eurocentric, secular nation-state ideology to the neo-Ottomanist one on the state level, there also exist main handicaps on the micro power level concerning the successful coordination of the refugee issue with full respect of the human rights. Economic, cultural and especially political factors play a role in the relationship between Syrians and Turkish residents. Fragmentation within the Syrian community living in Turkey is also evident. On the other hand, different from the state policy, Turkish people implicitly show their reluctance towards this migration wave without creating a social turmoil. In this line, it is suggested here that Neo-Ottomanism, as a rising trend, helps a considerable majority of the society to take a moderate stance towards the immigration flux.
