Abstract:
These days Generals are thick on the ground in Washington. Not only is the Secretary of Defense a general, but so too are the current and former National Security Advisors to the President and so is the White House Chief of Staff. Military discipline would seem to be the order of the day. Their culture of discipline may seem particularly ironic in one of the most disorganized administrations that we Americans have ever seen. It is nonetheless real.

In Washington, doomsday prophets tend to be effective motivational speakers. They successfully persuade the electorate that their cause is worthy and prompt Congress to take action. In his book Falling Behind? Boom, Bust, and the Global Race for Scientific Talent, Michael Teitelbaum takes on a particular brand of doomsday prophet: those who see impending shortages in the science and engineering workforce. Teitelbaum walks his readers through five postwar cycles of boom and bust in the science and engineering workforce, which eh argues have been driven to a large extend by political machinations set in motion by labor shortage claims (claims that have been almost universally rejected by economists studying the issue). The institutions that currently shape the science and engineering workforce are largely the product of policy responses to these booms and busts. As a result, Falling Behind? Is more than just a work of policy history. It is also a cogent analysis of contemporary R funding mechanisms, high-skill immigration policies, and PhD program structures.

Before the ink on the Treaty of Versailles was dry, the idea of creating an organization dedicated to educating, informing and advising future leaders about the causes and consequences of war was already gaining traction. At 'a series of unofficial meetings held in Paris in 1919',1 Lionel Curtis, an Oxford professor and visionary with a reputation for possessing an impressive array of entrepreneurial skills, was spearheading efforts to establish an Anglo-American research institution where scholars could explore international problems and advocate policy solutions.2 This kind of organization appealed to Curtis and to those with whom he discussed it for several reasons, not the least of which was that it could provide a valuable forum for both policy-makers and prominent policy experts in the leading western powers to talk to one another about international affairs. It was also a concept with which several of the delegates attending the Paris peace talks had some familiarity. In the nineteenth and early twentieth centuries a number of institutions had already taken root in Great Britain and in the United States with the aim of helping policy-makers navigate their way through complex policy problems. They included the Royal United Services Institute for Defence and Security Studies (1831), founded by the first Duke of Wellington; London's Fabian Society (1884), home to a number of prominent scholars, including Sidney and Beatrice Webb, co-founders of the London School of Economics; the Washington-based Carnegie Endowment for International Peace (1910), established by the Scottish-American steel tycoon Andrew Carnegie; and the Institute for Government Research (1916), which merged with two other institutions to form the Brookings Institution in 1927.3 Curtis and his colleagues in Great Britain and the United States were also aware of the ground-breaking research that had been conducted at hundreds of settlement houses in their respective countries. It was at places such as London's Toynbee Hall (1884) and Chicago's Hull House, co-founded by Jane Addams in 1889, that sociologists and other university faculty with expertise in social welfare policy could study the working conditions of the poor.4 In short, proponents of establishing a foreign affairs research institution recognized the importance of encouraging a dialogue between leading social scientists and high-level policy-makers.

4. Plan Colombia: A Retrospective

At first glance, perhaps the most notable feature of Plan Colombia has been its longevity. Given the current divisiveness in Washington, the bipartisan support it has received across three administrations now seems remarkable. After 12 years, the plan is gradually winding down, but the U.S. allocated more than $300 million under the program in 2012 alone. Although the Plan has evolved considerably since it was approved by the U.S. Congress in July 2000, it has become shorthand for wide-ranging U.S. cooperation with Colombia to assist that country in combating drugs, guerrilla violence, and related institutional and social problems. All told, the U.S. has spent nearly $8 billion on the initiative—more than anywhere outside of the Middle East, and Iraq and Afghanistan since the end of the Cold War. Although the effort gave priority to counter-narcotics operations—and specifically the eradication of coca in southern Colombia—from the outset it also encompassed assistance for the judiciary and economic development.

5. The future of US–Brazil relations: confrontation, cooperation or detachment?

US-Brazilian relations sunk to one of their lowest points ever following last year's exposure of the US government's massive surveillance of the South American giant-including the correspondence of President Rousseff and the business operations of Brazil's national oil company, Petrobras. Brazilian authorities responded angrily. The Brazilian president called off a highly valued state visit to Washington, denounced the US for violations of sovereignty and human rights, and proceeded to bypass the US to purchase nearly $5 billion worth of fighter aircraft from Sweden. In fact, US-Brazil ties have not been constructive for more than a generation. Yes, relations are mostly amiable, but with limited cooperation, considerable discord and some open clashes. Washington views Brazil primarily as a regional actor, and wants its cooperation mainly on inter-American issues. For Brazil, regional collaboration means working with other Latin American nations-not the United States. Brazil usually wants the US to keep a distance from the region. The US is no more enthusiastic about Brazil assuming a global role; differences over some of the world's most dangerous political and security challenges have made Washington uneasy about Brazil's engagement in international affairs and critical of its foreign policy judgements. Relations will probably improve, but they could get worse. The two governments need to acknowledge that their relationship is fragile and troubled, and take steps both to rebuild trust and to avert further deterioration and new confrontations. They have to be more careful with each other.

Abstract:
The Israel lobby in Washington is a network of organizations and community groups dedicated to influencing American policy towards the Middle East. Their success and access has made them the model for lobbies on Washington's Capitol Hill and US Government. Long known for successfully influencing American policy towards the Middle East, the lobby now faces its strongest challenge in history at a time when it is also facing what it considers a historically significant issue. The interim accord between Iran and members of the P5+1 have led to turmoil in Washington over the wisdom and plausibility of President Obama's diplomatic approach and about the softening of the current US posture towards Iran. In this debate, powerful conservative groups, a number of key Democrats, and the Israel lobby have been pit against progressive groups and Democratic elected officials in the Senate and the White House. In this article, I will briefly look at the history of the Israel lobby in America and explore its evolution as well as investigate the factors that, over time, caused it to take on a hard-line posture and drift towards the right. I will explore the tactics and strategies that the Israel lobby-the America Israel Public Affairs Committee (AIPAC) in particular-has undertaken to influence the outcome of events and undermine the possibility of diplomatic conflict resolution. Finally, I will examine the pitfalls and challenges hard-line pro-Israel groups face in effectively pursuing these policies and the long term harm they expose themselves to in alienating progressive and pro-peace groups.

The Conscience of the Constitution: The Declaration of Independence and the Right to Liberty, by Timothy Sandefur. Washington, DC: Cato Institute, 2014. 200 pp. $24.95 (hardcover). While the principles of liberty on which America was founded are under attack from so-called liberals and conservatives alike, and while expanding abuses of government power are too vast and complex for most Americans to fully follow, books by rational, knowledgeable professionals clearly and concisely explaining the problems and offering solutions are of immense value. Timothy Sandefur's The Conscience of the Constitution: The Declaration of Independence and the Right to Liberty fits this bill. Sandefur, a principal attorney at the Pacific Legal Foundation and an adjunct scholar at the Cato Institute, bases his latest work on an underappreciated idea in American legal thinking. It is the idea that the Declaration of Independence—understood as a formal, legal, diplomatic document issued by the representatives of thirteen British colonies to the king of England—is part of the law of the land, just as are the Constitution and the Bill of Rights. In fact, argues Sandefur, the Declaration used to be seen as the “conscience of the Constitution,” and reviving this understanding of its position in the framework of U.S. law will go a long way toward establishing the moral and political context within which lawyers, judges, and Supreme Court justices should argue and interpret constitutional law. Sandefur's thesis is controversial and is not likely to be well received in modern courts and law classrooms. Most law schools teach students to view the Declaration as a mere manifesto or letter of aspiration. But Sandefur wages a compelling intellectual defense of the Declaration-as-law on two fronts: against leftists, who have ridiculously claimed that the document was drafted as a wink-and-nod effort by elite white men to put down minorities and the lower classes; and against conservatives such as Russell Kirk and neoconservatives such as Irving Kristol who, afraid of its “natural rights” language, dismiss the ideas of the Declaration and characterize it as an underhanded “ploy to lure the French” into conflict with the English (p. 14). Sandefur, pointing out the baseless nature of such criticisms, puts forth a strong argument for holding the Declaration as law and highlights the Founding Fathers' own understanding of it as such. . . .

It was a rough four months for the US as Washington struggled to convince Asian audiences that the “rebalance” is sustainable given renewed attention to the Middle East, even before the Syrian crises. US engagement in Asia was multidimensional with participation at several ministeriallevel meetings, a visit by Vice President Biden, continued pursuit of the Trans-Pacific Partnership, and a show of military capability in Korea. But, it isn't clear North Korea got the message. Kim Jong Un seems to have adopted his father's play book: first create a crisis, make lots of threats, and follow up with a “smile diplomacy” campaign. So far, Washington has stuck to its game plan, insisting on a sign of genuine sincerity before opening a dialogue with Pyongyang. Finally, the US image in the region was damaged by revelations about classified NSA intelligence collection efforts.

The revelation in May of this year that the Internal Revenue Service (IRS) was systematically targeting Tea Party and other conservative groups for special scrutiny under the laws governing nonprofit organizations shocked the nation and triggered one of the Obama administration's biggest scandals to date. According to a Treasury inspector general's report, in May of 2010, agents in the IRS's Cincinnati office began singling out applications for nonprofit status from groups with terms such as "Tea Party" or "patriot" in their names. The agents conducted lengthy investigations of the groups to determine whether they intended to spend too much of their money on political activities that are prohibited to most nonprofits.1 The IRS required some groups to answer long lists of questions about their intentions, it demanded donor lists from others, and it even examined Facebook and Internet posts.2 Some groups simply gave up and withdrew their applications. Others spent two years waiting for a decision that never came.3 When Congress investigated the scandal, Lois Lerner, the former head of the office that oversees nonprofit organizations, invoked her Fifth Amendment right against self-incrimination and refused to testify. Later, hearings revealed that Douglas Shulman, the former head of the IRS, was cleared to visit the White House at least 157 times during his tenure and that IRS chief counsel William Wilkins, who was one of two Obama appointees at the IRS, helped develop the agency's guidelines for investigating the Tea Party groups.4 As a result, critics of the IRS have good reason to think that the scandal reaches the highest levels of our government. The public's outrage over this scandal is, of course, entirely appropriate. If the government can enforce laws based on nothing more than one's political views, then both freedom of speech and the rule of law are dead. But the outrage over the IRS's focus on conservative groups obscures a far more important question: Why was the IRS investigating the political activities of any group? The answer to that question is more troubling than the possibility of rogue IRS agents, biased law enforcement, or even abuses of power at the highest levels. As bad as all of those things are, the bigger threat to freedom is a legal regime that requires scrutiny of Americans' political activities and a political and intellectual culture that applauds such scrutiny and openly calls for more of it. This is the situation in America today. Our tax and campaign finance laws impose a host of regulations on Americans based on how much time, effort, and money they spend on political speech, and many opinion leaders agitate for even more laws and investigations every day. Against this backdrop, the IRS scandal should not surprise us. Our politicians and intellectuals demanded regulation of some of the loudest voices in our political debates, and the IRS delivered. Unfortunately, far too many critics of the IRS have accepted the premise that our laws should distinguish between groups that spend money on political activities and groups that do not. Expressing this view, Washington Post columnist Ezra Klein has argued that the real scandal was that the IRS did not treat all nonprofits as harshly as it treated the Tea Party groups.5 Using the same reasoning, congressional Democrats have attempted to blunt the scandal by claiming that the IRS also investigated some groups on the left.6 It appears that these claims are untrue, but the message is clear: As long as the government is scrutinizing everyone's speech equally, then there is no scandal. But this is the opposite lesson to learn from the IRS scandal. For anyone who cares about freedom of speech, the real scandal is that the government regulates Americans' campaign spending at all. So long as laws remain on the books that do so, scandals such as this one-and far worse-are inevitable. But to understand why that is so requires a deeper understanding of the premises on which the laws are based and how the laws operate in practice. . . .

ISAF's mission in Afghanistan has shifted from a combat role to focus more on pre- paring ANSF units to assume lead security responsibility by the end of 2014. A key element in advising and assisting the ANSF is SFA advisor teams, provided by the U.S. Army and Marine Corps. A House Armed Services Committee report accompa- nying its version of the Fiscal Year 2013 National Defense Authorization Act directed GAO to review DOD's establishment and use of SFA advisor teams. Specifically, GAO evaluated the extent to which (1) DOD, in conjunction with ISAF, has defined SFA advisor team missions, goals, and objectives; (2) the Army and Marine Corps have been able to provide teams; and (3) the Army and Marine Corps have developed programs to train teams for their specific missions. GAO reviewed doctrine and guid- ance, analyzed advisor requirements, reviewed training curricula, and interviewed Army, Marine Corps, theater command, and SFA advisor team officials in the U.S. and Afghanistan.

President Obama may have spent almost five years in the White House by now, but it's still possible to detect the furtive presence of a certain restless shade lurking in the dimmer corners of the federal mansion. Needless to say, this is something of a first: usually U.S. presidents have to die before they can join the illustrious corps of Washington ghosts, and 43 is, of course, still very much alive in his tony Dallas neighborhood, by all accounts enthusiastically pursuing his new avocation as an amateur painter. Yet his spirit is proving remarkably hard to exorcise.

One would expect no less from this study of contemporary forms of slavery by Emmanuel Decaux than that it identifies the fundamental puzzle at the heart of legal issues surrounding human exploitation, namely, that: there is a permanent contradiction between the successive attempts focused on 'slavery in all its forms' as well as 'the practices and institutions similar to' – which are at the heart of international instruments, and the programmes of action of international organisations and non-governmental organisations –; and the criminal law approach which requires a precise definition to incriminate; either domestically, in the name of the determinacy of the crimes and of the penalty, or internationally to allow for criminal cooperation. 1 It is to this fundamental paradox that Decaux devoted his attention during his lectures at The Hague Academy of International Law in 2008. These lectures were published in The Collected Courses of the Hague Academy series and were also reproduced as part of a pocketbook series. 2 The beauty of considering studies written in another language is to liberate oneself from assumptions – the given starting and end points of argument, and the continuity of well established discourses. If nothing else, surveying works in other languages opens the possibility of new revelations and discoveries – even for the most seasoned expert in an area – which come from narratives forged, in this case, in Paris, as opposed to a London or a Washington. With this in mind, Les formes contemporaines de l'esclavage does not disappoint. More so than in a monograph, the chapters of a study emanating from the Hague Academy stand alone, as each originates in a public lecture and thus must stand on its own merits. 15. Getting the Military Out of Pakistani Politics

The United States has a major stake in Pakistan's stability, given the country's central role in the U.S.-led effort to, in U.S. President Barack Obama's words, "disrupt, dismantle, and defeat" al Qaeda; its war-prone rivalry with India over Kashmir; and its nuclear arsenal. As a result, U.S. policy toward Pakistan has been dominated by concerns for its stability -- providing the reasoning for Washington's backing of the Pakistani military's frequent interventions in domestic politics -- at the expense of its democratic institutions. But as the recent eruption of protests in the Middle East against U.S.-backed tyrants has shown, authoritarian stability is not always a winning bet. Despite U.S. efforts to promote it, stability is hardly Pakistan's distinguishing feature. Indeed, many observers fear that Pakistan could become the world's first nuclear-armed failed state. Their worry is not without reason. More than 63 years after independence, Pakistan is faced with a crumbling economy and a pernicious Taliban insurgency radiating from its Federally Administered Tribal Areas (FATA), the semiautonomous seven districts and six smaller regions along its border with Afghanistan. It is still struggling to meet its population's basic needs. More than half its population faces severe poverty, which fuels resentment against the government and feeds political instability. According to the World Bank, the Pakistani state's effectiveness has actually been in steady decline for the last two decades. In 2010, Foreign Policy even ranked Pakistan as number ten on its Failed States Index, placing it in the "critical" category with such other failed or failing states as Afghanistan, the Democratic Republic of the Congo, and Somalia. The consequences of its failure would no doubt be catastrophic, if for no other reason than al Qaeda and its affiliates could possibly get control of the country's atomic weapons. The Pakistani Taliban's dramatic incursions into Pakistan's northwestern Buner District (just 65 miles from the capital) in 2009 raised the specter of such a takeover.

If the terrorist attacks of 9/11 on New York City and Washington D.C. were a rude wake-up call for potential security threats to continental North America, the reaction on part of Canada has been measured and typically cautious. The acts were of course immediately condemned and temporary refuge given to thousands of travellers stranded by closure of airspace over the United States until declared safe. The federal government and most Canadians extended sympathy and offers of assistance to their closest neighbour and main trading partner. Close cultural and economic ties between the two countries ensured as much. Unease, however, set in about the tough talk and next progression characterized by President George Bush's now famous “You're either with us or against us” speech. Canada's then Liberal prime minister decided not to send the Canadian military wholeheartedly into the invasion of Iraq, though deployment of Canadian troops in Afghanistan duly became a major commitment. Reassuring the United States of Canada's reliability and loyalty as a partner was imperative. To this end, the federal government tightened up financial restrictions on potential fund-raising by identified terrorist groups, introduced new legislation and bureaucratic structures focused on security issues, and better coordinated intelligence gathering and information sharing activities across government agencies and with principal allies. Canadians convinced themselves that any possibility of a 9/11 scale terrorist attack on Canada was unlikely, and even if one was planned or happened, the effect would be minimized by the pro-active measures of authorities. Selected use of security certificates and arrest of home grown Islamic terrorists, the so-called Toronto 18, apparently showed that the police and intelligence agents were up to the task. The threat of terrorism, if not eliminated, could at least be managed and thwarted when required to provide a reasonable level of safety to the Canadian state and society. Ten years on, the course of events has shown the chosen policy decisions to have been mostly sound. Though the highest leadership of Al Qaeda remain at large and defiant as ever in their stated resolve to attack the West, Canada has not yet experienced a major terrorist incident since 9/11.

17. The True Costs of Humanitarian Intervention

As forces fighting Libyan leader Muammar al-Qaddafi consolidated control of Tripoli in the last days of August 2011, many pundits began speaking of a victory not just for the rebels but also for the idea of humanitarian intervention. In Libya, advocates of intervention argued, U.S. President Barack Obama had found the formula for success: broad regional and international support, genuine burden sharing with allies, and a capable local fighting force to wage the war on the ground. Some even heralded the intervention as a sign of an emerging Obama doctrine. It is clearly too soon for this kind of triumphalism, since the final balance of the Libyan intervention has yet to be tallied. The country could still fall into civil war, and the new Libyan government could turn out to be little better than the last. As of this writing, troubling signs of infighting among the rebel ranks had begun to emerge, along with credible reports of serious human rights abuses by rebel forces. Yet even if the intervention does ultimately give birth to a stable and prosperous democracy, this outcome will not prove that intervention was the right choice in Libya or that similar interventions should be attempted elsewhere. To establish that requires comparing the full costs of intervention with its benefits and asking whether those benefits could be achieved at a lower cost. The evidence from the last two decades is not promising on this score. Although humanitarian intervention has undoubtedly saved lives, Americans have seriously underappreciated the moral, political, and economic price involved. This does not mean that the United States should stop trying to promote its values abroad, even when its national security is not at risk. It just needs a different strategy. Washington should replace its focus on military intervention with a humanitarian foreign policy centered on saving lives by funding public health programs in the developing world, aiding victims of natural disasters, and assisting refugees fleeing violent conflict. Abandoning humanitarian intervention in most cases would not mean leaving victims of genocide and repression to their fate. Indeed, such a strategy could actually save far more people, at a far lower price.

Merry Christmas, readers! And welcome to the Winter 2011 issue of The Objective Standard. I'd like to begin by congratulating Antonio Puglielli, the winner of the second annual TOS essay contest. Mr. Puglielli's entry, “'Dog Benefits Dog': The Harmony of Rational Men's Interests,” won him $2,000 and publication of his essay in TOS (see p. 67). Second place went to Caleb Nelson (winning $700) and third place to Deborah B. Sloan (winning $300). Congratulations to Mr. Nelson and Ms. Sloan, as well! As Mitt Romney and Newt Gingrich vie for the GOP presidential nomination, and as Republicans marshal efforts to secure as many Senate seats as possible, advocates of liberty need to keep an eye on the one principle that unifies our political goals and grounds them in moral fact. In “The American Right, the Purpose of Government, and the Future of Liberty,” I identify that principle and discuss its application to issues of the day, including “entitlement” spending, corporate bailouts, and the Islamist threat. If you wonder which side of the abortion debate has the facts straight—or why the issue should matter to anyone other than pregnant women—you will find answers in “The Assault on Abortion Rights Undermines All Our Liberties,” by Diana Hsieh and Ari Armstrong. And if you already know the answers, I think you'll agree that this is the article to circulate on this matter. 19. India's Rise, America's Interest: The Fate of the U.S.-Indian Partnership

Until the late 1990s, the United States often ignored India, treating it as a regional power in South Asia with little global weight. India's weak and protected economy gave it little influence in global markets, and its nonaligned foreign policy caused periodic tension with Washington. When the United States did concentrate on India, it too often fixated on India's military rivalry with Pakistan. Today, however, India is dynamic and transforming. Starting in 1991, leaders in New Delhi -- including Manmohan Singh, then India's finance minister and now its prime minister -- pursued policies of economic liberalization that opened the country to foreign investment and yielded rapid growth. India is now an important economic power, on track (according to Goldman Sachs and others) to become a top-five global economy by 2030. It is a player in global economic decisions as part of both the G-20 and the G-8 + 5 (the G-8 plus the five leading emerging economies) and may ultimately attain a permanent seat on the United Nations Security Council. India's trajectory has diverged sharply from that of Pakistan. With economic growth, India acquired the capacity to act on issues of primary strategic and economic concern to the United States. The United States, in turn, has developed a growing stake in continued Indian reform and success -- especially as they contribute to global growth, promote market-based economic policies, help secure the global commons, and maintain a mutually favorable balance of power in Asia. For its part, New Delhi seeks a United States that will help facilitate India's rise as a major power. Two successive Indian governments have pursued a strategic partnership with the United States that would have been unthinkable in the era of the Cold War and nonalignment. This turnaround in relations culminated in 2008, when the two countries signed a civil nuclear agreement. That deal helped end India's nuclear isolation by permitting the conduct of civil nuclear trade with New Delhi, even though India is not a party to the Nuclear Nonproliferation Treaty. Important as the agreement was, however, the U.S.-Indian relationship remains constrained. For example, although U.S. officials hold standing dialogues about nearly every region of the world with their counterparts from Beijing, Brussels, and Tokyo, no such arrangements exist with New Delhi.

India-US relations were characterized by a degree of ennui while India-East Asia relations were overshadowed by public tensions between China and India throughout much of the year. The Obama administration, preoccupied by multiple high-stakes domestic and foreign policy priorities, offered up two high-profile visits for New Delhi with Secretary of State Hillary Clinton going to India in July and Prime Minister Manmohan Singh coming to Washington in November as the first head of state visit. But the newly strengthened Congress-led government, which returned to power after the April-May national elections, remained wary of the Obama administration's priorities and approaches toward a range of issues including its Afghanistan-Pakistan (AfPak) strategy, nuclear nonproliferation, and climate change, as it felt some nostalgia for the primacy of place and purpose offered to India by the bygone Bush administration. Meanwhile, in India's ties with East Asia, even though New Delhi made diplomatic forays ranging from Mongolia to Papua New Guinea to the Pacific Islands Forum to Australia while sustaining its traditional relationships with Japan and ASEAN, the tense Beijing-New Delhi interaction over the decades-old border dispute was the focus of attention for most observers.

This December, diplomats from nearly 200 countries will gather in Copenhagen to negotiate a successor to the 1997 Kyoto Protocol, which for the first time bound wealthy countries to specific cuts in greenhouse gas emissions. Most of these emissions come from burning fossil fuels -- coal, oil, and natural gas -- for energy, from deforestation, and from the agricultural sector. They must be cut deeply in the coming decades if the world is to control the risks of dangerous climate change. Most of those devoted to slashing the world's greenhouse gas emissions have placed enormous weight on the Copenhagen conference. Speaking earlier this year about the conference, UN Secretary-General Ban Ki-moon was emphatic: "We must harness the necessary political will to seal the deal on an ambitious new climate agreement in December here in Copenhagen. . . . If we get it wrong we face catastrophic damage to people, to the planet." Hopes are higher than ever for a breakthrough climate deal. For the past eight years, many argued that developing nations reluctant to commit to a new global climate-change deal -- particularly China and India -- were simply hiding behind the United States, whose enthusiastic engagement was all that was needed for a breakthrough. Now the long-awaited shift in U.S. policy has arrived. The Obama administration is taking ambitious steps to limit carbon dioxide emissions at home, and Congress is considering important cap-and-trade and clean-energy legislation. The road to a global treaty that contains the climate problem now appears to be clear. But it is not so simple. The odds of signing a comprehensive treaty in December are vanishingly small. And even reaching such a deal the following year would be an extraordinary challenge, given the domestic political constraints in Washington and in other capitals that make such an agreement difficult to negotiate and ratify. The many government officials and activists seeking to solve the climate problem therefore need to fundamentally rethink their strategy and expectations for the Copenhagen conference.

The quarter ended with the question of whether President Obama's first late-night crisis phone call – the metric for leadership bandied about during the campaign – would be over a ballistic missile test by North Korea. The suspenseful end to the quarter contrasted with its quiet start where the focus of U.S.-ROK bilateral relations was on initial contacts between the Lee and Obama administration teams and policy coordination over the global financial crisis, while the North Korea missile launch issue slowly but steadily moved from a simmer to a slow boil. However events unfold, the launch itself gives the new administration its first taste of North Korean bad behavior and confronts it with the problem of finding the right balance between under- and over-reaction that is needed to move denuclearization negotiations forward.

Secretary of State Hillary Clinton's visit to Indonesia, part of her initial overseas journey to Asia, was enthusiastically received in the world's most populous Muslim country. The secretary praised Indonesia's thriving democracy as evidence of the compatibility of Islam and political pluralism. Noting Southeast Asia's importance to the U.S., Clinton announced that the State Department would begin consideration of a process to sign ASEAN's Treaty of Amity and Cooperation, a prerequisite for membership in the East Asia Summit. She also acknowledged that Washington's harsh sanctions against Burma's military junta had not changed that regime's draconian rule but also pointed out that ASEAN's engagement strategy was equally impotent. Nevertheless, she stated that the U.S. would consult with ASEAN in the process of reviewing its Burma policy. Meanwhile, ASEAN held its 14th summit in Thailand at the end of February. While the global economic crisis dominated the agenda, the future of a human rights commission mandated by ASEAN's new Charter proved the most contentious, with the more authoritarian ASEAN members insisting that noninterference in domestic affairs should remain the underlying principle of any human rights body.
