1. Holding the Islamic Republic of Iran accountable for atrocity crimes

Abstract:
With little to no prospect for accountability within Iran’s domestic courts, victims and survivors of serious violations of international law are turning toward an increasing number of foreign jurisdictions—most commonly in Europe and North America, but also in Latin America, Africa, and other regions—to pursue justice for human rights violations carried out by the Islamic Republic of Iran. Under the principle of universal jurisdiction, certain domestic justice systems allow prosecutions in national courts for crimes committed abroad, regardless of the victim’s or perpetrator’s nationality. Universal jurisdiction stems from the concept that certain crimes are of such gravity that they harm the international community as a whole, so national courts outside the country where the violations took place may prosecute them to protect the international order. Although the crimes subject to universal jurisdiction provisions differ by state, they generally include crimes against humanity, torture, war crimes, and genocide. Limitations on universal jurisdiction also vary between states, however, as do the processes for filing complaints and procedures for investigations, trials, and appeals. As was shown by the trial and conviction of Hamid Noury in Sweden for his involvement in the massacre of Iranian political prisoners in 1988, national prosecutions of international crimes can be a fruitful avenue to justice for victims of the Islamic Republic. To this end, the Atlantic Council’s Strategic Litigation Project has compiled a guide to aid practitioners and independent investigators in navigating the legal systems of European states with the highest likelihood of prosecuting Iranian human rights violators. Focusing on five states—France, Germany, the Netherlands, Sweden, and Switzerland—this manual outlines the crimes and violations subject to universal jurisdiction, best practices for investigating and documenting crimes, and processes for requesting investigations and participating in prosecutions as a victim, witness, or NGO. For information that is beyond the scope of this manual, the annex includes printed resources to consult and organizations to contact for additional assistance.

Intelligence and law enforcement agencies warn that Russia, China, Iran, and other foreign actors will seek to interfere in the 2020 presidential election.1 Foreign actors are increasingly sophisticated at using cyber tools and social media to probe and penetrate electoral infrastructure, manipulate public opinion, and cast doubt on the integrity of the election process. On one hand, the United States is better prepared to address these threats now than during the 2016 presidential election. For example, after the Department of Homeland Security (DHS) designated election systems as critical infrastructure in 2017, it established the Elections Infrastructure Information Sharing and Analysis Center, which enabled states and localities to more easily share information about threats to elections. This mechanism has had the additional benefit of making DHS better at helping states manage risks, as well as distributing information from the federal government to the states about possible threats.2 On the other hand, in many states there are still vulnerabilities in election infrastructure that foreign actors can exploit. These vulnerabilities exist at almost every step of the election administration process, including registering voters, verifying their registration at polling places, securing the devices that capture and tally the vote, transmitting that data to a central location on election night, and executing an accurate recount.3 While states usually make decisions about the rules of elections (policymaking),4 localities are typically responsible for the “nuts and bolts” of running an election — such as finding polling places and recruiting poll workers.5 Local election officials also help preserve the integrity of America’s elections by protecting against hacks into voter rolls and local election websites and working closely with federal and state officials to ensure the security of their voting systems.6 As the February 3, 2020 Iowa Democratic caucuses demonstrated, such vulnerabilities are not merely theoretical. During the caucuses — which were administered by political party officials, not election officials — the new app that the Iowa Democratic Party planned to use to report its caucus results did not work. Many of the nearly 1,700 precinct chairs who were responsible for transmitting the results did not receive training on how to use the app, and a large number appear to have been unable to successfully download it.7 Revisions and updates to the app were made as late as two days before the caucuses, making it nearly impossible to vet and test adequately.8 Although the federal government recently agreed to allocate an additional $425 million in election administration and security funds to state election offices,9 federal resources will likely be insufficient to address all outstanding vulnerabilities before the 2020 presidential election. It is also unclear how much of this funding will be distributed to local elections officials in time for the 2020 presidential election. This handbook, therefore, provides a list of steps that local election officials can implement at relatively little cost to fortify their elections systems before the 2020 presidential election.

Khamenei and other regime officials have been quick to swear revenge, but for now they may focus more on stoking patriotic and militaristic sentiment at home. A few hours after Iran confirmed that Islamic Revolutionary Guard Corps-Qods Force commander Qasem Soleimani had been killed in Iraq, Supreme Leader Ali Khamenei issued a statement describing those who shed his blood as “the most wretched of humankind.” Calling Soleimani the international symbol of “resistance,” he then announced three days of public mourning in Iran. He also declared that “severe revenge awaits the criminals” who killed Soleimani—an act that the United States had claimed credit for by the time he spoke. Other highranking officials echoed this sentiment, including President Hassan Rouhani, Speaker of Parliament Ali Larijani, and Defense Minister Amir Hatami, who explicitly promised “revenge” on “all those” involved in the assassination. Despite this rhetoric, however, and despite Soleimani’s unmatched role in carrying out Iran’s regional policy of adventurism and asymmetric warfare, the regime may avoid major, immediate retaliation if it sees such a move as too costly or as a potential trigger for serious military conflict with the United States. On January 1, amid escalating tensions in Iraq but before Soleimani’s assassination, Khamenei stated, “We would not take the country to war...but if others want to impose something on this country, we will stand before them forcefully.” In response to President Trump’s assertion that Iran played a role in the December 31 riot at the U.S. embassy in Baghdad, Khamenei told listeners he had two messages for Washington: “First, how dare you! This has nothing to do with Iran. Second, you should be reasonable and understand what is the main cause for these problems. But of course they are not [reasonable].”

Instead of focusing on Iran's missile retaliation or future threats, the Supreme Leader used his latest speech to extoll the virtues of public unity behind the regime’s revolutionary goals. On January 8, Supreme Leader Ali Khamenei delivered his first public speech since the U.S. assassination of Qasem Soleimani and the subsequent Iranian missile strike on Iraqi bases housing American forces. As part of an address that touched on regional solidarity against the United States and other notable subjects, he spent considerable time claiming that Soleimani symbolized the Iranian people’s continued commitment to the revolution. A week after Donald Trump was elected president in November 2016, Iran’s Supreme Leader Ali Khamenei played coy, remarking, “I have no judgment on the American election...[Both parties have been] naughty toward us.” Of course, his true reaction was far more complex. On one hand, he saw in the president-elect—who had spoken much of disentangling U.S. forces from the Middle East—a prospect of decreased military pressure on his country. On the other, he heard Trump’s raw vitriol directed at Iran’s leadership and the nuclear deal crafted by President Obama. The eventual U.S. withdrawal from the JCPOA demonstrated that the new president could back up his talk with punishing action. In this close analysis of statements by Khamenei and other Iranian leaders, former seminarian Mehdi Khalaji lays out the regime’s current views on President Trump and the United States. The means for assessing political fissures in Iran are by nature very limited and have become even more so since the June 12, 2009, election. Independent studies and data on the Iranian public, such as opinion polling, are sparse and not useful, and the Iranian press follows very strict red lines in discussing politics. Western diplomats in Iran are also restrained from understanding the political environment due to the oppressively formal nature of relations with Iranian officials, who rarely discuss sensitive issues with their Western counterparts. The latter are thus forced to gather information anecdotally, in private meetings with business leaders, cultural elites, and journalists -- hardly a sufficient sample of Iranian society.

Iran has the most politically active youth among the 57 nations of the Islamic world. As the most restive segment of their society, Iranian youth also represent one of the greatest longterm threats to the current form of theocratic rule. Young activists have heavily influenced the Islamic Republic's political agenda over the past 13 years. After the 2009 presidential election, youth and women were the two biggest blocs behind the region's first sustained “people power” movement for democratic change, creating a new political model in the Middle East. The Islamic Republic has forcibly regained control over the most rebellious sector of society through mass detentions of young activists, expulsions from universities and widening the powers of its own young paramilitary forces. Nevertheless, the demands from young people have not changed over the past year, and their anger is boiling just beneath the surface. The regime also remains vulnerable because it has failed to address basic socioeconomic problems among youth. The impact of Iran's youth on the political, economic and social agenda of the country over the next 25 years is important for U.S. policymakers to consider when facing complex decisions in balancing Iran's nuclear program and its internal political turmoil.

On August 19, Iranian president Mahmoud Ahmadinezhad submitted his list of cabinet nominees to the Majlis (Iran's parliament). The president's choice of individuals clearly shows his preference for loyalty over efficiency, as he fired every minister who, while strongly supportive of him on most issues, opposed him recently on his controversial decision to appoint a family relative as first vice president. Ahmadinezhad's drive to install loyalists involves placing members of the military and intelligence community in the cabinet, as well as in other important government positions. Despite the president's positioning, Iran's top leader, Ayatollah Ali Khamenei, remains in firm control of the country's vital ministries.

The results of Iran's March 14, 2008 parliamentary elections-a 70 percent victory for conservatives within Iran-came as little surprise. The ruling elite disqualified approximately 1,700 reformist candidates before the elections, minimizing the risk of a conservative defeat. However, the results revealed a growing divide between conservatives allied with President Mahmoud Ahmadinejad and a "third way" movement led by pragmatic conservatives who, though loyal to Supreme Leader Ayatollah Sayed Ali Khamenei, are critical of Ahmadinejad's economic policies and confrontational rhetoric with the West. The surprising electoral success of these pragmatic conservatives may pose a significant challenge to Ahmadinejad in Iran's 2009 presidential elections.

Reports that Ayatollah Ali Meshkini has either died or is on the brink of death shed light on the nature of power in Iran. Meshkini is speaker of the Assembly of Experts -- a body that, despite its traditionally minor role in Iranian politics, is constitutionally empowered to not only elect a new Supreme Leader if the post becomes vacant, but also to dismiss a sitting leader. Current Supreme Leader Ali Khamenei cannot be pleased that this body may now be headed by deputy speaker Ali Akbar Rafsanjani, a former president known to be a wily comeback artist. Although Khamenei has taken full advantage of the constitution to make the Supreme Leader the ultimate arbiter of Iranian politics, that could change depending on his health and Rafsanjani's scheming.

The recent death of Ayatollah Ali Meshkini effectively created a vacuum that was bound to lead to an ideological and political clash among Iran’s power players. Meshkini was the first and only chairman of the Assembly of Experts, objectively Iran’s most powerful institution. He has kept its inherent powers at bay to the desires of Iran’s supreme leader, Ayatollah Ali Khamenei. But now that has changed and Meshkini’s passing, with the recent victory of Hashemi Rafsanjani as his successor, has come at a time when the Islamic Republic is witnessing a socio-political redefinition in its conservative establishment. The ambitions of Iran’s old and new elitists have led to a political confrontation in filling Meshkini’s vacuity, a struggle that may have changed Iranian discourse, as we know it. Though this event is little known and hardly emphasized in media circles in the West, the politics leading up to Rafsanjani’s victory over the ultra-conservatives should be of great interest to those in discussion with Iran over its nuclear program and involvement in Iraq, particularly the United States. This article analyzes the Assembly’s role and significance within the Iranian institutional realm as well as depicts the candidates and politics that shaped this historic dilemma.

However, there is much evidence to the contrary. There is limited information available with which to form a judgment about the popularity of any politician or political program in Iran. The government forbids any independent opinion polling on matters as ordinary as the raging problem of drug addiction, let alone sensitive issues like negotiations with the United States or the nuclear program. The main sources of information for Western media are the statements and photographs that come from Iranian state media, or other Western journalists who go to Iran but cannot work freely in the face of government controls. The Western newsmedia has taken the massive turnouts at demonstrations in support of Ahmadinezhad and his nuclear policy as evidence of popular support for both. But the size of such demonstrations has no meaning beyond illustrating the efficiency of the regime's propaganda machine. Unfortunately, Western media take this propaganda for the truth. The Iranian regime has nearly succeeded in fashioning its own image and imposing it on its critics. Official results show Ahmadinezhad was elected by only 35 percent of eligible voters—in an election that was not free and fair, according to many top Iranian officials. Most of Ahmadinezhad's support came from rural regions and the poorer classes of Iranian society; these voters hoped that Ahmadinezhad's election would reduce corruption and raise their standard of living. Today there are clear signs of dissatisfaction within these constituencies. The evidence comes from independent journalists, blogs, and independent Iranian news websites which have reported increasing discontent with Ahmadinezhad's domestic policies.

Khalid Mishal, a Hamas leader currently residing in Damascus, visited Ankara today. Despite fierce debate in the Turkish press and objections from the secular-minded foreign policy elite, Mishal's visit went ahead with backing from Turkish prime minister Tayyip Erdogan and his Justice and Development Party (AKP) government. From the American perspective, the visit is important for three reasons. First, it could potentially hurt Turkey's longstanding role as an honest broker between the Israelis and the Palestinians. Second, it serves as yet another foreign policy breech between Turkey and the West. Third, the visit is a telltale sign of the AKP's policy of “strategic depth” toward the Middle East, a policy that Washington needs to understand given U.S. objectives in Iraq, Syria, and Iran.

This week, the Majlis approved a government bill authorising immediate use of the 2000-01 budget surplus. The windfall surplus, largely the result of increased oil revenues, should amount to 6-10 billion dollars by the end of the fiscal year in March. It will certainly transform Iran's external finances, but its impact on the domestic economy will be less immediate, and it will do little to ease investor concerns. Khatami's efforts to attract greater foreign investment depend on reform of the judiciary and other key changes to the regulatory climate. In the meantime, continuing political turmoil will deter all but those investors prepared to take a long-term view of Iran's economic potential.
