Abstract:
To meet today’s foreign policy challenges, the United States needs to end its overreliance on military superiority and intervention and instead put creative and persistent diplomacy in the lead to promote locally owned solutions to national, bilateral, and regional security issues and to address global challenges not amenable to military force. This rebalancing will not succeed if civilian statecraft is dysfunctional and unprepared. More funding and more diplomats will not solve this problem. What is needed is fundamental reform of structures, processes, and personnel practices, particularly at the State Department. These include strategic planning, resource planning, institutional integration, clear authority over security assistance programs, and moving away from nation-building and toward conflict prevention. Far-reaching changes in the way diplomats are recruited, trained, and promoted are also required. Without such changes, there is substantial risk that our diplomatic tools will be ineffective, resulting in even greater militarization of U.S. foreign policy when diplomacy fails.

Of all the free trade agreements (FTAs) concluded by Korea with its major trading partners since the turn of the century, the Korea-China FTA may be the largest in trade terms. It is, however, far from the best in terms of the depth of liberalization and the scope of obligations on trade and investment policies. Korea and China agreed to liberalize a large share of bilateral trade within 20 years, but both sides incorporated extensive exceptions to basic tariff reforms and deferred important market access negotiations on services and investment for several years. Political interests trumped economic objectives, and the negotiated outcome cut too many corners to achieve such a comprehensive result. The limited outcome in the Korea-China talks has two clear implications for economic integration among the northeast Asian countries. First, prospects for the ongoing China-Japan-Korea talks will be limited and unlikely to exceed the Korea-China outcome. Second, Korea and Japan need to strengthen their bilateral leg of the northeast Asian trilateral and the best way is by negotiating a deal in the context of the Trans-Pacific Partnership.

The Korean government's "creative economy" agenda reflects growing consensus that Korea's future growth and prosperity depends on its ability to become a global leader in developing and commercializing innovative new products, services, and business models. To succeed, the Korean government must address regulatory, structural, educational, and cultural obstacles that have constrained Korea's ability to fully utilize its innovative capacities. This new emphasis on innovation brings Korea into closer alignment with the United States, which has long focused on innovation in its growth strategies. Moreover, it comes during the early stages of implementation of the US-Korea Free Trade Agreement (KORUS), which intersects with important areas of Korea's innovation framework policies. The still unsigned Bilateral Security Agreement (BSA) between Afghanistan and the United States provides the legal basis for continuing U.S. military presence in Afghanistan. In addition to its substantive importance, the BSA is also a confidence-building mechanism. The delay in putting it in place is compounding uncertainty and further diminishing economic confidence during Afghanistan's already challenging and uncertain transition. Afghans' responses include, among others, hedging behavior (legal and illegal), personal decisions on whether to come back to or stay in Afghanistan, delays in investments, incipient job losses, declining demand for goods and services and real estate prices, and farmers planting more opium poppy.

The China-US bilateral investment treaty (BIT) negotiations have attracted attention due to the relative size and weight of both economies. Despite broad consensus about the importance of such a treaty, there is considerable debate about its shape and content. The debate is reflected in two recent Columbia FDI Perspectives. Donnelly argued that a China-US BIT should be modeled on the US Model BIT without "splitting the difference between Chinese and US positions", and that the possibility of meaningful BIT negotiations are "really up to China at this point".

U.S. administrations and officials are consistently caught flat-footed by the increasing assertiveness of the People's Republic of China (PRC) over disputed territories in the East China and South China Seas. This assertiveness is strident, yet controlled. Beijing's objectives in the region, with respect to maritime issues in particular, have been apparent for several decades. While the United States is well aware of the PRC's "talk and take" approach—speaking the language of negotiation while extending de facto control over disputed areas—U.S. policy has been tactical and responsive rather than strategic and preemptive, thus allowing China to control the pace and nature of escalation in executing talk and take.

In President Barack Obama's first term, his administration withdrew US forces from Iraq, ratcheted up pressure to thwart Iran's nuclear ambitions, began the adjustment to relations with post-authoritarian governments in Arab countries including Egypt, struggled with how best to handle an increasingly bloody rebellion in Syria, and attempted to restart diplomacy on the Israeli/Palestinian problem. At the beginning of his second term, US interests are at significant risk as the region continues to undergo profound changes, and Arab and European allies are asking for greater US engagement. The region also presents the United States with unanticipated opportunities, such as the development of Arab democracies and a reduction in Iranian influence. The challenge facing the United States is how to lead without dominating, and how to protect and promote US interests without absolving other actors of responsibility. Thus, the task for this administration is to develop a strategy: to match the president's positive rhetoric with meaningful follow-up in terms of diplomacy, assistance, and security cooperation.

Tension between the United States and its partners in the Gulf flared up visibly in the last several months, notably with Saudi Arabia's public displays of displeasure with the US approach to the Syria conflict, nervousness about an interim nuclear deal with Iran, and sharp differences over Egypt. The links between the United States and Morocco are among the oldest of the US' diplomatic bonds. In 1777, Morocco's Sultan Mohammed III was the first foreign sovereign to recognize the independence of the thirteen former British colonies. Subsequently, the 1786 Treaty of Peace and Friendship—negotiated by Thomas Barclay and signed by Thomas Jefferson and John Adams—established diplomatic relations between the two countries. Modified in 1836 with the addition of various security and commercial protocols, the accord is still in force, making it the United States' longest unbroken treaty relationship. But as venerable as this history is, the strategic importance of Morocco to pursuing the Atlantic community's interests in the security and development of northwestern Africa has only recently become fully apparent to US policymakers and analysts. President Barack Obama's invitation to King Mohammed VI to make an official visit to the United States this year indicates the importance that both countries attach to this significant strategic relationship.

When compared to its often rocky relations with Arab countries to the west, the Islamic Republic of Iran has managed to retain largely cordial ties with its neighbors to the east. Historic linguistic, religious, and cultural connections have helped Iran keep its influence in South Asia and become a key trading partner despite US-led sanctions. Because of its strategic location on the Persian Gulf and Arabian Sea, Iran provides India with access to Afghanistan and Central Asia that does not require transit through Pakistan. However, Iran and its neighbors, including Pakistan, face acute challenges such as scarce and poorly managed water resources, ethnic insurgencies, energy imbalances, and drug trafficking that require regional solutions.

Finland's decision to acquire advanced semi-stealthy Joint Air-to-Surface Standoff Missiles (JASSM) from the United States is much more than an arms deal – it has significant political and regional military implications. Finland is only the second country to be approved for JASSM. No NATO country has ever received such approval. This suggests something about the closeness of the relationship between the United States and Finland, as well as something about how the United States sees European and regional defence arrangements. In the web of multilateral, multinational and bilateral relationships that Finland is weaving to enhance its security, the US relationship is a key cable The JASSM acquisition significantly changes Finland's ability to disrupt enemy activities, both within Finland and beyond its borders. Despite being a conventional weapon, it will serve as a deterrent. Finnish decision-makers have a responsibility to understand both the implications of the new capabilities, and to ensure that the continued development of the Finnish Defence Forces is not inhibited due to misunderstandings of what a modern defence requires and consists of.

In looking at twenty years of independence in the former Soviet region of Central Asia, Kazakhstan stands out in most respects as a stable oasis in a desert of uncertainty. It is the wealthiest country in Central Asia. It has not suffered any serious conflict since gaining independence, and the development of its economy, financial sector, and private sector has been steadily moving forward as has its engagement with the global economy. It is little wonder, therefore, that the most stable and fruitful bilateral partnership for the United States in the region over the past twenty years has been with the Republic of Kazakhstan. US-Kazakhstan relations have never experienced a significant crisis, and there has been ongoing cooperation between the two countries in a variety of areas, including nuclear non-proliferation, economic development, and energy extraction.

Out of the proposed alternatives for dealing with Pakistan discussed in Washington, one that seems to have gained some traction calls for aggressively playing up Pakistan's civil-military divide by propping up civilians while dealing harshly with the military and the Inter-Services Intelligence (ISI). While normatively attractive, the approach to deal with Pakistan as two Pakistans is unworkable. It grossly exaggerates the U.S.'s capacity to affect institutional change in Pakistan and fundamentally misunderstands what underpins the civil-military dynamic. In reality, any attempt by the U.S. to actively exploit this internal disconnect is likely to end up strengthening right wing rhetoric in Pakistan, provide more space for security-centric policies, and further alienate the Pakistani people from the U.S. A more prudent approach would be one that limits itself to targeted interventions in areas truly at the heart of the civil-military dichotomy and that would resonate positively with the Pakistani people: by continuing to help improve civilian governance performance and by providing regional security assurances to Pakistan.

Following March 2011's “cricket diplomacy,” there is reason to be optimistic about progress on South Asian normalization as India and Pakistan have resumed bilateral dialogues. Improved relations are critical to U.S. interests in South Asia with respect to the stabilization of Afghanistan, reduction in Pakistan-based militant threats, and alleviation of regional nuclear tensions. Terrorism and the Kashmir issue remain the most toxic points of divergence which could derail progress as in past bilateral talks. Bilateral economic agreements should be pursued in order to enable commercial progress to facilitate political reconciliation. With the looming drawdown of international forces from Afghanistan in 2014, and the subsequent shift in the regional power balance, it is imperative that the international community utilize its leverage to ensure that Pakistan-India talks progress.

China\'s innovation policy and its perceived threat to American innovation and competitiveness is a hot topic in U.S.-China economic relations. The role of standardization, together with intellectual property rights and government procurement, are at the center of this conflict. Fundamental differences in their levels of development and economic institutions lead to quite different approaches to standards and innovation policy by the two countries. China\'s strategy of pursuing indigenous innovation based on local standards faces internal challenges in trying to bring together a diverse group of stakeholders with conflicting interests, as well as external pressures to adopt international standards. Enhanced cooperation on standards and innovation policies should be possible, once the United States and China accept that, while their economic and innovation systems are different, they are deeply interdependent. Both sides would benefit, creating new Chinese markets for American firms and easing technology licensing restrictions for Chinese firms.

The historic normalization between Armenia and Turkey has stalled and it is critical to prevent relations from deteriorating further. If Armenia and Turkey eventually succeed in opening their closed border, it will transform the South Caucasus region. But the concerns of Azerbaijan, Turkey's ally and the losing side in the Nagorny Karabakh conflict, need to be taken into account. The international community needs to pay more attention to the conflict and work harder to break the regional deadlock it has generated. The annual debate over the use of the word genocide to describe the fate of the Ottoman Armenians in 1915 has turned into an ugly bargaining process. It is time to take a longer view. President Obama should look ahead to the centenary of the tragedy in 2015 and encourage Turks to take part in commemorating the occasion.

Between Truman's first days as president and Israel's formation, his approach to the idea of a Jewish state evolved significantly, at times seeming to change in response to the last person with whom he met. 60. How much do U.S. corporations know (and care) about bilateral investment treaties? Some hints from new survey evidence

Abstract:
A remarkable number of countries have recently entered into bilateral investment treaties (BITs) as a means of protecting and promoting inward foreign direct investment (FDI). But do the treaties “work?” In exchange for giving up some mea sure of regulatory autonomy, host countries hope to receive increased flows of investment. Scholars have devoted substantial energy to examining whether this so-called “grand bargain” has in fact been realized. Most studies follow a common research design. The number of BITs that a state has signed are counted up, with the resulting independent variable regressed against country-level FDI flow data. Unfortunately, the results of these various and increasingly complex statistical exercises are inconsistent. 1 Some studies show that BITs can have massive positive impacts on foreign investment; others show modest positive impacts; others show no impact at all, or even a negative impact.

This week, David Cameron will visit Washington for the first time as Prime Minister to reaffirm Great Britain's 'special relationship' with the United States. Cameron will look to build on his June meeting with President Obama in Toronto as well as the recent visit of UK defense secretary Liam Fox by returning to Great Britain with concrete deliverables in exchange for London's long-standing staunch support of U.S. foreign policy goals. Despite his criticism of former PMs Blair and Brown's handling of the relationship with Washington, Cameron has vowed early in his tenure as prime minister to continue the UK's strong engagement in Afghanistan and to put a priority on relations with Washington. His ministers have nonetheless cautioned that London would not "slavishly" follow Washington's lead. A successful visit, as judged by the British public and media, will help end the unhelpful debate in the UK on the health of the 'special relationship.'

Vietnamese and Americans joined together in Hanoi last December for a happy celebration, commemorating the tenth anniversary of the entrance into force of the US-Vietnam Bilateral Trade Agreement signed in December, 2001. The gathering of current and former trade negotiators, diplomats, and business leaders exchanged witty anecdotes about who had been the toughest negotiator. However, the main focus for both American and Vietnamese participants was on the positive prospects for future US-Vietnam relations across the spectrum of trade and strategic common interests.

A higher Renminbi will have two advantages: for the United States, it will help to equilibrate the past trade imbalance; for China, it will stimulate consumption (and enhance imports). It will therefore help China switch from a purely exporting strategy to one that maintains domestic growth through internal consumption. The goods that were to be sent abroad can now be consumed by an increasingly middle class nation at home. These steps will bring China and the United States closer economically and increase international stability. However, unless the military-security relations of the two countries improve, this will not be a sufficient remedy for the two nations' long term problems.

This week, in a striking symbol of improved U.S.-Libyan relations and Tripoli's reengagement with the international community, Libyan leader Muammar Qadhafi is set to address the UN General Assembly. Previously, Qadhafi refused to visit the UN headquarters because it was located within the borders of "an enemy of humanity." Although the dynamic has changed, in the aftermath of the release of Abdel Basset al-Megrahi, the convicted perpetrator of the Lockerbie bombing, few have high expectations for Qadhafi's UN visit. Nevertheless, the Libyan leader could capitalize on his visit to draw closer to the Obama administration, although it is impossible to know how Libyan domestic considerations or other factors will impact Qadhafi's behavior in New York. These may eventually dictate a more inflammatory path.

In a September 7 interview with al-Jazeera, U.S. Secretary of Defense Robert Gates stated, "The more that our Arab friends and allies can strengthen their security capabilities, the more they can strengthen their cooperation, both with each other and with us. I think this sends the signal to the Iranians that the path they are on is not going to advance Iranian security, but in fact could weaken it." His comments reflect a dawning realization in the face a growing Iranian nuclear threat: that a new conventional military balance is slowly emerging in the Persian Gulf.

On August 18, Egyptian president Hosni Mubarak travels to Washington for a White House meeting with President Barack Obama. The trip -- Mubarak's first visit to the United States in six years -- marks the culmination of a six-month effort by the Obama administration to hit the reset button with Cairo. After years of tension resulting from the last administration's focus on human rights and democratic development, the traditional U.S.-Egyptian bilateral "bargain" has been effectively restored. In exchange for cooperation on key mutual interests -- the peace process and the Iranian threat --Washington appears to have shelved longstanding concerns over internal Egyptian governance. While the new dynamic may help mitigate some regional crises, the political and economic challenges Cairo faces will not age well, particularly as the state enters its first period of leadership transition in twenty-eight years.

India's Prime Minister, Manmohan Singh, will come to Washington on November 24, 2009, for the first state visit hosted by President Barack Obama. This event will be widely viewed as evidence of the importance attached to maintaining the upward trajectory in U.S.–Indian relations. By all accounts, the two leaders have already established a good working relationship—something skeptics feared was impossible given the prime minister's warm regard for President George W. Bush and the differences between Bush and Obama on many issues involving India. The global economic crisis, however, appears to have enhanced the personal collaboration between the two leaders, as many of Singh's ideas for stimulating the global revival have been backed by Obama in various forums, including most recently at the Group of Twenty's summit in Pittsburgh.

The small war between Georgia and Russia from 8 to 22 August 2008 has shattered any remaining illusions over the frontiers of the normative map of Europe. All the primary parties have to be criticised: Russia for setting a trap for Saakashvili to fall into, the Georgian leadership for its astounding military and political blunder in falling into it, and the United States for having failed to restrain its protégé. The first consequence is that Georgia has paid the price of Saakashvili's folly, with the definitive loss of Abkhazia and South Ossetia. The second consequence is triggered by Russia's continued occupation of strategic points in Georgia-proper, which means not peacekeeping but threatened strangulation of the Georgian economy and its role in the transit of oil and gas from the Caspian to the West. It also means that business as usual has become impossible, as already announced between NATO and Russia, and with more important decisions pending in both the EU and US. The third consequence is that the EU should immediately step up its policies to integrate Ukraine, with real perspectives of membership subject to the standard criteria. The fourth unknown consequence is how far this deteriorating process between Russia and the West will go. Russia may pretend, with its petro-power and wealth, to be immune from any actions by the West, but beyond the short-term it is vulnerable. Whatever these unknowns, already Russia has crossed a red line with its strategic occupation of Georgia-proper, rather than the option just to push Georgia out of South Ossetia. This latter option would have met with widespread understanding internationally. But with its chosen option Russia has placed itself in another category, which is a throwback to earlier times, and totally incompatible with the political and moral principles of modern Europe.

Ambassador Mahbubani's address looked at previous American actions that built "reservoirs of good will" that ultimately assisted America in its ideological victory in the Cold War, especially in Asia: its sharing of the "American dream" with the world; its openness to foreign students; the international order built by the United States after 1945; and, finally, the stabilizing effects of its military presence in East Asia. However, the end of the Cold War has brought changes, and the gulf between America's self-perception and the way it is seen in the Islamic world, and China in particular, demonstrate the dwindling of those good will reservoirs.
