With the support of Oxfam, the Columbia Center on Sustainable Investment reviewed select provisions in the Mines and Minerals Act 2009 and corresponding policy statements from the Minerals Policy 2018 to provide recommendations for how to best align the anticipated new mining law with international best practice. The 2009 law was reviewed with a focus on the following topics: • Fiscal regime; • Climate change; • Access to and use of land; • Community consultations and participation; • Human rights; and • Community development agreements.

Abstract:
There are stateless people all around the globe. The problem is very acute in the Asia–Pacific region. The United Nations High Commissioner for Refugees (UNHCR) estimates that there are 10 million stateless persons across the world. A stateless child is born every ten minutes. What does it mean to be a stateless person? It means you have no identity, you have no nationality. You are not recognised as a citizen of any country. As UNHCR has rightly pointed out, ‘Often they are excluded from cradle to grave— being denied a legal identity when they are born, access to education, health care, marriage and job opportunities during their life time and even the dignity of an official burial and a death certificate.’ Over one-third of the world’s stateless are children

The opening in Germany of the trial of two Syrian security officers accused of crimes against humanity was marked by the absence of regional Arab interest, despite its importance for the fight against impunity in MENA. This paper seeks to understand this lack of coverage by Arab media and the absence of interest from national as well as regional Arab human rights organizations, and highlights the implications of the trial for Syria as well as MENA’s struggle for accountability.

On July 9, 1955, two of the most eminent intellectuals of the 20th century, Bertrand Russell and Albert Einstein, issued an appeal to humanity, urging that the immense peril associated with nuclear weapons be recognized by governments and publics alike. The Russell-Einstein Manifesto warned that nuclear weapons pose a threat to the survival of the human species and called for major efforts to address and contain nuclear dangers. One of the consequences of the Manifesto was the holding of the first Pugwash conference in 1957. The origins and goals of Pugwash are contained in the Russell-Einstein Manifesto: to highlight the dangers of nuclear weapons, to call for the elimination of nuclear weapons, and to promote peaceful resolution of conflicts. Today, July 9, 2020, is the 65th anniversary of the Russell-Einstein Manifesto. We ask, how is the situation now, 65 years later?

Abstract:
It is difficult to imagine what could unite Jürgen Habermas, Francis Fukuyama, Judith Butler, Noam Chomsky, Martha Nussbaum, Michael Walzer, Yuval Noah Harari and Vladimir Mironov.1 However, the renowned Institute for Philosophy and Social Theory in Belgrade (IFDT), founded to settle dissident intellectuals expelled from the university for their involvement in the Yugoslav 1968 protests, managed to do so. An international appeal has reached us in the past few days which has revealed once more the ongoing clandestine attack on freedom of thought and academic autonomy in Serbia. Unfortunately, Serbia is not alone in democratic backsliding, neither in Southeast Europe or Europe more generally, nor at the global level. Democracy has been openly challenged in several EU states, while the most recent developments in the USA have revealed the depth of internal fractures in American liberal democracy. Thus, it is not surprising that the Southeast European region (SEE) - a post-conflict, semi-peripheral area in Europe - faces growing illiberalism and varying types of competitive authoritarianism and new despotism.

Abstract:
To get the transatlantic relationship back and on track and to ensure that it will remain relevant in the future, the United States and the European Union should prioritize putting forward concrete ideas and taking actionable steps on climate and energy, democracy and human rights, and digital technology issues. While the election of Joe Biden to the U.S. presidency presents an opening to restore the transatlantic relationship after Donald Trump, the real question facing U.S. and European officials is whether they can successfully manage to advance a new transatlantic agenda for the coming decade. Three pivotal areas where cooperation has fallen short in recent years but where there is now significant potential to do more are climate and energy, democracy and human rights, and digital technology issues. Representing the most pressing challenges our societies are facing in the twenty-first century, progress in these three areas could also help rebuild trust and promote cooperation in other policy areas. To get the transatlantic relationship back and on track and to ensure that it will remain relevant in the future, the United States and the European Union should therefore prioritize putting forward concrete ideas and taking actionable steps in each of these areas over the coming four years.

39. Ordinary Shareholders' Rights Protection in Botswana

Abstract:
This study seeks to examine institutional frameworks that exist in Botswana to protect the rights of ordinary shareholders. There is no literature on the subject matter in the context of Botswana; hence this study attempts to fill in the literature gap. The study uses a variety of data collection methods, such as semi-structured interviews, the Choppies case study and lessons learnt from other jurisdictions. Findings reveal that ordinary shareholders’ rights protection involves the use of institutional frameworks. In Botswana, existing frameworks are not adequate to protect ordinary shareholders’ rights. Furthermore, the study shows that ordinary shareholders in Botswana are mainly exposed to risks of losing their investments, partially or entirely, in case of non-compliance to regulatory requirements as shown by the reduction in Choppies’ stock price from P1.20 to P0.40 between years 2012 and 2018. The study suggests that the existing institutional frameworks should be reviewed to ensure adequate protection of ordinary shareholders’ rights.

40. A Comprehensive Framework for Studying Migration Policies (and a Call to Observe Them beyond Immigration to the West)

Abstract:
This piece is both an exercise in critical conceptual landscaping in the field of Migration Studies and the proposal of an analytical framework that can correct some of its most serious biases. The framework I propose allows the observing of migration policies as if they constituted a comprehensive policy field. This will permit comparisons across the whole spectrum of migration policies on a rigorous basis, and for all countries and regions. I identify two constitutive sides to the proposed framework, each dealing with how state‐like polities regulate the mobility of incoming or outgoing persons. I further suggest that it include regulations on the rights of individuals to pass through three stages of any international migration journey: the right to enter/exit; the rights as immigrant residents/emigrant non‐residents; and, the rights to citizenship and nationality. This comprehensive framework for studying migration policy promises advances for empirical agendas, but also for connecting them to normative ones rooted in global justice and democratic concerns.
