Abstract:
The war in Afghanistan represented an eastward shift in the United States' international focus. Previously concentrated on the Middle East, the United States has reconfigured its foreign policy directives to include interests east of the Middle East. The shift was long overdue. Central Asia is a rising regional security concern, and Chinese and Russian actions therein have cultivated robust political ties. Resulting cooperatives and agreements promote Chinese and Russian regional objectives. The Shanghai Cooperation Organization (SCO) originally consisted of five Central Asian and Asian countries (the Shanghai Five), ostensibly to unify signatories on economic, social and political platforms. However, the SCO is often a proxy to advance Chinese and Russian interests.

2. Iraqi Tribunal Imposes Death Sentence on Saddam Hussein

Abstract:
The Iraqi High Tribunal (IHT), or Iraqi Higher Criminal Court, previously known as the Iraqi Special Tribunal (IST), announced Nov. 5, 2006, that it was sentencing former Iraqi dictator Saddam Hussein Al-Majeed to death by hanging. The verdict comes in the first prosecution Saddam has faced before the tribunal, for the 1982 mass killing of villagers in the Shia town of Dujayl and related atrocities. Bringing Saddam and his henchmen to justice has posed unique challenges to an Iraq that seeks to make a former totalitarian dictatorship subject to rule of law, and in the process respect rule of law by providing fair trials. Unclear is the extent to which efforts to establish an historical record of atrocities, and undertake national healing, would be thwarted by executing Saddam before he can be tried for additional incidents. Of added significance are concerns raised by some voices that the death penalty itself is immoral and inconsistent with rule of law.

On Oct. 2 two U.S. and one Afghan soldier were killed in an insurgent attack in Kunar province. Three Americans were also wounded. A U.S. patrol was targeted by a suicide bomber in eastern Afghanistan on Oct. 7 – the five-year anniversary of the launch of Operation Enduring Freedom – no casualties were reported. Six men delivering aid from American forces were killed by a roadside bomb in eastern Afghanistan on Oct. 14. U.S.-led coalition and Afghan troops raided an insurgent hideout in Ghazni Province on Oct. 17; one soldier was wounded and three militants killed.

This report is prepared annually to provide Congress with official, unclassified, quantitative data on conventional arms transfers to developing nations by the United States and foreign countries for the preceding eight calendar years for use in its various policy oversight functions. All agreement and delivery data in this report for the United States are government-to-government (FMS) transactions. Some general data are provided on worldwide conventional arms transfers by all suppliers, but the principal focus is the level of arms transfers by major weapons suppliers to nations in the developing world.

6. Putting the Cart Before the Horse: United States resumes military assistance to Indonesia

In March 2006 the State Department formally ended a seven-year ban on U.S. exports of lethal defense articles to Indonesia. Indonesia had been under various combinations of U.S. military sanctions over the past 14 years, due to persistent and grave human rights violations by members of its security forces. This significant policy change removes all restrictions on military assistance for the first time since 1992. However, in the absence of any documented human rights improvements by the Indonesian armed forces, the timing of the decision is perplexing.

7. Afghanistan Stage III: NATO's most ambitious operation?

In the months ahead, NATO's International Security Assistance Force (ISAF) will deploy thousands more troops to Afghanistan as part of its ongoing mission to “support the Government of Afghanistan in providing and maintaining a secure environment in order to facilitate the re-building of Afghanistan.” Troop levels are expected to rise from about 8,000 in January to 17,000 by the end of October. The expansion, known as Stage III, will be responsible for maintaining security in the troubled southern provinces, where most violent attacks against foreign and domestic forces have taken place. NATO's commander, U.S. Gen. James L. Jones said ISAF could total as many as 25,000 troops eventually. British, Dutch and Canadian forces will be leading the effort to bring peace to Afghanistan through both civilian and military methods. Troops will be engaged in peacekeeping, reconstruction and, in all likelihood, open conflict – an effort Jones called “NATO's most ambitious operation.” Despite a lack of popular support for the missions in all three of the main troop-contributing countries, international leaders have pledged to safeguard Afghanistan from both internal and external forces that would otherwise lead the country into chaos.

Abstract:
A senior U.S. State Department official said on April 3 that more violence was expected in the coming months. Assistant Secretary of State for South and Central Asia Richard Boucher reaffirmed the opinion of some U.S. military leaders that the warmer months and the increased presence of International Security Assistance Force (ISAF) troops would signal a stepped up effort by insurgents to disrupt peacebuilding and reconstruction efforts. Boucher also cited the battle against narcotics traffickers as cause for increased fighting.

9. Terrorism Statistics Flawed

It has become a truism that any attempt to define or quantify terrorism is informed by political trends, and thus subject to fluctuations based not on hard facts but on political fashion. Yet the State Department's now defunct annual publication, Patterns of Global Terrorism, was the closest approximation of any government effort to provide information in an objective and consistent manner. As a successor to Patterns, the report produced by the U.S. National Counterterrorism Center (NCTC) – called A Chronology of Significant International Terrorism for 2004--effectively ends over 20 years of analytical consistency in the U.S. government's terrorism accounting practices.

Abstract:
Three Afghan guards and a French Special Forces officer were killed when insurgents attacked a post in Kandahar on March 4. The same day, a roadside bomb exploded when a government vehicle drove by, killing a local intelligence chief and three of his bodyguards. The Taliban claimed responsibility for both attacks.

This mentality would have you believe that any gains by China are directly at the expense of the United States. Abstract:
The U.S. State Department's list of Foreign Terrorist Organizations (FTOs) began in 1997 as a method of tracking down and striking back against specific terrorist groups around the world. FTOs are designated as such based on a demonstrated capability and/or willingness to engage in terrorist methods that threaten the U.S. national security interests. These methods include attacks on U.S. nationals, and American national defense, military, diplomatic, and economic interests. The FTO list provides the U.S. government with the legal authority to conduct prosecutions against U.S. citizens, or foreign nationals within the country, for aiding — financially, ideologically or logistically — any designated FTO. FTO designation can also mean certain members or representatives of the designated terror group can be denied entry to the United States through visa rejection or other means. The United States also maintains the authority to compel U.S. financial institutions to freeze any assets linked to an FTO and to report them to the U.S. Department of the Treasury pursuant to Executive Order 13244.

On Feb. 28, 2005, the U.S. State Department released its annual Country Reports on Human Rights. The reports detail information on 196 countries compiled by Foreign Service Officers abroad, domestic and international human rights groups, academics, activists, jurists and journalists that work to recount human rights conditions around the globe. These annual reports point "to the areas of progress and draw attention to new and continuing challenges" in the human rights realm, and are to be "used as a resource for shaping policy, conducting diplomacy and making assistance, training and other resource allocations."

15. Law Watch: Abu Ghraib Court Martial: "Ring Leader" Spc. Charles A. Graner, Jr., Sentenced to Ten Years

Abstract:
Spc. Charles A. Graner, Jr., on Jan. 14, 2005, became the fifth U.S. soldier convicted for Abu Ghraib prisoner abuse, all of them reservists. Graner, a prison guard in civilian life, was convicted at a general court martial for maltreatment of persons subject to his orders, conspiracy, assault, indecent acts and dereliction of duty. Unlike several earlier trials for Abu Ghraib prisoner abuse, this trial took place not in Iraq but at Fort Hood, Texas. The jury of 10 officers and enlisted men, all of whom had served in Iraq or Afghanistan, sentenced Graner on Jan. 15, 2004, to 10 years in prison (five less than the maximum possible) and to reduction in rank to private, dishonorable discharge and forfeiture of pay and allowances.

16. Considering China as a Potential Member of the Nuclear Suppliers Group

Abstract:
In January 2004, China formally requested to join the Nuclear Suppliers Group (NSG), an informal multilateral export control regime that aims to contribute to the nonproliferation of nuclear weapons through the coordination and implementation of guidelines which govern transfers of nuclear material and technology. The NSG's membership comprises the principal nuclear supplier states in Europe and the Americas, as well as Australia, Japan, New Zealand, the Republic of Korea, South Africa, and a number of former Eastern Bloc states, including Russia. The group's decisions, including those concerning the admission of new members, are made on a consensus basis, but the informal nature of the organization means that its decisions cannot be construed as legally binding upon its member countries.

With a decision notably brief for the mountain of argument leading up to it, the U.S. Supreme Court in Rasul v. Bush held on June 28, 2004, that foreign nationals imprisoned without charge at the Guantanamo Bay interrogation camps were entitled to bring legal action challenging their captivity in U.S. federal civilian courts.

19. The Proliferation Security Initiative in Perspective

Abstract:
Participant countries of the Proliferation Security Initiative (PSI), a U.S.-led effort to stem the illicit trafficking of weapons of mass destruction (WMD) and delivery systems, met on the first anniversary of the initiative, from May 31 to June 1 in Krakow, Poland. Russia announced on the first day of the meeting its decision to participate in the PSI, a move that U.S. officials had supported as an important step in augmenting the effectiveness of the initiative. However, Russia's participation will only occur, according to the Russian Foreign Ministry, as long as PSI activities do not violate national or international law. Russian officials have similarly expressed concerns that the PSI's land, sea, and air-based WMD interdiction activities could endanger international commerce, and give unwarranted powers to the U.S. Navy to act as a global police force.

Although we did not fully realize it at the time, our planning for Operation Iraqi Freedom (OIF) and our role in the Global War on Terrorism actually started within minutes after the attack on the World Trade Center. On September 11, 2001, the command began assuming roles in three major operations which culminated over nineteen months later with the Coalition victory in removing the Regime of Saddam Hussein and freeing the Iraqi people and the region from his threats.

21. U.S. Military Assistance to 1460 Report Countries: 1990-2005

Abstract:
On Jan. 30, 2003, the United Nations Security Council (UNSC) adopted resolution 1460, which reaffirms the council's previous resolutions (1261, 1314, and 1379) on children and armed conflict and calls on all parties to armed conflict to stop using child soldiers. Resolution 1460 also requests that the UN secretary general list the progress made by the 23 parties to conflict on the Security Council's agenda (S/2002/1299), including governmental armed groups that continue to use or recruit child soldiers. In response to Resolution 1460, and in advance of the Security Council's fourth open debate on children in armed conflict, the Coalition to stop the Use of Child Soldiers published a report that lists 17 countries where child soldiers were being used from January 2003 through September 2003. While the report does not cover every situation where children are being deployed, it specifically includes all of the countries covered on the Security Council's agenda, as well as other situations deemed critical by the coalition.

Abstract:
Since September 11, 2001, the question of how to provide for our security has loomed large over our national life. Many of the Bush administration's answers to this question have come under intense challenge—from the doctrine of preventive war to the development of new designs for “usable” nuclear weapons to the choice of war with Iraq as the centerpiece of its war on terrorism. But until recently one aspect of the administration's strategy has gone virtually unchallenged, namely its military budgets and the spending priorities contained within them. From 2000 to 2004, these budgets have increased by more than 50%. Congress has approved each of these budgets, and virtually the entire menu of programs specified in them, with hardly a whisper of debate.

John Bolton, U.S. undersecretary of state for arms control and international security, triggered a furor when on May 6, 2002, he stated, “The United States believes that Cuba has at least a limited offensive biological warfare research and development effort.” Two days later, I was meeting with a representative from the Cuban Interests Section on an unrelated matter when I posed the question, “How would Cuba respond if CDI asked to bring a group of experts down to learn more about these charges?” I had no expectations of hearing any more about it. But less than two weeks later, I was told that not only was there an interest, but that we were invited to bring anyone, come anytime, and visit anywhere we wanted. Clearly, Bolton's comments had struck a nerve in Havana.

What kind of question is: “What if Sun Tzu and John Boyd did a National Defense Review?” Sun Tzu, if he existed at all, has been gone some 2,500 years. The late Col. John R. Boyd, U.S.A.F., while intimately involved in fighter aircraft design during his active duty years, wrote practically nothing on hardware or force structure after he retired, when he created the strategic concepts for which he is best known today.

In 2001, prior to the attacks of Sept. 11, the Center for Defense Information published a national security review and force structure entitled Reforging the Sword: Forces for a 21st Century Security Strategy. Happily for the authors of Reforging, the Sept. 11 attacks did not make it obsolete. To the contrary, its emphases on working more closely with allies, on lighter, more agile forces, on intelligence, and on the importance of nonmilitary components of a conflict were important elements of the conduct of the counterattack by the administration of U.S. President George W. Bush. The events of Sept. 11 and Operation Enduring Freedom have reinforced the need raised in Reforging to prepare for new threats, and have enhanced the prospects for some of its proposed new directions, particularly in the area of allied collaboration if a multilateralist administration took office. This report updates Reforging the Sword in light of events on and since Sept. 11, 2001. The suggestions here use as a foundation the predilections spelled out in Reforging for working with allies, for taking the nonmilitary elements of modern war into consideration, and for trying to keep humans in the war-fighting loop.
