- With a three-month postponement, the European Council agreed to grant Candidate Status to Serbia in early March. This right and groundbreaking decision may yet not release Serbia from settling its relationship with Kosovo and from advancing in settling Kosovo's status. Serbia implemented the agreements of the Pristina-Belgrade dialogue held under the auspices of the European External Action Service only sluggishly. The dialogue has been subject to recurrent adjournments due to growing tensions between the conflicting parties. The fatal escalation of the customs conflict between Serbia and Kosovo in July 2011 illustrated the limbo in northern Kosovo threatening to overturn. The clear results of the referendum about the recognition of the government in Pristina held in Northern Kosovo in February 2012 constitute yet another indicator for the deadlock between the Albanian and Northern Serb communities. For the sake of stability, the EU member states must not be lenient with the status settlement question before allowing Serbia membership in the European Union.

- It is time to close international supervision of Bosnia's Brčko District. Once seen as a model of post-war reconciliation and good government, it is drowning in corruption and mismanagement that flourished despite its supervisors' best efforts. The territory is vital to Bosnia and Herzegovina (BiH)'s stability: it links the two halves of both Republika Srpska (RS) and the BiH Federation (FBiH), and belongs technically to both entities but is independently governed and multi-ethnic. Many of its former leaders are under suspicion in a corruption probe that may have only scratched the surface; several high profile development projects are collapsing in bankruptcy and litigation. RS has a strong influence on the district but is not threatening to undermine its status. Nevertheless, the international community should ensure that Serb leaders of that entity are left in no doubt that any move to take Brčko over would meet a strong reaction. Stability is now dependent on whether local politicians, law enforcement and the judiciary can take responsibility. International supervision is no longer helping, and a new strategy is needed.

- On 9 December 2011, the European Council will discuss Serbia as a future member of the EU. Serbia has come a long way in the past ten years, and the captures of alleged war criminals in recent years have underlined the commitment to a European future on the part of the Serbian government. However, Kosovo remains a serious obstacle for Serbia's EU dreams, as the latest developments in the region have demonstrated. The internal division of the EU on the issue complicates the matter further. Once again, politics prevails in EU enlargement. This DIIS Policy Brief focuses on some of the underlying dynamics of the EU enlargement.

6. Bosnia: Europe's Time to Act

- After years of hesitancy, European Union (EU) member states should make 2011 the year when the lead international role in Bosnia and Herzegovina shifts from the Office of the High Representative (OHR) to a reinforced EU delegation. Bosnia has outgrown the OHR established in 1995 after the Dayton Peace Agreement and the creation of the Peace Implementation Council (PIC). Today the country needs EU technical assistance and political guidance to become a credible candidate for EU membership, not an international overseer to legislate for it or maintain security. Member states should rapidly install a comprehensive plan to reinforce the EU presence, including an embassy led by a strong ambassador, strengthen the membership perspective and build local credibility. OHR should withdraw from domestic politics and, unless a threat to peace emerges, focus on reviewing past decisions.

7. Slippery Slope: Libya and the Lessons of Previous No-Fly Zones

- Twenty years ago, at the close of the 1991 Gulf War, the imposition of a UN-mandated no-fly zone contributed to the formation of a safe haven for Iraqi Kurds, resulting in the liberation of nearly three million people from Baathist dictatorship a full decade before the rest of Iraq. In 1992, new UN-mandated no-fly and no-drive zones were established in southern Iraq and the Balkans to contain rogue regimes and protect civilians from government repression. Given the current developments in Libya, it is natural to consider employing such options once again. Yet history shows that exclusion zones are particularly tricky operations. If not configured properly, they can be worse than useless, signaling fecklessness instead of resolve while providing little real protective value to civilians.

- The Balkans face more trouble in Kosovo as well as Bosnia and Herzegovina unless the United States and European Union take dramatic steps to get both back on track towards EU membership. In Bosnia, the international community needs to reconstitute itself as well as support an effort to reform the country's constitution. In Kosovo, Pristina and Belgrade need to break through the barriers to direct communication and begin discussions on a wide range of issues. This brief proposes specific diplomatic measures to meet these needs.

- Kosovo should not be allowed to stagnate as a "frozen conflict." There are well-established principles that can provide a basis for moving forward. Talks between Belgrade and Pristina on a framework for managing their relationship on practical issues are both possible and necessary, even if they do not happen right away. The time available should be used for careful preparations, especially by Pristina. As Belgrade and Moscow present serious challenges, a joint EU/U.S. effort has the best prospects for success to prevent a "frozen conflict."
