251. Suing for Sovereignty: Property, Territory, and the EU's Cyprus Problem

Abstract:
This article explores the actual and potential effects of recent European legal judgments on ongoing reunification negotiations in Cyprus. In particular, we argue that the European Union's failure to formulate a policy regarding the position of Turkish Cypriots in Europe has had increasingly negative consequences both for negotiations between the island's leaders and for relations between the Turkish Cypriot and Greek Cypriot communities. The EU has chosen to ignore the suspension of constitutional order in the Republic of Cyprus, in the process refusing to acknowledge the legal and political effects of the RoC's EU entry on Turkish Cypriots. We use a recent European Court of Justice judgment to illustrate the substantive effects of this hands-off approach, showing how the political use of transnational courts threatens to undermine what many have called the island's “last chance” at reunification.

The relations between Turkey and the European Union, which have reached a unique level of harmonization and integration since the start of accession negotiations on 3 October 2005, has become one of the most important anchors for Turkish foreign policy. The accession negotiations towards full membership to the EU are still continuing despite a number of difficulties and delays. This Policy Brief aims to make an analysis of current developments regarding the accession process. It also intends to make some predictions about future prospects related to the EU-Turkey relations.

Turkey became a non permanent member of the UN Security Council as of January 1, 2009. The Brief deals with the important functions of the Council and the election campaign which a candidate country to the Council may sometimes have to run. Five Security Council resolutions which have to various degrees changed the course of events are explained. More than that, the writer tries to portray the behind the scenes activities of the resolutions. Finally, by defining the atmosphere of the Council, the writer tries to give advice on what Turkey, as a non permanent member, should do and in particular the qualities which the Permanent Representative should possess.

Abstract:
There are now less than fifteen years left before we celebrate the centennial of the Republic of Turkey. Taking into consideration the fact that we, the humans, managed to squeeze into the last century two or three world wars and worn out several ideologies, even raising the Earth's temperature whilst exhausting its natural resources, no doubt we will be living in a much different world than the present one, in fifteen years from now... Moreover, the pace of change has increased such that it is incomparable with that of the past and the possibility of unforeseen technological and societal change has dramatically improved. The way the latest financial crisis erupted is the manifestation of such a potential. Since no one yet can predict the eventual outcome of the crises that suddenly shook the financial markets and economies like an earthquake, an attempt to foresee the first quarter of the 21st century might seem like a futile effort.

Over the past years, some analysts have suggested that George W. Bush's unpopular administration spawned the high levels of anti-Americanism in Turkey. Referring to this phenomenon as "anti-Bushism," however, discounted the rise of anti-Americanism in Turkey and implied that the country's adverse view of the United States would change with a new administration. Unfortunately, two recent polls suggest otherwise. Despite the new faces in Washington -- policymakers who have gone out of their way to embrace Turkey and its citizens -- anti-Americanism persists across Turkish society.

Abstract:
There is a lively debate centered on whether Turkey is undergoing an axis shift, meaning Turkey is drifting away from the Transatlantic system and heading towards the Middle East in the most acclaimed dailies and journals of the Western world. One may witness a flurry of commentaries, appraisals and op-ed articles published in these media outlets. Taking notice of the vibrant debate on Turkey's orientation in the international sphere, Turkey's leaders underlined Turkey's position with varying degrees of emphasis. Despite the statements of Turkey's policymakers, which argue against the idea of shift of axis, the debates over Turkey's identity and foreign policy orientation has not lost steam. The shift should not be attributed to Turkey's departure from its Western ties to be replaced by those with the East but rather, a shift of power as the inevitable outcome of the end of the Cold War and a fact of the new millennium.

On December 8, the United Nations Security Council will host its first-ever thematic debate on drug trafficking as a threat to international security. This focus is notable. U.S. officials are increasingly concerned with the evolving threat of drug trafficking, especially as terrorist organizations stake a bigger claim in this illegal arena. In fact, on November 18, FBI director Robert Mueller met with senior Turkish officials to address U.S.-Turkish efforts targeting the Kurdistan Workers Party (PKK), also known as Kongra-Gel. A press release from the U.S. embassy in Ankara following the meeting stressed that U.S. officials "strongly support Turkey's efforts against the PKK terrorist organization" and highlighted the two countries' long history of working together in the fight against terrorism and transnational organized crime.

On December 7, Turkish prime minister Recep Tayyip Erdogan will visit Washington to meet with President Barack Obama. The meeting follows Obama's April visit to Turkey, during which the U.S. leader reached out to Ankara in an effort to realign the countries' interests after the tumultuous years of the Bush administration. Despite Obama's efforts, Turkish foreign policy seems to be drifting farther away from the United States, especially on issues such as Iran and Sudan. Abstract:
The Palestinian question is a central issue at the both state and society level in Turkey. Thousands of Turkish people protested the Israeli aggression against the Palestinians in Gaza this month in different parts of Turkey. Turkish PM Erdogan responded to the Israeli action by labeling it an act of disrespect to Turkey and suspended Turkey's facilitating role for indirect talks between Israel and Syria. Erdogan also initiated an intensive diplomatic campaign at the regional and international levels, utilizing Turkey's seat in the United Nations Security Council. Turkey calls for an immediate ceasefire between Israel and Hamas, and urges a compromise between rival Palestinian groups. Finally, the war on Gaza will have far-reaching consequences for the future of the region as well as for Turkish-Israeli relations.
