Abstract:
Palestinian Arab citizens of Israel, who feel their political representatives cannot achieve significant change for them on domestic issues, find it hard to believe that their voice could be meaningful in Israel’s foreign relations. Indeed, their involvement in Israeli foreign relations, both in the governmental and non-governmental arena, is limited. However, one area in which their involvement and influence have significant untapped potential lies in forging ties with Diaspora Jewry. For instance, in London, there is a clear disconnect between the representative bodies of the Jewish community, such as the Board of Deputies of British Jews and the Jewish Leadership Council, and those representing the Palestinian community, such as The Association of the Palestinian Community in the UK and the Palestinian Forum in Britain which reflect the main currents of Palestinian thinking. While the disconnect is evident on the formal-organizational level, it does not preclude unofficial ties between Palestinians and Jews in London. Nonetheless, links between the two communities are limited, as is the space for joint discussions and exchanges of views, thoughts and narratives.

The seventh annual public opinion poll of the Mitvim Institute on Israel’s foreign policy was conducted in September 2019. It was carried out by the Rafi Smith Institute and in cooperation with Friedrich-Ebert-Stiftung, among a representative sample of Israel’s adult population (700 men and women, Jews and Arabs) and with a margin of error of 3.5%. This report presents the poll’s key findings, grouped under four categories: Israel’s foreign relations, Israel’s Foreign Service, Israel and its surrounding regions, and Israel and the Palestinians.

Abstract:
The question of the affinity between the Israeli-Palestinian track and the Israeli-Arab track is a contentious issue in Israeli public discourse. Prime Minister Netanyahu repeatedly claims that the Palestinian issue can be bypassed on the road to normalization with the Arab world, even without progress on that front. However, the history of Israeli-Jordanian relations attests to the strong and intrinsic link between these two arenas. The breakthrough that led to the 1994 peace treaty with Jordan was enabled by progress in negotiations with the Palestinians, and every crisis since in the Palestinian arena is reflected in relations with Jordan. All attempts to warm relations with Jordan and increase cooperation on civil issues (beyond the intelligence and military cooperation) require a parallel move vis-à-vis the Palestinians.

Abstract:
Over the last decade, Israel has accelerated a long-term process of annexation in the West Bank through legal, political, physical and rhetorical steps that are both explicit, and increasingly irreversible. What kind of reaction can Israel expect from the international community if these policies continue? This paper summarizes the annexationist trends in Israel, then examines cases of post-World War II annexation, to map the range of international reactions. The analysis shows that the international community (states and meta-state bodies) has responded with diverse tools, all designed to oppose and deter annexation. Yet such measures have only rarely stopped or reversed annexation. When annexation was stopped or reversed, the international pressure focused on violations of other major international norms or reflected state interests. Israeli annexation outright, but the international community can be expected to step up concrete policies of opposition. Not only would such responses not be unique to Israel – it would be an anomaly if the international community did not undertake opposition measures. The paper concludes by proposing that the international community develop a more expansive understanding of the concept of annexation to improve deterrence, and re-commit itself to the fundamental proscription against conquering territory by force.

307. Palestinian Refugees of Syria’s Yarmouk Camp: Challenges and Obstacles to Return

Abstract:
On 22 September 2018, a boat carrying 39 refugees sank while sailing illegally from the Lebanese coast towards Cyprus. Five-year old Syrian-Palestinian Khaled Nejme drowned in the incident, drawing attention to the plight of Palestinian refugees from Syria seeking refuge in Lebanon. Once considered lucky compared to Palestinian refugees in neighboring countries, Palestinian refugees from Syria are now experiencing secondary displacement and are among the most vulnerable refugee groups in Lebanon.1 This paper attempts to provide a better understanding of the attitudes toward the return of Palestinian refugees displaced from Syria. More specifically, the paper addresses the challenges faced by Palestinian refugees displaced from Syria’s Yarmouk camp and currently residing in Lebanon. Since the Syrian regime and its allies have retaken control of Yarmouk, and amidst increasing calls from Lebanon for the “voluntary return of refugees”, what are Syrian-Palestinian refugees’ prospects of return? What are some of the major obstacles preventing their return? And what are some of the basic conditions to be met for a truly voluntary return to be encouraged? To answer these questions, the authors conducted a series of interviews in Shatila camp and Ain el-Hilweh between 26 June and 16 September 2018.2 The interviews were constructed in a way that allowed ample space for the representation of different political positions, ideological orientations, social backgrounds, and age groups.

308. Lebanon: Anger in Palestinian Refugee Camps Gives Rise to a New Mobilization for Dignity

Abstract:
Those who visited Palestinian camps in Lebanon last month could not have missed a new upsurge in the popular mobilization on Palestinian streets. Their enthusiasm can be sensed in the spirits of the youth, their chants, and round-the-clock occupation of public spaces. This upsurge in mobilization was not only the result of the Lebanese Labour Minister’s implementation of his plan1 to combat businesses employing foreign labour without a permit – after giving them one month to regularize their situation.2 It was also the outcome of an accumulated sense of frustration, injustice, humiliation, indignation, deprivation and finally, anger that crystallized in these latest rounds of collective political action. The question then remains: why have Palestinians in Lebanon reached a breaking point at this stage, and why did the movement take this shape? There is no doubt that this anger accumulated gradually. First, it arose from the political-security arrangement for Palestinians in Lebanon, along with the historical absence of a socio-political contract with the Lebanese state. Second, it is the outcome of the deprivation, oppression, racism, and discrimination against Palestinian refugees in Lebanon, which was finally exacerbated by international resolutions hostile to the Palestinian cause, threatening the refugee cause and the right of return. Moreover, the economic situation of Palestinian refugees has deteriorated and was further compounded after the USA cut off its funding for the United Nations Relief and Works Agency for Palestine Refugees (UNRWA). However, alone these factors are not enough to fully explain this mobilization. These latest developments are also the product of a degree of practical awareness among the Palestinian youth and their discourse which explains their involvement in a movement demanding civil rights and an arrangement in which Palestinians are an agent of change against injustice. This movement is also proof of the existence of a new paradigm of the oppressed, who no longer identifies with the oppressors and becomes dependent on them, but instead seeks to break free from their oppression, and in so doing, spontaneously and effectively imposes a new social formula and project. This paper discusses the emergence of this popular mobilization and its transformation into a social movement, the challenges it has faced, and how its actors built a common framework for action to address their status as oppressed. It relies on field interviews – formal and informal – with actors and politicians, participatory observation, the analysis of organized groups, and contributions via WhatsApp and Facebook. The paper focuses on the movement in Ain al-Hilweh camp as one of the largest Palestinian refugee camps in Lebanon, with its political and security context that distinguishes it from other camps.

On 2 March 2019 Pugwash held a roundtable in Tel Aviv in cooperation with the Israeli Pugwash Group and the Alliance Center for Iranian Studies, University of Tel Aviv. More than 25 participants including former officials, academics, and members of civil society attended, including a small number from Europe, the US and Russia. Discussion broadly focused on the situation in the Middle East and the role of the United States and Russia, as well as China, and with a particular focus on Iran’s nuclear and missile programs. Many Israelis continue to have serious concerns regarding the entrenchment of Iranian influence and the extent of their force projection toward the Levant. Equally, many Israelis were keen to understand the nature of the Russian-Iranian relationship, most acutely expressed through their cooperation in Syria in recent years, and how the direction of US policy appears to be evolving in the region. In general, it was observed that the prevailing tensions in the region – with ongoing conflict in Syria and Yemen, the isolation of Qatar amongst many Arab countries, and the deepening rivalry between Iran and other countries – should be viewed through the lens of the lack of communication between officials and non-officials across the spectrum of complex issues.

Abstract:
Mohammad Darawshe's article analyzes the factors behind the historic low in the participation rate of Arab citizens, who stood at only 49.2% in the last elections. For the Arab voter, there weren’t compelling reasons to vote in the 2019 Knesset elections. In fact, a number of reasons motivated them not to. Quarrels around the issue of seat rotation plagued the Joint List and clarified for the Arab voter that the hope for unity had been lost. The Arab public therefore decided to punish the parties, taking from them the privilege it had given, returning them to their natural size in order to school them in the laws of modesty. Arab voters perceived the Nation-State Law as the antithesis of the integration to which they aspire. The law conveyed a clear message to Arab citizens that a border had been placed before them, and that they should not cultivate aspirations for class equality. Arab leaders must open the ranks of leadership and accept into it pragmatic social and economic figures. The mechanism of political parties are outdated and no longer reflect the new moods of the Arab public. There is no doubt that it is time to open a new chapter in Center-Left relations with Arab society. Without Arab cooperation, the Center-Left bloc will never come to power. Conversely, without the partnership of the Center-Left, the Arab public will not be able to influence decision-making in the state of Israel.

Abstract:
Dr. Salim Brake, in the current issue of Bayan, analyzes the considerations and voting patterns of the Druze in the Knesset elections. The Druze generally vote on utilitarian considerations, such as voting for parties expected to be included in the coalition and to influence government policy. Few of them vote for ideological motives. Social networks voiced fierce criticism following two legislative acts that have hurt Druze over the past year: Kaminitz Law and Nation State Law. Despite this, the Druze artificially separated their stance on these laws and voted for parties that supported those laws. The Blue-White party spoke against the Nation State Law in its current form, and as a result, drew significant support from the Druze community. However, Blue-White is only committed to amending the law and including a clause referencing equality within it, and not eliminating it as Druze hoped. The increase in support for the "Israel Beitenu" party is due to the fact that the Druze representatives in the Likud are not seen as representing the real interests of the Druze community. In addition, the Druze candidate in the "Israel Beitenu" party expressed opposition to the Nation State Law.

Abstract:
Amid the coalition negotiations underway in Israel there is a heated debate over various proposals regarding significant changes to the legal oversight of governmental and parliamentary work. Remarkable throughout the debate of these proposals is the lack of regard to their impact on the preservation and promotion of the character of Israel as a Jewish and democratic state, and instead, there is a worrisome focus on political and personal motives. Against this background, it is possible to propose several recommendations. First, in the current debate, the Court is accused of "stealing democracy" and of being a political institution with a blatantly left wing agenda. This incorrect premise, which undermines the ability to conduct a public debate in constructive fashion and erodes the legitimacy of the Court and the public's faith in the Court, must be reversed. Second, there is room for discussion on appropriate constitutional changes. Democratic countries around the world have differing successful constitutional structures, and there is no "one right answer." Yet any future change must be carried out through a focused discussion that incorporates all relevant parties, including politicians, judges, and academics with expertise in the field. Finally, whatever the eventual constitutional changes, they must not undermine the basic principles of the separation of powers, the rule of law, and the power of the Court to practice effective oversight of the government. These are essential building blocks for proper democratic rule.

On April 18, 2019, the US Department of Justice released a redacted version of the full report (448 pages) submitted by Special Counsel Robert Mueller about Russia’s interference in the 2016 US presidential elections. The report consists of two parts: the first presents the outcome of the investigation into Russia’s involvement in the election and draws conclusions regarding the presence or absence of a conspiracy or illegal coordination between the Russians and the Trump campaign; the second part deals with President Trump’s possible obstruction of justice regarding the FBI investigation into the Russian intervention and the investigation by the Special Counsel himself. This essay deals with the first part, i.e., the results of the investigation into the connection between the Russians and Trump for the purpose of influencing the election results. The report reflects accurately the US criminal law that deals with conspiracy and illegal coordination regarding elections. At the same time, it exposes a gap in the nation’s conceptual, organizational, legal, and technological preparedness to confront the possibilities that the digital space provides to undermine – internally and externally – the democratic process. Israel suffers from the same gap, and it is therefore imperative that the state confront it before the next Knesset election.

320. Does Hezbollah Want a War with Israel Now?

Abstract:
Voices in the Arab media have recently suggested that war between Israel and Hezbollah may erupt this coming summer. This debate began even before the rise in tension between the United States and Iran in the Gulf, which once again brought to the fore the possibility of Iran using Hezbollah as a proxy against Israel. In recent speeches, however, Hezbollah Secretary General Hassan Nasrallah acted quickly to calm the waters, while delivering messages designed to deter Israel from taking measures against Hezbollah. Nasrallah asserted that Hezbollah was capable of striking strategic sites on the Israeli home front and conquering parts of the Galilee. These statements indicate that as far as Hezbollah is concerned, the current circumstances are not convenient for a conflict with Israel, due to Hezbollah's continuing involvement in the war in Syria and a wish to avoid undermining Hezbollah's recent achievements in the Lebanese political system. Also important is Hezbollah's deepening economic plight, resulting in part from American sanctions against the organization and its patron, Iran, although these economic difficulties have not yet affected Hezbollah's continued investment in its military buildup and deployment for a future war with Israel. Nevertheless, even if Hezbollah has no interest in a large scale conflict with Israel at this time, escalation as a result of particular measures by Israel in Lebanon and the organization's response, or from Hezbollah's own actions against Israel aimed at serving Iranian interests, cannot be ruled out. Israel must therefore prepare in advance for the possibility of a military campaign in the north.
