Abstract:: In recent years, religious pluralism has become the focus of intense debate in Europe - from controversies regarding religious clothing and symbols in the public sphere, to those related to limits on religious speech and the accommodation of religious practices - owing to the perception that pluralism has failed to contend with the purported incommensurability of Islam and European society. This article examines this purported crisis of religious pluralism in Europe and argues that while it is often depicted as resulting from the particularities of Islamic culture and theology, recent controversies point to a deeper crisis born of a historical failure to resolve the question of the governance of religious subjects.

Abstract:: This analysis offers an evaluation of the last three elections of the Kurdistan Regional Government (KRG) in Iraq. These three elections included the regional parliamentary elections in September 2013, and the local and federal elections held simultaneously in April 2014. The KRG, as a federal region, exists in the north of Iraq where Kurds have managed their own affairs through a regional government since 1992. The KRG elections have very little in common with elections in the rest of Iraq. Compared to the rest of Iraq, the "region" has experienced a very different trajectory during the last two decades. As a postwar region, the KRG strives to solidify a stable democracy in a landlocked region, which suffers from minimal economic capital and weak democratic culture.

Abstract:: The main orientation of Turkish foreign policy has recently been described as Europeanization, Middle Easternization, or Islamization. This article offers an alternative reading of its discourse as a civilizational one, arguing that the concept of civilization has increasingly, albeit vaguely, been employed in Turkish foreign policy discourse in three different layers - national, regional and universal. Turkish foreign policy makers often invoke (and occasionally switch between) these different layers of civilization in a flexible manner, which adds dynamism to Turkish policies. Often integrated with the domestic and foreign policies of the AK Party government, this pragmatic discourse has proved useful for its proactive and assertive diplomacy. Based on the discourse analysis method, this article explores how and why the concept of civilization is utilized within this discourse.

Abstract:: The EU has been successfully exercising its conditionality as a key aspect of its enlargement strategy since the 1990s. However, with no accession prospect in sight and the perceived lack of credibility and consistency of the EU's conditionality, Turkey's already unequal partnership with Europe has been thrown further off balance. This article argues that this is not the case, as the EU retains its leverage over Turkey, even in the absence of factors that are known as central to the successful implementation of the EU's conditionality. This article suggests two main reasons. First, despite the rhetoric on the interdependence of Turkish and the EU economy, this interdependence is not on equal footing and the Turkish economy is heavily dependent on the EU. Second, there is rising concern in Turkey over free trade talks between the EU and the United States, with its potential impact on the Turkish economy.

Abstract:: When U.S. President Barack Obama cancelled a scheduled September 2013 summit meeting with his Russian counterpart, Vladimir Putin, “lack of progress on issues such as missile defense” was cited as the primary justification. Despite widespread and well founded assumption that the real trigger for the cancellation was the Russian decision to offer temporary asylum to Edward Snowden, the citing of missile defense was indicative. The comment marked one of the periodic plateaus of mutual frustration between the United States and Russia over U.S. attitudes to missile defense capability, stemming from a continued failure to achieve meaningful dialogue over U.S. plans and Russian fears.

5415. Versailles Redux? Eurozone Competitiveness in a Dynamic Balassa-Samuelson-Penn Framework

Abstract:: Prima facie, competitiveness adjustments in the eurozone, based on unit labor cost developments, appear sensible and in line with what the economic analyst might have predicted and the economic doctor might have ordered. But a broader and arguably better—Balassa-Samuelson-Penn (BSP)—framework for analyzing these adjustments paints a very different picture. Taking advantage of the newly released PPP-based estimates of the International Comparison Program (2011), we identify a causal BSP relationship. We apply this framework to computing more appropriate measures of real competitiveness changes in Europe and other advanced economies in the aftermath of the recent global crises. There has been a deterioration, not improvement, in competitiveness in the periphery countries between 2007 and 2013. Second, the pattern of adjustment within the eurozone has been dramatically perverse, with Germany having improved competitiveness by 9 percent and with Greece's having deteriorated by 9 percent. Third, real competitiveness changes are strongly correlated with nominal exchange rate changes, which suggests the importance of having a flexible (and preferably independent) currency for effecting external adjustments. Fourth, internal devaluation—defined as real competitiveness improvements in excess of nominal exchange rate changes—is possible but seems limited in scope and magnitude. Our results are robust to adjusting the BSP framework to take account of the special circumstances of countries experiencing unemployment. Even if we ignore the BSP effect, the broad pattern of limited and lopsided adjustment in the eurozone remains.

5416. Turkey and the PKK: Saving the Peace Process

Abstract:: The peace process to end the 30-year-old insurgency of the Kurdistan Workers' Party (PKK) against Turkey's government is at a turning point. It will either collapse as the sides squander years of work, or it will accelerate as they commit to real convergences. Both act as if they can still play for time – the government to win one more election, the PKK to further build up quasi-state structures in the country's predominantly- Kurdish south east. But despite a worrying upsurge in hostilities, they currently face few insuperable obstacles at home and have two strong leaders who can still see the process through. Without first achieving peace, they cannot cooperate in fighting their common enemy, the jihadi threat, particularly from the Islamic State in Iraq and Syria. Increasing ceasefire violations, urban unrest and Islamist extremism spilling over into Turkey from regional conflicts underline the cost of delays. Both sides must put aside external pretexts and domestic inertia to compromise on the chief problem, the Turkey-PKK conflict inside Turkey.

5419. Trading Forests: Quantifying the Contribution of Global Commodity Markets to Emissions from Tropical Deforestation

Abstract:: This paper aims to improve our understanding of how and where global supply-chains link consumers of agricultural and forest commodities across the world to forest destruction in tropical countries. A better understanding of these linkages can help inform and support the design of demand-side interventions to reduce tropical deforestation. To that end, we map the link between deforestation for four commodities (beef, soybeans, palm oil, and wood products) in eight case countries (Argentina, Bolivia, Brazil, Paraguay, Democratic Republic of the Congo, Indonesia, Malaysia, and Papua New Guinea) to consumption, through international trade. Although few, the studied countries comprise a large share of the internationally traded volumes of the analyzed commodities: 83% of beef and 99% of soybean exports from Latin America, 97% of global palm oil exports, and roughly half of (official) tropical wood products trade. The analysis covers the period 2000-2009. We find that roughly a third of tropical deforestation and associated carbon emissions (3.9 Mha and 1.7 GtCO2) in 2009 can be attributed to our four case commodities in our eight case countries. On average a third of analyzed deforestation was embodied in agricultural exports, mainly to the EU and China. However, in all countries but Bolivia and Brazil, export markets are dominant drivers of forest clearing for our case commodities. If one excludes Brazilian beef on average 57% of deforestation attributed to our case commodities was embodied in exports. The share of emissions that was embodied in exported commodities increased between 2000 and 2009 for every country in our study except Bolivia and Malaysia.

Abstract:: The EU has responded to the Ukraine crisis with a set of political and economic sanctions against Russia which constitute a qualitatively new step in the EU sanctions policy. The EU sanctions against Russia are exceptional and have strategic importance due to a combination of three factors: big power rivalry, the context of a major European crisis with global ramifications, and the costs of the sanctions for the EU itself. The EU has managed to maintain its fragile unity and has applied its collective diplomatic and economic weight in very difficult circumstances. The sanctions have not provided an alternative to diplomatic efforts to solve the crisis - on the contrary, hardening sanctions have been used as a way to put pressure on Russia to seriously engage in diplomacy. The impact of the sanctions on daily developments in Ukraine has been limited and uncertain, but the sanctions have imposed a long-term cost on Russia for violating key international norms. The policy process of Russia sanctions has exposed problems of leadership and coordination. The latest reform of the EU foreign policy machinery has streamlined the preparation of sanctions, but the current system still lacks the necessary resources to match the growing importance of the EU sanctions policy.

5421. The Trans-Atlantic Trade and Investment Partnership:European Disintegration, Unemployment and Instability

Abstract:: According to its proponents, the Trans-Atlantic Trade and Investment Partnership will stimulate growth in Europe and in the US. Projections endorsed by the European Commission point to positive, although negligible, gains in terms of GDP and personal incomes. In a paradox, these projections also show that any gains in Trans-Atlantic trade would happen at the expense of intra-EU trade reversing the process of European economic integration. Furthermore, recent literature has pointed out several problems in the most influential assessment of the TTIP's effects. Projections by different institutions have been shown to rely on the same Computable General Equilibrium model that has proven inadequate as a tool for trade policy analysis. In this paper we assess the effects of TTIP using the United Nations Global Policy Model, which incorporates more sensible assumptions on macroeconomic adjustment, employment dynamics, and global trade. We project that TTIP will lead to a contraction of GDP, personal incomes and employment. We also project an increase in financial instability and a continuing downward trend in the labor share of GDP. Evaluated with the United Nations model, TTIP appears to favor economic dis-integration, rather than integration, in Europe. At a minimum, this shows that official studies do not offer a solid basis for an informed decision on TTIP.

Abstract:: The advent of Cloud computing as the new underlying global infrastructure of computing presents distinctive new opportunities and challenges for Europe. Cloud computing is transforming computing resources from a scarce to an abundant resource, driving a wave of commoditization in previously high-end software and hardware. For Europe to gain independence from US-based global scale Cloud providers, our view is that it needs to move towards a distributed model of computing with federated governance. Distributed Cloud means the distribution of computation close to the geographic location of the data and the users, as opposed to the centralized model of today. Abstract:: The Comprehensive Assessment conducted by the European Central Bank (ECB) representsa considerable step forward in enhancing transparency ineuro-area banks' balance sheets. The most notable progress since the previous European stress test has been the hamonisation of the definition of non-performing loans and other concepts as well as uncovering hidden losses, which resulted in a €34 billion aggregate capital-chargenet of tax. Despite this tightening,most banks were able to meet the 5.5% common equity tier 1 (CET1) threshold applied in the test, whichsuggests that the large majority of the euro-area banks have improvedtheir financial position sufficiently to no longer constrainthem in financing the economy.Our own estimation based on the detailed results, however,provide a more nuanced picture, with a large numberof the banks still highly leveraged and in many cases unable to meet the regulatory capital requirementsthat will be introduced in the coming years underthe adverse stress test scenario.

During the recent elections for the European Parliament, populist eurosceptic parties were in the forefront of those campaigning against the EU's enlargement agenda. Abstract:: This CEPS Policy Brief is based on a larger study for the EEAS and European Commission, written by the same authors in the run-up of the Milan ASEM summit of 16-17 October 2014. The main idea of the study is to assess whether ASEM works and how, by verifying the factual evidence in detail. After all, ASEM has no institutions, no budget and no treaty, whilst dialogues and a loose improvement over time in Asia-Europe relations refer to process much more than genuine 'results'. The stocktaking covers all ASEM activities since the 2006 Helsinki summit. Summit and foreign ministers' declarations and ASEM calendar of activities (and interviews) are used to trace ASEM activities in the three ASEM pillars (political, economic, and peoples-to-peoples/cultural). All the 'regular' ASEM meetings at ministerial and other levels (many of which are only known to relatively few) have been mapped. Also the ASEM working methods, based on the 2000AECF framework and many subsequent initiatives, have been scrutinised, including whether they are actually implemented or not or partially. Such methods refer to how to work together in areas of cooperation (beyond the typical ASEM dialogue), organisation, coordination and ASEM visibility.

Abstract:: While EU and US sanctions against Russia over its aggression in Ukraine, and Russia's counter-sanctions, are much discussed due to their evident political significance, less attention has been given to Russia's punitive sanctions against the three Eastern European states – Ukraine, Moldova and Georgia – that have signed with the EU Association Agreements (AA), which include Deep and Comprehensive Free Trade Area (DCFTA) provisions. This paper therefore documents these trade policy restrictions and embargoes imposed by Russia, and provides some first indications of their impact. The immediate impact on trade flows, especially for agri-food products, has been substantial, albeit with some leakage through Belarus. The main instrument for the Russian measures has been allegations of non-conformity with Russian technical standards, although the correlation of these allegations with movements in Russia's geopolitical postures makes it obvious that the Russian technical agencies are following political guidelines dressed up as scientific evidence. These measures also push the three states into diversifying their trade marketing efforts in favour of the EU and other world markets, with Georgia already having taken significant steps in this direction, since in its case the Russian sanctions date back to 2006. In the case of Ukraine, Russia's threat to cancel CIS free trade preferences infiltrated trilateral talks between the EU, Ukraine and Russia, leading on 12 September to their proposed postponement until the end of 2015 of the 'provisional' implementation of a large part of the AA/DCFTA. This was immediately followed on 16 September by ratification of the AA/DCFTA by both the Rada in Kyiv and the European Parliament, which will lead to its full and definitive entry into force when the 28 EU member states have also ratified it. However Putin followed the day after with a letter to Poroshenko making an abusive interpretation of the 12 September understanding.

Abstract:: In April 2014, in a departure from its normal aversion to lending to countries in conflict, the International Monetary Fund (IMF) approved a US$17 billion loan to Ukraine to be disbursed over two years. At the time, Ukraine was three weeks away from a presidential election; engaged in combat with an armed separatist movement backed by Russia, its largest trading partner and supplier of energy; and experiencing a significant drain in foreign exchange reserves and bank deposits along with soaring yields on sovereign debt. The country was also reaping the returns of decades of economic mismanagement. Dire from both political and economic perspectives, the situation had the markings of a case where the IMF has the expertise to be usefully engaged, but there were also red flags demarcating circumstances that can hobble the IMF's effectiveness.

Governance related to these dimensions is scored on the following progress scale: 0%-19% represents "major regression"; 20%-39% represents "some regression"; 40%-59% indicates "minimal progress"; 60%-79% characterizes progress; and 80%-100% represents "major progress." Recognizing the difficulty of making objective judgments given the complexity of the issues, the results are offered as a range of subjective opinions from CIGI experts with diverse backgrounds.

Abstract:: China, in the next few years, faces the prospect of major regional and bilateral trade negotiations possibly including the Trans-Pacific Partnership (TPP), the Regional Comprehensive Economic Partnership with the Association of Southeast Asian Nations (ASEAN) and Japan, Korea, India, Australia and New Zealand and separate negotiations with India, Korea and Japan, potentially the United States and even possibly the European Union. A likely key element in such negotiations, and one already raised by the United States in the TPP negotiations, is that of trade arrangements involving state-owned enterprises (SOEs). China is viewed from outside as having a large SOE sector, and large SOEs are viewed as having a protected monopoly position in domestic Chinese markets.

Abstract:: Since its widespread settlement by Europeans in the 1840s, New Zealand (NZ) has been an agricultural economy. As has been pointed out “there [has been] no serious challenge to the fundamental precept that the country's economy rested on an agricultural foundation” (Macdonald and Thomson 1987, 231), and dairy has been a significant focus of that base. Dairy production was introduced to New Zealand with the clear intent to establish New Zealand as an adjunct to the economic needs of Britain (Hawke 1985). Indeed, the closeness of the relationship between “the Britain of the south” and the metropolitan centre is one of the fundamental characteristics of any environmental history of NZ agriculture (Pawson 2008). This would persist in a material sense for more than a century, until the United Kingdom joined the European Community (EC) in 1973.

Abstract:: Over the last two decades, the European Union has put in place various policy and regulatory instruments to address climate change and ensure environmental protection. These European efforts, however, have been far from fully successful for a number of reasons, including the difficulty of achieving simultaneously the objectives set by the "2020 Climate and Energy Package" and the inefficient governance mechanisms to pursue them. For this reason, the 2030 policy framework for climate and energy agreed by the European Council in October 2014 proposes a new governance structure which introduces greater flexibility for governments in reaching the targets. While the new structure allows Member States to choose policies that are best-suited to their national energy mix and preferences, it will have to ensure that the commitments undersigned at EU level are respected and the overall targets set by the Commission are met.

Abstract:: South-Eastern Mediterranean gas fields are still under exploration and development. Meanwhile, the question of which route or routes such gas would take into the global markets remains unanswered. The various possible routes appear to be problematic either politically or financially, leaving development stifled. However, with the crisis between Russia and Ukraine deepening Europe's interest in diversification of supplies, and with gas field owners and developers eager to monetise the resources, Eastern Mediterranean gas could become a potential source for the European Union. This paper tries to answer whether the South-Eastern Mediterranean resources can be regarded as a considerable supply for Europe and, if so, what are the alternative routes that would benefit all the parties involved.

Abstract:: The Arab uprisings alongside the Ukrainian crisis have triggered the perfect storm. The European Neighbourhood Policy (ENP), developed at the height of enlargement EUphoria, is in tatters. To be fair, its failure is only partly endogenous, and largely due to the dramatic transformation of the neighbourhood – east and south – which no one could have foreseen at the turn of the century. Be that as it may, the EU will have to fundamentally rethink its approach towards its turbulent backyard. To move forward, the EU needs to devise conceptually different approaches to the east and south. In both cases, instability and crises abound. In both, the magnitude of the challenges that the EU faces is so great that down-to-earth realism must be its guiding light. Formulating and pursuing down-to-earth objectives for the neighbourhood that reflect current realities is not cynical. It is responsible.

The upheaval in the region unleashed by the Arab awakening, along with critical socio-economic challenges like population growth and urbanization, are altering this picture. 5442. European Banking Union: An Immediate Tool for Euro Crisis Management and a Long-Term Project for the Single Market

Abstract:: After the adoption of a single monetary policy which commits the European Central Bank to maintaining the euro's purchasing power and price stability in the Eurozone, the European Union is facing a new, but equally fundamental challenge: the implementation in a relatively short time of the so-called "Banking Union". Its purpose is twofold: (1) breaking the link between banking and sovereign risk, with the ultimate goal of achieving full protection of EU savers in the event of a crisis; and (2) ensuring uniformity of credit conditions - which are still too fragmented - within the European banking market, to ensure greater EU integration of the financial system. Starting from the Communication in which the European Commission stressed the need for a banking union, this paper intends to explore the complex process towards its establishment by looking at the EU institutional mechanisms and the legal aspects. In particular, the analysis will be based on two building blocks: (1) the Single Supervisory Mechanism, with a single supervisor at the heart of the banking union; and (2) the Single Resolution Mechanism as a new integrated resolution framework and a resolution fund to address the failure of banking institutions. The paper then assesses the next steps for a fully fledged banking union, necessary in order for this new instrument to lay the foundations for a genuine Economic and Monetary Union, thereby fostering financial and economic stability in the euro area and in the EU as a whole.

Abstract:: The US-UK special relation has always been an attractive and important issue in international relations. The pro-American tendencies of the British and their partnership with American policies as opposed to being willing to more clearly align with the EU and other European countries, have raised various questions in the minds of scholars. Now, considering that David Cameron's Premiership is coming to an end and the next year's election in the UK and also the different challenges which Barack Obama faced in foreign affairs during his presidency along with his declining popularity in the US, this paper is going to find out whether the Anglo-American special relations have already came to an end or not. At the end, the Anglo-American dispute over Iran would be also examined. The Constructivism theory of international relations has been used here to analyze data which have been gathered from library sources and various other internet resources. It is concluded that the Anglo-American special terms which started after the Second World War and were deepened in the Cold War, have lost its strength in one way or another – especially after Bush-Blair era- and is waiting for a new shape with the change of British Premiership.

Abstract:: At noon on August 10, 1978, I arrived at the frontier between Austria and Czechoslovakia in my rickety old Opel sedan that was The New York Times bureau car. I'd driven up from Belgrade, where I was then based, covering an Eastern Europe thoroughly in the grip of communism. Now, when I arrived at the frontier, I steeled myself. I was about to pass through what Winston Churchill had 32 years earlier dubbed the Iron Curtain, separating East from West. These were difficult times. Communism and capitalism were very much at each others' throats, and there was no more extreme a contrast than in some of these heavily-fortified border points where the favored few could cross in both directions, provided they had all the right papers. Indeed, I had my American passport, my Czechoslovak visa, a fistful of dollars, my notebooks, and some background material, from which I had carefully expunged any Czech contacts and sliced off the letterhead of Radio Free Europe Research, the virulently anti-communist, American-backed propaganda source, that would likely have landed me in hot water with the ever-vigilant border police.

5448. Climate Policy Constraints and NGO Entrepreneurship: The Story of Norway's Leadership in REDD+ Financing

Abstract:: Norway – a small northern country with only 5 million inhabitants – is at present a global leader in REDD+ financing. In this paper, we explain why and how this happened by telling the story about the emergence of Norway's International Climate and Forest Initiative (NICFI) in 2007 and its institutionalization in the following years. We emphasize how a set of Norwegian climate policy characteristics prepared the ground for NICFI. These characteristics were the relative absence of less expensive potential emission cuts domestically, a tradition of seeking cheaper emission reduction options abroad, and few fiscal constraints due to high petroleum revenues. When the domestic demand for a more proactive climate policy started to increase from 2006 onward, two Norwegian environmental NGOs, The Rainforest Foundation Norway and Friends of the Earth Norway, exploited the window of opportunity that emerged from the tension between high domestic abatement costs and increasing domestic climate policy demands by proposing a large-scale Norwegian rainforest effort. This proposal resonated well with the new emphasis on reduced deforestation as a promising climate policy measure internationally. Towards the end of 2007, these ENGOs managed to convince a broad majority in Parliament that large-scale financing of measures to reduce deforestation globally should become an important part of Norwegian climate policy. Financing NICFI through the growth in the steadily increasing development aid budget dampened opposition from more fiscally conservative actors and facilitated the rapid set-up of a flexible implementing organization directly linked to some of the most proactive politicians. Several agreements with key rainforest countries were rapidly established, and including ENGOs in policy formulation and implementation helped maintaining the momentum and legitimacy for NICFI as a more permanent solution to Norway's climate policy dilemmas. NICFI's robustness and high level of legitimacy are illustrated by the fact that the initiative has survived the recent 2013 change of government quite intact. However, we also suggest that the long-time survival of the initiative may be dependent on the future of the UNFCCC process as well as the destiny of the national projects.

5449. To Charge or Not to Charge: Evidence from a Health Products Experiment in Uganda

Abstract:: In a field experiment in Uganda, we find that demand after a free distribution of three health products is lower than after a sale distribution. This contrasts with work on insecticide-treated bed nets, highlighting the importance of product characteristics in determining pricing policy. We put forward a model to illustrate the potential tension between two important factors, learning and anchoring, and then test this model with three products selected specifically for their variation in the scope for learning. We find the rank order of shifts in demand matches with the theoretical prediction, although the differences are not statistically significant.

Abstract:: World War II caused the displacement of millions of people throughout Europe. In response, the United States initiated a public-private partnership that assisted in the resettlement of hundreds of thousands of the region's displaced persons. For nearly 40 years after the War, the US commitment to refugee resettlement played out in an ad hoc fashion as it responded to emerging crises in different ways. During this period the government's involvement with resettlement became gradually intertwined with that of non-governmental resettlement agencies, which came to play an increasingly vital role in the resettlement process. The budding relationship that began in the middle decades of the twentieth century set the foundation for an expansive and dynamic public-private partnership that continues to this day. The Refugee Act of 1980solidified the relationship between resettlement agencies and the federal government, established political asylum in US law, and created the refugee resettlement program and a series of assistance programs to help refugees transition to life in the United States. This legislation marked a decisive turning point in the field of refugee resettlement.

5451. Why Europe must stop outsourcing its security

Abstract:: The EU claims to be in the business of “crisis management” – ready if need be to make “robust” military interventions to control conflict, especially in its neighbourhood. In practice, it now prefers to “outsource” such interventions to others, notably the United Nations and African Union (AU), limiting itself to supporting roles. This is not just shabby; it also saps Europe's influence in a world in which European interests and values are increasingly contested. And it places too great a burden on organisations such as the UN and AU. Unless the EU rediscovers a willingness to bear the costs and risks of military operations to control conflict, Europe can expect everintensifying refugee pressure on its southern borders. Although military force will not help in Ukraine or the turmoil of the Middle East, the EU could make a big difference if it were prepared to do more in crisis management in Africa. The EU could contribute to or complement UN or AU efforts in a variety of ways. Responding to the crisis in UN peacekeeping, Ban Kimoon has ordered a review. New EU High Representative Federica Mogherini should do the same, involving outside experts in a stock-take of international efforts to control conflict to Europe's south and commissioning specific proposals to get the EU back to playing a properly responsible security role.

Abstract:: Ukraine has experienced a year of unprecedented political, economic, and military turmoil. The combination of Russian military aggression in the east and a legacy of destructive policies leading to pervasive corruption has plunged the country into an existential crisis. The West, meanwhile, has been largely paralyzed with uncertainty over how to assist Ukraine without reviving Cold War hostilities. Yet all is not lost for Ukraine. A tenuous ceasefire, along with the successful elections of President Petro Poroshenko in May and a new parliament in October offer an opportunity for economic reform. If the current ceasefire in the east holds, Ukraine has a great opportunity to break out of its vicious circle of economic underperformance. Yet, the window of opportunity is likely to be brief. The new government will have to act fast and hard on many fronts to succeed.

Abstract:: The February 2014 protests in Bosnia- Herzegovina have shown clearly that Bosnia- Herzegovina is still- 20 years after the signing of the Dayton Accords- the key country for security in the Western Balkans. These protests have also shown the limits of the influence of EU policies in the region, and have again sparked local and international discussions about the future role of the international community in general, and the EU in particular. Besides the discussion about quick and large-scale change to the Dayton Constitution, some observers and students of Balkan politics have pointed to the need for partial reforms, while others favour the idea that the international community should stop meddling in Bosnian affairs. The early reactions of EU officials to the events in Bosnia-Herzegovina have prioritised socio-economic measures rather than constitutional reforms. The following article stresses the importance of an increased EU commitment to Bosnia-Herzegovina under a revised and comprehensive strategy. The new strategy should include improving the economy as one of its priorities; however, the EU should also increase its efforts for constitutional reforms and assume more responsibility to make the Bosnian state functional. The article also highlights that recent events in Bosnia-Herzegovina have illustrated the urgency for a more decisive enlargement policy towards the Western Balkans and argues that the integration of the Western Balkans and Turkey with the EU are not rival processes but complementary.The article first examines the Euro-Atlantic integration of the Balkans in the post-Dayton period and then makes suggestions to improve security and stability in the Western Balkans.

Abstract:: Since the onset of the Euro crisis in 2009-‐2010, the EU has introduced a series of far-‐reaching changes in its institutional architecture for economic and social governance. At the heart of this new architecture is the 'European Semester' of policy coordination, through which the Commission, the Council, and the European Council set priorities for the Union in the Annual Growth Survey (AGS), review National Reform Programmes (NRPs), and issue Country-‐Specific Recommendations (CSRs) to Member States, backed up in some cases by the possibility of financial sanctions. The European Semester brings together within a single annual policy coordination cycle a wide range of EU governance instruments with different legal bases and sanctioning authority, from the Stability and Growth Pact (SGP), the Macroeconomic Imbalances Procedure (MIP), and the Fiscal Treaty to the Europe 2020 Strategy and the Integrated Economic and Employment Policy Guidelines. This process in turn has given the EU institutions a more visible and intrusive role than ever before in scrutinizing and guiding national economic, fiscal, and social policies, especially but by no means exclusively within the Eurozone (Costamagna 2013; Chalmers 2012).

Abstract:: Regional politics in Latin America today are defined by a variety of trends: Brazil continues to grow, but its leadership in the region has substantially decreased during the administration of Dilma Rousseff, which began in 2011; several countries-including Argentina, Bolivia, and Venezuela-have chosen to "Latin-Americanize" their foreign policy, discarding their former alignments with the United States; left-leaning governments, clearly critical of US power in the region, have tried to consolidate organizations such as the Bolivarian Alliance for the Peoples of Our America (ALBA) to increase their autonomy vis-à-vis the United States; right and right-center governments have responded by deepening their commercial links with the United States and the European Union (EU) and by organizing the Pacific Alliance, a traditional arrangement for free-trade and freedom-of-movement; and, finally, many countries in the region are adopting-independently of their ideological and political orientations-increasingly diversified foreign policies. Abstract:: Ever since the founding of the Republic in 1923, the idea of making Turkey a European country has been a major component of the nation-building project, although Europe has also been perceived as a threat. The incumbent Justice and Development Party (AKP) embarked on an EU-inspired reform project at first, but has subsequently taken an increasingly anti-European position. Turkey's EU bid under the AKP government needs to be seen within the context of the domestic power struggle, whose origins can be traced to two opposing modernization alternatives: radical and Islamic. Within the domestic power struggle, the AKP has used the EU process as a tool to de-legitimize the secularist state elite-lite, composed of the armed forces and the judiciary. After having consolidated its hegemony, the AKP abandoned its EU aspirations, and there is currently very little societal pressure from the AKP constituency to continue the EU reforms.

Abstract:: This paper will explore whether and to what extent the (legal) rules of coordination that originated and developed in the EU can be transposed to SADC – a region characterized by high levels of migration, weakly developed social security systems and the absence of suitable portability arrangements. The principle of coordination of social security is primarily aimed at eliminating restrictions that national social security schemes place upon the rights of migrant workers to such social security. One of the fundamental principles of social security coordination is that of portability, which is the ability to preserve, maintain, and transfer vested social security rights or rights in the process of being vested, independent of nationality and country of residence. The best practice around the world to ensure portability of social security entitlements consists of multilateral and bilateral social security agreements. These agreements originated and developed in the EU, and EU coordination arrangements arguably still represent the most sophisticated and developed system of its kind, and one that is worth emulating. In this paper, it is argued that any future attempts at coordinating social security schemes in SADC should start with employment injury schemes, which is the only social security scheme common to all SADC member states. The paper considers some of the issues that should be taken into account in designing social security agreements in SADC along the lines of the EU model.

5465. Why Brazil has not criticised Russia over Crimea

Abstract:: Emerging powers frequently stress the importance of sovereignty and the inviolability of international law. As a consequence, many Western observers expected that emerging powers such as Brazil would be quick to condemn Russia's annexation of Crimea. Yet Brazil remained neutral and abstained from the UN General Assembly resolution that criticised Russia. Together with the other BRICS countries, it opposed suggestions to exclude Russia from the G-20, thus markedly reducing the effectiveness of Western attempts to isolate President Putin. Brazil's unwillingness to criticise Russia may have less to do with its opinion on Russia's annexation of Crimea per se and more to do with Brasília's scepticism of Western attempts to turn Russia into an international pariah. From Brasilia's perspective, pushing countries against the wall is rarely the most constructive approach. In addition, many in Brazil are wary of a global order that privileges the U.S. and allows it to flout many norms that apply to everyone else, arguing that these double standards are far more damaging to international order than any Russian policy. Finally, Russia annexed Crimea at a time when anti-Americanism around the world still runs high as a consequence of the NSA spying scandals, making alignment with U.S. positions politically costly at home.

Abstract:: From the start of the Ukrainian crisis Turkey kept a low profile and adopted a strategy best described as "don't poke the Russian bear". Russia is a major Turkish trading partner and Turkey relies heavily on Russian natural gas for its energy needs, while Turkish prime minister Erdogan has also been dealing with serious domestic challenges in the last year. Therefore, due to both external and internal factors, Turkey will avoid confronting Russia directly and will pass the buck to the U.S. and EU. In the short to medium term there are three plausible scenarios under which Turkey will change its current policy. They include the oppression of Crimean Tatars by the Russian authorities; military confrontation in the Black Sea between Russia and NATO; or a more unified, tougher stance against Russia by the West. In the long term Turkey most likely will revert to its traditional role of balancing Russia by strengthening its ties with the West, while reducing its energy dependence on Russia.

It contends that international law does not take geography as it is but actively creates and sustains a state-based geography. It argues that the challenges Bethlehem identifies are not new but are inherent in international law's efforts to impose a state-based order on a global world. The question is not whether international lawyers will respond to these challenges, but how they will respond. Will they follow Bethlehem in reinforcing a statist order, or will they place sovereignty of states in the service of the global human community?

Abstract:: The rights and remedies of private parties under the three principal global treaties for the protection of intellectual property are restricted to persons having the status of ressortissants under the relevant treaty, and by the general law of diplomatic protection. Two largely neglected issues arise in relation to ressortissants, which the treaties do not expressly resolve. The first concerns whether the obligations which state A assumes towards the nationals of state B can be enforced by states other than B. The second is whether the obligations assumed by a state under one of these treaties extend to that state's own nationals. It is suggested that the Bananas III and Havana Club decisions have effectively resulted in unlimited locus standi for WTO members to complain of breaches of TRIPs, including the incorporated provisions of the Paris and Berne conventions. The answer to the second question is more tentative, but it is suggested that there may be greater opportunities for arguing that the provisions of TRIPs are binding on states in relation to their own nationals, including incorporated Paris and Berne Articles, than there were under either of those earlier treaties on their own.

The full article is published in Int J Constitutional Law (2014) 12 (1): 105–134 doi:10.1093/icon/mou003 Three transformational developments flowed from Van Gend en Loos: the central symbols and ideals of EU law; an autonomous legal order with more power than traditional treaties; and a system of individual rights and duties. The judgment also set out how each of these developments was to be deployed. The symbols and ideals were set out to proclaim EU authority rather than to go to what the EU did. What the EU did was, above all, government through law. The EU legal order was conceived, above all, therefore, as a vehicle for the expression of EU government. This, in turn, shaped the allocation of individual rights which were predominantly granted only where they furthered the realization of the collective objectives of EU government. Conceiving EU law as governmental law also left a profound and negative effect on EU legal meaning. This became shaped by EU law being reduced to something to sustain activities valued by EU government rather than to provide a wider, more emancipatory imaginary.

Abstract:: This article assesses how, 50 years after the ECJ delivered its judgment in Van Gend en Loos (VGL), the doctrine of direct effect of international law has fared outside the European Union. While obviously the core of VGL (that is, that it is EU law, not national law, which requires direct effect) is not replicated anywhere else in the world, the courts of a considerable number of states have been able to give direct effect to international law. Against the background of an exceedingly heterogeneous practice, this article argues that the concept of direct effect is characterized by a fundamental duality. Direct effect may function as a powerful sword that courts can use to pierce the boundary of the national legal order and protect individual rights where national law falls short. But more often than not, the conditions of direct effect legitimize the non-application of international law and shield the national legal order from international law. International law provides support for both functions. But above all, it defers the choice between these functions to national courts. The practice of direct effect of international law exposes how national courts play a critical political function at the intersection of legal orders.

The full article is published in Int J Constitutional Law (2014) 12 (1): 136–163 doi:10.1093/icon/mou006 Did the famous Van Gend en Loos judgment constitute a breakthrough for a constitutional practise in European law or was it merely drawing the logical legal consequences of earlier case law and of the Treaties of Rome? Based on comprehensive archival studies, this article argues that neither earlier case law nor the Treaties of Rome can fully account for the judgment. Instead, Van Gend en Loos represented a genuine revolution in European law. Prompted by the legal service of the European Commission, the European Court of Justice (ECJ) took a decisive step towards addressing two major problems of international public law, namely the lack of uniform application of European law by national courts across the six member states and the lack of primacy granted to international law in several member states. The judgment was based on a new teleological and constitutional understanding of the Treaties of Rome developed by the legal service, and took the first step towards establishing an alternative enforcement system. The ECJ would already in 1964 take the second step by introducing primacy in the Costa v. E.N.E.L. judgment. The new enforcement system remained highly fragile, however, due to the dependency on the cooperation of national courts through the preliminary reference system. As a result, the full effects of the Van Gend en Loos judgment were only felt after the Single European Act (1986) pushed reluctant national governments and courts to finally come to terms with the legal order the ECJ had developed.

Abstract:: The Van Gend en Loos (VGL) decision established the conceptual premises of a crucial issue to shape the relationships between the European Union and international law: the function of direct effect as a powerful instrument to guarantee that the rules of one system are complied with in another legal order. However, if compared with direct effect of EU legal rules, the issue of the effects of EU international agreements is made more complicated by the combination of the more traditional question of the self-executing character of international agreement provisions and the narrow meaning of direct effect. The former issue, strongly affected by the technique of incorporation and the rank of international law obligations within the incorporating legal order, goes to the heart of the constitutional architecture of the EU legal order where a balance is to be found between the obligation to comply with international law and the integrity of the EU legal order. The latter notion concerns instead the relationship between the private person and the legal rule and defines the special character of the EU which distinguishes it from international law. Since such a quality of EU rules cannot be automatically applied to international law rules incorporated in the EU legal order it must be verified case by case. This is the reason why, for the present author, the double test approach, first applied by the ECJ in VGL, is the right test to determine direct effect of EU international agreements, but cannot be applied to verify the self-executing effect of international law in the traditional (broader) meaning.

Abstract:: Focusing on the case law developed by the Court of Justice of the European Union since Van Gend en Loos, this article contends that three important shifts occurred concerning the effects of EU law in national courts since that case was decided. First, the existence of a particular category of ('direct effect') EU norms, which implies a process of selection among EU law provisions, is no longer as problematic as the method of comparison and combination of norms in judicial reasoning that has become a vehicle for the penetration of EU law in courts. Second, the possibility for individuals to claim (subjective) rights on the basis of the Treaty is overshadowed by questions concerning obligations imposed by the Treaty on individuals, and more generally, on the methods through which this horizontal effect occurs. Third, the duty for national courts to apply EU law provisions directly (direct enforcement) is now coupled with one prior question that these courts have to address, and which has become much more sensitive than before in view of the growing centrality of fundamental rights' protection in the EU system: the question of the applicability of EU and national (constitutional) law. Having examined these three shifts, the article concludes that it has become urgent to reconsider the effects of EU law in member states in order to avoid a decline of individual rights and freedoms resulting from EU law enforcement. Thus, 'Revisiting Van Gend en Loos' leads to a reflection on the hypothesis, in which EU law should yield and national courts should be granted more discretion, when confronted with the resisting substance of national law (especially fundamental rights or freedoms protected by national constitutions).

Abstract:: In July 2013, the European Commission adopted a new Banking Communication – the seventh since the start of the financial crisis – updating its criteria for the evaluation of state aid in the banking sector in response to the evolving economic and institutional environment. Under this Communication, any credit institution in need of recapitalisation or 'impaired asset' measures will be required, prior to any further action, to submit a plan for restructuring or the orderly winding down the bank. Moreover, whenever there is a capital shortfall, the Commission will require that, prior to any injection of public funds, not only shareholders – as has been the case so far – but also junior creditors write down or convert into equity their claims on the bank, regardless of whether the bank is under resolution, in order to minimise the need for state aid.

5482. Sovereign Debt Crisis Management: Lessons from the 2012 Greek Debt Restructuring

Abstract:: The 2012 Greek debt exchange was a watershed event in the euro area debt crisis. It generated fears of contagion and was viewed as a threat to the euro itself. Although it achieved historically unprecedented debt relief, amounting to €106 billion (55 percent of GDP), it was “too little, too late” in terms of restoring Greece's debt sustainability. There is a heated debate as to whether the debt restructuring should have taken place sooner, when Greece's adjustment program was agreed to in May 2010. This paper argues that a deep haircut up front, under threat of legislative action, would have been seen as unnecessary and deeply coercive. But delaying the restructuring beyond mid-2011, when it became clear that Greece's debt was unsustainable, was unjustified. The delay reduced the stock of privately held debt subject to a haircut, possibly making an official debt restructuring inevitable down the road. Initial fears that the Greek debt restructuring would pose a serious threat to the euro area's financial stability proved to be exaggerated. On the contrary, it demonstrated that an orderly default involving a pre-emptive debt restructuring is possible in a monetary union, provided appropriate firewalls are in place to limit contagion risks. With crisis management institutions and procedures now in place in the euro area, and with much stricter fiscal surveillance, the Greek experience is likely to remain unique in the history of debt restructurings; however, some lessons can be learned from its specific features.

5483. Is There a Case – Legally and Politically – for Direct Effect of WTO Obligations?

Abstract:: WTO law does not require its direct effect in domestic legal orders. Whilst the stances taken in these are diverse, showing that direct effect is not denied on the whole to WTO law, all the major trading members of the WTO deny it. The fact that, in a case where a WTO member does not comply and is targeted by trade sanctions, the economic actors who in practice bear the burden of these sanctions are deprived of any recourse, may be considered unfair enough to question again the denial of direct effect. The analysis focuses notably on the EU where the debate has expanded more than anywhere else and concludes that direct effect should, even in the name of fairness or justice, be handled with caution.

5484. Waiting for the Existential Revolution in Europe (Abstract only)

Abstract:: This essay argues, contrary to the widespread beliefs that prevailed after 1989, that the experience of post-communist countries and their peoples, both before and after 1989, can bring something new to our understanding of Europe's present predicament: sometimes as an inspiration, sometimes as a cautionary tale. The lessons offered by post-communist Europe concern some deeply held convictions about the very nature of the EU and its constitutional structure. Only if this experience is absorbed in Europe as its own will post-communist countries truly return to Europe – and Europe become united. The cautionary tales of post-communist Europe concern the worrying consequences of the suppression of social conflicts 'in the name of Europe'. Such conflicts often get translated into identitary politics, which in the context of European integration often turn against the Union. The second lesson concerns the ill fate of Havel's existential revolution. The attempts of some European constitutionalists to reform individualistic emphasis of the integration project are problematic for the same reason: they turn attention away from politics, where real solutions need to be found. This relates to the third suggestion made here: that the experience of living in a collective dream of socialism can be used as an inspiration rather than as something that needs to be erased from the collective memory of Europe.

Abstract:: We deal in EJIL with the world we live in – often with its worst and most violent patholo-gies, often with its most promising signs of hope for a better world. But, inevitably, since our vehicle is scholarship, we reify this world. Roaming Charges is designed not just to offer a moment of aesthetic relief, but to remind us of the ultimate subject of our schol-arly reflections: we alternate between photos of places – the world we live in – and photos of people – who we are, the human condition. We eschew the direct programmatic photo-graph: people shot up; the ravages of pollution and all other manner of photojournalism. 'Roaming', 'Charges', and those irritating 'Roaming Charges' – was chosen because of the multiple and at times conflicting meanings, feelings and associations the words, jointly and severally, evoke and which we hope to capture in our choice of photo-graphs. As we roam around the world we aim for images which charge us: please and challenge, even irritate, at the same time. We seek photos which have some ambiguity, are edgy and relate in an indirect way, both to the current circumstance but also to that which is, like human dignity, permanent and enduring.

5486. Domestic Implementation of Human Rights Judgments in Europe: Legal Infrastructure and Government Effectiveness Matter

Abstract:: Over the past couple of years, international law and international relations scholarship has shifted its focus from the question of whether human rights treaties bring any state-level improvements at all to investigations in the domestic context of the factors and dynamics influencing state compliance. In this direction, and focusing on the European Court of Human Rights, this study inquires into the factors that account for variable patterns of state compliance with its judgments. Why do national authorities in some states adopt a more prompt and responsive attitude in implementing these judgments, in contrast to other states that procrastinate or respond reluctantly? On the basis of a large-N study of the Strasbourg Court's judgments and a comparison across nine states, this article argues that variation in state implementation performance is closely linked to the overall legal infrastructure capacity and government effectiveness of a state. When such capacity and effectiveness are high and diffused, the adverse judgments of the Strasbourg Court are unlikely to be obstructed or ignored, even when the government, political elites, or other actors are reluctant and not in favour of substantive remedies.

5487. Domestic Implementation of European Court of Human Rights Judgments: Legal Infrastructure and Government Effectiveness Matter: A Reply to Dia Anagnostou and Alina Mungiu-Pippidi

Abstract:: This article responds to the valuable contribution by Dia Anagnostou and Alina Mungiu- Pippidi in which they analyse how nine countries implemented European Court of Human Rights judgments that found violations of Articles 8–11 of the European Convention on Human Rights. Their conclusion that capacity plays an important role in the implementation of ECtHR judgments is certainly correct. In this short response, I highlight various aspects of the authors' analysis where they make problematic choices with regard to data and statistical methods. First, I describe and use a more comprehensive dataset that allows us to reach more generalizable conclusions. Secondly, I show how survival analysis is a more appropriate framework than logit or linear regression for analysing these data. Thirdly, I argue that the difficulty of the implementation task needs to be accounted for in any analysis of cross-country variation in implementation. My re-analysis shows that low capacity countries attract judgments that are more difficult to implement. The analysis also uncovers a subtle relationship between time, institutional capacity, and checks and balances. High capacity helps willing politicians to implement judgments quickly. Yet, among judgments that have been pending longer, countries with higher capacity are no quicker to implement than lower capacity countries. By contrast, checks and balances initially slow down implementation but help to eventually ensure begrudging implementation.

Abstract:: As usual, international law comes in late. It was already in the golden years of new world orders and geopolitical shifts after the end of the Cold War that historiography began its global turn. Of course, there had been pioneers and path-breakers before, but it was only in the 1990s that an ambiance of globalization and trans-nationalization triggered new approaches on a larger scale. An actual experience of political, economic and cultural interconnectedness put historiographical emphasis on transfers, networks, connections and cooperation, on transformation and translation.Historical analysis was called to overcome not only the boundaries of the nation-state, but also the limitations of material and epistemic Eurocentrism in its various forms. During the past decade, there has been a growing interest in global histories in many parts of the world.

In the following, I shall offer a critique of the Handbook from a largely Islamic international law perspective as (but) one example of a supranational non-European legal system. The depth of the volume covering a variety of times, spaces, and themes provides us with a much awaited tool against the 'gaps' and the 'forgetfulness' of how today's doctrines and practices of international law came about, not shying away from the voices that question the narrative of international law serving peace and justice. The Handbook is therefore laudable for a number of things.

5491. Statelessness: An Invisible Theme in the History of International Law

Abstract:: The Oxford Handbook is a welcome and necessary intervention in the history of international law. In the introduction, the editors signal their reformist programme: out with the progressive, triumphalist narrative; in with the dark side of international law and its side tracks outside the European experience. In addition to this programme, the project displays two further signs of its serious intent to change the field. First, the authors embarked on a truly collective project, including a week of face-to-face consultation, in a rare effort to define a reasonably unified agenda. Scholarly redirection is a social as well as an intellectual undertaking, and the community built around this volume marks its purposefulness. Secondly, the book's scope is massive: more than five dozen chapters, more than three dozen authors, and more than 1,000 pages of text provide the bulk necessary to accomplish the paradigm shift that the editors intend. The extensive range of the book, especially in its 'Regions' section, does what is necessary to transform globalizing intent into actuality. It is a foundational volume, and any scholarly edifice building upon it will have a broader footprint than was previously possible.

Abstract:: Last Spring, the Rechtskulturen programme, an initiative of the Wissenschaftskolleg zu Berlin at the Transregionale Studien Forum, invited me to participate in a symposium on the Oxford Handbook of the History of International Law – a robust book of 1250 pages. I was asked to 'critically assess' the Handbook's 'global history' approach, that is, to assess whether it was a successful step in 'overcoming Eurocentrism' in the history of international law. The symposium turned out to be a wonderful event, a gathering of historians, anthropologists, political scientists, and lawyers, where I became very conscious of my own professional language but where I also experienced a willingnesss to transcend disciplinary boundaries and biases. The following remarks should be interpreted as a continuation of that discussion. Before looking at some of the contributions in the Handbook that did depart from 'well-worn paths' (to use the editors' expression) (3), I would like to say few words about the 'global history' approach (1) and the unfortunate resilience of Eurocentric voices in the Handbook (2).

Abstract:: As we remarked in the Introduction to our Handbook, it is exciting but also risky to leave a well-worn path (at 2). It means meeting unforeseen obstacles. We were quite aware of the fact that if we wanted to shed light on historical developments in international law which so far had remained in darkness or obscurity, we had to be prepared to encounter the unexpected and not so readily understood – that is, accounts and narratives which call into question conventional wisdom and which, at least initially, pose additional problems rather than providing easy answers. We knew that new research on issues which had rarely been examined before would not be perfect or 'complete'. In other words, we expected, and in fact expressly invited, criticism of a work which tried to break new ground.

Abstract:: The intellectual climate has never been more open to a critical analysis of existing monetary institutions both here and abroad. When the Germans agreed to a monetary union, they were promised that they would keep the Bundesbank; only the name would be changed to the European Central Bank. Instead, Germans with whom I have spoken now think they got the Banca d'Italia. In the United States, before the financial crisis, the Federal Reserve was held in high regard by the public. Now, at least in some circles, "the Fed" has become a term of opprobrium, not unlike "the IRS."

Abstract:: This paper examines the experience of Switzerland within the greater discourse of neutrality in international relations. When many scholars or policy makers discuss neutrality, they often draw upon the experience of the Swiss. Switzerland has, since the early 19thcentury, constructed an identity as a neutral state. Unlike nearly every other neutral European in modern political history, Switzerland has been successful. In this paper we show the Swiss as an outlier in the dialogue on neutrality. Switzerland has been far more successful at neutrality than any other state for reasons of culture, history and international recognition. Neutrality as a policy has been largely a failure for most states. The Swiss, however, possess three major attributes that allow them to succeed and prosper in their role as neutral. First is the incorporation of an armed deterrent into the national culture. Second is the provision of neutrality as a collective good. Finally is the solidification of Swiss neutrality into international law, custom and convention over nearly 200 years.

Abstract:: Military historians love studying battles. For this purpose, they evaluate operation plans and analyze how these plans were executed on the battlefield. The battle history of the Cold War focuses first and foremost on the planning for the nuclear clash between NATO and the Warsaw Pact. Although between 1945 and 1989-90 the world saw countless hot wars on the periphery of the Cold War, the "Cold World War," as the German historian Jost Dülffer termed it, is best examined through the operational plans of the military alliances for what would have been World War Three. To conduct such an analysis we must consider Total War under nuclear conditions.

Abstract:: Dynamics of Energy Governance in Europe and Russia Relations between Europe and Russia in the post-Cold War era constitute a fascinating area of study, as it involves many interlinked socioeconomic and political issues. Significantly, the events that shaped the political landscape of contemporary Europe, i.e., the reunification of Germany and collapse of the Soviet domination of East Europe, were precursors to the disintegration of the Soviet Union. The book under discussion focuses on the issue of energy governance in Europe and Russia, which is significant as both Russia and Europe share a flourishing codependent energy trade relation and the issue touches on many areas of common bilateral concern- political, economic, technological, environmental, bureaucratic and legal. The book has twelve chapters, divided in three thematic sections, apart from Introduction, Conclusion and Afterword. It represents a culmination of debates exchanged through the Political Economy of Energy in Europe and Russia (PEEER) network and approaches the entire issue through the theoretical approach of International Political Economy. Essentially, the book aims to focus on multiple actors and institutions that shape the policy processes of energy governance in Europe and Russia, in the context of an interlinked and interdependent global, regional and local scenario. In the first section on “Transnational Dynamics” the focus is on legal issues. Tatiana Romanova discusses EU-Russian energy relations in the context of legal approximation (Article 55 of the EU-Russian Partnership and Cooperation Agreement), noting two particular focal points – the improvement of the energy trade scenario and the clean energy agenda. Daniel Behn and Vitally Pogoretskyy analyze the system of dual gas pricing in Russia and its impact on EU imports. They raise an important debate between the Statist and Liberal approaches by questioning the consistency of this system with WTO regulations. For Anatole Boute, the export of European foreign energy efficiency rules to non-EU countries, especially Russia, has the potential to become the cornerstone of the EU's new energy diplomacy, to meet the challenges of a secure energy supply from Russia, and to mitigate bilateral climate concerns. M. F. Keating, on the other hand, deals with the connection between and possible harmonization of global best practices (to systemically use competition, regulation and privatization to reform the energy sector) and the EU's energy security agenda.

Abstract:: Picknick mit den Paschas: Aleppo und die levantinische Handelsfirma Fratelli Poche (1853-1880) Studies on the Europeans who lived in the Ottoman Empire have been mostly conducted through the Ottoman and European state archives. Few works on the social history are based on private papers, such as Beshara Doumani's work, Rediscovering Palestine: Merchants and Peasants in Jabal Nablus, 1700-1900 (Berkeley and Los Angeles: University of California Press, 1995). As scholars of the Ottoman social history focus on the ethnic and religious minorities, foreigners, merchants, peasants, and women, such archives have become more precious than ever in order to reconstruct the story of understudied subjects. Ade's book takes its power from this background, as she skillfully uses the private archives of Poche and Marcopoli families, which were discovered in the 1990s. Comprised of two separate folios, the trade firms of both families kept chronologically archived accounting books, daily payments, warehouse books, and deadline records of payments from 1853 until 1921. Apart from family papers, there are memoirs, the archives of European vice-consulates, accounting and trade books, and documents from state archives in Aleppo, Istanbul, Paris and Nantes. After the Ottomans took over Aleppo, the city became a trade terminus for the mercantile coming from the Asia and a maritime link for European merchants. In a few decades time, most European consular representations and trade companies moved their centers from Damascus and Tripoli to Aleppo, which became the third largest urban center in the Ottoman realm after Istanbul and Cairo. Aleppo was not only in the middle of the empire but also a major city in the Arab territories on the cultural boundary of the Turkish and Arab population, which was made up of Kurds, Arabs, Turks, Christians, Jews and Bedouins. The city kept its status as one of the most active trade centers in the Eastern territories of the Ottoman Empire until late 19th century.
