Abstract:: The FY2019 budget saw the country’s largest movement of teachers descend on the state capital and force Governor Doug Ducey to scramble to save his re-election prospects. Gradually growing through social media, the #RedforEd movement culminated with 50,000 teachers and supporters walking out of classrooms and descending onto the Capitol grounds. Gov. Ducey deftly rose to the occasion from his initial one percent raise to a 20 percent raise by FY2021 before the walkout commenced, moving the pressure to legislators to seal the deal, which they did on May 3, 2018. Stronger revenue growth than prior years enabled the governor and Legislature to find the necessary funds.

52. California: Brown's Last Budget Hurrah

Abstract:: California passed a 2018‒2019 budget with record budget surpluses as the state attention shifted to the upcoming 2018 election. This was Jerry Brown’s final budget after sixteen years as governor, a state record. Brown was concerned the state’s volatile income tax revenues might not hold up during a future recession and wanted to store as much of the surplus away in the state’s emergency “rainy-day” fund. Continuing the annual pattern, Democratic legislators wanted to spend some of the surplus on social services, including the increasing problems of homelessness and affordable housing. In addition, legislators began to address the long-ignored problem of sexual harassment in the capitol and was on the front line of the #MeToo movement, leading several legislators to resign. Democrats did well in the November elections, leading to an even bluer California.

53. Hawaii: Priced Out of Paradise

Abstract:: Hawaii adopted a state budget that authorizes $14.3 billion in spending for FY2019. The Aloha State’s economy continues to benefit from record-breaking tourist numbers and robust federal military spending. Although the state’s unemployment rate is among the lowest ever recorded for any state in the nation, the cost of housing has made it increasingly difficult for working families to purchase a home. Tax revenues are strong, but they remain very dependent on the tourism industry. Hawaii also faces huge liabilities for pension and health care payments that are promised to retired state employees.

54. New Mexico: The Lost Decade

Abstract:: In January 2018, the New Mexico State Legislature convened for its regular session, a thirty day budget session, per its constitutional mandate. Thirty days later the legislative session ended quietly and the state of New Mexico closed the book on the great recession and a decade of financial and political strife. The 2018 legislature passed a $6.38 billion dollar budget, re-supplied dangerously low general fund reserves, and provided small raises to teachers and state employees. Oil and gas revenues are up, unemployment is slowly coming down and legislative-executive political battles have muted. The balanced budget, signed by the governor in early March, brings the state back to where it began almost 10 years before, leading one observer to refer to the time as the “lost decade in New Mexico” (Cole 2018).

55. Oregon: Progressive Agenda, Yet Facing Great Fiscal Risks

Abstract:: The 2018 midterm elections strengthened the Democrats’ control of Oregon’s state government. Governor Kate Brown won re-election with 50percent of the vote defeating moderate Republican Knute Buehler with 46.6percent of the vote. Democrats also increased their seats in both the House and Senate, leading to super majorities in both houses. Governor Brown and the Democrats in Salem have taken fairly strong progressive policy stances in 2017 and 2018, particularly opposing President Trump’s immigration and marijuana policies, reinforcing the West Coast carbon-reduction pattern, and strongly supporting health care coverage expansion. With a booming economy and unemployment at record lows, the state seems to be able to deliver on its progressive agenda for the 2017-19 biennium, but funding progressive policies in the future will be a challenge for the governor for a variety of reasons. The fate of this progressive vision depends on five elements: (1) the continuation of the favorable economy and the corresponding revenue growth in the approaching budget cycle; (2) the ability to manage the ongoing taxing and spending structures that include major obligations for the Public Employees Retirement System (PERS); (3) the constraints of ongoing dependency on income taxes; (4) the vicissitudes of Trump era politics and policy with declining federal funds; and (5) continued public support for expansive public policies.

Abstract:: As a state that overwhelmingly relies on sales tax revenue, Washington benefitted from a strong economy in 2018. However, that revenue was necessary as the state faced a court ordered deadline to fully fund K-12 education, and a need to address transportation, mental health, and a capital budget held over from the 2017 session. This is all in addition to creating a new Department of Children, Youth and Families. The state government was under unified government for the first time since 2012 which may have contributed to the state completing its work in a supplemental budget year on time and adjourning by the March deadline.

57. US Undocumented Population Continued to Fall from 2016 to 2017 and Visa Overstays Significantly Exceeded Illegal Crossings for the Seventh Consecutive Year

Abstract:: This article presents estimates of the US undocumented population for 2017 derived by the Center for Migration Studies of New York (CMS). It focuses on the steep decline in the undocumented population from Mexico since 2010. While the president has focused the nation’s attention on the border wall, half a million[1] US undocumented residents from Mexico left[2] the undocumented population in 2016 alone, more than three times the number that arrived that year, leading to an overall decrease of nearly 400,000 undocumented residents from Mexico from 2016 to 2017. From 2010 to 2017, the undocumented population from Mexico fell by a remarkable 1.3 million. For the past 10 years, the primary mode of entry for the undocumented population has been to overstay temporary visas. This article provides estimates of the number of noncitizens who overstayed temporary visas and those who entered without inspection (EWIs) in 2016 by the top five countries of origin. Summary of Findings The US undocumented population from Mexico fell by almost 400,000 in 2017. In 2017, for the first time, the population from Mexico constituted less than one half of the total undocumented population. Since 2010, the undocumented population from Mexico has declined by 1.3 million. In California, the undocumented population from Mexico has declined by 26 percent since 2010, falling from 2.0 to 1.5 million; it also dropped by 50 percent in Alabama, and by one third in Georgia, New York, and New Mexico. The undocumented population from Venezuela grew rapidly after 2013, increasing from 60,000 to 145,000 in just four years. Visa overstays have significantly exceeded illegal border crossings during each of the last seven years. Mexico was the leading country for overstays in 2017, with about twice as many as India or China. The estimates presented here were derived by CMS based on information collected in the Census Bureau’s annual American Community Survey (ACS). The procedures used to derive detailed estimates of the undocumented population are described in Warren (2014). CMS used its annual estimates of the undocumented population for 2010 to 2017 — by state of residence, country of origin, and year of entry — to compile the information described here. Additional methodological details appear as footnotes or as notes in the tables.

58. Bodily Inertia and the Weaponization of the Sonoran Desert in US Boundary Enforcement: A GIS Modeling of Migration Routes through Arizona’s Altar Valley

Abstract:: Since 2000, 3,199 human remains of unauthorized migrants have been recovered from the Sonoran Desert of southern Arizona (Coalición de Derechos Humanos 2018). These recovered remains provide only one indicator of the scope of death and suffering affecting unauthorized migrants and their loved ones — something that also includes thousands of individuals whose whereabouts or remains are never encountered (and who therefore remain disappeared) (ibid.). Just as significantly, the number of human remains recovered in southern Arizona has remained consistently high despite a significant decline during the past decade in the number of apprehensions (a figure frequently used as a proxy for unauthorized migration) in the Border Patrol’s Tucson Sector. This condition has led scholars and commentators alike to observe an increase in the ratio of deaths to migration, even as unauthorized border crossing fluctuates (Martínez et al. 2014; Reineke and Martínez 2014; International Organization for Migration 2018). In 2012, the southern Arizona humanitarian organization No More Deaths began systematically tracking the use and vandalism of cached drinking water it supplies at 512 sites across an 800-square-mile area of southern Arizona’s Altar Valley, a high-traffic migration corridor bisected by the US–Mexico border (Ferguson, Price, and Parks 2010; Regan 2010; Boyce 2016; Chambers et al. 2019). On an almost daily basis, volunteers with No More Deaths travel this migration corridor to resupply caches of 5–20 gallons of clean drinking water, physically hauling this water by truck and by foot. Each cache site is tracked using a Global Positioning System (GPS) coordinate to make navigation of the remote desert borderlands and the location of dispersed and frequently hidden cache sites easier for new volunteers. In 2015, the authors began working with No More Deaths to digitize and conduct spatial and statistical analysis on the data entered into these desert aid logs, with the express aim of seeing what this archive can reveal about everyday activity related to boundary enforcement and migration, as well as the efficacy of the organization’s activities throughout time. In total, No More Deaths’ desert aid archive contains 4,847 unique entries from March 2012 to December 2015, logging the date when an individual cache site was visited, the number of new water gallons deposited during this visit, the number of water gallons encountered intact and unused from previous resupply visits, the conditions of any empty water bottles left behind (including telltale signs of human vandalism, as well as occasional animal damage), and any subjectively unusual conditions or noteworthy events that were observed at the site or during the visit. Combined, this archive provides remarkable and uncommon insight into subtle changes in migration routes and patterns within the Altar Valley desert corridor, as well as those quotidian forms of harassment and vandalism of water supplies that we believe are intended to amplify and maximize hardship for unauthorized border crossers. Indeed, scholars have long argued that the US Border Patrol’s enforcement strategy of “Prevention Through Deterrence” (PTD), first launched in 1994, is premised on instrumentalizing the difficult climate and terrain of the US–Mexico border by pushing migration routes away from traditional urban crossing areas and into increasingly rugged and remote desert areas (Andreas 2001; Cornelius 2001; Rubio-Goldsmith et al. 2006; Nevins 2008; Martínez et al. 2014; De León 2015; Slack et al. 2016). The Border Patrol’s own policy documents make this case. Observing that migrants “crossing through remote, uninhabited expanses of land and sea along the border can find themselves in mortal danger,” the Immigration and Naturalization Service (INS — at the time, the Border Patrol’s parent agency) argued that by channeling migration routes into “harsh terrain less suitable for crossing and more suitable for enforcement,” the Border Patrol would eventually obtain a “tactical advantage” over would-be border crossers (INS 1994, 7). Then–INS Commissioner Doris Meissner later reflected, “We did believe that geography would be an ally for us. It was our sense that the number of people crossing through the Arizona desert would go down to a trickle once people realized what [it’s] like” (quoted in Cornelius 2005). In this article, we conduct geospatial modeling and statistical analysis of No More Deaths’ desert aid archive. This involves measuring changes in the distribution of water use throughout time across the 62 cache sites consistently visited during all four calendar years included in the dataset, and then reading this measurement against a model of ruggedness that incorporates multiple variables including slope, vegetation, “jaggedness,” and ground temperature while controlling for Euclidian distance. Adjusting for seasonal variation and the overall volume of water use, we find a statistically meaningful increase in the cumulative ruggedness score of migration routes associated with cache sites during the four calendar years included in No More Deaths’ desert aid logs. These findings reveal a steady pressure toward more rugged and difficult crossing routes throughout time, an outcome that provides important context for the vandalism and harassment that target migrants and humanitarian aid workers alike (see No More Deaths and Coalición de Derechos Humanos 2018). In what follows, we first provide greater detail on the context of our study and of the authors’ collaboration with No More Deaths. Next, we discuss our research methodology, including the contours of the geographic information system (GIS) modeling through which we conduct our analysis. We then present our findings, and discuss and contextualize these, before turning to some of the limitations of our study and directions for future research. We conclude by considering some of the policy implications of our findings, as well as their implications for studies of mobility, border policing, and state violence, including in contexts when states are instrumentalizing environmental features and conditions for the purposes of boundary enforcement.

59. Fixing What’s Most Broken in the US Immigration System: A Profile of the Family Members of US Citizens and Lawful Permanent Residents Mired in Multiyear Backlogs

Abstract:: The US Department of State (DOS) reports that as of November 2018, nearly 3.7 million persons had been found by US Citizenship and Immigration Services (USCIS) to have a close family relationship to a US citizen or lawful permanent resident (LPR) that qualified them for a visa, but were on “the waiting list in the various numerically-limited immigrant categories” (DOS 2018). These backlogs in family-based “preference” (numerically capped) categories represent one of the most egregious examples of the dysfunction of the US immigration system. They consign family members of US citizens and LPRs that potentially qualify for a visa and that avail themselves of US legal procedures to years of insecurity, frustration, and (often) separation from their families. Often criticized in the public sphere for jumping the visa queue, it would be more accurate to say that this population, in large part, comprises the queue. While they wait for their visa priority date to become current, those without immigration status are subject to removal. In addition, most cannot adjust to LPR status in the United States, but must leave the country for consular processing and, when they do, face three- or 10-year bars on readmission, depending on the duration of their unlawful presence in the United States. This population will also be negatively affected by the Department of Homeland Security’s (DHS) proposed rule to expand the public charge ground of inadmissibility (Kerwin, Warren, and Nicholson 2018). In addition, persons languishing in backlogs enjoy few prospects in the short term for executive or legislative relief, given political gridlock over immigration reform and the Trump administration’s support for reduced family-based immigration. In this paper, the Center for Migration Studies (CMS) offers estimates and a profile based on 2017 American Community Survey (ACS) data of a strongly correlated population to the 3.7 million persons in family-based visa backlogs: i.e., the 1.55 million US residents potentially eligible for a visa in a family-based preference category based on a qualifying relationship to a household member. CMS data represents only part of the population in family-based backlogs. In particular, it captures only a small percentage of the 4th preference, brothers and sisters of US citizens.[1] However, everybody in CMS’s data could be petitioned for, if they have not been already. Among this population’s ties and contributions to the United States, the paper finds that: Fifty-nine percent has lived in the United States for 10 years or more, including 23 percent for at least 20 years. Nearly one million US-born children under age 21 live in these households, as well as 111,600 US-born adults (aged 21 and over) who have undocumented parents. 449,500 arrived in the United States at age 15 or younger. 139,100 qualify for the DREAM Act based their age at entry, continuous residence, and graduation from high school or receipt of a GED. Seventy-two percent aged 16 and older are in the labor force, and more than two-thirds (68 percent) are employed; these rates exceed those of the overall US population. Two-thirds of those aged 18 or older have at least a high school diploma or its equivalent, including 25 percent with a bachelor’s degree or higher, and 295,100 aged three and older are enrolled in school. The median income of their households is $63,000, slightly above the US median. More than two-thirds (68 percent) have health insurance, including 51 percent with private health insurance. Nearly one-third (32 percent) live in mortgaged homes, and 12 percent in homes owned free and clear. The paper provides several recommendations to reduce family-based backlogs. In particular, it proposes that Congress pass and the President sign into law legislation to legalize intending family-based immigrants who have been mired in backlogs for two years or more. In addition, this legislation should define the spouses and minor unmarried children of LPRs as immediate relatives (not subject to numerical limits), not count the derivative family members of the principal beneficiary against per country and annual quotas, and raise per country caps. The administration should also re-use the visas of legal immigrants who emigrate each year, particularly those who formally abandon LPR status. This practice would reduce backlogs without increasing visa numbers. Congress should also pass legislation to advance the entry date for eligibility for “registry,” an existing feature of US immigration law designed to legalize long-term residents. In particular, the legislation should move forward the registry cutoff date on an automatic basis to provide a pathway to status for noncitizens who have lived continuously in the United States for at least 15 years, have good moral character, and are not inadmissible on security and other grounds. In fact, Congress advanced the registry date on a regular basis during most of the 20th century, but has not updated this date, which now stands at January 1, 1972, for 33 years.

60. The Effects of Immigration Enforcement on Faith-Based Organizations: An Analysis of the FEER Survey

Abstract:: The effects of US immigration enforcement policies on immigrants, US families, and communities have been well-documented. However, less attention has been paid to their impact on faith-based organizations (FBOs). Faith communities provide a spiritual home, and extensive legal, resettlement, social service, health, and educational services for refugees and immigrants. This report presents the findings of the FEER (Federal Enforcement Effect Research) Survey, which explored the effects of US immigration enforcement policies on immigrant-serving Catholic institutions.[1] Many of these institutions arose in response to the needs of previous generations of immigrants and their children (Kerwin and George 2014, 14, 74-75). Most strongly identify with immigrants and have long served as crucial intermediaries between immigrant communities and the broader society (Campos 2014, 149-51).[2] Over its first two years, the Trump administration has consistently characterized immigrants as criminals, security risks, and an economic burden. Among its policy initiatives, the administration has supported major cuts in family-based immigration, attempted to terminate the Deferred Action for Childhood Arrivals (DACA) program, reduced refugee admissions to historic lows, instituted admission bars on Muslim-majority countries, attempted to strip Temporary Protection Status (TPS) from all but a fraction of its beneficiaries, erected major new barriers to asylum, and proposed new rules regarding the public charge grounds of inadmissibility that would make it more difficult for poor and working class persons to obtain permanent residence. US immigration enforcement policies have separated children from their parents, criminally prosecuted asylum-seekers, expanded detention, increased arrests of non-citizens without criminal records, and militarized the US-Mexico border. These policies have failed to stem the flow of migrants and asylum-seekers: instead these flows have increased dramatically in recent months. These policies have succeeded, however, in devastating children, instilling fear in immigrant communities, blocking access to the US asylum system, and undermining immigrant integration (Kerwin 2018).[3] The FEER survey points to a paradox. On one hand, US enforcement policies have increased the demand for services such as legal screening, representation, naturalization, assistance to unaccompanied minors, and support to the US families of detainees and deportees. Many Catholic institutions have expanded their services to accommodate the increased demand for their services. On the other hand, their work with immigrants has been impeded by federal immigration policies that effectively prevent immigrants from driving, attending gatherings, applying for benefits, and accessing services for fear that these activities might lead to their deportation or the deportation of a family member. Among other top-line findings, 59 percent of 133 FEER respondents reported that “fear of apprehension or deportation” negatively affected immigrants’ access to their services, and 57 percent of 127 respondents reported that immigrant enforcement very negatively or negatively affected the participation of immigrants in their programs and ministries.

61. Do Immigrants Threaten US Public Safety?

Abstract:: Opponents of immigration often claim that immigrants, particularly those who are unauthorized, are more likely than US natives to commit crimes and that they pose a threat to public safety. There is little evidence to support these claims. In fact, research overwhelmingly indicates that immigrants are less likely than similar US natives to commit violent and property crimes, and that areas with more immigrants have similar or lower rates of violent and property crimes than areas with fewer immigrants. There are relatively few studies specifically of criminal behavior among unauthorized immigrants, but the limited research suggests that these immigrants also have a lower propensity to commit crime than their native-born peers, although possibly a higher propensity than legal immigrants. Evidence about legalization programs is consistent with these findings, indicating that a legalization program reduces crime rates. Meanwhile, increased border enforcement, which reduces unauthorized immigrant inflows, has mixed effects on crime rates. A legalization program or other similar initiatives not currently under serious consideration have more potential to improve public safety and security than several other policies that have recently been proposed or implemented.

62. Paradoxes of Protection: Compassionate Repression at the Mexico–Guatemala Border

Abstract:: Anti-immigrant rhetoric and constricting avenues for asylum in the United States, amid continuing high rates of poverty, environmental crisis, and violence in Guatemala, Honduras, and El Salvador, have led many migrants from these countries to remain in Mexico. Yet despite opportunities for humanitarian relief in Mexico, since the early 2000s the Mexican government, under growing pressure from the United States, has pursued enforcement-first initiatives to stem northward migration from Central America. In July 2014, Mexico introduced the Southern Border Program (SBP) with support from the United States. The SBP dramatically expanded Mexico’s immigration enforcement efforts, especially in its southern border states, leading to rising deportations. Far from reducing migration or migrant smuggling, these policies have trapped migrants for longer in Mexico, made them increasingly susceptible to crimes by a wide range of state and nonstate actors, and exacerbated risk along the entire migrant trail. In recognition of rising crimes against migrants and heeding calls from civil society to protect migrant rights, Mexico’s 2011 revision to its Migration Law expanded legal avenues for granting humanitarian protection to migrants who are victims of crimes in Mexico, including the provision of a one-year humanitarian visa so that migrants can collaborate with the prosecutor’s office in the investigation of crimes committed against them. The new humanitarian visa laws were a significant achievement and represent a victory by civil society keen on protecting migrants as they travel through Mexico. The wider atmosphere of impunity, however, alongside the Mexican government’s prioritization of detaining and deporting migrants, facilitates abuses, obscures transparent accounting of crimes, and limits access to justice. In practice, the laws are not achieving their intended outcomes. They also fail to recognize how Mexico’s securitized migration policies subject migrants to risk throughout their journeys, including at border checkpoints between Guatemala and Honduras, along critical transit corridors in Guatemala, and on the Guatemalan side of Mexico’s southern border. In this article, we examine a novel set of data from migrant shelters — 16 qualitative interviews with migrants and nine with staff and advocates in the Mexico–Guatemala border region, as well as 118 complaints of abuses committed along migrants’ journeys — informally filed by migrants at a shelter on the Guatemalan side of the border, and an additional eight complaints filed at a shelter on the Mexican side of the border. We document and analyze the nature, location, and perpetrators of these alleged abuses, using a framework of “compassionate repression” (Fassin 2012) to examine the obstacles that migrants encounter in denouncing abuses and seeking protection. We contend that while humanitarian visas can provide necessary protection for abuses committed in Mexico, they are limited by their temporary nature, by being nested within a migration system that prioritizes migrant removal, and because they recognize only crimes that occur in Mexico. The paradox between humanitarian concerns and repressive migration governance in a context of high impunity shapes institutional and practical obstacles to reporting crimes, receiving visas, and accessing justice. Abstract:: This article provides an overview and critique of US immigration and asylum policies from the perspective of the author’s 46 years as a public servant. The article offers a taxonomy of the US immigration system by positing different categories of membership: full members of the “club” (US citizens), associate members (lawful permanent residents, refugees, and “asylees”), friends (nonimmigrants and holders of temporary status), and persons outside the club (the undocumented). It describes the legal framework that applies to these distinct populations and recent developments in federal law and policy that relate to them. It also identifies a series of cross-cutting issues that affect these populations, including immigrant detention, immigration court backlogs, state and local immigration policies, and constitutional rights that extend to noncitizens. It ends with a series of recommendations for reform of the US asylum system, and a short conclusion.

Abstract:: At a time when politics, financial considerations, and a push for expediency put pressure on the US immigration system, it can be difficult to have faith in the adjudicatory process. Case resolution quotas, directives that constrain courts’ ability to render justice in individual cases, and executive decisions that contract immigration judges’ discretion contribute to an immigration system that looks less and less like judicial adjudication of some of the highest-stakes cases in our legal system and more like a ministerial claims-processing scheme. A ray of hope exists, however, in the proliferation of public defender–style systems that offer universal representation to those facing deportation. This essay describes the genesis and expansion of the universal representation movement — a project based on the idea that indigent individuals should be entitled to counsel regardless of the apparent merits or political palatability of their case. It describes the benefits of such a program to the immigration adjudication system writ large. Beyond the oft-cited increase in success rates for individuals represented and the benefits to the communities in which such programs are located, universal representation promotes the integrity of the court system and strengthens an adjudicatory procedure that, for too long, has functioned primarily to expeditiously churn through cases. Finally, looking forward, it considers some of the challenges this movement faces as it grows and it identifies areas for further expansion.

65. Putting Americans First: A Statistical Case for Encouraging Rather than Impeding and Devaluing US Citizenship

Abstract:: This article examines the ability of immigrants to integrate and to become full Americans. Naturalization has long been recognized as a fundamental step in that process and one that contributes to the nation’s strength, cohesion, and well-being. To illustrate the continued salience of citizenship, the article compares selected characteristics of native-born citizens, naturalized citizens, legal noncitizens (most of them lawful permanent residents [LPRs]), and undocumented residents. It finds that the integration, success, and contributions of immigrants increase as they advance toward naturalization, and that naturalized citizens match or exceed the native-born by metrics such as a college education, self-employment, average personal income, and homeownership. It finds that: Naturalized citizens enjoy the same or higher levels of education, employment, work in skilled occupations, personal income, and percentage above the poverty level compared to the native-born population. At least 5.2 million current US citizens — 4.5 million children and 730,000 adults — who are living with at least one undocumented parent obtained US citizenship by birth; eliminating birthright citizenship would create a permanent underclass of US-born denizens in the future. Requiring medical insurance would negatively affect immigrants seeking admission and undocumented residents who ultimately qualify for a visa. About 51 percent of US undocumented residents older than age 18 lack health insurance. In 2017, about 1.2 million undocumented residents lived with 1.1 million eligible-to-naturalize relatives. If all the members of the latter group naturalized, they could petition for or expedite the adjustment or immigration (as LPRs) of their undocumented family members, including 890,000 “immediate relatives.” Their naturalization could put 11 percent of the US undocumented population on a path to permanent residency. The article also explores a contradiction: that the administration’s “America first” ideology obscures a set of policies that impede the naturalization process, devalue US citizenship, and prioritize denaturalization. The article documents many of the ways that the Trump administration has sought to revoke legal status, block access to permanent residence and naturalization, and deny the rights, entitlements, and benefits of citizenship to certain groups, particularly US citizen children with undocumented parents. It also offers estimates and profiles of the persons affected by these measures, and it rebuts myths that have buttressed the administration’s policies. For example, the Trump administration and restrictionist legislators have criticized the US immigration system’s emphasis on family reunification for its supposed failure to produce skilled workers. Yet the article finds that: The current immigration system, which prioritizes the admission of the nuclear family members of US citizens and LPRs, yields a legal foreign-born population that has occupational skills equal to those of the native-born population. The legal foreign-born population living in 24 US states and Washington, DC, and those from 94 source countries have higher percentages of skilled workers than the overall population of native-born workers.

66. DACA and the Supreme Court: How We Got to This Point, a Statistical Profile of Who Is Affected, and What the Future May Hold for DACA Beneficiaries

Abstract:: In June 2012, the Obama administration announced the establishment of the Deferred Action for Childhood Arrivals (DACA) program, which sought to provide work authorization and a temporary reprieve from deportation to eligible undocumented young immigrants who had arrived in the United States as minors. Hundreds of thousands of youth applied for the program, which required providing extensive evidence of identity, age, residence, education, and good moral character. The program allowed its recipients to pursue higher education, to access more and better job opportunities, and to deepen their social ties in the United States. This article provides a statistical portrait of DACA recipients based on administrative data from US Citizenship and Immigration Services (USCIS) and estimates drawn from the 2017 American Community Survey (ACS) Census data. It finds the following: As of September 30, 2019, there were 652,880 active DACA recipients. Sixty-six percent of recipients are between the ages of 21 and 30. The top five countries of birth for DACA recipients are Mexico (80 percent), El Salvador (4 percent), Guatemala (3 percent), Honduras (2 percent), and Peru (1 percent). DACA recipients reside in all 50 states and Washington, DC, and in US territories including Puerto Rico, Guam, and the Virgin Islands. The top five states with the highest number of DACA recipients are California (29 percent), Texas (17 percent), Illinois (5 percent), New York (4 percent), and Florida (4 percent). Eighty-one percent of DACA recipients has lived in the United States for more than 15 years. Six percent is married to US citizens, 4 percent to lawful permanent residents (LPRs), and 13 percent to undocumented immigrants. Among US-born children younger than 18 years, 346,455 have at least one DACA parent. Fifty-five percent of DACA recipients graduated from high school, 36 percent has some college education, and 7 percent a bachelor’s degree or higher. Ninety-five percent is employed. The Trump administration rescinded the DACA program in September 2017, leaving recipients and their families in a legal limbo. Federal litigation led to a nationwide preliminary injunction and DACA’s partial reinstatement for existing recipients. At this writing, the case is before the US Supreme Court, which will determine the program’s fate. Beyond its statistical portrait, the article provides testimonies from DACA recipients who recount how the program improved their lives and their concerns over its possible termination. It also provides recommendations for Congress, local and state governments, and immigration advocates. In particular, it recommends passage of legislation that would create a path to citizenship for DACA recipients and programs and policies to support and empower young immigrants.

Abstract:: This article explores the meaning of military service for Indigenous men who volunteered during the Second World War. At its core, this question can help elucidate what is often the “big why?” invariably asked by people encountering this subject for the first time: why did young Indigenous men fight for a freedom, democracy and equality that they had never experienced? Employing a transnational lens, the article seeks to do interrelated things. First, it examines the meaning of military service for Indigenous men in each of three distinct phases: prior to their enlistment, while serving in the army and in combat, and after demobilisation and transitioning to veterans. Second, this study considers Indigenous perspectives and experiences in relation to, and the broader context of, the non-Indigenous comrades-in-arms with whom they enlisted, served, and sacrificed. In the end, this examination reveals a diversity of interpretations amongst Indigenous soldiers at each stage, but cannot be definitive in the face of such complexity and the ultimately idiosyncratic and personal nature of veterans’ lived experiences.

Abstract:: This paper examines controversies over responses to hybrid warfare ranging from defensive societal and institutional resilience to more aggressive measures, and considers some of the strengths and limits of classic deterrence theory. How Canada and NATO interpret major transformations, and the language of ‘hybrid war’ that they adopt, matter because they influence responses. Reflecting NATO’s rhetoric and policies, Canada has become more internally focused, adopting a ‘whole of government’ and increasingly ‘whole of society’ approach, while at the same time taking more offensive actions and developing new partnerships and capabilities. Canada and NATO are taking significant steps towards ‘comprehensive deterrence’, yet more clarity is needed in how responses are combined to avoid the dangers of hybrid wars with no end.

Abstract:: The United States Army’s leader development program offers new opportunities to examine how leaders are developed within the traditional workforce. Leader development is at the forefront of Army training and is coordinated through an institutional, operational, and self-development domain. Each domain contributes toward a holistic leader development program which prepares soldiers to be lifelong leaders. Veterans transitioning out of the military are often credited as possessing the leadership skills employers seek, though exploration of the process used to develop leadership attributes in soldiers has been minimal. Upon comparing the Army’s leader development program with other private sector leadership development training, similar goals were identified though the Army’s approach is distinguishable. This paper is an analysis of the U.S. Army’s leader development process and makes comparisons with leadership development in the traditional workplace. Three propositions are presented and discussed for leadership scholars and practitioners to consider. The authors also call for increased research and exploration of leader development in the military for transferability into the traditional workplace.

Abstract:: This article sets out to catalogue narration strategies used in the professional discourse about Effects-Based Operations (EBO). EBO was at the heart of the US military transformation (2001-2008) and is one of few concepts officially discontinued instead of being simply replaced by a successor concept making it a crucial case for analysing its rise and fall. An analytical framework for classifying the rhetoric of military innovations is presented in this article. Based on this framework the debate about EBO in the U.S. military journal Joint Force Quarterly between 1996 and 2015 is assessed with a view to three questions: How was EBO framed by military experts? Was the shift of institutional support for EBO reflected in the discourse? And, is there evidence to suggest that the EBO discourse had an influence on the adoption and later discontinuation of EBO? The analysis shows that in the case of EBO a particularly homogenous discourse pattern existed, which might have contributed to the concept’s quick and ultimate demise.

Abstract:: For nearly five decades, Washington and Moscow have engaged in negotiations to manage their nuclear competition. Those negotiations produced a string of acronyms—SALT, INF, START—for arms control agreements that strengthened strategic stability, reduced bloated nuclear arsenals and had a positive impact on the broader bilateral relationship. That is changing. The Intermediate-range Nuclear Forces (INF) Treaty is headed for demise. The New Strategic Arms Reduction Treaty (New START) has less than two years to run, and the administration of Donald Trump has yet to engage on Russian suggestions to extend it. Bilateral strategic stability talks have not been held in 18 months. On its current path, the U.S.-Russia nuclear arms control regime likely will come to an end in 2021. That will make for a strategic relationship that is less stable, less secure and less predictable and will further complicate an already troubled bilateral relationship.

72. After Hanoi: Where do Trump and Kim Go from Here?

Abstract:: There were high expectations at the second meeting of American and North Korean leaders in Vietnam last month after the absence of progress on denuclearization commitments made at the first summit in Singapore last summer. Yet at Hanoi, not only were the two leaders unable to deliver an agreement with tangible steps on denuclearization, but they also dispensed with the joint statement signing, cancelled the ceremonial lunch and skipped the joint press conference. In a solo presser, President Donald Trump said that sometimes you “have to walk, and this was just one of those times.”[2] The President indeed may have avoided getting entrapped into a bad deal at Hanoi. What North Korea put on the table in terms of the Yongbyon nuclear complex addresses a fraction of its growing nuclear program that does not even break the surface of its underlying arsenal and stockpiles of fissile materials, not to mention missile bases and delivery systems. And what North Korea sought in return, in terms of major sanctions relief on five UN Security Council resolutions that target 90 percent of North Korea’s trade, would have removed one of the primary sources of leverage, albeit imperfect, on the regime. In this instance, no deal was better than a bad deal for the United States. Nevertheless, the Hanoi summit has left the United States with no clear diplomatic road ahead on this challenging security problem, a trail of puzzled allies in Asia and the promise of no more made-for-television summit meetings for the foreseeable future. The question remains, where do we go from here? When leaders’ summits fail to reach agreement, diplomacy by definition has reached the end of its rope. President Trump and Secretary of State Mike Pompeo put on the best face they could in Hanoi, talking about closer understanding and continued good relations between the two sides as a result of the meetings, but the failed summit leaves a great deal of uncertainty going forward. South Koreans will frantically seek meetings with Washington and Pyongyang to pick up the pieces. The North Koreans already have sent an envoy to China to chart next steps. While I do not think this will mean a return to the “Fire and Fury” days of 2017 when armed conflict was possible, we have learned numerous lessons from Hanoi for going forward.

Abstract:: Iran’s Supreme Leader Ayatollah Ali Khamenei, a cleric who will turn 80 in July 2019 and has ruled over Iran since 1989, has made a political career out of demonizing the United States. And yet, he knows full well that at some point—whether in his lifetime or after—Tehran has to turn the page and look for ways to end the bad blood that started with the birth of the Islamic Republic in 1979. But Khamenei’s efforts to make the United States a strawman are not easily undone in present-day Tehran, where anti-Americanism is the top political football, as the two main factions inside the regime—the hardliners versus the so-called reformists—battle it out for the future of Iran. Meanwhile, President Donald Trump’s “maximum pressure” on Iran has made it all but impossible for Khamenei to meet Washington half-way. Accordingly, the best Khamenei can do for now is to wait out the Trump White House. There will be no Khamenei-Trump summits. That much is abundantly clear if one listens to the chatter from Tehran. But the issue of possible relations with post-Trump America is still hotly contested in the Islamic Republic. In the meantime, with Trump’s re-imposition of sanctions from November 2018, Tehran’s hope in the short term is that Europe, together with Iran’s more traditional supporters in Moscow and Beijing, can give Iran enough incentive so that it can ride out the next few years as its economy comes under unprecedented pressure.

74. Supporting Prosperity and Competitiveness by Approving the New USMCA

Abstract:: On November 30, the leaders of the United States, Canada and Mexico signed a new trade agreement to succeed the 1994 North American Free Trade Agreement. The United States-Mexico-Canada Agreement (USMCA) modernizes the 25-year-old NAFTA, but the legislatures in all three countries must still approve it.[1] The new USMCA will preserve the massive trading and shared-production networks that support millions of jobs in the U.S., Mexico and Canada and the ability of North America to compete effectively with China, Europe and other economic powers. Approving USMCA this year is very much in the national interests of all three countries given the $1.3 trillion in trade between them and the many businesses, workers and farmers that depend on the commerce and co-production that interlinks North America. These economic relationships also strengthen the rationale for maintaining strong political relationships among the three neighbors. There was widespread agreement to update NAFTA to reflect the changes in trade practices and in the three economies since 1994.[2] NAFTA does not cover Internet-based commerce, for example. Other areas required modernization, including trade in services, protection of intellectual property rights (IPR), environment and labor, which is a priority for U.S. unions.[3] Mexico, Canada and the U.S. tried to accomplish this NAFTA update with negotiation of the Trans-Pacific Partnership (TPP) agreement, but in January 2017 President Donald Trump pulled out of TPP, preferring to renegotiate NAFTA.[4] Approval of USMCA by the U.S. Congress remains uncertain. A number of Democrats are asking for stronger enforcement commitment particularly regarding labor. Others express concern that USMCA provisions may keep some prescription medical costs high.[5] Business and agricultural associations are urging approval of USMCA because it will provide certainty to continue the cross-continental collaboration that preserves vital intra-North American markets for manufacturing, agriculture and services and helps them out-perform global competitors. In response to democrat and union concerns, USMCA’s advocates argue that it includes significantly stronger labor provisions and enforcement.[6] Before the agreement moves ahead, however, the three countries must also find a solution to the tariffs the U.S. put on steel and aluminum from Canada and Mexico in 2018 for “national security” reasons. In response, those countries imposed equivalent tariffs on a range of U.S. exports, spreading economic pain across all three countries.[7] Mexico and Canada, as well as key members of Congress, want this problem resolved before approving USMCA.[8] The U.S. International Trade Commission must also assess USMCA’s economic impact. This report is due in mid-April. The administration must also propose implementation legislation (and guidelines) before Congress formally considers the agreement. Congress will then have a limited time to act on USMCA under existing legislation, but members of Congress could drag the process out.[9] The political window for U.S. congressional approval will close this year, however, given the 2020 U.S. elections.[10] President Trump, USTR Lighthizer and others have begun lobbying for approval, as have Mexico and Canada more quietly. The months ahead will thus be vital for trade and long-term relationships in North America and for the continent’s ability to weather well future international competition. Given the enormous economic benefits of approving USMCA, the U.S. Congress, the Administration and the non-government stakeholders should engage intensively to find ways to address concerns raised and find a “win-win” way to approval. Fortunately, the United States public increasingly views trade in North America as positive. According to the Chicago Council on Global Affairs, for example, those seeing NAFTA and now USMCA as “good” for the U.S. economy have grown significantly, rising from 53 percent in 2017 to 70 percent seeing USMCA as “good” this year. This is a solid foundation for rapid approval of USMCA.[11]

Abstract:: Seeing the words “U.S.-Canada Trade War” in headlines is hard to imagine in any year, but to see them in 2018 was jarring. How is it possible that best friends and neighbors who have had the most successful trading relationship in the world now could have an association characterized by the word war? This is hard enough for the average American or Canadian to conceive of, but it was particularly hard for me to do so, as the U.S. Ambassador to Canada until January 20, 2017. When I left Ottawa, I was confident that the U.S.-Canada relationship was strong—indeed, perhaps never stronger. In March 2016, we had a state dinner in Washington for Prime Minister Justin Trudeau, the first in nearly 20 years. Then-President Barack Obama later repaid the favor and addressed the Canadian Parliament for the first time in more than 20 years. Our two-way trading relationship was valued at a huge $670 billion per year, and while no longer our largest, it was the most balanced, with the United States having a slight but rare trade surplus in goods and services. Through an integrated supply chain, our companies and citizens worked together. On average more than 400,000 people legally crossed our 5,525-mile non-militarized border daily for work and tourism. But the U.S.-Canada relationship was and is much larger than trade. Canadian and American troops have fought and died together from the beaches of Normandy to the mountains of Afghanistan, and our countries are founding members of the North Atlantic Treaty Organization (NATO). The North American Aerospace Defense Command (NORAD)—a unique Canadian-American partnership—patrols the skies above our shared continent. Our intelligence and law enforcement agencies constantly exchange information on threats from terrorism, nuclear proliferation, espionage and complex crimes. Our two countries work together to protect the environment and provide stewardship of the magnificent Great Lakes, where cities such as Toronto and my own Chicago are located. This dense web of mutually beneficial cooperation is based on a shared set of values. Both our countries settled the vast North American continent, providing undreamt-of opportunities to millions of immigrants. Both our countries have an abiding commitment to democracy and the rule of law, and when we fall short, we make the needed changes. Beyond our countries’ being next-door neighbors, the largest number of Americans living abroad live in Canada and the largest number of Canadians living abroad live in the U.S. We are best friends, but more important, we are family.

76. Reaching Georgia's Occupied Territories through Exchanges

Abstract:: In 2018, the U.S. Embassy in Tbilisi initiated people-to-people (P2P) exchanges to the United States for agricultural scientists and university leaders from the Russian-occupied Georgian territory of Abkhazia. An initial study tour in the spring of 2018 focused on mitigating the devastating agricultural damage from the Brown Marmorated Stink Bug (BMSB), and a second tour in the fall of 2018 focused on higher education leadership. Despite political sensitivities and logistical hurdles, such people-to-people programs increase participants’ understanding of the United States and give them an unbiased, first-hand experience of American civil society, its culture of innovation and democratic values. For otherwise isolated Abkhaz thought leaders, these experiences directly counter Russian anti-Western propaganda and demonstrate the benefits of Georgia’s pro-Western choice.

77. Islamic Terrorism and the US Policy for the Resettlement of Syrian Refugees

Abstract:: This article addresses the refusal of US policy, between 2016 and 2017, to resettle Syrian refugees from the Syrian Civil War, which began in 2011 and has forced millions of Syrians to migrate to neighboring countries or to the West. Thus, the hypothesis defended is that the terrorist attacks by Islamic radicals in the US contributed to the increase of prejudice and generalization regarding Arabs and Muslims and, therefore, the Syrian refugees would be conceived as probable threats to the national security. In order to verify this, we present a bibliographical review confirmed by some secondary descriptive data on the perception of the American society on the Syrian and Muslim refugees. The work of Said (1993) on Orientalism, as well as the writings of Huntington (1993, 1997) on the Clash of Civilizations, are used as theoretical reference. Finally, it is concluded that the US refusal to resettle Syrian refugees is mainly due to traumas related to Arabs and Muslims, as well as national security concerns, albeit unfounded.

Abstract:: This article analyses the trends of India’s foreign policy in recent years under the light of political and economic dynamics, with a focus in its regional surrounding. The text locates an inflection towards economic liberalization undertaken in the beginning of the 1990´s, and then moves on to the context of economic expansion in the 21st century. The achievements and limits of those processes are taken into consideration. In the political realm, as the legitimacy of the Indian National Congress (INC) was brought to check, so was its hegemony, in a process that has favored the rise of political agencies identified with hindu nationalism and communalism, such as the BJP. Overall, the hallmarks of Indian politics that prevailed since independence under leadership of the Congress Party are left behind: economic nationalism, secular politics, and international non-alignment. In this context, the broad orientation of Indian foreign policy also has changed. The text analyses the consequences of this inflection in the regional context, focusing the Neighbors first policy and the priority given to infrastructural connectivity with Southeast Asia (Look East and Act East policies), as well as the recent intensification of business in the African continent. Altogether, the expectations of an alternative civilizatory horizon in the context of the Cold War which has nurtured Nehruvian politics, has given place to a pragmatic rationality that accepts the United States leadership and as such, draws strategies adapting to the mercantile trends that typify globalisation.

Abstract:: The issue of the Falklands catalyzes the attention of researchers in studies of the military presence of extraregional actors in South America. However, France, a state equally exogenous to the South American nations, is present in the region, keeping a colonial territory, where contingents and military installations are located, almost always ignored in regional security studies. In this context, this paper aims to highlight the military presence of France and the United Kingdom in America and South Atlantic, and to analyze the tensions arising from this presence in relation to the regional Brazilian view of defense.

Abstract:: n the division of labor that Craig Calhoun and I agreed upon, he's going to deal with the insidious threats, the subtler ones, the ones that are perhaps characteristic of American or North Atlantic academic life, and I'm going to deal with the straight on, in your face, “boom boom” threats that have arisen where I am in Hungary. I'm going to tell you a little narrative about what's happened to Central European University (CEU), and then I'd like to talk about a characterization of these kinds of societies. The relationship between a place like Hungary and a place like here is complex. There is a collusive relationship, a disturbingly collusive relationship between liberal democratic societies, which enjoy full academic freedom, and societies which do not. And it's that collusive relationship that I think we need to think about. That will be my headline. Most of you will know that CEU is a graduate institution offering masters and PhDs, accredited in New York state and by Middle States. We offer degrees that are accredited also by the Hungarian administration. So we're a kind of European-American institution. We're one of almost thirty institutions of higher learning around the world that have no domestic US campus. But note, this is the geostrategic implication: these institutions are now implanted all over the world in authoritarian societies where their capacity to operate freely is very much in question. So my story about Hungary is not just a story about Hungary. It's potentially a story about Egypt, about Russia, about Abu Dhabi—about all the places where American norms of academic freedom are suddenly under challenge because of the emergence of these kinds of regimes.

81. The Marketization of Citizenship in an Age of Restrictionism

Abstract:: Tough action and rhetoric are the stamp of U.S. President Donald Trump’s immigration policy. The decision in September 2017 to revoke the Deferred Action for Childhood Arrivals (DACA)—a program that shields young undocumented immigrants (“Dreamers”) from removal, granting them an opportunity to complete school, enroll in college, volunteer for the armed services, or join the workforce—proved to be the most contentious in a groundswell of executive orders, directives, memos, and wide-ranging enforcement efforts to curtail unauthorized presence.1 Critics describe such sweeping measures as amounting to an anti-immigrant crusade. Supporters, meanwhile, applaud them as taking the handcuffs off immigration enforcement officers and border patrol agents. With the rising tide of restrictionism and the government’s tough-on-immigration approach under the rubric of a “nation of laws,” it is easy to lose sight of the only immigration program that has been renewed and extended under the Trump administration: the EB-5 program, or the “golden visa.”2 The contrast between the DACA “Dreamers” and the EB-5 “Parachuters” reveals the sharp edge, and deep injustices, of current policies. In 2017 the president signed into law and renewed the extension of the EB-5 program, which offers the world’s wealthy a coveted path to securing lawful permanent residence (LPR) status, jumping the queue and gaining an easy pass through the otherwise increasingly bolted gates of admission. The price tag for securing a green card via the EB-5 program ranges from $1 million to a “discounted” rate of $500,000 if funds are for specially designated rural areas or areas of high unemployment.3 The American golden visa, like comparable schemes in other desirable destination countries, caters to the global 1 percent. It treats money transfers—in large quantities—as a currency for acquiring entry visas, residence permits, and, ultimately, citizenship itself. Unlike the Dreamers, who now face the risk of deportation from the only country they have ever known as home, these visa applicants have no prior “bona fide relationship with a person or entity in the United States.”4 Instead, they gain a privileged route to enter the United States and remain lawfully in the country based on their ability to transfer capital across borders. The contrast between the DACA “Dreamers” and the EB-5 “Parachuters” reveals the sharp edge, and deep injustices, of current policies. The former have already become part of the fabric of the United States—including its society and economy—through their ongoing, peaceful, and productive presence, yet the sword of deportation continues to hang over their heads. On the other hand, the latter benefit from expedited and simplified pathways to obtain full-fledged legal membership, even if they fail to establish any tangible connections to their new home country. The intrusion of market logic into the sovereign act of defining “who belongs” raises significant justice and equality concerns that require closer scrutiny. The United States is not alone in testing, blurring, and eroding the state-market boundary regulating access to membership. A growing number of countries are putting their visas and passports up for sale. The proliferation of these programs is one of the most significant developments in citizenship and immigration practice in the past few decades, yet it has received scant attention in the literature. In the following pages, I begin to address this lacuna by identifying the core legal and normative puzzles associated with this new trend, which I will refer to as the marketization of citizenship to highlight a dual transformation: the commodifying of access to membership and the hollowing out of the “status, rights, and identity” components of citizenship.5 Marketization is never merely an economic process; it is also deeply political, as it reshapes and reengineers the boundaries of and interactions between states and markets, voice and power, the inviolable and the mercantile. The intrusion of market logic into the sovereign act of defining “who belongs” raises significant justice and equality concerns that require closer scrutiny, both empirical and normative—the remit of this essay. I treat these new developments as a productive site to explore foundational questions about the character of citizenship and its transformation in today’s world. I begin by tracing the global surge in the marketization of citizenship, providing illustrative examples, before turning to explore the official rationales for the EB-5 and exposing their shortcomings. Moving from the positive to the normative, I develop several lines of critique that seek to show that this new trend is uniquely threatening to notions of citizenship reflecting the horizon of equality and participation, regardless of which theories of state and society—liberal, civic republican, or democratic—inform them.

82. The Response of the American Jewish Joint Distribution Committee to the Crisis of Soviet Jewish Émigré Dropouts (Noshrim) in the 1970s

Abstract:: The JDC is an American Jewish organization that assists overseas Jewish commu- nities in distress. It is responsible to “American Jewry” and those organizations that fund it. Bauer (1974, 19) argued that the JDC has been guided by its founding “pledge of impartiality – it steers clear of political involvements” and takes pride in being “probably the only really non-partisan organization in Jewish life.” This paper examines the role of the JDC in caring for Soviet émigrés who left on visas for Israel but chose to resettle elsewhere. They were known as “dropouts” (Noshrim in Hebrew). It also deals with the JDC policy toward recently settled Russian Jews who left Israel to resettle elsewhere. In its work with Soviet Jewish emi- gres did the JDC serve the interests of the Israeli government, its donors and or the emigres? Did the JDC abide by its pledge of impartiality? Did the JDC try to force them to resettle in Israel against their wishes? The paper focuses on the spring of 1976 when the number of dropouts outnumbered those resettling in Israel. This led to a joint committee of Israelis and American Jews to coordinate a response. The ‘freedom of choice’ debate ensued; should So- viet Jews resettle in Israel or have the freedom to choose where to resettle? The findings here are based on archival records in the JDC, the Hebrew Immigrant Aid Society (HIAS), the CJF (Jewish federations) and the American Jewish Committee (AJC). The author also conducted interviews and reviewed secondary sources. The paper should contribute to a better under- standing of the JDC and its past ties to Israel and the American Jewish community.

83. Understanding the Dispute over the Treatment of Products Exported to the European Union from the Occupied Territories in the Context of the Transatlantic Trade and Investment Partnership

Abstract:: While the European Union (EU) does not recognize any legal Israeli sovereignty over the territories occupied by Israel in 1967, it does not grant preferential access to the EU market for goods produced in the Israeli settlements in this area, contrary to the preferential treatment for goods produced in Israel. This situation is different, however, as regards the United States (U.S.) trade policy, which does not make any distinction between goods pro- duced in Israel and in the Occupied Territories, since it grants the preferential access to both. Furthermore, the currently suspended negotiations of the super-regional trade agreement called the Transatlantic Trade and Investment Partnership (TTIP), spurred the enacting of a law that set the principal negotiating objectives of the U.S. regarding commercial partner- ships, which included some provisions to discourage politically motivated economic actions against the State of Israel. As TTIP embraced the free trade agreement between the EU and the U.S., the EU differentiation policy could become problematic for the two partners, which despite the failure of the negotiations, revealed much about economic diplomacy. Conse- quently, this article attempts to show the different approaches adopted by the two trading powers, in order to deal with the dispute over the treatment of products exported to the EU from the Occupied Territories.

85. Time to Yell “Cut?” An Evaluation of the California Film and Production Tax Credit for the Motion Picture Industry

Abstract:: Enacted in 2009, California’s Film and Production Tax Credit was a policy reaction to fears that the state had lost motion picture industry jobs to other states and countries. The incentive has since been allocated over $1 billion in taxpayer funding. Advocates hail the tax credit as a success, but is there evidence to support that claim? This study examines motion picture industry employment in California from 1991 through 2016 to determine the impact of the Film and Production Tax Credit and competing incentives offered by other governments. Results show the tax credit had no significant effect on changes in three occupational categories associated with the motion picture industry. Employment was similarly unaffected by competing incentives. Motion picture industry employment in California instead appears to track the national labor market. These findings were robust to several alternative measures and model specifications and advise that California policymakers should eliminate the Film and Production Tax Credit as soon as possible.

86. Tuition as a Path for Affordability? The Pursuit of a Progressive Tuition Model at the University of California

Abstract:: In an environment of declining public funding and rising tuition rates, many public universities in the US are moving toward a “progressive tuition model” that attempts to invest approximately one-third of tuition income into institutional financial aid for lower-income and middle-class students. The objective is to mitigate the cost of rising tuition and keep college affordable. But is this model as currently formulated working? Utilizing data from the Student Experience in the Research University (SERU) Survey of undergraduates and other data sources, this study explores these issues by focusing on students at the University of California (UC) and 10 research-intensive public institutions that are members of the SERU Consortium. Focusing mostly on survey data from 2014, we find that increases in tuition, and costs related to housing and other living expenses, have not had a significant negative impact on the number of lower-income students attending UC or on their behaviors. Since the onset of the Great Recession, there has been an actual increase in their number—a counterintuitive finding to the general perception that higher tuition equals less access for the economically vulnerable. At the same time, there is evidence of a “middle-class” squeeze, with a marginal drop in the number of students from this economic class. With these and other nuances and caveats discussed in this study, the progressive tuition model appears to have worked in terms of affordability and with only moderate indicators of increased financial stress and changed student behaviors. This study indicates that tuition can and should be a part of the search for a viable funding model for many public universities, like UC, and that demanding lower or no tuition does not appear to be based on any substantial analysis of the correlation of tuition and affordability.

Abstract:: In 2014, California passed the Ballot Initiative Transparency Act (SB 1253, or BITA) which provided some of the biggest changes to California’s ballot initiative process in recent decades. BITA went into effect for the first time during the 2016 election cycle and was designed to provide more opportunities for legislative compromise and to allow for more public involvement in the ballot initiative process. Our study examines BITA and its impact on the ballot initiative process. Specifically, we sought to understand the extent of BITA’s impact on influencing the state legislature and the initiative proponents to seek legislative compromise. Furthermore, we examine the implementation of the new mechanisms BITA put in place and offer suggestions for how to potentially improve their effectiveness for future elections.

88. Allocating Transportation Revenues to Support Climate Policies in California and Beyond

Abstract:: California has established itself as a leader in efforts to reduce greenhouse gas emissions from transportation. However, the state has not reflected its ambitious policies for greenhouse gas (GHG) reduction and climate action in its practices for allocating state transportation funding. This paper reviews the complex systems through which California generates and allocates state revenue for transportation investment. It finds that the state’s framework for funding transportation projects and programs is disconnected from its GHG goals, reflective more of historical political deals than of contemporary climate policy. The paper also suggests preliminary steps for revising this framework to reinforce GHG reduction goals. Such recommendations are particularly salient given the state’s recently completed study of road user charges as an alternative transportation revenue source, as well as the passage of new legislation that restructures the state’s fuel taxes (Senate Bill 1, 2017). Implementation of road charges or any other new or revised transportation revenue source would need to address the disposition of revenues generated. This paper argues that California should use any such opportunity to align the distribution of state transportation dollars with its climate objectives, not fall back on status quo allocation practices.

89. Campaigning in Lilliput: Money’s Influence in Small and Mid-Sized City Elections

Abstract:: Research on federal, state and big-city elections has concluded that campaign spending is a necessary but not sufficient condition for electoral success: even though the best financed candidates do not always win, aspirants for office need to raise and spend funds to mount competitive campaigns. But scholars have not explored whether this pattern holds in small to mid-sized cities. Money influences elections in all jurisdictions, but it is plausible that as cities get smaller campaign finance dynamics change. In this paper I explore whether campaign finance dynamics are different in small and mid-sized cities, using a dataset of 61 California cities. Despite reason to think that they will vary, I find that campaign finance patterns are similar across cities of various sizes. Few city council candidates are able to mount credible campaigns without money, even in small cities. Incumbents enjoy high re-election rates across all cities, and levels of competition may even decrease with constituency size.

90. Does More Choice Lead to Reduced Racially Polarized Voting? Assessing the Impact of Ranked-Choice Voting in Mayoral Elections

Abstract:: Politics in American cities is largely driven by racial group cleavages, and voting in urban elections is polarized along racial lines. Several cities have implemented a relatively new reform to urban elections called ranked-choice voting (RCV), which eliminates the plurality run-off election by giving voters the option to rank-order several vote preferences. This article examines whether the expanded preference choices associated with ranked-choice voting reduce the level of racially polarized voting in mayoral elections. In the first stage of analysis, precinct-level election results from Oakland, CA, and San Francisco, CA, are used to explore variation in racially polarized voting before and after the implementation of RCV. The second stage of analysis uses a difference-in-differences design to analyze racially polarized voting in RCV cities compared to non-RCV cities. The results indicate that racially polarized voting did not decrease due to the implementation of RCV. Rather, the results show that RCV contributed to higher levels of racially polarized voting between white and Asian voters.

Abstract:: The adoption of the top two primary system in California is resulting in a rising number of general elections in which candidates from the same party compete. Incidentally, California is also home to a large and diverse Latino community. When party identification is no longer a reliable cue, do Latino voters turn to the race or ethnicity of a candidate in selecting whom to support? We examine co-partisan Republican general elections in California’s state assembly from 2012‒2016. Using surname-matched precinct-level voter data, we conduct ecological inference analysis to estimate support for candidates based on the ethnicity of voters. Taking the case of Latino voters, we find a strong level of support for Latino Republican candidates, suggesting that a candidate’s ethnicity may inform voters’ strategic decision making in partisan elections.

Abstract:: On July 9, 2002, Governor Gray Davis signed the California Voting Rights Act (CVRA) into law. The intent of the CVRA was to build upon the voting rights protections embodied in the Federal Voting Rights Act (FVRA) by enhancing the influence of minority populations in local government elections. The CVRA has led to multiple legal challenges of at-large electoral systems in dozens of governments in California. This paper explores the impacts of the CVRA on local governments as well as potential impacts of recent changes to the CVRA.

Abstract:: With the expansion of US-led economic policy following the economic depression of the 1970s and the proliferation of new information and communication technologies, the 1980s became a crucial period signaling dramatic changes all around the world. By the end of these years, the Keynesian economy, which accredited states as active and interventionist players in the economy in order to ensure both growth and equity, began to break down. In this period economic liberalism gained power again and political and economic theories and practices turned towards neoliberalism. As a result, deregulation, privatization and the withdrawal of the state from many areas were accelerated. All these changes were significant and affected the structure of almost everything, including education, culture, life and trends in thought. Friedrich A. von Hayek was one of the pioneers of this transformation. Therefore, this descriptive study attempts to understand the points where neoliberalism combines with liberalism and how it is separated from liberalism through Hayek's views about the welfare state, legislative body, social justice, and competition terms. Abstract:: The Doha Ministerial Declaration on the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement and Public Health adopted in November 2001 clarified the right to use the TRIPS flexibilities to promote public health. Examining the hegemonic struggle of opposing social forces from a neo-Gramscian perspective, the paper attributes this outcome to the strategy of trasformismo used by market-oriented social forces to legitimize the policies of the World Trade Organization (WTO) and prevent resistance against the market-driven TRIPS Agreement. It argues that although non-governmental organizations (NGOs) such as Medecins Sans Frontieres, Third World Network, and Oxfam worked as a counter-hegemonic force to ensure the access of least developed countries to generic versions of patented drugs, flexibilities confirmed by the Doha Declaration can be seen more as a strategy of trasformismo to absorb counter-hegemonic ideas than the counter-hegemonic groups’ successful incorporation of the right to ensure public health into the TRIPS Agreement.

95. Immigration and the War on Crime: Law and Order Politics and the Illegal Immigration Reform and Immigrant Responsibility Act of 1996

Abstract:: The 1996 Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) was a momentous law that recast undocumented immigration as a crime and fused immigration enforcement with crime control (García Hernández 2016; Lind 2016). Among its most controversial provisions, the law expanded the crimes, broadly defined, for which immigrants could be deported and legal permanent residency status revoked. The law instituted fast-track deportations and mandatory detention for immigrants with convictions. It restricted access to relief from deportation. It constrained the review of immigration court decisions and imposed barriers for filing class action lawsuits against the former US Immigration and Naturalization Service (INS). It provided for the development of biometric technologies to track “criminal aliens” and authorized the former INS to deputize state and local police and sheriff’s departments to enforce immigration law (Guttentag 1997a; Migration News 1997a, 1997b, 1997c; Taylor 1997). In short, it put into law many of the punitive provisions associated with the criminalization of migration today. Legal scholars have documented the critical role that IIRIRA played in fundamentally transforming immigration enforcement, laying the groundwork for an emerging field of “crimmigration” (Morris 1997; Morawetz 1998, 2000; Kanstroom 2000; Miller 2003; Welch 2003; Stumpf 2006). These studies challenged the law’s deportation and mandatory detention provisions, as well as its constraints on judicial review. And they exposed the law’s widespread consequences, namely the deportations that ensued and the disproportionate impact of IIRIRA’s enforcement measures on immigrants with longstanding ties to the United States (ABA 2004). Less is known about what drove IIRIRA’s criminal provisions or how immigration came to be viewed through a lens of criminality in the first place. Scholars have mostly looked within the immigration policy arena for answers, focusing on immigration reform and the “new nativism” that peaked in the early nineties (Perea 1997; Jacobson 2008).Some studies have focused on interest group competition, particularly immigration restrictionists’ prohibitions on welfare benefits, while others have examined constructions of immigrants as a social threat (Chavez 2001; Nevins 2002, 2010; Newton 2008; Tichenor 2009; Bosworth and Kaufman 2011; Zatz and Rodriguez 2015). Surprisingly few studies have stepped outside the immigration policy arena to examine the role of crime politics and the policies of mass incarceration. Of these, scholars suggest that IIRIRA’s most punitive provisions stem from a “new penology” in the criminal justice system, characterized by discourses and practices designed to predict dangerousness and to manage risk (Feeley and Simon 1992; Miller 2003; Stumpf 2006; Welch 2012). Yet historical connections between the punitive turn in the criminal justice and immigration systems have yet to be disentangled and laid bare. Certainly, nativist fears about unauthorized migration, national security, and demographic change were important factors shaping IIRIRA’s criminal provisions, but this article argues that the crime politics advanced by the Republican Party (or the “Grand Old Party,” GOP) and the Democratic Party also played an undeniable and understudied role. The first part of the analysis examines policies of mass incarceration and the crime politics of the GOP under the Reagan administration. The second half focuses on the crime politics of the Democratic Party that recast undocumented migration as a crime and culminated in passage of IIRIRA under the Clinton administration. IIRIRA’s criminal provisions continue to shape debates on the relationship between immigration and crime, the crimes that should provide grounds for expulsion from the United States, and the use of detention in deportation proceedings for those with criminal convictions. This essay considers the ways in which the War on Crime — specifically the failed mass incarceration policies — reshaped the immigration debate. It sheds light on the under-studied role that crime politics of the GOP and the Democratic Party played in shaping IIRIRA — specifically its criminal provisions, which linked unauthorized migration with criminality, and fundamentally restructured immigration enforcement and infused it with the resources necessary to track, detain, and deport broad categories of immigrants, not just those with convictions.

96. DREAM Act-Eligible Poised to Build on the Investments Made in Them

Abstract:: This paper presents the results of a study by the Center for Migration Studies (CMS) on potential beneficiaries of the DREAM Act of 2017 (the “DREAM Act” or “Act”). The study reveals a long-term, highly productive population, with deep ties to the United States. In particular, it finds that: More than 2.2 million US residents would qualify for conditional residence under the DREAM Act. An additional 929,000 — who are now age 18 and over — arrived when they were under 18, but have not graduated from high school and are not enrolled in school and, thus, would not currently qualify for status under the Act. The DREAM Act-eligible can be found in large numbers (5,000 or more) in 41 states and more than 30 counties, metropolitan areas, and cities. Potential DREAM Act recipients have lived in the United States for an average of 14 years. Sixty-five percent (age 16 and above) participate in the labor force, with far higher rates in Wisconsin, Massachusetts, Utah, Arkansas, Illinois, Tennessee, and Oregon. This population works heavily in sales and related occupations; food preparation and serving; construction and extracting; office and administrative support; production; transportation and material moving; and building/grounds cleaning and maintenance. Many of the DREAM Act-eligible are highly skilled and credentialed. 70,500 are self-employed. Eighty-eight percent speaks English exclusively, very well, or well. 392,500 have US-citizen children, and more than 100,000 are married to a US citizen or lawful permanent resident. Twenty-nine percent has attended college or received a college degree. The DREAM Act-eligible include 50,700 Temporary Protected Status (TPS) recipients from El Salvador, Haiti, and Honduras, 45 percent of whom live in the Miami metro area, Los Angeles County, the Washington, DC area, Houston, New York City, the San Francisco metro area, and the City of Dallas. The study also underscores the immense investment — $150 billion — that states and localities have already made in educating these young Americans. It argues that over time and with a path to citizenship the return on this investment will increase by virtually every indicia of integration — education levels, employment rates, self-employment numbers, US family members, and English language proficiency.

97. Twenty Years After IIRIRA: The Rise of Immigrant Detention and Its Effects on Latinx Communities Across the Nation

Abstract:: This paper studies the dynamics of detention, deportation, and the criminalization of immigrants. We ground our analyses and discussion around the Illegal Immigration Reform and Immigrant Responsibility Act of 1996’s (IIRIRA’s) detention mandate, the role of special interest groups and federal policies. We argue that these special interest groups and major federal policies have come together to fuel the expansion of immigrant detention to unprecedented levels. Moreover, we aim to incite discussion on what this rapid growth in detention means for human rights, legislative representation and democracy in the United States. This study analyzes two main questions: What is the role of special interests in the criminalization of immigrants? And does the rapid increase in detention pose challenges or risks to democracy in the United States? Our study is grounded within the limited, yet growing literature on immigrant detention, government data, and “gray” literature produced by nonprofits and organizations working on immigration-related issues. We construct a unique dataset using this literature and congressional reports to assess what factors are associated with the rise of immigrant detention. A series of correlations and a time series regression analysis reveal that major restrictive federal immigration policies such as IIRIRA, along with the increasing federal immigration enforcement budget, have had a significant impact on immigrant detention rates. Based on these findings, we recommend three central policy actions. First, the paper recommends increased transparency and accountability on behalf of the Department of Homeland Security, Immigration and Customs Enforcement, and on lobbying expenditures from for-profit detention corporations. Second, it argues for the repeal of mandatory detention laws. These mandatory laws have led to the further criminalization and marginalization of undocumented immigrants. And lastly, it argues that repeal of the Congressional bed mandate would allow for the number of detainees to mirror actual detention needs, rather than providing an incentive to detain. However, we anticipate that the demand for beds will increase even more given the current administration’s push for the criminalization and increased arrests of undocumented individuals. The rhetoric used by the present administration further criminalizes immigrants.

Abstract:: The governance of immigration has a checkered past, and policy makers’ efforts at reform rarely meet expectations. Critiques have echoed over the years and across the political spectrum. The current system of immigration governance is scattered around the federal government, with no clear chain of command. No single government department or agency captures the breadth of the Immigration and Nationality Act’s reach. At the crux of understanding immigration governance is acknowledging that immigration is not a program to be administered; rather, it is a phenomenon to be managed. The abundance of commissions that have studied the issues and the various administrative structures over time offers some wisdom on ingredients for successful governance. Based upon this research, options for effective immigration governance emerge. This paper studies the administration of immigration law and policy with an eye trained on immigration governance for the future. It opens with a historical overview that provides the backdrop for the current state of affairs. It then breaks down the missions and functions of the Immigration and Nationality Act by the lead agencies tasked with these responsibilities. The paper concludes with an analysis of options for improving immigration governance. Each of these options poses unique challenges as well as political obstacles.

99. Predicting Unauthorized Salvadoran Migrants’ First Migration to the United States between 1965 and 2007

Abstract:: Although Salvadoran emigration to the United States is one of the most important migratory flows emanating from Latin America, there is insufficient information about the predictors of first unauthorized migration from El Salvador to the United States. In this study, we use data from the Latin American Migration Project–El Salvador (LAMP-ELS4) to perform an event history analysis to discern the factors that influenced the likelihood that a Salvadoran household head would take a first unauthorized trip to the United States between 1965 and 2007. We take into account a series of demographic, social capital, human capital, and physical capital characteristics of the Salvadoran household head; demographic and social context variables in the place of origin; as well as economic and border security factors at the place of destination. Our findings suggest that an increase in the Salvadoran civil violence index and a personal economic crisis increased the likelihood of first-time unauthorized migration. Salvadorans who were less likely to take a first unauthorized trip were business owners, those employed in skilled occupations, and persons with more years of experience in the labor force. Contextual variables in the United States, such as a high unemployment rate and an increase in the Border Patrol budget, deterred the decision to take a first unauthorized trip. Finally, social capital had no effect on the decision to migrate; this means that for unauthorized Salvadoran migrants, having contacts in the United States is not the main driver to start a migration journey to the United States. We suggest as policy recommendations that the United States should award Salvadorans more work-related visas or asylum protection. For those Salvadorans whose Temporary Protected Status (TPS) has ended, the United States should allow them to apply for permanent residency. The decision not to continue to extend TPS to Salvadorans will only increase the number of unauthorized immigrants in the United States. The United States needs to revise its current immigration policies, which make it a very difficult and/or extremely lengthy process for Salvadorans and other immigrants to regularize their current immigration status in the United States. Furthermore, because of our research findings, we recommend that the Salvadoran government — to discourage out-migration — invest in high-skilled job training and also offer training and credit opportunities to its population to encourage business ventures.

100. Immigration Detention, Inc.

Abstract:: This article addresses the influence of economic inequality on immigration detention. The US Department of Homeland Security (DHS) detains roughly 350,000 migrants each year and maintains more than 30,000 beds each day. This massive detention system raises issues of economic power and powerlessness. This article connects, for the first time, the influence of economic inequality on system-wide immigration detention policy as well as on individual detention decisions. The article begins with a description of the systemic impact that for-profit prisons have had on the federal immigration detention system, by promoting wide-scale detention. The resulting expansion of detention has led to ever-increasing profitability for the private for-profit prison sector, which allows the companies to exercise even more influence over policymakers to achieve yet higher levels of detention. The influence of wealthy private prison corporations also affects the very nature of immigration detention, leading to the use of jail-like facilities that are the product offered by the private prison industry. The article then describes the mechanisms by which economic inequality dictates the likelihood and length of detention in individual cases. The detention or release decisions made by DHS in individual cases must account for the need to keep numerous detention beds full to satisfy the contracts made with powerful private prison companies. DHS regularly sets bond amounts at levels that are not correlated to flight risk or danger, but rather to the length of time that the individual must be held in detention to keep the available space full. The article presents data, obtained from immigration authorities, regarding detention and bond patterns at a specific detention center that demonstrate this point. The research finds an inverse relationship between the number of newly arriving immigrants in the detention center and the bond amounts set by US Immigration and Customs Enforcement (ICE). During times when new arrivals were few, the amount required to be released from detention on bond was high; during times when there were many new arrivals, bond amounts were reduced or set at zero. The article also presents another way in which economic inequality affects the likelihood of detention at the individual level. Release and detention are largely controlled through the use of monetary bond requirements, which must be paid in full. The regular use of financial bonds as the exclusive mechanism for release means that those migrants who are most able to pay are most likely to be released, without regard to their likelihood of absconding or endangering the community. Wealth thus determines detention rather than an individualized determination of the necessity of depriving an individual of liberty. The article urges that the role of economic inequality in immigration detention raises troubling issues of democratic governance and the commodification of traditional governmental functions. The current system also leads to an unjustifiable redistribution of wealth from the poor to the rich. Looking at immigration detention through the lens of economic inequality offers new lines of theoretical inquiry into immigration detention. It connects the discussion of immigration detention to scholarly critiques of for-profit prisons and the privatization of state security functions more generally. It also brings a new perspective to prior work in the immigration and criminal justice contexts, questioning the fairness and utility of requiring payment of monetary bonds to obtain liberty from detention. The article concludes with recommendations for reform. These reforms would help to sideline the influence of economic inequality in immigration detention decision making.
