1. Democracy Support and Peaceful Democratisation after Civil War

Abstract:
Evidence exists that democracies are particularly stable, yet also that processes of democratisation are highly susceptible to conflict, especially if democratisation occurs in the aftermath of violent conflict. New research from the German Development Institute / Deutsches Institut für Entwicklungspolitik (DIE) indicates that external democracy support can help mitigate the destabilising effects of post-conflict democratisation. Since the 1990s, democracy support has been integral to most peacebuilding efforts. Supporting free and fair elections or a vibrant media seems well-suited for fostering peace: Democratic institutions can actively deal with societal conflicts, in sharp contrast to authoritarian regimes, which often rely on repression. However, altering power relations through more political competition can also trigger power struggles, which newly emerging democratic institutions may have difficulty containing. Therefore, questions arise regarding countries that have embarked on a process of democratisation after civil war: Can democracy support help to mitigate destabilising effects, or does it reinforce them? If it can foster peace, how should it be designed in order to avoid renewed violence? The wisdom or folly of supporting democracy to build peace after civil war has caused controversy, yet has rarely been tested empirically. This briefing paper summarises findings from DIE research that addresses this gap.

2. An alienated partnership: German-Russian relations after Putin's return

The return of Vladimir Putin as Russia's president and the probable end of Dmitri Medvedev's modernization project will increase the alienation within German-Russian relations. Germany's modernization partnership with Russia has produced limited results because the two sides have different views on the cooperation. While the German side wants to develop common projects of good practice which will modernize the Russian economy and politics, the Russian side is interested in technology transfer. The interest in and knowledge of Russia among German decision-makers is decreasing. Germany lacks vision and concepts on how to influence developments in Russia. This is also due to the resistance of the current Russian elite towards implementing political reforms. As a result, Russia is losing its most important advocate in the EU (also regarding energy policy). This will have a negative impact on EU-Russia relations because the EU lacks leadership on Russia. Ongoing changes in Russian society, which challenge the Putin system, will present an opportunity to find new allies in Russia for cooperation and modernization, which may increase Germany's interest in its large neighbour. But this will call for a more balanced approach between the Russian elites and society in Germany's Russia policy.

4. The Political Economy of Heterogeneous Development: Quantile Effects of Income and Education

Does development lead to the establishment of more democratic institutions? The key to the puzzle, we argue, is the previously unrecognized fact that based on quantitative regime scores, countries over the past 50 years have clustered into two separate, very distinct, yet equally-common stages of political development—authoritarian states with low levels of freedom on one side an d democracies with liberal institutions on the other side of a bimodal distribution of political regimes. We develop a new empirical strategy—exploiting exogenous world economic factors and introducing new panel data estimators—that allows for the first time to estimate the effects of development as well as unobserved country effects in driving democracy at these different stages of political development. We find that income and education have the least effect on democracy when authoritarian regimes are consolidated and that only country effects, possibly accounting for institutional legacies, can lead to political development. Ironically, it is in highly democratic and wealthiest of nations that income and education start to play a role; however greater wealth and better educated citizenry can both help and hurt democracy depending again on what the country's institutional legacies are. Far from accepting the notion that much of the developing world is cursed by unchanging and poor long-run institutions, policy-makers should take note that with democratization we also see country-specific factors that in turn condition the difference income and education make for democracy.

5. Germany after the elections: A liberal dawn?

The German elections provided a clear mandate for current Chancellor Angela Merkel to form a new coalition government between her Christian Democrats (CDU) and the Liberals (FDP), led by Guido Westerwelle. Coalition talks between the two parties have started and are likely to be concluded by early November. The big winners of the elections have been the Liberals (+4.8%), as well as Germany's two other mid-sized parties, the Greens (+2.6%) and die Linke (+3.2%). The biggest loser of the elections were the Social Democrats (SPD) (-11.2%), who return to opposition after 11 years in government. Despite Angela Merkel's popularity, the electoral standing of the CDU has also deteriorated (-1.4%).Overall, the elections represent a clear shift in the political spectrum from left to right. They also indicate a further weakening of Germany's two “catch-all” parties, CDU and SPD, and will lead to a more fluid and less predictable party system. As the clear winners the Liberals are in a strong position to shape the agenda of the new government, especially when it comes to tax cuts and structural reforms. But it would be wrong to see the elections as a vote in favour of radical change. Rather, they were a vote against the unpopular grand coalition government. As a result, some friction between FDP and CDU might be unavoidable. In the short-run the domestic agenda will also be constrained by next year's elections in North-Rhine Westphalia; important because of their impact on the government's majority in the Bundesrat, Germany's upper chamber. At home, the new government will face a difficult trade-off between the campaign promises of windfall tax cuts and the pressing need of budget consolidation. Differences also remain over health care reforms and labour market policies, while there is a consensus on extending nuclear energy and corporate tax reforms. Broad, there will be few changes as Angela Merkel will dominate her inexperienced new foreign minister on all important foreign policy issues. As before, Germany will seek close ties with the US, but will only reluctantly grow into the role of a more “normal” international actor. In the EU, the new government will seek to play a constructive role, but is unlikely to be the source of new ideas and initiatives.

6. How European Protest Transforms Institutions of the Public Sphere: Discourse and Decision-Making in the European Social Forum Process

Abstract:
Against the background of the alleged democratic deficit of EU institutions, this case study explores how politicization and emerging transnational public spaces in European protest movements innovate existing practices of discursive or grassroots deliberative democracy in national social movements. I studied the European Social Forum (ESF) process, a transnational participatory democracy platform created by civil society groups and social movement organizations. I explored discourse and decision-making in the small-scale European Assemblies in which hundreds of activists have met six times a year since 2002 to organize the ESFs, and form campaigns on issues such as global and social justice, peace, climate change, migration, health, or education. Comparing activists' democratic norms and discourse practices in these frequently occurring European Assemblies with social forum assemblies at the national level in Germany, Italy and the UK, I arrived at a surprising result: European Assemblies reflect a higher degree of discursive inclusivity, dialogue and transparency in decision-making and discussion compared to national social forum assemblies. In this paper I discuss structural, strategic and cultural changes that occur in the process of a Europeanization “from below”, that is, when social movement activists work together transnationally across a certain time period. I argue that European protest as a form of contentious Europeanization has developed new social practices and actors that innovate existing practices of participatory democracy at the national level, showing the relevance of social movements to democratize European integration.

7. The "Going" of the Third Reich: Recivilizing Germans through Political Education

Historians and political sciences have begun to discuss how and when postwar Germany overcame its authoritarian past and reestablished democracy and a tolerant civil society. This article argues that the national and regional Offices for Political Education have contributed significantly to the recivilizing process. The article provides the first preliminary academic attempt to outline the offices' historical background, their changing institutional structure, and their place in the civic education context since the mid 1950s. A series of case studies examine the historical literature disseminated by specific offices to illustrate the process of overcoming a problematic past and constructing new identities. In turn, the historical role models promoted by the offices, the manner in which federalism was presented, the timing of and fashion in which the Holocaust became a significant theme and the way in which regional identities were understood and fostered, are examined. These cases illustrate how historical information was employed, at first in fairly simple and propagandistic fashion, but always to inculcate democratic and civil norms. The question of the impact of the offices' work is left open, since research on reception has yet to be undertaken, but some evidence about their important contributions to reshaping German values is provided.

Ziel ist es, einen Forschungsansatz zu entwickeln, der diesen Räumen angemessenen ist. Zu diesem Zweck werden zunächst eurozentrische Prämissen im Governance-Konzept sichtbar gemacht. Hier geht es um die zentrale Dichotomie zwischen staatlichen und gesellschaftlichen Akteuren. Die Allgegenwart dieser Unterscheidung wird anschließend mit Hilfe der (de-)konstruktivistischen Erkenntnistheorien Foucaults, Luhmanns und Derridas erklärt. Ausgehend von einem zwar unumgänglichen, aber in seinem Ausmaß variablen Eurozentrismus skizziert die Autorin schließlich eine äquivalenzfunktionalistische Governance-Forschung, die nach der Art und Weise einer Leistung, nach dem „Wie“ und dem „Wer“, fragt. Das vorliegende Working Paper versteht unter Governance eine Perspektive auf Regieren: Governance dient der intentionalen Handlungskoordination unter einer Mehrzahl von Akteuren durch kollektiv bindende Entscheidungen. Der Mehrwert des Governance-Begriff s liegt in der Betonung der Kontingenz der Modi des Regierens und der beteiligten Akteure. Wir argumentieren, dass der Governance-Begriff schwach normativ ist. Der „dichte Begriff “ des Regierens meint stets eine regelgeleitete Verteilung von Gütern im Unterschied zu Übeln. Jedes Regieren, das diesen Namen verdient, garantiert ein Mindestmaß an Erwartungssicherheit hinsichtlich überlebenswichtiger und Sozialität überhaupt ermöglichender Sachverhalte für eine defi nierte Gesamtheit von Regelungsadressaten. Die Übertragbarkeit dieses Governance-Begriff s auf Räume zerfallen(d)er Staatlichkeit ist aus zwei Gründen fraglich. Zum einen fehlt hier eine Instanz, die die Inklusion aller Betroff enen in die Governance-Leistungen letztverantwortlich garantieren kann, zum anderen ist in fragmentierten Gesellschaften umstritten, wer überhaupt dem Kreis der Regelungsadressaten angehört. Ein zentrales theoretisches Problem des wissenschaftlichen Diskurses über Governance besteht darin, dass die sozialwissenschaftlichen Konzepte vor dem Hintergrund der Erfahrung des Regierens in modernen und hoch entwickelten demokratischen Nationalstaaten der OECD-Welt formuliert wurden. Hieraus ergeben sich konzeptionelle Probleme hinsichtlich ihrer Anwendbarkeit auf historische und gegenwärtige Räume begrenzter Staatlichkeit. Governance ist zu einem zentralen Thema sozialwissenschaftlicher Forschung geworden. Dabei besteht Übereinstimmung, dass politische Gemeinwesen bestimmte Leistungen in den Bereichen Herrschaft, Sicherheit und Wohlfahrt erbringen sollen. In den Debatten wird aber oft „eff ektive Gebietsherrschaft“ als Kernelement moderner Staatlichkeit stillschweigend vorausgesetzt, und die Forschung konzentriert sich auf die OECD-Welt. In globaler sowie historischer Perspektive sind autoritative Entscheidungskompetenz und Gewaltmonopol des Staates jedoch die Ausnahme, nicht die Regel. Ein Blick auf die Länder des Südens, „zerfallen(d)e Staaten“ in den Krisenregionen der Welt oder ehemalige Kolonien bestätigt dies. Hier wird politisch gesteuert, ohne dass die vielfältigen Verfahren demokratischer und rechtsstaatlich organisierter Wohlfahrtsstaaten verfügbar wären. Der SFB 700 fragt daher nach den Bedingungen von Governance in diesen Räumen begrenzter Staatlichkeit: Wie und unter welchen Bedingungen werden Governance-Leistungen in den Bereichen Herrschaft, Sicherheit und Wohlfahrt in Räumen begrenzter Staatlichkeit erbracht, und welche Probleme entstehen dabei? Die SFB-Teilprojekte untersuchen, wie dort regiert wird und welche Probleme dabei entstehen. Dabei gehen wir davon aus, dass sich in Räumen begrenzter Staatlichkeit „neue“ Formen des Regierens herausbilden, die vorwiegend „weiche“ Steuerungsformen nutzen, auf vielfältigen Kooperationsformen zwischen staatlichen und nicht-staatlichen Akteuren basieren und durch eine Verschränkung von globalen, nationalen und lokalen Ebenen charakterisiert sind.

Abstract:
Public discourse, understood both as ideas about public action and interactive processes that serve to 'coordinate' the construction of those ideas and to 'communicate' them to the public, has been central to the success (or failure) of the reform projects of social democratic parties. Certain background factors, including countries' policy legacies, problems, preferences, and capacity set the stage for reform while good ideas which are cognitively sound and normatively appropriate as well as relevant, coherent, and consistent contribute to reform success. But institutional context also matters with regard to how ideas are conveyed to whom, with 'simple' polities emphasizing the 'communicative' discourse to the general public and more 'compound' polities the 'coordinative' discourse among policy actors. This is demonstrated with examples from Germany, France, Britain, Italy, the Netherlands, Denmark, and Sweden.

Will Kymlicka has argued “democratic politics is politics in the vernacular.” Does it imply that democratic politics is impossible in a multilingual community, whether at the local, national, regional or global level? This paper discusses this assumption and maintains that democratic politics should imply the willingness of all players to make an effort to understand each other. Democratic politics imply the willingness to overcome the barriers to mutual understanding, including the linguistic ones. Any time that there is a community of fate, a democrat should search for methods that allow deliberation according to the two key conditions of political equality and participation. If linguistic diversity is an obstacle to equality and participation, some methods should be found to overcome it, as exemplified by the Esperanto metaphor. The paper illustrates the argument with four cases of multi-linguistic political communities: a) a school in California with English-speaking and Spanish-speaking students; b) the city of Byelostok in the second half of the nineteenth century, where four different linguistic communities (Polish, Russian, German and Yiddish) coexisted. This led Markus Zamenhof to invent Esperanto; c) the linguistic problems of the Indian state, and the role played by English – a language unspoken by the majority of the Indian population in 1947 – in developing Indian democracy; and d) the case of the European Parliament, with twenty languages and a wealth of interpreters and translators.

15. European Corporate Governance Reform and the German Party Paradox

This paper addresses the current discussion on links between party politics and production regimes. Why do German Social Democrats opt for more corporate governance liberalization than the CDU although, in terms of the distributional outcomes of such reforms, one would expect the situation to be reversed? I divide my analysis into three stages. First, I use the European Parliament's crucial vote on the European takeover directive in July 2001 as a test case to show that the left-right dimension does indeed matter in corporate governance reform, beside cross-class and cross-party nation-based interests. In a second step, by analyzing the party positions in the main German corporate governance reforms in the 1990s, I show that the SPD and the CDU behave “paradoxically” in the sense that the SPD favored more corporate governance liberalization than the CDU, which protected the institutions of “Rhenish,” “organized” capitalism. This constellation occurred in the discussions on company disclosure, management accountability, the power of banks, network dissolution, and takeover regulation. Third, I offer two explanations for this paradoxical party behavior. The first explanation concerns the historical conversion of ideas. I show that trade unions and Social Democrats favored a high degree of capital organization in the Weimar Republic, but this ideological position was driven in new directions at two watersheds: one in the late 1940s, the other in the late 1950s. My second explanation lies in the importance of conflicts over managerial control, in which both employees and minority shareholders oppose managers, and in which increased shareholder power strengthens the position of works councils.

The prevalence of collective violence and the agony of mass atrocity may prove to be the twentieth century's most distressing and enduring legacies. From Germany to Uganda, from Cambodia to Sierra Leone, from the Former Yugoslavia to Rwanda, the past hundred years are replete with examples of terrifying violations of human rights and humanitarian law committed against diverse groups of people. Limited attempts to unveil the truth about past horrors, to hold individuals responsible, and to deter future offenses have repeatedly proven inadequate. A dearth of satisfactory moral and legal responses to these crimes often left victims suffering without any sense of reconciliation, while perpetrators routinely enjoyed impunity rather than facing justice.

18. The Honecker Trial: The East German Past and the German Future

Fifty years after the Nuremberg tribunals, Germany is once again caught up in a series of controversial trials involving former dictators. This time officials of the former German Democratic Republic (GDR) sit in the dock. Some observers have criticized these proceedings, maintaining that they will result in the imposition of an arbitrary form of 'victor's justice.' Others have claimed, in contrast, that the cumbersome German Rechtsstaat ('state under the law') will prove incapable of responding to public demands for retribution. In this paper the author maintains that Germany's courts have not been at a loss to answer these complaints. By grounding their judgments in preexisting East German law, the courts have managed to bring some of the GDR's former leaders to justice while at the same time guaranteeing most defendants the full protections of the rule of law. In the process the courts have even conveyed an important message about the terms under which both German populations will be brought back together again.
