301. British Colonial Policy and the Persian Gulf Islands

Abstract:: In the aftermath of the visit of the Iranian President to the Island of Abu Musa on 11 April 2012 and the uproar that followed, a fresh look at the issue is warranted. The concern of this paper is not to discuss the three Islands of Abu Musa and the Tunbs, but to briefly review the context which gave rise to the issue of the three islands in the first place and influenced its development to date. The paper tries to place the current controversy surrounding the three islands in its historic perspective, explaining how it grew out of antagonism that marked the relationship between the prevailing global power, Great Britain, and the major regional power, Iran, for 170 years. It aims to address the general policy of Britain during its presence in the Persian Gulf, which aimed in part to control all islands of this waterway. It explains how for 170 years, Britain tried to erode Iranian influence in the Persian Gulf, both directly by asserting its colonial rule over Iranian islands and port districts, and indirectly by claiming Iranian islands for its protégés on the Arab littoral. It shows that this tactic applied to almost all other Iranian islands in one way or another and was not limited to the three islands of Abu Musa and the Tunbs.

302. Global Poverty and the Limits of Academic Expertise

Abstract:: Academics are not a natural kind. They have varied expertise and aims, and most have no expertise that is particularly relevant to problems of poverty and development. This presumably is why the essay in this issue by Thomas Pogge and Louis Cabrera-a virtual "manifesto" of the newly formed Academics Stand Against Poverty (ASAP)-shifts to and fro between addressing "academics" and addressing "poverty-focused academics." Even those academics whose work touches on poverty and development-a quite small minority-are mostly expert in some but not in other aspects of these topics. Some are expert in international law, but not in economics; others know about international trade, but not about aid; some study corruption, but know nothing about nutrition-and so on. A few know a lot about normative argument, but their credentials are sketchy when it comes to empirical evidence. Many more are interested in empirical evidence, usually of a specific sort, but are uncritical of or confused about normative argument. (I suspect that many suffer from a lingering positivist hangover, which suggests that there is no intellectually respectable way to support normative claims, and indeed that this fear may lie behind the appeals to the importance of academic neutrality that Pogge and Cabrera discuss.)

Abstract:: The world is marked by very great poverty and inequality. The lives of many of our fellow inhabitants of this planet are blighted by malnutrition, disease, and destitution. Yet mass suffering is often met by casual indifference or acceptance, and sometimes even by active support of the status quo. While tragedies occur elsewhere in the world, the vast majority of us continue in our daily tasks and, in the words of W. H. Auden, turn away " quite leisurely from the disaster. " It is in response to this reality that Academics Stand Against Poverty (ASAP) asks: What, in light of mass poverty, are the responsibilities of academics?

304. "Small Is Beautiful": Lessons from Laos for the Study of Chinese Overseas

Abstract:: During the colonial period, Laos welcomed the smallest overseas Chinese communities in Southeast Asia, communities that almost disappeared after the communist forces seized power in Laos in 1975. Yet, this landlocked country shares a long history with China and even experienced a Golden Age thanks to the thriving caravan trade between Yunnan and mainland Southeast Asia. The Greater Mekong Subregion initiative, a development programme launched by the Asian Development Bank, has revitalized these historical trade routes, causing thousands of Chinese migrants to pour onto the new roads of Laos, channelled through the North–South Economic Corridor linking Kunming to Bangkok. Depicted as “an army of ants” that plunders the natural resources of this poor country, these Chinese migrants are also the main drivers of development. The paper seeks to examine the specificity of China's engagement in Laos. I suggest that this small and forgotten country can provide insightful lessons to better understand the current changes taking place in Chinese migration worldwide.

305. Development vs. Environment in Taibei

Abstract:: Although Taiwan arguably needs civil and official collaboration non environmental protection, the implementation of an efficient system of environmental regulations has often been hindered by the many actors involved in the process of environmental governance (state, economic actors, civil society, media), whose interests are divergent. Consequently, there is no uniform, homogeneous authority for environmental governance but rather a variety of official and less official agents of authority whose interests and powers overlap and compete. In this paper we will introduce a case study dealing with the controversy surrounding the construction of an alternative road connecting Danshui with Taibei City (namely, the Danshui North Shore Road Project, Danbei daolu) to elucidate what the key influences are that govern environmental power dynamics between different agents with conflicting (or, sometimes, colluding) interests and how these multiple levels of interaction are negotiated by the various players. Our hypothesis holds that although environmental policies are, for the most part, mandated from the top, at the local level their implementation can be bypassed, altered or stalled by these various agents.

We have established a diverse editorial team of scholars from Europe and North America linked first by a commitment to publish highest quality scholarship in international relations (IR) and development, broadly conceived, regardless of substantive or methodological focus; and second by a common awareness of the contribution the Central and East European (CEE) experience can make to the study of international politics. We envision the JIRD as a globally relevant journal with a CEE touch. This does not mean dealing primarily with CEE themes, although the region will naturally remain more strongly in focus than in comparable IR journals. More profoundly, it means nurturing both CEE IR scholarship and also the broader transnational scholarly context in which it develops.

Abstract:: Korea’s economic development since the 1980s has occurred in the context of capital controls and a strong governmental role in achieving sustained growth. The experiences of two financial crises—the Asian financial crisis (1997–98) and the global financial crisis (2008–09)—confirm the impression of a highly responsive state, although different pictures emerge as to how the Korean government sought to abolish or deploy capital controls in accordance with global consensus and intellectual trends in international political economy. Contrary to the policies of financial liberalization by the Korean government in the aftermath of the Asian financial crisis, the Korean government shifted to a policy direction favoring capital controls following the global financial crisis, as seen in recent Group of 20 proclamations. However, given the necessity of capital inflows for an outward-oriented economy such as Korea’s, which is heavily dependent on foreign capital inflows for investment, it is questionable to what extent Korea can effectively take advantage of capital controls, what the goals of such controls should be, whether there will be strong political backing for implementation of such policies, and what political risks the current government faces in implementing new capital controls. This paper seeks to provide answers to these questions by examining Korea’s initiatives for capital controls in light of its history and the surge of capital inflows to emerging market economies since the global financial crisis.

316. Under the Influence of Buddhism: The Psychological Wellbeing Indicators of GNH

Abstract:: Measuring human well-being is important in determining whether people’s lives improve or worsen over time. Today many countries focus on Gross Domestic Product (GDP) as a basis to measure economic well-being, but focus on economic growth fails to capture the overall well-being of the people (Kusago 2007; Stiglitz, Sen, and Fitoussi, 2009). Alternative measurements such as Genuine Progress Index (GPI) and Human Development Index (HDI) have been introduced to measure the non-economic aspect of well-being. GPI and HDI include important factors that contribute to healthy living but are still calculated based on monetary values (Hargen 2002; Kusago 2007). Gross National Happiness (GNH) is the central development philosophy of Bhutan (Planning Commission 1999). This unique philosophy aims at maximising well-being and minimising suffering by balancing economic needs with spiritual and emotional needs. Bhutan’s fourth king, Jigme Singye Wangchuck, coined the term “Gross National Happiness” in the late 1980s arguing that “Gross National Happiness is more important than Gross Domestic Product” (as cited by Ura 2008, para.1). His vision was to create a GNH society: “an enlightened society in which happiness and wellbeing of all people and sentient beings is the ultimate purpose of governance” (as cited by Ura 2008, para.2).GNH is premised on the notion that happiness pursued and realised within the context of the greater good of society offers the best possibility for the sustained happiness of the individual. Yet, society as a whole cannot achieve happiness if individuals compete irresponsibly for it. To this end, GNH recognises that happiness ought to be realised as a collective goal; it cannot be left as an individual goal: “GNH stresses collective happiness to be addressed directly through public policies in which happiness is an explicit criterion in projects and programmes” (Thinley 2005, p.7). If a government’s policy framework and its goals are adverse to happiness, happiness will fail as a collective goal (Ura 2008). In the GNH context, a government concerned with the happiness of its citizens must create an enabling environment for people to achieve happiness. The Bhutan-Vision 2020 strongly reaffirms the notion of Gross National Happiness as the central development concept for the country.

LIMITED PREVIEW | PURCHASE FULL 16 FEBRUARY As the quarter opens, Israel maintains a tight siege of Gaza aimed at unseating the governing Hamas authority, in control since 6/2007. The Israel Defense Forces (IDF) enforces a 300-m deep no-go zone inside the full length of the Gaza border and limits the Palestinian fishing zone off Gaza to 500–1,000 m off the immediate Bayt Lahiya and Rafah coasts, and 3 naut. mi. elsewhere—restrictions that place 17% of Gaza's total landmass, including 35% of its viable agricultural areas, and 85% of the maritime areas allocated to the Palestinians under the Oslo accords off limits to Palestinians. In the West Bank, governed by the Fatah-led Palestinian Authority (PA), IDF operations and restrictions on movement and access continue but are relatively low. In the West Bank, the IDF patrols in Tulkarm before dawn and in Birzeit late at night; conducts late-night arrest raids, house searches nr. Nablus. Major clashes between govt. forces and protesters seeking regime change are reported in eastern Libya, while modest demonstrations in Yemen call for the president to step down. From this point, large antigovernment protests (1,000s to 10,000s) become nr. daily events. (NYT, WP 2/19; NYT 2/21) 19 FEBRUARY Israeli naval vessels intercept a Palestinian fishing boat off the n. Gaza coast, escort it to Ashdod, confiscate the boat, and release the fishermen. In the West Bank, the IDF patrols in 4 villages nr. Jericho, Qalqilya, Salfit, and Tulkarm in the afternoon, and 1 village nr. Tulkarm late at night. From Ramallah, FCC mbr. Tawfik Tirawi calls for a “day of rage” against the 2/18 U.S. veto; protests denouncing the U.S. are held in Bethlehem, Hebron, Jenin, Nablus, and Tulkarm. For safety, the U.S. consulate in East Jerusalem restricts staff movement for 3 days. (HA, Oxfam International, WP 2/20; PCHR 2/24; OCHA 2/25) In Libya, security forces in Benghazi open fire on some 20,000 mourners leaving funerals of antigovernment protesters killed in recent clashes, leaving at least 84 dead and scores injured and bringing the death toll in 3 days of clashes to as many as 200 dead and nearly 850 wounded in Benghazi alone. British embassy officials say they have received reports of govt. forces using heavy weapons and snipers against protesters. From this point, antigovernment demonstrations and fierce military repression escalate sharply, and opposition groups take up arms. (NYT, WP 2/20; NYT, WP, WT 2/21) 20 FEBRUARY Saying the Fatah-Hamas split has “gone on too long and should not continue,” PA PM Salam Fayyad offers to form an interim national unity govt. with Hamas and not to interfere with Hamas's rule in Gaza in the run-up to elections, if it agrees to take part in presidential and legislative elections in 9/2011. Elements within Fatah denounce the move. Hamas responds with skepticism. Qalqilya and Tulkarm; conducts evening and late-night patrols nr. Qalqilya and Salfit. Jewish settlers uproot 270 olive trees fr. 2 Palestinian plots nr. Nablus. In Ramallah, some 3,000 Palestinians organized by Fatah protest the 2/18 U.S. veto, waving banners and shouting slogans against the Obama administration. (MNA, WP 2/21; PCHR 2/24; OCHA 2/25) 21 FEBRUARY In the West Bank, the IDF tears down Palestinian's tents in Khirbat Tana, where the IDF demolished homes and other structures on 2/9/11 (see Quarterly Update and Settlement Monitor in JPS 159); conducts late-night arrest raids, house searches, and patrols in 6 villages nr. Qalqilya, as well as nr. Bethlehem and Jenin. More than 80 Palestinian nonprofit organizations from the West Bank, Jerusalem, and the Gaza Strip issued a statement calling on Fatah and Hamas to take practical steps toward ending their rift. (MNA 5/23; PCHR 2/24; OCHA 2/25) The Knesset passes the Foreign Govt. NGO Funding Transparency Law tightening requirements on groups that accept foreign funding, widely seen as an effort to undermine left-wing Israeli organizations. (MNA 2/23; WJW 2/24) (see Quarterly Update) After a week of violent clashes, the Libyan govt. has lost control of most of the eastern part of the country to armed antigovernment protesters. Qaddafi responds with overwhelming force, dispatching warplanes, helicopters, special forces, and heavily armed mercenaries (paid and flown in to Tripoli by the planeload in recent days to shore up the regime) to hunt down demonstrators. Fighting has also reached Tripoli, where there are reports of strafing fr. the air, combat in the streets, burning buildings, and looters ransacking police stations. Dozens of senior Libyan officials and diplomats resign in outrage, and widespread defections by the military nationwide are reported. (WP, WT 2/21; NYT, WP, WT 2/22) 22 FEBRUARY In the morning, the IDF makes 2 brief incursions into Gaza to level land along the border fence in s. Gaza to clear lines of sight. IDF troops on the n. In the West Bank, the IDF demolishes 8 tents (home to 40 Bedouin) and 2 wells nr. Suissa settlement outside Hebron; sends some 40 undercover troops into Salim nr. Nablus, where they raid an apartment building and arrest a wanted Palestinian; patrols in and around Tulkarm, in Qalqilya, and in villages nr. Jenin in the morning, summoning 4 Palestinians to appear for questioning; conducts late-night patrols in al-Bireh, Qalqilya, and 2 village nr. Ramallah and Tulkarm. Jewish settlers fr. Bat Ayin nr. Qaddafi vows to hunt down and kill protesters “house by house,” 1,000s of his supporters take to the streets of Tripoli brandishing machetes and join trucks heading to outlying areas to conduct neighborhood searches. With most residents bunkered in their homes and media outlets cut off, the extent of the violence in the Tripoli area is unclear. Rights groups estimate that 519 Libyans have been killed, 3,980 have been wounded, and at least 1,500 have gone missing since violence erupted a wk. ago. Hereafter, fighting quickly devolves into bitter civil war. (NYT, WP, WT 2/23) 23 FEBRUARY Fayyad reiterates his 2/20 national unity offer, saying the PA would forgo further U.S. aid for the sake of national unity if the U.S. went through with threats to suspend aid to the PA if Hamas joined the govt. Abbas and senior Hamas officials agree to discuss the idea. (JPI 3/11) (see Quarterly Update) At Abbas's request, Israel agrees to allow some 300 Palestinians fleeing Libya to enter the West Bank. In Gaza, Islamic Jihad and Hamas mbrs. detonate an explosive device by the border fence as an IDF patrol passes on the Israeli side, then fire 3 mortars at the troops, causing no injuries. Abstract:: Gary Johnson currently campaigns as a candidate for U.S. president with the same outspoken fidelity to free markets, limited government, and fiscal responsibility that guided his two terms as governor of New Mexico. Aside from making headlines earlier this year with his strong opposition to an antihomosexual Republican-circulated marriage pledge, which he called “offensive” and “un-American,” he has been neglected by the mainstream press and has been excluded from several televised debates. He presses on in a struggle from which higher-polling candidates have already dropped out. Johnson started a one-man handyman company in 1976 and over the next two decades developed it to employing one thousand people. Against the odds, he launched his campaign for governor in 1994 and carried his win to a second term, a governorship marked by his stand for “freedom across the board.” During his eight years in office, his main focus was responsible management of the government pocketbook, and he earned the nickname “Governor Veto” by vetoing more bills than the other forty-nine governors combined. He cut twelve hundred state job positions, cut taxes, reformed Medicaid, promoted school vouchers, privatized prisons, and helped eliminate the state's budget deficit. An unconventional Republican, he supports the right to abortion, the legalization of marijuana, and legal equality for homosexuals. Today he retains popularity among New Mexico's voters. Goal-driven, independent, and with a zest for life, he has competed in multiple Ironman Triathlons, summited Mt. Everest, and personally built his current home in Taos, New Mexico. He's a divorced father of two and lives with his fiancée. I spoke with him just before his strong campaign push in New Hampshire at the end of August. —David Baucom David Baucom: Thank you for speaking with me, Governor Johnson. Gary Johnson: Absolutely. DB: With the decline of the U.S. economy and the emergence of the Tea Party movement, people in America are finally asking questions to the effect of, What is the proper role of government? As a candidate for president of the United States, what do you regard as the proper purpose of government? GJ: The proper purpose of government would be to protect you and me against individuals, groups, corporations that would do us harm, whether that's from a property perspective or physical harm. And that would also apply to other countries. DB: Relating to that, how would you define “rights,” and where would you draw the line for what individuals can properly claim as a right? GJ: You know, my definition of it, I guess, is the whole notion that we have too many laws. And that when it comes to rights, that they really have a basis in common sense, that they really have a basis in natural law, if you will. Do unto others as you would have others do unto you. That government gets way, way, way too involved in trying to define that, as opposed to you and me working that out. DB: President Obama calls for “sacrifice” from everyone, but especially from “rich” individuals and corporations, whose taxes he wants to raise. You've said you don't think raising taxes on the rich is the way to deal with the financial crisis. As president, what would be your solution to the crisis? GJ: Well, I'm advocating the FairTax. I think we should scrap the entire tax system that we have and replace it with the FairTax. I'm talking about FairTax.org, for those who aren't aware of this proposal that I think has been around now for about ten years. By all free market economists' reckoning, it is what it is: it's fair, and it simplifies the existing tax system. So, by “simplify [the] existing tax system,” it abolishes the IRS and does away with all existing federal taxes: income tax, Social Security withholding, Medicare withholding, unemployment insurance, business-to-business tax, corporate tax. Replacing the current system would be a one-time federal consumption tax of 23 percent, which is meant to be revenue neutral, so we would still need to cut our spending by 43 percent, believing that part of revitalizing this country is balancing the federal budget and replacing it with the FairTax. . . .

Abstract:: International relations (IR) studies in China have developed considerably over the past three decades. The field is now well established with 49 degree-granting institutions, as well as a series of 'think tanks' that produce policy-related analyses of international issues. Recent survey research of publication trends in the field reveals a significant new diversity of research subject areas, with an increased emphasis on topics associated with Western 'liberal' IR theory and international political economy, while at the same time revealing a tenacity of 'realist' topics such as major power relations. While the quantitative dimensions of the field have grown dramatically – institutions, faculty, publications – the overall quality of research remains very uneven across China and generally weak when compared internationally. Abstract:: Colin Dueck's superbly written history of Republican American presidents since the end of World War II is a fine introduction to American conservatism and American presidential politics alike. Most historians and political scientists focus their attention on a single administration and try to describe changes within a single or between two or three consecutive administrations. That is quite fine of course, but what is often missing is the evolution in a particular brand of a political party's approach to a specific area over a prolonged period of time, a longue durée so to speak. This lack of attention to changes in the long run has contributed to the misperception that there is one Republican or Democratic angle to foreign affairs. Dueck therefore tries to complement the history by focusing on the evolution of Republican foreign policy over the past six decades and though the book's title suggests a consistent Republican approach to foreign affairs, he excels in describing the different angles by which American Republican presidents have perceived international relations and formulated their policies. The author does not hide his general sympathy for a conservative stance on foreign policy but manages a critical evaluation where it is being called for. The book's narrative does not necessarily add anything new to the existing body of research, but it is, nonetheless, a rather apt description of American conservative thought and Republican politics alike. Dueck brilliantly conflates the recent history of political thought, the emergence of new and powerful lobbies, party and domestic politics, and public diplomacy with the performance of Republican presidents. And wherever convenient Dueck pays sufficient attention to developments on the side of the Democratic party as well.

Abstract:: From post-World War II decolonization to establishing order in war-torn polities today, external intervention can play an important role in fostering sovereign statehood in weak states. Much attention in this regard emphasizes local reactions to outside pressures. This article augments these perspectives by drawing attention to ways that foreign actors may affect the development of sovereignty through their efforts to work with various domestic groups. Structured comparisons of China and Indonesia during the early to mid-twentieth century suggest that active external intercession into domestic politics can collectively help to shape when and how sovereignty develops. As these are least likely cases for intervention to affect sovereign state making, the importance of foreign actors indicates a need to reconceptualize the effects of outside influences on sovereignty creation more broadly.

Abstract:: December marks the 20th anniversary of the end of the Soviet dictatorship and the beginning of Russia's postcommunist transition. For Russians, the intervening years have been full of elation and promise but also unexpected trouble and disappointment. Perhaps of all the painful developments in Russian society since the Soviet collapse, the most surprising -- and dismaying -- is the country's demographic decline. Over the past two decades, Russia has been caught in the grip of a devastating and highly anomalous peacetime population crisis. The country's population has been shrinking, its mortality levels are nothing short of catastrophic, and its human resources appear to be dangerously eroding. Indeed, the troubles caused by Russia's population trends -- in health, education, family formation, and other spheres -- represent a previously unprecedented phenomenon for an urbanized, literate society not at war. Such demographic problems are far outside the norm for both developed and less developed countries today; what is more, their causes are not entirely understood. There is also little evidence that Russia's political leadership has been able to enact policies that have any long-term hope of correcting this slide. This peacetime population crisis threatens Russia's economic outlook, its ambitions to modernize and develop, and quite possibly its security. In other words, Russia's demographic travails have terrible and outsized implications, both for those inside the country's borders and for those beyond. The humanitarian toll has already been immense, and the continuing economic cost threatens to be huge; no less important, Russia's demographic decline portends ominously for the external behavior of the Kremlin, which will have to confront a far less favorable power balance than it had been banking on.

Reviewed by Loribeth Kowalski Parents in America typically tell their children that they can be anything they want to be when they grow up, and children tend to believe it and explore the countless possibilities. I recall my own childhood aspirations: imagining myself as an archaeologist, wearing a khaki hat and digging in the desert sun; as a veterinarian, talking to the animals like Dr. Doolittle; as a writer, alone at my desk, fingers poised over a typewriter keyboard. Recently I found an old note in a drawer. It said, “When I grow up, I want to be a doctor. I want to save people. When I grow up, I WILL be a doctor.” Underneath my signature I had written “age 10.” Unfortunately, in today's America, a child cannot be whatever he wants to be. Leave aside for the time being the difficulties involved in entering a profession such as medicine. Consider the more man-on-the-street jobs through which millions of Americans seek to earn a living, support their families, and better themselves. Suppose a person wants to drive a taxi in New York City. To do so, he will first have to come up with a million dollars to buy a “medallion.” If he wants to create and sell flower arrangements, and lives in Louisiana, he'll have to pass a “highly subjective, State-mandated licensing exam.” If he wants to sell tacos or the like from a “food truck,” and lives in Chicago, he had better keep his business away from competing restaurants, or else face a ticket and fine. And a child doesn't have to wait until he's an adult to directly experience such limitations on his freedom. Last summer, authorities in various states shut down children's lemonade stands because they didn't have vending permits or meet other local regulations. In today's America, it is increasingly difficult to enter various professions, near impossible to enter some, and, whatever one's profession, it is likely saddled with regulations that severely limit the ways in which one can produce and trade. Timothy Sandefur explores and explains these developments in The Right to Earn a Living: Economic Freedom and the Law. Sandefur addresses this subject in the most comprehensive manner I've seen, surveying the history of economic liberty from 17th-century England through the Progressive era in America and up to the present day. He shows how the freedom to earn a living has been eroded in multiple ways throughout the legal system, from unreasonable rules, to licensing schemes, to limitations on advertising, to restrictions on contracts. In The Right to Earn a Living, we see how these and other factors combine to create a system in which it is more and more difficult to support oneself and one's family in the manner one chooses.

Abstract:: The article is a response to the contemporary state of research of the security-development nexus and attempts to analyze the heterogeneous area of its interpretations and implementations. It analyzes the ways and describes the development of interpretations of the security-development nexus. The text also offers empirical material to enable looking at the variety of effects. It shows that despite a broad interdisciplinary debate, three general attitudes have been generated. The first one is based on the idea that security is the prerequisite of development, the second one that development is the prerequisite of security, and the third one that security and development go hand in hand. The area of concepts appears to be wide and varied as well. The contemporary concepts differ mainly in whose development and whose security they take into account, and which one from these two values (development or security) is understood as more important and how it is interpreted (what is “security” and what is “development”). On the operational level it is clear, that the security-development nexus is not only an academic and theoretical reflection or pose, but that it also influences the practice and changes the national, as well as the international politics. The presented empirical material does not say anything about the size of the change and the number of actors affected, however, it shows that it is no marginal phenomenon, because it has affected important players in the international system as well as rules governing the system.

Abstract:: The protection of minorities in modern international law is intimately connected with and fuelled the recognition of the crimes of persecution and genocide. Minority protection represented the proactive component of the international efforts to ensure the contribution of certain groups to the cultural heritage of humankind. Prohibition and prosecution of persecution and genocide represented the reactive element of these same efforts. The restitution of cultural property to persecuted groups by the international community was recognition that their ownership and control of these physical manifestations was necessary for the realization of this purpose. In this article, I consider the emergence, contraction, and revival of the interconnection between minority protection, the prevention and punishment of genocide, and the protection and restitution of cultural heritage over the last century-long development of international law. It is argued that the central aim driving and interweaving these initiatives is the effort to ensure the continuing contribution of each group to the cultural heritage of all humanity.

Abstract:: The prevailing view of the form which the effort to regulate non-international armed conflicts should take has been summarized by the Appeals Chamber of the International Criminal Tribunal for the former Yugoslavia (ICTY) in the Tadić interlocutory appeal on jurisdiction: '[w]hat is inhumane, and consequently proscribed, in international wars, cannot but be inhumane and inadmissible in civil strife'.This mirroring approach of emulating the laws applicable in international armed conflicts in the non-international context was subsequently adopted by the drafters of the Rome Statute of the International Criminal Court in 1998; the drafters chose to include a list of war crimes applicable in cases of non-international armed conflicts which resembled (though was still narrower than) the list of crimes applicable in international conflicts. The recent Kampala ICC review conference expanded the non-international crimes list, further narrowing the gap between the 'international' and the 'non-international' lists of crimes.Taking a similar position, the 2005 study on customary international humanitarian law (IHL) published by the International Committee of the Red Cross concluded that all but a handful of the rules identified as customary applied in international and non-international armed conflicts equally.Given the traditional resistance by states to assuming the same degree and range of constraints which apply in international armed conflicts in internal ones, humanitarian advocates have sought to advance the regulation of internal armed conflicts by supplementing IHL with norms borrowed from international criminal law (ICL) and international human rights laws (IHRL). The resulting international law of internal armed conflicts has thus been a patchwork of norms which ostensibly apply to all non-international armed conflicts, drawn from the IHL of international conflicts, ICL, and IHRL, often proving to be incoherent, unworkable, and ineffective. Abstract:: When the current economic crisis began, political leaders all around the world spread the idea that capitalism needed somehow to be reformed. 1 A couple of years later one might think that not much has been achieved in that direction and blame politicians for their lack of will. However, it is not so clear that reforms – even if the political will existed – would be easy to realize. As Danny Nicol argues, the neoliberal conception of capitalism is constitutionally shielded as a result of the content and the development of different but coexisting legal regimes such as the World Trade Organization (WTO) or the European Union (EU), and of the activism of the European Court of Human Rights (ECtHR). Describing the resulting 'constitutional protection of capitalism' is precisely what this book is about: Nicol tries to determine to what extent national politics are predetermined by the ongoing economic integration. Or, putting it differently, his research aims at explaining how much room for manoeuvre states, and in particular the United Kingdom, maintain now that the international and European economic integration treaties they ratified years ago have evolved in an unexpected way. Abstract:: The renewed interest in the law of belligerent occupation probably reached its peak in 2009, when various monographs were published by distinguished authors as well as by younger scholars. The book under review originated from a doctoral thesis defended by Andrea Carcano at the University of Milan. His investigation focuses on the 2003 occupation of Iraq as the ideal test-case to verify whether the existing legal regime is adequate to address the challenges posed by present-day scenarios, including Afghanistan, Congo, and the Arab–Israeli conflict. The book is divided into three parts. The first one comprises two chapters, which present respectively the legal framework of belligerent occupation and the other applicable norms of international law. Chapter I takes a historical perspective on the legal concept of occupation, which the author considers functional to the subsequent analysis for two main reasons: to investigate the underlying values guiding the development of the law of belligerent occupation; and to compare current theories regarding the role of the law in such a situation with similar arguments upheld in the past (at 13). Carcano identifies three epochs, which modelled different concepts of occupation. The first one is valid until the Modern Age and is influenced by the Roman law tradition: occupation is considered as 'conquest and exploitation of the territory'. Abstract:: Dialogue, this noble art, which, like many other things, was invented by the Greeks, is always a sort of collaboration, a way of trying to attain the truth. Perhaps this is why Plato used it as a literary vehicle when he wrote his Socratic dialogues, a corpus of pieces in which he laid the foundations of Western philosophy. Deeply impressed by the death of his mentor Socrates, Plato wrote some of the most brilliant and insightful works of all time, perhaps in order to keep on debating with his master after his death. In all likelihood, no-one since has ever had the same great ability to create such architectures of thought. His enjoyable and entertaining dialogues deal with essential topics such as the nature of time, politics, love, and death. Not only is his style concise and meticulous, with a proverbial ability to pose the right questions, but also didactic and kind. His dialogues enable all participants to engage in an inquiry which, despite not always being successful in reaching the desired goal, has at least proved to be a fundamental tool in the development of all expressions of human thought. The book under review is inspired, mutatis mutandis, by this very same philosophy regarding dialogue. As its editors (Filippo Fontanelli, Giuseppe Martinico, and Paolo Carrozza) point out in their introduction, '[t]he process of fragmentation of the international legal order and the absence of constitutional devices governing the connections between the various legal regimes can be reduced to a rational picture only through the activity of the judges' (at 23). Abstract:: The European Union has been trying to achieve its long-term goals through partnerships and cooperation with other like-minded global actors. Africa (through its regional institutional body, the African Union) has been the first and only multilateral entity with which the EU has forged a long-term partnership. Despite its rhetorical language, the Africa-EU Strategic Partnership is unlikely to upgrade the political and economic interaction between the two partners. In the past few years, serious rifts have grown between the EU and its African counterparts concerning trade agreements and development policies. Moreover, new actors have made significant inroads in Africa, providing an alternative to its long-standing dependence on Europe.

340. Recalibrating Homeland Security

Abstract:: The United States has made a mess of homeland security. This is hardly surprising. The policymakers responsible for developing homeland security policy in the wake of September 11, 2001, did so under extraordinary conditions and with few guideposts. The Bush administration's emphasis on combating terrorism overseas meant that it devoted limited strategic attention to the top-down law enforcement and border-focused efforts of the federal departments and agencies assigned new homeland security responsibilities. President Barack Obama has largely continued his predecessor's policies, and congressional oversight has been haphazard. As a result, nearly a decade after al Qaeda struck the World Trade Center and the Pentagon, Washington still lacks a coherent strategy for harnessing the nation's best assets for managing risks to the homeland -- civil society and the private sector. For much of its history, the United States drew on the strength of its citizens in times of crisis, with volunteers joining fire brigades and civilians enlisting or being drafted to fight the nation's wars. But during the Cold War, keeping the threat of a nuclear holocaust at bay required career military and intelligence professionals operating within a large, complex, and highly secretive national security establishment. The sheer size and lethality of U.S. and Soviet nuclear arsenals rendered civil defense measures largely futile. By the time the Berlin Wall came down and the Soviet Union collapsed, two generations of Americans had grown accustomed to sitting on the sidelines and the national security community had become used to operating in a world of its own. To an extraordinary extent, this same self-contained Cold War-era national security apparatus is what Washington is using today to confront the far different challenge presented by terrorism. U.S. federal law enforcement agencies, the border agencies, and the Transportation Security Administration (TSA) are subsumed in a world of security clearances and classified documents. Prohibited from sharing information on threats and vulnerabilities with the general public, these departments' officials have become increasingly isolated from the people that they serve.

341. International Relations studies in Asia: distinctive trajectories

Abstract:: This article investigates and explains the development of International Relations studies (IRS) in China, Japan, and India. Beginning in early 1980s IRS experienced exponential growth in China and is becoming a separate discipline in that country. Despite early starts, IRS in Japan and India is still an appendage in other disciplinary departments, programs, and centers although growing interest is discernible in both countries. Continued rise of Asian powers along with their growing roles and responsibilities in constructing and managing regional and global orders is likely sustain and increase interest in IRS in these countries and more generally in Asia. Distinctive trajectories have characterized the development of IRS in China, Japan, and India. Distinctiveness is evident in master narratives and intellectual predispositions that have shaped research and teaching of IR in all three countries. The distinct IRS trajectories are explained by the national and international context of these countries as well as the extensiveness of state domination of their public spheres. Alterations in national circumstances and objectives along with changes in the international position explain the master narratives that have focused the efforts of IR research communities. Extensiveness of state domination and government support, respectively, explain intellectual predispositions and institutional opportunities for the development of IRS. IRS in Asia has had a predominantly practical orientation with emphasis on understanding and interpreting the world to forge suitable national responses. That orientation contributed to a strong emphasis on normative–ethical dimensions, as well as empirically grounded historical, area, and policy studies. For a number of reasons including intellectual predispositions and constraints, knowledge production in the positivist tradition has not been a priority. However, IR theorizing defined broadly is beginning to attract greater attention among Asian IR scholars. Initial interest in Western IR theory was largely a function of exposure of Asian scholars to Western (primarily American) scholarship that has been in the forefront in the development of IR concepts, theories, and paradigms. Emulation has traveled from copying to application and is now generating interest in developing indigenous ideas and perspectives based on national histories, experiences, and traditions. Although positivism may gain ground it is not deeply embedded in the intellectual traditions of Asian countries. Furthermore, theorizing in the positivist tradition has not made significant progress in the West where it is also encountering sharp criticism and alternative theories. Asian IR scholarship would continue to emphasize normative–ethical concerns. And historical, area, and policy studies would continue to be important in their own right, not simply as evidentiary basis for development of law-like propositions. It also appears likely that Asian IR scholarship would increasingly focus on recovery of indigenous ideas and traditions and their adaptation to contemporary circumstances. The net effect of these trends would be to diversify and enrich existing concepts, theories, methods, and perspectives, and possibly provide fresh ones as well. The flourishing of IRS in Asia would make the IR discipline more international.

Abstract:: The development of International Relations theory (IRT) in China has been framed by three debates since 1979. The first was about China's opening up to the outside world. It started with the question of whether the world was characterized by 'war and revolution' or 'peace and development' between orthodox and reformist scholars and continued to focus on China's interest between orthodox scholars and the newly rising Chinese realists. It resulted in a wide acceptance of the reformist argument that peace and development characterized our era and of the realist view that China was a normal nation-state and should have its own legitimate national interest. The second started in the early 1990s and centered on the better way of realizing China's national interest. It was between Chinese realists and liberals. While the former emphasized national power, the latter proposed the alternative approach of international institutions. The third debate was on China's peaceful rise. It evolved at the turn of the century, when all the three major American IRTs, realism, liberalism, and constructivism, had been introduced into China and therefore the debate was more a tripartite contention. Realists believed that it was impossible for any major power to rise peacefully, while liberals and constructivists both supported the peaceful-rise argument. Liberals stressed more the tangible benefits derived from international institutions and constructivists explored more China's identity in its increasing interaction with international society. Although it was Chinese constructivists who explicitly discussed the identity issue, all the three debates and all the debating sides have reflected this century puzzle since the Opium War – China's identity vis-à-vis international society. These debates have helped push forward the IRT development in China and at the same time established Western IRT as the dominant discourse. A new round of debate seems likely to occur and may center on the question of the world order. This time it may help the newly burgeoning but highly dynamic Chinese IRT to develop and contribute to the enrichment of IRT as knowledge of human life.

Abstract:: British International Relations (IR) theory is distinguished by a concern with institutions and norms, and by an emphasis on history, philosophy, and law rather than the formal methods of the social sciences; in both respects, but especially the latter, it differs from American IR theory. The origins of British IR theory are traced, and the importance of the 'English School' (ES) is stressed, partly because of the work it stimulates, but also because of its role as a brand which helps to establish the independence of British IR from the otherwise dominant American profession. Along with ES scholarship (pluralist and solidarist), political theory and IR, and critical theory, including critical security studies, are the major areas where contemporary IR theory in Britain is located. This is likely to persist, but the generally critical approach taken to social scientific theorizing may be changing, with the increasing importance of historical sociology and critical realist work. It may also be the case that the privileged status of IR theory in British IR may be under challenge.

Abstract:: High-level contacts between the US and Chinese militaries resumed in January with a visit by Defense Secretary Robert Gates to China. Immediately following his trip, President Hu Jintao traveled to the US for a state visit. The occasion combined informal discussion with all the protocol trappings of a state visit by a leader from an important country. Both countries exerted great efforts to ensure the visit's success, which put the bilateral relationship on more solid footing after a year that was characterized by increased tensions and discord. At the invitation of Secretary of State Hillary Clinton, State Councilor Liu Yandong made a week-long visit to the US in mid-April. China held its annual “two meetings” – the National People's Congress and the Chinese People's Political Consultative Congress – and endorsed the 12th Five-Year Plan for National Economic and Social Development.

Abstract:: The Millennium Development Goals (MDGs) are an international commitment to the reduction of poverty and to promoting human development across the planet. The goals are measurable targets attached to a timeframe for making a difference in the lives of billions of people. In September 2000, over 189 member states at the United Nations General Assembly endorsed the MDGs. The goals are also recognition of the fact that 60 years after the end of World War II, the world remains far from achieving the ideals of peace and prosperity inspired by the end of that global conflict. The MDGs provide a strategic framework for developing, implementing and monitoring poverty-eradication programs at national and international levels.

Abstract:: Burma (also known as Myanmar) is a land of contrasts. It is geographically the largest country in Southeast Asia, stretching from tropical beaches to Himalayan peaks. It is rich in resources, including natural gas, timber, and gems. Eighty years ago its people were generally acknowledged to be the best educated in the region, and their prospects for development were expected to be high. Yet today, Burma is the poorest country in Southeast Asia with a per capita GDP of about $625; governmental health and educational expenditures are pitifully small; and Burmese rank near the bottom in most human-development indexes. The ethnic Burman, mostly Buddhist majority lives mostly in the central plains; but more than one hundred other distinct ethnic groups exist, as do notable Christian, Muslim, and Hindu minorities. Visitors universally praise the hospitality of Burmese peoples; yet ethnic-based armed conflicts simmer and sometimes flare in border areas, and Burma receives constant international criticism for major human rights abuses.

Abstract:: Two decades ago, the leaders of Canada, Mexico and the United States forged an agreement that transformed North America from just a geographical expression to the world's most formidable economic entity. The North American Free Trade Agreement (NAFTA) eliminated most of the trade and investment barriers that had segmented the continent. Within a decade, trade among the three countries tripled and foreign direct investment (FDI) quintupled. By 2001, the three nations of North America accounted for 36 percent of the world product—up from 30 percent in 1994. And while many economists have waxed enthusiastic about the growing power of Brazil, U.S. trade with Mexico today is more than six times larger than its trade with Brazil. Unfortunately, since 2001 regional cooperation has stagnated. NAFTA, designed to expand trade and investment, has proven too limited in addressing the current issues facing the three countries. The time has come for the leaders of North America to recommit to regional integration if they want to effectively address the policy issues facing the region. For example, in the wake of the 2008 financial crisis, NAFTA can play a major role in job creation. A revamped agreement can potentially double exports and allow North America to once again compete with integrated markets in Asia and Europe. Beyond jobs, enhanced coordination and information sharing among NAFTA partners will allow for better control of immigration and the flow of illicit drugs across our borders. Finally, strengthening ties will begin to close the development gap between Mexico and its two neighbors, fortifying the economic and political bloc. The Rise and Fall of North America Though NAFTA has long faded from the headlines, the agreement's first years showed much promise. When the North American market was created in 1992, the impact was almost immediate. Contrary to the claim by U.S. presidential candidate Ross Perot that American jobs would be “sucked” into Mexico, the dramatic increase in North American trade coincided with the largest wave of job creation in U.S. history. Between 1992 and 2000, roughly 22 million jobs were added in the U.S., while trade with and FDI in Canada and Mexico grew more than 17 percent each year. The combination of expanded trade and investment meant that the three countries were actually making products together rather than just trading them. By combining U.S. capital and technology with Mexico's cheaper labor and Canada's abundant resources, the enlarged North American market experienced rapid growth, while Europe stagnated. From the onset of the U.S.-Canadian Free Trade Agreement in 1988 to 2001, trade among Mexico, Canada and the U.S., as a percentage of their trade with the world, leapt from 36 percent to 46 percent. The decline of the integration idea could be dated to the spring of 2001, when Presidents Vicente Fox of Mexico and George W. Bush of the U.S. met Canadian Prime Minister Jean Chrétien in Québec. Fox and his Foreign Minister Jorge Castañeda arrived with a suitcase filled with proposals, such as a North American Commission, a “cohesion” fund to reduce the development gap, a customs union and an immigration agreement. But Chrétien was not interested in including Mexico in Canada's talks with the U.S., and Bush rejected any new multilateral institution or fund. The opportunity for progress was lost. The share of trade among the three countries as a percentage of their trade with the rest of the world dropped from 46 percent in 2001 to 40 percent in 2009—almost to pre-NAFTA levels. The average annual growth of trade among the three countries declined by two-thirds, while growth of foreign direct investment decreased by one-half…

Abstract:: The relationship between Turkey (and its predecessor, the Ottoman Empire) and Europe has been long, often tense or openly hostile, and is in some senses fundamental to the identities and development of each; this relationship also adds a considerable burden of suspicion to Turkey's current aim of joining the European Union (EU). This essay examines these propositions by providing an account of the history of the relationship and of Europe's recent, conditional approach to Turkish accession to the EU. While accepting that much remains to be done at the institutional level to bring Turkey into alignment with EU norms, this paper argues that Turkish accession is a historic opportunity for Europe that it should not squander. Despite mixed signals, further development of Turkey's democracy along the path to Europe is the most likely course. The story is not “never-ending”, but the end will not come quickly.

Abstract:: This article is written in the general spirit of contributing to the development of the English School (ES) approach to International Relations (IR), and from the specific perspective of the work of Martin Wight. The literature on international society has greatly enriched our understanding of international order. However, it falls short in what it offers to one important contemporary debate. This deficiency results from its evasion of a central dilemma: how is the role of the Great Powers in managing international order best sustained when their number approximates to one single Great Power? Given the English School's attachment to the role of the Great Powers, it cannot afford to ignore this question. This article adapts ES theory to reflect a world characterized by a concentration of power. The concept of hegemony is central, and will be applied to the arguments about a putative succession between the United States and China. The case is made that their respective power trajectories need to be plotted, not just against relative material capabilities, but taking into account also the appeal of the international orders they come to represent.

Abstract:: This article assesses the contribution that IGAD has made to regional security in the Horn of Africa since the adoption of its peace and security mandate in 1996. It describes the evolution of IGAD and its mandate in the context of regional conflict and wider African peace and security processes. It explores the local dynamics of the two major IGAD-led peace processes, in Sudan (1993–2005) and in Somalia (2002–2004), and discusses the effectiveness of IGAD's institutional role. A consideration of the wider impact of the peace agreements highlights the way IGAD has enhanced its role by setting the agenda on peace support operations in Somalia. The article concludes that IGAD's successes are more the result of regional power politics than of its institutional strength per se. Despite the obvious need for a better regional security framework, the scope for the IGAD Secretariat to develop an autonomous conflict-resolution capability will remain limited. However, IGAD brings a new diplomatic dimension to conflict management that locks in regional states and locks out interested parties beyond the region. With regard to Somalia, the organization has played a pivotal role in directing African and wider international responses to conflict in the region.

356. The future of the Arctic: cauldron of conflict or zone of peace?

Abstract:: The forces of climate change and globalization are transforming the Arctic, tightening the links between this seemingly remote region and the world at large with regard to matters of environmental protection, sustainable development, and the pursuit of peace. This has triggered an explosion of both popular and scholarly interest in the far north. Much of the resultant literature is marked by persistent expectations that the Arctic will become the scene of escalating jurisdictional conflicts, resource wars, a new great game and even armed clashes during the coming years. Yet as the books considered in this review article make clear, these expectations are greatly exaggerated; there is much to be said for the proposition that armed conflict is less likely to occur in the Arctic than in most other parts of the world anytime soon. What is needed is an alternative paradigm to provide a basis for understanding the significance of the profound changes now eroding the old order in the Arctic and establishing a basis for framing innovative governance arrangements capable of ensuring the future of the Arctic as a zone of peace.

Abstract:: Myanmar has been under military rule in various guises for nearly fifty years. The most durable and unyielding of the authoritarian regimes in Southeast Asia, Myanmar's military rulers have expertly exploited circumstances and methods that prolong their rule, even as they have failed to deliver genuine economic growth and development. Their methods include ruthlessly suppressing dissent, inciting ethnic divisions and fears of external threats and making implicit bargains with neighboring states and domestic elites over the spoils available to a rentier state. Myanmar's emergence in recent years as a significant regional supplier of natural gas has dramatically increased the country's distributable economic rents, thus exacerbating the country's political stasis. This article examines the ways in which Myanmar's military regime has maintained its rule through the exploitation of these methods, but with a particular focus on the impacts of the country's exploitable energy and resource wealth and its implications for Myanmar's economic development and political transition.

359. The Art of Censorship in Vietnam

Abstract:: Vietnam now participates in a capitalist market and keeps its borders open, but it still imposes a dated yet effective communist matrix of control over the country's media outlets. This article examines the effectiveness of this system of control with respect to visual art. I find that contemporary art in particular is able to communicate—and express frustrations with—the tensions between rapid economic development and political stagnation, and between cultural traditionalism and modernization. Art can speak with relative impunity because its meaning is more difficult to pinpoint than written criticism of the regime. However, it is important to note that few, if any, Vietnamese artists advocate a change of regime. Instead, they emphasize their concerns about tensions in society caused by rapid development and its effect on centuries-old traditions. The current one-party regime certainly contributes to this tension, but it would be an oversimplification to call these artists “protest artists”; rather, they act as a lens through which both Vietnamese citizens and outsiders get an honest and unbiased view of a country that is too often thought of in terms of colonialism or war.

Abstract:: “Invent your own job; take such an interest in it that you eat, sleep, dream, walk, talk, and live nothing but your work until you succeed.”1 That was Walt Disney's motto—and exactly how he lived. Passionate about his vision, he persisted until he made it reality, often overcoming seemingly impassible obstacles. In order to succeed in building his entertainment empire, and later his first theme park, Disneyland, Disney made his work his life, an all-consuming, 24/7 state of being. Even in the last years of his life, he ate, slept, dreamed, walked, talked, and lived nothing but his work—but by then his focus had shifted from filmmaking and Disneyland to Walt Disney World. According to Disney, Walt Disney World was “the most exciting and challenging assignment . . . ever tackled at Walt Disney Productions.”2 However, the Walt Disney World we know today is a far cry from what Disney himself had envisioned. Walt Disney did not intend it to be the world's largest vacation resort but rather the epicenter of a transformation in urban planning, which would improve domestic living by imbuing it with groundbreaking technology. The heart of Walt Disney World was to be EPCOT, not the theme park that currently bears that name but an actual Experimental Prototype Community of Tomorrow, a futuristic city that would serve as a proving ground for the latest science and technology. EPCOT was Disney's pet project in his later years. Sadly, he passed away before it was completed, and without his passion and persistence, the futuristic city he had envisioned would not come to be. His vision and tenacity, nevertheless, are remarkable in themselves. Long before tackling the EPCOT project, Disney persisted in the face of many setbacks and stumbles, some of which threatened to leave him homeless and hungry. Although he did everything he could to save them, Disney's first two animation studios failed. His third studio, formed with his brother, Roy, after the two moved to California, finally saw success with its popular animated character, Oswald the Lucky Rabbit. Unfortunately, in the face of this success, Disney discovered that the rights to his creation were actually held by Universal. Forging ahead, he strode past this disappointment by creating Mickey Mouse, who became far more popular with moviegoers than his predecessor and brought the studio much recognition and wealth. Even after Mickey Mouse had become a regular on the silver screen, however, Disney was eager to innovate again. In his eyes, his production studio needed a “new adventure,” a “'kick in the pants,' to jar loose some new enthusiasm and inspiration.”3 In 1934, Disney began developing the studio's first full-length feature animated film, Snow White and the Seven Dwarfs. Despite his own enthusiasm, however, many friends and associates, including his brother and wife, thought the film would destroy the Disney Studio. Indeed, financial troubles nearly halted production. But Disney refused to give up, mortgaging his house and taking out a loan to complete the film—which became one of the most popular films of 1937 (and, adjusted for inflation, is number ten on the list of top-grossing American films), establishing him as a master in the entertainment industry. Such persistence and passion would be crucial to the development and creation of EPCOT, which, as Disney conceived it, became a monumental undertaking. He envisioned EPCOT as a revolution in urban planning, “a community of tomorrow that will never be completed, but will always be introducing, and testing, and demonstrating new materials and new systems.”4 It was to be a completely functioning prototype city in which captains of industry could test their solutions for the problems of modern-day city living. For this reason, all residents would rent rather than own their homes, and Disney Corporation would constantly update, change, and test the technology therein. As Disney indicated in a 1966 promotional film, residents' homes would “be built in ways that permit ease of change so that new products may continuously be demonstrated.”5 During the workday, residents would enjoy a city geared toward maximizing their efficiency and productivity. Outside of work, EPCOT would provide them with a safe, convenient, entertaining, and educational atmosphere. . . .

Abstract:: Although Ayn Rand published her epic novel Atlas Shrugged fifty-four years ago, and although it has consistently sold hundreds of thousands of copies annually, Rand's magnum opus has spent decades mired in Hollywood “development hell.” Numerous producers, stars, screenwriters, and film production companies have endeavored but failed to execute a film version (see: “Atlas Shrugged's Long Journey to the Silver Screen,” p. 35). All the while, fans of the novel have anxiously waited for the day when they could watch the story come to life on the silver screen. That day is finally here. Atlas Shrugged: Part I, the first in a planned trilogy, should, for the most part, please the novel's patient fans. Fortuitously following a blueprint similar to one outlined by Rand in the 1970s (see “Adapting Atlas: Ayn Rand's own Approach,” p. 38), the film covers the first third of the story. Like the novel, the movie focuses on Dagny Taggart as she endeavors to save her struggling railroad from both intrusive government regulations and the mysterious John Galt, who is hastening the nation's collapse by causing the great entrepreneurs and thinkers of the country to disappear. She is aided in her efforts by Henry “Hank” Rearden, a steel magnate who is also being squeezed by government regulations and is anxious to put an end to John Galt's activities. Those familiar with the novel know generally what to expect: the disappearance of more and more industrialists and other great producers, the banning of Rearden Metal, the “Anti-Dog-Eat-Dog Rule,” the initial run of the John Galt Line, and finally Wyatt's Torch and the collapse of Colorado.

Abstract:: Security is only 20 percent of the solution; 80 percent is governance and development." "There is no military solution to insurgency." These and similar statements have rightly refocused counterinsurgency doctrine and popular thinking away from purely military solutions to the conflicts in Iraq and Afghanistan. Yet these catchphrases have become substitutes for deeper consideration of the role of security in the current conflicts and in insurgency in general, hiding some important points and leading to assumptions that are an insufficient basis for policy.

Abstract:: In addition to the problems of building and maintaining an effective civilian presence in Afghanistan and Iraq is the matter of developing institutional knowledge in the civilian agencies—what works and what does not work in the field. The task is all the more daunting because civilian agencies do not have a core mission to maintain expertise in stabilizing war-torn countries, particularly those experiencing major counterinsurgency and counterterrorist operations. Yet the Department of State, U.S. Agency for International Development, Departments of Agriculture, Justice, Commerce, Treasury, Homeland Security, Health and Human Services, Transportation, Energy, and other agencies have been sending personnel to Afghanistan, Iraq, and other fragile states for several years now. The agencies have relied on a combination of direct hires, temporary hires, and contractors, but nearly all of them have been plagued by relatively short tours and rapid turnarounds, making it difficult to establish enduring relationships on the ground and institutional knowledge in the agencies. The constant coming and going of personnel has led to the refrain heard more and more frequently that the United States has not been fighting the war in Afghanistan for 8 years, but rather for just 1 year, eight times in a row.

Abstract:: The English geographer Sir Halford Mackinder ended his famous 1904 article, "The Geographical Pivot of History," with a disturbing reference to China. After explaining why Eurasia was the geostrategic fulcrum of world power, he posited that the Chinese, should they expand their power well beyond their borders, "might constitute the yellow peril to the world's freedom just because they would add an oceanic frontage to the resources of the great continent, an advantage as yet denied to the Russian tenant of the pivot region." Leaving aside the sentiment's racism, which was common for the era, as well as the hysterics sparked by the rise of a non-Western power at any time, Mackinder had a point: whereas Russia, that other Eurasian giant, basically was, and is still, a land power with an oceanic front blocked by ice, China, owing to a 9,000-mile temperate coastline with many good natural harbors, is both a land power and a sea power. (Mackinder actually feared that China might one day conquer Russia.) China's virtual reach extends from Central Asia, with all its mineral and hydrocarbon wealth, to the main shipping lanes of the Pacific Ocean. Later, in Democratic Ideals and Reality, Mackinder predicted that along with the United States and the United Kingdom, China would eventually guide the world by "building for a quarter of humanity a new civilization, neither quite Eastern nor quite Western."

Abstract:: For a poor person in the developing world, the struggle for human rights is not an abstract fight over political freedoms or over the prosecution of large-scale war crimes but a matter of daily survival. It is the struggle to avoid extortion or abuse by local police, the struggle against being forced into slavery or having land stolen, the struggle to avoid being thrown arbitrarily into an overcrowded, disease-ridden jail with little or no prospect of a fair trial. For women and children, it is the struggle not to be assaulted, raped, molested, or forced into the commercial sex trade. Efforts by the modern human rights movement over the last 60 years have contributed to the criminalization of such abuses in nearly every country. The problem for the poor, however, is that those laws are rarely enforced. Without functioning public justice systems to deliver the protections of the law to the poor, the legal reforms of the modern human rights movement rarely improve the lives of those who need them most. At the same time, this state of functional lawlessness allows corrupt officials and local criminals to block or steal many of the crucial goods and services provided by the international development community. These abuses are both a moral tragedy and wholly counterproductive to the foreign aid programs of countries in the developed world. Helping construct effective public justice systems in the developing world, therefore, must become the new mandate of the human rights movement in the twenty-first century.

Abstract:: The rapid economic development of Asia since World War II -- starting with Japan, South Korea, and Taiwan, then extending to Hong Kong and Singapore, and finally taking hold powerfully in India and mainland China -- has forever altered the global balance of power. These countries recognize the importance of an educated work force to economic growth, and they understand that investing in research makes their economies more innovative and competitive. Beginning in the 1960s, Japan, South Korea, and Taiwan sought to provide their populations with greater access to postsecondary education, and they achieved impressive results. Today, China and India have an even more ambitious agenda. Both seek to expand their higher-education systems, and since the late 1990s, China has done so dramatically. They are also aspiring to create a limited number of world-class universities. In China, the nine universities that receive the most supplemental government funding recently self-identified as the C9 -- China's Ivy League. In India, the Ministry of Human Resource Development recently announced its intention to build 14 new comprehensive universities of "world-class" stature. Other Asian powers are eager not to be left behind: Singapore is planning a new public university of technology and design, in addition to a new American-style liberal arts college affiliated with the National University. Such initiatives suggest that governments in Asia understand that overhauling their higher-education systems is required to sustain economic growth in a postindustrial, knowledge-based global economy. They are making progress by investing in research, reforming traditional approaches to curricula and pedagogy, and beginning to attract outstanding faculty from abroad. Many challenges remain, but it is more likely than not that by midcentury the top Asian universities will stand among the best universities in the world.

Abstract:: This article analyzes Turkey's domestic political developments in 2009, by situating them against the results and implications of the 2007 national elections. It examines major issues on Turkey's agenda: the redefinition of civilian-military relations, the Kurdish question, the issue of conservative social networks and the Ergenekon investigation. The article argues that while the governing Justice and Development Party previously pursued a survival strategy based on alliances with liberal reformists and the EU to curtail the power of the military, in the wake of the 2007 elections it opted to explore issues of common ground with the military. The developments in 2009, which was a year of harvesting the fruits of this new strategy, show that this strategy worked in regards to the Kurdish question, but it has failed on the issue of conservative social networks, as the military and the government remained embroiled in an undeclared confrontation on this issue.

373. Can One Laptop Per Child Save the World's Poor?

Abstract:: The One Laptop per Child (OLPC) program is one of the most ambitious educational reform initiatives the world has ever seen. The program has developed a radically new low-cost laptop computer and aggressively promoted its plans to put the computer in the hands of hundreds of millions of children around the world, including in the most impoverished nations. Though fewer than two million of the OLPC's XO computers have been distributed as of this writing, the initiative has caught the attention of world leaders, influenced developments in the global computer industry and sparked controversy and debate about the best way to improve the lot of the world's poor. With six years having passed since Nicholas Negroponte first unveiled the idea, this paper appraises the program's progress and impact and, in so doing, takes a fresh look at OLPC's assumptions. The paper reviews the theoretical underpinnings of OLPC, analyzes the program's development and summarizes the current state of OLPC deployments around the world. The analysis reveals that provision of individual laptops is a utopian vision for the children in the poorest countries, whose educational and social futures could be more effectively improved if the same investments were instead made on more proven and sustainable interventions. Middle- and high-income countries may have a stronger rationale for providing individual laptops to children, but will still want to eschew OLPC's technocentric vision. In summary, OLPC represents the latest in a long line of technologically utopian development schemes that have unsuccessfully attempted to solve complex social problems with overly simplistic solutions.

Abstract:: The restive Nile basin which has long been identified as a flashpoint prone to conflict embarked on a new path of cooperation with the launching of the Nile Basin Initiative (NBI). Anchored in a Shared Vision 'to achieve sustainable socio-economic development through the equitable utilization of, and benefits from, the common Nile Basin water resources', the NBI has provided a convenient forum for the negotiation of a Cooperative Framework Agreement (CFA) to set up a permanent, inclusive legal and institutional framework. Negotiation of the CFA has, however, faced a serious impasse as a result of the introduction of the concept of 'water security'. The introduction of this non-legal, indeterminate, and potentially disruptive concept is, indeed, a regrettable detour to a virtual blind-alley. The justifications for this fateful decision are totally unfounded and specious. The decision rather makes sense as an unwarranted move pushing into further obscurity the already intractable Nile waters question, at best, and a logical cul-de-sac in the decade-long negotiations which have arguably fallen prey to the hegemonic compliance-producing mechanism of 'securitization' sneaked in under the veil of 'water security', at worst. Resolution of the Nile waters question should thus first be extricated from the morass of 'water security' and then be sought nowhere but within the framework of international water law.

Abstract:: The Justice and Development Party (AK Party) government has initiated a number of democratic opening initiatives to tackle with the Kurdish question, the Alevi question, the Roma question, and the minorities question. This paper focuses on the reaction of the main opposition party, the Republican People's Party (CHP) to the initiative. It seeks to explain the CHP's reaction through the concept of “electoral hegemony”, which refers to a situation where one party becomes an uncontestable actor in the electoral process, which, while weakening the possibility of the opposition parties winning elections, also weakens the faith and trust of their supporters that these parties could govern Turkey through winning elections. It is argued that the CHP's reaction to the democratic opening initiative is in fact directly related to its need to respond effectively to the electoral hegemony of the AK Party, and that it has developed its response through the concept of sovereignty which has always been integral to its historical identity as the main carrier of the state-centric Turkish modernity.

Abstract:: Turkey under the pro-Islamic Justice and Development Party (AKP) government has represented an opportunity to go beyond the Orientalist modernization framework and produce “value” by countering the culturalist arguments that foreclose the possibilities of democratization in modernizing Muslim countries. The secular opposition, however, has reproduced the logic of the February 28 process and has therefore immobilized and forced the AKP into a struggle to survive, both as a political party and as the elected government of the country. It is this power struggle that has come to epitomize the democratization debate and the democratization process in Turkey. In this context of an impoverished democratization debate, it remains to be seen whether and to what extent the AKP can accomplish the task of revitalizing the constitutive capacities of politics in Turkey.

Abstract:: Turkey's current government's 'democratic opening' project has led to a series of political discussions regarding the cause and resolve of the Kurdish issue. One major consequence of this debate has been the polarization of opinion between conservatives, represented by the ruling Justice and Development Party (Adalet ve Kalkınma Partisi, AKP) and nationalists, represented by the Nationalist Action Party (Milliyetçi Hareket Partisi, MHP). This study elaborates on the major reasons for MHP's opposition to AKP on the 'democratic opening.' In doing so, the study examines the historical, ideological distinctions between the two parties and their perception of ethnic and linguistic differences in Turkish society. AKP comes from a political tradition that has been relatively more accommodating towards such differences. On the contrary, MHP has roots in an ethno-nationalist and mono-culturalist ideology, which can be observed in its denial of the identity component of the Kurdish issue.

Abstract:: The last quarter of 2009 proved to be a quiet one for US-Russia relations. Although there were no major bilateral rifts, several issues continue to fester, including the impasse over the Iranian nuclear program. The biggest disappointment, however, may have been the failure to reach an agreement on the replacement for the Strategic Arms Reduction Treaty (START) that expired on Dec. 5. Negotiations are set to resume in January, but end-of-year remarks by Prime Minister Vladimir Putin about the dangers of the US ballistic missile defense system threaten to throw a wrench into the discussions. Meanwhile, the long-awaited East Siberian oil pipeline destined for Asian markets has finally come on line.

Abstract:: The last quarter of 2009 featured high-level Chinese leadership diplomacy with individual Southeast Asian countries, ASEAN, and Asian regional multilateral groups. Salient meetings involved the ASEAN Plus 1 and Asian leadership summits in Thailand in October, a presidential visit to Malaysia and Singapore, including the APEC leaders meeting in Singapore in November, and high-level visits to Australia in late October, and Myanmar and Cambodia in December. Chinese official media commentary showed some concern over recently heightened US and Japanese diplomatic activism in the region. Abstract:: The last quarter of 2009 raised hopes for developments in China's relations with both Koreas. Chinese Vice President Xi Jinping received head-of-state treatment during his mid-December visit to South Korea. In Seoul, Xi presented a series of proposals to further the China-ROK strategic cooperative partnership, including pressing for a free trade agreement. President Lee Myung-bak and Premier Wen Jiabao held bilateral talks on Oct. 10 in Beijing on the sidelines of the China-ROK-Japan trilateral summit, which Lee used to promote his “grand bargain” on North Korean denuclearization. There were also several exchanges between China and the DPRK. In early October, Premier Wen led a large delegation to Pyongyang and proposed a comprehensive set of deals with North Korea. As the first Chinese premier to visit Pyongyang in 18 years, Wen was warmly hosted by Kim Jong-il. Following Wen's visit, the director of the United Front Department of the Workers' Party of Korea (WPK) and Pyongyang's official in charge of inter-Korean relations, Kim Yang-gon, made a five-day trip to China. President Hu Jintao reportedly extended a formal invitation to Kim Jong-il to visit China “at a convenient time” at his meeting with Choe Thae-bok, secretary of the WPK Central Committee and one of Kim's closest aides, who led a WPK delegation to Beijing in late October.

Abstract:: A flurry of high-level political and diplomatic contacts marked the quarter. The engagement culminated in the December visit of DPJ Secretary General Ozawa Ichiro to China and his meeting with President Hu Jintao followed by the visit of Vice President Xi Jinping to Japan and his audience with Emperor Akihito. Both Japanese and Chinese political leaders repeatedly made clear their intentions to advance the bilateral relationship. While progress on issues related to joint development of resources in the East China Sea and resolution of the adulterated gyoza case remained noticeably lacking, public opinion polls suggested an upward trend in the way both Japanese and Chinese viewed each other and the bilateral relationship.

Abstract:: This has been a quiet but constructive quarter in cross-Strait relations. Taipei and Beijing were focused on ratifying and beginning implementation of the Economic Cooperation Framework Agreement (ECFA). With Beijing‟s agreement, Singapore and Taipei announced that they would consider negotiating a WTO-consistent economic cooperation agreement. This important flexibility by Beijing allows President Ma to show that ECFA has opened the door at least slightly to Taiwan‟s involvement in regional trade liberalization. Despite Washington‟s approval of small commercial arms sales, Beijing indicated a willingness to resume military exchanges with Washington. Nevertheless, arms sales to Taiwan remain a threat to US-China relations.

Abstract:: The past quarter in inter-Korean relations might be called the morning after the night before. Tensions over the sunken ROK corvette Cheonan by no means disappeared; the less so since North Korea still denied responsibility, while the South smarted at its failure to convince key powers – China and Russia above all – of Pyongyang‟s culpability. The Cheonan incident remains a crime and an obstacle. Yet hopeful signs are emerging that both sides realize they will have to get past this eventually and that they might as well start now. Among various small initiatives, including flood aid, the quarter ended on a hopeful note with an agreement to hold a fresh round of reunions of separated families in late October.

Abstract:: This article analyses social capital in Ukraine, using the Autonomous Republic of Crimea (ARC) as a case study. To understand how a multiethnic society like Crimea can build and strengthen social capital in the face of economic and political challenges, we focus on the relationship between global, regional and local politics; the subsequent impact on people's work and private lives; and the actions which can be undertaken by nongovernmental organizations (NGOs), international organizations and the state in order to avoid the detrimental trends the region is currently experiencing. Regarding social capital, Ukraine provides an enigmatic example as the country has myriad civil society actors who should, theoretically, constitute the cornerstone of social capital formation and interethnic cooperation. Our findings suggest, however, that there is still a long way to go before trust and shared values become a basis for political and economic growth in Ukraine. An integral element for improving public trust in Ukraine, specifically in Crimea, can be found by examining the impact of global and regional processes on interethnic cooperation within local groups, their specific initiatives and the ways in which they have developed mechanisms for avoiding unresolved conflict.

Abstract:: The Kurdish initiative announced by the governing Justice and Development Party has increased the discussions on the proper ways and forms of dealing with the Kurdish question in Turkey. The announcement acted as an opening of Pandora's box through which all different images of the problem began to be manifested simultaneously. Assuming that the public perception would have a direct impact on the trajectory of the implementation of the initiative, this essay examines different aspects of the public perception of the issue by relying on the findings of a joint survey conducted by SETA and Pollmark. It is contended that effective settlement of the Kurdish question requires encountering and resolving certain tensions in the public perceptions, which can be done by achieving a language in which the grammar of politics and the values that maintain social integration is more transitional and interdependent.

396. Charting the Hamas Charter Changes

Abstract:: Hamas Charter has sparked a lot of controversy, both inside and outside the organization. This paper offers a critical analysis of the original Charter that was issued in 1988. The document attempted to offer an ideology to counter Zionism, but it advocated views that are essentially anti-Jewish, xenophobic and outside the mainstream of the scholarly tradition of Islam. The paper also highlights the contradiction between the search for a just peace and the language of triumphalism and demonization in the Charter. Tracing the political development of Hamas since 1992, the paper presents evidence that current political leaders of Hamas are moving the organization beyond the ideological rhetoric of the early years of the movement. While they have abandoned the outdated Charter, they have not developed a credible perspective on negotiating peace.

398. The Use of Force against Terrorists

Abstract:: Whether states can use force against terrorists based in another country is much discussed. The relevant provisions of the UN Charter do not provide a conclusive answer, but have to be interpreted. The present article suggests that in the course of the last two decades, the Charter regime has been re-adjusted, so as to permit forcible responses to terrorism under more lenient conditions. In order to illustrate developments, it juxtaposes international law as of 1989 to the present state of the law. It argues that the restrictive approach to anti-terrorist force obtaining 20 years ago has come under strain. As far as collective responses are concerned, it is no longer disputed that the Security Council could authorize the use of force against terrorists; however, it has so far refrained from doing so. More controversially, the international community during the last two decades has increasingly recognized a right of states to use unilateral force against terrorists. This new practice is justified under an expanded doctrine of self-defence. It can be explained as part of a strong international policy against terrorism and is part of an overall tendency to view exceptions to the ban on force more favourably than 20 years ago. Conversely, it has led to a normative drift affecting key limitations of the traditional doctrine of self-defence, and increases the risk of abuse.

399. Piracy, Law of the Sea, and Use of Force: Developments off the Coast of Somalia

Abstract:: Attacks against ships off the coast of Somalia have brought piracy to the forefront of international attention, including that of the Security Council. SC Resolution 1816 of 2008 and others broaden the scope of the existing narrow international law rules on piracy, especially authorizing certain states to enter the Somali territorial waters in a manner consistent with action permitted on the high seas. SC resolutions are framed very cautiously and, in particular, note that they 'shall not be considered as establishing customary law'. They are adopted on the basis of the Somali Transitional Government's (TFG) authorization. Although such authorization seems unnecessary for resolutions adopted under Chapter VII, there are various reasons for this, among which to avoid discussions concerning the width of the Somali territorial sea. Seizing states are reluctant to exercise the powers on captured pirates granted by UNCLOS and SC resolutions. Their main concern is the human rights of the captured individuals. Agreements with Kenya by the USA, the UK, and the EC seek to ensure respect for the human rights of these individuals surrendered to Kenya for prosecution. Action against pirates in many cases involves the use of force. Practice shows that the navies involved limit such use to self-defence. Use of force against pirates off the coast of Somalia seems authorized as an exception to the exclusive rights of the flag state, with the limitation that it be reasonable and necessary and that the human rights of the persons involved are safeguarded.

Abstract:: The book is a collection of essays contributing to comparative studies on the constitutional systems of Middle Eastern countries, with particular reference to Afghanistan, Iran, Iraq, and Turkey. While the first four essays – by Darling, Arjomand, Brown, and Mayer – provide a comparative and general analysis of their respective topics, the last four essays – by Shambayat, Bilgin, Rubin, and Arato – are country case studies. The authors are mostly scholars of political and social science; Linda Darling is a historian and Ann Elizabeth Mayer is the sole lawyer among the authors. The impressive list of authors includes internationally recognized experts. Although there are a number of publications on the constitutional law of most of the individual states examined here, the unique feature of this book is that it is one of the first, or even the first, which describes the constitutional development in a large variety of Islamic, Middle Eastern countries in a broad comparative perspective, highlighting peculiarities, similarities, and problems of the different legal systems.
