Since the early days of the Syrian uprising in 2011, President Bashar al-Assad’s regime has made it a priority to keep state agencies running, allowing Assad to claim that the regime is the irreplaceable provider of essential services. Breaking the regime’s monopoly on these public services and enabling the moderate opposition to become an alternative source of them would weaken the regime and prevent the radical jihadist Islamic State from emerging to fill power vacuums across the country.

The Bharatiya Janata Party’s (BJP’s) historic victory in India’s 2014 general election prompted declarations of a watershed in the behavior of the Indian voter. Upon closer inspection, the reality is more nuanced. On some parameters, such as voting based on economic and ethnic considerations, there were indeed discernible changes. However, the empirical evidence suggests these shifts were well under way before 2014. In other areas—namely, support for regional parties, dynastic politicians, and candidates associated with criminal activity—contemporary voters demonstrated much greater continuity with the past.

Three years after the uprising that ousted Hosni Mubarak from power, Egypt continues to grapple with an authoritarian state. Throughout the rise and fall of the Muslim Brotherhood, authoritarian forces remained the key political players. Democratic alternatives have not capitalized on cracks in the system. Prospects for the Brotherhood's political reintegration and a democratization of political Islam are bleak. As long as credible alternatives fail to gain traction, the old state will persist and Egypt's central challenges will remain unresolved.

More than three years after the January 25 revolution toppled then Egyptian president Hosni Mubarak, Egypt continues to struggle with an authoritarian media sector and constraints on freedom of expression. Postrevolution regimes have not capitalized on opportunities to reform state and private media, and critical voices have been harassed and marginalized by state and nonstate actors. As long as Egypt continues to be governed by rulers who believe controlling the media is in their best interest, reform will only come about through the few dissident voices in the media backed up by support from civil society and the masses.

Turkey's ruling Justice and Development Party (AKP) has witnessed economic success and launched major reforms, in particular writing a new constitution, negotiating with the Kurdistan Workers' Party, passing four judicial reform packages, and installing an ombudsman. In sharp contrast, the AKP's exclusive reliance on its election victories for legitimacy and increasingly authoritarian practices in the fields of freedom of cultural expression and coexistence of different lifestyles are at odds with its stated objective of establishing an advanced democracy. Popular discontent with these practices and unending restrictions on media freedom resulted in major protests in May and June 2013.

Islamists have become an important political force in Mauritania since formal Islamist associations first emerged in the 1970s. Islamist activism has contributed to the ongoing Islamization of Mauritanian society, as is evident from the proliferation of mosques and Islamic associations in the capital, Nouakchott, and elsewhere. In the 1990s, political liberalization allowed Islamists to participate in elections as independents, and since its legalization in 2007, Tewassoul, the strongest Islamist party in Mauritania today, has become a significant minority voice in the country's politics and has built ties with Islamists elsewhere in the Arab world. These moderate Islamists who participate in elections hold different beliefs and goals from Mauritania's jihadist fringe. Overall, Mauritanian Islamism does not currently pose a threat to the United States. The mainstream of the movement appears committed to democracy and, even so, is unlikely to take power. Islamist parties like Tewassoul have never captured a large share of the vote in elections, and moderate Islamist leaders have explicitly rejected using violence to take over the state. Indeed, the United States may even find an upside to the Islamists' rise: Mainstream Islamist leaders publicly condemn the Muslim terrorist group Al-Qaeda in the Islamic Maghreb (AQIM), which the Mauritanian government has been combating since 2005.

Egypt's tumultuous uprising of 2011 was about many things, but among the most central was a demand by legions of political activists and large crowds of mobilized citizens that public authority in the country be reconstructed to operate in a clearly accountable manner, fully governed by the rule of law. Egyptian judges might therefore be expected to look upon the post-uprising environment as a time when they can finally realize a vision that they have been articulating for a generation in the face of an imperious and impervious presidency: A state ruled by law in which they will be insulated from political pressures and private interests, providing full autonomy to individual judges and to the judiciary as a body to issue decisions that will be respected and implemented by all the agencies of the Egyptian state.

Large-scale violence immediately flared up again, with a series of terrorist attacks against mostly Shi'i targets reminiscent of the worst days of 2006.

Workers have long sought to bring change to the Egyptian system, yet the independent labor movement has only recently begun to find a nationwide voice. As Egypt's sole legal trade union organization and an arm of the state for nearly sixty years, the Egyptian Trade Union Federation (ETUF) has had a monopoly on representing workers. Though its mission is to control workers as much as it is to represent them, ETUF has been unable to prevent the militant labor dissidence that has escalated since the late 1990s. Workers were by far the largest component of the burgeoning culture of protest in the 2000s that undermined the legitimacy of the Mubarak regime.

The implementation of economic reform amid this uncertainty is particularly challenging as political demands take precedence. The state attempted several times to revive the Egyptian economy since the Infitah, or “open door,” policy initiated by President Anwar Sadat in the mid-1970s. Successive, though unsuccessful, reform programs during the 1990s contributed to the pervasive poverty that served as a central driver of the 2011 Egyptian revolution and persists today. Past experiences can provide useful lessons for what to avoid in the future, even if they are unable to impart what exactly should be done.

Many observers, Afghan and foreign alike, have decried the inclusion of warlords in the new governmental structures as the chief corrosive agent undermining efforts to reconstruct the state. Indeed, warlord governors have not been ideal government officials. They have employed informal power and rules, as well as their personal networks, to preserve control over their respective provinces. Pessimism about the progress of democracy in the developing and postcommunist worlds has risen sharply in recent years. Negative developments in a variety of countries, such as military coups, failed elections, and the emergence of antidemocratic populist leaders, have caused some observers to argue that democracy is in retreat and authoritarianism on the march. A broad look at the state of democracy around the world reveals however that although the condition of democracy is certainly troubled in many places, when viewed relative to where it was at the start of this decade, democracy has not lost ground in the world overall. The former Soviet Union is the one region where democracy has clearly slipped backward in this decade, primarily as a result of Russia's authoritarian slide. The Middle East has also been a source of significant disappointment on democracy but mostly in comparison with unrealistic expectations that were raised by the Bush administration. In most of the rest of the world good news with respect to democratization is found in roughly equal proportion to bad news and considerable continuity has prevailed as well.

Algerians no longer live in fear of being killed by radical Islamists at faux barrages (makeshift roadblocks) or of being “disappeared” by “ninjas” — hooded police - men who break down front doors and take occupants away, never to return. This is a remarkable achievement in a country that during the 1990s was synonymous with horrendous violence perpetrated both by Islamist radicals and by security forces. Algeria has regained stability, with radical Islamism no longer a fundamental threat to security across the country. The virtual quarantine in which the country was confined during the mid-1990s has been lifted. It is also increasingly opening up to foreign investment. Algerians have enjoyed a period of peace and relative prosperity, despite occasional flare-ups of violence. During the presidency of Abdelaziz Bouteflika, who took office in 1999, Algeria has transitioned from civil war, state failure, and moral decay to stability.

Concerns about security and stability have now virtually halted U.S. democracy promotion efforts. Incumbent regimes in the Arab world, monarchical and republican alike, have weathered the period of intense, worldwide political change that has followed the end of the Cold War without giving up much of their power. Though not completely untouched by events that have shaken the rest of the world, most Arab regimes have survived the wave of political transformation that has engulfed the rest of the world relatively intact. Many regimes have carried out reforms, but the reforms have been directed at modernizing the economy and addressing social issues rather than redistributing power in the political system. Indeed, most regimes that talk of political reform are in reality avoiding it. To be sure, there have been some political changes: For example, more political parties exist today in most Arab countries than fifteen years ago, and more countries hold elections of varying quality. Access to information and the quality of political debate have increased in many countries as well. Power, however, remains firmly where it was: in the hands of kings and presidents.

Kuwait has a long history of consultative government, constitutionalism, and participatory politics unique among the monarchies of the Gulf region. The ruling Al Sabah family's place in the political system was established by agreement—not force—among the leading families of the trading city of Kuwait in the mid-eighteenth century; administration by consultation continued until the late nineteenth century. In the twentieth century, while the country was a British protectorate, authoritarian tendencies within the ruling family were countered by a strong constitutional movement that started in the 1920s, bore fruit in parliamentary elections in 1938, and resulted in a fairly democratic constitution when the country became independent in 1961. Since then, Kuwait has had 11 parliamentary elections, and the National Assembly has continued to play a very powerful role in the state.

Since independence in 1947, Jordan has shown a remarkable ability to survive as a political entity. Surrounded by regional conflict and starved of resources, it has endured a massive influx of Palestinian refugees and numerous coup attempts. For decades, the Hashemite monarchy has overcome these political and economic storms by weakening institutionalized opposition to its rule and relying on the distribution of benefits and privileges to create a cohesive support base and a security establishment loyal to the existing political order. The regime has been able to sustain this situation by capitalizing on Jordan's geographic centrality. Benefiting from Jordan's image as an oasis of stability in a deeply troubled region, the monarchy has been able to secure a flow of external assistance that has helped counteract the lack of natural resources and maintain domestic political stability. But the balance has always been precarious. The contemporary process of political reform in Jordan must be understood in this context.

The political opening that began in late 2004 in Egypt has been unlike any seen in the country in at least twenty years, perhaps in a half century. It has resulted so far in Egypt holding its first-ever presidential election as well as parliamentary elections that were significantly fairer and more transparent than in the past, although marred by violence. Political dissidents are making bolder demands, most of the taboos on criticizing the regime have been swept away, and there is now more opposition representation in Parliament than at any time since the 1952 Free Officers' coup. The Muslim Brotherhood, an illegal organization but also the only effective opposition party, made dramatic gains in the fall 2005 elections. And this new momentum is probably irreversible. Russia's regime has gone through a major aggravation during the first year of President Vladimir Putin's second term. The regime suffers from serious overcentralization of power, which has led to a paralysis of policy making. Putin's power base has been shrunk to secret policemen from St. Petersburg. Although his popularity remains high, it is falling. Neither unbiased information nor negative feedback is accepted. As a result, the Putin regime is much more fragile than generally understood. Russia's current abandonment of democracy is an anomaly for such a developed and relatively wealthy country, and it has made Russia's interests part from those of the United States. The United States should not hesitate to promote democracy in Russia, while pragmatically pursuing common interests in nonproliferation and energy.

Bush speaks of the United States having a “calling” or “mission” that has come from the “Maker of Heaven.” Yet, while he uses explicitly religious language more than his immediate predecessors, there is nothing exceptional about a U.S. president resorting to religious themes to explain his foreign policy. U.S. goals in the world are based on Protestant millennial themes that go back to seventeenth-century England. What has distinguished Bush from some of his predecessors is that these religious concepts have not only shaped his ultimate objectives but also colored the way in which he viewed reality—sometimes to the detriment of U.S. foreign policy.

If they fail, the United States will be faced with a choice of whether to keep the country together by force or get out—and it is better to find out sooner rather than later.

This short paper launches the second set of studies in the Carnegie Papers Middle East Series. The first set, now also published as a book under the title Uncharted Journey: Promoting Democracy in the Middle East, examined the most important issues concerning democracy promotion and democratic change in the Middle East. One of the conclusions that emerged from those studies is that the Middle East still offers a rather discouraging political picture. There are some liberalized autocracies but no democratic countries in the region. The link between economic and political reform remains weak. Democratic reformers have failed to build strong constituencies, and the organizations with strong constituencies are Islamist rather than democratic. The integration of Islamists in the reform process remains poor. And the United States, now championing democracy in the region, has little credibility in Arab eyes, and still has not consistently integrated democracy promotion in its policy toward the area. Yet, despite all these problems, it is becoming increasingly clear that there is a ferment of reform in the Middle East. But how significant is it?

DELIBERATION OF DEMOCRACY PROMOTION IN THE MIDDLE EAST intensified after the attacks of 9/11, and has been further energized by the transatlantic debates that were progeny of the Iraqi conflict. More intense debate over support for political change in the Middle East has forced the United States and Europe into a closer exploration of each other's actual and intended approaches to democracy promotion in the region. Debates have centered, in particular, on preparations for June's Group of Eight (G8) and EU–U.S. summits and the United States' proposed Greater Middle East Initiative. While many in the U.S. bemoan European irresolution, others acknowledge the need for American policy to understand and harness the EU's more pervasive presence in much of the Middle East. While Europeans express dismay at the Bush administration's heavy-handed instrumentalism, they have also been forced to engage with new U.S. initiatives that appear to heed the EU's own pleas for a focus on the root causes of instability. With the U.S. and EU eyeing each other over the parapets of their Iraqi-inspired wrangles, it is an opportune moment to delineate and critically assess how Europeans have developed their democracy promotion policies in the Middle East.

The Bush administration is preparing to launch a “Greater Middle East Initiative” at the G-8 summit meeting in June. The plan is to bring the United States, Europe, and the Middle East together around a set of commitments to help transform the region politically and economically. The time is indeed opportune for engagement on regional reform, but as planned, the initiative fails to establish a basis for genuine partnership and does little to address the real challenges of Arab democratization. The administration should rethink its approach and start a new process of genuine consultations to come to an agreement on how all three sides can work cooperatively to address the regional problems that threaten the security of Arab societies and the West.

IN THE THREE YEARS SINCE THE TERRORIST ATTACKS of September 11, 2001, the question of Arab reform not only has become closely linked in the minds of Western policy makers to the fight against Al Qaeda, but also has become a dominant theme of discussion in the region itself. Arab satellite television stations broadcast talk shows featuring vigorous discussions about the persistence of authoritarian rule in Arab countries and the incompetence of incumbent regimes. The opinion pages of Arab newspapers are replete with articles championing democratic reform as the only way to strengthen the region against Western control, or, conversely, to connect it with globalization and “modernity.” Civil society groups, political parties, and even business organizations are promulgating reform manifestos with increasing regularity. Political reform is also the focus of heated debates in unexpected circles such as the Egyptian Muslim Brotherhood and the Saudi royal family. All Arab governments have acknowledged the need for reform in principle (some have even talked of democracy), and many have announced their own reform initiatives.

No American administration has talked more about democracy in the Middle East than the Bush administration. The president and his advisors have spoken optimistically about a post-Saddam democracy in Iraq, one that might eventually become a veritable light to other Arab nations. This grand vision assumes that sooner or later, advocates of democracy throughout the Middle East will demand the same freedoms and rights that Iraqis are now claiming. Yet, however inspiring this vision appears, the actual reform plan that the administration has thus far set out is unlikely to produce radical changes in the Arab world. Regardless of how dramatic the change in Baghdad is, when it comes to our friends in Egypt, Jordan, Kuwait, Morocco, and Yemen, the administration's reform plan points to evolution rather than revolution.

Since early last year, the Bush administration has paid unaccustomed attention to the issue of democracy in the Middle East. Following September 11, many U. S. officials have worried that the authoritarianism of most Arab regimes has bred frustration in their countries, and this frustration has in turn favored the growth of terrorist organizations. U.S. discussions about the need for democracy in the Middle East have triggered a strong negative reaction by Arab commentators and journalists, including in discussions of democracy in the Arab press. However, very little of this writing has dealt with the problem of democracy in the real sense—that is, with the issue of how Arab governments relate to their citizens now and how they should relate to their citizens in the future. Instead, Arab commentators have treated democracy as a foreign policy issue, asking why the United States is suddenly discussing democracy in the Arab world and what true intentions it is trying to hide behind the smoke screen of democracy talk. The debate in the Arab press reveals some of the obstacles that the United States faces as it attempts to define its new pro-democracy role in the Middle East.

Although the current rule-of-law promotion field is still expanding as it approaches the end of its second decade, it still faces a lack of knowledge at many levels of conception, operation, and evaluation. There is a surprising amount of uncertainty, for example, about the twin rationales of rule-of-law promotion—that promoting the rule of law will contribute to economic development and democratization. There is also uncertainty about what the essence of the rule of law actually is—whether it primarily resides in certain institutional configurations or in more diffuse normative structures. Rule-of-law promoters are also short of knowledge about how the rule of law develops in societies and how such development can be stimulated beyond simplistic efforts to copy institutional forms. And the question of what kinds of larger societal effects will result from specific changes in rule-of-law institutions is also still open. Although aid institutions engaged in rule-of-law assistance do attempt some—lessons learned—exercises, many of the lessons produced are superficial and even those are often not really learned. Several substantial obstacles to greater knowledge accumulation in this field persist, including the complexity of the task of promoting the rule of law, the particularity of legal systems, the unwillingness of aid organizations to invest sufficient resources in evaluations, and the tendency of both academics and lawyers not to pursue systematic empirical research on rule-of-law aid programs. Whether rule-of-law aid is on the path to becoming a well-grounded field of international assistance remains uncertain.

The increasingly popular idea in Washington that the United States, by toppling Saddam Hussein, can rapidly democratize Iraq and unleash a democratic tsunami in the Middle East is a dangerous fantasy. The U.S. record of building democracy after invading other countries is mixed at best and the Bush administration's commitment to a massive reconstruction effort in Iraq is doubtful. The repercussions of an intervention in Iraq will be as likely to complicate the spread of democracy in the Middle East as promote it. The United States has an important role to play in fostering democracy in the region, but the task will be slow and difficult given the unpromising terrain and lack of U.S. leverage over key governments.

As governments and donor agencies struggle over questions of aid and international development, a growing consensus is emerging regarding the connections between poor governance and underdevelopment. An increasing number of initiatives, from the U.S. Millennium Challenge Account to the New Partnership for African Development (NEPAD), explicitly link improving governance with pursuing sustainable development and poverty alleviation. Lack of pluralism and transparency, inefficient bureaucracies, and underdeveloped public institutions contribute to corruption, reduce governmental responsiveness to citizens' needs, stifle investment, and generally hamper social and economic development. A frequent donor favorite on the laundry list of “good governance” reforms advocated for developing countries is rule of law reform. The new development model contends that sustainable growth is impossible without the existence of the rule of law: a set of uniformly enforced, established legal regimes that clearly lays out the rules of the game.

JUDICIAL REFORM EFFORTS IN LATIN AMERICA, and by extension worldwide, seem to fall easily prey to magic bullets. In the past two decades, reformers in the region and aid providers from North America and Western Europe have seized upon a whole series of entry points for judicial reform—including model codes, accusatory criminal justice systems, court administration reforms, information technology, alternative dispute resolution, legal services, and constitutional courts. Sometime during the late 1980s, as the issue of judicial independence came to receive more serious attention, judicial councils joined the list, and nearly a dozen countries adopted them. It was not until the late 1990s that questions about their utility began to emerge. Although Latin America is beginning to reexamine its love affair with the councils, the model has been gaining ground in other regions. Western Europeans, who invented the mechanism, have been suffering their own doubts. This has not prevented their joining with U.S. reformers in recommending it to postcommunist nations in Eastern Europe and the former Soviet Union and in Africa, Asia, and the Middle East. The cautionary lessons from Latin America's several-decade experiment with judicial councils have not yet been analyzed and disseminated. This essay is a start in that direction.

IN LATE 1999, tens of thousands of people filled the streets of Seattle in one of the most visible manifestations of civil society in recent decades. They had gathered to show their opposition to the World Trade Organization (WTO) and the broader forces of economic integration that it represents. The WTO, which was meeting to set an agenda for a proposed new round of global trade negotiations, found it- self under scrutiny as never before. For several days, television news shows around the world displayed protesters being gassed and arrested by the hundreds. Although media reports portrayed the protesters as a combination of American labor unionists who wanted to protect their jobs at the expense of Third World workers and hippies left over from the 1960s, in fact the protesters represented a broad and to some degree transnational coalition of concerns. They objected not only to the WTO's ability to override domestic environmental legislation but also to the very nature of the processes by which governments and corporations are fostering economic integration.
