6801. The Role of the Ministerial Advisor in Security Sector Reform: Navigating Institutional Terrains

Abstract:
International actors in Security Sector Reform (SSR) are increasingly taking on roles as “advisors” to Ministries of Interior, Defense, and Justice. Rather than directly implement changes necessary for SSR, these advisors must persuasively articulate suggestions to their local counterparts. Advisors' success depends on their ability to convey recommendations in a manner that makes change acceptable to their advisees. Ministerial and governmental advising is not the exclusive purview of any one entity. Rather, advising is undertaken by a diverse range of individuals from U.S. and foreign governments, militaries, NGOs, private contractors, and U.N. agencies. These actors have correspondingly diverse objectives and approaches to SSR; without coordination or consensus on SSR programming, advisors may find themselves working at cross - purposes. Furthermore, the multiplicity of advisors and institutions makes sharing best practices and improving over time and across conflicts extremely difficult.

In meetings conducted in Baghdad in May 2009, senior Iraqi leaders indicated how they interpret January's provincial election results, expressed concerns about the recent downturn in security, lamented the tremendous financial pressure the government is feeling due to the decline in oil prices, and projected their hopes for national elections slated for 30 January 2010. The Iraq is, numbering about 20, represented the highest level of nearly all of the main Iraqi political factions, including leaders in the Council of Representatives (COR), members of the presidency, and top officials in the government.

In 2009, Haiti has been the subject of an unprecedented diplomatic initiative led by the United Nations. In rapid succession, Haiti received visits from the UN Secretary General Ban Ki-moon, the UN Security Council, former President Bill Clinton and Secretary of State Hillary Clinton and numerous senior delegations from Caribbean and South American countries. In April, Haiti was the subject of an international donors' conference hosted by the Inter-American Development Bank that reaffirmed previous commitments and pledged $324 million in new economic assistance. The visits and the donors' conference were preceded by a UN sponsored report by Oxford economist and bestselling author Paul Collier on specific steps that could help Haiti achieve economic security.

The assassinations of the chief of defence staff, General Batista Tagme Na Wai, on 1 March 2009 and Presi- dent Joao Bernardo Nino Vieira early the next day have plunged Guinea-Bissau into deep uncertainty. National Assembly Speaker Raimundo Pereira was quickly sworn in as interim president pending the election the constitution requires. That the killings occurred only months after the acclaimed November parliamentary elections, however, indicates that, in current circumstances, the democratic process cannot cope with the rule of the gun, as well as the extent to which the military's use of force has overwhelmed state institutions. Without outside help to end military involvement in politics and impunity, it may be impossible to halt a slide into further violence. Elites need to stand up to the military, but they require support. The international community should work for an international or hybrid commission of inquiry into the killings. Security system reform needs to be improve d by better international coordination and creation of a national commission with enhanced autonomy.

President Barack Obama publicly unveiled his administration's so-called AfPak (Afghanistan-Pakistan) strategy on March 27, 2009. Over the subsequent weeks, the White House has also briefed relevant congressional leaders and committees, the media, NATO allies, and other regional and international partners. The U.S. House of Representatives has moved ahead with its own legislative debate (the PEACE bill), and the administration recently submitted a 2009 supplemental budget request consistent with its new strategy.

For perhaps the first time since Iran and the U.S. broke ties in 1980, there are real prospects for fundamental change. The new U.S. president, Barack Obama, stated willingness to talk unconditionally. Iran's Supreme Leader, Ayatollah Khamenei, implicitly blessed dialogue, and presidential candidates are vying to prove they would be the most effective interlocutor. Yet, while U.S. objectives and tactics are relatively familiar, little is known of Iran's thinking, even as much is assumed. Western interaction with its opaque political system and decision-making has both shrivelled and been narrowly focused on the nuclear file. Under-standing Iran's perspective is critical if engagement is to succeed. This briefing, based on meetings with officials and analysts, seeks to shed light on what Tehran thinks about dialogue, its goals and visions of a future relationship. It concludes that while full normalisation might be out of reach for now, there is a chance to achieve a more realistic objective: the start of a long-term dialogue that minimises risks of confrontation and advances areas of mutual interest.

The Israeli military campaign in Gaza has exacerbated the already strained relationship between Hamas and Egypt, and threatens to further undermine their ties. Under increasing stress from Israeli air operations over the past week, Hamas has been pressing Egypt to open the Rafah Crossing to provide sanctuary to ordinary Gazans and the organization's targeted leadership. Instead of helping Hamas, however, Cairo -- which views its own Islamists with increasing concern -- seems more interested in weakening the organization. Although the relationship appears poised for a breakdown, Hamas, with only Israel and Egypt on its borders, will continue to depend heavily on Cairo if it hopes to remain in power in Gaza.

Le 4 mars 2007, les deux principaux protagonistes de la crise ivoirienne signaient l'accord politique de Ouagadougou (APO). Ce compromis a, dans un pre-mier temps, apporté un environnement de paix en Côte d'Ivoire. La ligne de démarcation entre les deux pro-tagonistes a été démantelée. Un nouveau gouvernement a été formé et les bases ont été jetées pour apporter une réponse aux deux questions-clés du conflit : l'identité et la citoyenneté ivoiriennes et la légitimité du pouvoir. Mais, plus de deux ans après son adoption, l'APO va mal. Une sortie de crise sera possible uniquement si les engagements pris dans la capitale burkinabé sont enfin suivis d'effets. Sortir la Côte d'Ivoire de sa décen-nie de crise ne nécessitera pas seulement l'organisation d'élections crédibles mais impliquera également des progrès significatifs dans le processus de désarmement ainsi qu'une véritable réunification de l'administration. Ceci demandera la remobilisation de la facilitation burkinabé et une pression accrue des partenaires inter-nationaux sur les acteurs du conflit.

The international community is currently in the midst of negotiating a follow-up agreement to the Kyoto Protocol, due to be concluded at Copenhagen in December this year. The European Union has so far taken extensive measures internally to comply with its commitment under the Protocol, and has thereby led the global effort to slow down climate change. At Bali in December 2007, the European Union played an active role in brokering a deal with developing countries on the Copenhagen building blocks, while US climate politics were still largely in gridlock.

Turkey is a country that appears destined to provoke debate. Ankara's recent foreign policy activism is a case in point. For quite some time, the Turkish top leadership has been tirelessly criss-crossing the globe – from Algeria to Saudi Arabia and from Russia to Azerbaijan. Everywhere they go, the Turks tend to air new diplomatic initiatives, offer mediation, advance blueprints for new regional security regimes and, last but not least, seek to boost trade ties. There is one feature, though, that cannot fail to catch the eye: almost all of Turkey's foreign policy moves over the last couple of years have a pronounced Eurasian and/or Middle Eastern bent.

Finland is to elect 13 representatives to the seventh European Parliament on 7 June 2009. In the last European elections in 2004, EU-wide voter turnout remained at 46%, the figure in Finland reaching only 41.1%. This was, however, a considerable improvement on the 1999 elections, where Finnish turnout was a meagre 31.4%.

The Russian Cabinet discussed a draft 'climate doctrine' on 23 April 2009. The document, opened for comments 28 May 2009, is a political declaration on the approach to climate change. The debate around the doctrine was largely based on the scientific report published by the Hydrometeorological Service of Russia (Roshydromet) in February 2009. This document recognizes climate change as a human-induced phenomenon and acknowledges the main characteristics of the changes expected.

Stability has not been characteristic of the Russian party system: political parties have appeared and disappeared between the federal elections, both politicians and the electorate have changed their affiliation, and legislation regarding political parties and elections has been amended. During the 2000s, the party system has also undergone significant changes. Both the changed political culture and the creation of Putin's power vertical have required – and enabled – a stronger control of the party system by the executive power. We can even argue that the most important actor in the party system is the executive power and, in particular, the presidential administration. The parliamentary tool in the hands of the executive power is the United Russia Party, which received the majority of the seats in the State Duma in the last two elections in 2003 and 2007, and thus ensured a smooth process for adopting the bills prepared by the president, the presidential administration or the government. Economic growth and the popularity of Mr Putin have secured the survival of the current party system as part of the power vertical but now, with the consequences of the economic crisis and with a president more liberal in his rhetoric than his predecessor, there are expectations, and even some signs, of the liberalization of the party system.

Under the Kyoto Protocol, Japan has pledged to reduce its GHG emissions during the first commitment period by 6% relative to 1990. However, Japan's national GHG inventory indicates that emission levels for 2007, the latest year for which official estimates are currently available, have reached 1.374 billion tons of CO2 equivalent, representing a 9% increase relative to the base year.

It is broadly accepted that we need to restrict global temperature increases to as far below 2°C as possible if we are to avoid triggering runaway, irreversible and catastrophic climate change. The World Business Summit on Climate Change provides an example of the leadership role that the global business community has assumed in paving the road to a post-2012 climate regime. Among various proposals from the business lobby for the creation of a policy for concerted action on climate change, the concept of co-operative sectoral approaches has risen to the top of the agenda. The Bali Action Plan of December 2007 put sectoral approaches officially on the negotiating table, with its proposal for 'cooperative sectoral approaches and sector-specific actions' as a means to 'enhance implementation of' articles in the UN Framework Convention on Climate Change (UNFCCC 2007: Art. 1 (b) (iv)).

In June 2009 the blockade on the Gaza Strip enters its third year. The intense closure policy, coupled with the government of Israel's recent military operation 'Cast Lead', has had a devastating impact on the lives and livelihoods of one and a half million Gazans, pushing them further into poverty and aid dependency. Parties to the conflict and the international community have, to varying degrees, prioritised their own political objectives over people's rights and needs, leaving Gazans sitting on the ruins of their homes. By attempting to isolate Hamas, the government of Israel and key international donor governments and institutions have in fact isolated the people of Gaza, thereby reducing chances of securing a peaceful, just and durable resolution to the Israeli-Palestinian conflict.

A fair and adequate global climate regime requires a massive effort across the board to reduce the risks to lives and livelihoods that poor people face first and most. Rich countries must reduce greenhouse gas (GHG) emissions first and fastest, with ambitious targets at home. High levels of rich-country pollution over the last century mean that even ambitious emissions-reductions targets will not be enough to avoid catastrophic climate change. Deep emissions reductions in rich countries are still critical, but climate security will now be won or lost as a result of co-operative efforts in which rich countries finance large-scale reductions in emissions in developing countries. Establishing a Global Mitigation and Finance Mechanism could achieve these reductions while respecting principles of equity, and delivering tangible development gains for poor people. This must be a centre piece of the Copenhagen deal in December 2009. But much greater political attention and support is needed for this vital part of the deal to be developed in time.

It is the world's biggest and fastest human displacement in over a decade. The offensive launched by the Pakistan army against armed militants in North West Frontier Province (NWFP) at the end of April 2009 has resulted in a massive exodus requiring an enormous humanitarian response. Although exact numbers are difficult to verify, at least two million women, men, and children fled their homes in the districts of Swat, Dir and Buner, mostly during May. In late May, the UN refugee agency (UNHCR) was registering 126,000 newly displaced people per day.

The Group of Eight (G8) leaders established the Counterterrorism Action Group (CTAG) at the 2003 Evian summit with a view to enhancing global counterterrorism capacity-building assistance and coordination activities and to reducing duplication of effort. The G8 had become increasingly dissatisfied with the slow progress of the UN Security Council's Counter-Terrorism Committee (CTC) in trying to stimulate and help coordinate global counterterrorism capacity-building activities during the first two years of the latter's existence. Among the goals in creating the CTAG was to offer the CTC a donor forum in which to share information regarding priority assistance needs related to the implementation of Security Council Resolution 1373, with a view to identifying the appropriate donors to address each identified need. The G8 agreed to invite “other states, mainly donors,” and the CTC to join the group, which now includes Australia, the European Commission, Spain, and Switzerland.

For much of the period following the attacks of September 2001, the United Nations' response to terrorism was dominated by the UN Security Council, which adopted a number of resolutions imposing a range of counterterrorism-related obligations on all member states. Perhaps the most significant of these is Resolution 1373 (2001),1 which enumerated a detailed list of obligations, such as criminalizing the financing of terrorism, freezing terrorists' assets, denying terrorists safe haven, and bringing terrorists to justice, that all member states must undertake as part of a global counterterrorism campaign, regardless of other, more pressing priorities or the perceived level of the threat. These requirements in turn generated a host of counterterrorism responses at the regional, subregional, and national levels around the globe.

6836. Indonesia: The Hotel Bombings

On 17 July 2009, suicide bombers attacked two hotels in the heart of a Jakarta business district, killing nine and injuring more than 50, the first successful terrorist attack in Indonesia in almost four years. While no one has claimed responsibility, police are virtually certain it was the work of Noordin Mohammed Top, who leads a breakaway group from Jemaah Islamiyah (JI), the regional jihadi organisation responsible for the first Bali bombing in 2002. One of the hotels, the Marriott, was bombed by Noordin's group in 2003; this time, a meeting of mostly foreign businessmen appears to have been the target. The restaurant of the nearby Ritz-Carlton was also bombed.

6837. Bosnia: A Test of Political Maturity in Mostar

The administration of Mostar is collapsing, a warning sign for Bosnia and Herzegovina (BiH). There has been no mayor, budget or functioning city council since an October 2008 election; tension threatens to poison relations between the leading Bosniak and Croat parties, which are coalition partners throughout BiH. The crisis is rooted in ethnic demographics, recent conflict history and a city statute that replicates many of the power-sharing rules that govern the state. Mostar's Croat majority, much like the state's Bosniak majority, chafes against these rules, considering them illegitimate and foreign-imposed, and seeks to force the Office of the High Representative (OHR – the international community's peace implementation body) to impose a solution on its behalf. Yet, a fair solution is within the council's competence and, like the city's chronic grievances, can best be handled without the High Representative using his extraordinary (Bonn) powers. The international community should deliver the message that fourteen years after the end of their war, it is time for the Bosnians to take responsibility for their own futures.

President Obama has been supporting a new bill, the Employee Free Choice Act, designed to promote the labor unions' drive for unionization. This bill, if enacted, will surely be a big boon for unions as it helps enlarge their membership, enhance their bargaining power vis-à-vis businesses, and enrich their coffers to wield political clout. An important issue here, however, is how such reinforced unionism contributes to the U.S.'s much needed industrial competitiveness and employment—and, more specifically, how this new policy will affect the U.S. as a host to FDI in the auto industry.

After declining in 2008 by 17% to US$1.73trn from US$2.09trn in 2007—the high point of a four- year long boom in cross-border mergers and acquisitions (M) and FDI—global FDI inflows are forecast to plunge by 44% to less than US$1trn in 2009. The big drop in 2009 is occurring despite the improvements in the global economy in recent months. A notable feature of trends in 2009 is that, for the first time ever, emerging markets are set to attract more FDI inflows than the developed world.

The first sovereign wealth fund (SWF) was established by Kuwait in 1953, and was followed by many others from 1973-4, after the first oil crisis. Since then, each major jump in oil and gas prices increased the number and size of SWFs; after 2000, countries with large trade surpluses also began to establish SWFs. By April 2009, SWFs had grown to $3-5 trillion of assets under management, invested mostly in high quality bonds. Equity investments have been a much smaller part of their portfolio and began to grow only in the 1990s. This trend has since accelerated with at least 698 documented equity investments between June 2005 and March 2009.

The internationalization of Brazilian companies is a relatively recent phenomenon. From 2000 to 2003, outward foreign direct investment (OFDI) averaged USD 0.7 billion a year. Over the four-year period 2004−2008, this average jumped to nearly USD 14 billion. In 2008, when global FDI inflows were estimated to have fallen by 15%, OFDI from Brazil almost tripled, increasing from just over USD 7 billion in 2007 to nearly USD 21 billion in 2008 (annex figure 1 below). Central Bank data put the current stock of Brazilian OFDI at USD 104 billion, an increase of 89% over 2003. Caution is in order about these figures, however, as in Brazilian outflows it is difficult to separate authentic FDI from purely financial investment under the guise of FDI. According to the most recent data, 887 Brazilian companies have invested abroad.

On March 12, 2009, the Canadian federal government passed significant amendments to the Investment Canada Act (ICA), Canada's foreign investment law of general application. Though the amendments generally liberalize important aspects of the Canadian foreign investment review regime, they also include a broadly worded national security test that now allows the responsible Minister to review proposed investments in Canada on national security grounds. On July 11, 2009, the government published draft regulations that provide the details of the new national security review process. Until the end of 2007, western media, governments and regulators often seemed more concerned about protecting domestic firms from investments by sovereign wealth funds (SWFs) than about attracting capital inflows. Politicians in many countries called for the regulation of sovereign foreign investments at that time, when SWF investments were growing rapidly. In fact, during 2006 and 2007, countries that introduced at least one regulatory change (many of them related to such investments) making the investment climate less welcoming for multinational enterprises accounted for 40% of all FDI inflows.

A crucial challenge to all countries in the current economic crisis is to stimulate investment, including foreign direct investment (FDI). Countries striving to attract FDI often resort to two types of policies: improving infrastructure or lowering taxes, as a means of attracting new FDI, or keeping existing FDI. Indeed, recent empirical studies (e.g. Bénassy-Quéré et al. 2007; Bellak et al. 2009) confirmed that both lower taxes and improved infrastructure exert a considerable influence upon multinational enterprises' decision to invest in a particular country, when controlling for other important location factors (like market size, labor costs etc.).

Starting on a small scale during the 1970s and 1980s, the emergence of globally distributed R networks of multinational enterprises (MNEs) accelerated rapidly in the 1990s. The “globalization of innovation” was facilitated and driven by a complex set of factors, including changes in trade and investment governance, improved intellectual property rights through TRIPS, the growing ease and falling cost of communicating and traveling around the globe, and the concomitant vertical industry specialization and unbundling of value chains. The Stockholm Programme sets the agenda for the European Union's actions for the next five years in the area of Justice and Home Affairs (JHA). It is the next step towards the goal of making the EU into an Area of Freedom, Security and Justice (AFSJ). Justice and Home Affairs became the third pillar of the EU after the Maastricht Treaty came into force in 1993. Originally, it was firmly intergovernmental area of policy-making but some parts were transferred to the supranational first pillar when the treaty of Amsterdam came in to force 1999. In the same year the EU decided it need a focused plan for cooperation in this field for the next five years; and the Tampere Programme was produced. This was followed in 2004 by the Hague Programme that ends this year, and the Stockholm Programme will lay out the next five years of JHA cooperation. Producing the programme has been complicated due to both the sensitive nature of many of the issues covered and by doubt until recently over whether the Lisbon Treaty would be ratified. The ratification of Lisbon changes the power balance between the European Commission, Council and Parliament and this has ramifications for the JHA area. With the success of the EU single market and the end of border controls within the EU, to stop crime within the EU, to guarantee the rights of citizens who are moving between EU member states, and to manage people from third countries who are seeking to come into the EU, requires cooperation across the Union. The Stockholm Programme seeks to lay out what path this should take. Migration policy is an important and difficult part of the programme. How Europeanised dealing with irregular migrants and asylum seeker should be has been one of the politically difficult areas within the programme.

Saudi Arabia's interests vis-à-vis international climate policy are fundamentally tied to its ownership of the world's largest proven oil reserves and its political economy, which depends on oil revenues for stability and survival. The 'discrimination' against carbon dioxide and fossil fuels is a recurring theme that reflects the country's disapproval of any constraints on global oil consumption. The Saudi position has evolved around four pillars: preserving oil revenues, receiving compensation for the adverse impacts of climate change mitigation, avoiding commitments, and acquiring technology and capacity for adaptation. Saudi Arabia's influence in the negotiations stems from a long-term strategy of obstructionism, the ultimate aim of which is to prevent an agreement from emerging. The country's status as a developing country is increasingly contested due to its high GDP per capita, while its calls for compensation for losses in oil revenue are strongly criticised, but Saudi Arabia still faces major development challenges, economic diversification being the most pressing. Although Saudi Arabia's position towards adaptation requires adjusting, there are clear points of dialogue with the West, including technology transfer and capacity building.

6856. Medvedev's amendments to the law on defence: The consequences for Europe

In November 2009, the 'Law on Amendments to the “Law on Defence”' proposed by President Medvedev entered into force. It allows the Kremlin to dispatch troops outside Russia for four purposes: to counter armed attacks against Russian armed forces, other troops and bodies deployed beyond its borders; to counter or prevent an armed attack against another country if this country has requested Russia to do so; to protect Russian citizens abroad from an armed attack; and to combat piracy and guarantee the safety of shipping. The law is an attempt to close the gap between Moscow's strategic goals, primarily the establishment of its geopolitical dominance over the former Soviet republics, and Russia's legislation, which restricted its ability to deploy armed forces beyond national borders. In effect, the amended legislation enables the Kremlin to deploy its armed forces abroad in a wide range of situations, precisely because of a lack of clear criteria. The wording of 'Medvedev's amendments' sheds light on some plans and scenarios that may be taking shape in Moscow. It is not beyond the realms of possibility that Russia may plan to ignite large-scale disturbances and ethnic clashes in Sevastopol or in Latvia and Estonia, which may be used as a pretext for Russian military intervention. A Russo-Ukrainian conflict in Crimea would pose not so much a military as a political challenge for Europe and the West. Even though Ukraine does not belong to these organizations, if NATO and the EU failed to respond to Russian intervention in Crimea with strong political and economic measures, their strategic relevance would be seriously undermined. If NATO did not defend its member states in the Baltic, the strategic role of the Alliance would be reduced to zero. The aforementioned scenarios fall into the worst-case category, yet there are numerous precedents in Russia's history which demonstrate that worst-case scenarios can become reality. European dependence on Russian energy supplies and interest in Russia's support in resolving the Iranian nuclear problem and the conflict in Afghanistan, as well as the Obama administration's interest in Russia's partnership in nuclear issues, constrain Western ability to respond. However, the West could and should make it quite clear that new Russia's military interventions will result in the country's political ostracization. Furthermore, the West could propose and develop an internationally recognised mechanism regulating the most important aspects of humanitarian intervention. In particular, it should minimise the ability of individual states to make unilateral decisions to intervene militarily if the UN Security Council were unable to make firm decisions. Such mechanisms could be discussed and developed in the frameworks of the UN, the OSCE, the so-called Corfu process and similar international forums.

Over the last half-century, public policy has affected land-use practices across the borders linking China, Thailand, and Laos. Political and economic reforms have facilitated labor mobility and a shift in agricultural practices away from staple grains and toward a diverse array of cash crops, rubber being one of the foremost. China has promoted the conversion of forests to rubber agroforestry in southern Yunnan--profitable for farmers, but a concern in terms of biodiversity and long-term viability. In Thailand, the response is at the other end of the spectrum as the government's concerns about land-use practices and watershed management have led to policies that dramatically constrain land-use practices and limit tenure rights. In Laos the future is not yet clear. Government policies provide weak support for both private land ownership and protected areas. In a global environment where national policy has such a dramatic effect on land use and land cover, the factors behind land-use change merit close examination.

Loss of the world's forests contributes an estimated 17 percent to all global greenhouse gas emissions, creating both a major challenge and an opportunity for international climate change agreements. In response, global policymakers have proposed that new carbon agreements include rewards for reducing forest-based emissions, an initiative known as REDD–Reducing Emissions from Deforestation and Forest Degradation. By creating financial incentives to reduce forest-sourced greenhouse gases, REDD projects could generate funding from developed countries to reduce deforestation in developing countries. In addition, some climate change specialists believe that REDD projects could benefit forest-dependent communities, whose participation is key to controlling the local forces that drive deforestation. Some communities are already learning about the new REDD carbon projects. As one villager from Cambodia explains, "We are going to sell our air to the people who are polluting in the city."

In late 2008 the Association of Southeast Asian Nations (ASEAN) committed to creating a human rights body, which emerged as the Intergovernmental Commission on Human Rights (ICHR), the terms of reference (TOR) for which have since been adopted. Although the TOR for the commission currently outlines a primarily advisory rather than an enforcement role, the very existence of the ICHR has the potential to act as a trigger to further discussion on human rights issues in member states and open avenues for further action. To take maximum advantage of this opportunity to further the human rights agenda in ASEAN member states, it is essential that critical early decisions are made carefully so as to leave the most latitude for future action. While some observers are concerned that the ICHR lacks teeth, the fact that all ten ASEAN governments have agreed to implement a human rights commission is remarkable and is an essential first step toward ASEAN's stated goal of respecting and protecting human rights.

Southeast Asia faces enormous challenges in managing its agricultural and environmental resources, from global warming to biodiversity loss. But chances for effectively addressing these issues may be hampered by the wide acceptance of four basic assumptions that guide the way we think about problems of managing agriculture and the environment. These assumptions form an interlinked system of thought that privileges the traditional and local over the modern and cosmopolitan. When taken to an extreme they lead to the view that traditional farmers are always right and that modern science is the cause, rather than a possible cure, of the serious environmental problems associated with agricultural development in Southeast Asia. Although when first proposed these assumptions were a radical alternative to the conventional thinking, in recent years they have themselves become the new conventional wisdom.

The possibility that North Korean ships may be smuggling weapons of mass destruction is a matter of intense concern in the Asia Pacific region and beyond. The few reported incidents of North Korean ships involved in WMD transport are ambiguous; some ships have been engaged in legal weapons trade and some carried "dual-use" goods suitable for use in nonmilitary applications, like agriculture. Ownership of the North Korean merchant fleet is largely private and highly fragmented; most of its ships are small, old, and in poor repair, and are often subject to rigorous scrutiny in foreign ports. The inability of the government to effectively regulate the low-cost, substandard shipping industry creates the risk and incentives to smuggle goods, including WMD. Anti-proliferation efforts should abandon the divisive and unsuccessful Proliferation Security Initiative and concentrate on negotiating North Korea's entry into international arms control treaties, maintain stringent port controls, and negotiate technical assistance to reduce the vulnerability of the North Korean shipping industry.

While much of the region is experiencing water shortages, poor water management lies at the heart of many problems. Climate change — in the form of glacier melt, drought, rising temperatures, and changes to the monsoon cycle — will increasingly exacerbate water scarcity. Although the region's water challenges do not necessarily or inevitably lead to armed conflict, they increasingly threaten to undermine human security. Cooperation will be critical for the region to meet its water challenges in the years and decades ahead.

The first permanent European Council President and second High Representative for EU foreign policy have been chosen. After weeks of speculation, the question of who will occupy the roles has now been answered: Herman Van Rompuy will take office as European Council President on 1 January 2010; and Catherine Ashton will be appointed the EU's foreign affairs chief on 1 December 2009. The presidency of the European Council has until now been performed by the head of State or government of the member state holding the rotating presidency, but the Lisbon Treaty clearly stipulates that from its entry into force, the President of the European Council may not hold national office. The position of a High Representative had previously existed, but the function has been significantly re-written by the Lisbon Treaty. So, in addition to new faces, there are also new unknowns. The question of precisely what powers the President and High Representative will exercise remains largely unknown, as it is not yet clear how they will perform as individuals and in tandem. Nevertheless, the Treaties give at least a general indication of the powers these two leaders will wield.

Recent political changes in Moldova offer a window of opportunity for both EU-Moldova relations and for the Eastern Partnership. In the next few months, the EU should move quickly to consolidate the reform process in Moldova. In particular, the EU should send a group of high-level EU policy advisors to the country for the purpose of promoting reform of law-enforcement agencies. Leaders from the EU and its member states should also undertake a series of high-profile visits to Moldova to demonstrate support for reforms and European integration. Finally, the EU should support visible projects that have a quick policy impact, and will have broader relevance for Moldova's modernisation. Such projects could include equipping the entire country with free wireless internet access, the liberalisation of air travel between the EU and Moldova, replacing the corrupt traffic police with speed cameras and traffic patrols and moving forward on liberalising visas for Moldovans.

The European Union needs a new five-year strategy for the development of the next phase of the Area of Freedom, Security and Justice (AFSJ). The existing plan, designed in The Hague Programme of 2004, expires at the end of this year. The Justice and Home Affairs research unit of CEPS has already set out, in several contributions, the big issues and provided policy recommendations for the next five-year plan – The Stockholm Programme – which will be adopted under the Swedish Presidency in December. In June 2009, the European Commission published its perspective towards the Stockholm process in its Communication: “An area of Freedom, Security and Justice serving the citizen: Wider freedom in a safer environment”.3 In this Policy Brief, we take a closer look at the Commission's Communication and highlight the strengths and weaknesses of the approaches adopted for each of the different policy domains falling under the AFSJ rubric. The Communication assesses the AFSJ under three main headings: 1. successes, 2. ambivalent areas and 3. challenges. We will also follow these headings and comment accordingly. Our commentary on the three areas also provides answers to some of the thorny questions raised in the priorities for the Stockholm Programme. We spell these out in the conclusions and put forth a set of policy recommendations.

Why has the private sector failed to thrive in much of sub-Saharan Africa? Drawing on a unique set of enterprise surveys, we identify inadequate infrastructure (especially unreliable electricity and poor quality roads) and burdensome regulations as the biggest obstacles to doing business. We find as well that the private sector in many countries is dominated by ethnic minorities, which inhibits competition and lowers demand for a better business environment. Solutions include investing in infrastructure, providing risk guarantees, and reforming regulations to lower the cost of doing business, as well as increasing access to education for would-be entrepreneurs.

The United Nations climate change negotiations currently underway and now seemingly likely to conclude only six to 12 months after the UN Framework Convention on Climate Change (UNFCCC) hosted meeting at Copenhagen in December 2009, are beset by a series of obstacles, the most fundamental of which reflect the North-South divide, largely between the Organisation of Economic Co-operation and Development (OECD) and non-OECD economies. In this brief we argue that movement across this divide is the single most important element in a successful conclusion to the negotiation. Current obstacles reflect asymmetries between developing and developed countries both in terms of growth in carbon emissions — and hence the costs of reducing emissions proportionately relative to some base date level, but also in terms of historical emissions as a source of damage. These are compounded by the imprecision of the negotiating mandate — a lack of a clear definition of the basic principles involved, particularly in the case of the original UNFCCC principle of common yet differentiated responsibilities, which accepts but does not clearly delineate differentiated responsibilities for developing and developed countries on climate change. Significant movement in the negotiating position of either side (or both) is likely a necessity for a climate deal to be reached even in post-Copenhagen negotiations. However, the recent unilateral commitment by China to reduce emissions by 40-45 percent per unit of GDP from a 2005 base year by 2020 is a positive first step.

From many perspectives, the London Summit of the G20 leaders at the beginning of April 2009 was a success – and a hard act to follow. The discussion was framed around crisis resolution and the strengthening of the international financial architecture. Beyond any concrete achievement, the success of the London Summit is that it morphed into an ongoing process with a rolling agenda, rather than remaining a one-off event. Undoubtedly the Italian Presidency of the G8 has a hard task, being caught between the success of London and the decreasing relevance of the G8. But there is also scope for building a meaningful bridge between London and the G8 meeting in L'Aquila in July 2009, and continuing and strengthening the economic governance reform process. There is an urgent need to continue to push for progress on a number of key items that were not adequately addressed at the London Summit and where progress can be made in L'Aquila – fostering clarity for the G20 agenda for the next meeting in Pittsburgh in September 2009. With regard, in particular, to the reform of the International Monetary Fund, the Italian Presidency should use its G8 chair to initiate a dialogue on reform of the European representation, taking advantage of having all the key players gathered together in L'Aquila.

Each Summit of the Americas forum has been accorded a single imprint. The 1994 Miami summit is remembered as the “Trade Summit,” the 1998 Santiago summit as the “Education Summit,” the 2001 Quebec City Summit as the “Democratic Summit,” and the 2005 Mar del Plata in Argentina—although officially focused on the themes of “Creating Jobs to Fight Poverty and Strengthen Democratic Governance”—is best remembered as the “Summit of Disorder.” The Fifth Summit of the Americas, April 17 – 19, 2009, presents an opportunity to identify the event with a regional sub-set of the Americas: the Caribbean. The host country, Trinidad and Tobago, is the first Caribbean country to host the event and, with a population of only 1.3 million, is the smallest state ever to host “such a logistically complicated and politically sensitive gathering” (Erikson, 2009: 179). Relegated to a marginal position in the first four summits, the Caribbean now moves to centre stage in 2009.

The economic crisis of 2008–09 is the second major crisis in just over a decade that Asia has endured. Unlike the Asian crisis of 1997–98, however, the current crisis originated mainly in the West. Asia's excessive reliance on net exports as the principal driver of economic growth since the 1997–98 crisis rendered it especially vulnerable to external shocks, and most Asian countries have paid dearly. The more open the economy, the more vulnerable it is to such shocks. The newly industrialized Asian economies (Singapore, Hong Kong, South Korea, and Taiwan), which are among the most open and dynamic in the world, are expected to contract by about 6 percent in 2009.

In the first decade after India declared independence in 1947, the Indian state faced numerous challenges to its very existence and legitimacy. These ranged from a war with Pakistan over the state of Jammu and Kashmir immediately after independence, an issue that continues to challenge policy makers in both countries, to the first armed uprising in the country in Telengana led by Communists in what is today the state of Andhra Pradesh.

Beginning in 1949, China considered, and dealt with, so-called Uyghur separatism and the quest for Eastern Turkestan (Xinjiang) independence as a domestic problem. Since the early 1990s, however, Beijing has begun to recognize the international aspects of this problem and to deal with its external manifestations. This new policy has affected China's relations with Turkey, which has ideologically inspired Uyghur nationalism, offered sanctuary to Uyghur refugees, and provided moral and material support to Eastern Turkestan movements, organizations, and activities.

Abstract:
This Note focuses on the relationship between L-20 ( L for Leaders) or G-20 type meetings and more formal reforms , particularly of the IMF. It should NOT be read as a proposed agenda for the April meeting of the L-20+, but as an input into the agenda of global reform that constitutes the context of the London and other international meetings. I do believe that given the massive and immediate threat posed by the unfolding worldwide economic crisis, the April meeting should focus on (i) the global size and coordination of the fiscal stimulus and macroeconomic policies worldwide (ii) immediate coordination as needed in the dramatic actions required with regard to the banking system in many major economies and, (iii) financial support to the developing countries experiencing a massive decline in export revenues, capital flows and remittances. The London meeting will be the first and very important start of a series of meetings in 2009, including the Spring and Fall meetings of the IMF/World Bank, which constitute an opportunity to build a global economic governance system that can manage the recovery from the current crisis, build globally coordinated financial sector regulation and reflect the realities of the 21st century.

The crisis that started with Hamas winning the Palestinian Authority (PA) elections in January of 2006 seems to have entered a new stage with the start of 2009. Israel, which provides the occupied PA with the bulk of its economic resources, the US and the EU classifying Hamas as a terrorist organization and the resulting 3 year long economic siege and blockade, and the Israeli operation that started on the 27th of December and lasted for 22 days have all made the humanitarian situation in this region unbearable.

The question of Iran “ going nuclear” is of global concern. Iran has up to now used devious methods to violate the Non-Proliferation Treaty and has indeed misled the world community. The Obama Administration is concerned about these developments as much as the previous Bush Administration was. However, President Obama's approach to nuclear weapons in general and talks with Iran have been different both in essence and form. Another matter of concern has been the attitude of Israel and the manner in which the US has tried to handle the Israeli dossier towards Iran. The October 1st negotiations with Iran have been considered constructive by the West. These negotiations will take time and probably prove to be difficult. Turkey's attitude towards a “nuclear” Iran seems to be ambivalent in recent times, whereby while Turkey does not want a nuclear Iran, it seems to be pointing a finger to nuclear Israel.

For many years successive governments in Turkey have ignored an even denied the existence of Kurds in Turkey. What would have been possible in the past by recognizing cultural rights has now been a problem whereby an operation seems to be needed. Two common and important mistakes of governments: one is to say Kurds are primary citizens of this country as if there are secondary citizens! The second is “end the terror and we will recognize some rights”. Basic rights cannot be negotiated. This second mistake has led Öcalan to announce his own road map paralel to the Governments. Negotiating with hostile entities is very difficult and needs public consensus. Turkey, unlike Britain and Spain does not have public consensus. The best way was and is to follow EU's democratisation road map.

This article explores the actual and potential effects of recent European legal judgments on ongoing reunification negotiations in Cyprus. In particular, we argue that the European Union's failure to formulate a policy regarding the position of Turkish Cypriots in Europe has had increasingly negative consequences both for negotiations between the island's leaders and for relations between the Turkish Cypriot and Greek Cypriot communities. The EU has chosen to ignore the suspension of constitutional order in the Republic of Cyprus, in the process refusing to acknowledge the legal and political effects of the RoC's EU entry on Turkish Cypriots. We use a recent European Court of Justice judgment to illustrate the substantive effects of this hands-off approach, showing how the political use of transnational courts threatens to undermine what many have called the island's “last chance” at reunification.

There are now less than fifteen years left before we celebrate the centennial of the Republic of Turkey. Taking into consideration the fact that we, the humans, managed to squeeze into the last century two or three world wars and worn out several ideologies, even raising the Earth's temperature whilst exhausting its natural resources, no doubt we will be living in a much different world than the present one, in fifteen years from now... Moreover, the pace of change has increased such that it is incomparable with that of the past and the possibility of unforeseen technological and societal change has dramatically improved. The way the latest financial crisis erupted is the manifestation of such a potential. Since no one yet can predict the eventual outcome of the crises that suddenly shook the financial markets and economies like an earthquake, an attempt to foresee the first quarter of the 21st century might seem like a futile effort.

Where green turtles graze on seagrass and algae, the sea bottom habitat is healthier and more productive, hence commercially important species such as shrimps, lobster, and fish thrive. Besides that, by depositing their eggs on the shore, turtles transport vital nutrients from the ocean to nutrient-poor coastal and inshore areas.
