Abstract:: First, a lack of effective internal control prevents external oversight bodies, such as parliamentary committees, from fulfilling their role effectively. Intelligence service managers play a crucial role in facilitating scrutiny by oversight bodies not only by ensuring that major infractions are reported to the appropriate authority, but also by creating an environment that encourages cooperation with oversight bodies. Second, while transparency is essential to maintaining democratic control of government, intelligence services require a significant degree of secrecy to be effective. Consequently, intelligence services are subject to highly restricted oversight, unlike other public institutions. Effective internal control is therefore essential to rectify this inherent (and unavoidable) imbalance by ensuring that the day-to-day work of intelligence services is carried out in accordance with the law and with respect for human rights. Third, to avoid undue influence and ensure independent, objective analysis, intelligence services must retain a degree of autonomy from the executive. Executive control over intelligence services is therefore sometimes less pronounced, meaning that effective internal control is vital to ensuring intelligence services act within the rule of law. For the above reasons, intelligence services should be subject to both effective oversight and internal control. This Thematic Brief addresses the latter by examining internal control systems used in Euro-Atlantic countries.

Abstract:: The analysis reflects the current state from the viewpoint of legal solutions, but also from the viewpoint of real problems seen in practice, which come in part as the result of inconsistent and insufficiently precise legal provisions. Thus, a special emphasis was put on the provisions that do not fully serve the reform priorities and the segments that do not correspond to international documents and the practice of European courts. The analysis offers alternative solutions and concrete recommendations to overcome the evident weaknesses in some of the existing legal provisions. This is especially true for several segments underlined in the text (provisions on interception of communications without the mediation of OTA; provisions on metadata; certain aspect in the interception of communications in the interest of security and defense; security of data; as well as the provisions on oversight and control over the interception of communications). Abstract:: This Guide is designed to support Western Balkan governments and non-state actors that are planning to establish cybersecurity Public-Private Partnerships (PPPs) as part of their public–private cooperation. Drawing on international best practice, and referencing the region’s distinctive cultural, economic, and social context, it highlights options for establishing suitable cooperation frameworks and methods for overcoming obstacles. Chapter 1 of this Guide defines and sets out the main concepts and principles that underpin the guidance on planning, establishing, and maintaining a cybersecurity PPP. Chapter 2 provides practical, advice on how to plan, set up, and run a cybersecurity PPP in the specific context of the Western Balkans. Chapter 3 presents various types of cybersecurity PPPs and offers concrete examples from the Western Balkans and other parts of the world. A second text entitled “Legal and policy frameworks in Western Balkan economies on PPPs in cybersecurity” provides a succinct overview of the frameworks already in place in the Western Balkan economies.

9. Cyber Threats During The COVID-19 Outbreak and Activities of National CERTS in the Western Balkans

Abstract:: This report outlines cyber incidents and response of national Computer Emergency Response Teams (CERTs) in Western Balkan economies in Spring 2020, during the first months of COVID-19. Through surveys and feedback gained from national Western Balkan CERT teams, this report analyses specific challenges faced and provides insights on how transnational and private sector cooperation could further improve cyber incident response in the region. In a COVID-19 world, where many services have moved online at accelerated speed, there are exponentially more cyber threats to not only individuals and businesses, but also healthcare facilities, educational institutions, critical infrastructure and state organs. This report outlines how in the Western Balkan region, the largest vector of cyber threats during the early months of COVID-19 came from traditional phishing campaigns targeting and exploiting public health and safety concerns during the pandemic. Following survey conducted with Western Balkan national CERTs, the report categorizes activities and joint efforts of the CERTs during the outbreak of COVID-19 into two main categories: 1. Public awareness raising efforts and public security warnings; 2. Extended trainings and educational activities. The report concludes by emphasizing the need and interest for more regional and international cybersecurity co-operation in the Western Balkan region, which was confirmed by several national CERTs during a regional meeting held in preparation for the drafting of this report.

Abstract:: Increased cooperation between Western Balkan economies in the face of continuously increasing cyberattacks, cybercrime and hybrid threats present a key goal of numerous recent European declarations and initiatives. The Declaration of the 2020 Zagreb Summit between the European Union and Western Balkan leaders notes that so-called hybrid activities originating from third-state actors, including disinformation around COVID-19, have become increasingly prevalent in the Western Balkans and calls for increased cooperation to address such threats. Additionally, The Digital and Green Agenda for the Western Balkans, the Regional Cooperation Council, the Regional School of Public Administration and other regional initiatives provide a general framework for enhanced cooperation. In addressing these important issues, this paper identifies the ways in which closer regional collaboration is beneficial for building resilience, enhancing regional cybersecurity and enhancing strategic communication, collaboration and partnerships. The cybersecurity workforce shortage, skills gap and slow progress in public administration reforms are significant concerns for economic development and national security in the region, especially given the rapid digitization of global and regional economies.

Abstract:: As the interwoven threats and opportunities of cybersecurity and digital development grow more complex, and geopolitical tensions rise, both donors and recipients should look towards a more holistic understanding of capacity building in the Western Balkans, while embracing an approach which enables meaningful international engagement on the peace and security of cyberspace. Continued interest and investment in cybersecurity capacity building in the region clearly indicates that the Western Balkans remain strategically important for a number of international actors. Systematic coordination-by-design methodologies and best practices among donors that utilise whole-of-society and multi-stakeholder approaches can improve the legitimacy, ownership and sustainability of outcomes in the context of persistent challenges to human capacity, political will, and resource scarcity. Furthermore, to better define the roles of different capacity building actors, help identify opportunities for strategic partnerships, and clarify donor-recipient relationships, donors should seek to strengthen the links between policy objectives and strategies for capacity building interventions. This discussion paper explores how cyber capacity building actors and initiatives in the Western Balkans could be better coordinated, while considering the barriers to reaching cyber maturity in the region. Firstly, the paper offers a brief overview of projects, donors, and implementing organisations active in the Western Balkans, based on desk research and a series of interviews with relevant stakeholders. Secondly, the paper explores best practices on coordination through the framework implemented by Operational Guidance for the EU’s International Cooperation on Cyber Capacity Building. Based on the above findings, practical insights and recommendations are proposed, with an eye towards enhancing future cybersecurity capacity building investment

Abstract:: Parliaments play an indispensable role in good security sector governance. As democratically elected representatives, parliamentarians ensure that individual and collective security is provided in accordance with the will of the people. This also requires that security sector institutions subject themselves to parliamentary oversight, which is one of the primary means of verifying that security actors respect the mandate they are given. This comparative study gathers observations and lessons drawn from specific country cases, all of which have wider applicability in the field of SSG/R and can be used to inform future policy choices and SSR interventions. The study maps out challenges, remedies, and opportunities for parliaments in exercising security sector oversight, through the analytical lens of the “triple A” framework – authority, ability, and attitude – all of which are necessary conditions for parliaments to play an effective role in SSG. Case studies from Colombia, The Gambia, North Macedonia, and Tunisia form the basis of the comparative analysis in this text, which examines cross-national patterns of institutional variation and their efficacy in contributing towards good SSG.

Abstract:: The use of police force, either in the context of management of public assemblies and demonstrations or in the context of more routine police functions such as searches, seizures or arrests, has come under increased scrutiny around the world. Latin America, in particular, has become the epicentre of a wave of police reforms triggered by incidents involving the use of force. This publication aims to provide guidance on the key pillars that shape governance of police use of force. The paper focuses on the three main dimensions of the use of force: rule of law, human resources, and accountability. The document was built upon the work that DCAF has undertaken with police organisations in different regions and is informed by DCAF’s decades of experience supporting police reform processes across a range of countries. It offers specific examples to illustrate the context-dependent nature of each countries’ practices. While some of the examples come from countries with relatively low levels of crime and violence, the rationale behind their use of force practices is still worth considering as the underlying principles can often be adapted even to contexts that are more fragile or complex.

Abstract:: This paper examines the interlinkage between SSR and transitional justice as complementary tools to provide a platform for reconciliation, reforming abusive institutions and ensuring oversight and accountability of the justice and security sector. Looking at the case of The Gambia, the paper argues that SSR should be considered as an integral component to transitional justice, under the pillar of the guarantee of non-recurrence, which require states to take all necessary measures to prevent recurrence of violations, including the necessary reforms to shape its security sector in such a way that fully enshrines respect for human rights. An integrated approach to SSR and transitional justice implies the need to “deal with the past” as a core objective of the SSR agenda while ensuring an effective coordination and communication between the two processes so that SSR is continuously fed by and mindful of the proceedings of the Truth, Reconciliation and Reparations Commission (TRRC). Furthermore, “dealing with the past” in the framework of SSR implies addressing the issue of potential vetting of security personnel allegedly involved in past abuses. In parallel, the transitional justice process constitutes an opportunity for the Government to initiate legal and judicial reforms required for effective prosecution of those allegedly responsible for serious violations of human rights committed during the past regime. While the paper argues that more could have been done to link SSR and transitional justice in The Gambia, the release of the TRRC report in the coming weeks will constitute a unique opportunity to effectively integrate transitional justice into the SSR agenda. The adoption of proper mechanism and strategies will be critical to ensure transparent and inclusive review of and dialogue around the recommendations of the TRRC as they pertain to the security sector to ensure that these recommendations are a matter of public interest and that they duly (re)shape the SSR agenda.

Abstract:: The United Nations’ 2030 Agenda is a global action plan for sustainable development and a key priority for the UN and its member states. Within the 2030 Agenda, SDG 16 has a pivotal role highlighting the security-development nexus and emphasizing the need for strong institutions which adhere to good governance principles. The achievement of SDG 16 requires that national security sectors are well governed, subject to civilian oversight, and respectful of human rights and the rule of law. Abstract:: In the context of the Canadian-led Elsie Initiative aiming to reduce barriers for uniformed women in UN Peace Operations, DCAF has developed the Measuring Opportunities for Women in Peace Operations (MOWIP) methodology, in partnership with Cornell University and research institutions in eight troop- and police contributing countries across the world. The MOWIP methodology aims to provide institutions with the evidence base necessary to design effective interventions which substantially increase the number of women who deploy. While it is currently being piloted in 7 other countries, the MOWIP methodology was successfully implemented in Zambia with the Zambia Police Service (ZPS) between May 2019 and March 2020, in partnership with the Southern African Centre for the Constructive Resolution of Disputes (SACCORD). This resource highlights the key takeaways from the process of implementing the MOWIP methodology in Zambia along with good practices and lessons learned at each stage, including the preparation phase, the data collection phase, the data analysis phase and the validation phase. It aims to provide guidance to TPCCs or security institutions interested in implementing the MOWIP methodology themselves regarding the resources and time commitment required, and outlines the outcomes and benefits of undergoing the Barrier Assessment for the ZPS.

Abstract:: Comprehensive and practical, these guidelines are designed to support Liberian lawmakers in applying human rights principles to their work in security sector reform and governance. In their capacity as the peoples’ representatives, parliamentarians have a critical role to play in promoting respect for human rights. This is even more relevant in Liberia, where security institutions are often reported as the most prominent violators of human rights, notably among vulnerable groups, such as women and LGBTI persons. Therefore, it is essential to reassert that respect for human rights is an obligation deriving from both international instruments and the Liberian Constitution, and to strengthen the security sector’s compliance with these legally binding instruments. Through their core functions of oversight, law-making and representation, Liberian legislators possess an array of tools to help them achieve this objective. However, their lack of basic human rights knowledge and key reform and governance concepts hampers their effective use of these tools. These guidelines aim to bridge this knowledge gap and suggest concrete steps to help Liberian Legislators succeed in this endeavour. Following a brief discussion on why Liberian lawmakers must actively promote respect for human rights in the security sector (Chapter 1), these guidelines lay out what the main international human rights standards and instruments are (Chapters 2 and 3), and make suggestions on how legislators can integrate them in their daily practice (Chapter 4).

Abstract:: This paper provides insights into intelligence reform efforts in Croatia, including lessons learned by the author during his tenure as director of Croatia’s Security and Intelligence Agency and recommendations for reform efforts in countries in transition. More specifically, the paper provides insights into the main challenges faced during the reform processes, starting from the adjustments of the legal frameworks, to the implementation of the reform agenda. As a starting point, the agency’s self-assessment helped to identify intelligence requirements and priorities and pointed to the need of investing in the development of new and effective intelligence capabilities within the service. Maybe one of the most important insights was the acknowledgement that effective oversight helped earning public trust and respect. Modernization and transformation processes had to address decentralization of authority, the balancing of privacy rights and the initiation of a public dialogue on the role and future of intelligence.

Abstract:: This report is a two-factor analysis of cybersecurity, including the legislative framework and key national actors in cybersecurity. The report presents the main cybersecurity threats in Moldova and the needs arising from national security objectives. After analysing the national cybersecurity strategy for Moldova, an identification and need for the main actors within the state who would be responsible for the implementation of the national strategy on cybersecurity was undertaken. A national action plan for cybersecurity was designed. It was understood that for a responsible and developed society there is a necessity to collaborate with the private sector and academia, and thus a robust cooperation and communication mechanism was described to include all the relevant stakeholders. The report reflects the conclusions and final remarks that have made the operational cybersecurity architecture in Moldova an elaborate framework.

Abstract:: This paper seeks to identify the emerging and expanding gaps in the governance of private cybersecurity companies and activities and to explore ways forward and policy options for governments. The first section of the paper will explore the characteristics of typical cyber operations and challenges related to their conduct by private actors. Section two will address the governance challenges around cybersecurity and three main departure points for regulation: the fact that geographic scope does not limit cybersecurity companies, that cyber operations can slide from defensive to offensive very quickly; and that cybersecurity services are often exported for the purpose of (or with the knowledge they will be) violating human rights. This section will also integrate perspectives of international law. Section three will lay out suggestions for policy options in relation to international law and existing international normative frameworks. In conclusion, the paper will offer a framework and way forward as food for thought in order to address cybersecurity operations in relation to PMSCs.

48. Event Report: Exchange of Legislative Experiences on the Governance of the Security Sector in Colombia

Abstract:: The election of a new Congress in Colombia in March 2018 provided an opportunity to work on security sector governance and strengthen the role of Congress in overseeing the security sector in a way that helps the country face its current and future challenges. International experiences from other countries can provide relevant technical and conceptual lessons that can enrich the work of the Colombian Congress in matters of security. In this context, the Geneva Centre for Security Sector Governance (DCAF), the Friedrich Ebert Stiftung in Colombia (FESCOL), the Folke Bernadotte Academy (FBA) and the Swedish Embassy in Colombia organised a forum on legislative experiences in security sector governance. The forum took place on the 6th of December 2018 in the Hall of the Constitution of the Colombian Congress in Bogotá and was attended by members of the Colombian Congress as well as parliamentarians from Sweden, Germany and the Philippines. The purpose of this event was to enable participants to partake in the debate over the role of the legislative vis-à-vis the security sector, allowing members of the Colombian Congress and their international counterparts to share lessons learned and promote good practices in security sector oversight. The event was moderated by the Honourable Senator Rodrigo Lara Restrepo, who was the Speaker of the House of Representatives (2017–2018). This Event Report summarises the presentations and discussions of the event and includes two Think Pieces produced by Dr. Mario J. Aguja for this event.

Abstract:: SSR for Safer Cities - Supporting States to Achieve SDG 11 Safety and security has already become an urban experience for more than half of the world’s population. Against this backdrop, SDG 11 seeks to bring sustainable and peaceful development to the people who live in cities by calling on states to “Make cities and human settlements inclusive, safe, resilient and sustainable”. Yet high rates of urban violence reflect a failure to address the challenges of urbanization in national and donor-supported strategies for security and development. Urban violence exacerbates state fragility and human suffering, endangers local and regional peace, and drives uncontrolled migration. This fact demonstrates the urgency of linking SDG 11 with SDG 5 on women’s empowerment and SDG 16 on peaceful, just and inclusive societies. Within this larger priority there is now a pressing need to address the immediate challenges of SSR in urban contexts, manifests in the purpose of DCAF’s Policy and Research Division project “SSR for Safer Cities” supported by the Human Security Division of the Swiss Federal Department of Foreign Affairs. As part of the project, three case studies on security in cities conducted by local experts over the course of 2018 examine SSR within the urban realm; the selected cities are Bogotá, Cape Town and General Santos City.
