- Two recent articles in these pages -- "The Myth of the Autocratic Revival [1]" (January/February 2009) and "How Development Leads to Democracy [2]" (March/April 2009) -- have taken issue with my July/August 2007 essay, "The Return of Authoritarian Great Powers [3]." In the first, Daniel Deudney and G. John Ikenberry dispute my argument that the authoritarian capitalist great powers Germany and Japan were defeated in both world wars largely because of contingent factors rather than structural inefficiencies. As I have argued, these countries were too small in comparison to the United States. With respect to the challenge posed by China and Russia, Deudney and Ikenberry insist that developed nondemocratic capitalist societies will not be viable in the long run.

- Al-Qa`ida's strategy in Pakistan remains intentionally opaque, but has demonstrably shifted in recent years to promote increased confrontation with the Pakistani state. Al-Qa`ida's fighters originally used Pakistan as a key logistics base and facilitation point for the Afghan and Arab mujahidin during the 1980s, but since 2001 Pakistan has served primarily as an operational safe haven where al-Qa`ida and its affiliates can plan local, regional and international terrorist attacks. Pakistan's Federally Administered Tribal Areas (FATA) and smaller parts of Baluchistan and the North-West Frontier Province (NWFP) comprise al-Qa`ida's physical center of gravity. Increasingly, however, al-Qa`ida has utilized its media prowess and ideological authority to discredit the Pakistani state and promote cooperation among a variety of Pakistani militants to challenge the state's authority and undermine its support for U.S. efforts in Afghanistan.

- Throughout history, shifts in governing coalitions have critically affected war termination. For example, the execution of the Athenian democratic ruler Cleophon and the ascendancy of the pro-Spartan oligarchs in B.C. 404 led to Athens' surrender to Sparta and ended the twenty-seven-year Second Peloponnesian War. Similarly, the death of Russian Empress Elizabeth in January 1762 led her Prussophile successor, Peter III, to immediately recall Russian armies that were occupying Berlin and conclude the Treaty of Saint Petersburg by May—ending the fighting between Russia and Prussia in the Seven Years' War. During World War I, riots in Germany ushered in a new government that then negotiated the final war armistice, as Kaiser Wilhelm II fied to Holland. Likewise, during World War II, France and Italy surrendered shortly after changes in their governing coalitions, in 1940 and 1943, respectively. Most recently, on his first full day in office, U.S. President Barack Obama summoned senior officials to the White House to begin fulfilling his campaign promise to pull combat forces out of the war in Iraq.

- The AK Party's chronic 'political insecurity' may have passed a threshold as the ruling party resurfaces as an actor taking advantage of its pro-European Union sentiments to begin a 'grand negotiation' with Turkey's thus-far publicly shunned Kurdish leaders after decades of bloodshed. This new window of opportunity could not have emerged without the explosion of the Ergenekon incident, which has offered a persuasive critique of the closed, dark, intolerant and secret communities friendly with the military bureaucracy and state officials but insidiously devoted to destroying the government. In the post-Ergenekon era, the new democratic opening represents a significant departure from a military solution to the Kurdish issue which has blocked civilian imaginations by declaring the Kurdish identity demands as a security threat to the officially proscribed Turkish identity. The real issue at stake now for the AK Party government is a redefinition of the locus and space where the phenomenon of real political power takes place in Turkey.

- This commentary reflects on the Turkish government's recent 'opening' to address the Kurdish problem and the domestic, regional and international conditions that created a conducive environment for this initiative. It maintains that although the Turkish leadership has grasped the new dynamics of the regional and domestic developments and changed its conventional perception of the problem, the initiative is constrained by the fact that it is motivated by a concern to remove the violent aspect of the Kurdish question, i.e., terminating the Kurdish insurgency once and for all. It also suggests that despite the optimism generated by the opening to solve the Kurdish problem, the achievement of its ultimate objective is far more complex than seen at the first glance. The commentary places a special attention on the dilemmas encountered by the Democratic Society Party as it seeks to represent the demands of its predominantly Kurdish constituency.

- MADRID-Spain was attacked by Islamists on March 11, 2004, but the new government that emerged from the polls three days later never learned the right lessons from that massacre. Prime Minister José Luis Rodríguez Zapatero and his Socialist government argued that Spain had been attacked because of its presence in Iraq and because of the conservative government's cooperation with the administration of U.S. President George W. Bush. Based on this notion, they concluded that by pulling out of Iraq and distancing itself from America, Spain could insulate itself from Islamic terrorism.

610. Close Encounters of a Sovereign Kind

- This article considers the prominence that threats of force have had in international political life since the end of the Cold War, and how we tend to overlook these threats in favour of the actual uses of force. Security Council Resolution 678 of November 1990 is one such example. Emblematic of the rule of law and its New World Order, it is often invoked for the 'authorisation' it gave to Member States of the United Nations 'co-operating with the Government of Kuwait ... to use all necessary means to uphold and implement resolution 660 (1990) and all subsequent resolutions and to restore international peace and security in the area' - but this provision was made contingent upon whether 'Iraq on or before 15 January 1991 fully implements [previous] resolutions'. We examine the range of circumstances in which threats of force have arisen and find that these go beyond the archetypal 'close encounter' between states - such as the Cuban Missile Crisis of 1962 and the 'threats of force' directed against Iraq prior to Operation Desert Fox (1998) and Operation Iraqi Freedom (2003). Making use of the jurisprudence of the International Court of Justice from its Nuclear Weapons advisory opinion (1996), we advance the idea of a prohibition of the application of force, and consider the logistics of its operation in state practice; first, in the recent relations between the United States and Iran and, then, through a modern reprise of the facts of the Corfu Channel Case of April 1949. We allude to the importance of the legislative background and purpose behind this prohibition, constantly reflecting upon the intricacies of state relations in which this provision of the United Nations Charter seeks to make its mark.

611. Piracy, Law of the Sea, and Use of Force: Developments off the Coast of Somalia

- Attacks against ships off the coast of Somalia have brought piracy to the forefront of international attention, including that of the Security Council. SC Resolution 1816 of 2008 and others broaden the scope of the existing narrow international law rules on piracy, especially authorizing certain states to enter the Somali territorial waters in a manner consistent with action permitted on the high seas. SC resolutions are framed very cautiously and, in particular, note that they 'shall not be considered as establishing customary law'. They are adopted on the basis of the Somali Transitional Government's (TFG) authorization. Although such authorization seems unnecessary for resolutions adopted under Chapter VII, there are various reasons for this, among which to avoid discussions concerning the width of the Somali territorial sea. Seizing states are reluctant to exercise the powers on captured pirates granted by UNCLOS and SC resolutions. Their main concern is the human rights of the captured individuals. Agreements with Kenya by the USA, the UK, and the EC seek to ensure respect for the human rights of these individuals surrendered to Kenya for prosecution. Action against pirates in many cases involves the use of force. Practice shows that the navies involved limit such use to self-defence. Use of force against pirates off the coast of Somalia seems authorized as an exception to the exclusive rights of the flag state, with the limitation that it be reasonable and necessary and that the human rights of the persons involved are safeguarded.

But we will not be energy independent for the next thirty to forty years, even with a strong push to increase energy efficiency and spur the development of petroleum alternatives. During this time, America will remain dependent on oil derived from authoritarian regimes, weak states and nations in the midst of civil war.

- IT IS commonly accepted that the United States was "invaded" by an unprecedented wave of illegal immigrants beginning in the 1980s. According to the Department of Homeland Security, by 2008 there were 11.6 million illegal immigrants living in the United States, 61 percent from Mexico. The next-closest source was El Salvador, at just 5 percent. Hence the "invasion" was framed as a Mexican issue, with pundits from Lou Dobbs to Patrick Buchanan warning of dire consequences for America if it was not checked, by force if necessary.

- IN LIGHT of the costly tragedy in Iraq, some have commented that inspections would have been an alternative to war. They were not. It was not that simple. Moreover, even with the most intrusive and extensive inspection system ever implemented, we still did not know the extent of Iraq's WMD capacity. Arms inspections are no substitute for war or political compromise, or good independent intelligence. Too often, too many have expected too much from such mechanisms. Inspections are not a goal in themselves. As the urgency and perils of North Korean and Iranian nuclear programs continue to escalate unchecked, attention repeatedly turns to inspections as the remedy of all ills. Yet, the invasiveness of the Iraq inspections was unique. We will never again be able to cajole another country to the extent we did Baghdad. And still we see the limits that even these intrusive inspections had. But, there are untold lessons to be learned from this bizarre case. More than anything else it goes to show that, in spite of their failings, inspections have a purpose and can be wielded to gain information and to deter WMD programs.

- This article reviews and critiques recent scholarly work on Southeast Asian relations with the great powers, examining the strategies that ASEAN governments have used and the effects of those strategies. The author argues that Southeast Asian governments have generally steered away from traditional balance of power politics to promote a more complex 'balance of influence' comprising military, economic, institutional, and ideational dimensions. A key feature of this balance of influence strategy has been its inclusiveness. Southeast Asian governments have invited competing great powers to participate in the region\'s economic and diplomatic affairs so that they develop stakes in the region's peace and prosperity. The author contends that Southeast Asian efforts have been relatively successful to date, contributing to a multi-dimensional balance that is relatively resilient and places significant constraints on any external power's ability to exercise unwanted dominance in the region.

- More than a decade has passed since the East Asian economies were marred by the massive financial crisis, which some assessed as the best thing that could have happened to the region (Kristopf and WuDunn, 2000). This 'blessing in disguise' allegedly comes from the fact that the governments of the crisis-hit countries 'responded by launching one of the most ambitious governance reform projects in living memory' (p. 1). Such reform is implemented by the East Asian governments' active compliance to international standards of transparency, finance, and corporate governance. The influence of this so-called 'regulatory neoliberalism' has been credited as the source of convergence of East Asian economies to international norms.

- The extremist environment in the Philippines continues to improve. The main organizations that have traditionally been at the forefront of national security concern are either exhibiting a continued readiness to engage in negotiations with the government in Manila or are variously suffering from battlefield losses, criminalization or reductions in popular support. Although there has been an increase in kidnappings by the Abu Sayyaf Group (ASG), this is actually a sign of the group's weakness and declining capabilities. Moreover, the United States and Australia remain committed to underwriting assistance packages to the Armed Forces of the Philippines (AFP) and the Philippine National Police (PNP), both of which continue to make steady advances in the struggle against violent extremism.

- His article asks why Turkey recently adopted the emerging international norm of inter-civilizational dialogue as one of its foreign policy priorities. In addressing this question, we turn first to an assessment of the limitations of normative and realist arguments, then suggest that the Justice and Development Party's (AK Party) considerations of domestic political survival were necessary factors in the adoption of intercivilizational dialogue, even though in and of themselves, they were not sufficient. The AK Party government, circumscribed by the secularist establishment, strategically adopted the norm of inter-civilizational dialogue to create a legitimate space for its survival in Turkey's domestic political sphere. This conclusion stems from the theoretical finding that in those states in which political power is not concentrated in the government, the domestic political considerations of the government gain priority in foreign policymaking.

- Barack Obama's inauguration as America's new president has been welcomed as opening a 'new era' in Turkey's relations with the United States. May 2009 also saw the appointment of a new foreign minister in Ankara, in the person of Professor Ahmet Davutoğlu. This article examines how these new directions are playing out in the Middle East, one of the world's most turbulent regions which also has crucial economic and strategic importance for Turkey. It focuses on Turkey's relations with four regional states – Iraq, Israel/ Palestine, Syria and Iran. The article closes by assessing whether Turkey has been able to achieve the government's ambition of 'zero problems' with its neighbors, and the degree to which it has been able to develop a new role as conciliator and go-between in addressing the region's bitter conflicts.

- This article examines the effect of government consumption on economic growth in 23 Latin American countries over the years 1974–2003. Employing the Armey Curve, we show that the typical Latin American government is spending beyond the optimal point. Using panel data and a fixed effects (FE) model, we find that increases in government consumption lead to unambiguous decreases in economic growth.

- Over the last 35 years, the U.S. government has embarked on several major projects to spur the commercial development of energy technologies intended to substitute for conventional energy resources, especially fossil fuels. Those efforts began with the 1973 energy crisis when President Nixon became the first U.S. leader to announce a plan for energy autarky. Presidents Ford and Carter followed Nixon's “Project Independence” with similar pledges. But beginning with Ford's 1975 energy act, plans for energy independence were tied directly to the development of new, alternative energy technologies. Under President Carter in particular, the federal government embarked on highly publicized, heavily funded efforts at developing new technologies with specific timetables for commercial entry and, in a few cases, a timetable for mass market substitution. Current mandates for ethanol and other biofuels fit this latter objective.

- Government and organized criminal groups co-exist in uneasy equilibrium. Criminal groups adjust their behavior as a function of their own goals and resources in relation to inter-group cooperation and conflict, dynamic markets, and public policies; governments adjust their behavior according to shifting perceptions of the benefits offered, threats posed, and strategies adopted by criminal groups. When governments attempt to control or repress their activities, criminal groups employ various tools and instruments that might be grouped into three categories: evasion, corruption, and confrontation. The paper draws on recent cases from Brazil and Mexico with respect to tactical and strategic choices by governments and criminal groups, seeking to address three broad questions. What factors disrupt the state-criminal group equilibrium? Under what circumstances do disruptions produce significant levels of violence (as opposed to evasion or corruption)? What are the implications for the quality of democracy as criminal groups violently confront the state?

Political commentator Peggy Noonan observed that the judgment ''newly re-emerging as the final argument'' for Bush's presidency is that he succeeded in preventing another attack on the scale of September 11, 2001. - After the September 11, 2001, attacks, governments throughout the world rushed to improve their counterterrorism policies. Several countries tightened legislation, increased resources available to their intelligence and law enforcement agencies, and established repressive policies to uncover and prosecute terrorist networks. Policymakers, fearing an imminent attack, understandably focused their attention on aggressive methods. - Nineteenth-century America was the closest thing to capitalism-a system in which government is limited to protecting individual rights-that has ever existed. There was no welfare state, no central bank, no fiat money, no deficit spending to speak of, no income tax for most of the century, and no federal regulatory agencies or antitrust laws until the end of the century. Consequently, total (federal, state, and local) government spending averaged a mere 3.26 percent of Gross Domestic Product (GDP). The Constitution's protection of individual rights and limitation on the power of government gave rise to an economy in which individuals were free to pursue their own interests, to start new businesses, and to create as much wealth as their ability and ambition allowed. This near laissez-faire politico-economic system led to the freest, most innovative, and wealthiest nation in history. Since the beginning of the 20th century, however, capitalism and freedom have been undermined by an explosion in the size and power of government: Total government spending has increased from 6.61 percent of GDP in 1907 to a projected 45.19 percent of GDP in 2009; the dollar has lost more than 95 percent of its value due to the Federal Reserve's inflationary policies; top marginal income tax rates have been as high as 94 percent; entitlement programs now constitute more than half of the federal budget; and businesses are hampered and hog-tied by more than eighty thousand pages of regulations in the Federal Register. What happened? How did America shift from a predominantly free-market economy to a heavily regulated mixed economy; from capitalism to welfare state; from limited government to big government? This article will survey the progression of laws, acts, programs, and interventions that brought America to its present state-and show their economic impact. Let us begin our survey by taking a closer look at the state of the country in the 19th century. Total (Federal, State, and Local) Government Spending America's Former Free Market The Constitution established the political framework necessary for a free market. It provided for the protection of private property (the Fifth Amendment) including intellectual property (Article I, Section 8), the enforcement of private contracts (Article 1, Section 10), and the establishment of sound (gold or silver) money (Article I, Sections 8 and 10). It prohibited the states from erecting trade barriers (Article I, Section 9), thereby establishing the whole nation as one large free-trade zone. It permitted direct taxes such as the income tax only if apportioned among the states on the basis of population (Article 1, Sections 2 and 9), which made them very difficult to levy. Finally, it specifically enumerated and therefore limited Congress's powers (Article I, Section 8), severely constraining the government's power to intervene in the marketplace. Federal regulatory agencies dictating how goods could be produced and traded did not exist. Rather than being forced to accept the questionable judgments of agencies such as the FDA, FTC, and USDA, participants in the marketplace were governed by the free-market principle of caveat emptor (let the buyer beware). As historian Larry Schweikart points out: merchants stood ready to provide customers with as much information as they desired. . . . In contrast to the modern view of consumers as incompetent to judge the quality or safety of a product, caveat emptor treated consumers with respect, assuming that a person could spot shoddy workmanship. Along with caveat emptor went clear laws permitting suits for damage incurred by flawed goods. To be sure, 19th-century America was not a fully free market. Besides the temporary suspension of the gold standard and the income tax levied during the Civil War, the major exceptions to the free market in the 19th century were tariffs, national banking, and subsidies for "internal improvements" such as canals and railroads. These exceptions, however, were limited in scope and were accompanied by considerable debate about whether they should exist at all. Alexander Hamilton, Henry Clay, and Abraham Lincoln supported such interventions; Thomas Jefferson, Andrew Jackson, and John Tyler generally opposed them. These interventions (except for tariffs) were, as Jefferson, Jackson, and Tyler pointed out, unconstitutional. But history shows that they were also impractical. Tariffs were initially implemented, beginning with the Tariff Act of 1789, as a source of revenue-the main source in the 19th century-for the federal government. Pressure from northern manufacturers, however, to implement tariffs for purposes of protection led to the "Tariff of Abominations" (1828), which was scaled back by 1833 due to heavy opposition from the South. Tariff rates then remained relatively low-about 15 percent-until the Civil War. By 1864, average tariff rates had risen to 47.09 percent for protectionist reasons and remained elevated for the remainder of the century. As to national banking, the Second Bank of the United States' charter expired in 1836, thereby paving the way for the free banking era-which lasted until a national bank was reinstituted during the Civil War. By virtually every measure of bank health, this free banking era was the soundest in American history. In terms of capital adequacy, asset quality, liquidity, profitability, and prudent management, national banking proved to be inferior to free banking. As to subsidies for internal improvements, although private entrepreneurs financed and built most roads and many canals, state governments intervened in the 1820s to subsidize canal building-amending their constitutions to do so. However, most state-funded canals either went unfinished, generated little to no income, or went bankrupt. As a result, by 1860 most state constitutions were amended again to prohibit such subsidies. After the Civil War, federal subsidies for the transcontinental railroads caused similar problems-as well as corruption. Further, they were proven to be a hindrance to rather than a precondition of a thriving railroad industry: James Jerome Hill's Great Northern was the most successful of the transcontinental railroads, yet was built without any subsidies or land grants. The foregoing interventions, though impractical, were motivated in part by a desire to help promote the development of business and industry. But lurking in the periphery, growing in popularity, and poised to fuel further government interference in the marketplace, was the ideology of collectivism-the notion that the individual must be subordinated to the collective or the "common good." This idea was stated by economist Daniel Raymond in his 1820 textbook: "it is the duty of every citizen to forgo his own private advantage for the public good." And as the 19th century progressed, this idea was increasingly cited as a justification for government intervention. One of the most important instances of this was the Supreme Court's decision in Munn v. Illinois (1876). In the majority opinion, Chief Justice Morrison Waite declared: Property does become clothed with a public interest when used in a manner to make it of public consequence. . . . When, therefore, one devotes his property to a use in which the public has an interest, he, in effect, grants to the public an interest in that use, and must submit to be controlled by the public for the common good. . . . Although the case applied only to the states, Munn undermined the sanctity of private property rights by establishing the precedent that property "clothed with a public interest" (i.e., any property related to business) is subject to government regulation and control. As a result, Munn helped pave the way for the two major assertions of federal control over the economy-the Interstate Commerce Act and the Sherman Antitrust Act-that would come in the Gilded Age.

- President Obama's July visit focused global attention on Ghana. His speech to the Ghanaian Parliament, however, was clearly a message to the African continent as a whole. He declared that “…this moment is just as promising for Ghana—and for Africa—as the moment when my father came of age and new nations were being born. This is a new moment of promise. Only this time, we have learned that it will not be giants like Nkrumah and Kenyatta who will determine Africa's future. Instead, it will be you—the men and women in Ghana's Parliament, and the people you represent. Above all, it will be the young people—brimming with talent and energy and hope—who can claim the future that so many in my father's generation never found.” Explaining why Ghana was a particularly relevant place to discuss Africa's future, President Obama stated, “Here in Ghana, you show us a face of Africa that is too often overlooked by a world that sees only tragedy or the need for charity. The people of Ghana have worked hard to put democracy on a firmer footing, with peaceful transfers of power even in the wake of closely contested elections. And with improved governance and an emerging civil society, Ghana's economy has shown impressive rates of growth.” More pointedly, President Obama recognized that “time and again, Ghanaians have chosen Constitutional rule over autocracy, and shown a democratic spirit that allows the energy of your people to break through.”

- Over the last 35 years, the U.S. government has embarked on several major projects to spur the commercial development of energy technologies intended to substitute for conventional energy resources, especially fossil fuels. Those efforts began with the 1973 energy crisis when President Nixon became the first U.S. leader to announce a plan for energy autarky. Presidents Ford and Carter followed Nixon's “Project Independence” with similar pledges. But beginning with Ford's 1975 energy act, plans for energy independence were tied directly to the development of new, alternative energy technologies. Under President Carter in particular, the federal government embarked on highly publicized, heavily funded efforts at developing new technologies with specific timetables for commercial entry and, in a few cases, a timetable for mass market substitution. Current mandates for ethanol and other biofuels fit this latter objective.

- This December, diplomats from nearly 200 countries will gather in Copenhagen to negotiate a successor to the 1997 Kyoto Protocol, which for the first time bound wealthy countries to specific cuts in greenhouse gas emissions. Most of these emissions come from burning fossil fuels -- coal, oil, and natural gas -- for energy, from deforestation, and from the agricultural sector. They must be cut deeply in the coming decades if the world is to control the risks of dangerous climate change. Most of those devoted to slashing the world's greenhouse gas emissions have placed enormous weight on the Copenhagen conference. Speaking earlier this year about the conference, UN Secretary-General Ban Ki-moon was emphatic: "We must harness the necessary political will to seal the deal on an ambitious new climate agreement in December here in Copenhagen. . . . If we get it wrong we face catastrophic damage to people, to the planet." Hopes are higher than ever for a breakthrough climate deal. For the past eight years, many argued that developing nations reluctant to commit to a new global climate-change deal -- particularly China and India -- were simply hiding behind the United States, whose enthusiastic engagement was all that was needed for a breakthrough. Now the long-awaited shift in U.S. policy has arrived. The Obama administration is taking ambitious steps to limit carbon dioxide emissions at home, and Congress is considering important cap-and-trade and clean-energy legislation. The road to a global treaty that contains the climate problem now appears to be clear. But it is not so simple. The odds of signing a comprehensive treaty in December are vanishingly small. And even reaching such a deal the following year would be an extraordinary challenge, given the domestic political constraints in Washington and in other capitals that make such an agreement difficult to negotiate and ratify. The many government officials and activists seeking to solve the climate problem therefore need to fundamentally rethink their strategy and expectations for the Copenhagen conference.

- China has challenged the United States on multiple policy fronts since the beginning of 2009. On the security dimension, Chinese ships have engaged in multiple skirmishes with U.S. surveillance vessels in an effort to hinder American efforts to collect naval intelligence. China has also pressed the United States on the economic policy front. Prime Minister Wen Jiabao told reporters that he was concerned about China's investments in the United States: “We have lent a huge amount of money to the U.S. Of course we are concerned about the safety of our assets. To be honest, I am definitely a little worried.” The head of the People's Bank of China, Zhou Xiaochuan, followed up with a white paper suggesting a shift away from the dollar as the world's reserve currency. China's government has issued repeated calls for a greater voice in the International Monetary Fund (IMF) and World Bank. To bolster this call, Beijing helped to organize a summit of the leaders of Brazil, Russia, India, and China (BRIC) to better articulate this message.

- This contribution analyses the impact of the global financial crisis on the Chinese economy and the policies implemented by the Chinese government to cope with it. We argue, first, that China has not been able to decouple its economic performance from that of the U.S. and other developed countries. Second, although economic growth in the second quarter of 2009 showed that the stimulus package is working, the current development does not seem to be sustainable. In order to avoid another round of overheating, the government needs to adjust its stimulus policy. Third, the current crisis offers opportunities to conduct necessary structural adjustments in favour of more market-based and innovative industries, more investment by private companies and a stronger role of private consumption in economic growth. Fourth, with the external demand from the OECD countries declining, Chinese export companies need to further diversify their international markets and re-orient their production and sales strategies to some extent towards the domestic market.

- Imagine the following: 1. A couple improves their oceanside backyard with tables and benches, a barbecue pit and kitchenette, an outdoor shower and restroom, and a beautiful flower garden. Thirty years later, government officials inspect the yard and declare that the amenities are ugly and out of character with the surrounding area, and that, because the amenities underscore the fact that the yard is private, they have a detrimental psychological effect on the public traversing the adjacent beach. The government orders the couple to clear out their yard and restore it to its "natural" condition, or face stiff penalties. 2. A man purchases a vacant lot along the Pacific coast with the dream of building his residence there, but when he submits his building plans to the local government, he is told that the size and location of his structure would sully boaters' views of the coastline. The government demands that he reduce the size of his proposed home to one-quarter its planned size and place it in a geologically hazardous corner of the lot. 3. A family that has been cramped for years in a mobile home on their 143-acre ranch wants to build a house large enough to accommodate them, but when they apply for a building permit, the government tells the family that, in exchange for permission to build, they must agree to a perpetual agricultural easement over almost all of their land-an "agreement" that would force the family and future generations to farm the property forever. Unfortunately, we need not imagine any of these scenarios, because they are true stories of real people suffering at the hands of a real tyrant. Even as you read, these and other such abuses are occurring in California. The tyrant in question is the California Coastal Commission, a state bureaucracy with near-limitless authority over people's property and, thus, their lives. Although the Commission's power to dictate how property owners may use their property is limited to certain regions in California, similar commissions exist in other states, and the Commission's endeavors provide an ideal case study regarding how and why governmental bodies at all levels across America are increasingly violating property rights. - This article seeks to reconcile a fundamental normative tension that underlies most international reconstruction efforts in war-torn societies: on the one hand, substantial outside interference in the domestic affairs of such societies may seem desirable to secure political stability, set up inclusive governance structures, and protect basic human rights; on the other hand, such interference is inherently paternalistic-and thus problematic-since it limits the policy options and broader freedom of maneuver of domestic political actors. I argue that for paternalistic interference in foreign countries to be justified, it needs to be strictly proportional to domestic impediments to self-government and basic rights protection. Based on this claim, I model different degrees of interference that are admissible at particular stages of the postwar reconstruction process. Extrapolating from John Rawls's Law of Peoples, I suggest that full-scale international trusteeship can be justified only so long as conditions on the ground remain "outlaw"—that is, so long as security remains volatile and basic rights, including the right to life, are systematically threatened. Once basic security has been reestablished, a lower degree of interference continues to be justified, until new domestic governance structures become entirely self-sustaining. During this second phase of postwar reconstruction, external actors ideally ought to share responsibility for law-enforcement and administration with domestic authorities, which implies in practice that domestic and international officials should jointly approve all major decisions. I discuss various approximations of such shared responsibility in recent international peace operations and speculate about how best to ensure a timely transition toward full domestic ownership.

- Beijing and Taipei continued to work cooperatively through various dialogue channels to improve cross-Strait relations. The focus this quarter was on the first ever visit by a “designated representative” of the Chinese government to Taiwan – the visit of ARATS Chairman Chen Yunlin in November, when four agreements were signed. This process is gradually establishing a degree of trust in this long-troubled relationship. However, a vocal opposition minority in Taiwan disrupted the Chen visit and forced President Ma Ying-jeou to make adjustments. Despite the progress, there is still no evidence that Beijing has taken any steps to reduce its military threat directed at Taiwan. President Hu's new six-point statement and Taipei's initial reaction to it highlight the continuing gap between their positions. The global economic crisis is confronting the relationship with new challenges, the scope of which is not yet clear. Internationally, Taiwan's desire for participation in the WHO will be a test of this evolving relationship next spring.

But the end of the year brought a possible way forward, with hints from both sides that they are considering a deal where the South would pay for the release of abductees and prisoners of war held by the North. It remains to be seen whether this will fly or how soon the two Koreas can tone down the enmity stoked over the past year. Meanwhile, nongovernmental interaction continues, albeit on a far smaller scale than during the former “Sunshine” policy.

The 13th annual Prime Ministerial Meeting in Moscow in late October and the 13th session of the Russian-Chinese Intergovernmental Commission on Military-Technical Cooperation in Moscow in early December provided some fresh impetus for the impasse in two important areas of bilateral relations: the long-awaited oil pipeline to China and military relations. Separately, the quarter also witnessed the final, albeit low-key, ceremony for settling the last territorial issue when Russia officially transferred to China control of one and a half islands of the disputed territory near Khabarovsk. However, the world around Russia and China was in turmoil not only because of the financial tsunami that was leaving no nation behind, but also because of regional crises between India and Pakistan as well as Israel and Palestine, and the stagnation in the Korea denuclearization process.

- Secretary of State Hillary Clinton's choice of Japan, Indonesia, South Korea, and China for her first official trip overseas helped shine a spotlight on Asia as a high priority region this quarter, as did North Korean Dear Leader Kim Jong-il's announcement that he intended to conduct a satellite launch in early April. The drama surrounding the anticipated launch provided an unfortunate back drop for otherwise very positive pronouncements about intended Obama administration policies in East Asia, even if the quarter closed with only a handful of those eventually to be tasked with implementing these policies at their desks. ASEAN leaders finally held their postponed summit and celebrated the entry into force of their much-maligned Charter. Meanwhile, Australian Prime Minister Kevin Rudd visited Washington to underscore that the U.S. and Australia are still “mates,” even as his reluctance to send more combat forces to Afghanistan foreshadowed the difficulty President Obama faces in getting allies to sign up for his “surge” there. Finally, economic forecasts kept being adjusted downward as Asian leaders prepared for the G20 summit in London in hopes that this would bring a turnaround.

- A new calendar year did little to change the tenor of Japanese domestic politics as the public became increasingly frustrated with parliamentary gridlock and the leadership of Prime Minister Aso Taro, whose approval rating plummeted amid a deepening recession. Opposition leader Ozawa Ichiro continued pressure tactics against the government and became the favorite to succeed Aso until the arrest of a close aide damaged his reputation and stunted momentum for a snap election. Aso demonstrated the art of political survival, touting the urgency of economic stimulus over a poll he could easily lose and which need not take place until the fall. In an effort to prevent political turmoil from weakening Japan's global leadership role, the government dispatched two Maritime Self-Defense Force (MSDF) destroyers to participate in antipiracy operations in the Gulf of Aden.

The suspenseful end to the quarter contrasted with its quiet start where the focus of U.S.-ROK bilateral relations was on initial contacts between the Lee and Obama administration teams and policy coordination over the global financial crisis, while the North Korea missile launch issue slowly but steadily moved from a simmer to a slow boil. However events unfold, the launch itself gives the new administration its first taste of North Korean bad behavior and confronts it with the problem of finding the right balance between under- and over-reaction that is needed to move denuclearization negotiations forward.

- The bilateral dialogue in the first quarter of the year was cordial, if somewhat distant. The administration of President Barack Obama sent clear and positive signals to the Kremlin. At times President Dmitry Medvedev and Prime Minister Vladimir Putin reciprocated with positive language; at times Moscow's negative rhetoric reappeared. Clearly the Russian leadership has been making a cautious assessment of the new U.S. leader. Optimism was again evident at the London meeting between Obama and Medvedev on the eve of the G20 summit on global economic issues. In London, the two leaders pledged cooperation on a variety of issues, centering on arms control. There has been nothing positive in the bilateral relationship to report since last April when then-President George W. Bush visited then-President Putin at Sochi. Since that time, the relationship has plunged to depths unseen since the Cold War. Although many observers wish to see progress (and have come to forecast it), there is clearly much work to be done to repair the rift that has developed over the past six years.

- Secretary of State Hillary Clinton's visit to Indonesia, part of her initial overseas journey to Asia, was enthusiastically received in the world's most populous Muslim country. The secretary praised Indonesia's thriving democracy as evidence of the compatibility of Islam and political pluralism. Noting Southeast Asia's importance to the U.S., Clinton announced that the State Department would begin consideration of a process to sign ASEAN's Treaty of Amity and Cooperation, a prerequisite for membership in the East Asia Summit. She also acknowledged that Washington's harsh sanctions against Burma's military junta had not changed that regime's draconian rule but also pointed out that ASEAN's engagement strategy was equally impotent. Nevertheless, she stated that the U.S. would consult with ASEAN in the process of reviewing its Burma policy. Meanwhile, ASEAN held its 14th summit in Thailand at the end of February. While the global economic crisis dominated the agenda, the future of a human rights commission mandated by ASEAN's new Charter proved the most contentious, with the more authoritarian ASEAN members insisting that noninterference in domestic affairs should remain the underlying principle of any human rights body.

- Beijing and Taipei have been making preparations for the third round of ARATS-SEF talks to be held in May or June at which time additional agreements on finance, flights, and crime are expected. The global recession has precipitated a dramatic decline in cross-Strait trade and that, in turn, has contributed to accelerated plans to negotiate a comprehensive cross-Strait economic agreement. However, the planning for such an agreement has produced a storm of opposition protest in Taiwan, which represents the most serious challenge yet to President Ma's cross-Strait policies. Officials on both sides are speaking optimistically about finding a formula under which Taipei could be an observer at the World Health Assembly (WHA) in May. Although defense reports from both sides acknowledge reduced tensions, there is as yet no sign that Beijing will reduce the military threat directed at Taiwan.

- Looking back, it was a hostage to fortune to title our last quarterly review: “Things can only get better?” Even with that equivocating final question mark, this was too optimistic a take on relations between the two Koreas – which, as it turned out, not only failed to improve but deteriorated further in the first months of 2009. Nor was that an isolated trend. This was a quarter when a single event – or more exactly, the expectation of an event – dominated the Korean Peninsula and Northeast Asia more widely. Suspected since January, announced in February and awaited throughout March, despite all efforts to dissuade it North Korea's long-anticipated Taepodong launched on April 5. This too evoked a broader context, and a seeming shift in Pyongyang. Even by the DPRK's unfathomable logic, firing a big rocket – satellite or no – seemed a rude and perverse way to greet a new U.S. president avowedly committed to engagement with Washington's foes. Yet, no fewer than four separate senior private U.S. delegations, visiting Pyongyang in unusually swift succession during the past quarter, heard the same uncompromising message. Even veteran visitors who fancied they had good contacts found the usual access denied and their hosts tough-minded: apparently just not interested in an opportunity for a fresh start offered by a radically different incumbent of the White House.

- Australia's government swung from the right to the left of the political spectrum in 2007. The U.S. did the same in 2008. Yet, not much changed in the fundamentals of the 57-year-old U.S.-Australia alliance. The assertion of alliance continuity, however, comes with a major caveat: the tectonic effects being exerted by China's rise. As with the rest of the Asia-Pacific, Australia is adjusting significant aspects of its foreign and security policy to the magnetic pull of China, which was dramatized for Canberra through the middle of 2009 by an outburst of Chinese official anger directed at Australia. Other important influences to consider include the so-called “Kevin Rudd” effect, the global economic crisis, and the ongoing conflicts in the Middle East.

- The Kurdish question in Turkey has a long history which was viewed within the framework of nation building, integration and underdevelopment until it was perceived as a security issue with the emergence of the PKK in the 1980s. During the 1990s, dominated by the security perspective, the scope of the question was reduced to terrorist acts alone under a state of emergency rule. A number of changes transformed the nature of question, such as the Kurdish political movement since the 1990s, forced migration, the capture of PKK leader Abdullah Ocalan in 1999 and the emergence of autonomous Kurdish government in northern Iraq. A permanent settlement of the Kurdish question must be based on developing new and alternative strategies vis-a-vis existing policies. In this context, a comprehensive package of measures should include not only security measures, but more importantly democratic reforms and economic investments.

- The inauguration of the Lee Myung-Bak government on February 25, 2008, aroused expectations that President Lee's new North Korea policy would bring about more effective results in dealing with Pyongyang, including the realization of denuclearization of North Korea. Contrary to initial expectations, Lee's North Korea policy has encountered unexpected problems and challenges as North Korea has not only suspended official inter-Korean dialogue and contacts since April but also refused to resume the talks with Seoul unless the Lee government would accommodate Pyongyang's demands: (1) to honor the two inter- Korean summit agreements: the June 15 Joint Declaration (2000) signed between Kim Dae-Jung and Kim Jong-Il and the October 4 (2007) Declaration signed between Kim Jong-Il and Roh Moo-Hyun; (2) to discard the Lee government's “Vision 3000: Denuclearization and Openness”; and (3) to abandon the strategy of strengthening South Korea's alliance with the U.S. and Japan to pressure North Korea. In short, North Korea wants the Lee government to continue the sunshine policy of engagement toward the North. However, it is difficult for the Lee government to accommodate the North's demand, for President Lee promised during the presidential election campaign in 2007 to discard the sunshine policy as it had failed not only to prevent North Korea's nuclear weapons program but also to induce North Korea to adopt reform and openness.

- How do states use economic-security linkages in international bargaining? Governments can provide economic benefits as a side payment to reinforce security cooperation and use close security ties as a source of bargaining leverage in economic negotiations. Domestic political pressures, however, may constrain the form of linkage. First, economic side payments are more likely to be chosen in areas that will not harm the key interests of the ruling party. Second, involvement by the legislature pushes governments toward using security ties as bargaining leverage for economic gains. Evidence from negotiations between Britain and Japan during the Anglo-Japanese alliance of 1902 to 1923 supports the constraining role of domestic politics. Economic-security linkages occurred as Britain gave favorable economic treatment to Japan in order to strengthen the alliance. Economic competition between the allies, however, made it difficult for Britain to grant asymmetrical economic benefits. In tariff negotiations where business interests had more influence in the domestic policy process, the alliance was used as leverage to force reciprocity.

- Governing Gaza: Bureaucracy, Authority, and the Work of Rule provides a fascinating and sophisticated examination of the foreign governing systems enacted by civil servants in the Gaza Strip during the periods of the British Mandate over Palestine (1917-48) and the Egyptian administration of the Gaza Strip (1948-67). The mainstay of Ilana Feldman's book is what she calls "the tenuous domain of the everyday that was never entirely lost" in the "ruptures of Palestinian history" (p. 2). Feldman is both an anthropologist and a historian, and thus her book, an "ethnographic history," examines both the "government at work" and what it meant for people to "work for the government." Her analysis encompasses historical material currently held in archives in four different countries, enriched with oral histories of civil servants, and made sense of by her own experiences of living in Gaza amid the modern-day bureaucracy of the Palestinian Authority (PA) and the Israeli occupation authorities.

- In recent years, the problem of political corruption has become especially pressing in Ukraine. The scale of that phenomenon in governmental and political institutes lets us describe political corruption as an attribute of their everyday activity. Political corruption poisoned all branches and institutes of state governance, local self-government, and presents the main obstacle on the road of Ukraine’s development into a truly democratic state. Political corruption may be identified as the main reason for the political crises of 2006-2009, and in more general terms, did not let Ukraine use its chance of fundamental internal modernisation and approach to EU standards in different sectors that arose after the presidential elections in 2004. Ukraine’s political elite proved unprepared to accept an incorrupt model of politics and governance, and therefore unprepared for large-scale and, most of all, effective fighting political corruption. As a result, accusations of political corruption became only a tool of political struggle and public rhetoric of politicians. Meeting no effective counteraction, political corruption gradually evolved from deviant behaviour into a norm of relations in the state and political circles. “Hierarchic corrupt pyramids” and “closed corrupt cycles” were created in the system of governance, involving representatives of different institutes of governance. Political corruption is nourished by the activity of the most potent financial and industrial groups, and structures of the shadow economy that have enough resources to finance politics behind the scene and influence the authorities in that manner. Political and state figures secured themselves against political responsibility. Channels of public influence on the authorities are effectively obstructed. The system of parliamentary elections and most of local self-government bodies bars voters’ influence on its personal membership. Exercise of the citizens’ right to organisation and conduct of referendums, accomplishment of the procedures of presidential impeachment or bringing members of the parliament to criminal responsibility are next to impracticable. The structures primarily called to oppose corruption – courts and law-enforcement bodies – proved the most vulnerable to it. Internally corrupt, affected by varied managerial and political influences, they cannot effectively discharge their functions of fighting political corruption. The peculiarities of such inability are, on one hand, failed attempts of prosecution of top officials in cases of corruption, on the other – persecution of political opponents under invented pretexts. Further spread of political corruption in Ukraine endangers its national security, since it impairs the effectiveness of the authorities, undermines their public legitimacy, promotes legal nihilism in society, disappointment about the values of democracy and the rule of law. This results in impairment of the country’s competitiveness on the world scene, its ability to effectively counter inner and outer challenges. This study by Razumkov Centre was intended to identify the specificities and scale of political corruption in Ukraine, the fields and reasons of its growth, to provide the basis for formulation of the optimal strategy of countering that phenomenon.

- Historians and political sciences have begun to discuss how and when postwar Germany overcame its authoritarian past and reestablished democracy and a tolerant civil society. This article argues that the national and regional Offices for Political Education have contributed significantly to the recivilizing process. The article provides the first preliminary academic attempt to outline the offices' historical background, their changing institutional structure, and their place in the civic education context since the mid 1950s. A series of case studies examine the historical literature disseminated by specific offices to illustrate the process of overcoming a problematic past and constructing new identities. In turn, the historical role models promoted by the offices, the manner in which federalism was presented, the timing of and fashion in which the Holocaust became a significant theme and the way in which regional identities were understood and fostered, are examined. These cases illustrate how historical information was employed, at first in fairly simple and propagandistic fashion, but always to inculcate democratic and civil norms. The question of the impact of the offices' work is left open, since research on reception has yet to be undertaken, but some evidence about their important contributions to reshaping German values is provided.

- Policy on transport infrastructure in Germany will come under increasing pressure thanks to considerable changes in basic conditions. Demographic change, shifts in economic and regional structures, continued social individualization, and the chronic budget crisis in the public sphere are forcing a readjustment of government action. At root, the impact of the changes in demographics and economic structures touches on what Germans themselves think their postwar democracy stands for. Highly consensual underlying assumptions about Germany as a model are being shaken. The doctrine that development of infrastructure is tantamount to growth and prosperity no longer holds. The experience in eastern Germany shows that more and better infrastructure does not automatically lead to more growth. Moreover, uniform government regulation is hitting limits. If the differences between boom regions and depopulated zones remain as large as they are, then it makes no sense to have the same regulatory maze apply to both cases. In transportation policy, that shift would mean recasting the legal foundations of public transport.

- Defense transformation in small and medium-sized countries has a dialectical aspect. On one hand, it is a general process that has arisen as a result of the effect of the forces of globalization on domestic security and defense issues. As such, it is identical for all countries, having the same features. - Since the collapse of communism and communist states from 1989-1992, the twenty-eight states that currently comprise postcommunist Europe and Eurasia have evolved to different political directions. Some regimes in this region have completed a transition to democracy; others have been arrested at some point on the path to democracy and became a sort of 'defective democracies'; and still others have yet to break with the communist past. This issue focuses on this middle-ground category: countries where elections are regularly held, but the behavior of political actors, notably the government, but not only, is not always democratic. Albania, Moldova, Belarus, Ukraine, Russia, the Caucasus countries present a great variation among themselves, but have also something in common: they do not fit well the classic patterns of either democracy or authoritarianism. The regional trend, particularly noticeable over the past decade, showed hybrid regimes resisting to political change - either in the direction of becoming authentic democracies or reverting back to dictatorship. The purpose of this issue is to explore the lessons for democratization that can be drawn from the postcommunist experience over the past seventeen years. First, what explains defective democracies? Second, what can and cannot be transferred from successful Central Europe to the rest of countries? Finally, is there still a future for democracy promotion in postcommunist Europe?

- In a sharp break from the past, Turkey's AK Party government now openly accepts the existence of a domestic Kurdish problem, and views it moreover as being mutually interrelated with the rise of separatism among Iraqi Kurds and the problem of PKK terrorism. Turkey now has official contacts with the Iraqi Kurds and is working to find a lasting solution to the Kurdish problem by implementing socio-economic and cultural measures in addition to the military one. While the Iraqi Kurds, the American administration and Turkey are beginning to reconcile their differences concerning the Kurdish issue, Turkey faces internal division; certain parties such as the General Staff, the National Movement Party and the Democratic Society Party continue to push for radical measures. Today, there seems to be little opportunity to find common understanding. But as existing conditions deteriorate and pressure mounts both within the domestic sphere and from the international community, it grows increasingly important for Turkey to find a lasting solution to the Kurdish issue.

- The Kurdish question has been a source of domestic conflict since the inception of the Turkish Republic. It has been one of the mostly securitized issues in domestic politics. Despite the continuation of the securitizing agenda, and years of denial by the state, in the mid-1990s alternative discourses on the cultural rights of the Kurds started to emerge. The AK Party government departed from previous attitudes by repeatedly emphasizing the Kurds\' right to express their culture and identity. This article analyzes the developments regarding the Kurdish issue during the AK Party government and asks whether they can be seen as a desecuritization process. The article argues that although there are significant signs of desecuritization, Turkey continues to swing between forces, agendas, and actors of securitization and desecuritization when it comes to the Kurdish issue.

- There are more resources now devoted to the pursuit of peace than at any time in the history of the international system. The participating cast of actors—international, regional, state, and nonstate—seek to create a peace that is essentially Kantian in spirit, and thus heavily dependent upon the maintenance of an international liberal order through international governmental organizations, such as the United Nations. The resultant peace-building strategies are then often justified in terms of the promotion of human rights, democratization, and ''human security''—concepts that together form the cornerstone of what has come to be termed the ''liberal peace.'' Evidence increasingly suggests, however, that the mechanisms used to achieve such a peace typically fail to secure a sustainable peace, and in particular that they may not adequately take into account those actors whose claims for peace may prove especially intransigent—such as those with ethnic and identity claims, and those, ironically, for whom the achievement of human security is particularly pertinent.

- Many intergovernmental organizations (IOs) have recently established offices of internal oversight. Yet scandals such as the one surrounding the Oil-for-Food Program in the United Nations have revealed serious flaws in the design of these institutions, especially their lack of independence from top administrators of the bureaucracies that they are supposed to oversee. This study argues that this is due, in great part, to the initial use of an imperfect domestic model. It shows that, in addition to using a flawed model as a starting point for negotiations, states and IO officials intentionally weakened oversight offices even more. The study argues that member-states need to quickly give such offices increased independence in order to make them more effective and to avoid the continued erosion of the legitimacy of IOs.

- The European Court of Human Rights (ECtHR) is the crown jewel of the world's most advanced international system for protecting civil and political liberties. In recent years, however, the ECtHR has become a victim of its own success. The Court now faces a docket crisis of massive proportions, the consequence of the growing number of states subject to its jurisdiction, its favourable public reputation, its expansive interpretations of individual liberties, a distrust of domestic judiciaries in some countries, and entrenched human rights problems in others. In response to this growing backlog of individual complaints, the Council of Europe has, over the last five years, considered numerous proposals to restructure the European human rights regime and redesign the European Convention on Human Rights (ECHR). This article argues that these proposals should be understood not as ministerial changes in supranational judicial procedure, nor as resolving a debate over whether the ECtHR should strive for individual or constitutional justice, but rather as raising more fundamental questions concerning the Court's future identity. In particular, the article argues for recognition of 'embeddedness' in national legal systems as a deep structural principle of the ECHR, a principle that functions as a necessary counterpoint to the subsidiary doctrine that has animated the Convention since its founding. Embeddedness does not substitute ECtHR rulings for the decisions of national parliaments or domestic courts. Rather, it requires the Council of Europe and the Court to bolster the mechanisms for governments to remedy human rights violations at home, obviating the need for individuals to seek supranational relief and restoring countries to a position in which the ECtHR's deference to national decision-makers is appropriate.

- According to J. Rawls, 'in a constitutional regime with judicial review, public reason is the reason of its supreme court'; it is of constitutional importance for the 'overlapping, constitutional consensus' necessary for a stable and just society among free, equal, and rational citizens who tend to be deeply divided by conflicting moral, religious, and philosophical doctrines. The European Court of Justice (ECJ), the European Court of Human Rights (ECtHR), and the European Free Trade Area (EFTA) Court successfully transformed the intergovernmental European Community (EC) treaties and the European Convention on Human Rights (ECHR) into constitutional orders founded on respect for human rights. Their 'judicial constitutionalization' of intergovernmental treaty regimes was accepted by citizens, national courts, parliaments, and governments because the judicial 'European public reason' protected more effectively individual rights and European 'public goods' (like the EC's common market). The 'Solange method' of cooperation among European courts 'as long as' constitutional rights are adequately protected reflects an 'overlapping constitutional consensus' on the need for 'constitutional justice' in European law. The power-oriented rationality of governments interested in limiting their judicial accountability is increasingly challenged also in worldwide dispute settlement practices. Judicial interpretation of intergovernmental rules as protecting also individual rights may be justifiable notably in citizen-driven areas of international economic law protecting mutually beneficial cooperation among citizens and individual rights (e.g. of access to courts). Multilevel economic, environmental, and human rights governance can become more reasonable and more effective if national and international courts cooperate in protecting the rule of international law for the benefit of citizens (as 'democratic principals' of governments) with due regard for human rights and their constitutional concretization in national and international legal systems.

- In 2001 approximately 100 Central Intelligence Agency officers, 350 U.S. Special Forces soldiers, and 15,000 Afghans overthrew the Taliban regime in less than three months while suffering only a dozen U.S. fatalities. They were supported by as many as 100 U.S. combat sorties per day. Some individuals involved in the operation argued that it revitalized the American way of war. This initial success, however, transitioned into an insurgency, as the Taliban and other insurgent groups began a sustained effort to overthrow the Afghan government. The fighting, which began in 2002, had developed into a full-blown insurgency by 2006. During this period, the number of insurgent-initiated attacks rose by 400 percent, and the number of deaths from these attacks by more than 800 percent. The increase in violence was particularly acute between 2005 and 2006, when the number of suicide attacks quintupled from 27 to 139; remotely detonated bombings more than doubled from 783 to 1,677; and armed attacks nearly tripled from 1,558 to 4,542. Insurgent-initiated attacks rose another 27 percent between 2006 and 2007. The result was a lack of security for Afghans and foreigners.

- The recent closure case brought against the ruling Justice and Development Party is a direct assault on Turkey's democracy. For this reason, America should not lose the opportunity to swiftly and unequivocally repudiate the establishment's attempts to re-assert control over Turkish politics by undemocratic means. The lack of a concrete resolution on the part of the U.S. in regard to the case has already resulted in a credibility gap. Given America's emphasis on and interest in Turkey's democracy and attendant reform process, a simple re-affirmation of its commitment to citizen's choices in free and fair elections would send a powerful message to a country that is on edge. Instead, Turkey is left with 'friends' who lack credibility and resolve at the worst possible moment. If the ruling party and its leadership are banned from political life, not only will Turkey lose its credibility in the Middle East as the only indigenous Muslim-majority democracy, the United States will also lose credibility in the world theatre for failing to support democracy in Turkey.

- This article discusses the limits of the freedom of political parties in Turkey. The political party bans constitute one of the most important problems threatening the freedom of political parties in Turkey. The restrictions on the political parties come to the fore in two different forms: dissolution after the military coups and closure by means of legislation. In the current context of the case opened against the AK Party, it may be possible and advisable to apply an amendment, bringing Turkish jurisprudence in such matters in line with the standards of the European community. It is concluded that the Constitutional Court should interpret cases of the dissolution of political parties in the context of the principles of "secularism" and the "unitary state" in such a way as to take into account the requirements of the principle of "the rule of law" and to allow different political alignments to express themselves in a "human rights respecting" and "democratic" country.

- Contrary to popular belief, the number of conflicts and the number of casualties, refugees and displaced persons resulting from them has fallen dramatically since the end of the Cold War. Previously, with neither superpower wanting a dispute to be settled to its disadvantage, conflicts dragged on indefinitely or were permanently frozen. After 1989, dynamics changed and international interventions began to pursue more far-reaching objectives: to disarm combatants, promote civil society, restore the economy, etc. Nation-building thus replaced inter-positional peacekeeping as the dominant form of international intervention with such missions becoming larger, longer and more frequent. The UN's success rate, as measured in enhanced security, economic growth, return of refugees and installation of representative governments meets or exceeds that of NATO- and EU-led missions in almost every category. It is time, therefore, for Western governments, militaries and populations to get over their disappointment at the UN's early failures and begin once again to do their fair share in these efforts.

696. Not a Zero-Sum Game: Atlanticism and Europeanism in Italian Foreign Policy

- In Italy, Atlanticism and Europeanism should not be seen as two alternative and therefore mutually exclusive policies. Strengthening Atlanticism, for instance, does not necessarily correspond to an equal weakening of Europeanism, as implicitly assumed by those who expect a tilt one way or the other each time a centre-right government replaces a centre-left one or vice versa. Rather, the two policies are hierarchical and constitute a "nested game", with Europeanism nested, as it were, in Atlanticism. Italy's foreign policy choices thus result from a double constraint, one of which, Atlanticism, is more important than the other, Europeanism. More precisely, Italian foreign policymakers have traditionally regarded Europeanism as a policy aimed at reinforcing Atlanticism.

- Despite the belief of some that British Prime Minister Brown's attitudes towards the European Union could not be predicted, much in his period as Chancellor of the Exchequer suggested that Britain's role within the European Union would not be a high priority of his premiership. Early indications bear out this expectation. There will probably not be a British referendum on the Reform Treaty, but the rhetoric employed by Brown's government to describe the Treaty will be negative and minimalist. Although no significant body of British opinion favours with-drawal from the European Union, British popular resentment towards the Union is unlikely to disappear under Brown's leadership.

- Following the economic disasters of the 1960s and 1970s, brought on by the statist policies of the political left, America seemed to change course. Commentators called the shift the "swing to the right"-that is, toward capitalism. From about 1980 to 2000, a new attitude took hold: the idea that government should be smaller, that recessions are best dealt with through tax cuts and deregulation, that markets work pretty effectively, and that many existing government interventions are doing more harm than good. President Bill Clinton found it necessary to declare, "The era of big government is over." Today that attitude has virtually vanished from the public stage. We are now witnessing a swing back to the left-toward statism. As a wave of recent articles have proclaimed: The era of big government is back. The evidence is hard to miss. Consider our current housing and credit crisis. From day one, it was blamed on the market and a lack of oversight by regulators who were said to be "asleep at the wheel." In response to the crisis, the government, the policy analysts, the media, and the American people demanded action, and everyone understood this to mean more government, more regulation, more controls. We got our wish. First came the Fed's panicked slashing of interest rates. Then the bailout of Bear Stearns. Then the bailout of Freddie Mac. Then a $300 billion mortgage bill, which passed by a substantial margin and was signed into law by President Bush. No doubt more is to come. All of this intervention, of course, is supported by our presidential candidates. Both blame Wall Street for the current problems and vow to increase the power of the Fed's and the SEC's financial regulators. John McCain has announced that there are "some greedy people on Wall Street that perhaps need to be punished." Both he and Barack Obama envision an ever-growing role for government in the marketplace, each promises to raise taxes in some form or another, and both support more regulations, particularly on Wall Street. Few doubt they will keep these promises. What do Americans think of all this? A recent poll by the Wall Street Journal and NBC News found that 53 percent of Americans want the government to "do more to solve problems." Twelve years earlier, Americans said they opposed government interference by a 2-to-1 margin. In fact, our government has been "doing more" throughout this decade. While President Bush has paid lip service to freer markets, his administration has engineered a vast increase in the size and reach of government. He gave us Sarbanes-Oxley, the largest expansion of business regulation in decades. He gave us the Medicare prescription drug benefit, the largest new entitlement program in thirty years. He gave us the "No Child Left Behind Act," the largest expansion of the federal government in education since 1979. This is to say nothing of the orgy of spending over which he has presided: His 2009 budget stands at more than $3 trillion-an increase of more than a $1 trillion since he took office. All of this led one conservative columnist to label Bush "a big government conservative." It was not meant as a criticism. Americans entered the 21st century enjoying the greatest prosperity in mankind's history. And many agreed that this prosperity was mainly the result of freeing markets from government intervention, not only in America, but also around the world. Yet today, virtually everyone agrees that markets have failed. Why? What happened? To identify the cause of today's swing to the left, we need first to understand the cause and consequences of the swing to the right.
