On February 20, the Lebanese cabinet—with a Hizballah-led opposition boycott—extended the term of the UN commission investigating the February 2005 assassination of former prime minister Rafiq Hariri. While the commission's work can now continue for as long as one more year, any future decision about organizing an international tribunal to try those indicted for the murder remains hostage to a vote—requiring the opposition's assent—in the paralyzed Lebanese parliament. Meanwhile, Hizballah continues to press its demand for increased political power within a “national unity” government, threatening civil disobedience should its demands not be met.

As recently as December, Palestinian Authority (PA) president Mahmoud Abbas refused to back a proposal for a unity government offered by Palestinian Legislative Council (PLC) member and head of the Independent Palestine list Mustafa Barghouti. That deal was based on the concept of a technocratic compromise under which Hamas officials would not have held the prime ministership or led any ministries. Yet under the terms of the February 8 Mecca accord, the current prime minister, Hamas's Ismail Haniyeh, will stay on as head of the next government, and the only portfolios Hamas members specifically will not hold are the finance, foreign affairs, and interior ministries, which will be headed by independents acceptable to both sides. The key question then is why Fatah settled for a unity agreement in February that provided it far less gains than previous unity proposals rejected by Abbas.

Abstract:
There are three possibilities for the future of the troubled Hamas-Fatah relationship. The first is the default option, involving perpetual tension with progressively worsening violence—and no decisive victor. Each side mistakenly believes that it can swiftly defeat the other. Hamas believes it can win through continued rearmament and resistance, and that its political message resonates with its constituency. Its own efforts—along with Hizballah's perceived victory in summer 2006—have lent Hamas confidence in its current footing. For its part, Fatah believes it has historical claim to both power and representation, and that its rule of the Palestinian Authority (PA), the Palestine Liberation Organization (PLO), and the governmental security apparatus are ingredients of a decisive victory, regardless of the continuing arms race.

As international pressure on the Iranian government toughens, the Iranian regime is facing more fragmentation at home. In an unprecedented action against a sitting president, 150 of the 290 members of the Iranian Majlis (parliament) signed a letter blaming President Mahmoud Ahmadinezhad for raging inflation and high unemployment, and criticizing his travel to Latin America at a time when he has not sent the Majlis a draft budget for the fiscal year that starts March 21. Under Iranian law, this letter constitutes the first step required if the Majlis wants to remove the president from office.

Tomorrow, around 400,000 Omani men and women are expected to vote in elections for eighty-five seats on the nation\'s Majlis al-Shura, or Consultative Council. Among the conservative Arab states of the Persian Gulf region, Oman -- a key U.S. ally and exporter of oil and gas, strategically positioned opposite Iran -- is often considered to be the most politically progressive, perhaps even evolving slowly toward a constitutional monarchy. But the country remains dominated by its ruler, Sultan Qaboos bin Said, and for now, the council is limited to advice on public services and infrastructure.

The October 20 announcement of Ali Larijani's resignation as Iran's chief nuclear negotiator and secretary of the Supreme National Security Council (SNSC) has intensified pressure on President Mahmoud Ahmadinezhad. Faced with criticism over the resignation, Tehran ensured that Larijani attended the Iran-European Union (EU) nuclear talks in Rome on October 23. His continued presence in the negotiations raises serious questions about who is in charge of Iran's nuclear policy and other key issues, making the regime's intentions even more of an enigma to the Europeans. As EU foreign policy chief Javier Solana stated after the Rome meeting, "I found the same Larijani I had met before, and he had the role of chief negotiator."

On October 21, Kurdistan Workers Party (PKK) operatives carried out an attack from northern Iraq into Turkey, killing twelve Turkish soldiers. This incident followed the killing of more than thirty people in recent weeks, including an incident in which the PKK pulled a dozen civilians off a public bus and shot them. The Turkish public has responded to the attacks by calling for incursion into northern Iraq to eliminate PKK camps there.

On July 31, in a contest widely seen as a tune-up for November's parliamentary balloting, Jordanians went to the polls for municipal elections. Amman had hoped these would showcase Jordan's relatively advanced style of representative democracy in the Middle East. Instead, in a surprise development, the Islamic Action Front (IAF) -- the political party of the Jordanian Muslim Brotherhood -- withdrew hours into the voting, claiming that government-sponsored fraud had "overstepped the bounds." Subsequently, independent and progovernment candidates swept the elections.

Jordanians go to the polls tomorrow to elect nearly 1,000 local representatives and 92 mayors. On their own, these elections are of minimal interest to Washington: municipalities have small budgets, limited responsibilities, and scant independence from the central government. But the voting comes just a month after the Hamas takeover of Gaza, during a spike in the violence in Iraq, and a week after a landslide victory for the Islamist-leaning Justice and Development Party (AKP) in the Turkish national elections. Adding to the significance of the Jordanian ballot is the fact that, after boycotting the 2003 contest, the Jordanian Muslim Brotherhood's political party, the Islamic Action Front (IAF), will participate in this year's elections. A potential IAF victory highlights growing concern that Islamists are on a political roll throughout the Middle East, and that Jordan may be vulnerable.

Reports that Ayatollah Ali Meshkini has either died or is on the brink of death shed light on the nature of power in Iran. Meshkini is speaker of the Assembly of Experts -- a body that, despite its traditionally minor role in Iranian politics, is constitutionally empowered to not only elect a new Supreme Leader if the post becomes vacant, but also to dismiss a sitting leader. Current Supreme Leader Ali Khamenei cannot be pleased that this body may now be headed by deputy speaker Ali Akbar Rafsanjani, a former president known to be a wily comeback artist. Although Khamenei has taken full advantage of the constitution to make the Supreme Leader the ultimate arbiter of Iranian politics, that could change depending on his health and Rafsanjani's scheming.

Iran's recent detention of 15 British sailors and marines, captured in the contested waters of the Shatt al-Arab near the Iranian coast, has exacerbated tensions between the United States and Iran. This paper aims to analyse the basic parameters of the new draft constitution in Turkey. Having outlined the radical amendments to the current Constitution in terms of both fundamental rights and state organs, the paper takes up the procedural and substantial criticisms directed against the draft Constitution. It also contains a number of policy recommendations for taking necessary measures to ensure the broadest possible participation of the Turkish people in the constitution making process. The paper concludes that adoption of the proposed constitution will remove the physcological obstacle to democratisation of the Turkish political regime by disproving the deeply embedded belief that civilians in Turkey cannot make a new constitution under truly democratic circumstances.

By electing a parliament dominated by Hamas, Palestinians have sharply challenged U.S. policy. The initial American reaction—undermining the new government—will leave the population in chaos, with various Palestinian groups vying for influence. Political constraints preclude anything but a Hamas government in the short term. But the Hamas victory should not be viewed as a defeat for the American vision of reform—which, indeed, may offer a path out of the current deadlock. The United States should develop a policy for the longer term to continue calming the Israeli- Palestinian conflict; maintain the Palestinian Authority; and work for political reform by focusing on the judiciary, media, and other institutions that are independent of the current regime.

In today's Arab world, Islamists have assumed the role once played by national liberation movements and leftist parties. They are the mass movements of the twenty-first century. They are well embedded in the social fabric, understand the importance of good organization, and are thus able to mobilize considerable constituencies. Their ideology prescribes a simple solution to the persistent crises of contemporary Arab societies—a return to the fundamentals, or true spirit, of Islam. Indeed, “Islam is the solution” has been the longtime slogan of Egypt's Muslim Brotherhood. Like all successful movements, Islamists have been able to distill a long, complex philosophical tradition into simple slogans that have quickly supplanted the Pan-Arabism and socialism that dominated the region until the 1970s. As a result, in most countries Islamists represent the only viable opposition forces to existing undemocratic regimes.

224. Weak Viability: The Iraqi Federal State and the Constitutional Amendment Process

The cycle of violence in Iraq is, in part, constitutional: it derives from competing visions of the Iraqi state that have not been reconciled. An amendment to Iraq's constitution to delay the creation of new federal regions, together with a package of legislation and intergovernmental agreements on oil, division of governmental power between Baghdad and the regions, and the judiciary, may be enough to slow or even arrest this decline in the security situation, and may be achievable. A “government of national unity,” though desirable, will not by itself be able to generate the necessary constitutional consensus. Iraq's new legislature, the Council of Representatives, is now considering the process of constitutional amendment described in Article 142 of the constitution. Prime Minister Nouri al-Maliki has announced the constitutional review as part of his government's platform. This amendment process, assuming it proceeds, will come in the wake of widespread opposition to the constitution from Sunni Arab Iraqis in the October 2005 referendum. It is expected that a Constitution Review Committee (CRC) will soon be appointed, in line with Article 142. To the extent that it was opposed by Sunni Arabs, the constitution lacks the essential criterion of any constitution: the consent of all major national communities. The 2005 Iraqi constitution may nonetheless, as a legal text, be a sufficient and necessary framework for the radically regionalized Iraqi polity which the constitution drafters envisaged. The constitutional challenge in Iraq is first about peacemaking, not state building. As the Iraqi parliament faces the challenge of appointing, mandating and staffing a CRC, the first, and essential, set of questions is therefore political: How can the amendment process be used as a vehicle to remedy the political failure of last year's constitution drafting process? How can consensus be built, and in particular how can Iraq's Sunni Arabs be encouraged to give their assent to the new federal Iraq? How can Iraq's Kurdish and Shia leaders be encouraged to make worthwhile constitutional concessions to Sunni Arab positions so as to elicit that consent? The second set of questions is legal: What are the minimum constitutional amendments needed, if any, to ensure that Iraq is a viable, if not a strong, state? To the extent that the Sunni Arab position has been one that purports to defend the Iraqi state, legal or technical improvements to the text that support Baghdad's ability to govern may draw support from Sunni Arabs, thereby generating clear political benefits. There are additional legal questions that, though not strictly related to the Sunni Arab problem, are pressing: in particular, What are the minimum constitutional amendments needed, if any, to ensure that the human rights of all Iraqis receive adequate protection? It is not only the Sunni Arabs who feel disenfranchised by the constitution; nationalists, some women's groups, and groups representing Iraq's minorities express similar views. It will be very difficult to pass constitutional amendments of any sort, especially those that seek to shift power from Iraq's regions to the central government. Regional interests have the upper hand, constitutionally and politically. There is no reason to expect that the constitution's Kurdish and Shia authors will see the need for constitutional amendments to the text that they themselves deliberately, if hastily, constructed. The referendum procedure for amendment is onerous, with a three-governorate veto power. High expectations of the amendment procedure will lead to disappointment and may amplify, rather than reduce, violence. For this reason, legal instruments other than constitutional amendments must be considered as ways to remedy the political and legal deficiencies of the constitution. A CRC should be established, with strong Sunni Arab membership. Given the pressing and complex nature of the necessary constitutional deal, the CRC should be mandated to make recommendations, where appropriate, not only for constitutional amendments, but also for (1) legislation, (2) intergovernmental agreements and, where appropriate (3) interparty agreements and (4) international agreements, all of which might encourage Sunni Arab political commitment to the Iraqi constitution and ensure viability for the Iraqi state. A three-part formula, concerning the creation of new regions, oil, and the delineation of powers between the central government and the regions, offers a way forward for the CRC to heal the wounds caused by the deficiencies in the 2005 drafting process. That formula would not require the Kurdistan party or the hitherto most influential Shia party, the Supreme Council for the Islamic Revolution in Iraq (SCIRI), to make major modifications to their constitutional positions.

Palestinian president Mahmoud Abbas's pursuit of a referendum on the Palestinian National Accord has been widely interpreted by commentators and reporters as a power play designed to circumvent the Hamas-led government and force it to implicitly accept Israel's existence. But while the process of conducting a referendum -- the legality of which remains questionable -- would shift power away from the government and the legislature, the actual text of the document, which a group of Palestinian prisoners in Israeli jails negotiated, more closely resembles the political program of Hamas than that of Abbas. Moreover, Hamas has recovered from its initial surprise at the referendum initiative and has mounted an effective response, first by challenging the legality of a referendum, then by dragging Abbas into negotiations over the substance of the Accord. Despite a possible compromise that may emerge in coming days and shift the composition of the government or modify the language of the Accord, Hamas has used the internal Palestinian debate over a referendum to secure its internal legitimacy and advance many of its governing priorities.

On April 18, the Jordanian government announced it had discovered a cache of weapons -- including rockets, C-4 explosives, and small arms -- in a northern Jordanian town. Jordanian authorities said the weapons belonged to Hamas and had entered Jordan from Syria. Subsequently, Jordan arrested ten Hamas militants and cancelled a scheduled visit by Palestinian Authority (PA) foreign minister Mahmoud al-Zahar, a Hamas leader. While the discovery of these weapons underscores Hamas's continuing efforts to prepare for terrorist acts even while it proclaims a tahdiya (period of calm), it also has important implications for internal Jordanian politics and the rising influence of Jordan's own Islamist movement.

On April 7, the State Department announced its plan for restructuring aid to the Palestinians in response to the formation of a government led by Hamas, which has refused Quartet demands to recognize Israel, cease violence and terror, and accept past diplomatic agreements. In order to target assistance toward the Palestinian people rather than the Hamas leadership, the United States will now provide the vast majority of its aid (some $203 million) for humanitarian needs, including food, health, and education programs primarily administered by United Nations agencies such as the UN Relief and Works Agency (UNRWA), the UN Children's Fund (UNICEF), and the UN World Food Program. An additional $42 million is allocated for "securing and expanding democracy," in an effort that "protects and promotes moderation and democratic alternatives to Hamas." Assisting the development of such a peaceful and democratic alternative -- as distinct from an immediate overthrow of Hamas -- will require the United States to support programs driven internally by Palestinians that can foster a broad-based political movement. Bolstering a centralized Fatah-like organization run by elites will only lead to further corruption and the continued alienation of the Palestinian public.

237. Bad Riddance: The Dangers of Deportation as a Counterterror Policy

Sami al-Arians plea agreement, unsealed last week in Tampa, Florida, has been almost universally billed as a domestic counterterrorism victory. Al-Arian pleaded guilty to providing financial and material support to Palestinian Islamic Jihad, a U.S. specially designated terrorist group, and agreed to be deported. He is one of a small but important number of U.S. deportees (out of approximately 200,000 annually) who have connections to international terrorism.Many in the United States will say good riddance to people like al-Arian, a sentiment shared by a substantial portion of Europeans whose governments are increasing their own efforts to send terrorist suspects back to their countries of origin. Since the July 7 London transit bombings, Britain has signed deportation agreements with Jordan, Libya, and Lebanon, and is negotiating a similar one with Algeria. Spain, Germany, Italy, and the Netherlands have all recently introduced or passed legislation that will facilitate deportation on national security grounds, while the French for their part wonder why other Western democracies have been so slow to catch on. France has been deporting terrorist suspects and other extremists for more than a decade, including more than a dozen radical imams in 2005 alone. American and European deportation policies differ in key areas. U.S. policy is aimed at lawbreakers generally, whereas Europe, because of its more ingrained challenge of domestic radicalism, targets extremist imams and other purveyors of jihadist ideology who can have a pervasive radicalizing effect on a community. Nevertheless, the same rationale underpins deportation on both sides of the Atlantic, and enthusiasm for the policy seems almost universal. Sending problem immigrants back to their native countries allows Western governments to deal with extremists outside the framework of domestic legal codes that remain woefully ill-equipped to address the threat of terrorism. Deportation minimizes the need to adopt draconian measures such as indefinite detention. It is counterterrorism on the cheap, and has become the policy of first choice for domestic law enforcement agencies that lack the personnel and resources to conduct adequate surveillance on all potential terrorists. But although deportation of terrorist suspects may be the most appealing of several bad policy options, it is by no means a perfect solution. Deportation is designed to displace the threat, but it may ultimately create a host of other challenges for the West in Muslim countries and ultimately on its own territory.

240. The Shape of Israel's Election Race

In a surprise move prior to Israel's March 28 election, Acting Prime Minister Ehud Olmert unveiled a proposal that Israeli settlers be consolidated into West Bank settlement blocs largely adjacent to the Green Line. A week after the announcement, Israeli public reaction suggests his gamble seems to have paid off. According to a Yediot Ahronot poll released on March 17, Israelis favor Olmert's unilateralist proposal by a margin of 52 percent to 45 percent. Moreover, Olmert's poll standing was not negatively impacted by the proposal, despite the fact that it could mean the removal of an estimated 60,000 settlers from dozens of settlements scattered across the larger part of the West Bank outside Israel's security barrier. (Inside the Israeli security barrier, there are approximately 193,000 settlers, mostly in blocs, in the 8 percent of the West Bank largely adjacent to the pre-1967 boundaries. By comparison, President Clinton's final proposal in 2000 involved Israel keeping 5 percent of the land.) An Olmert security advisor and former Shin Bet head, Avi Dichter, says the Israel Defense Forces (IDF) will not be withdrawn from the West Bank. Olmert was able to use his commanding lead to answer critics who say that the new party leader lacks Ariel Sharon's track record and therefore the authority to ask the public to trust his decisions. In the March 17 poll, Olmert's Kadima stood to win 39 seats in the 120-seat Knesset; Labor was polling at 19 seats and Likud, 15 seats. Olmert's standing was undoubtedly assisted by Israel's March 15 operation to seize from a Jericho prison the assassins of Israeli cabinet minister Rehavam Zeevi. Olmert hopes the operation will burnish his security credentials and undercut Netanyahu's argument that he is uniquely tough enough to challenge Hamas. (Olmert needs to be concerned about the 22 percent of Israelis who are undecided—the equivalent of twenty-five Knesset seats.)

As Israelis assess the implications of Hamas's victory in January elections to the Palestinian Legislative Council, a new threat may be developing in Lebanon. Al-Qaeda–linked terrorists have been present in Lebanon for a decade, but recent statements by Ayman al-Zawahiri and Abu Musab al-Zarqawi suggest that the dual objectives of destabilizing Arab regimes and targeting Israel proper are becoming top al-Qaeda priorities. Al-Zarqawi–linked terrorists in Lebanon have already engaged in low-level targeting of Israeli and Lebanese interests, yet several obstacles may hinder their ability to launch significant attacks in or from Lebanon. The Lebanese government, although weak, has a clear interest in preventing both internally and externally directed al-Qaeda activity. The dynamic among Hizballah, the Palestinians, and al-Qaeda remains more ambiguous, but early signs suggest potential antagonism among the groups. Together, Israel and the United States may be able to help Lebanon contain this emerging threat.

At a time when attention is focused on the problems democracy has brought in one part of the Middle East, such as the Palestinian territories, it has been easy to overlook how democratic processes were key to resolving a crisis in another Middle Eastern country: Kuwait. The January 15 death of Kuwait's emir, or ruler, Sheikh Jaber brought to power the physically and mentally incapacitated Sheikh Saad al-Abdullah al-Sabah. But the crisis engendered by his ill health and his refusal to abdicate was resolved quickly through democratic processes. On January 24, the parliament of the oil-rich Persian Gulf state of Kuwait exercised a previously unused constitutional power and voted to oust Sheikh Saad. The new emir, Sheikh Sabah al-Ahmed al-Sabah, is expected to be confirmed by parliament on January 29, and is now under pressure from some members of parliament to choose a prime minister from outside the ranks of the ruling al-Sabah family.

The ongoing popular challenge to the pro-Western Lebanese government of Prime Minister Fouad Siniora marks yet another setback in the Bush administration's attempt to impose a new order on the Middle East more compatible with perceived U.S. strategic interests. The success of the nonviolent people power movement against Syria's overbearing role in Lebanese politics during the spring of 2005dubbed the Cedar Revolutionwas an impressive triumph of popular democratic forces, forcing the withdrawal of Syrian forces and enabling the country to proceed with parliamentary elections without Syrian interference. However, despite claims by the Bush administration to the contrary, the electionswhich, like all Lebanese elections, took place under the country's colonially-imposed confessional representation systemdid not constitute a victory for reformers. Instead, the victors were primarily a group of corrupt pro-Western elite politicians from the same traditional political families who have ruled the country since independence. Their credibility among the Lebanese people was reduced further this summer when the United States rejected their pleas to use its considerable influence to stop Israel's brutal 35-day military assault against their country which took the lives of more than 1,000 civilians and caused billions of dollars of damage to the country's civilian infrastructure.

Whether it will lead to a catastrophic descent into greater violence or even ethnic cleansing, or to a managed transformation into a loose federation of regions enjoying extreme autonomy, depends on whether it becomes possible for Sunni Arabs to form their own region, as Kurds already have and Shias are bound to do once the constitution is in effect. The central thrust of U.S. policy in Iraq must now be to help Sunnis organize an autonomous region and to convince Shias and Kurds that it is in their interest to make this possible. Paradoxically, announcing now a timetable for the inevitable withdrawal of U.S. troops from Iraq could give Washington additional leverage in influencing all sides to accept the necessary compromises.

From Saudi Arabia's establishment in 1932, its minority Shiite population has been subject to discrimination and sectarian incitement. Beginning in the early 1990s, with then Crown Prince Abdullah's active support, the government took steps to improve inter-sectarian relations. But the measures were modest, and tensions are rising. The surprise election of Mahmoud Ahmadi-Nejad, who is being sworn in as president this week, has given rise to dire predictions about Iran's domestic and foreign policies and relations with the U.S. and the European Union. There are reasons for concern. Based on his rhetoric, past performance, and the company he keeps, Ahmadi-Nejad appears a throwback to the revolution's early days: more ideological, less pragmatic, and anti- American. But for the West, and the U.S. in particular, to reach and act upon hasty conclusions would be wrong. Iran is governed by complex institutions and competing power centres that inherently favour continuity over change. More importantly , none of the fundamentals has changed: the regime is not about to collapse; it holds pivotal cards on Iraq and nuclear proliferation; and any chance of modifying its behaviour will come, if at all, through serious, coordinated EU and U.S. efforts to engage it.

The July 16–18 visit to Tehran by Iraqi prime minister Ibrahim Jafari and ten other members of his council of ministers has been hailed by some as the beginning of a new era in Iran-Iraq relations. In fact, the pattern of near-term relations was set during Iraqi defense minister Saadoun al-Dulaimi's preparatory visit to Iran on July 5–7. At a joint press conference on July 7 with his Iranian counterpart, Rear Admiral Ali Shamkhani, the Iraqi official fell victim to the oldest trick in the Iranian diplomatic playbook. Speaking well beyond what had been agreed by the two sides, Shamkhani announced “wide defense cooperation” and alluded to the imminent conclusion of a defense pact between the two countries (as Iran has done in the past with Bahrain, Kuwait, Oman, and Saudi Arabia). Al-Dulaimi was likewise forced to clarify the limited nature of the discussions while also taking pains to state, “Iraq will not be a source of insecurity and instability for any of its neighbors. Nobody can use [Iraqi territory] to attack its neighbors.” The message to both Tehran and Washington was clear: the three-way game between the governments of Iran, Iraq, and the United States has begun again. With Iraq caught in the middle, Baghdad intends to play an increasingly autonomous role as the game unfolds.

Ten years ago today, the Israeli prime minister, Yitzhak Rabin, was assassinated. This was one of the darkest days in the history of the State of Israel, the Israeli democracy, and the Jewish people. Prime Minister Rabin, who had also previously served as the IDF's chief of the General Staff, was born in Jerusalem in1922—perhaps symbolically, during the days of the first significant Arab murderous attacks against there established Israeli settlements in the land of Israel. In January 1964, Yitzhak Rabin was promoted to the rank of lieutenant general, becoming the seventh IDF chief of the General Staff. After war broke out in 1967, General Rabin led the IDF to the decisive victory in the Six Day War and, on December 31, 1967, stepped down from his command with Israel enjoying, for the first time since its establishment, defensible borders.

Instead, the October 20 joint press conference at the White House concluded with Bush acknowledging that his presidency may not witness the creation of a Palestinian state by 2008. His administration, Bush said, might merely “lay that foundation so that the process becomes irreversible.” The same administration that two years ago endorsed the Quartet's Roadmap to Israeli-Palestinian peace based upon a detailed schedule of commitments now expresses hesitancy on committing to any “timetable” for the creation of a Palestinian state. Bush administration policy has always had a performance-based rather than a time-based approach, but now it is not putting down any time markers.

On 14 February 2005, an explosion in downtown Beirut killed twenty persons, among them the former Prime Minister, Rafik Hariri. The United Nations' Secretary-General dispatched a Fact-Finding Mission to Beirut to inquire into the causes, the circumstances and the consequences of this assassination. Since it arrived in Beirut on 25 February, the Mission met with a large number of Lebanese officials and representatives of different political groups, performed a thorough review of the Lebanese investigation and legal proceedings, examined the crime scene and the evidence collected by the local police, collected and analyzed samples from the crime scene, and interviewed some witnesses in relation to the crime. The specific 'causes' for the assassination of Mr. Hariri cannot be reliably asserted until after the perpetrators of this crime are brought to justice. However, it is clear that the assassination took place in a political and security context marked by an acute polarization around the Syrian influence in Lebanon and a failure of the Lebanese State to provide adequate protection for its citizens. Regarding the circumstances, the Mission is of the view that the explosion was caused by a TNT charge of about 1000 KG placed most likely above the ground. The review of the investigation indicates that there was a distinct lack of commitment on the part of the Lebanese authorities to investigate the crime effectively, and that this investigation was not carried out in accordance with acceptable international standards. The Mission is also of the view that the Lebanese investigation lacks the confidence of the population necessary for its results to be accepted. The consequences of the assassination could be far-reaching. It seems to have unlocked the gates of political upheavals that were simmering throughout the last year. Accusations and counter-accusations are rife and aggravate the ongoing political polarization. Some accuse the Syrian security services and leadership of assassinating Mr. Hariri because he became an insurmountable obstacle to their influence in Lebanon. Syrian supporters maintain that he was assassinated by "the enemies of Syria"; those who wanted to create international pressure on the Syrian leadership in order to accelerate the demise of its influence in Lebanon and/or start a chain of reactions that would eventually force a 'regime change' inside Syria itself. Lebanese politicians from different backgrounds expressed to the Mission their fear that Lebanon could be caught in a possible showdown between Syria and the international community, with devastating consequences for Lebanese peace and security. After gathering the available facts, the Mission concluded that the Lebanese security services and the Syrian Military Intelligence bear the primary responsibility for the lack of security, protection, law and order in Lebanon. The Lebanese security services have demonstrated serious and systematic negligence in carrying out the duties usually performed by a professional national security apparatus. In doing so, they have severely failed to provide the citizens of Lebanon with an acceptable level of security and, therefore, have contributed to the propagation of a culture of intimidation and impunity. The Syrian Military Intelligence shares this responsibility to the extent of its involvement in running the security services in Lebanon. It is also the Mission's conclusion that the Government of Syria bears primary responsibility for the political tension that preceded the assassination of former Prime Minister Mr. Hariri. The Government of Syria clearly exerted influence that goes beyond the reasonable exercise of cooperative or neighborly relations. It interfered with the details of governance in Lebanon in a heavy-handed and inflexible manner that was the primary reason for the political polarization that ensued. Without prejudice to the results of the investigation, it is obvious that this atmosphere provided the backdrop for the assassination of Mr. Hariri. It became clear to the Mission that the Lebanese investigation process suffers from serious flaws and has neither the capacity nor the commitment to reach a satisfactory and credible conclusion. To find the truth, it would be necessary to entrust the investigation to an international independent commission, comprising the different fields of expertise that are usually involved in carrying out similarly large investigations in national systems, with the necessary executive authority to carry out interrogations, searches, and other relevant tasks. Furthermore, it is more than doubtful that such an international commission could carry out its tasks satisfactorily - and receives the necessary active cooperation from local authorities - while the current leadership of the Lebanese security services remains in office. It is the Mission's conclusion that the restoration of the integrity and credibility of the Lebanese security apparatus is of vital importance to the security and stability of the country. A sustained effort to restructure, reform and retrain the Lebanese security services will be necessary to achieve this end, and will certainly require assistance and active engagement on the part of the international community. Finally, it is the Mission's view that international and regional political support will be necessary to safeguard Lebanon's national unity and to shield its fragile polity from unwarranted pressure. Improving the prospects of peace and security in the region would offer a more solid ground for restoring normalcy in Lebanon.

Arafat may have suffered a lingering physical demise, but politically he has long been in decline. He lost much of his international credibility over his unwillingness to rein in Palestinian terrorism against Israel, and domestically his authority had gradually been eroded. While lacking an anointed heir, a succession plan is more or less in place. Political infighting is a possibility, though a desire for unity will probably prevail in the short term. But Arafat's successors will struggle to end the chaos and lawlessness into which the West Bank and the Gaza Strip have descended. Over the longer term Arafat's passing will remove the main obstacle to internal Palestinian reform. It has the potential to re-invigorate the peace process although it will not solve the fundamentals of the current impasse. It will also complicate Israeli Prime Minister Ariel Sharon's plans for a unilateral withdrawal from Gaza and parts of the West Bank, even if his instinct will be to press ahead.

Interpretation of the last variable is problematic: It could point to some antidemocratic aspect of Arab culture (though this appears not to be supported by survey evidence), or it could be a proxy for some unobservable such as investment in institutions of internal repression that may not be culturally determined and instead reflect elite preferences. Hypotheses that did not receive robust support include the presence of oil rents, the status of women, conflict with Israel or other neighbors, or Islam. The odds on liberalizing transitions occurring are low but rising. In this respect the distinction between the interpretation of the Arab ethnic share as an intrinsic cultural marker and as a proxy for some unobservable is important-if the former is correct, then one would expect the likelihood of regime change to rise only gradually over time, whereas if it is the latter, the probabilities may exhibit much greater temporal variability.

Two models may be draw up of coalitions of the willing. The first model is epitomized by the group of countries assembled by the United States for the mobilization of the 2003 Iraq war. The second model is the form of coalition associated with the anti-personnel landmines campaign and the initiative on the International Criminal Court in the mid to late 1990s. This paper will explore the relationship between these different types of coalitions. The former type is characterized by a top-down, state-centric, and coerced/opportunistic strategic form. The latter type by way of contrast takes a bottom-up, voluntary, mixed actor, diplomatic approach. Yet, along side these differences are some striking, but unanticipated similarities. Most dramatically, both types have been assembled on an intense stylistic basis with an eye to avoiding the frustrations associated with working via established institutions. By looking more closely at the external expression and inner workings of these modes of activity, the model of coalitions of the willing is stretched out in terms of their motivations, sense of ownership, and future trajectory.

The election of the hard-line Teheran mayor, Mahmoud Ahmadinejad, over former President Ayatollah Hashemi Rafsanjani as the new head of Iran is undeniably a setback for those hoping to advance greater social and political freedom in that country. It should not necessarily be seen as a turn to the right by the Iranian electorate, however. The 70-year old Rafsanjani — a cleric and penultimate wheeler-dealer from the political establishment — was portrayed as the more moderate conservative. The fact that he had become a millionaire while in government was apparently seen as less important than his modest reform agenda. By contrast, the young Teheran mayor focused on the plight of the poor and cleaning up corruption.

Cyprus is one of the key issues in Turkish Foreign Policy today, probably even more so than it has ever been. A peaceful settlement that optimizes the needs and minimizes the concerns of both the Turkish Cypriot and Greek Cypriot sides is of utmost significance and urgency. A settlement is needed not only to enable Turkey to continue its path towards European accession, but also in order to establish and perpetuate a peaceful coexistence between the two communities on the island. The suspension of efforts to solve the Cyprus issue after the referendum on April 24, 2004, could pave the way for unwelcome developments in Turkey, the EU and in the region as a whole. Therefore TESEV see it as their mission to alert policy makers, opinion leaders and diplomats of the urgency of the issue. As has been stated previously on different occasions, TESEV has three major areas of activity: Democratization, Good Governance and Foreign Policy. There has been a dynamic wave of political, economic, judicial and legal reforms in Turkey vis-à-vis her prospective membership of the European Union. Internal dynamics for democratization, local governance, fiscal policies, transparency and judicial reform and new perspectives in foreign policy have been subjects of concern in this process. These subjects are also the determinants of TESEV’s major program axes. The Foreign Policy Program, one of TESEV’s three main program areas, has been dealing with the Cyprus issue at both governmental and non-governmental levels, with specific reference to the Annan Plan. We support the Annan Plan as the basis for a viable solution. This monograph provides a historical account of the problem and settlement efforts, elaborates the Annan Plan and provides some suggestions for the way forward.

In its National Strategy for Victory in Iraq the Bush administration recognizes that the key to defusing the insurgency is drawing the Sunni Arab community into the political process. And it correctly sees that this requires "inclusive institutions that offer power-sharing mechanisms and minority protections." As the strategy notes: such institutions would "demonstrate to disaffected Sunnis that they have influence and the ability to protect their interests in a democratic Iraq." Unfortunately, the administration finds it difficult to apply this precept where it would matter most: in the election process.

President Bush was correct when he asserted on 2 December 2004 that it was "time for the Iraqi citizens to go to the polls." Indeed, it is long past time. Elections should have occurred a year or so after the fall of the Hussein regime. But the fact that they are overdue does not mean that an adequate foundation for meaningfully democratic elections has been laid. It has not. Unfortunately, the balloting due to take place on 30 January will not fulfill the promise of democracy nor satisfy the Iraqi passion for selfdetermination. For these reasons, it cannot bring peace. It is more likely to exacerbate civil strife.

THE CENTRAL DILEMMA OF DEMOCRATIC reform in Arab countries can be summed up fairly simply. Presidents and kings remain too powerful, untrammeled by the limits imposed by effective parliaments and independent judiciaries. Countervailing institutions remain weak, if they exist at all, not only because constitutions and laws deliberately keep them that way, but also because they are not backed by organized citizens demanding political rights, participation, and government accountability. This does not mean that there is no desire for democracy on the part of Arab publics. Recent opinion surveys suggest that in the abstract there is strong support for more open political systems, increased protection of human rights, and broader personal liberties. However, the existence of a general, diffuse sense that democracy is a good thing is quite different from the existence of organized constituencies that provide a counterweight to the authoritarianism of incumbent governments. The demand, or better the desire, for democracy is present in the Arab world today; what is lacking is a supply of broad-based political organizations pushing for democracy—political parties, social movements, labor unions, large civic organizations. Unless such constituencies develop, the future of democracy remains extremely uncertain. In many countries, governments anxious to burnish their modern image will continue to introduce modest reforms. Until the governments face stronger pressure from organized citizens, however, they will not take steps to truly curb the power of the executive by strengthening checks and balances and allowing unfettered political participation.

Muqtada al-Sadr represents a serious long-term political and military challenge to the coalition and the new Iraqi government. Open warfare between Sadr and the coalition first emerged on April 4, 2004, with "uprisings" by his militia, the so-called Mahdi Army, in Baghdad and across southern Iraq. Although Sadr has not achieved his objective of a broad-based Shi'i rebellion, coalition forces have not been able to bring him to justice or dissolve his militia. Both sides are now playing a high-stakes game. The coalition is betting that it can eliminate or reduce Sadr as a political force without causing a serious breach with the larger Shi'i community. Sadr is gambling that he can persist, even prosper, in the face of the coalition. Indeed, he has long-term political goals and is positioning himself for the upcoming elections. The prospects that the coalition can bring him under control at acceptable cost and risk remain uncertain.

295. Radical Departure: Toward A Practical Peace in Iraq

The key to enabling total US troop withdrawal from Iraq within 400 days is achieving a political accord with Sunni leaders at all levels and with Iraq's neighbors - especially Syria and Iran. The proximal aim would be to immediately lower the level of conflict inside Iraq by constricting both active and passive support for the insurgency, inside and outside the country. This would allow the United States to shift resources to the training mission and to adopt other de-escalatory measures - most importantly: a withdrawal time line. The strategic price of this diplomatic initiative would be a return to self-governance in Sunni areas, a guaranteed level of representation for these areas in the national assembly, an end to broad-brush measures of de-Baathification, an amnesty for most indigenous insurgents and for most former Baathists, and a de-escalation of the US confrontation with Syria and Iran regarding a range of issues. In conjunction with these diplomatic initiatives, the United States would announce a tentative time line for withdrawal of its troops from Iraq -- associated with training milestones. Also: US forces would end major offensive sweeps inside the country, adopt a defensive posture, and shift the emphasis of their activity to training Iraqi security forces. Finally: the Iraqi government would re-activate portions of the old army -- partly as a confidence-building measure, but also in order to (i) rob insurgent organizations of their recruiting base, (ii) augment the power of the new Iraqi security forces, and (iii) produce a better ethnic balance in the new forces (which are currently dominated by Kurds and Shiites). As new forces increase in capacity, US forces would be removed, further reducing a stimulus of insurgent action. Four hundred days - 57 weeks - is sufficient time to complete several Iraqi training cycles, including field exercises for many units at the battalion and brigade levels. Some division level training also can occur. Given sufficient resources (24,000 training personnel), 100,000 Iraqi security personnel can receive remedial training and another 80,000 new personnel can be trained and exercised during this period. Together with the full provision of all appropriate equipment, this development effort can yield Iraqi security forces that are several times more capable than those it controls in mid-2005. After thirteen months, the only foreign military assets remaining in Iraq would be a small monitoring and training mission with a security detail: less than 10,000 foreign civilian and military personnel in all. US troops should constitute no more than one-third of the military component -- that is, approximately 2,000 troops. This mission should be conducted under a three-year UN mandate and joint NATO-international command. In addition, the United States might maintain a 25,000-person rapid reaction task force in the region, but outside either Iraq or Saudi Arabia.

No American administration has talked more about democracy in the Middle East than the Bush administration. The president and his advisors have spoken optimistically about a post-Saddam democracy in Iraq, one that might eventually become a veritable light to other Arab nations. This grand vision assumes that sooner or later, advocates of democracy throughout the Middle East will demand the same freedoms and rights that Iraqis are now claiming. Yet, however inspiring this vision appears, the actual reform plan that the administration has thus far set out is unlikely to produce radical changes in the Arab world. Regardless of how dramatic the change in Baghdad is, when it comes to our friends in Egypt, Jordan, Kuwait, Morocco, and Yemen, the administration's reform plan points to evolution rather than revolution.

With Saudi Arabian, Turkish, and Jordanian host-nation restrictions limiting coalition ground and air operations, the United States has begun to develop a range of Iraqi airfields as forward operating bases for combat aircraft. This is ironic considering that successive U.S. governments spent billions of dollars to develop an unparalleled basing environment to support U.S. power projection in the Gulf. Recent decisions by Saudi Arabia and Turkey -- key U.S. allies -- have arguably prevented Washington from waging a shorter and less costly war in terms of both blood and treasure. Yet, the United States has benefited greatly from its policy of diversifying basing assets in the smaller Gulf Cooperation Council (GCC) states, recognizing that Kuwait, Qatar, and Oman are dependable allies and that Iraq may one day replace Saudi Arabia as a key airbase provider.

In a dramatic session yesterday, the Turkish parliament convened to consider a motion sent by the Justice and Development Party (AKP) government, which had requested that a large U.S. force be permitted to use Turkish soil as a staging ground for a possible campaign in Iraq. The legislature refused to authorize the motion, however, blocking the creation of a northern front in the looming war. Of the 533 deputies in session, 264 voted for the motion, 250 voted against it, and 19 abstained, bringing the motion only three votes shy of the majority required by the constitution. AKP assurances that only 30 to 40 of its delegates would object to the motion crashed to a halt over the course of the session, with 99 of the party's deputies voting nay. Although the democratic will of the Turkish parliament should be respected, the fact remains that the AKP government failed to pass its agenda through the legislature. Some analysts argue that this spells trouble for both Turkey and AKP, with others speculating that U.S.-Turkish relations are now at a historical threshold.
