Abstract:
It would be unrealistic to expect crime to continue dropping sharply as it did in the 1990s, but that is no reason to undermine the progress brought by successful policies. With recent FBI data showing crime on the rise, it is time to reconsider the massive de-funding of one of the most successful federal anti-crime measures of the 1990s: the U.S. Department of Justice's Office of Community Policing Services (COPS) program. The program, authorized by the Violent Crime Control and Law Enforcement Act of 1994, provides grants to state and local police to hire additional officers and adopt aspects of "community policing."

There are frequent complaints that U.S. income inequality has increased in recent decades. Estimates of rising inequality that are widely cited in the media are often based on federal income tax return data. Those data appear to show that the share of U.S. income going to the top 1 percent (those people with the highest incomes) has increased substantially since the 1970s.

Democratic development in the Palestinian Authority (PA) is at the top of the Bush administration's priorities. While the Palestinian Legislative Council (PLC) elections of January 2006 were democratic, democratic elections by themselves do not constitute a democratic system. The current situation in the West Bank and Gaza cannot be called democratic by international norms. Respect for the rule of law and human rights and observation of individual rights and freedoms do not currently prevail in the PA.

What are the relative constraints of a multilateral approach versus a bilateral approach to the use of financial tools against illicit activity? Anytime we see a threat to the country through the financial system, we are going to take action immediately using the domestic authorities we have. We try to be careful, however, to make sure that those are carefully targeted to conduct and are not extra territorial. That provides a good basis for entering into discussion with friends and allies throughout the world, both on a bilateral basis with others and then on a multilateral basis.

On April 30, 2007, the Turkish stock market slumped and the value of the lira dropped following a massive demonstration in Istanbul against the Justice and Development Party (AKP) government, coupled with a statement by the military voicing support for secularism. Previously, the comparatively healthy Turkish economy had boosted the chances that the AKP, rooted in the country's Islamist movement, would achieve further electoral victories this year. On April 24, Prime Minister Recep Tayyip Erdogan named Foreign Minister Abdullah Gul as his party's candidate for president -- a legislatively elected post. In the April 27 parliamentary session, however, the secular opposition boycotted the vote, and the AKP failed to muster the required two-thirds majority. The Turkish constitutional court subsequently annulled the vote, and the status of the presidential election is now uncertain. In the meantime, the parliament has moved legislative elections up from November to July 22.

707. Brazilian Counterterrorism Efforts: Legislative Progress, But Little Action on the Ground

Abstract:
In March, Brazilian authorities drafted a new antiterrorism law instituting stiff penalties for a variety of violent acts committed by both individuals and organizations. The new legislation, expected to pass Brazil's congress in a modified form, will likely be used to target criminal gangs from Brazil's indigent favela neighborhoods, not Middle Eastern terrorist groups operating in the Argentina-Brazil-Paraguay Tri-Border Area (TBA). Brazil denies that illegal terrorist activities are being conducted in the TBA, and it does not regard groups like Hizballah or Hamas as terrorist organizations. Much of the legal foundation needed to successfully combat international terrorism is already in place in Brazil, but the government has not demonstrated the will to confront the problem.

On March 17, the Palestinian Legislative Council (PLC) approved the formation of a Hamas-Fatah national unity government by an 83–3 margin. This culminated a process that began in early February with the Mecca accord facilitated by Saudi Arabia's King Abdullah. Many governments have withheld comment since that accord. One reason for their relative silence is reluctance to criticize a project associated with King Abdullah, who is emerging as a leading force in the Arab world and a linchpin of U.S. efforts to isolate Iran. Another is bated hope that the new government guidelines will be a marked improvement over those of the current Hamas government. Since Hamas's victory in January 2006 parliamentary elections, the focus has been on three principles proposed by the Quartet (the United States, Russia, the European Union, and the UN): (1) recognition of Israel, (2) disavowal of violence, and (3) adherence to past written commitments.

Since a roadside bomb exploded on January 25—targeting a vehicle carrying members of Hamas\'s Executive Force—more than thirty-two people have been killed, seventy-five injured, and dozens kidnapped in the deadliest wave of fighting between Hamas and Fatah to date. For the past five years, U.S. Army and Marine Corps officers have been operating in highly complex combat environments in both Afghanistan and Iraq. Uniformed decisionmakers realized early on that these wars required a wide array of skill sets and areas of expertise beyond those traditionally taught to junior officers. Army chief of staff Gen. Peter Schoomaker has stressed the need for a new kind of Army leader skilled in governance, statesmanship, and diplomacy and able to understand and work within different cultural contexts. The question, then, is to what extent the education given to future ground component officers at the U.S. Military Academy at West Point and the U.S. Naval Academy at Annapolis is working to produce such leaders. Specifically, to what extent are the traditional engineering-based curricula at the nations service academies producing leaders with the requisite language and cultural skills necessary to be effective officers on the ground in Iraq and Afghanistan?

716. Lebanon Goes to Paris III: High Stakes in France and Beirut

On January 25, Lebanon will participate in Paris III, the third international donor conference for Lebanon convened by French president Jacques Chirac since February 2001. The top agenda items are grants and soft loans for Lebanon and the economic reform plan of Lebanese prime minister Fouad Siniora. For Siniora and his "March 14" ruling coalition, the success of the conference -- i.e., international commitments to provide billions to Lebanon -- is exceedingly important, as the government is coming under increasing pressure from the Hizballah-led opposition. Indeed, this week, the opposition upped the ante in its continuing effort to topple the Siniora government, closing key Lebanese arteries, including the highways into Beirut and the airport road. If Paris III is broadly perceived as "successful," it will strengthen Siniora and demonstrate that the March 14 coalition can govern and advance key Lebanese interests without Hizballah participation in government. Should international donors not prove particularly generous, the momentum will shift toward the opposition.

As international pressure on the Iranian government toughens, the Iranian regime is facing more fragmentation at home. In an unprecedented action against a sitting president, 150 of the 290 members of the Iranian Majlis (parliament) signed a letter blaming President Mahmoud Ahmadinezhad for raging inflation and high unemployment, and criticizing his travel to Latin America at a time when he has not sent the Majlis a draft budget for the fiscal year that starts March 21. Under Iranian law, this letter constitutes the first step required if the Majlis wants to remove the president from office.

On December 17, a donor conference will convene in Paris with the goal of bolstering Palestinian governance in the West Bank -- the first such meeting since the 2006 Stockholm conference. Current Middle East envoy Tony Blair has expressed optimism that the international community will support President Mahmoud Abbas and technocratic prime minister Salam Fayad. A sum of $5.6 billion is needed for the 2008-2010 period, and with the price of oil close to $100 per barrel, that target could be reached easily with contributions from the Gulf. But how much are the Gulf Arab states actually prepared to contribute to an issue that would seem to rank as one of their great political priorities?

Foreign aid is an important and effective tool for buttressing allies, alleviating poverty and suffering, supporting key foreign policy objectives, and promoting the image and ideals of the United States abroad. Indeed, as its own website attests, the U.S. Agency for International Development (USAID) "plays a vital role in promoting U.S. national security, foreign policy, and the War on Terrorism." Toward these goals -- and considering that several agency-approved aid recipients have been linked to terrorist groups in recent years -- USAID's proposed new partner-vetting system (PVS) is a welcome and overdue development.

Conceived in 2003 and 2004, the European Neighbourhood Policy (ENP) has now had two years of operational experience. This initial experience has seen a sorting out of the partner states, with Action Plans drawn up for five Eastern and seven Southern partner states. We would distinguish among these 12 states between the 'willing' and the 'passive'; and among the other partner states without Action Plans between the 'reluctant' and the 'excluded'. These groupings should be the basis for stronger differentiation in the policy packages offered by the EU. In general the political context now calls for a strong reinforcement of the ENP, since the benign situation of 2004 has given way now to a more menacing one, given threats to European values bearing down on the EU from all sides. The EU institutions recognise these needs in principle, and last December the Commission advanced many valuable proposals. 'ENP plus' is a term being used by the current German Presidency, without this yet being defined in a public document in operational detail. In our view, 'ENP plus' could mean: Plus an advanced association model for the able and willing partner states, Plus a strengthening of regional-multilateral schemes, Plus an upgrading of the standard instruments being deployed, and Plus the offer of an 'ENP light' model for difficult states or non-recognised entities.

Abstract:
Globalisation is being blamed for the squeezing of the middle class and protectionism is being offered as a solution. We argue in this paper that the increase in inequality is a long-term trend resulting from a variety of factors, including the decline in manufacturing, the reduction in the progressivity of taxation and the steady increase in asset prices, and that globalisation has only had a marginal impact on it. Protectionism will not reverse any of these trends. We discuss some policy options aimed at cushioning this increase in inequality and argue that they will likely result in expanding fiscal deficits and pressure on central banks to test the limits of growth.

In its Communication on Enlargement Strategy and Main Challenges 2006-2007, released 8 November 2006, the European Commission concluded: “Overall, the fifth enlargement has been a considerable success” and “(t)he EU's institutions have continued to function effectively” (p. 4). In his speaking points to the press, Enlargement Commissioner Olli Rehn (2006) stressed two important criteria for evaluating the integration process: With respect to institutional matters, the EU's decision-making processes must remain effective and accountable, for the sake of current member states as well as in view of further enlargement. With respect to policy-making, the EU needs to be in a position, as it enlarges, to continue developing and implementing common policies in all areas. Accordingly, assessment of the impact of enlargement on EU policies is planned to take place at all key stages of the enlargement process.

727. Nagorno-Karabakh: Risking War

Abstract:
Armenia and Azerbaijan have failed to resolve the Nagorno-Karabakh conflict, even though the framework for a fair settlement has been on the table since 2005. A comprehensive peace agreement before presidential elections in both countries in 2008 is now unlikely but the two sides still can and should agree before the polls to a document on basic principles, which if necessary clearly indicates the points that are still in dispute. Without at least such an agreement and while they engage in a dangerous arms race and belligerent rhetoric, there is a risk of increasing ceasefire violations in the next few years. By about 2012, after which its oil revenue is expected to begin to decline, Azerbaijan may be tempted to seek a military solution. The international community needs to lose its complacency and do more to encourage the leaderships to prepare their societies for compromise and peace.

728. Winding Back Martial Law in Pakistan

General Pervez Musharraf imposed martial law in Pakistan on 3 November 2007. He suspended the constitution, sacked the chief justice of the Supreme Court and removed other judges of that court who declared his act illegal. Police immediately began arresting lawyers, politicians and human rights activists. Independent television channels were taken off the air and reporting restrictions imposed. Thousands have since been jailed, journalists threatened and protests by lawyers and others suppressed. Replacing dissenting judges with hand-picked appointees, and ruling by decree, Musharraf's objective is to retain personal power by gaining judicial approval for martial law, followed by the creation of a democratic façade through rigged elections. The international community should demand the immediate restoration of constitutional order, the rule of law and the legitimate judiciary, the release of political prisoners and the appointment of an impartial caretaker government to oversee free and fair elections.

Sinhala nationalism, long an obstacle to the resolution of Sri Lanka's ethnic conflict, is again driving political developments on the island. Nationalist parties, opposed to any significant devolution of power to Tamil areas of the north and east and to negotiations with the Tamil Tigers, help set President Mahinda Rajapaksa's agenda. The government takes a hardline stance, responding in part to opposition to the flawed 2002-2006 ceasefire and peace process. Would-be peacemakers need to better understand Sinhala nationalism, which is too often dismissed as merely irrational and racist. The risk that Ethiopia and Eritrea will resume their war in the next several weeks is very real. A military buildup along the common border over the past few months has reached alarming proportions. There will be no easy military solution if hostilities restart; more likely is a protracted conflict on Eritrean soil, progressive destabilisation of Ethiopia and a dramatic humanitarian crisis. To prevent this, the international community – in particular, the UN Security Council and the U.S., which is the single most influential outsider – must act immediately to give both sides the clearest possible message that no destabilising unilateral action will be tolerated. Once the immediate danger is past, efforts should be reinvigorated to ensure that the parties comply with their international law obligations, disengage on the ground and restore the Temporary Security Zone (TSZ) – in a longer time frame – to develop political and economic initiatives for resolving the fundamental problems between the old foes.

On 6 December 2006, Joseph Kabila was sworn in as the first democratically elected president since Congolese independence, concluding a landmark electoral process largely devoid of major violence or gross irregularities. Democratic governance is now expected to support peacebuilding and reconstruction. The new government has weak and barely functioning institutions, however, and the international community, which has given decisive support to the peace process, must continue to help it overcome serious security and political challenges. Immediate agenda items include to set up promptly a new structure to coordinate aid efforts, renew the United Nations Mission (MONUC) with a strong mandate and increase efforts to improve security throughout the country.

As Democrats took over the United States Congress in January 2007, many trade advocates trembled. Over the past decade, votes on trade liberalization had broken increasingly along partisan lines. Trade promotion authority (TPA)—indispensable for negotiating new trade agreements—passed by just one House vote in December 2001, with just 21 out of 210 Democrats in favor. In July 2006 the Central American Free Trade Agreement—Dominican Republic (CAFTA-DR) won by just two votes, with a minuscule 15 of 202 Democrats voting “aye.” By one accounting, voters in November 2006 had replaced 16 trade-friendly House Republicans (and five similar Senate Republicans) with tradeskeptical Democrats. No seats in either house moved in the free trade direction (Evenett and Meier 2006).

The United States and Russia have the biggest responsibility for countering nuclear terrorism because together they account for the overwhelming share of global nuclear materials, expertise and weapons. The two countries also have between them the most substantial capacities in counter-terrorism intelligence and response. There is little to separate the two in their policies against nuclear terrorism. Where there are differences in approach on some aspects of nuclear proliferation, the two countries have accepted an obligation as the pre-eminent nuclear powers to try to narrow their differences. The international community cannot defeat nuclear terrorism or limit it without an active and vigorous alliance between Washington and Moscow.

The March 2007 Ouagadougou Political Accord (OPA), signed by Laurent Gbagbo, president of Côte d'Ivoire, and Guillaume Soro, leader of the Forces Nouvelles (FN) rebel movement, holds great promise for ending the current political stalemate and reuniting the country. The political crisis began in September 2002 with an attack by military officers protesting the government's decision to demobilize them; according to some, it was also, an attempted coup d'état. The uprising generated other rebel groups, which took control over the northern part of the country and ignited a civil war. Even after the brunt of the fighting ceased, the country remained divided, with northern Côte d'Ivoire devoid of public services and the state's administration. The OPA is the sixth peace agreement directed at ending the political crisis; the previous five were never fully implemented due to, among other factors, disagreements about the selection of the mediator, the absence of political will among the signatories, and the tense relationship between the government of Côte d'Ivoire and the United Nations. Blaise Compaoré, president of Burkina Faso, mediated the negotiations leading to the signing of the OPA. Burkina Faso remains the facilitator of the agreement's implementation.

The discussion drew on a new RAND book, The Beginner's Guide to Nation Building, whose authors include Dobbins and Cole, a “Framework for Success for Societies Emerging from Conflict” developed by USIP, and new operating models nearing approval by the U.S. government for the deployment of civilians to missions abroad. This USIPeace Briefing highlights the main points made during the discussion and does not represent the views of the Institute, which does not advocate specific policies. Drawing on past experience, the panel emphasized that the success of future nation building missions depends on acquiring support from policymakers in Congress and the Administration, applying lessons learned in the past, using common frameworks and doctrine for the future, and increasing civilian capacity, which is sorely lacking.

In February 2007, the U.S. Institute of Peace (USIP) facilitated a series of dialogues in Kathmandu, Nepal between civil society, the Nepal police, and representatives of political parties. The aim was to identify those areas of mutual concern related to security and the rule of law in Nepal. Civil society representatives from development organizations, media, human rights groups, the legal community, and Dalit and Janajati rights groups participated. The representatives from the Nepal police included deputy inspector generals, senior superintendents, superintendents, and deputy superintendents of police. The dialogue sessions were conducted over the course of four days. On day one, civil society representatives met to discuss the challenges and possible solutions to security and the rule of law. The next day, the police discussed the same issues. On day three, the two groups came together to develop a joint list of high-priority issues. On the final day, the police and civil society representatives presented this joint list to political party representatives.

The Democratic Republic of Congo (DRC) is among the most mineral-rich countries in Africa. During the war, those natural resources fueled the conflict, and provided illegal sources of wealth for some. Now, as the DRC undertakes the rebuilding of its economy, the management of natural resources serves as a key component in its development strategy. Properly and profitably managing natural resources in the DRC is a complex task that must take into account security issues, regulatory reform, the structure and legality of past contracts, and the political environment for change. To address these issues, the U.S. Institute of Peace organized a meeting of the Congo Peacebuilding Forum on May 17, 2007. Panelists included Rico Carisch, of the United Nations Group of Experts for the DRC, and Peter Rosenblum, of Columbia University School of Law. The recent and widespread sense of crisis in the European Union (EU), with competing demands for a more social Europe, limiting further enlargement, greater protection of the environment, and less immigration, for example, suggest that new lines of political contestation are challenging conventional ways of thinking about EU politics. The EU Internal Dynamics (EU ID) unit at the Danish Institute for International Studies is launching a project, subject to external research funding, to analyse the extent and ways in which new political issues such as climate change, immigration, security and enlargement, are leading to new lines of political contestation in the EU. The objective is to understand if and why the two conventional lines of contestation over more or less integration and left or right politics in the EU need to accommodate emerging lines of political contestation over a more cosmopolitan versus a more communitarian EU. The biggest surprise in the current Danish debate is that there is still very broad coverage of EU issues involving the media and public conferences, particularly regarding the Constitutional Treaty; energy and the environment; enlargement to South Eastern Europe and beyond; and more recently the difficult relations between Russia and the EU. The public debate over the Constitutional Treaty is active, while the government looks forwards to what the German Presidency, as well as the 'No' countries, put forward as suggestions after the French Presidential elections. Following Denmark's four-point suggestion at Lahti for an EU energy policy, the Danish concerns over renewable supply, increased efficiency, a liberalised market, and more research in order to improve energy security have heightened. After the Commission's report of enlargement and integration capacity, the Danish debate has focused on support for the Croatian bid for EU membership, whilst emphasising the need for considerable reforms in Turkey. Finally, following the rebuke by Denmark, Sweden, Estonia and Poland in Lahti on the question of human rights in Russia after the murder of Anna Politkovskaya, the failure to overcome the Polish-Russia impasse at the EU-Russia summit is also important in the Danish debate.

China has in a very short time span embraced multilateral mechanisms to address a broad range of issues and avoided confrontation with the United States. Both stances have shaped Asian and European views of a rising China. At present, Asian and European leaders take China's word regarding its peaceful intentions as a rising power. However, Asian and European policy-makers tend to refrain from confronting China too strongly on issues sensitive to Beijing (poor implementation of intellectual property rights, disregard for human rights, etc). The more prosperous China grows, the less influence any other country will have over Beijing's policies. A rising China is a challenge to others because of its sheer size, its great need for imported energy, and the environmental degradation it causes due to its ongoing industrialization. The troubled relationship between China and Japan is one of increasing concern and could lead to aggravated tensions in East Asia.

Even our language reflects these ancient roots: “rivalry” comes from the Latin rivalis, or “one using the same river as another.” Countries or provinces bordering the same river (known as “riparians”) are often rivals for the water they share. Competition policy plays a key role in promoting consumer welfare and market opening. Lack of competition is a main reason for the high prices of many products and services on the Swiss market. Traditionally, Swiss competition policy has been relatively lenient and low profile, allowing a relatively uncompetitive internal market to remain unchallenged. The impact of competition policy on economic development has therefore been at best neutral. As the slow rate of growth becomes an issue, however, a more vigorous approach to competition has been identified as an important factor for improving growth prospects. The 2003 reform of the Cartel Act strengthened Swiss competition law, in particular by introducing direct sanctions for the most serious infringements and a leniency programme, thus bringing it closer to that of the European Union and of many other OECD countries. The Swiss Competition Commission has been given considerable new powers to combat private restraints of competition. Comco will have to enforce the new laws resolutely and step up action to promote regulatory reforms. In doing so, it is burdened by institutional arrangements and mechanisms that temper its full independence. The Swiss competition enforcers do not benefit from the networks of exchanges available to national competition authorities in EU member States. Matters are further complicated by a relative lack of resources. Strengthening competition is a key for an effective internal market. The amendments to strengthen the Cartel Law and pending reform proposals signal determination on the part of the Confederation to tackle the problems. It is too early to say how effective they will be and the extent to which they will encourage a change in general attitudes, notably among the sub federal levels of government.

China is confronting widespread violent and even deadly social unrest, raising Communist Party alarms about national security. Some observers speculate that unrest could undermine China's national leadership, as it did in the Ukraine and the Philippines. Some U.S. policy makers might welcome unrest in China as a path to democracy and “freedom.” But rather than an opportunity to transform China's political order, China's social unrest should be understood as the unavoidable side effects—worsened by local corruption—of successful market reforms and expanded economic and social choice. Managing this unrest humanely requires accelerated reform of legal and social institutions with special attention to corruption. More violence would generate more suffering, potentially destabilizing East Asia and harming U.S. interests. The United States should encourage China to strengthen its social reconciliation capabilities, without making electoral political reform a prerequisite for intensifying engagement across the board.

The index presented in this report attempts to measure how closely existing school systems resemble free markets and rates education policy proposals on how conducive they are to the rise of competitive marketplaces. We define an education market as a system that provides the freedom for producers and consumers to voluntarily associate with one another, as well as the incentives that encourage families to be diligent consumers and educators to innovate, control costs, and expand their services. It is a system in which schools can offer instruction in any subject, using any method, for which families are willing to pay.

The West at War focuses on both U.S. and European counterterrorism efforts from the September 11 attacks until June 2005, specifically the role of law enforcement and prosecutors in the United States and Europe. The 9-11 Commission's examination of the counterterrorism policies of Britain and especially Germany made clear that Europe did not posses the adequate tools to counter the terrorist threat prior to the September 11 attacks. Al-Qaeda's Hamburg cell produced the leaders of the September 11 hijacking teams. Prior to the September 11 attacks, German authorities were constrained by domestic factors that inhibited their ability to investigate terrorist organizations. While Europe's approach to terrorism suffered from many problems, there are also were some potential lessons for the United States. In particular, the experience of Britain's domestic intelligence agency MI-5 may have possible implications for strengthening the counterterrorism capabilities of U.S. authorities.

Abstract:
On September 11, 2006, advisors to Palestinian president Mahmoud Abbas and prime minister Ismail Haniyeh announced that the two had reached agreement on the formation of a national unity government after months of on-again, off-again discussions. The core of the agreement appears to be that Haniyeh will remain prime minister, Hamas will yield some key ministries, such as finance and foreign affairs, to Fatah, and the government will adopt some formula for its program that will allow it to claim it has met the Quartet's three conditions for renewing international aid. According to the Quartet's statement on January 30, “future assistance to any new government would be reviewed by donors against that government's commitment to the principles of nonviolence, recognition of Israel, and acceptance of previous agreements and obligations, including the Roadmap.”

On August 15, Syrian president Bashar al-Asad gave a significant policy speech to the Syrian Journalists Union in which he expressed his support for Hizballah. More importantly, the address sought to redefine Syria's position in the Arab world. Building on Washington's talk of the birth of a new Middle East, Asad described his own vision for a new Middle East, one with an empowered Arab resistance, a weakened Israel, and a renewed regional unity against Western interests.
