In the last several years, national courts and international institutions have increasingly begun to treat conservative or climate-adverse actions by states as violations of their obligations under international law and human rights. This has been followed by some countries more affected by climate change and engaged in international bodies to put more pressure on Global North states to protect the climate. The sympathetic attitude of international courts towards such complaints may, in the long term, force the need for increased climate ambition or even compensation payments by, among others, Poland.

Abstract:
After the death of twenty-two-year-old Mahsa (Jina) Amini in the custody of Iran’s morality police on September 16, 2022, protests quickly spread throughout the country under the slogan of “Woman, Life, Freedom.” Amini’s death galvanized a movement that connects women’s individual freedom to choose their dress code to the systemic social, political, and economic grievances of a larger population that is demanding fundamental change. In claiming the realization of their basic rights, Iranians are revolting against a system that not only oppresses women and peaceful dissent but also continues to fail to meet citizens’ needs. This fight, which has attracted global solidarity, highlights the core message that when women’s rights are marginalized to nonexistence, human rights for all are at risk. The protests have taken place amid mounting repression of organized peaceful activism, a continuing deterioration of Iranians’ basic rights, and a host of economic ills, including rising inequality, increasing poverty, worsening living conditions, skyrocketing food prices, raging inflation, and rising unemployment. Three years of the coronavirus pandemic as well as decades-long comprehensive economic and financial sanctions have gravely added to the socioeconomic calamity. On top of this economic insecurity, precarious and perilous working conditions had already sparked increasing protests in Iran in recent years, resulting in the government’s harsh crackdown on human rights activists and civil society as well as further infringements on rights, including internet shutdowns, even before current events. Repression and the deterioration of Iran’s socioeconomic conditions have aggravated the situation for women in particular. Especially in recent years leading up to the current protests, this trend has hindered Iranian women’s ability to mobilize, protest, and achieve the full realization of their rights. Those who experience intersecting discrimination because of their minority background or social status are impacted even more if they live in rural areas, which are less developed than urban ones, or in areas on Iran’s border, which the state views predominantly through a security lens. The international response to Iran’s very poor human rights record and current protests, however, has lacked a holistic approach that considers women’s key role as agents of change and encompasses civil and political as well as social and economic rights as integral components of women’s rights. In fact, women’s rights and gender equality are not only goals in themselves but also enable the realization of fundamental rights of other marginalized groups, such as children and minorities. Moreover, women’s rights and gender equality are the strongest indicators of and preconditions for sustainable and peaceful societies, both internally and externally. Yet, the European Union’s (EU’s) current approach to Iran does not account for this reality. Over the past years, the EU’s policy toward the country has focused on negotiations to revive the Joint Comprehensive Plan of Action (JCPOA) after Washington’s withdrawal from the deal in 2018. The current situation in Iran urgently highlights the need for a policy framework that responds to the government’s repression and gross human rights violations and, equally, considers the disastrous socioeconomic situation in the country, which is a key obstacle to the public’s ability to organize to realize its rights. Given the importance of economic precarity and socioeconomic inequality in the current revolt, the EU should adopt policies that can support the protesters’ rights and demands in the short term while considering a revised long-term approach centered on empowering Iranians in their efforts to create long-lasting democratic change.

3. Transitional Justice in Iraq: The Challenges of National Healing and Recovery

Abstract:
Transitional justice in Iraq is a record of squandered opportunities and compromised institutions. Over five decades, Iraqi society has endured human rights abuses on a wide scale, perpetrated by state and non-state actors. The post 2003 era offered a chance to heal wounds and promote national recovery by adopting policies of transparent judicial accountability, equitable reparations, truth-telling and documentation, and national reconciliation to repair the torn social fabric. Instead, in the immediate aftermath of the war of 2003, a victor’s justice prevailed, which deformed the principles of transitional justice and undermined its mechanisms through rampant sectarianism, clientelism and corruption, leading to new abuses, increased strife and deepening social fissures. Twenty years into the new political order, Iraqi policy-makers must reconsider their policies and reform their mechanisms to achieve social cohesion, or risk further social fragmentation and conflict.

4. Local Voices, Global Action: Transnational Organizing in Apparel Supply Chains

This working paper discusses transnational organizing in apparel supply chains. It learns from labor rights advocates in the global South who are building social movements, advocating for national reforms, and promoting new forms of accountability in the apparel industry. In particular, the paper examines how the Bangladesh Center for Worker Solidarity (BCWS) and Cambodia’s Center for Alliance of Labor and Human Rights (CENTRAL) have each played a critical role in advancing new agreements and monitoring their implementation. They have increasingly influenced and become leaders in the Clean Clothes Campaign Network. Based on multiple interviews with CENTRAL’s Tola Moeun and BCWS’s Kalpona Akter, the paper traces how they have worked with international allies to expose flaws in supply chain monitoring in the apparel industry. It discusses how they worked with independent trade unions to build grassroots campaigns that often preceded or inspired international campaigns. At the same time as Moeun and Akter came under threat for their national advocacy, they engaged international allies and became experts on trade policy and global supply chains. They are now not only leading proponents of enforceable, multiparty agreements between multinational corporations (MNCs) and independent trade unions, but also advocates for more effective mandatory human rights due diligence laws (MHRDD). Balancing this international advocacy with organizing for national policy reforms is a strategy made all the more necessary by the context of shrinking civic space in Bangladesh and Cambodia. Many companies are seeking to strengthen their human rights due diligence in supplier countries and to engage stakeholders in that process. At this time, the perspectives and experience of BCWS and CENTRAL help identify what is needed to advance more worker-centered approaches. Three sets of lessons emerge about what is needed to sustain transnational supply chain advocacy movements. Firstly, movement-building and trust are vital ingredients in effective supply chain advocacy. Secondly, it is important for human rights due diligence processes to take into account risks to worker rights. Thirdly, strengthening worker voice in global supply chains requires more effective scrutiny and regulation of MNCs.

Abstract:
Since the seizure of Kabul on 15 August 2021, the Taliban have been consolidating power by recreating the Islamic Emirate of Afghanistan of the 1990s. The Taliban government’s limiting of human rights, especially of women, and constant ties to terrorist organisations reduce the chances of international recognition. Afghanistan has not yet become a centre of global terrorism or a source of mass migration, but the suspension of economic support has deepened the humanitarian crisis. Western partners, including the EU and the U.S., should pursue humanitarian aid and consider unfreezing Afghan currency reserves.

Abstract:
Social media platforms such as Facebook can be effective in spreading positive awareness of gender equality and women’s rights; however, those who oppose these beliefs also use the same platform as a medium for spreading their ideologies. This paper aimed to examine the backlash faced by women public figures who are active on social media and shared content about Gender-based violence, along with the actors behind it. The study also looked into two controversial national events which raised discussions on sexual harassment and violence against women and the effectiveness of the Digital Security Act (DSA) 2018 and other relevant laws and policies used to counter these sorts of violence. A qualitative approach was followed with an analysis of the Facebook accounts related to the case studies and some quantitative data was collected through CrowdTangle software. The study showed that all female public figures faced a backlash mostly from men and boys with some comments from women. While they sought a remedy, DSA did not play a strong role. Women’s rights issues such as women’s education, employment, and domestic violence are seen as liberal feminism while issues like consent, divorce, single parenthood, sexuality, and gender diversity are considered more radical issues.

Abstract:
As part of its primary role of promoting the values of democracy, justice, human rights, and dialogue among Palestinian youth, Pal-Think for Strategic Studies has conducted the “Civic Education 2” project funded by the National Endowment for Democracy (NED) for the second consecutive year. The project’s goal is to amplify Palestinian young men and women’s skills and background on democracy and human rights issues. This book marks the conclusion of the theoretical and practical training program that empowered 25 youth to conduct awareness-raising meetings and discuss their issues in radio interviews. Afterward, the participants prepared five research papers that addressed various issues from a youth perspective in an analytical way and in line with the IMRaD format. Finally, Pal-Think would like to thank everyone who contributed to producing this youth-centered, informative effort, whether through reading or discussing the papers. Pal-Think affirms its determination to continue its work, plans, and programs that aim at improving youth’s access to policy-making centers and promoting their social role.

Within the activities of PalThink Academy for Human Rights and Democracy, PalThink produced a report titled A Highlight on Political, Economic, and Social Rights in Palestine. The report mainly provided a profound analysis of the current public situation in the Palestinian territories from 2019 to 2022. Furthermore, the report was anchored on six indicators including good governance, political participation, public freedom, education, health, and labour. In addition, it gave an in-depth insight into the root causes and consequences of ongoing violations of human rights. To conclude, the report proposed recommendations pertaining to the needed interventions to alleviate the challenges facing human rights in Palestine. Abstract:
The United States provides generous aid to developing countries around the world. However, one of the conditions for aid giving is to first make sure that the receiving country is not involved in human rights violations. In this respect the US has also passed legislation in 1970s that clearly forbids aid, both economic and military, to a country involved in human rights violations. While such legislation is in place, the actual practice of aid giving often ignores the human rights violations. In this article, we focus on the US aid giving to Egypt and explore whether the US took into consideration the aspect of human rights violation by the latter. Examining US economic and military aid to Egypt over an extended period of several decades covering various regimes including that of President Sisi, we conclude that the US has consistently ignored the aspect of human rights violations as the country is vital for safeguarding US foreign policy goals in the region.

Abstract:
Europe and the United States share an interest in promoting human rights in China but often struggle to affect change in this regard. Because of ineffective approaches and low political commitment, human rights are a marginalized issue in transatlantic China policy and an afterthought to commercial interests. European and US policymakers have attempted to compartmentalize their approach to China, keeping human rights separate from commercial and other interests. This does little to advance human rights, and it only seems to encourage more assertive and coercive behavior by China. During the last few years, the Western assumption that trade and foreign capital would transform China into a more open and democratic society has been replaced by a disillusioned realization that its rise as a superpower is reshaping the international order. Under President Xi Jinping, China has evolved from its previous position as rule-taker and status quo-keeper at the UN to become an assertive rule-maker and international norm entrepreneur. Its vulnerability to external pressure has declined while its power to exert pressure and economic coercion on others has increased. China no longer presents its political and economic model merely as different from but as superior to that of the liberal democracies in the West. For several years now, European and US policymakers have declared an “end of naivety” in relation to China. After years of debating how to make the EU more resilient and robust, Russia’s invasion of Ukraine has “given birth to geopolitical Europe,” in the words of its chief diplomat, Josep Borrell. It remains to be seen whether this moment of clarity will translate into a more principled defense of human rights and investment in democratic resilience. For this to happen, there needs to be a broader reckoning with how Western countries for decades mishandled the authoritarian challenge to the international order, often because they were pursuing stronger economic ties with the same governments they now see as systemic rivals.

The Taliban’s takeover of Afghanistan on 15 August 2021 unraveled significant achievements of the Women, Peace and Security (WPS) agenda in Afghanistan over the last two decades.1 Every western donor present in the country pushed the WPS agenda over the past two decades of their engagement in Afghanistan. The previous Government of Afghanistan adopted a National Action Plan on Women, Peace and Security in 2015. They made concerted efforts to implement the NAP by promoting women’s participation in the peace process, the parliament, in government and the security sector, and to protect women and girls from gender-based violence and other violations of their human rights.

14. The Security Ghost of the January 25th Revolution in al-Sisi Regime’s Policy toward Gaza

This study argues that al-Sisi regime has been haunted by the January 25 uprisings as a potential recurrent threat to the state survival during the formulation of national and foreign politics. In the aim of boosting its international legitimacy before Western allies, especially the US, the regime has capitalized on political instabilities in Gaza as a means to ensure its security grip on power without incurring foreign allies’ critics for human rights violations. How did al-Sisi regime mobilize Gaza as a means for bolstering its international credibility before Western bailers and shunning off the January 25 security ghost? In answering this question, this study refers to haunted politics in foreign policy-making as an informative perspective about the impact of traumatic events on ruling regimes’ interpretation of incidents, convocation of memories, recreation of meanings, and subjugation of citizens. Unlike Mubarak’s limited support for the Palestinian cause and Morsi’s exclusive ties with Hamas, al-Sisi adopted a balanced approach toward Gaza in the aim of counterbalancing the US reservations over the regime’s human rights violations since 2013.

Feminism is a mission for far-reaching transformation of society. It focuses on gendersensitive foreign policy agenda, shifting away from traditional approaches. Therefore, it can be considered more than just gender equality where the goal of gender justice dominates the idea. In 2014, Sweden proclaimed a Feminist Foreign Policy (FPP), followed by Canada in 2017, France and Luxembourg in 2019, and Mexico in 2020 which opened a path for many other countries to follow the trail. Swedish FFP talks about 3 Rs, i-e; Rights, Representation and Resources. The political framework of Feminist Foreign Policy revolves around the welfare of that marginalized faction of the society which has been facing all kinds of oppression emanating from forces of patriarchy, colonization, hetero-normativity, capitalism, racism, imperialism and militarism. The study intends to answer the primary question why it is important for the world to adopt FFP and will it even work in South Asia, particularly Pakistan where gender is one of the consolidating principles of the society. With these ideas’ backdrop, Swedish Feminist foreign policy gives us window of opportunity to think over the subject. However, the fact remains that this practice is different from one country to another, one region to another and one culture to another but the important is to be able to prove that it is beneficial for country’s concern to include women at the level of society because it is smart economics.

16. Operation Condor, The War on Drugs, and Counterinsurgency in the Golden Triangle (1977-1983)

In the late 1960s, the Mexican government launched a series of counternarcotics campaigns characterized by the militarization of drug production zones, particularly in the northwestern region—the so-called Golden Triangle, epicenter of both production and trafficking of marijuana and opium poppy since the 1930s. Operations Canador (1969–1975) and Trizo (1976) served as a laboratory for methods to curb drug production, ranging from harassment of drug growers to the aerial defoliation of illicit crops. Operation Condor (1977–1988) combined and enhanced these strategies, wreaking havoc on communities of alleged drug growers, but without entirely disrupting the drug industry. This paper explores the role of the US government in the militarization of Mexico’s anti-drug policy, underscoring how the ruling party (the Institutional Revolutionary Party, PRI) took advantage of this shift to tackle domestic issues and reassert its hegemony. I argue that Operation Condor functioned as a counterinsurgency campaign oriented to thwart both social and armed movements, eliminate competitors in the narcotics market, and reorganize the drug industry to protect successful drug lords. Operation Condor also caused the decentralization of the drug industry from the northwest and created a new clientelistic pact between drug lords and national security agencies, such as the Federal Security Directorate (DFS), the Office of the Attorney General of Mexico–Federal Judicial Police (PGR-PJF), and the Secretariat of National Defense (SEDENA), which benefited from drug proceeds. Finally, the de facto state of siege imposed in the Golden Triangle produced thousands of victims of harassment, torture, rape, murder, forced-disappearance, and displacement; massive human rights abuses that authorities either concealed or denied.

As the COVID-19 pandemic has increased reliance on digital technologies, it has highlighted the growing digital divide between and within societies. Universal access to the digital world has become more urgent than ever, and failure to achieve it could undermine progress toward the Sustainable Development Goals. While closing the digital divide and increasing connectivity are among the UN secretary-general’s priorities for 2021, this goal remains elusive and faces many obstacles. One challenge is the lack of a shared understanding of what universal connectivity means. It is not just a technical challenge; it also requires addressing questions related to adoption, usage, accessibility, and the relevance and veracity of content. Another challenge is that funding for digital connectivity is uncoordinated and not easily accessible by those who need it most. There is also a lack of concerted leadership and coherent governance structures at all levels. Moreover, getting the framing right is key. National, global, and local leaders need to establish clear and compelling links between universal connectivity and the 2030 Agenda with its message to “leave no one behind.” Addressing these challenges requires a human-centered, human rights–based approach. Connectivity comes with risks, including privacy issues, misinformation and hate speech, and online violence and sexual harassment. While discussions on universal connectivity have gained momentum, these human rights considerations often remain an afterthought. Governments, businesses, and civil society need to understand connectivity as a right whose protection is their shared responsibility. Ultimately, bridging the digital divide requires a stronger and more inclusive multilateral system. Geopolitics, a lack of shared understanding, knowledge gaps, and suspicion between actors continue to hold back digital cooperation at the UN. Governments need to meaningfully include private sector and civil society actors in formal decision-making processes. In parallel, the UN should create informal platforms to build trust among stakeholders. To achieve meaningful and sustainable progress toward digital inclusion, all actors need to commit to working through a multi-stakeholder platform.

19. The OSCE as Sisyphus: Mediation, Peace Operations, Human Rights

Over the past decade, the Organization for Security and Co-operation in Europe (OSCE) has been returning to its origins as a Cold War–era Conference – a forum where states and blocs, often antagonistic to one another and espousing opposing ideals, can air their frictions and hostilities. The OSCE was created without legal personality and with the liberum veto of the consensus principle. These constraints stunted the growth of executive capabilities and bound the OSCE closely to the will of its participating States. That rendered most mediation efforts ineffective, especially where an OSCE state is both belligerent and mediator in the same conflicts. Peace operations have been more effective – notably the Special Monitoring Mission in Ukraine – but the same factors have tightly constrained its activity. Though all participating States committed themselves to democratic governance, rule of law and respect for human rights, these ideals failed in much of the former Soviet Union, and autocrats have used the organisation’s lack of legal personality and the consensus principle to hobble the OSCE’s efforts. Historically speaking, the European Community and then the European Union have always reacted with paradigm changes in their foreign policies to watershed moments in the Middle East. In response to the two Arab-Israeli wars in 1967 and 1973, the European Community actually set up its own foreign policy in the first place and initiated the Euro-Arab Dialogue. After the Camp David Accords, the nine foreign ministers came out with the Venice Declaration in 1980 which reminded its partners in Washington and Tel Aviv that the Palestine question had been ignored and set the parameters for diplomacy in the 1990s. After the Cold War, however, the European Union became absorbed into the so-called Middle East Peace Process (MEPP), resulting in less independent EU agency on Israel/Palestine. This trend has become particularly obvious over the past four years of the Trump presidency, during which time the EU seemed almost paralyzed. While Europeans are now counting on the incoming Biden administration, during the election campaign Joe Biden stated that he will leave the US embassy in Jerusalem and that he is also favourable of the normalization deals between Israel and certain Arab states which President Trump had pushed for. At the same time, the Biden team seems hesitant to return to negotiations.

Why do new democracies comply with international human rights obligations? We analyze Paraguay’s compliance with all reparation measures requested by the Inter-American Human Rights System over the past two decades. In contrast to most studies, which focus on reparation measures ordered by a single organ in the system, our study covers all orders resulting from friendly settlements, reports published by the Inter-American Commission on Human Rights, and rulings by the Inter-American Court of Human Rights. We provide a novel classification of human rights cases, and evaluate three competing explanations for compliance: legal factors, international pressures, and domestic political will. Our analysis of 1,426 reparation-years underscores the importance of changes in political will over time.

This paper examines the intellectual production of the Chilean clerical movement, Christians for Socialism (CpS). It does so by contextualizing the emergence of CpS within the Chilean Church’s own transformations in theological practices and in grassroots interactions with workers and the poor. The election of self-declared Marxist Salvador Allende in 1970 inspired a sector of the clergy to rethink both the role of the Church in society and the role of the poor in the nation. I draw on Ernst Bloch’s concept of concrete utopia to argue that in Chile Christians for Socialism not only creatively converged Marxist and religious thinking but contributed to altering conventional notions of the two. The notion of transcendence and the construction of a “New Man” appealed to the utopian aspects of both religious and Marxist thinking. Moreover, the Chilean CpS had a Latin American impact, as evidenced by the First Latin American Encounter of Christians for Socialism in Santiago, Chile, in 1972, and a world impact, seen in the formation of the Ecumenical Association of Third-World Theologians in 1976. While the legacy of CpS and liberation theology in Chile is far more visible in the grassroots work undertaken during the dictatorship of Augusto Pinochet, an examination of this movement’s theological and ideological productions before the coup is critical to comprehending members’ subsequent material, on-the-ground actions.

It was around the mid-2000s when Turkey—if only for a short period of time—promulgated the idea of “zero problems with neighbours”. At the time, Turkey was seeking positive reforms in all aspects of public life and a cooperative future with neighbouring countries based on mutual understanding and converging interests. Furthermore, Turkey imagined itself as a bridge between, not as a wall separating and isolating, different regions. Unfortunately, those days are long gone. For almost a decade now, Turkey has been reactionary in its treatment of its own citizens and solipsistic with regard to its neighbours. Democratic backsliding and human rights abuses inside Turkey have become the norm, while militarisation and unilateralism increasingly characterise its foreign policy choices. Its government actions have begun to resemble those of a rogue state. This report seeks neither to explain the intricacies of Erdoğan’s problematic behaviour towards its own people and the rest of the world, nor to denigrate Turkey’s standing. Rather, it aims to raise the alarm about the slippery slope Turkey finds itself on, hopefully well before his governance causes irreparable damage to the region. The report starts by presenting general aspects of Turkey’s relationship with international stakeholders, such as the EU and the US. It proceeds by mapping out internal developments that exemplify strong tendencies of democratic backsliding and human rights abuses. The third part focuses on regional aspects of Turkey’s foreign policy behaviour, starting with the most severe cases that epitomize the militarisation of its foreign policy and violations of international law. It concludes with various cases of political differences between Turkey and states on its periphery, which, combined with the other more severe cases described, demonstrate how Turkey’s foreign policy expectations of ‘zero problems with neighbours’ have turned into a ‘zero neighbours’ reality.

Abstract:
The X and X decision of the European Court of Justice highlighted the gap in current EU law regarding human rights protections in entry procedures. Currently over 90% of those granted refugee status in the EU arrive through irregular means. There is an increasing need for a new form of visa, specifically to accommodate humanitarian matters, which are not currently covered by the pre-existing Schengen rules. For limited numbers, consulates of EU states would be empowered to issue Visas for asylum seekers in order to legally cross EU borders to launch an asylum application. Research shows that the economic costs for the implementation of this humanitarian visa system would be minimal and that the political and humanitarian benefits would be significant.

28. EU return sponsorships: High stakes, low gains

The concept of ‘return sponsorships’ is the most novel of the New Pact on Migration and Asylum’s proposals. It is also proving to be one of the most controversial in the negotiations. With this proposal, the Commission set out to resolve the discussion between member states on responsibility-sharing in migration matters, and simultaneously increase the number of migrants returned to their country of origin. Under the new scheme, member states would have to support other EU countries facing migratory pressure. If, however, they oppose the option of relocating asylum seekers, they can ‘contribute’ by facilitating the returns of migrants who lack permission to remain in Europe instead. But making this idea work in practice will not be straightforward. In unpacking the return sponsorship mechanism, Olivia Sundberg Diez and Florian Trauner have reached the following five conclusions: 1) Existing conflicts between member states over responsibility-sharing will not be settled but transposed onto discussions about the precise requirements of return sponsorship, in particular, the transfer of migrants within Europe if returns are unsuccessful. 2) The flexibility embedded in the solidarity mechanism comes at the expense of tangible support for EU border states, who continue to shoulder a disproportionate amount of the responsibility to receive and process new arrivals. 3) Matching the preferred contributions of a sponsor with a border state’s needs will be extremely complex in terms of administration, and effective enforcement tools are lacking. Repeated delays and the politicisation of solidarity processes are likely, giving member states many opportunities to shift and shirk their responsibilities. 4) Return sponsorships may create new human rights risks for migrants ordered to return, both in and outside of the EU. 5) The return sponsorship concept relies on returns being done faster and in far greater numbers. This is far from certain: many third countries, for one, will remain reluctant to readmit their own nationals. The Commission is taking a considerable risk with the return sponsorship proposal while the potential gains are modest. If the proposal is to move forward, negotiators should prioritise strengthening the predictability and tangibility of support provided by the solidarity mechanism to the EU’s border states, ensure that return sponsorships do not lead to new human rights violations, and avoid inflated expectations regarding the impact of the growing use of conditionality on returns.

The world is observing one of the worst humanitarian crises of this century: the Uyghur genocide, a colonial project that uses modern surveillance and widespread concentration camp apparatuses. At the heart of this genocide is a fundamental “otherization” of the Uyghur people that relies on Islamophobic policy and rhetoric to dehumanize the indigenous population of East Turkistan, known to China as Xinjiang. The Chinese Communist Party (CCP) employs Islamophobia to over-police Muslim populations and curtail their civil liber- ties. Islamophobic rhetoric has also driven surges in hate crimes against Muslim communities. The United Nations notes that this trend continues today as Is- lamophobic incidents continue to rise globally.1 The genocide in East Turkistan is the defining human rights atrocity of the twenty-first century thus far. The CCP has remolded a global trend of Islamophobia to fit their own needs—a new chapter in a horrific history. Though the motivations of the Chinese state in East Turkistan are varied, economic gain, cultural unification, and national consolidation all rank highly. Specific policies targeting the practice of Islam have allowed for a brutal crackdown on cultural norms in the region. Meanwhile, a global trend toward Islamophobia has given the genocide some political cover in the global sphere.

Since the fall of Baghuz city in North East of Syria in March 2019, thousands of women, children and former IS fighters have been imprisoned in either camps or prisons. Following the Turkish military operation in October 2019, the security conditions have deteriorated, resulting in fewer guards as well as more instability and vulnerability for all those imprisoned. The worsening living conditions, the absence of adequate medical care and lack of access to education endanger the future of the children imprisoned in the camp. Moreover, the influence of the Muhajirats remains constant as a means for the spreading of propaganda inside and outside the camps.

On July 9, 1955, two of the most eminent intellectuals of the 20th century, Bertrand Russell and Albert Einstein, issued an appeal to humanity, urging that the immense peril associated with nuclear weapons be recognized by governments and publics alike. The Russell-Einstein Manifesto warned that nuclear weapons pose a threat to the survival of the human species and called for major efforts to address and contain nuclear dangers. One of the consequences of the Manifesto was the holding of the first Pugwash conference in 1957. The origins and goals of Pugwash are contained in the Russell-Einstein Manifesto: to highlight the dangers of nuclear weapons, to call for the elimination of nuclear weapons, and to promote peaceful resolution of conflicts. Today, July 9, 2020, is the 65th anniversary of the Russell-Einstein Manifesto. We ask, how is the situation now, 65 years later?

It is difficult to imagine what could unite Jürgen Habermas, Francis Fukuyama, Judith Butler, Noam Chomsky, Martha Nussbaum, Michael Walzer, Yuval Noah Harari and Vladimir Mironov.1 However, the renowned Institute for Philosophy and Social Theory in Belgrade (IFDT), founded to settle dissident intellectuals expelled from the university for their involvement in the Yugoslav 1968 protests, managed to do so. An international appeal has reached us in the past few days which has revealed once more the ongoing clandestine attack on freedom of thought and academic autonomy in Serbia. Unfortunately, Serbia is not alone in democratic backsliding, neither in Southeast Europe or Europe more generally, nor at the global level. Democracy has been openly challenged in several EU states, while the most recent developments in the USA have revealed the depth of internal fractures in American liberal democracy. Thus, it is not surprising that the Southeast European region (SEE) - a post-conflict, semi-peripheral area in Europe - faces growing illiberalism and varying types of competitive authoritarianism and new despotism.

While the election of Joe Biden to the U.S. presidency presents an opening to restore the transatlantic relationship after Donald Trump, the real question facing U.S. and European officials is whether they can successfully manage to advance a new transatlantic agenda for the coming decade. Three pivotal areas where cooperation has fallen short in recent years but where there is now significant potential to do more are climate and energy, democracy and human rights, and digital technology issues. Representing the most pressing challenges our societies are facing in the twenty-first century, progress in these three areas could also help rebuild trust and promote cooperation in other policy areas. To get the transatlantic relationship back and on track and to ensure that it will remain relevant in the future, the United States and the European Union should therefore prioritize putting forward concrete ideas and taking actionable steps in each of these areas over the coming four years.

This study seeks to examine institutional frameworks that exist in Botswana to protect the rights of ordinary shareholders. There is no literature on the subject matter in the context of Botswana; hence this study attempts to fill in the literature gap. The study uses a variety of data collection methods, such as semi-structured interviews, the Choppies case study and lessons learnt from other jurisdictions. Findings reveal that ordinary shareholders’ rights protection involves the use of institutional frameworks. In Botswana, existing frameworks are not adequate to protect ordinary shareholders’ rights. Furthermore, the study shows that ordinary shareholders in Botswana are mainly exposed to risks of losing their investments, partially or entirely, in case of non-compliance to regulatory requirements as shown by the reduction in Choppies’ stock price from P1.20 to P0.40 between years 2012 and 2018. The study suggests that the existing institutional frameworks should be reviewed to ensure adequate protection of ordinary shareholders’ rights.

This piece is both an exercise in critical conceptual landscaping in the field of Migration Studies and the proposal of an analytical framework that can correct some of its most serious biases. The framework I propose allows the observing of migration policies as if they constituted a comprehensive policy field. This will permit comparisons across the whole spectrum of migration policies on a rigorous basis, and for all countries and regions. I identify two constitutive sides to the proposed framework, each dealing with how state‐like polities regulate the mobility of incoming or outgoing persons. I further suggest that it include regulations on the rights of individuals to pass through three stages of any international migration journey: the right to enter/exit; the rights as immigrant residents/emigrant non‐residents; and, the rights to citizenship and nationality. This comprehensive framework for studying migration policy promises advances for empirical agendas, but also for connecting them to normative ones rooted in global justice and democratic concerns.

“A human crisis that is fast becoming a human rights crisis”. UN Secretary General António Guterres was among the first to raise the alarm about possible human rights implications of government measures to fight COVID-19. Since its outbreak, 87 states – both authoritarian and established democracies – have declared a state of emergency to curb the spread of the virus, which implies certain derogations from international human rights conventions. Protecting the right to life and physical integrity are fundamental duties facing government authorities, commitments enshrined in law – specifically Article 2 of the European Convention on Human Rights (ECHR) and Article 6 of the International Covenant on Civil and Political Rights (ICCPR). Derogations from human rights conventions are permissible under certain circumstances, but any limitation must be motivated by absolute necessity, must not be disproportionate and must be limited in time.

Las confrontaciones entre las empresas y los pueblos indígenas sobre la energía renovable se remontan a la continuidad de la opresión y la represión de los gobiernos y las empresas hacia los pueblos indígenas, lo cual se denomina colonialismo interno. Basado en un estudio longitudinal en el Istmo de Tehuantepec en Oaxaca, México, este artículo ofrece una forma diferente para discutir derechos humanos y empresas en inversiones eólicas en dicho país. Asimismo, a través de los conceptos de colonialismo interno y justicia ambiental, analiza los Principios Rectores sobre las Empresas y los Derechos Humanos de las Naciones Unidas. El colonialismo interno expone la profundidad de las dinámicas conflictivas en las inversiones eólicas, en los territorios de los pueblos indígenas con respecto a la injusticia ambiental en sus derechos humanos.

Abstract:
There are stateless people all around the globe. The problem is very acute in the Asia–Pacific region. The United Nations High Commissioner for Refugees (UNHCR) estimates that there are 10 million stateless persons across the world. A stateless child is born every ten minutes. What does it mean to be a stateless person? It means you have no identity, you have no nationality. You are not recognised as a citizen of any country. As UNHCR has rightly pointed out, ‘Often they are excluded from cradle to grave— being denied a legal identity when they are born, access to education, health care, marriage and job opportunities during their life time and even the dignity of an official burial and a death certificate.’ Over one-third of the world’s stateless are children

Abstract:
Guantánamo Bay military prison is a site of egregious and ongoing human rights violations perpetrated by the United States government. Opened in early 2002 on a U.S. naval base in Cuba, the prison has housed 780 adults and minors from around the world—all Muslim—most of whom have been subjected to torture and severe abuse at the hands of the U.S. armed forces and the CIA. Most were never formally charged with any crime and were detained for years without trial. As of 2022, thirty-nine remain imprisoned at Guantánamo Bay prison.

Abstract:
U.S. legislation and case law have both upheld and challenged the legal authority of the Guantánamo Bay military prison. This includes the 2001 Authorization for Use of Military Force (AUMF) and the Military Commissions Act of 2006, as well as Supreme Court cases such as Hamdan v. Rumsfeld (2006) and Boumediene v. Bush (2008). Serious legal issues have arisen around the legal rights and protections of those imprisoned, including the right to habeas corpus and the right to be tried under the U.S. legal system (as opposed to U.S. military tribunals). Attorneys for those imprisoned at Guantánamo Bay military prison have been subjected to surveillance and interference by the U.S. government, and the U.S. government tightly controls the release of information about the military prison and those imprisoned there.

Abstract:
A majority of those imprisoned at the Guantánamo Bay Detention Camp were subjected to various forms of physical and psychological abuse—techniques that were developed by two American psychologists contracted by the CIA to develop its torture program. The torture included but was not limited to waterboarding, sexual harassment and abuse, physical abuse, and sleep deprivation. Those formerly imprisoned still experience physical and psychological distress and trauma as a result of their treatment in Guantánamo Bay. A 2014 U.S. Senate intelligence report found the torture program was ineffective in its stated goal of obtaining military intelligence.

Tobias Vestner and Alessandro Mario Amoroso, from the GCSP Security and Law team, are the authors of a Training Guide designed for Swiss private security companies to fulfil the obligations introduced by the Federal Act on Private Security Services provided Abroad (PSSA). The guide is tailored to the needs of companies operating and maintaining weapons systems and/or providing installation services, training on equipment and systems, and/or operational or logistical support to armed forces. Its purpose is to enable company personnel to understand key concepts and standards of human rights and international humanitarian law, including the risk and avoidance of direct participation in hostilities. The various chapters provide the necessary knowledge and tools to train company personnel to identify, prevent, and report activities that can constitute direct participation in hostilities or complicity in human rights and international humanitarian law violations. The guide includes thirty practical scenarios for training on direct participation in hostilities, with answers, which can be used to discuss the risk and avoidance of activities amounting to direct participation in hostilities.

Abstract:
In its current form, the international investment treaty regime may stymie the business and human rights agenda in various ways. The regime may incentivize governments to favour the protection of investors over the protection of human rights. Investment treaty standards enforced through investor-state arbitration risk adversely affecting access to justice for project-affected rights holders. More broadly, the regime contributes to a system of global economic governance that elevates and rewards investors’ actions and expectations, irrespective of whether they have adhered to their responsibilities to respect human rights. Without comprehensive reform, investment treaties and investor-state arbitration will continue to interfere with realization of human rights and broader public interest objectives. This Chapter provides an overview of the interaction between human rights law and the investment treaty regime. It highlights the challenges that arise from tension between international human rights and investment norms, including the impact of the investment regime on the ability of host states to regulate and on access to justice for investment-affected rights holders. The chapter also explores whether and how human rights issues have been addressed by the investment regime to date, highlighting recent developments in treaty drafting practice and responses to human rights argumentation by investment tribunals. It notes the shortcomings of current approaches, and concludes by briefly setting out options for reform.

50. Innovative Financing Solutions for Community Support in the Context of Land Investments

Abstract:
Communities affected by agricultural, forestry, and other resource investments urgently need increased funding for legal and technical support. Without support, communities risk losing access to critical land and resources, suffering human rights violations, or missing opportunities to benefit from investments. A lack of community support can also lead to conflict and challenges that are damaging for companies and host governments. Donors and support providers have found ways to finance support for communities, but such efforts can only extend so far. Promising new opportunities exist for filling the financing gap, yet they will require sustained efforts by a range of actors. This report presents a call to action to help communities secure the support they so crucially need. The report explores options for tapping new funding sources for community support. These include: Government marshaling of funding from companies and others, through taxes, fees, and penalties Basket funds, operated by independent, trusted entities and funded by contributions from multiple actors Market-based impact investments and social impact bonds Direct company funding Third party funding Other solutions for increasing funding or reducing costs, including crowdfunding, generating profits from social enterprises, affordable user fees or in-kind services, contingency and uplift fees, and court-ordered fee shifting. The report also presents overarching considerations for developing a new financing initiative. These include: the initiative’s likely cost, efficiency and financial sustainability, political complexity and obstacles, political economy implications, the importance of strong governance mechanisms, and the logistics required to link funding, communities and support providers.
