Abstract:
For decades, U.S. policy toward the Middle East has been paralyzed by "the Islamist dilemma" -- how can the United States promote democracy in the region without risking bringing Islamists to power? Now, it seems, the United States no longer has a choice. Popular revolutions have swept U.S.-backed authoritarian regimes from power in Tunisia and Egypt and put Libya's on notice. If truly democratic governments form in their wake, they are likely to include significant representation of mainstream Islamist groups. Like it or not, the United States will have to learn to live with political Islam. Washington tends to question whether Islamists' religious commitments can coexist with respect for democracy, pluralism, and women's rights. But what the United States really fears are the kinds of foreign policies such groups might pursue. Unlike the Middle East's pro-Western autocracies, Islamists have a distinctive, albeit vague, conception of an Arab world that is confident, independent, and willing to project influence beyond its borders. There is no question that democracy will make the region more unpredictable and some governments there less amenable to U.S. security interests. At their core, however, mainstream Islamist organizations, such as the Muslim Brotherhood in Egypt and Jordan and al Nahda in Tunisia, have strong pragmatic tendencies. When their survival has required it, they have proved willing to compromise their ideology and make di⁄cult choices. To guide the new, rapidly evolving Middle East in a favorable direction, the United States should play to these instincts by entering into a strategic dialogue with the region's Islamist groups and parties. Through engagement, the United States can encourage these Islamists to respect key Western interests, including advancing the Arab-Israeli peace process, countering Iran, and combating terrorism. It will be better to develop such ties with opposition groups now, while the United States still has leverage, rather than later, after they are already in power.

9503. Terrorism After the Revolutions

On December 17, Mohamed Bouazizi, a Tunisian street vendor, set himself on fire to protest police harassment. His death incited unrest throughout Tunisia; less than a month later, protests toppled Tunisian President Zine el-Abidine Ben Ali. Egypt, the most populous and influential country in the Arab world, soon followed suit. Al Qaeda met both these dramatic events with near silence. Only in mid-February did Osama bin Laden's Egyptian deputy, Ayman al-Zawahiri, officer comments. But even then, he did not directly address the revolutions or explain how jihadists should respond. Instead, he claimed that the Tunisian revolution occurred "against the agent of America and France," gamely trying to transform Tunisians' fight against corruption and repression into a victory for anti-Western jihadists. On Egypt, Zawahiri offered a rambling history lesson, ranging from Napoleon to the tyranny of the Mubarak government. He released his statement on Egypt on February 18, a week after Hosni Mubarak resigned, and offered little guidance to potential followers on how they should view the revolution or react to it. U.S. politicians are moving quickly to claim the revolutions and al Qaeda's muted response as victories in the struggle against terrorism. "This revolution is a repudiation of al Qaeda," declared Senator John McCain during a visit to Cairo on February 27. And indeed, looking out from bin Laden's cave, the Arab world looks less promising than it did only a few months ago. Although bin Laden and al Qaeda have been attempting to overthrow Arab governments for more than 20 years, the toppling of the seemingly solid dictatorships in Tunisia and Egypt caught them flat-footed and undermined their message of violent jihad. Nevertheless, al Qaeda and its allies could ultimately benefit from the unrest. For now, al Qaeda has greater operational freedom of action, and bin Laden and his allies will seek to exploit any further unrest in the months and years to come.

9504. The Future of the Liberal World Order

Abstract:
There is no longer any question: wealth and power are moving from the North and the West to the East and the South, and the old order dominated by the United States and Europe is giving way to one increasingly shared with non-Western rising states. But if the great wheel of power is turning, what kind of global political order will emerge in the aftermath? Some anxious observers argue that the world will not just look less American -- it will also look less liberal. Not only is the United States' preeminence passing away, they say, but so, too, is the open and rule-based international order that the country has championed since the 1940s. In this view, newly powerful states are beginning to advance their own ideas and agendas for global order, and a weakened United States will find it harder to defend the old system. The hallmarks of liberal internationalism -- openness and rule-based relations enshrined in institutions such as the United Nations and norms such as multilateralism -- could give way to a more contested and fragmented system of blocs, spheres of influence, mercantilist networks, and regional rivalries. The fact that today's rising states are mostly large non-Western developing countries gives force to this narrative. The old liberal international order was designed and built in the West. Brazil, China, India, and other fast-emerging states have a different set of cultural, political, and economic experiences, and they see the world through their anti-imperial and anticolonial pasts. Still grappling with basic problems of development, they do not share the concerns of the advanced capitalist societies. The recent global economic slowdown has also bolstered this narrative of liberal international decline. Beginning in the United States, the crisis has tarnished the American model of liberal capitalism and raised new doubts about the ability of the United States to act as the global economic leader.

9505. Getting the Military Out of Pakistani Politics

The United States has a major stake in Pakistan's stability, given the country's central role in the U.S.-led effort to, in U.S. President Barack Obama's words, "disrupt, dismantle, and defeat" al Qaeda; its war-prone rivalry with India over Kashmir; and its nuclear arsenal. As a result, U.S. policy toward Pakistan has been dominated by concerns for its stability -- providing the reasoning for Washington's backing of the Pakistani military's frequent interventions in domestic politics -- at the expense of its democratic institutions. But as the recent eruption of protests in the Middle East against U.S.-backed tyrants has shown, authoritarian stability is not always a winning bet. Despite U.S. efforts to promote it, stability is hardly Pakistan's distinguishing feature. Indeed, many observers fear that Pakistan could become the world's first nuclear-armed failed state. Their worry is not without reason. More than 63 years after independence, Pakistan is faced with a crumbling economy and a pernicious Taliban insurgency radiating from its Federally Administered Tribal Areas (FATA), the semiautonomous seven districts and six smaller regions along its border with Afghanistan. It is still struggling to meet its population's basic needs. More than half its population faces severe poverty, which fuels resentment against the government and feeds political instability. According to the World Bank, the Pakistani state's effectiveness has actually been in steady decline for the last two decades. In 2010, Foreign Policy even ranked Pakistan as number ten on its Failed States Index, placing it in the "critical" category with such other failed or failing states as Afghanistan, the Democratic Republic of the Congo, and Somalia. The consequences of its failure would no doubt be catastrophic, if for no other reason than al Qaeda and its affiliates could possibly get control of the country's atomic weapons. The Pakistani Taliban's dramatic incursions into Pakistan's northwestern Buner District (just 65 miles from the capital) in 2009 raised the specter of such a takeover.

Abstract:
On August 18, 2010, a Venezuelan drug trafficker named Walid Makled was arrested in Colombia. U.S. officials accused him of shipping ten tons of cocaine a month to the United States, and they made a formal extradition request to try him in New York. Although the Venezuelan government had also made an extradition request for crimes Makled allegedly committed in Venezuela, senior U.S. diplomats were confident that the Colombian government would add him to the list of hundreds of suspects it had already turned over to U.S. judicial authorities in recent years. So it came as a surprise when Colombian President Juan Manuel Santos announced in November that he had promised Venezuelan President Hugo Chávez that Makled would be extradited to Venezuela, not the United States. Colombia, Washington's closest ally in South America, appeared to be unveiling a new strategic calculus, one that gave less weight to its relationship with Washington. What made the decision all the more unexpected is that the U.S. government still provides Colombia with upward of $500 million annually in development and security assistance, making Colombia one of the world's top recipients of U.S. aid. For the United States in Latin America today, apparently, $500 million just does not buy what it used to. Across the region in recent years, the United States has seen its influence decline. Latin American countries are increasingly looking for solutions among themselves, forming their own regional organizations that exclude the United States and seeking friends and opportunities outside of Washington's orbit. Some U.S. allies are even reconsidering their belief in the primacy of relations with the United States. Much of this has to do with the end of the Cold War, a conflict that turned Latin America into a battleground between U.S. and Soviet proxies. Washington has also made a series of mistakes in the years since then, arrogantly issuing ultimatums that made it even harder to get what it wanted in Latin America.

9507. How to Save the Euro - and the EU

Abstract:
The European Union is in danger of compounding its ongoing economic crisis with a political crisis of its own making. Over the last year, crises of confidence have hit the 17 EU members that in the years since 1998 have given up their own currencies to adopt the euro. For the first decade of this century, markets behaved as though the debt of peripheral EU countries, such as Greece and Ireland, was as safe as that of core EU countries, such as Germany. But when bond investors realized that Greece had been cooking its books and that Ireland's fiscal posture was unsustainable, they ran for the door. The EU has stopped the contagion from spreading -- for now -- by creating the European Financial Stability Facility, which can issue bonds and raise money to help eurozone states. Together with the International Monetary Fund, the European Financial Stability Facility has already lent Greece and Ireland enough money to cover their short-term needs. But such bailouts are only stop-gap measures. Portugal and Spain, and to a lesser extent Belgium and Italy, remain vulnerable to pressure from bondholders. Portugal is likely to receive 50-100 billion euros over the next few months. But should Spain also need a bailout -- which could cost as much as 600 billion euros -- the 750 billion euro European Financial Stability Facility would soon be exhausted. In that event, the main euro creditors, primarily British, French, and German banks, might have to accept so-called haircuts, substantial cuts in the principals of their loans. (The banks' tax-avoidance strategies might inflate this total, but the Bank for International Settlements has estimated that the exposure of British, French, and German banks to the group of vulnerable debtor states referred to as the PIGS -- Portugal, Ireland, Greece, and Spain -- amounted to more than $1 trillion in mid-2010.) Encouraged by Germany, some of the states in difficulty have sought to placate bond markets by making ruthless cuts in government spending. But as many economists have pointed out, these measures are hindering growth without satisfying bondholders that their money is safe; bondholders worry that these measures are not politically sustainable. In fact, they are likely to undermine Europe's political union.

It is time for the international community to recognize that the Doha Round is doomed. Started in November 2001 as the ninth multilateral trade negotiation under the auspices of the General Agreement on Tariffs and Trade and its successor, the World Trade Organization (WTO), the talks have sought to promote economic growth and improve living standards across the globe -- especially in developing countries -- through trade liberalization and reforms. Yet after countless attempts to achieve a resolution, the talks have dragged on into their tenth year, with no end in sight. To be sure, world leaders, negotiators, and commentators have expressed their unanimous support for a successful outcome -- the “balanced” and “ambitious” agreement called for by so many summit statements. But concluding a trade agreement is like pole-vaulting. Everything must come together at once -- after the extensive preparation and the building of momentum, there is that one giant leap -- with the hope that the entire body will sail over the bar. Most trade agreements survive several failed attempts before success is achieved. But the Doha Round keeps crashing into the bar.

9509. Who's Afraid of the International Criminal Court?

Last February, soon after Libyan leader Muammar al-Qaddafi unleashed his forces against civilian protesters, the United Nations Security Council unanimously voted to refer the situation in Libya to the International Criminal Court. Days later, the ICC's chief prosecutor, Luis Moreno-Ocampo, announced the launch of an investigation of members of the Qaddafi regime, promising, "There will be no impunity in Libya." With the UN Security Council injecting the court into one of the year's biggest stories, the ICC may seem to have become an indispensable international player. It already is looking into some of the gravest atrocities committed in recent decades -- in the Democratic Republic of the Congo, Sudan, and Uganda, among others -- and its investigation into the 2007 election-related violence in Kenya is shaking up that country's elite. But a closer look suggests that the ICC's sleek office building on the outskirts of The Hague houses an institution that is still struggling to find its footing almost a decade after its creation. The court has failed to complete even one trial, frustrating victims as well as the dozens of governments that have contributed close to $1 billion to its budget since 2003. The ICC's first trial was nearly dismissed twice. Its highest-profile suspects -- Sudanese President Omar al-Bashir and Joseph Kony, the leader of the Lord's Resistance Army (LRA), the rebel group that has terrorized northern Uganda and neighboring areas -- have thumbed their noses at the court and are evading arrest. And with all six of the ICC's investigations involving abuses in Africa, its reputation as a truly international tribunal is in question.

9510. Recalibrating Homeland Security

The United States has made a mess of homeland security. This is hardly surprising. The policymakers responsible for developing homeland security policy in the wake of September 11, 2001, did so under extraordinary conditions and with few guideposts. The Bush administration's emphasis on combating terrorism overseas meant that it devoted limited strategic attention to the top-down law enforcement and border-focused efforts of the federal departments and agencies assigned new homeland security responsibilities. President Barack Obama has largely continued his predecessor's policies, and congressional oversight has been haphazard. As a result, nearly a decade after al Qaeda struck the World Trade Center and the Pentagon, Washington still lacks a coherent strategy for harnessing the nation's best assets for managing risks to the homeland -- civil society and the private sector. For much of its history, the United States drew on the strength of its citizens in times of crisis, with volunteers joining fire brigades and civilians enlisting or being drafted to fight the nation's wars. But during the Cold War, keeping the threat of a nuclear holocaust at bay required career military and intelligence professionals operating within a large, complex, and highly secretive national security establishment. The sheer size and lethality of U.S. and Soviet nuclear arsenals rendered civil defense measures largely futile. By the time the Berlin Wall came down and the Soviet Union collapsed, two generations of Americans had grown accustomed to sitting on the sidelines and the national security community had become used to operating in a world of its own. To an extraordinary extent, this same self-contained Cold War-era national security apparatus is what Washington is using today to confront the far different challenge presented by terrorism. U.S. federal law enforcement agencies, the border agencies, and the Transportation Security Administration (TSA) are subsumed in a world of security clearances and classified documents. Prohibited from sharing information on threats and vulnerabilities with the general public, these departments' officials have become increasingly isolated from the people that they serve.

The result will be an age of American austerity. Would you like to leave a comment? 1CommentsJoin To the Editor: Roger Altman and Richard Haass ("American Profligacy and American Power," November/December 2010) persuasively argue that continued American profligacy promises to undermine American power. But the situation is even more urgent than they suggest. Although Altman and Haass expect markets to remain calm "possibly for two or three years," the rising price of gold suggests otherwise. Gold has risen from $460 per ounce to $1,400 per ounce in the last five years -- representing a 67 percent devaluation of the U.S. dollar per unit of gold. As former U.S. Federal Reserve Chair Alan Greenspan has said, gold is "the ultimate means of payment." Moreover, on top of new government debt over the next several years, maturing existing debt will need to be refinanced. At 4.6 years, the average maturity of the U.S. federal debt held by the public (debt that now totals $9.1 trillion) is tight relative to, for instance, the average maturity of 13.5 years for British government debt. According to the International Monetary Fund, the maturing debt of the U.S. government will equal 18.1 percent of U.S. GDP during 2011 alone. Altman and Haass rightly note that the U.S. government's annual interest expense will rise dramatically as its stock of debt increases and interest rates inevitably rise. Further debt increases would substantially darken the fiscal outlook for the federal government. And even a relatively small rise in interest rates would have a significant impact. TIM W. 9514. Turkey's Cyprus Problem

To the Editor: Hugh Pope ("Pax Ottomana?" November/December 2010) observes that Turkey succeeded in being elected to a rotating seat of the UN Security Council for 2009-10. It might then be assumed that Turkey's policies have been guided by the principles of the UN Charter. But Turkey continues its 40,000-strong troop occupation of a large part of the Republic of Cyprus -- an EU and UN member state -- despite numerous Security Council resolutions since its initial 1974 invasion calling for its immediate withdrawal. Turkey does not comply with its legal obligations to Cyprus or to the EU and forcibly interferes with Cyprus' rights in its exclusive economic zone of maritime jurisdiction. Pope writes that "in 2003, the [ruling party in Turkey] reversed traditional Turkish policy by agreeing to endorse a UN plan to reunify" Cyprus. What he does not say, however, is that the latest version of the plan wholly incorporated Ankara's demands. In addition, Pope makes an unfounded assertion in stating that "since joining the EU in 2004, Cyprus has pulled all available levers to block Turkey's own accession to the union." If this were the case, Turkey would not have been endorsed as a candidate for EU membership in 2005, since such a decision requires unanimity, and so Cyprus could have exercised its veto. Like Pope, many welcomed Turkish Foreign Minister Ahmet Davutoglu's declared goal of the "settlement of disputes" that "directly or indirectly concern Turkey" and Turkey's "zero problem" policy toward its neighbors. Other than paying lip service to supporting the UN-sponsored intercommunal talks on Cyprus, however, Turkey has not conceded an inch toward achieving a solution within the agreed framework. If the Cyprus problem were solved through a viable compromise settlement with Turkey's help, Turkey will have removed a major obstacle to its EU accession. Moreover, a reunited and peaceful Cyprus, free of foreign troops, would be transformed into a bridge of peace from a bone of contention and would cooperate with Turkey and Greece on an array of issues. This outcome can be achieved through good neighborly relations on the basis of the principles of the UN Charter, not through occupation, domination, and a Pax Ottomana. Abstract:
The (illegal) exploitation and (bad) management of high value resources like timber, diamonds, gold, minerals and oil constitute key-factors for the inflammation, continuation and termination of numerous intra-state conflicts. Since the 1990s these conflicts have been increasingly settled by the conclusion of comprehensive peace agreements between the conflicted state and belligerent non-state parties. At the example of the Lomé, Accra and Ouagadougou Agreement, which were negotiated to terminate the conflicts in Sierra Leone, Liberia and Côte d'Ivoire , the paper describes and analyzes whether and how these agreements addressed the redistribution of conflict-resources during the peace process. In the course of this documentation, the paper finds a strong involvement of the UN Security Council when it comes to the redistribution of resources and the implementation of all three agreements that goes beyond addressing an immediate threat to peace and security. Focusing on this involvement of the Security Council to exert a strong pull towards the compliance of the parties with these agreements, the paper will discuss the legal nature of the example peace agreements and of the specific obligations concerning the redistribution of resources. The paper finds that, under certain circumstances, internationalized comprehensive peace agreements, with a strong endorsement and involvement of the Security Council, can create effective legal obligations for the parties with respect to the redistribution and treatment of resources during the transition from conflict to peace.

Following Argentina's withdrawal from the 1995 Joint Declaration concluded with the UK for the common exploration and exploitation of hydrocarbons in the Falklands, the sovereignty dispute over the Islands has recently re-emerged as an economic 'struggle' for access to the North Falklands Basin's oil deposits. The pa per analyzes the states' pending sovereignty dispute and their present claims, from the perspective of the exploitation of the Island s' natural resources. The lawfulness of uncoupling the treatment of title to territory and to natural resources, particularly in an area where sovereignty is disputed has been examined in the present paper. By considering the UN practice on the Falklands' case, it is argued that a separate treatment is not per se unlawful, provided that all the parties having a legitimate sovereign claim over the territory are involved. The Joint Declaration is employed as a model to provide evidence in this regard. In addition, the paper discusses the unilateral conduct of the parties as a possible alternative to a cooperative agreement. As the UK is currently acting unilaterally with regard to the access to the oil deposits in the Islands, the implications of its conduct are also reviewed.

Non-traditional maritime security concerns have become more important than ever in the post-Cold War era. Naval forces of most developed countries are more concerned about these threats than conventional war. One of the main maritime security issues for many countries in the world is illegal, unreported and unregulated (IUU) fishing in the marine area. With these burgeoning issues comes the potential for a large number of disputes involving international law. In early 2002, a long-line fishing vessel under a Russian flag – the Volga, was detained by Australian authorities a few hundred meters outside the Exclusive Economic Zone of Australia's Heard and McDonald Islands in the Southern Ocean. The vessel was reportedly engaged in illegal fishing. This incident gave birth to litigation in international and Australian courts. Apart from these cases, Russia also announced separate litigation against Australia for violation of Articles 111 and 87 of the United Nations Convention on the Law of the Sea (UNCLOS). Considering the outcome of these cases, this article critically examines the characteristics of litigation as a strategy for pacific settlement of disputes over marine living resources. Using the Volga Case as an example, this article explores some issues related to the judicial settlement of disputes over marine living resources. This article demonstrates that the legal certainty of winning a case may not be the only factor influencing the strategy for settlement of an international dispute.

The focus of this paper is the connection between conflict and commercial activity. In particular, it focuses on the ongoing conflict in the Eastern Democratic Republic of Congo (DRC) that is funded, in large part, by the sale of conflict commodities – minerals, metals, and petroleum – that fund violent groups at their source and then enter legitimate markets and products around the world. Recently, attention has turned to how to regulate conflict commerce as a tool for divesting from violent conflict. In the United States, for example, the recently adopted Dodd-Frank Wall Street Reform and Consumer Protection Act include a provision addressing conflict minerals originating from this region. The violent and secretive nature of conflict minerals transactions makes crafting effective regulation and policing strategies challenging. As a result the Dodd-Frank Act, like other domestic and international efforts, is designed in large part to discover, gather and disseminate information about the nature and scale of conflict commodities emanating from the DRC. This paper analyzes this legislation while also discussing a number of other current conflict commerce governance efforts. It observes the difficulty of regulating in the context of conflict and corruption and analyses the use of regulation as a tool for information- xtraction, information-forcing and information-dissemination as opposed to its use as a tool for directly proscribing undesirable behavior.

This paper analytically investigates the incentive scheme of perpetrators of violent conflicts. It provides a rational equilibrium framework to elicit how monetary incentives and survival considerations shape a combatant‟s decision to participate in a conflict. In the model, a leader decides to award soldiers monetary incentives. Civilians finance the militia via donations and soldiers decide on the actual fighting and indulge in looting. We explore the scheduled decision-making that takes place on the path toward a violent conflict and study the principal-agent relationship that exists between the leader and the militia. In addition, we analyze the effect of several internal factors (productivity and survival risk) and external factors (relative economic resources, opponents‟ military strength) on the intensity of the conflict.

Enhancing compliance with international norms by armed non-state actors is central to efforts to improve the protection of civilians in armed conflict. Limited engagement with such actors, as well as lack of clarity as to the precise nature and extent of the international legal regimes that are applicable to them, constitute significant barriers to achieving better compliance. In this article the authors argue for international human rights law to be more widely seen as imposing direct obligations upon armed nonstate actors and for counter-terrorism legislation not to be interpreted so as to preclude engagement on positive respect for humanitarian norms. What is needed is greater engagement with armed non-State actors, not less.

The increasing use of private military companies by states in armed conflict raises questions regarding the regulation of those non-state actors. However, even though the privatization of core state functions might be an emerging phenomenon with respect to its extent and quality, there is no legal vacuum for the activities of private military contractors. According to international humanitarian law, states must ensure respect for the ius in bello and enforce applicable international law also with respect to private contractor personnel if they are charged with functions governed by international law. Against this background, the challenge for future regulation is on the national and administrative level. States must intensify their efforts to implement existing standards.

The fight against insurgents in Afghanistan and Iraq has led the U.S. and its allies to devote growing attention and resources to counterinsurgency strategies, stability operations and civil-military operations. Humanitarian and development assistance have acquired an important role in military strategies. However, the activities carried out by armed forces in the field of humanitarian assistance in Afghanistan and Iraq have been criticized for blurring the distinction between civilian and military actors and thus increasing the risk of being targeted for humanitarians and civilians. The article analyzes the conduct of U.S. armed forces in Afghanistan and Iraq and the challenges it has posed to humanitarian actors. It then examines U.S. military doctrines and manuals and argues that their most recent versions have increasingly taken into account the needs of humanitarian actors and the principles of humanitarian action, but reasons for concern remain. The engagement of the military in humanitarian assistance has not been definitely limited. In addition, humanitarians should be careful in their relationships with the armed forces in the field of information-sharing.

In the light of rising competition, scarce natural resources are increasingly perceived as a potential national security risk. Hence, governments are increasingly intervening in primary commodity markets to secure domestic supply at lower prices, for instance, by restricting exports through tariffs and quotas. While limiting exports may be justified in certain cases such as temporary shortages of food supply, they are often a second-best policy tool to address domestic market failures, risking international trade distortions. Some import-dependent countries have therefore lobbied for an update of WTO regulations to curtail the use of export restrictions; others have turned to preferential trade agreements (PTAs) to achieve stricter disciplines. In this paper, the following questions are addressed: What are the current WTO rules regulating export restrictions on natural resources, and what are their limitations? Are PTAs better equipped to prevent trade distortions through export restrictions? To answer these questions, we confine our analysis mostly to Free Trade Agreements (FTAs), not considering the multitude of one-sided preferential agreements.

In the last decade of globalization, States in the Middle East, East Asia, Europe, and North America have looked towards Africa and Southeast Asia for opportunities to lease for 30-50 years large tracts of arable land for production of commodity crops and biofuels in order to meet the needs of home markets. Facing their own governance challenges, States in Africa and Southeast Asia have leased land to private foreign investors without requiring any environmental review or mitigation of the proposed land leases. This paper argues that in food insecure states the recent flurry of land leasing activity to foreign agribusiness is likely to lead to unintended long term consequences for the ecology in land-leasing States by depleting the already fragile environment through monocropping, chemical pesticide and fertilizer applications, and large scale irrigation. This paper argues that international investment law may provide foreign investors with legal protection if land leasing States in the future decide to regulate the leases in a manner that discriminates against large agribusiness. The current proposals for self-regulatory voluntary codes of conduct do not provide sufficient oversight over the leasing process to protect the public's interest in a healthy and productive environment against foreign investors who have under the current lease structure no incentive to improve the land that they are leasing. The creation of an United Nations based ombudsman to provide legal and technical oversight and support for States making long-term leases has greater potential than a voluntary code for ensuring a balanced negotiation among the interests of host State governments for investment, investors for arable land, and the public for long-term sustainability.

The threat of water-related conflicts is comparatively more real and serious in the Middle East and North Africa hydrographic region where the Nile is found. Ominous predictions about water being the next casus belli in the region abound. There are many conflict determinants in the Nile basin which lend much credence to the predictions and the basin's proneness to conflict is quite evident. The unprecedented positive rapport brought about by the launching of the Nile Basin Initiative (NBI) and the enormous hope and optimism evoked by its lofty Shared Vision explain the unprecedented serenity and cooperative atmosphere the basin has witnessed over the past decade. The decade-long effort to work out and agree on an inclusive legal and institutional framework for the basin has, due to the cunning interpolation of the treacherous, non-legal concept of 'water security', ended up in failure., The subsequent shift to and endorsement of benefit sharing as an alternative, simple and cure-all solution to the Nile waters question has further dimmed the prospect for the realization of the Shared Vision which now sounds more like a pipe dream than a realizable vision. Whether these adverse developments would finally pave the way for the ominous predictions to come to pass is as much unlikely as it is perplexing. It will be argued, in this paper, that the likelihood of violent conflicts over the Nile waters is an unlikely scenario, the more likely turn of events being further continuation of the iniquitous status quo.

Imagine a civilian communications system is being temporarily relied upon by an opposing military force for vital operations. If one launches a computer network attack against the communications system, the operation may disable the opposing force's ability to function adequately and, as a result, prompt their surrender. The alternative course of action is to launch a traditional kinetic weapons attack in the hopes of inflicting enough casualties on the troops to induce surrender. Given these options, the law of war would encourage the utilization of the computer network attack because it would result in less unnecessary suffering. But is the same true if we are unsure of the collateral consequences of the computer network attack on a large civilian population that also relies on this communications system? For instance, because civilians use the same communications system to gather critical information, disabling the system might result in rioting, civil disorder, serious injuries, and deaths. Further, civilians may be unable to call for help, seek out medical assistance, or locate emergency response centers. Given these unknown yet potentially severe collateral consequences to civilians, it becomes less clear that a proportionality analysis under the law of war would favor the computer network attack over the traditional kinetic operation. In this article, Professor Lucian E. Dervan examines the application of the law of war to information operations and analyses the role of the Geneva Convention's utilitarian goals in determining the validity of computer network attacks against dual-use civilian objectives.

Information is a fundamental resource in post-conflict societies. However, information-sharing may lead to both advantages and disadvantages. The main focus of the present paper is the flow of information and knowledge from the International Criminal Tribunal for the Former Yugoslavia (ICTY) to the domestic judicial system of Bosnia and Herzegovina. Following a brief introduction of the dynamics of the changing relationship of the Tribunal and the Bosnian judiciary, the paper aims to outline the positive achievements and the practical barriers of the international intervention into the management of war crime cases in Bosnia and Herzegovina. The paper introduces the practical problems that came forth with the introduction of the adversarial procedure in the domestic judicial system, by which measure international intervention might have gone too far resulting also in negative consequences with regard to the management of domestic war crime trials.

In 2009, the Permanent Court of Arbitration administered a unique case: the Abyei Arbitration between the Government of Sudan and the Sudan People's Liberation Movement/Army. This case is unique in several aspects: first, it is an example of intra-state dispute settlement in a conflict zone rich in natural resources, second, it was conducted under a fast-track procedure, and third, it was fully transparent, with all documents and full webcast of the proceedings still available on the PCA website. Currently there is a large number of outstanding intra-state disputes, not limited to Africa, so this paper assesses why the Parties in the Abyei Arbitration chose arbitration in the first place and whether this model could be successfully applied to other similar disputes.

In Joseph Heller's comic war novel, Catch-22, the catch-22 of the title refers to a supposed military regulation that allowed one to be relieved of military service if one was insane, but further provided that no one who realized he would be better off out of military service could possibly be insane. Humanity's so far leaderless approach to dealing with rapidly accelerating climate change embodies a similar, but profoundly tragic, catch-22 that has, among other twists and contradictions, transmuted justice into paralysis. Many thought that the natural global leader of the effort to gain control of global climate change would be the United States, with its splendid cadre of scientists and its history of technological innovation. But our politicians have failed to be worthy of our scientists or of the trust we citizens have placed in them. Facing reality appears to be increasingly unpopular among those who pass as our national political leaders. Those who refuse to face reality often find that what they ignore may come back to bite them, and worse, it may hurt others who trust them with their well-being. It is unclear which members of the U.S. Senate have sold their souls to the fossil-fuel interests and which have simply closed their minds. But the effect is the same: the facts on the ground—and in the air, water, and ice of the planet—are racing further and further ahead of the faltering U.S. political efforts to respond to them. And the American failure of political leadership is one major factor that is crippling efforts to negotiate multilateral action at the international level.

The "resource curse" can strike countries that derive a large portion of their national income from exporting high-value natural resources, such as oil, gas, metals, and gems. Resource-exporting countries are subject to four overlapping curses: they are more prone to authoritarianism, they tend to suffer more corruption, they are at a higher risk for civil wars, and they exhibit greater economic instability. The correlations between resources and such pathologies as authoritarianism, corruption, civil conflict, and economic dysfunction are evident in the list of the five major African oil exporters: Algeria, Angola, Libya, Nigeria, and Sudan. The recent histories of mineral exporters support the correlations: for example, "blood diamonds" fueled Sierra Leone's decade-long civil war, and the continuing conflict in the metal-rich eastern Congo has caused up to 6 million deaths. The phenomenon is not solely African: Burma, Yemen, and Turkmenistan, for example, are also resource cursed. Moreover, poor governance in resource-cursed countries can engender follow-on pathologies, such as a propensity to cause environmental damage both domestically (for example, through the destruction of forests) and globally (through increased greenhouse gas emissions). Most research on the resource curse has focused on the institutions of exporting countries. This essay focuses instead on importing countries, especially those in North America and Europe. I survey how the resource curse impedes core interests of importing states. I then discuss how the policies of importing states drive the resource curse, and how these policies violate their existing international commitments. The second half of the paper describes a policy framework for importing states that can improve international trade in resources for both importers and exporters.

As global governance institutions proliferate and become more powerful, their legitimacy is subject to ever sharper scrutiny. Yet what legitimacy means in this context and how it is to be ascertained are often unclear. In a previous paper in this journal, we offered a general account of the legitimacy of such institutions and a set of standards for determining when they are legitimate. In this paper we focus on the legitimacy of the UN Security Council as an institution for making decisions concerning the use of military force across state borders. The context for this topic has changed over the last decade as a result of the ongoing development of the responsibility to protect (RtoP) doctrine and extensive discussions about it in the United Nations. Yet the mostly widely accepted proposals for RtoP still require Security Council authorization for forceful intervention, and strictly limit the conditions under which such intervention may take place.

How is the just assignment of climate change mitigation costs related to the fair allocation of burdens for climate change adaptation? In distributing the costs associated with climate change, most scholars have focused exclusively upon mitigation burdens, which reduce ongoing contributions to climate change, primarily through greenhouse gas abatement efforts. Few consider the distribution of adaptation costs, which concern projects that seek to minimize harm from human-induced climate change. This article explores both, grounding each in the justice framework appropriate to each activity, with mitigation efforts based in distributive justice and adaptation activities in corrective justice, and outlines an overarching account of responsibility that! links the two. From such an account, it suggests, a more coherent view of the tradeoffs between mitigation and adaptation is possible, enabling a more integrative policy framework for linking ongoing efforts in one category with required burdens in the other.

Abstract:
How do great powers respond to acute decline? The erosion of the relative power of the United States has scholars and policymakers reexamining this question. The central issue is whether prompt retrenchment is desirable or probable. Some pessimists counsel that retrenchment is a dangerous policy, because it shows weakness and invites attack. Robert Kagan, for example, warns, “A reduction in defense spending . . . would unnerve American allies and undercut efforts to gain greater cooperation. There is already a sense around the world, fed by irresponsible pundits here at home, that the United States is in terminal decline. Many fear that the economic crisis will cause the United States to pull back from overseas commitments. The announcement of a defense cutback would be taken by the world as evidence that the American retreat has begun.” Robert Kaplan likewise argues, “Husbanding our power in an effort to slow America's decline in a post-Iraq and post-Afghanistan world would mean avoiding debilitating land entanglements and focusing instead on being more of an offshore balancer.... While this may be in America's interest, the very signaling of such an aloof intention may encourage regional bullies.... [L]essening our engagement with the world would have devastating consequences for humanity. The disruptions we witness today are but a taste of what is to come should our country flinch from its international responsibilties.” The consequences of these views are clear: retrenchment should be avoided and forward defenses maintained into the indefinite future.

For a decade after the end of the Cold War, observers were profoundly optimistic about the state of the European Community (EC). Most endorsed Andrew Moravcsik's claim that the establishment of the single market and currency marked the EC as “the most ambitious and most successful example of peaceful international co - operation in world history.” Both arrangements, which went into effect in the 1990s, were widely regarded as the “finishing touches on the construction of a European economic zone.” Indeed, many people thought that economic integration would soon lead to political and military integration. Germany's minister for Europe, Günter Verheugen, declared, “[N]ormally a single currency is the final step in a process of political integration. This time the single currency isn't the final step but the beginning.” Meanwhile, U.S. defense planners feared that the Europeans might create “a separate 'EU' army.” In short, the common view was that the EC had been a great success and had a bright future.

On January 10, 2007, President George W. Bush announced in a televised prime-time address to the nation a bold, even risky, new strategy in the Iraq War. The United States' military and political fortunes in the war had eroded so sharply over the preceding year that President Bush had authorized a thorough internal review to deter - mine why the current strategy was not succeeding and what, if anything, could be done about it. The review had concluded that the United States was on a trajectory that would end in defeat unless the president authorized a new strategy and committed new resources to it. Bush used the televised address to describe in broad strokes the results of the review and the new strategy, which the media quickly dubbed the “surge strategy,” because its most controversial provision involved sending have new brigade combat teams (BCTs) to Iraq, a commitment that grew to a total of nearly 30,000 additional troops—this at a time when public support for the Iraq War was strained to the breaking point.

This article investigates and explains the development of International Relations studies (IRS) in China, Japan, and India. Beginning in early 1980s IRS experienced exponential growth in China and is becoming a separate discipline in that country. Despite early starts, IRS in Japan and India is still an appendage in other disciplinary departments, programs, and centers although growing interest is discernible in both countries. Continued rise of Asian powers along with their growing roles and responsibilities in constructing and managing regional and global orders is likely sustain and increase interest in IRS in these countries and more generally in Asia. Distinctive trajectories have characterized the development of IRS in China, Japan, and India. Distinctiveness is evident in master narratives and intellectual predispositions that have shaped research and teaching of IR in all three countries. The distinct IRS trajectories are explained by the national and international context of these countries as well as the extensiveness of state domination of their public spheres. Alterations in national circumstances and objectives along with changes in the international position explain the master narratives that have focused the efforts of IR research communities. Extensiveness of state domination and government support, respectively, explain intellectual predispositions and institutional opportunities for the development of IRS. IRS in Asia has had a predominantly practical orientation with emphasis on understanding and interpreting the world to forge suitable national responses. That orientation contributed to a strong emphasis on normative–ethical dimensions, as well as empirically grounded historical, area, and policy studies. For a number of reasons including intellectual predispositions and constraints, knowledge production in the positivist tradition has not been a priority. However, IR theorizing defined broadly is beginning to attract greater attention among Asian IR scholars. Initial interest in Western IR theory was largely a function of exposure of Asian scholars to Western (primarily American) scholarship that has been in the forefront in the development of IR concepts, theories, and paradigms. Emulation has traveled from copying to application and is now generating interest in developing indigenous ideas and perspectives based on national histories, experiences, and traditions. Although positivism may gain ground it is not deeply embedded in the intellectual traditions of Asian countries. Furthermore, theorizing in the positivist tradition has not made significant progress in the West where it is also encountering sharp criticism and alternative theories. Asian IR scholarship would continue to emphasize normative–ethical concerns. And historical, area, and policy studies would continue to be important in their own right, not simply as evidentiary basis for development of law-like propositions. It also appears likely that Asian IR scholarship would increasingly focus on recovery of indigenous ideas and traditions and their adaptation to contemporary circumstances. The net effect of these trends would be to diversify and enrich existing concepts, theories, methods, and perspectives, and possibly provide fresh ones as well. The flourishing of IRS in Asia would make the IR discipline more international.

Abstract:
The development of International Relations theory (IRT) in China has been framed by three debates since 1979. The first was about China's opening up to the outside world. It started with the question of whether the world was characterized by 'war and revolution' or 'peace and development' between orthodox and reformist scholars and continued to focus on China's interest between orthodox scholars and the newly rising Chinese realists. It resulted in a wide acceptance of the reformist argument that peace and development characterized our era and of the realist view that China was a normal nation-state and should have its own legitimate national interest. The second started in the early 1990s and centered on the better way of realizing China's national interest. It was between Chinese realists and liberals. While the former emphasized national power, the latter proposed the alternative approach of international institutions. The third debate was on China's peaceful rise. It evolved at the turn of the century, when all the three major American IRTs, realism, liberalism, and constructivism, had been introduced into China and therefore the debate was more a tripartite contention. Realists believed that it was impossible for any major power to rise peacefully, while liberals and constructivists both supported the peaceful-rise argument. Liberals stressed more the tangible benefits derived from international institutions and constructivists explored more China's identity in its increasing interaction with international society. Although it was Chinese constructivists who explicitly discussed the identity issue, all the three debates and all the debating sides have reflected this century puzzle since the Opium War – China's identity vis-à-vis international society. These debates have helped push forward the IRT development in China and at the same time established Western IRT as the dominant discourse. A new round of debate seems likely to occur and may center on the question of the world order. This time it may help the newly burgeoning but highly dynamic Chinese IRT to develop and contribute to the enrichment of IRT as knowledge of human life.

Abstract:
A common view of Japan's International Relations (IR) studies in the post-World War II period is that they are characterized by pacifism and historical approaches. This paper argues that while pacifism has continued to serve as the basis of them, the approaches adopted by researchers have become increasingly diversified. Specifically, although the main issues for Japanese IR studies in the postwar period (i.e. defense strategy, world political economy, and global issues) have been consistently addressed by researchers on the basis of pacifism, the theoretical orientation of researchers has continually become stronger. Finally, this paper argues that both changing and continuous characteristics of IR studies in Japan have been supported by global developments, and concludes that this trend will continue into the near future.

Abstract:
There are many stories to be told regarding the development of International Relations (IR) theory in the United States over the last century. Some have pointed out IR's evolutionary properties, emphasizing the debates that have produced fitter theory with empirical reality. Others have argued that the development has been largely scientific with knowledge built hierarchically through time. In this article, I propose an alternative view of American IR's development. Specifically, I argue that IR theory is best understood through heterarchical organization, with core ideas and concepts rerepresented in new ways, and various levels of analysis, over time. In making this argument I trace duel processes of borrowing ideas from other disciplines and rerepresenting those ideas in new forms in order to solve vexing theoretical problems. The article demonstrates how conceptions of anarchy have been significantly affected by other disciplines and relates those conceptions to views of international security both at home and abroad, particularly in the Asia-Pacific region.

Abstract:
British International Relations (IR) theory is distinguished by a concern with institutions and norms, and by an emphasis on history, philosophy, and law rather than the formal methods of the social sciences; in both respects, but especially the latter, it differs from American IR theory. The origins of British IR theory are traced, and the importance of the 'English School' (ES) is stressed, partly because of the work it stimulates, but also because of its role as a brand which helps to establish the independence of British IR from the otherwise dominant American profession. Along with ES scholarship (pluralist and solidarist), political theory and IR, and critical theory, including critical security studies, are the major areas where contemporary IR theory in Britain is located. This is likely to persist, but the generally critical approach taken to social scientific theorizing may be changing, with the increasing importance of historical sociology and critical realist work. It may also be the case that the privileged status of IR theory in British IR may be under challenge.

Abstract:
This is an important book, which is long overdue. As the centre of gravity in world politics moves, slowly but inexorably, from West to East, we will all need to know how world affairs are understood and interpreted in both the new power centers and, just as importantly, in countries that have no pretensions to great power status themselves, but must coexist in the neighborhood of the new giants. At least we all need to know about it on the plausible assumption that in the future, as in the recent past, the process of global integration will continue. If, in the face of some future catastrophe, we retreat into our separate civilizational and cultural comfort zones, it may not matter so much. This is not an impossible future, but given the power, reach, and rapid development of modern communications and information technology, it seems a highly improbable one.

For those who live in the American International Relations community, Etel Solingen's Nuclear Logics: Contrasting Paths in East Asia the Middle East undoubtedly represents a stunning success of the study of nuclear proliferation. In 1994, Solingen published an influential article in this field of research, 'The Political Economy of Nuclear Restraint', in International Security, and argued that countries with ruling coalitions pursuing economic liberalization have stronger incentives to refrain from developing nuclear weapons than those with 'inward-looking, nationalist, and radical-confessional coalitions'. Based on the review of cases in South Asia, on the Korean Peninsula, in the Middle East, and in Latin America, she concluded that the former are internationalist in nature and are unwilling to damage international trade and investment by going nuclear, whereas the latter are more likely to pursue nuclear weapons because they care much less about the economic costs of nuclearization. In Nuclear Logics, Solingen expands such findings of her 1994 article and argues even more persuasively that 'internationalizing models of political survival make the development of nuclear weapons less likely than inward-looking models' (p. 46). Starting from 'the puzzle of contrasting historical trajectories' across East Asia and the Middle East since the late 1960s (p. 4), Solingen conducts the first ever 'systematic efforts' (p. 11) to explain why East Asia has largely moved toward denuclearization while the norm among the core Middle East powers has been nuclearization. Criticizing four alternative theories of nuclear choices of states, i.e. neorealism, neoliberal institutionalism, constructivism, and 'theories about democracy and foreign policy', as insufficient to solve her puzzle, Solingen insists that the study of nuclear proliferation must pay more attention to the effects of internationalization on domestic politics and nuclear policy. According to Solingen, '[w]hereas inward-looking models might have regarded nuclear weapons as assets in the arsenal of building regime legitimacy, outward-oriented ones regarded them as liabilities' (p. 277) and the two distinct patterns of nuclear choices in the Middle East and East Asia during the 'second nuclear age' can be well explained by the heavy regional concentrations of respective models in respective regions. In East Asia, the concentration of leaders who stake their political survival on economic growth through integration into the global economy reinforced individual, domestic incentives of leaders to avoid nuclearization across the borders. In the Middle East, the concentration of leaders who resist internationalization by trade protection, import substitution, and state entrepreneurship had the opposite effect. In fact, Solingen's careful case studies of four 'nuclear aspirants' in East Asia and five in the Middle East successfully demonstrate that '[t]he nuclear choices of all pertinent cases' in the two regions since the 1960s 'are compatible with domestic survival models' (p. 277).

The biggest headlines during the first four months of 2011 were generated by the triple tragedy in Japan, which left Tokyo (and much of the rest of the world) shaking, especially over nuclear safety. On the Korean Peninsula, Chinese concerns about the ROK/US “enough is enough” (over?)reaction to North Korean aggressiveness resulted in Beijing's acknowledgment that the road to a solution must run through Seoul, providing a new foundation for a resumption of Six-Party Talks. Meanwhile, elections among the Tibetan diaspora began a long-anticipated political transition, shaking Chinese policy toward the province. More fighting between Thailand and Cambodia over disputed borders has rattled ASEAN as it challenges the most important of its guiding principles – the peaceful resolution of disputes. Economic developments all highlighted growing doubts about the global economic order and the US leadership role. It's easy to predict the biggest headline of the next four month period: "Bin Laden is Dead!" Implications for Asia will be examined in the next issue; initial reactions were predictable.

The earthquake, tsunami, and nuclear disaster that struck Japan March 11 tested the leadership credentials of the Kan government and the alliance coordination during simultaneous crises. With the exception of disconnects in assessing the nature of the nuclear emergency at the Fukushima Daiichi plant, the March 11 tragedy revealed the strength of the alliance as the Obama administration demonstrated US solidarity with Japan by announcing a partnership for reconstruction to support Japan's recovery. Prime Minister Kan reshuffled his Cabinet for the second time and unveiled a policy agenda aimed at “the opening of Japan” but faced scrutiny for failing to usher budget-related legislation through a divided Diet. Bilateral diplomacy proceeded apace and was aimed at advancing economic and security cooperation, though a controversy over alleged remarks about Okinawa by a senior US diplomat had the potential to cause another crisis in the alliance.

High-level contacts between the US and Chinese militaries resumed in January with a visit by Defense Secretary Robert Gates to China. Immediately following his trip, President Hu Jintao traveled to the US for a state visit. The occasion combined informal discussion with all the protocol trappings of a state visit by a leader from an important country. Both countries exerted great efforts to ensure the visit's success, which put the bilateral relationship on more solid footing after a year that was characterized by increased tensions and discord. At the invitation of Secretary of State Hillary Clinton, State Councilor Liu Yandong made a week-long visit to the US in mid-April. China held its annual “two meetings” – the National People's Congress and the Chinese People's Political Consultative Congress – and endorsed the 12th Five-Year Plan for National Economic and Social Development.

The US and South Korea continued strong solidarity and close policy coordination on North Korea in early 2011. The US made repeated calls for North Korea to improve its relations with South Korea and show sincerity about denuclearization. The Hu Jintao visit to the US in January paved the way for the first inter-Korean talks since the Yeonpyeong shelling, although they collapsed as the two Koreas could not resolve their dispute over the sinking of the Cheonan. Meanwhile, the US and South Korea agreed to pursue a UNSC Presidential Statement that would denounce North Korea's uranium enrichment program. Possible resumption of US food aid and Jimmy Carter's Pyongyang visit were new variables, although neither brought any change. The KORUS FTA looks near its long-awaited passage in the Congress. With both the Obama and Lee administrations making final efforts to clear all political barriers , it appears that the measure will be passed in both countries in the coming months.

9561. US-Southeast Asia Relations: Dismay at Thai-Cambodian Skirmishes

Both the US and ASEAN expressed dismay at border skirmishes between Thailand and Cambodia around the Preah Vihear temple and two other ancient temples about 160 km to the west. Artillery exchanges and small arms fire call into question the two countries' commitment to the ASEAN rule of the peaceful settlement of disputes among its members. Washington has promised to aid Philippine maritime capabilities to patrol both its South China and Sulu Seas' territorial waters as part of a larger US goal of keeping Asian sea lanes open. New ships and radar installations as well as navy and coast guard training are being provided by the US. In Indonesia, the US embassy inaugurated a new public diplomacy program, @america, an interactive information technology site designed to demonstrate the breadth of American life to Indonesia's tech-savvy young people. Wikileaks releases of US embassy cables published in the Australian press critical of President Yudhoyono caused some tension between Jakarta and Washington. As the current ASEAN chair, Indonesia seemed to follow Secretary of State Clinton's call for an ASEAN role in resolving the South China Sea islands dispute. US relations with Vietnam and Cambodia continue to be strained over human rights concerns. While ASEAN has called for the lifting of economic sanctions on Burma since its recent national election and the release of Aung San Suu Kyi from house arrest, Washington seems in no hurry to follow suit, labeling the election as fatally flawed and noting that political prisoners remain in jail. Finally, the US promised high-level participation in ASEAN-led regional organizations, including the ARF, the ADMM+, APEC, and the EAS.

Following last year's strong Chinese criticisms of US and regional moves seen directed against Chinese policies in Southeast Asia, the reassuring message of good neighborliness and cooperation that Chinese leaders and commentary reverted to at the end of 2010 continued into 2011. The shift was reflected through more positive attention to Southeast Asia and other neighbors, seeking to advance extensive Chinese engagement, especially rapidly growing economic interchange, while endeavoring to play down differences over territorial disputes and other questions. Wariness remained over US policies and practices, but disputes were registered less frequently and in less strident tones than in much of 2010. The treatment was consistent with the improvement in China-US relations registered in Chinese commentary coincident with the prelude and aftermath of President Hu Jintao's January visit to Washington.

The Cross-Strait Economic Cooperation Committee held its first meeting in February, an important step in implementing the Economic Cooperation Framework Agreement. Both Beijing and Taipei believe this year will see steady consolidation of cross-strait relations, but few new agreements. The backdrops of this modest prospect are the leadership transitions underway on both sides of the Taiwan Strait. Evidence of PLA modernization confirms that military capabilities threatening Taiwan continue to increase, confronting Washington with difficult decisions on arms sales to Taiwan.

The first four months of 2011 saw no real improvement in relations between the two Koreas. Their sole official contact, military talks in February, broke up in acrimony after two days. A slight easing of South Korea's aid restrictions in April was in response to dire humanitarian need in the North, and probably does not indicate a wider thaw. There was the hint of back-channel talks, but no progress. The obstacles are familiar. Pyongyang's peace offensive as the year began did not impress Seoul as it failed to deal with two stumbling-blocks: the sinking of the Cheonan and the shelling of Yeonpyeong Island. The North continues to deny all responsibility for the former and insists it was provoked into the latter. This appears to be a recipe for stalemate, perhaps for the rest of Lee's presidency, which ends in February 2013 – although in Korea surprises are always possible.

In the aftermath of North Korea's artillery shelling of Yeonpyeong Island on Nov. 23, 2010, Chinese officials showed great concern about the possibility of escalation, focusing special concern on the possibility that South Korean military exercises might lead to military escalation. The January summit between Presidents Hu and Obama served to reduce tensions to some degree, especially through a call for resumption of inter-Korean talks in the US-China Joint Statement released at the summit. Following the apparent stabilization of inter-Korean relations, China has stepped up calls for "creating conditions" for the resumption of Six-Party Talks, engaging in diplomatic exchanges with both Koreas, including meetings between Special Representative for Korean Peninsula Affairs Wu Dawei and ROK nuclear envoy Wi Sung-lac on Feb. 10-11 in Beijing and again on April 26 in Seoul, and through DPRK Vice Minister Kim Kye Gwan's meetings in Beijing with Wu Dawei, Foreign Minister Yang Jiechi, and Vice Foreign Minister Zhang Zhijun respectively in mid-April in China. Although South Korea in April agreed to China's proposed "three-step" process toward restarting Six Party Talks – (1) Inter-Korean, (2) US-DPRK, and (3) Six-Party Talks – this plan makes the resumption of multilateral talks depend most critically on reaching consensus on the preconditions for inter-Korean talks, which remain stalled since a preparatory meeting for inter-Korean defense ministers' talks broke down in February.

Old problems – the Senkaku fishing boat incident, the East China Sea, and China's increasing maritime activities in waters off Japan – persisted in early 2011. Efforts by Japan to keep lines of communication open with China's leadership included a visit to China by members of the Diet and Japan's senior vice minister for foreign affairs. The China-Japan Strategic Dialogue resumed in Tokyo at the end of February. Less than two weeks later, the March 11 earthquake and tsunami hit Japan. China responded by providing emergency assistance and sending a rescue and medical team. Prime Minster Kan personally thanked China's leadership and the Chinese people for their assistance, support, and encouragement. The Asahi Shimbun offered the hope that the crisis could provide a fresh start in Japan's relations with its Northeast Asian neighbors.

China-Russia economic relations were “reset” on New Year's Day 2011 when the 1,000-km Skovorodino-Daqing branch pipeline was officially opened. The pipeline, which took some 15 years from conception to completion, will transport 15 million tons of crude annually for the next 20 years. The low-key ceremony marking the launch of the pipeline at the Chinese border city of Mohe was followed by several rounds of bilateral consultations on diplomatic and strategic issues in January. In March and April, Moscow and Beijing sought to invigorate their “joint ventures” – the Shanghai Cooperation Organization (SCO) and the Brazil, Russia, India, China (BRIC) forum – at a time when both Moscow and Beijing feel the need for more coordination to address several regional and global challenges and crises.

In the analysis of the media landscape and media reporting on political candidates in Bosnia and Herzegovina during the 2010 general election campaign, it was noticed that major media were affiliated to various political groups and openly advocated for or riled against voter choices. As a result, the media market of the country is characterized by a high level of segmentation between media which exclusively advocates a nationalist position and media which maintain a 'civic' orientation. These media organizations, according to their orientation, favor certain personalities that are deeply embedded in the favored national, cultural, or religious position. This paper examines the role of opinion leaders who represent dominant ethno-political groups in BiH via the dissemination of media messages during the preelection campaign.

This article analyses President Yar'Adua's health crisis, defined not only in medical terms, but also the “cabalic” politicisation of his unconstitutional absence from duty, and the attendant unconstitutional efforts to sustain an absentee presidency. These efforts were sustained through lies, propaganda, threats and constant violations of the constitution, which refreshed the centrifugal tendencies of the country to a dizzying height. The article also evaluates the role of various actors in the management and mismanagement of the crisis. The case illuminates the complexity of democratic transitions, showing simultaneously the reality and limits of neopatrimonialism under a hybrid regime. The important lesson is that in the face of regimethreatening development as the case illustrated here, a vibrant and united civil society can make a significant difference.

In 2004 the government of Tanzania introduced the Loans Board in order to manage funding for students in higher education. The main goal of this board is to identify poor and needy students so as to assist them in accessing higher education. This article examines the key instruments in providing loans to students, that is, the Higher Education Student's Loans Board Act No. 9 of 2004 and its related regulations and how they impact the access to education. Based on interviews, documents, and newspapers it is argued that the Loans Board has failed to meet its grand objective. Instead, it has turned to be a mechanism for limiting poor and needy students' access to higher education.

In the aftermath of the Second World War, right-wing movements were a synonym for genocide and racism and a dark stain on the history of Europe. Scholars such as George Mosse, Roger Griffin or Eugene Weber have tried to explain the roots and causes of this phenomenon in order to prevent its reoccurrence. Nevertheless, a few decades later, extremist groups have begun to take over European politics, in spite of the supposedly learnt lessons of the past. What are the legacies, if any, of the former fascist movements and what are the new features of these parties? To what needs do they respond, who is their public and by what means is their message conveyed? Illiberal Politics in Liberal Times tries to provide an answer to these questions, as it focuses on the rightwing movements through the lens of Europeanization and political culture. They have so far been analyzed from various perspectives, but mainly as arising from expected events and relying only on their inner constituencies to act upon domestic and foreign policies.

After the end of the Cold War imperialism in the form of neoliberalism exerts its hegemony over the entire world. Under what came to be known as the “Washington Consensus”, which emphasizes liberal democracy, market economy and foreign capital investments, the U.S sought to enhance and consolidate its access to cheap natural resources and raw materials from Latin America, thereby capitalizing its domination over the region. Challenging the neoliberal paradigm, the masses in Latin America developed a series of social movements to protest this form of foreign domination. At the beginning of 2010, the State of California in the throes of fiscal crisis decided that it will open its prison doors to some 6,500 prisoners from its bloated penal system, the largest in America. Yet the savings from this endeavor will only put a small dent in the ballooning budget that is forecasted to continually swell over its current $8 billion price tag and will devour an even greater proportion of its state budget on top of the 11 percent it already consumes next year. As for next steps, the governor proposes handing prisons over to private contractors and opening up a US prison in Mexico for illegal immigrants. None of the plans include reducing judicial sentencing or increasing funds for rehabilitation and counseling for the growing prison population. At the same time, the state legislature continues to slash welfare and education expenditures as Governor Arnold Schwarzenegger proposes to completely eliminate the state's welfare program for families, medical insurance for low-income children and Cal Grants cash assistance to college and university students. The proposals would completely reshape the state's social service network, transforming California from one of the country's most generous states to one of the most tightfisted, while the release of a few prisoners does nothing to curb the sentencing structures that continue to overcrowd the state's penitentiaries.

The relevance of institutions for the economic analysis is a theoretical core issue within contemporary debate. Mainstream neoclassical economics, in fact, has traditionally considered institutions as a peripheral element: they are constraints, which can interfere with market outcomes, but that nevertheless are mainly irrelevant in understanding the inner mechanisms of markets. On the contrary, within the Institutional Economics, and later the New Institutional Economics (NIE) many scholars has tried to support the idea that institutions are the crucial element which explains economic performances: moulding actors preferences and behaviour, institutions directly affect each element of economics theory. In their analyses NIE scholars draws from various scientific disciplines, like political science, cognitive theories, social psychology and sociology: they make an attempt to abandon the thrifty descriptions produced by mainstream economists, giving a much broader insight in economic dynamics. At the same time, they try to outline an empirical description of market's configuration. In the last two decades NIE has gained considerable relevance and scientific recognition: first Ronald Coase, in 1991, then Douglass C. North in 1993, and finally Oliver E. Williamson and Elinor Ostrom who, in 2009, won the Nobel Prize for Economics. Despite this, NIE is still usually referred as a heterodox scholarship.

The post-Cold War endeavor not to take for granted the fundamental concepts in security studies that realism and its kinds had simply presumed, found its resonance in the study of Turkey's foreign and security policy. The scholarly engagements on that subject embracing a constructivist approach to security studies, or inspired from critical security studies, have recently proliferated. Malik Mufti's Daring and Caution in Turkish Strategic Culture, Republic at Sea, adds to that suite by introducing the concept of strategic culture, a concept that has hitherto been poorly explored in previous studies on Turkey. In it, Mufti aims to explain the peculiar way in which Turkish security policymaking actors throughout the Turkish Republic perceive their external environment and conceive of what constitutes the most proper way to respond to the threats they subjectively perceive. In doing so, he also hopes to offer insights into some of the ongoing debates in the strategic culture literature.

There may be no simple answer to why governments increasingly promote the participation of faiths in the design and implementation of public policies. For Adam Dinham, the “imperatives driving an interest in faith” are threefold: governments see faiths as a repository of resources (“buildings, staff, volunteers and relationships”), as a potential means of fostering “community cohesion,” and as part of a broader “extension of new forms of participative governance” (p. 5-6). The focus in Faith, Public Policy and Civil Society is on such matters in the UK over the past decade or so, and the attention he periodically pays to the US and Canadian cases is usually not much more than passing reference. They are useful and generally insightful references, typically helping to elucidate one aspect or another of the issue under consideration, but readers needing a thorough-going and systematic comparative study will need to turn elsewhere. But that's not to suggest that those with interests outside the UK will not find much to value in this volume, and it should surely be required reading for those invested in “faithbased” service provision and political participation in the UK.

Perhaps the most misleading platitude that one hears all too often in discussions of the contemporary rise of piracy off the Horn of Africa is that piracy has been around since the beginning of recorded history. On the surface, the statement is of course true. But this truth comes at the tremendous price of conceptually flattening differences between diverse social and historical situations into a one dimensional legal category, thereby obfuscating the genealogy of a concept and a figure that has been formative to the history of nations. One of the most discussed aspects of the so called democratic deficit of the EU is the lack of a European public sphere. The Union's democracy is perceived by its citizens as Schumpeterian in nature and this perception corresponds to a large extent to reality. Schumpeter described democracy as the rule of the politician, who gains decision making power in the free competition over votes. The parliament's role is of minor importance; it decides more by acceptance than by initiative. Citizens can neither bring up the issues nor decide them. The European Union is indeed an ideal platform for such a model, be - cause it is elitist, technocratic and rather complicated for the ordinary citizens. European integration was and still is an elite-dominated project, where citizens do not have many possibilities to intervene during legislation-periods. Over many years, the consensual behaviour of the political elites hindered the emergence of broad debate and of conflict in a European public sphere. As a consequence, scepticism towards the integration process became stronger in the Member States. At the beginning of the new millennium, politicians tried to turn the table by stressing the importance of the involvement of the citizens. A convention was installed to work out a Constitutional Treaty. But once again, the debate remained elite-dominated. The heads of governments finally signed another elitist compromise without the broad involvement of the citizens. The rejection of the Constitutional Treaty in France and the Netherlands in 2005 can thus be considered as the result of an elitist and Schumpeterian model of democracy which is perpetuated by the new reform treaty of Lisbon. Thus, the claim for a European public sphere remains relevant, although scholars differently define such a sphere. The argument of this paper is that besides the often claimed Europeanization and transnationalisation of European debate, the notion of broad conflict is of high importance for the emergence of a European public sphere.

Authorities in belligerent countries are now faced with a new problem: modern warfare and natural disasters. Between 2001 and 2010, four relatively publicized adoption related cases have caused some Third World countries to revitalize their concerns over the rights of children in such cases of adoption, mainly the New Life Children's Refuge (NLCR) in Haiti, the Zoe's Ark in Chad, the Katherine Hart case in Southeast Asian countries, and the twelve United States adoptive parents' case in Cambodia. The thesis of this paper is that there are systemic vulnerabilities and gaps in the current global adoption systems across the Third World Countries, thus creating irregularities and scandals that are predictable to an extent, such as the ones in the four cases under consideration. An investigation will be made as to some of the lessons that can be drawn there from. In the end, this paper concludes by highlighting that, although the four do not hint at the full picture of complications that may arise as a result of global adoption in their corresponding regions, they do, indeed, bear important ramifications, ones that are ignored at the cost of the well-being of children involved.

This paper analyzes the main intuition behind the concept of Regional Innovation System (RIS) and the corresponding policy implications in a literal notion. The aspects that are the reasons of regional disparities in terms of innovation such as clusters, agglomerations, research and development (R) will be investigated via observing whether development agencies, clusters, industrial zones and universities which overall are contributing factors in regional development exist or not. Aligned with these aspects, this paper analyzes the reasons for the disparities between regions. Consequently, policy approaches and innovation strategies towards the regions that are distinguished due to disparities (as peripheral, metropolitan and industrial regions) will be presented. The following will constitute of the analysis of Turkey's Aegean, Marmara, East Anatolia and Southeast Anatolia regions with respect to the results reached in the prior analysis. The objective is to investigate the characteristics of the corresponding regions and determine the aspects for the developmental gap between them. The policy applications regarding regional innovation systems, the effects of universities in the mentioned regions and the adopted policies within the process of EU membership are presented. The literal analysis indicates that although in the recent years there have been improvements regarding regional development, previously it has been the western regions that received the most attention. These findings could be verified in a further research with a thorough statistical analysis using regional data on labour productivity, capital investment, expenditure on R, registered patents and economic growth.

This paper attempts to analyze Turkish politics in the post-1980 period with a special reference to the relationship among the state elites, political elites and societal actors, and its impact on the constitution of civil society in Turkey. After the 1980 military intervention, the political and economic realms of Turkey witnessed a relative degree of liberalization through Özal's neo-liberal policies. The January 24 economic decisions paved the way for economic liberalization as well as letting new economic and societal actors emerge. These new economic actors were different from the prevailing economic actors which used to enjoy a considerable amount of opportunity spaces in the economic sphere. Together with the Özal governments, Islamic segments started to become powerful in both political and economic realms. This paper analyses the chief traits of Turkish politics and economics and their impact upon civil society aftermath the 1980 coup in general, and the relationship and/or interaction among the state elites, political elites and societal actors in particular. The engagements of newly-emerging societal and economic actors into Turkish political scene and the challenge of these actors against the so-called “Kemalist-Republican” elites are also illustrated in the paper. Moreover, state-Islam interaction, politics-Islam interaction as well as Kemalism-newly-emerging societal and economic actors interaction will be studied with a special emphasis to the post-1980 period. The major argument of the paper is that, in Turkey, both civil society issues and political issues reveal outcomes which are primarily shaped by the nature of the relationship between state elites and political elites in general and by Turkish political culture in particular.

Within the coming year, the American led-NATO mission will begin withdrawing troops from Afghanistan. Though the decrease in troop levels in the short-term has been expected, the final date wherein all American and NATO troops leave the country is still a matter of heated debate, primarily for two reasons: the inconclusive steadiness of the present Afghan regime and the uncertainty of what a post-withdrawal Afghanistan would like. With this in mind, this article intends to explore both the logic of NATO intervention and the subsequent occupation of that war-torn country. It examines the primary reasons why stability and progress within Afghanistan have been elusive, the current debate amongst policy makers regarding the steps ahead, and finally proposing an alternative model that proposes a new US and NATO regional strategy that places the burden on Afghanistan stability and reconstruction on neighbors who share the larger NATO goal of a self-sufficient and stable Afghan government. Accordingly, the most potentially successful NATO approach towards Afghan stability would adopt the proven economic, social, political, infrastructural, and local governance models of regional states, and honing and adopting those models into the broader Afghan domestic theatre. For this to happen, a new plan of cooperation from both NATO and American policy makers with regional states and their respective civil societies needs to be constructed and implemented.

On August 4, 1995, Croatian troops launched Operation Storm, a military action to gain control of the land occupied by Serb forces. The operation displaced some 200,000 Serbs from Croatia's Krajina region, but concluded the Croatian war, which started in 1991. The Arab world has been changed irreversibly by the popular uprisings that started in early 2011. The long period of dormancy that enveloped the Arab world has come to an end. The uprisings have been triggered in all countries by similar mixes of economic hardship and lack of civil and political rights. But we should not expect the uprisings to lead to similar changes in all countries. Already, three different patterns are emerging. In Tunisia and Egypt, the presidents have been overthrown by members of their own regime, including the military; they are now trying to limit the extent of change and to transform a potentially revolutionary process into one of reform from the top. In Yemen and Libya, the challenge to the leaders has turned into a challenge to the survival of the state itself: the two countries have no institutions that can persist if the presidents are ousted. In other countries affected by protest, the regimes have been trying to subdue the protest through a mixture of populist concessions, cautious reforms introduced from the top, and the occasional use of force.

There has been strong concern about the direction of the current revolts in the Middle East. The fear has been that the revolts may result in the Iranian-style Islamic revolutions in the Arab countries. This commentary questions the empirical validity of such claims, showing that the Arab revolts differ considerably from the Islamic revolution in ideology and trajectory. It suggests that we are witnessing the coming of a post-Islamist Middle East, in which the prevailing popular movements assume a postnational, post-ideological, civil, and democratic character. It is, therefore, argued that we are entering a new era in the region where Islamism—undermined by a crisis of legitimacy for ignoring and violating people's democratic rights—is giving way to a different kind of religious polity, which takes democracy seriously while wishing to promote pious sensibilities in society.

Abstract:
The democratic uprisings in North Africa and the Middle East have been widely celebrated but in the West they have generated concern and apprehension. Most of this concern involves the future role of religion in the politics of the Arab world. In this essay, I make two broad observations. First, concern in the West about the rise of mainstream Islamist parties is partly based not on the illiberal orientation of these groups but the fact that they are politically independent actors who challenge Western geo-strategic interests in the region. Second, the role of religion in government has never been democratically negotiated en masse in the Arab world. To assume that this issue has been resolved and a broad consensus exists is to project a Western understanding of religion-state relations on the Arab-Islamic world. Doing so is both erroneous and analytically distorted. The battles over the role of religion in politics have yet to begin in the Arab world.
