1. Europe’s Return to UN Peacekeeping in Africa? Lessons from Mali

In a break from recent tradition, European member states are currently contributing significant military capabilities to a United Nations (UN) peacekeeping operation in Africa. Europeans are providing more than 1,000 troops to the UN Multidimensional Integrated Stabilization Mission in Mali (MINUSMA) by staffing a wide range of operations including an intelligence fusion cell, transport and attack aircraft, and special forces. Yet for European troop-contributing countries (TCCs) that have spent several years working in North Atlantic Treaty Organization (NATO) operations in Afghanistan, participating in a UN mission has been a process of learning and adaptation. For the UN, the contributions of key capabilities by European countries have pushed the UN system to adjust to the higher expectations of the new European TCCs, which has proved difficult in Mali’s complicated operating environment and political situation.

Peace and political transition processes provide key opportunities to transform institutions, structures, and relationships in societies affected by conflict or crises. Despite these wide-ranging implications, women’s participation in formal peacemaking remains low. And empirical evidence regarding the impact of women’s participation on peace has been lacking. The International Peace Institute’s new report, “Reimagining Peacemaking: Women’s Roles in Peace Processes” examines the challenges and opportunities presented by women’s participation in peace and transition processes. It shares new quantitative and qualitative evidence on the impact of this participation and explores models and strategies for strengthening women’s influence throughout mediated processes. Based on research carried out at the International Peace Institute in New York and the Graduate Institute of International and Development Studies in Geneva, the new report shows how the lag in women’s participation is linked to broader dilemmas in the peacemaking landscape today. Drawing on a comparative study of forty peace and transition processes from the Broadening Participation Project, it demonstrates that when women are able to effectively influence a peace process, a peace agreement is almost always reached and the agreement is more likely to be implemented. The report also features a case study on two distinct peace processes in the Philippines, where an unprecedented level of women’s participation offers lessons on their influence

Since independence, African states and organizations have made significant investments in conflict management and resolution tools. So why do some African states and regions remain saddled by conflict and instability? How can African states leverage democratic governance to end wars? The new report Silencing the Guns suggests that the key to ending conflict in Africa lies in fostering effective governance and creating political and economic institutions that can effectively prevent, manage, and resolve conflicts. Author Gilbert Khadiagala unpacks how and why democratic governance is linked to conflict prevention and management, and provides an overview of landmark trends that have influenced governance in Africa since the 1950s. He shows that not all forms of democratic governance reduce conflicts and examines the ways in which “developmental dictatorships,” corruption, and the privatization of security are posing obstacles for governance and peace today.

This report assesses the United Nations Security Council's current approach to drawing down sanctions in intrastate war situations. After examining broader questions surrounding the UN's authority to impose sanctions and the corresponding limits on these powers, this report assesses criteria used by the council to terminate sanctions. It observes that multilateral sanctions under the UN Security Council tend to last substantially longer than sanctions by regional organizations, such as the African Union and the Economic Community of West African States (ECOWAS); and it argues that short sanctions periods are preferable to long sanctions periods.

6. Mediating Transition in Yemen: Achievements and Lessons

Yemen remains the only site of an Arab Spring uprising that has ended in a negotiated agreement and a structured, internationally supported transition process. As Jamal Benomar, the United Nations Special Adviser to the Secretary-General on Yemen, stated, “Yemen was definitely heading towards a Syria-type scenario” before international actors, including the United Nations (UN), helped to shepherd a complex transition process, which continues at the time of writing. Benomar, with support from a wide array of stakeholders, helped avert an escalating conflict in Yemen by stepping in to offer the good offices of the UN secretarygeneral without waiting for the UN Security Council or the embattled Yemeni regime to demand UN action. Benomar's interventions— including bringing Yemen's major political parties together amid the uprising—helped ensure that the country did not devolve into civil war when President Ali Abdullah Saleh stepped down after thirty-three years in power. That is, the UN opened a space for dialogue where none had previously been considered possible.

As the situation in Syria continues to deteriorate, could the humanitarian crisis afflicting the country and its neighbors provide an entryway for regional cooperation? This policy paper examines how regional responses to humanitarian crises have succeeded or failed to meet humanitarian objectives in order to inform approaches to contemporary crises. It also assesses whether such regional responses contributed to strengthening regional integration and cooperation, paving the way for increased regional stability and an improved capacity to respond to emergencies. The report explores two different humanitarian crises: the war in the former Yugoslavia in the 1990s and Cyclone Nargis in Myanmar in 2008. Examining the ways in which countries in each region and regional organizations addressed humanitarian needs, it draws a number of lessons that could be applied in contemporary crises: Regional ownership over the response is crucial, but not necessarily spontaneous. External actors can usefully contribute through a balanced mix of pressure and technical support. Preexisting regional organizations can provide a valuable institutional framework on which to build the response. An approach that focuses on the specific needs of the most vulnerable individuals can help to depoliticize discussions while strengthening trust among regional stakeholders. Complementary policy-level and expert-level processes can equip the response with both political commitment and regular working relationships for addressing tangible needs.

Traditional approaches to international conflict mediation—in which statesmen hammer out agreements between governments, or between governments and well-defined rebel movements—are falling short in the face of 21st century violence. Interstate conflict has decreased dramatically, and today one off civil wars with clearly defined parties are relatively rare: 90 percent of civil wars occur in countries already affected by conflict. Despite international efforts to mediate and implement peace agreements, between a quarter and a half of all civil wars recur within five years.

Among the many elements that determine the success or failure of United Nations peacekeeping operations, the effectiveness of individual peacekeepers plays a prominent, though often underestimated, role. But “effectiveness” is an elusive concept. It is the product of a number of factors, ranging from the will of peacekeepers to the quality and suitability of their equipment; from timely deployment to strategic planning; from logistics to financial support. Ongoing efforts to improve the effectiveness of UN peacekeeping cover all these areas and more, including training, as a means to ensure that UN peacekeepers are adequately prepared to accomplish their tasks.

In his introductory remarks, IPI President Terje Rød-Larsen noted that when the United Nations was established after the Second World War, organized crime had almost nothing to do with international peace and security. It was a problem in a few big cities and isolated regions, but it was not a topic of international relations. In the 1980s, the situation began to change. The collapse of Communism opened new markets, and criminals began to take advantage of instability in conflict zones and fragile states. Globalization created new opportunities for illicit activities to flourish thanks to new technologies, new markets, and greater openness. Increases in trade, financial transactions, and communications made it easier for criminals to do business around the world and to launder money. Criminal groups also exploited unstable regions. As a result, by the beginning of the twenty-first century, organized crime had gone global, reaching macroeconomic proportions and posing a threat to international peace and security.

12. Peacekeeping Reimbursements-Key Topics for the Next COE Working Group

With UN peacekeeping operating in more complex environments and taking on new tasks, peacekeepers need appropriate equipment to carry out their mandates. A central aspect to equipping peacekeepers is ensuring that member states are appropriately reimbursed for their contributions under a equipment reimbursement system, called the Contingent-Owned Equipment System(COE). Every three years the United Nations conducts a meeting to negotiate the terms and conditions of the financial reimbursements paid to member states for the equipment they provide to UN peacekeeping operations. Preparations and briefings to member states are already underway in New York for the next COE Working Group meeting, to be held January 20-31, 2014. With 98,311 military and police deployed with their related equipment in seventeen missions around the world, the financial implications of these tri-annual discussions can be significant. In MONUSCO alone, the mission's annual budget for reimbursements to troop-contributing and police-contributing countries for major equipment and self-sustainment in the fiscal years 2008/09, 2009/10, and 2010/11 were $144million, $160million, and$180million, respectively.

Everyone knows that Africa, cradle of humanity, land of the Pharaohs and human civilization, and vast reservoir of human and natural resources, is not doing well. She crosses the deepest crisis that has shaken her since the end of colonial times. The specter of chaos lurks everywhere. She is now seen as the continent of “collapsing states” and “zombie nations”; the continent of extreme poverty, misery, and injustice; the continent of horrors, of the Rwandan genocide and of the worst atrocities committed in Liberia, Sierra Leone, Kenya, Darfur and elsewhere. This brutal reality has been, for quite some time now, analyzed by most observers and experts with certain fatalism, as testified by these book titles with pessimistic or even alarmist tones: “Black Africa Started on the Wrong Foot” (René Dumont), “Can Black Africa Take Off?” (Albert Meister); “And What If Africa Refused Development” (Axelle Kabou); “Africa Down” (Jacques Giri). By now, it is just a chorus of permanent lamentations about the “lost continent,” the “damned continent,” or the “cursed continent” whose past is not passing. And the rest of the world, which sees us as negligible, even contemptible (“all corrupt and all dictators,” they say), consider that henceforth, they no longer need us.

As part of its project on peace and security in the Sahel- Sahara region, IPI's Africa Program has partnered with the Mauritania-based think tank, the Centre for Strategies for Security in the Sahel Sahara Region. The Centre 4S was established in June 2011 to help countries in the Sahel take the lead in transforming the region's daunting security and development challenges into opportunities. Originally written in French, this June 2012 research paper from the Centre 4S examines the principal threats to peace and security in the Sahel and their impact on development. It then offers proposals and recommendations for surmounting the current conflicts before presenting possible future scenarios for the region.

Today, United Nations (UN) peacekeeping stands at another crossroads. With consistently high demands for peacekeepers and an expanding range of mandated tasks, the UN faces the challenge of finding more, and better, peacekeepers. This comes at a time when financial austerity measures are being imposed across much of the world and in a political context where the UN must compete with other international organizations to recruit peacekeepers from what is a relatively limited global pool of relevant capabilities. To meet the challenge, the UN's New Horizon initiative and the General Assembly's Special Committee on Peacekeeping Operations (C-34) have called for an “expanding of the pool of available capabilities.” The Providing for Peacekeeping Project was established by the International Peace Institute to inform and assist this endeavor.

Why.Is.Management.Important? The UN field mission is a complex beast. From the smallest political mission to the largest peacekeeping operation, it employs a uniquely diverse staff and performs a broad array of tasks in an environment that is sometimes dangerous, often unstable, and always challenging. Resources are scarce and inflexible. Internal regulations and procedures are cumbersome, and, at times, can impede rather than facilitate success. On top of it all, success is often hard to measure or even recognize. Unlike the private sec-tor, success in the field does not come from increased quarterly profits, but rather from a conflict prevented, the perception of a peace dividend, or the renewed optimism of a host population. Unfortunately, UN staff can only contribute to these goals, as so many factors are beyond the mission's control.

22. Bridge over the Dniestr: Confidence-Building Measures in Moldova

Damaged by shelling during the 1992 conflict, the Gura Bicului Bridge, which spans the Dniestr river, was reconstructed in 2001 with money from the European Union. The bridge—along the main highway between the Black Sea and the Baltic coast—should facilitate trade and contacts between Moldova and the break-away region of Transdniestria. But it has never been reopened: only pedestrians and bicyclists are allowed to cross. It stands as a potent symbol of how hard it has been, for the past twenty years, to bridge the two sides of the Dniestr.

In many peace negotiations International Contact Groups have been a helpful tool in preventing a peace process from stalling or failing. Members, commonly states and international organizations, exert leverage on the parties to the conflict, sustain the parties' commitment to a peaceful resolution of the conflict and restore mutual trust. While international nongovernmental organizations have been overlooked in this context, they may expedite problem-solving by contributing through their networks within civil society, their experience from similar peace processes in different countries, and their perceived independence from the parties to conflict. With the assistance of international nongovernmental organizations a peace process may lead to a higher degree of efficiency and legitimacy in delivering sustainable results. The recent negotiations between the government of the Philippines and the Moro Islamic Liberation Front use this potential and incorporate four nongovernmental organizations to an unprecedented degree as part of an International Contact Group. This Peace Brief illustrates their innovative methods and capacities during this ongoing negotiation process. The next round of negotiations is scheduled for April 27 and 28, 2011.

This report is the first publication produced by IPI's research project on Understanding Compliance with UN Security Council Resolutions. It provides fresh insights from the new IPI Security Council Compliance Database. The report examines trends in how the Security Council has engaged with civil wars since 1989, variations in where and when it chose to engage, and the gradual evolution of the Council's civil-war response strategies. Future analysis by this project will seek to provide answers to two questions: To what extent do civil-war parties comply with demands issued by the Security Council? And what factor or combination of factors best explains the variance in the level of compliance—e.g., conflict settings, conflict management strategies, or political dynamics within the Security Council?

Abstract:
In recent years, donor governments and international organizations such as the UN and the World Bank have developed a number of frameworks and tools to assess governance, conflict, and fragility. This report argues that there are multiple, and often contradictory, objectives underlying the development and use of such assessment tools. Underpinning this multiplicity of objectives are deep assumptions, many of which remain unstated. Different agencies tend to define the problem through their own institutional lens, and the assessment tools they create reflect these biases. As the Organisation for Economic Co-operation and Development—Development Assistant Committee's (OECD-DAC's) work on governance assessments has pointed out, assumptions underlying governance assessment methodologies are usually not explicit, but tend to measure governance against existing norms in OECD countries. Similarly, the different approaches to conflict assessment adopted by major bilateral and multilateral actors demonstrate conceptual and intellectual differences in their understanding of the nature of conflict; the same may be said for various donors' approaches to assessing state fragility.

“Overstretched,” “underresourced,” and “overmatched” are terms commonly used to describe UN peacekeeping. The first is a result of the vast number of conflicts the Security Council has chosen to address with peace operations. The second is due to a lack of available specialized equipment, highly trained personnel, and funds—a constraint compounded by global recession. The final descriptor, “overmatched,” is, at least partly, a consequence of the challenging, complex environment in which the UN operates. The multiplicity of actors involved, the unpredictability of the environment, and the enormous obstacles to sustainable peace all suggest a complexity through which the UN—a large bureaucracy dependent on the will and capacity of its member states—is often unprepared to navigate.

The commission has facilitated the articulation of mutual commitments as part of the peacebuilding frameworks developed in Burundi, Sierra Leone, Guinea-Bissau, and the Central African Republic. This has begun to fill an important gap. But, the PBC has so far not fulfilled the full promise of this principle: to serve as a forum where national and international actors can hold each other to their commitments. This brief reflects on the PBC's experience with mutual accountability and puts it into a broader context to highlight why it is an area where the PBC can potentially add value.

The study of peacemaking and mediation blossomed in the immediate post-Cold War years and into the new millennium.The 2001 terrorist attacks on the US and subsequent attacks in Indonesia, Spain, and the UK, marked a significant watershed in world politics, raising the question of whether war-fighting against this new adversary would eclipse peacemaking and conflict prevention.While the jury remains out on the extent of the paradigm shift signaled by September 11, 2001, there is no question that today's environment features elements of both continuity and change for peacemakers. The threat to international security posed by certain forms of terrorism cannot be ignored. But the totality of challenges facing the international system today cannot be reduced to the terrorist threat, nor can the international community's response be reduced to a “war on terrorism.”1 In this section of the paper, we will identify important areas of consensus about peacemaking that have carried over from the late 1980s and early 1990s to the present, take note of continuing debates in the broader field of conflict management and resolution that affect the way practitioners and scholars think about their activities, and discuss certain “new emphases” in this field that can affect the way peacemakers operate, whether as state-based or unofficial actors.

Efforts to predict the future of peacekeeping almost always prove to be unsuccessful. In 1958, United Nations Secretary-General Dag Hammarskjöld reported to the General Assembly on the lessons of the UN Emergency Force deployed to Egypt during the Suez crisis two years before. He surrounded his observations with qualifications, as some “circumstances are of such a nature that it could not reasonably be expected that they would often be duplicated elsewhere. Nor can it be assumed that they provide a sufficient basis to warrant indiscriminate projection of the UNEF experience in planning for future United Nations operations of this kind.” Sure enough, when the UN began to deploy to the Congo two years later, the 1958 report was to prove “not especially pertinent” to the task at hand.

The focus of this paper is on conflicts within states. These range from the full scale armed conflict of a civil war (between two “states within states”), through relatively isolated and contained low intensity insurrection against the state, to regular bouts of communal violence in a “well functioning” state. I wish to ask how poverty and inequality causally interact with these phenomena. The causality from conflict to poverty is not much in doubt and stands to reason—conflict destroys or impairs incentives for productive economic investment and innovation at all levels. However, the precise nature of causality in the other direction, from poverty and inequality to conflict, is more ambiguous and subject to greater debate. It is this causal chain that is the focus of this working paper; but in order to do this we in turn need a more nuanced characterization and discussion of inequality and poverty concepts and trends. Certain types of inequality, in particular, will be seen to be particularly fertile ground for conflict; other types may be more benign. And if the attempts to reduce poverty through economic growth lead to initial increases in the “wrong” type of inequality, the conflicts this engenders may dissipate beneficial effects of poverty reduction on conflict. However, each scenario will have essentially specific features related to structural and historical factors that differ from country to country. The general principles will thus have to be applied carefully in designing country specific policies and interventions. The second section of the paper introduces some basic concepts of poverty and inequality and reviews their strengths and limitations in helping us understand the origins of conflict. Section three turns to the theory and evidence of the causal links between poverty, inequality, and conflict. Based on this analysis, section four discusses policies to reduce the likelihood of conflict, while the fifth section offers a conclusion.

Since September 2001, the Security Council and its various counterterrorism-related subsidiary bodies have made significant contributions to the global counterterrorism campaign, primarily through norm setting and institution building and by keeping terrorism on the political agenda while engaging in dialogue with—and stimulating the activities of—states and multilateral bodies. Yet, rather than together constituting a comprehensive strategy to address the global terrorist threat, each Council initiative has had an improvisational, ad hoc quality. Following each major terrorist attack—often against one of its own members—the Council's response has extended well beyond the specific incident at hand with little regard to its relation to the already existing Council program.

Although migrant workers, refugees and immigrants have been sending money, goods and ideas home for millennia, until about a decade ago donors and international finance agencies paid little attention to the phenomenon. Interest has grown exponentially as statistics show what we now call migrant remittances to be among the most important contributing factors to national economies in several countries. Nearly all the countries in the conflict, war-to-peace transition, and crisis categories are highly dependent on remittances. The slow recovery of livelihoods and persistent violence or repression ensure high levels of migration and the need for remittances in such countries for several years after conflict and crises have ended. By all accounts, migrant remittances reduce poverty in important ways in developing countries. Research shows that migrants transfer funds and invest in their countries of origin at times when international investment has all but disappeared. By serving these purposes in countries emerging from or still experiencing conflicts (e.g., Bosnia and Herzegovina, Kosovo, Sri Lanka, Afghanistan, Somalia, Liberia, Côte d'Ivoire and others), remittances can be seen as a sine qua non for peace and rebuilding.

Since 1989, insurgency has consumed Indian-administered Jammu and Kashmir (IJK), claiming at least 45,000 lives. With overt "nuclearization" by India and Pakistan in 1998, and with "jihadist" militants playing an increasingly prominent role in the insurgency since the mid-1990s, the Kashmir conflict also bears the marks of a distinctly twenty-first century security predicament.

47. Beyond Greed and Grievance: Policy Lessons from Studies in the Political Economy of Armed Conflict

This policy report provides a synopsis of the key findings from case studies on the political economy of armed intra-state conflicts, commissioned by the International Peace Academy's program on Economic Agendas in Civil wars (EAC W ). These findings offer lessons for improved policies for conflict prevention and resolution. Combatants' incentives for self-enrichment and/ or opportunities for insurgent mobilization created by access to natural and financial resources were neither the primary nor sole cause of the separatist and non-separatist conflicts analyzed. Nevertheless, extensive combatant self-financing complicated and prolonged hostilities, in some cases creating serious impediments to their resolu-tion. In all cases, however, these factors interacted to varying degrees with long-standing socio-economic and political grievances, inter-ethnic disputes, and security dilemmas brought about by weak and unaccountable systems of governance. Conflict analysis should avoid "resource reductionist" models in favor of comprehensive approaches that not only account for the complex interrelationship between economic and political dynamics, but also incorporate the political economy of both rebellion and state failure. Improved understanding is required of the role that combatant access to resources can play in shaping a permissive opportunity structure for separatist and non-separatist conflicts relative to other socio-political factors. Different resource endowments affect different sorts of conflicts and benefit combatant parties in distinct ways, depending, inter alia, on the mode of exploitation and how proceeds are managed by the state. "Lootable" resources, such as alluvial diamonds and illegal narcotics are more likely to be implicated in non-separatist insurgencies. They prolong conflict by benefiting rebels and conflict-dependent civilians, compromising battle disci-pline, and by multiplying the number of peace spoilers. "Unlootable" resources, such as oil, gas, and deep-shaft mineral deposits tend to be associ-ated with separatist conflicts, which are often caused by ethno-political grievances over inequitable resource revenue-sharing and exclusionary government policies. Given the importance of lootable natural resources and easily captured diaspora remittances in sustaining many of today's armed conflicts, improved international regulatory efforts to curtail these resource flows are both warranted and necessary. Commodity control regimes need to be strengthened and also complemented by more comprehensive efforts that address the financial flows connected with those resources. However, even the most robust resource control regimes are unlikely to have a decisive or even fully positive impact. Where conflicts are motivated by a mix of political, security, ethnic, and economic factors, curtailing resource flows to combatants may weaken their military capacity but not their resolve to continue fighting. In addition, regulatory regimes may have adverse humanitarian effects by increasing civilian predation by rebels or by stifling civilian incomes. When designing and implementing regulatory regimes, policy-makers need to distinguish between those who exploit armed conflict for profit and power and those who participate in war economies to sustain their civilian livelihoods. The offer of "economic peace dividends" may co-opt belligerents into ceasefires or more formal peace processes. Critically, however, economic inducements are unlikely to achieve these results in the absence of a credible military threat and may risk the creation of "negative peace," where justice and sustainability are deeply compromised and the threat of renewed conflict remains high. Policy-makers need to identify and adequately integrate economic incentives of combatants into a wider set of political and strategic inducements for conflict resolution and peace-building. Today's insurgents increasingly engage in illegal economic activities either directly or through links with international criminal networks. However, insurgency groups have not equivocally transformed into mere criminal organizations as they retain- albeit to varying degrees- military and political goals. While improved interdiction and law enforcement are important policy tools, casting rebellion as a criminal rather than a political phenomenon may risk mischaracterizing legitimate grievances, thereby foreclosing opportu-nities for negotiated resolution, and may lend de facto legitimacy to state actors, regardless of their behavior and role in the conflict. Poor economic governance and state weakness are the critical mediating factors between resource abundance and vulnerability to armed conflict; the first engenders popular grievances, the second makes separatist and non-separatist insurgencies politically and militarily feasible. Policy responses need to focus on structural conflict prevention efforts by, inter alia, designing and supporting tools and strategies for more effective, equitable, and accountable systems of resource management, complemented by longer-term strategies of economic diversifica-tion and poverty reduction. Contemporary intra-state conflicts have strong regional and even global linkages. By increasing the number of potential war profiteers and peace-spoilers and multiplying the points of conflict, these broader dimensions not only affect the character and duration of hostilities, but also complicate the prospects for conflict resolution and post-conflict stability. Both conflict analysis and policymaking need to address these regional dimensions by strengthening the economic management capacities of formal regional organi-zations and ad hoc alliances, complementing- and thus strengthening- national and global conflict management strategies.

There has been surprisingly little systematic analysis of how economic factors contribute to the success or failure of peace agreements. What is clear however, is that economic factors play a more significant role in the failure of peace agreements than they do in the success of such initiatives; Peace agreements are often very weak on economic aspects. This is problematic because the success of the first phase of peace implementation is largely dependent on three economic factors: sufficiently rapid economic revival to generate confidence in the peace process; adequate funding to implement key aspects of the peace agreement; and, for a sustainable peace, there must be sufficient funding to enable the establishment of government institutions and the transition to a peace-time economy; Five important lessons have emerged from experience in the area of peace implementation over the last decade: The need for broad-based impact assessments At present, assessments tend to measure whether an aid project was implemented as planned, not whether it contributed to a sustainable peace. As a consequence, important opportunities to make informed mid-course adjustments in long-term programs and to develop more effective programs are lost; An early emphasis on employment is critical Active employment is critical to redirecting behavior and encouraging support for the peace process. The success of crucial programs such as those for the demobilization and reintegration of former combatants and the return of refugees and internally displaced persons are also linked to the availability of employment; Invest in Building Institutional and Social Capital Conventional approaches to post-conflict economic recovery tend to emphasize macroeconomic stability at the expense of economic infrastructure. However, in post-conflict settings, the financial and legal institutions so necessary to implement economic policy and ensure good governance are either weak or nonexistent. More attention must be paid to financing the development of basic public sector capacities and social capital. Donor decisions about whom to assist and what to fund have lasting political impacts Donor monies influence government policy, whether directly through the imposition of explicit conditions or in more indirect ways. Lending decisions also influence the political landscape within the recipient county and the behavior of third-party implementers; An international presence introduces economic distortions It is seldom acknowledged that the economic impact of international peace missions runs contrary to the aims of self-government and economic and political sustainability. As a consequence, decisions about implementation and exit are extremely important; There is an urgent need for a new economic strategy that addresses the challenges of post-civil war environments.

In the rare circumstances in which the United Nations administers a post-conflict territory, what law should be enforced? By whom? And, crucially, how should one resolve the potential dilemma between building capacity for sustainable local institutions and maintaining respect for international standards of justice? This report examines these questions through the experiences of United Nations administrations in Kosovo (1999— ) and East Timor (1999-2002) and the assistance mission in Afghanistan (2002— ). Practice in this area has, necessarily, been improvizational rather than principled. But it is possible to draw some broad lessons from these three experiments in judicial reconstruction First, the administration of justice should rank among the higher priorities of a post-conflict peace operation – certainly far higher than it is currently ranked in Afghanistan. There is a tendency on the part of international actors to conflate armed conflict and criminal activity more generally. Drawing a clearer distinction and being firm on violations of the law increases both the credibility of the international presence and the chances of a peace agreement holding. Failure to do this undermined the credibility of the international presence in Kosovo, and led to missed opportunities in East Timor. Secondly, in an immediate post-conflict environment lacking a functioning law enforcement and judicial system, rule of law functions may have to be entrusted to military personnel on a temporary basis. Recourse to the military for such functions is a last resort, but may be the only alternative to a legal vacuum. The law imposed in such circumstances should be simple and consistent. If it is not feasible to enforce the law of the land, martial law should be declared as a temporary measure, with military lawyers – especially if they come from different national contingents – agreeing upon a basic legal framework. Persons detained under such an ad hoc system should be transferred to civilian authorities as quickly as possible. Thirdly, once the security environment allows the process of civil reconstruction to begin, sustainability should generally take precedence over temporary standards in the administration of basic law and order. Whether internationalized processes are appropriate for the most serious crimes should be determined, where possible, through broad consultation with local actors.

50. Tiptoeing Through Afghanistan: The Future of UN State-Building

Afghanistan represents a radically different model in the panoply of UN peace operations. On paper it resembles earlier assistance missions that provided governance and development support to post-conflict societies. In practice, however, the UN mission remains intimately involved with the Afghan Transitional Administration and therefore with the peace process that put it in place. This disjunction between formal authority and practical influence poses a challenge not only for the specific operation in Afghanistan but also to accepted models of UN peace operations more generally. Most analyses of UN peace operations suggest that the more complex the political environment, the larger the amount of resources required to complete the mandate. On any such measure, the UN Assistance Mission in Afghanistan (UNAMA) faces an uphill battle. UNAMA is instead pursuing a high-risk strategy that requires two conceptual leaps from the normal mould of peace operations. The first is that it is possible to blur the normal distinction between negotiating a peace agreement and implementing it. The second is that the UN can make up for its small mandate and limited resources through exercising greater than normal political influence. There is widespread agreement among UNAMA and most of its Afghan partners that expansion of the International Security Assistance Force (ISAF) beyond Kabul would be an important stabilizing factor in this process. If it is to be done, it should be done urgently, while all parties are still buying into the Loya Jirga process. Given the reaction of the United States and potential troop-contributing nations, however, expansion now appears highly unlikely. Every UN mission and development programme now stresses the importance of local 'ownership'. This may be the first mission where some of the local population themselves are truly taking charge. Development, however, is notoriously supply- rather than demand-driven; donor countries are infamous for pledging one thing and delivering another. Agencies must therefore take this into account when constructing fictional budgetary targets that they know will not be met, making responsible financial planning still more difficult. Compounding these problems is confusion in Afghanistan as to what projects are actually going to be funded and when. This is partly caused by the refusal of some of the largest donors to have their money pooled into a trust fund for the whole of Afghanistan. The Emergency Loya Jirga was intended to encourage Afghans from all parts of the country to 'buy into the peace process'. This phrase was used metaphorically, but should also be understood literally. Encouraging Afghans to see the solutions to their problems as lying in the embryonic institutions of the state is good politics internationally. It is also Afghanistan's best chance for stability and relative prosperity.
