When the European Commission unveiled its New Pact on Migration and Asylum in September 2020, one of its most decried shortcomings was the lack of specific initiative to develop legal avenues of arrival in the EU, especially in the area of labour migration. On 27 April 2022, the Commission presented a new package of initiatives which aims at both reducing irregular immigration and addressing labour shortages by simplifying aspects of the legal routes and stays into the EU, and proposed a number of steps to operationalise the Talent Partnerships, a unique framework to stimulate mutually beneficial international mobility and to match labour market demands and skills needs between Member States and third countries. The EU Talent Partnerships will build on previous experiences and lessons learnt from a handful of EU-funded pilot projects on labour mobility that were launched following the adoption of the Joint Valletta Action Plan in 2015. While these pilot projects have offered an opportunity to experiment with different options on how to meet labour market demands in the EU, they have only achieved relative success due to the difficulty of mobilising the private sector and, more generally, the competitiveness of EU labour markets. Despite its fragmented competences on labour migration, the EU still has room to play to increase the attractiveness of its Member States’ labour markets and to facilitate the involvement of the private sector in recruiting candidates internationally. This policy brief seeks to provide insights into the role of the EU to improve private sector engagement and develop a sustainable and competitive ecosystem for future labour mobility schemes.

The EU’s increased climate ambitions require unprecedented growth in renewable energy and a diversified supply of critical raw materials. Building long-term partnerships and investing in innovation will be vital to pave the way for a clean and secure energy future. With energy being used as a prominent geopolitical weapon and energy prices soaring, the need for enhanced energy security and reliable resource suppliers is essential. The EU has realized it must reduce its natural resources’ dependence to ensure its prosperity, safeguard its interests, and reinforce its strategic autonomy. Especially the European Arctic region should be taken into account when considering the role it can play as a provider of renewable energy, sustainable development, and a reliable supplier of critical raw materials. Despite the specific challenges and costs associated with its cold and vulnerable climate, the region has certain advantages over parts of the world where political instability or low environmental standards are problematic. With its available resources, expertise, and technological innovations, the Arctic, which is often called an innovative testbed and a high-tech knowledge hub, can be instrumental for the EU to realize its Green Deal objectives, end its dependence on fossil fuels, strengthen its autonomy, and ensure its prosperity.

Since the decision to accept Croatia as a candidate member in 2011, the debate in the European Union about its enlargement has been rather subdued. But in 2022, after the bloody invasion of Ukraine by Russian troops, the new European security architecture that the EU (and NATO) tried to build after the end of the cold war has been profoundly shaken. We thought we could manage our ambiguous relationship with Russia and the European members of the ex-Soviet Union through dialogue and economic partnerships. We underestimated the urgency of stabilizing the Western Balkans through EU accession. After membership was offered to Croatia, gestures have been made – more bureaucratic than political – to negotiate the accession of other Western Balkan countries. But ‘enlargement fatigue’ fast developed – ignoring the fact that Russia and China were growing as non-democratic competitors and that Turkey was drifting out of the Western values system. Time has come now to redraw the map. The EU, NATO and the G7 reacted to the Russian aggression in Ukraine with a spectacular show of unity. In the European Council of June 24, 2022, candidate status has been offered to Ukraine and Moldova as well as a membership perspective to Georgia, and a meeting with the leaders of all Balkan countries has revived their hope for a reinvigoration of their own accession. Even if the war in Ukraine is still ongoing, it is time to prepare public opinion in the EU to this new approach to enlargement policy – starting with the fulfilment of the promises we made to the Western Balkans countries as early as in 2003 at the Thessaloniki summit. Looking also where the enlargement of the EU should end, in order to restore as best as possible ‘stability’ on the continent, the aim of the European project from the start. The basic premise that has to be kept in mind from the outset, is that the launching of the European community, its transformation into a Union, and its step by step enlargement, contrary to what Vladimir Putin pretends, has nothing to do with imperialism – nor a secret American plot to prolong or revive the cold war. It aims only at reinforcing the stability of the continent. The purpose of this article is to demonstrate this premise through the history of EU enlargement, and to look at how future steps in this direction could make this happen.

The relationship between Turkey and the European Union has never been easy. It is now affected by the activism of Ankara’s foreign policy, conducted in disregard of international law. Turkey remains, however, an important partner for the EU, as it is still officially a candidate for membership (since 1987) and in the Customs Union (since 1995). It impacts the EU, both in its internal (immigration, trade, other common policies) and external policies (through its gunboat diplomacy against two Member States (Greece and Cyprus) and countries eligible to the European Neighbourhood Policy). Moreover, the impact of the war in Ukraine will affect relations between Brussels and Ankara. In the face of Turkish activism, the EU lacks the capacity to anticipate and react, a problem that concerns not only its relations with Turkey, but its overall neighbourhood and association relations with its periphery. In the framework of the work on the neighbourhoods of the European Union (EU) carried out by the Institute for European Studies of the University of Saint-Louis and following its Annual Conference, with the aim of contributing to a better account of the Union’s relations with its periphery, the working group “Turkey” presents its elements of analysis in the run-up to 2023, which will be marked both by the centenary of the Republic and by long-awaited elections. Although much of this work was done before the outbreak of the war in Ukraine (24 February 2022), it has lost none of its relevance. One might even think that a stronger EU attitude towards Turkey in 2018-2020 might have made the Kremlin think twice. Faced with Turkish bellicosity in the eastern Mediterranean, the weakness of European reactions may have convinced Moscow that it could act with impunity against a country that is a member of neither the EU nor NATO.

Abstract:
Ever since its creation in 1974, the European Council has dominated the EU agenda, even though at first lacking any legal status and devoid of formal decision-making powers. EUCO meetings elicit huge media interest. Hundreds of journalists cover every summit. Following those meetings is the best way to understand what goes on in the EU and where it is headed. That is why it is worth looking more in detail at how the EUCO expresses itself, namely via its conclusions. Those conclusions are heard because they emanate from the most powerful representatives of the 27 Member States and the President of the European Commission. They take on a life of their own. The Lisbon treaty stipulates in Article 15 (1) that the EUCO “shall provide the Union with the necessary impetus for its development and shall define the general political directions and priorities thereof. It shall not exercise legislative functions.” This loosely worded definition leaves a margin of maneuver for the EUCO. It caters for what the EUCO has done since its inception: agreeing on major decisions shaping the future of the EU, including treaty changes (Article 48 TEU) and conditions of eligibility for countries wanting to join the EU (Article 49 TEU); negotiating the Multiannual Financial Framework (MFF) packages; setting out political positions on key policies; tasking the Council and other institutions to progress with work on given files; commenting on major political developments outside the EU; reacting to acute crises and setting the framework for handling them.

From fighting climate change to limiting dependencies on systemic rivals – radically shifting towards a green economy has become a strategic imperative to secure European autonomy, prosperity, and security. The catch: the EU’s dependence on minerals and metals at the heart of green technologies foreshadows looming geoeconomic and geopolitical crises. In the long-term, recycling and technological advances will scale and become key measures for decreasing supply vulnerabilities. By launching a war against Ukraine, right on the borders of the European Union, Russia has unleashed the strongest push to strengthen Europe’s defence since the end of the Cold War. Only its initial, 2014 invasion of Ukraine came close to having such effect. NATO has activated its defence plans and deployed forces on the borders with Russia. Just about every state in Europe has announced increased defence spending. And the EU finalised its Strategic Compass, its first ever defence strategy, with a much increased sense of urgency and purpose. The role of the EU in linking up national announcements and NATO targets is crucial, in fact, by providing a framework to align the efforts of the EU Member States, and by ensuring that the EU’s own indispensable targets are incorporated.

What is valuable, is vulnerable. So it is for peace, democracy, and the ability to lead the good life. They are never permanently gained, but remain a permanent aspiration. Throughout history, it has always been thus. At this very moment, Europe is once again witnessing a war on the continent. How did we act after the Second World War to ensure that Europe would no longer be a continent constantly plagued by war? We aspired to an “ever closer European Union”. Panta rhei – everything flows. Today once more we see an acceleration of history; perhaps we are even reaching a tipping point. To be fit for purpose in this new geopolitical context, we must accelerate the construction of the EU as well. More than ever, we must not just react, but act, with foresight. European management must give way to European leadership. That does require, among other steps, a revision of the European Treaties – that is for the medium term. What follows, was originally conceived before the Russian invasion of Ukraine. It is a plea for a Brussels Declaration, subscribed by all EU Member States, to achieve an “ever closer Union”. What might, before 24 February, have been seen as revolutionary, may now be seen as an evident next step, which is revolutionary only in its simplicity. A step to complement the 11 March 2022 Versailles Declaration.

The EU is adapting its policy toolkit under the heading of ‘open strategic autonomy’, which combines the Union’s market-liberal preferences with more assertive economic policies. While the EU is largely deploying defensive measures to protect itself from unfair trade practices and economic coercion, it is also increasingly moving towards a more strategic use of economic tools. The EU’s economic defence capabilities include initiatives to improve competitiveness in key strategic sectors (such as cloud computing, semi-conductors, and pharmaceuticals) as well as instruments to deter, block or retaliate against distortive or coercive measures by other powers. The strategic policies of the EU include trade and investment instruments for economic ‘binding’, such as the new ‘Global Gateway’ initiative, as well as means for leveraging the attractiveness of access to the single market to promote the EU’s norms and interests. The EU’s recent sanctions against Russia demonstrates the Union’s coercive capabilities in the economic domain, and its potential as a geoeconomic power.

The global rivalry between the US and China, as well as geopolitical competition and instability in the EU’s southern neighbourhood, are perceived by France as urgent matters requiring stronger EU foreign policy, conceptualized as European sovereignty. The French foreign policy elite are still largely committed to the idea of France’s exceptional role in the world, and to the extent that the EU as a whole fails to live up to the tasks presumed by France, continue their attempts at forging coalitions of the willing. France has in recent years built a web of strategic partnerships, for example with Greece, the Republic of Cyprus, the United Arab Emirates, and Egypt, through which it aims to govern the instability in the EU’s southern neighbourhood. The aim is also to deter regional adversaries such as Turkey, a strategy that needs to be re-evaluated due to the Russian invasion of Ukraine. France often equates its national interests with those of the EU. While this can be seen to enhance European sovereignty, it also risks increasing the perception that the EU would be a participant in various Middle Eastern conflicts. This undermines the EU’s ability to function as an objective broker and anchor of norms.

The war in Ukraine and the long-term consequences of the Covid-19 pandemic have put the spotlight on important political developments in the three largest EU members, Germany, France and Italy. In Germany, the new coalition government led by Olaf Scholz is trying to adapt the country’s foreign, energy and fiscal policies to the new international scenario, relinquishing some of its long-term tenets. France has just re-elected Emmanuel Macron as President, who is likely to advocate more flexibility in EU fiscal rules and strategic autonomy in foreign, defence and energy policy. Mario Draghi’s government has attempted to steer Italy out of the economic and health crisis and has sought closer cooperation with France. Italy will hold a general election by June 2023, with four parties vying for pre-eminence. In the wake of Brexit, Berlin, Paris and Rome have tried to revive the integration process. In the near future, it is expected that they will continue to drive EU politics, even if sometimes with different priorities, in close consultation with European partners.

At the NATO Madrid Summit in June 2022, Allies invited Finland and Sweden to join the NATO Alliance. In preparing for its membership, Finland will need to go through a reflection process on how it intends to contribute to NATO’s core tasks and make the most of its membership. Finland should consider making substantial contributions to the deterrence and defence posture in the Baltic Sea region, including in the Baltic states, and elsewhere on the Eastern Flank. In parallel, Finland should also ensure it contributes to the Southern Flank. Finland should aim to hit the ground running into the next cycle of the NATO Defence Planning Process (NDPP) and fulfil all relevant capability targets. Finland should also aim to “start strong to stay strong” on all existing NATO Pledges, notably those on defence investment, cyber-defence, and resilience. It is typical for individual NATO Allies to seek a salient role when it comes to certain specific topics. For Finland, the Arctic (Northern Flank) and resilience seem most promising.

The crises of previous years and the rise of strategic competition have put the EU’s traditional approach to multilateralism under pressure. The EU’s pledge for “a more stringent and strategic approach to multilateralism” has become even more relevant with Russia’s war of aggression against Ukraine. Three adjustments to the EU’s approach to multilateralism signify a more strategic approach. In a move towards a more instrumental engagement, the EU is using international cooperation as an avenue to protect its interests in the global competition. The EU is displaying more willingness than before to leverage its power bilaterally and through its work in international organisations. It is also more willing to focus on ad hoc frameworks in order to preserve the effectiveness of global cooperation and extend it to new areas of governance. Strategic multilateralism comes with certain risks attached. It can undermine the legitimacy of the formal multilateral system and the global protection of fundamental rights. The EU needs to weigh the benefits of a more strategic approach against the risks of global fragmentation.

With the signing of the trilateral Memorandum of Understanding (MoU), Turkey dropped its initial objection to Finland’s and Sweden’s NATO membership, but has since argued that the conditions agreed in the MoU have not yet been fulfilled. In addition to requiring Sweden and Finland to take a more vigorous stance regarding the Kurdistan Workers’ Party (PKK) and its extension in Syria, Turkey has used Nordic NATO applications as a tool to raise these issues on NATO’s agenda, pressuring the US in particular for a change in its Syria policy. Turkey’s reservations need to be conceptualized within its determined search for strategic autonomy, increased room for manoeuvre, and an ideological decoupling from the West. Turkey’s strategic interests have increasingly diverged from the rest of the alliance, likely leading to a more permanent intra-alliance opposition position in the coming years, part of which are the ongoing trilateral talks between Turkey, Finland and Sweden.

17. Estimating the EU's Return on Investment from an Ambitious Program to Incentivize New Antibiotics

Anti-microbial drugs form the backbone of modern medicine. Yet their lifespan is naturally limited; over time, use of these drugs selects for mutations that survive exposure those same drugs, driving “anti-microbial resistance”, or AMR. Already, drug-resistant infections kill an estimated 33,000 citizens of the European Union (EU) every year. In the absence of sufficient research and development (R&D) investment for new antimicrobials, deaths from drug-resistant infections could increase dramatically in the coming decade. To address this growing crisis and solve market failures that prevent the development of new antibiotics, the EU is considering incentive programs that would help provide predictable and value-based compensation to the successful developers of new antibiotics. In this note, we present the results of a modelling exercise to estimate the likely return on investment (ROI) from such a program, assuming it is paired with complementary and proportionate efforts from the EU’s G7 partners. The results are necessarily imprecise due to several uncertain parameters, but nevertheless provide evidence of a very high expected ROI that is robust to different inputs and assumptions.

The war in Ukraine will have a pervasive impact on the North Atlantic Treaty Organization (NATO), which is set to adopt a new strategic concept at the upcoming Madrid summit in June 2022. There is little doubt that adapting the alliance’s deterrence and defense posture in Eastern Europe will be a strategic priority on the road to Madrid. However, the alliance should not neglect other challenges and priorities, including preserving stability in its southern neighborhood. Spanning from North Africa and the Sahel to the Balkans and the Middle East, NATO’s “South” remains fraught with growing vulnerabilities—and is not impervious to the broader strategic competition with Russia and China. The EU is not always united and visible in foreign policy. This policy brief argues it could make more use of leading groups of member states under the coordination of the High Representative and European External Action Service (EEAS), the type of strategic thinking that guided the development of the Strategic Compass, and a Team Europe approach to a wider range of international activities, going beyond development cooperation. One idea would be to formulate a European Council Forum on Economic Security and Sanction policy. The Netherlands could contribute proactively, for instance by advocating for a strategic conversation on the topic of economic power at the level of the European Council.

Abstract:
Russia’s war of aggression against Ukraine has been a wake-up call for Europe, which has taken decisive steps to assist Ukraine and shore up European security and defense. Yet this moment could be short-lived if not followed by a sustained, collective effort to transform and rationalize European defense. Without this, additional European defense spending may be wasted and the continent will continue to rely on the United States for its defense. European nations should fully leverage the European Union, the North Atlantic Treaty Organization (NATO), and other multilateral formats to overcome fragmentation and avoid a piecemeal approach to defense. By doing so, they can invest together in modern capabilities, build a strong, resilient, and open industrial base, and think creatively to pool and share forces. Importantly, the United States has a crucial role in providing both practical and political support to achieve this shared goal of a stronger and more capable European defense.

Is the euro a golden goose laying golden eggs? Well, certainly not, if one asks an average Greek or Italian whose countries have consistently faced lower GDP per capita levels than the level they last recorded back in 2008. On the of them introduced the common European currency in 2007 and 2009. Not only are their countries more prosperous, but the euro also enjoys high social support. The aforementioned and diametrically opposite experiences show that the euro is at times, and especially during economic downturns, an issue which arouses other hand, is the euro a stinging viper? Surely not, if one poses this question to an average Slovene or Slovak whose countries boast rapid economic catch-up with the EU’s average level of economic development, especially since bothof them introduced the common European currency in 2007 and 2009. Not only are their countries more prosperous, but the euro also enjoys high social support. The aforementioned and diametrically opposite experiences show that the euro is at times, and especially during economic downturns, an issue which arouses many controversies.

The beginning on November has been rich on worrysome developments in Eastern Europe and around Ukraine in particular. With reports of the Organization for Security and Cooperation in Europe (OSCE) of continued and evergrowingnumberofceasefireviolationson the frontline in Donetsk and Lugansk regions - climbing to more than 750 daily on 12th and 13th November - satellite data on suspicious build-up of Russian forces near the Ukrainian border and respective US warning its EU allies of Russia’s potential invasion in Ukraine, migrant crisis on Polish-Belarussian border leading to aggressive land and aerial border patrol checks by joint Belarus and Russia military forces - the whole security landscape of Eastern Europe becomes ever more shaky and troublesome. Spiced up with undeclared energy war in Europe and Troyan Horse of Nord Stream 2, muscle stretching in the Black Sea, still-to-be-defined political configuration and policies of the new German government, turbulent presidential run-up France, everything leads to ideal mulled waters for perfect fishing. At first glance, all the mentioned presents rather gloomy picture of unfavorable setting, in which Ukraine has to operate nowadays. Russia seemingly has a tactical upper hand it its confrontation with the West and enjoys this advantage. Yet, this could be true, if we ignore some fundamental systemic changes. They are firmly shaping irreversibility of Ukraine’s pro- Western orientation and ever further steady integration into European and Euro-Atlantic structures, thus leaving tiny fading prospect for potential return of Ukraine into Russian orbit of influence. Recent poll data demonstrate that 62% of Ukrainians support the country’s integration into the EU, while 58% support Ukraine’s membership in NATO. The number of Ukrainians, who see better guarantees in Ukraine’s membership in NATO has risen to 55% in 2020 (compared to 26% for neutral status and 5% for a military union with Russia and other CIS countries).

On NATO’s entire Eastern and South-Eastern flank, the Allies face a major, pressing and subtle challenge. Using sub-conventional grey zone tactics, Moscow has repeatedly tried, and at times succeeded, in expanding its influence, eroding international norms, undermining the rules-based in- ternational order, and shifting the balance of power in its favour. Preventing Russia from launching such op- portunistic acts of aggression is particularly import- ant because its armed forces are developing the ability to attack quickly – under the cover of increasingly capable defences – countries on their periphery in a clear effort to impose a fait accompli.1 NATO countries are at a particular disadvantage in this type of compe- tition. Their force structures consist of expensive and technologically complex information-gathering platforms, such as satellites and manned aircraft, which due to their high costs are also scarce and employed with reluctance by states who generally hesitate to put them in harm’s way. Additionally, the prohibitively high cost of these platforms deters some countries from investing in these types of capabilities. As debates within NATO about cash, capabilities and contributions continue to hold the stage, highlighting Allies’ needs for different types of capabilities – less expensive, more resilient, and relatively more disposable – is important.2 Equal- ly critical is the need for Allies to develop new concepts of operations as well as new organi-zations to employ them effectively. The solution may not involve fielding exotic new capabilities so much as employing existing ones in innovative ways. It will also benefit greatly from approaches that allow Allies and partners to participate fully. If we do not adapt, we risk being surprised by potentially catastrophic events in a future conflict.

27. Operation Althea and the Virtues of the Berlin Plus Agreement

What is commonly known as the “Ber- lin Plus” arrangements, signed in March 2003, provides for the European Union (EU) to draw upon NATO’s assets and capabilities for operations in which the Alliance would not be militarily involved. Following lengthy delays incurred by the Cyprus question, it was only as of 2003 that the agreement was successfully implemented with the transfer of operations from NATO to the EU in both the former Yugoslav Republic of Macedonia (2003) and then in Bosnia-Herzegovina (2004). The Berlin Plus agreement guarantees EU access to NATO planning capabilities, which contribute to EU- led military operations through the identification of command options, procedures for release and recall of NATO assets and capabilities, and the exchange of classified intelligence under reciprocal security protection rules. At the end of the conflicts in the former Yugoslavia (1999), the EU had no defence staff fit to plan nor conduct an operation, and it is only fifteen years ago that member states established national Operation Headquarters (OHQ), which nations make available for EU operations, as was done in 2006 in the Demo- cratic Republic of Congo and in 2007 in Chad. At the end of the 1990s, the Berlin Plus proposal made em- inent sense: it prevented any duplication (by the EU) of assets and fostered the emergence of a European operational culture. But is the Arrangement still fit for purpose almost 20 years later?

In recent years NATO has markedly increased its presence in the Baltic states. Relatively “light”, yet highly diverse multinational forces have been placed across the Alliance’s frontline with an underly- ing objective: to deter Russia. In this effort, the United States has served as a critical ballast. The Pentagon has directed sophisticated military exercises and rotated US service members throughout the region. These mea- sures, however, often did not align with US President Donald Trump’s spoken words nor written tweets. This obvious dichotomy disoriented Allied governments and shook bedrock assumptions about US security commitments. As political power changes hands in Washington, this lends an opportunity for a retooling of the transatlantic partnership. Domestically, incoming US President Joe Biden ran on the platform “Build Back Better”. In the spirit of that slogan, this Policy Brief lays out policy cor- rectives that both sides of the Atlantic could pursue to strengthen the US-Baltic security link.

The post-Cold War enlargements have changed the Alliance, its geopolitics and the definition of its purpose, which is no longer limited to deterring against threats to Allies’ territory. Enlarge- ments have also redefined the security and defence policies of the new member states, by transforming their armed forces, civil military relationships and im- pacting their defence industries. The states that joined NATO since 1989 are usually categorized as Central Europe or Central and East- ern Europe. Within this Central European realm of new member states, one can distinguish between the North-East, the Centre, the South-East, and the West- ern Balkans. All states in these groupings were com- munist prior to the end of the Cold War. Today, with the Cold War fast becoming a faded memory, Central Europeans tend to define their security needs with in- creasing divergence, with major repercussions on their defence policies, in spite of their belonging to the same Alliance. This Policy Brief maps out Central Europe by identifying groups of states in the region and looking at defence policy divergences. It focuses on a number of indicators, such as defence spending, acquisition of defence equipment and attitudes towards hosting for- eign NATO troops on their soil.

30. The Strategic Argument for a Political NATO

Abstract:
The 1949 Washington Treaty is a remarkably brief document consisting of a preamble and 14 articles. The Treaty describes only the po- litical commitments and obligations of the signato- ries. It does not articulate a requirement for NATO members to spend a certain amount of their Gross Domestic Product (GDP) on defense nor does it specify the military capabilities that a NATO member must possess to defend the Alliance. From 1949 to the collapse of the Soviet Union, NATO was the singular locus of geopolitical discus- sion between North America and Europe. These were not easy discussions, yet the Alliance weathered strident policy and geopolitical policy differences. NATO also endured its members temporarily ceasing to be democracies due to military coups or concern about Communist influence on NATO governments. With a political body standing on the shoulders of a credible military deterrence, Allies were able to deploy creative problem-solving skills to bridge political dif- ferences, such as the policy innovation of deterrence and détente, while pursuing other, quieter methods, such as the temporary suspension of sharing sensitive intelligence from compromised NATO governments. Unfortunately, NATO’s centrality as a political forum greatly diminished after the Cold War as the Alliance reduced its political consultations in a less demanding geopolitical environment. Despite occa- sional interruptions of intense political discussion re- lated to conflict in the Balkans and the September 11th attacks, US retrenchment, combined with Europe’s inward focus, minimized NATO as a political forum. NATO was increasingly consumed by tactical decisions on out-of-area operations and transatlantic policy divisions over the Iraq War which fueled both Europe’s desire for greater autonomy and America’s questioning of the military utility of its Allies. NATO leaders substituted tactical – albeit important – military decisions regard- ing troop contributions, placement, and caveats as a substitute for political discussion. This political drift has now become so great that NATO members have begun to withhold support for the defensive planning of other Allies and new disputes between NATO members have the potential to escalate.

NATO has always been an important player in global politics. It is in the nature of the Alli- ance that its essential military missions were always carefully defined and its geographical boundar- ies strictly set by the collective defence commitments among its members. Nevertheless, NATO’s role as a politico-military institution among the great powers of the Cold War ensured it would always be global- ly significant. It could not have been otherwise. This remains as much the case – though now in different ways – as we consider the international environment taking shape for the 2030s. In this new environment the unavoidable global responsibilities of being a regional military alliance can be summarised in three ways; looking at NATO’s role in helping western powers defend their wider interests in the multi-polar world; helping meet the pseudo-ideological challenges posed by the rise of autocracies; and contributing to issues of the “global commons”.

Under the guidance of the Secretary General Jens Stoltenberg, in 2020 NATO embarked on a reflection process aimed at equipping the Alliance for the challenges of 2030.1 Composed of several parts, actors and phases, the process ul- timately aims to make NATO more relevant in the years ahead when technological disruption, climate change, competition among Great Powers and vio- lent non-state actors will pose new and major threats. Ideas, proposals, and recommendations are coming in from within and from outside the Alliance. In late 2020, analysts recommended for the first time the establishment within NATO of a net assessment (NA) capability to deal with an in- creasingly complex strategic environment.1 The same recommendation was reiterated in the NATO 2030 report to address the problem of “strategic simultane- ity”: i.e. the emergence of multiple, simultaneous and interconnected threats. According to the Reflection Group appointed by the Secretary General, “NATO should consider creating a new net assessment office [...] with the mission of examining NATO’s strate- gic environment on the basis of agreed threats and challenges across the whole spectrum of military and non-military tools. [...] A net assessment function [...] would bring a systematic methodology distinct from horizon scanning. It would exist to analyse the organisation’s strengths and options [...]”.2 The term NA was first coined in the US during the early 1970s by national security official Andrew W. Marshall to refer to a constellation of concepts and techniques for evaluating relative power. In West- ern usage, however, and for some decades now, it has been employed in a broader sense to denote the function of combining the appreciation of one’s own strength against that of one’s opponents in interna- tional affairs at the highest level.

Its objective is to facilitate the emergence of a European defence industrial and technological base through cooperation between European industrialists and thus reduce European "capability bottlenecks" in the field of military equipment while attempting to increase the Union's "strategic autonomy". After almost three decades of the Common Foreign and Security Policy (CFSP) and a decade since the establishment of the European External Action Service (EEAS), it is high time to assess whether EU foreign policy has indeed become “more visible, more coherent and more effective”, as stated in the Lisbon Treaty. Despite most media and experts having a rather disdainful view, there have been some successes. And the increasingly bleak geopolitical situation has a led to growing recognition in EU member states that they must try and work together if Europe is to become an international actor, defend multilateralism and maximise its influence on the world stage. But that understanding has not always been on display in recent years. Clearly, there remain significant challenges in coordinating the foreign policies of 27 member states, each with their own interests, traditions and capabilities. Fraser Cameron (EPC Senior Adviser), therefore, argues that the EU should have more modest ambitions. Instead of harbouring grand ideas, it could take small yet concrete steps in the direction of a more coherent and effective EU foreign policy. In this Policy Brief, he puts forward ten practical ideas.

Abstract:
The EU steps up its efforts to curb its territorial CO2-emissions. It is planning to introduce a carbon border adjustment mechanism (CBAM) to level the playing field and to raise own resources. The authors point out that unilateral European climate policy action, whether shored up with a CBAM or not, can only play a limited role in reducing global CO2-emissions. A EU-CBAM cannot stop indirect leakage, it has ambiguous effects on other countries’ mitigation efforts, and it poses the risk of conflicts with trade partners. They propose that the EU, together with the US and other like-minded countries, should push hard to establish a climate club with a common minimum price of CO2 and a common CBAM applied to third countries. Such a framework would incentivize other countries to join while limiting leakage and reducing the risk of trade policy disputes.

The COVID-19 pandemic revealed the vulnerability of international value chains in the face of global shocks. This has triggered a political discussion regarding a possible reshoring of vulnerable supply chains back home. The aim is to reduce dependencies on foreign suppliers and thus improve crisis resilience of the domestic economy. The debate is also rooted in the growing dependence on Asian suppliers and the colliding political and ideological systems between China and the West. Unilateral decoupling of the EU from China (a doubling of trade costs) would reduce real income in the EU on average by 0.8 percent. In terms of GDP in 2019, this equals a permanent loss in real income of 131.4 bn EUR. Should China retaliate, real income would fall by 1.0 percent (170.3 bn EUR). With its extremely interconnected economy, real income in Germany would even decline by 1.4 percent (48.4 bn EUR). China would also lose from such a trade war, with real income declining by 1.3 percent. Should the EU increase its trade barriers against all its non-European trading partners, real income in the Union would fall by 3.5 percent or 584.3 bn EUR in case of a unilateral increase and by 5.3 percent or 873.1 bn EUR in case the rest of the world responds by also raising trade barriers.

41. Rule-Bending Debates in Recent Finnish EU Policy: Pacta Sunt Servanda?

The Finnish EU policy line has traditionally been adaptable and compromise-seeking, but recent examples related to the rule-bending of EU law reveal some new tendencies. Finland has stood out from the European mainstream in several cases that relate to the rule-bending of EU law in three different ways: rule-bending by others, collective rule-bending, and its own rule-bending. First, intervening in rule-bending by others has found support in Finnish EU policy. Finland prioritized the rule of law in its 2019 Council presidency, as well as in the Government Report on EU policy published on 28 January 2021. Second, alleged collective rule-bending seems to be linked to the threat of federalism. In negotiations on the recovery and resilience facility in 2020, there was a wide domestic debate on whether the result was consistent with the traditional interpretation of EU treaties. Third, Finland’s own rule-bending of the Schengen Border Code’s six-month limit for internal border controls during the Covid-19 crisis seems to have been quietly accepted, with the Interior Minister acknowledging the existence of an “illegal state of affairs”.

42. Focussing European Cooperation with the Middle East and North Africa on Social Contracts

2021 is proving to be a key year for cooperation between Europe and its neighbours in the Middle East and North Africa (MENA) region. As the European Union (EU) launches its new multiannual budget, the COVID-19 pandemic has demanded a rethink of the political, economic and social priorities that the EU and its member states should pursue with MENA countries. Europe’s potential for positive influence on state–society relations in MENA countries has yet to be realised. The latest European Neighbourhood Policy (ENP) South Communication, published in February 2021, promises a “new agenda” for cooperation with MENA countries. It does not, however, address conflicts between its own objectives, especially between liberal–democratic political and economic reforms, accountable government and respect for human rights on the one hand, and restrictive trade practices, migration management and security cooperation on the other. Furthermore, there is little bilateral policy coordination among EU member states. Focussing cooperation on social contracts would help overcome such conflicts, which are inherent in cooperation targeting short- to medium-term goals, such as migration management, resilience and private investment. In authoritarian contexts, these measures tend to strengthen the state at the expense of society, and thereby increase prospects for conflict, rather than the stability they promise. The social contract perspective is long-term. Social contracts rely on the state’s delivery of the “3 Ps”: protection (of citizens), provision (of economic and social services) and participation (in decision-making). The social contract provides an analytical tool and a set of organising principles for joint EU and member state priorities and activities. The social contract lens shows how the 3 Ps work together as a framework for social cohesion, peaceful relations and political stability. In practical terms, its use would help improve the effectiveness, coherence and coordination of EU and member state cooperation with MENA countries. Some EU member states prefer to focus on trade and economic cooperation, some on political reform and human rights, and others on migration management. If all take a more long-term perspective, they will realise that sustainable social contracts in MENA countries are good for all of their aims. All European actions should support reforms in MENA countries that aim to make social contracts more acceptable to the contracting parties – governments and social groups. Ideally, such reforms result from negotiations of social contracts between parties on equal terms. In practice, how¬ever, the negotiation power of social groups is often limited – one reason why Europe should ensure that its programmes strengthen societies at least as much as governments. This paper discusses four key cooperation areas which are potential drivers of change for social contracts: • Conflict resolution, peacebuilding and reconstruction; • Post-COVID-19 recovery: health and social protection; • Participation at local, regional and national levels; and • Mutually beneficial migration and mobility. The EU and its member states, by working together on the 3 Ps in these four areas, can influence positive change in the MENA region.

With multiple post-Brexit pathways that could still be pursued following the recent adoption of the new security agreements, the EU-UK cyber security relationship is still evolving. Value must be placed on collaboration to tackle shared cyber threats, the role EU institutions play in bringing cyber security actors together, and Britain’s former contribution to European security. These factors strongly indicate that, although new opportunities may present themselves, there will likely be irreversible losses for collective cyber resilience due to Brexit. In order to work towards a new, valuable relationship model, it is recommended that both the EU and UK uphold professional, transparent and non- political security cooperation going forward, whilst remaining open to flexible operational support in the unpredictable and ever-changing cyber threat landscape. Ultimately, within an international system affected by “instability, insecurity and uncertainty”,61 it remains to be seen what opportunities and challenges arise, and if the resulting relationship, whether based on one specific pathway or a combination of all three, could constitute an effective EU relationship model for non-EU entities in the cyber security field.

The policy brief is a result of conclusions from roundtable discussions with policy makers and researchers that took place in Prague and Oslo in late 2019 and early 2020. The researchers studied how to better respond to fear factors and move beyond them in foreign policy. A key observation made in the new brief is that while changes in American, Chinese and Russian foreign policies may trigger anxiety and uncertainty among smaller European states, fears like this can also have productive effects on foreign policy thinking and practice. For states like Czechia and Norway, it can create opportunities for re-thinking support networks and reaching out to new partners. While Norway and Czechia have different historical, geographical and (sometimes) political points of departure, the two states’ assessment of recent international developments is similar. This creates room for conversation and mutual learning - including how to best respond to increased levels of rivalry between great powers, and changing dynamics in the EU and NATO. There are also similarities in how Norway and Czechia perceive their regional collaboration with their respective Nordic and Visegrad states – and how there is considerable scope for them to branch out from their regional formats.

On 25 November 2020 the independent Reflection Group, established by the NATO Secretary Gen- eral following the December 2019 London Lead- ers meeting, released its report titled “NATO 2030: United for a New Era”.1 Composed of ten leading personalities,2 the Group was mandated to look at NATO’s current and future role and suggest recommendations on how to rein- force Alliance unity, political consultation between Allies, and NATO’s political role. The initiative came implicitly as a response to the French President’s statement about NATO being “brain dead”, made in the context of the October 2019 US withdrawal from northern Syria and the subsequent Turkish operation there, both apparently carried out without consultation within NATO. The Report is divided into three parts, looking in se- quence at: the vision and main findings; the security and political environment; and recommendations.

The six countries of the EU’s Eastern Partnership (EaP) have dysfunctional health-care systems and lack resources and protective equipment for their doctors and hospitals. However, much more will be needed to help the EU’s eastern partners fight the coronavirus and mitigate the socioeconomic impact of this crisis.

The European Union and its member states have yet to start upgrading EU policies to their declared ambitions of a more geopolitical and strategically sovereign EU. The EU spends more on support for Eastern Partnership countries than the United States does, but Washington has long taken care of security sector reform and capacity building there. If the EU is to be more geopolitically influential in its own neighbourhood, it needs to start developing strategic security partnerships with key neighbours to the east and the south. The bloc should do so by creating a security compact for the Eastern Partnership, comprising targeted support for intelligence services, cyber security institutions, and armed forces. In exchange, Eastern Partnership countries should conduct anticorruption and rule of law reforms in the security sector. The EU should treat this compact as a pilot project that it will implement with important partners in the Middle East and Africa.

Abstract:
ECFR research into how EU member states and institutions worked together – or failed to – at the height of covid-19 confirms Germany was the bloc’s undisputed crisis leader. Germany made a shaky start in showing solidarity on the pandemic, but regained other member states’ trust on the health and economy fronts. The Netherlands, however, paid a reputational price as the leading ‘frugal’ state opposing greater financial burden-sharing. EU institutions won few plaudits but policymakers still look to it for post-crisis economic leadership. France emerged at the head of a strengthened ‘southern’ grouping of member states, while the Visegrad platform was invisible during this crisis. It will fall to Germany and France to close the north-south divide, building coalitions on major policies. But they should not forget that closing the east-west divide remains an important goal.

Since 2011, members of the Gulf Cooperation Council (GCC) have become increasingly assertive players across the Middle East and north Africa, particularly given the shifting US role in the region. European countries, long used to working under a US umbrella in the Gulf, have struggled to recalibrate their relationships with Gulf states and have been increasingly marginalised as relevant actors. Europeans urgently need to strengthen their geopolitical role in the Gulf, overcoming competition between one another to shape a more autonomous, strategic, and forceful role in defence of their key interests. Europeans can shift the balance of power in the Gulf in their favour and help address key crises by approaching the Gulf through flexible new frameworks based on core coalitions that address specific issues.

This policy paper examines Estonia’s partners in the European Union with the aim of identifying ways to enhance its influence on policy-making. Effective coalition-building is also important for the EU as a whole, since it can improve the Union’s capacity to take decisions and act. The paper highlights that: Estonia has a relatively strong position in the EU, considering its small size and limited resources. It is particularly well-connected with the Nordic-Baltic partners and should seek ways to use this grouping more effectively as a means to reach out to larger member states and shape decisions in the Union. The main challenge is to build stronger links with France and Germany, something that has become all the more important due to Brexit. Teaming up with other countries that are better connected to Berlin and Paris, such as Finland, Sweden, the Netherlands and Belgium, is one way to pursue this goal. It is too early to draw conclusions about the impact of the latest change of government in Estonia on the country’s influence and image among partners in the EU. However, the research interviews show some indications of a weakened position. Estonia should avoid losing its reputation as a results-oriented member state that takes into consideration the priorities of others while pursuing its own interests in a constructive manner.

The United Kingdom officially left the European Union on 31 January 2020 following the signing of the exit agreement. This departure went hand in hand with the opening of a transitional period until 31 December 2020, during which the rules of the internal market continue to govern relations between the two sides. However, negotiations have not yet been completed, since the framework for the future relationship between the United Kingdom – which has now become a third country – and the 27 Member States of the European Union has yet to be established. The joint political declaration of 30 January 2020 accompanying the exit Agreement provides for : "an ambitious, broad, deep, flexible partnership in trade and economic cooperation – with a comprehensive and balanced free trade agreement at its centre –, law enforcement and criminal justice, foreign, security and defence policy, as well as broader areas of cooperation"[1]. Initiated in February 2020 the negotiations on the future Agreement have been hampered by the Covid-19 pandemic. The 27 Member States decided that the defence of their positions would, as with the exit Agreement, be entrusted to the European Commission represented by a single negotiator, the Frenchman Michel Barnier. On the British side, former diplomat, David Frost, is in charge of defending the positions of the British government led by Boris Johnson, however the former will be called to another post as Government Adviser for National Security from September 2020. Although face-to-face negotiations resumed in Brussels at the end of June 2020, in substance they have made very modest progress. Hence a legitimate question: can an agreement on the future relationship between the United Kingdom and the European Union be reached by 31 December 2020, while Boris Johnson's government has refused to make use of the possibility offered of extending the transition period and thus the negotiations until 30 June 2020? Is there a risk of ending the year 2020 without a no deal and to have economic relations between the United Kingdom and the European Union governed by the common law of the World Trade Organisation?

Almost 20 years ago, an early assessment of the role of the EU in the non-proliferation of nuclear weapons concluded that it performed better at addressing the arms control agenda in multilateral fora than at resolving proliferation crises.1 The reasons for this seemed straightforward: a composite actor like the EU can coordinate better in a multilateral setting, where it is able to rely on ample preparation time, than in the context of international crises that often arise unexpectedly. A decade after that initial assessment, the situation was the opposite. In 2015, France, Germany and the UK – the E3 – assisted by successive EU High Representatives, secured a deal with Iran after years of painstaking talks alongside the US, China and Russia, putting the EU on the map as a non-proliferation actor. However, in the Review Conference of the Non-Proliferation Treaty (NPT) that took place in the same year, the EU appeared divided in a session that eventually failed to agree a final document.2 How can this evolution be explained – and ideally improved – with a view to the upcoming Review Conference (RevCon) of the NPT in April-May 2020? The present Brief outlines the record of the EU in this context, highlighting the difficulties encountered in the 2015 edition, and identifying the stakes for the EU in the forthcoming RevCon as well as a possible way forward.

Abstract:
Following the Euromaidan protests and the annexation of Crimea in 2014, Ukraine has witnessed continued violence in the east of the country, with approximately 13,000 people killed, including more than 3,300 civilians, and as many as 30,000 wounded. After a period of stalled negotiations, 2019 brought new momentum to the peace process: Ukraine’s new president, Volodymyr Zelensky, and his political party ‘Servant of the People’ won an unprecedented majority in the 2019 elections, gaining full control over the executive and legislative branches of power with more than 70% of all votes cast across the country. One of the instrumental factors for President Zelensky’s victory was his promise to end the war in Donbas. To this end, he agreed to revive negotiations in the Normandy Format (between France, Germany, Russia and Ukraine) and reactivated direct communication channels with the Kremlin. The president’s message regarding reconciliation with the separatist, Russia-backed ‘People’s Republics’ of Donetsk and Luhansk appears to resonate with the majority of Ukrainians: more than 50% of citizens believe that Kyiv should negotiate a peace deal with separatist leaders and more than 70% support the Ukrainian president’s engagement in direct dialogue with Russia.

The Gulf monarchies face a core dilemma: advancing their security interests through deterrence or through promoting a new diplomatic process. The arrival of the Biden administration in Washington, and the perception of US disengagement from the region, offers an opportunity for Europeans to help de-escalate tensions between GCC states and Iran. The European interest lies in supporting a return to the Iranian nuclear deal and a regional dialogue between the Gulf monarchies and Iran, an approach that is more likely to promote lasting stability. Europeans can support this process by strengthening their own regional security posture and confronting head-on the geopolitical tensions at the heart of regional rivalries.

In recent years the Netherlands has voiced security-related concerns about the involvement of Albanian nationals in organised crime in the Netherlands. These concerns culminated in a request to the European Commission to suspend visa-free travel for Albanians to the EU. This policy brief argues that the current Dutch approach does not provide the best means to address issues of organised crime, such as drug trafficking, related to Albanian nationals. It identifies several inadequacies in the crime data used to substantiate the Dutch position and the way Dutch authorities publicly communicate them. It posits that greater bilateral cooperation beyond the EU accession framework could improve efforts to fight transnational organised crime effectively. The opening of EU accession negotiations with Albania may offer a window of opportunity to formulate a constructive agenda of cooperation beyond the formal EU enlargement framework.

The sub-regional multilateral format of China and 16 post-communist states (16+1) proved that it could last seven years and that it has the potential to absorb new members. Consequently, the European Union is increasingly concerned about its potentially divisive effects on the EU’s unity. The expected economic benefits of 16+1 for the European partners have been scarcely relevant; still, the European states exploit the 16+1 format for strengthening their bilateral agendas with China. Amidst the trade war with China, the US regards China’s rising influence in Central Europe as a political issue. Beijing’s priority in Europe is to calm down the tension with the EU, Germany, and France over the 16+1 platform. However, the accession of Greece to the enlarged format of 17+1 in the recent 16+1 summit in Dubrovnik and the gaining of support for the Belt and Road Initiative in Italy enable China to establish its foothold on the European South’s doorstep in connection with the 17+1 regional platform.

The discussion on the future of EU enlargement was opened again this year. After yet another disappointment for Albania and North Macedonia at the European Council’s session in October, the discussion turned towards a revision of the enlargement methodology. The argument that the enlargement process needs to undergo a reform, put forward by France as a justification of its October veto for Albania and North Macedonia, is based on the fact that the current process is not delivering adequately. That is true especially for the current frontrunners, Montenegro and Serbia, setting a bad example for other candidate countries in the region and giving more reasons to oppose enlargement to some already sceptical EU Member States. Both countries’ progress on the accession path has recently slowed down significantly, with some suggesting that the current low number of chapters that are being opened and closed, and progress only on “technical” rather than substantial matters, is due to the serious problems both countries have in the area of rule of law and democratic standards.

Notably since 2015, it has focused on preventing irregular migration and privileges engagement with the main countries of origin and transit of migrants. In the context of the 2015 Joint Valletta Action Plan (JVAP), a funding instrument – the EU Emergency Trust Fund for Africa (EUTF) –was created to channel development aid in support of EU interests in curbing migration. As reflected in historical and more recent policy agendas, economic integration and free movement within the continent and its regions constitute key elements of African development ambitions and narratives. But an increasing body of research suggests that EU activities (in particular the EUTF) sideline or even undermine African stakeholders and interests in decision-making and programming on migration. This paper analyses the effects of EU political dialogue and programming on regional free movement (RFM) in two African regions: the Intergovernmental Authority on Development (IGAD) in the Horn of Africa and the Economic Community of West African States (ECOWAS) in West Africa. These regions receive the greatest amount of EUTF funding. While both IGAD and ECOWAS have frameworks on RFM, these are at very different stages of development. The analysis, based on literature review and field research, shows that EU approaches to and impact on RFM differ significantly in the two regions. In the IGAD region, the EU is not undermining but rather supporting free movement – albeit not as significantly as it could. In contrast, in the ECOWAS region the EU’s focus on preventing irregular migration is undermining progress on RFM. At least three factors drive this difference: 1) institutional coherence and decision-making powers vary considerably in the two regions; 2) whereas some powerful member states in the IGAD region consider free movement to be a barrier to their hegemonic role, member states in the ECOWAS region largely see it as positive; and 3) EU migration programming in these regions is driven by different levels of urgency – with the largest number of irregular migrants coming from West Africa, the EU’s objective of curbing migration is more accentuated in the ECOWAS region.
