35701. The Cost and Cost-Effectiveness of Alternative Strategies to Expand Treatment to HIV-Positive South Africans: Scale Economies and Outreach Costs

Abstract:: The South African government is currently discussing various alternative approaches to the further expansion of antiretroviral treatment (ART) in public-sector facilities. Alternatives under consideration include the criteria under which a patient would be eligible for free care, the level of coverage with testing and care, how much of the care will be delivered in small facilities located closer to the patients, and how to assure linkage to care and subsequent adherence by ART patients. We used the EMOD-HIV model to generate 12 epidemiological scenarios. The EMOD-HIV model is a model of HIV transmission which projects South African HIV incidence and prevalence and ARV treatment by age group for alternative combinations of treatment eligibility criteria and testing. We treat as sunk costs the projected future cost of one of these 12 scenarios, the baseline scenario characterizing South Africa's 2013 policy to treat people with CD4 counts less than 350. We compute the cost and benefits of the other 11 scenarios relative to this baseline. Starting with our own bottom-up cost analyses in South Africa, we separate outpatient cost into non-scale-dependent costs (drugs and laboratory tests) and scale-dependent cost (staff, space, equipment and overheads) and model the cost of production according to the expected future number and size of clinics. On the demand side, we include the cost of creating and sustaining the projected incremental demand for testing and treatment. Previous research with EMOD-HIV has shown that more vigorous recruitment of patients with CD4 counts less than 350 appears to be an advantageous policy over a five-year horizon. Over 20 years, however, the model assumption that a person on treatment is 92 percent less infectious improves the cost-effectiveness of higher eligibility thresholds over more vigorous recruitment at the lower threshold of 350, averting HIV infections for between $1,700 and $2,800 (under our central assumptions), while more vigorous expansion under the current guidelines would cost more than $7,500 per incremental HIV infection averted. Granular spatial models of demand and cost facilitate the optimal targeting of new facility construction and outreach services. Based on analysis of the sensitivity of the results to 1,728 alternative parameter combinations at each of four discount rates, we conclude that better knowledge of the behavioral elasticities would be valuable, reducing the uncertainty of cost estimates by a factor of 4 to 10

35703. Do Mobile Phone Surveys Work in Poor Countries?

Abstract:: In this project, we analyzed whether mobile phone-based surveys are a feasible and cost-effective approach for gathering statistically representative information in four low-income countries (Afghanistan, Ethiopia, Mozambique, and Zimbabwe). Specifically, we focused on three primary research questions. First, can the mobile phone survey platform reach a nationally representative sample? Second, to what extent does linguistic fractionalization affect the ability to produce a representative sample? Third, how effectively does monetary compensation impact survey completion patterns? We find that samples from countries with higher mobile penetration rates more closely resembled the actual population. After weighting on demographic variables, sample imprecision was a challenge in the two lower feasibility countries (Ethiopia and Mozambique) with a sampling error of +/- 5 to 7 percent, while Zimbabwe's estimates were more precise (sampling error of +/- 2.8 percent). Surveys performed reasonably well in reaching poor demographics, especially in Afghanistan and Zimbabwe. Rural women were consistently under-represented in the country samples, especially in Afghanistan and Ethiopia. Countries' linguistic fractionalization may influence the ability to obtain nationally representative samples, although a material effect was difficult to discern through penetration rates and market composition. Although the experimentation design of the incentive compensation plan was compromised in Ethiopia and Zimbabwe, it seems that offering compensation for survey completion mitigated attrition rates in several of the pilot countries while not reducing overall costs. These effects varied across countries and cultural settings.

35704. Fiscal Policy, Inequality, and the Ethnic Divide in Guatemala

Abstract:: Guatemala is one of the most unequal countries in Latin America and has the highest incidence of poverty. The indigenous population is more than twice as likely to be poor than the nonindigenous group. Fiscal incidence analysis based on the 2009-2010 National Survey of Family Income and Expenditures shows that taxes and transfers do almost nothing to reduce inequality and poverty overall or along ethnic and rural-urban lines. Persistently low tax revenues are the main limiting factor. Tax revenues are not only low but also regressive. Consumption taxes are regressive enough to offset the benefits of cash transfers: poverty after taxes and cash transfers is higher than market income poverty.

35705. Trade, Migration, and the Place Premium: Mexico and the United States

Abstract:: Large wage differences between countries (“place premiums”) are well documented. Theory suggests that factor price convergence should follow increased migration, capital flows, and commercial integration. All three have characterized the relationship between the United States and Mexico over the last 25 years. This paper evaluates the degree of wage convergence between these countries during the period 1988 and 2011. We match survey and census data from Mexico and the United States to estimate the change in wage differentials for observationally identical workers over time. We find very little evidence of convergence. What evidence we do find is most likely due to factors unrelated to US-Mexico integration. While migration and trade liberalization may reduce the US-Mexico wage differential, these effects are small when compared to the overall wage gap.

Abstract:: This paper looks at the impact of corruption on the effectiveness of antiretroviral drugs in preventing AIDS deaths and the potential channels that generate this relationship. This is based on a unique panel dataset of countries in sub-Saharan Africa, which combines information on all imported antiretroviral drugs (ARVs) from the World Health Organization's Global Price Reporting Mechanism with measures of corruption and estimates of the HIV prevalence and the number of AIDS deaths in each year and in each country. Countries with higher levels of corruption experience a significantly smaller drop in AIDS deaths as a result of the same quantity of ARVs imported. This is robust to different measures of corruption and to a measure of overall death rates as well as HIV-specific death rates as the outcome. A case-study analysis of the Kenyan experience illustrates one potential mechanism for the observed effect, demonstrating that disproportionately more clinics begin distributing ARVs in areas that are predominantly represented by the new leader's ethnic group.

35707. The Face of African Infrastructure: Service Availability and Citizens' Demands

Abstract:: The need for infrastructure improvements is a top-tier economic, political, and social issue in nearly every African country. Although the academic and policy literature is extensive in terms of estimating the impact of infrastructure deficits on economic and social indicators, very few studies have examined citizen demands for infrastructure. In this paper, we draw upon survey data to move beyond topline estimates of national infrastructure access rates towards a more nuanced understanding of service availability and citizen demands at the regional, national, and sub-national level. We find a predictable pattern of infrastructure services across income levels—lower income countries have fewer services. The survey data also allows us to observe the sequencing of infrastructure services. On the demand side, survey respondents are most concerned with jobs and income-related issues, as well as with the availability of infrastructure: specifically transportation and sanitation. These priorities transcend demographic factors, including gender and location (urban/rural).

Abstract:: Violence in the Darfur region of Sudan's far west continues unabated. Some 450,000 persons were displaced in 2014 and another 100,000 in January 2015 alone, adding to some two million long-term internally displaced persons (IDPs) since fighting erupted in 2003. The government remains wedded to a military approach and reluctant to pursue a negotiated national solution that would address all Sudan's conflicts at once and put the country on the path of a democratic transition. Khartoum's reliance on a militia-centred counter-insurgency strategy is increasingly counter-productive – not least because it stokes and spreads communal violence. Ending Darfur's violence will require – beyond countrywide negotiations between Khartoum, the rebel Sudanese Revolutionary Front (SRF) coalition and unarmed players – ad-dressing its local dimensions, within both national talks and parallel local processes.

35709. Myanmar's Electoral Landscape

Abstract:: Myanmar is preparing to hold national elections in early November 2015, five years after the last full set of polls brought the semi-civilian reformist government to power. The elections, which are constitutionally required within this timeframe, will be a major political inflection point, likely replacing a legislature dominated by the Union Solidarity and Development Party (USDP), established by the former regime, with one more reflective of popular sentiment. The opposition National League for Democracy (NLD) party of Aung San Suu Kyi is well-placed to take the largest bloc of seats. There have been major improvements in election administration since the deeply flawed 2010 elections and the more credible 2012 by-elections. While the election commission is still widely perceived as close to the government and the USDP, the transparent and consultative approach it has adopted and the specific decisions it has taken suggest it is committed to delivering credible polls. This includes major efforts to update and digitise the voter roll; consultation with civil society and international electoral support organisations on the regulatory framework; invitations to international electoral observers for the first time, as well as to domestic observers; changing problematic provisions on advance voting; and reducing the costs of a candidacy. The broader political environment is also more conducive to credible elections, with a significantly freer media and much improved civil liberties. There remain major challenges to a credible, inclusive and peaceful election. Much of the periphery of the country is affected by armed conflict, and though there have been important steps toward bringing the six-decade civil war to a close, the process remains fragile and incomplete. The vote could be marred by violence in some areas and will not be possible in others. In central Myanmar, rising Burman nationalism and anti-Muslim sentiment have exploded sporadically into violence, something that could happen again in the politically charged context of an election. In Rakhine state, minority Muslim communities have been disenfranchised by a decision to cancel their identification documents. Electoral security and risk management preparations have become a critical priority of the election commission. Capacity constraints will also come into play. The country has very limited experience of democratic polls, including government staff, security services and election commission staff at the local level. Understanding among the electorate is also very low, and major education efforts will be required. For the elections to be successful, there must also be broad acceptance of the results. In a context of divergent expectations and, inevitably, winners and losers, this will be a challenge. While reformist government leaders appear reconciled to the prospect of the NLD winning the most seats, it is unclear whether this sentiment is shared by a majority of the old elite. Similarly, it is unclear whether the NLD's base fully under- stands likely post-election scenarios. With Aung San Suu Kyi constitutionally barred from the presidency and no obvious alternative within its ranks, it is probable that even if the party wins a landslide, it will have to select a compromise candidate for president – potentially a reformist member of the old regime. The some three months between the elections and the presidential electoral college's decision will be a time of considerable uncertainty, possible tension, and intense behind-the-scenes negotiation. The outcome, and the extent to which it is broadly accepted, will determine whether there is a smooth transfer of power and whether the next administration will have the broad support necessary to govern or have its legitimacy constantly questioned. Probably the most important factor will be the support – or at least acquiescence – of the military, which retains strong influence over the process. The commander-in-chief has voiced support for the democratic electoral process and has undoubtedly foreseen the prospect of strong support for the NLD. But this does not mean he would be comfortable with all the potential implications of such an outcome. The elections are coming less than five years into what will continue to be a long and difficult transition for Myanmar. They create a moment of political competition and polarisation in a transition process that requires compromise and consensus. If credible and inclusive, they can help to build confidence that the country is on a new political path and thereby inject fresh momentum into the reforms. Equally, they could damage the delicate set of compromises that has so far kept the process broadly on track. It behoves political leaders on all sides to ensure that they keep this larger prize foremost in their minds.

35710. Electoral Rentierism? The Cross-National and Subnational Effect of Oil on Electoral Competitiveness in Multiparty Autocracies

Abstract:: Building on theoretical insights from research on the rentier state and the “resource curse,” several studies have supported the argument that oil hinders democracy. However, previous research on the rentier state has neglected the global surge of multiparty autocracies or “electoral authoritarian” regimes since the end of the Cold War. No systematic study has been carried out on the question of whether or not and how oil affects electoral contests in nondemocratic regimes. In this paper we contribute to filling this gap by combing the literature on multiparty autocracy and the political economy of the rentier state. As oil production creates substantial, nontransparent revenue streams to national and subnational governments, we hypothesize that oil production has a negative effect on electoral competitiveness, both cross‐ and subnationally, in multiparty autocracies. Consequently, the democratic “resource curse” emphasized in earlier work on the rentier state is likely to persist even after the introduction of multipartyism in cases where oil production predates democratic institutions. The paper tests the hypothesis cross‐nationally, using data on all multiparty elections held in the world in the period 1975–2010, and subnationally, using a new data set on subnational election results and oil production in Nigeria. Our results confirm that oil impedes electoral competitiveness, both cross‐ and subnationally, in multiparty autocracies.

35711. State Extraction and Anti-Colonial Rebellion – Quantitative Evidence from the Former German East Africa

Abstract:: Does extraction increase the likelihood of antistate violence in the early phases of state building processes? While much research has focused on the impacts of war on state building, the potential “war‐making effects” of extraction have largely been neglected. The paper provides the first quantitative analysis of these effects in the context of colonial state‐building. It focuses on the Maji Maji rebellion against the German colonial state (1905–1907), the most substantial rebellion in colonial Eastern Africa. Analyses based on a newly collected historical data set confirm the correlation between extraction and resistance. More importantly, they reveal that distinct strategies of extraction produced distinct outcomes. While the intensification of extraction in state‐held areas created substantial grievances among the population, it did not drive the rebellion. Rather, the empirical results indicate that the expansion of extractive authority threatened the political and economic interests of local elites and thus provoked effective resistance. This finding provides additional insights into the mechanisms driving the “extraction–coercion cycle” of state building.

Abstract:: The African party literature, especially research prescribing to the long‐dominant ethnic voting thesis, has asserted that African party systems exhibit low levels of party nationalization. However, systematic research on nationalization across parties and party systems is still lacking. This study argues that the prospects for building nationalized parties vary substantially between incumbent and opposition parties. Incumbent parties, with their access to state resources, have been successful in creating nationwide operations, even in countries where geographical factors have been unfavorable and ethnic fractionalization is high. The analysis utilizes a new data set of disaggregate election results for 26 African countries to calculate nationalization scores for 77 parties and study the correlates of party nationalization. The results show that factors like ethnic fractionalization, the size of the geographical area, and urbanization affect party nationalization, but only in the case of opposition parties. Incumbent parties, on the other hand, generally remain nationalized despite unfavorable structural conditions.

Abstract:: Within the last 50 years, the Brazilian share of South American power has increased from one‐third to one‐half of the overall material capabilities in the region. Such a significant change in the regional power structure cannot have gone unnoticed by Brazil's neighbors. The article addresses the main question related to South American unipolarity (1985–2014): Why have most countries in the region not implemented any consistent balancing or bandwagoning strategies vis‐à‐vis Brazil? Drawing on neoclassical realism, the article proposes that certain domestic variables – government instability, limited party‐system institutionalization, and powerful presidents – have diverted the attention of political elites and foreign policy executives from the challenges generated by a rising Brazil. Crisp‐set qualitative comparative analysis is used to test this hypothesis and other alternative explanations for the regional imbalance.

Abstract:: This paper uses the case of Sino–Southeast Asian relations to gain insights on China's ability to muster support for its global agenda. The analysis focuses on the regional–global nexus of interstate relations and explores the extent to which the quality of two states' regional relations influences the likelihood of behavioral alignment in global politics. To this end, we consider a range of potentially influential aspects of Sino–Southeast Asian relations (the quality of bilateral relations based on recent event data, alliance policy, regime similarity, development level, and economic ties) and employ a statistical model to search for correlations with observed trends of voting coincidence in the United Nations General Assembly during the period 1979–2010. We find a strong correlation between the quality of regional bilateral relations and global policy alignment, which indicates that patterns of regional cooperation and conflict also impact the trajectory of China's rise in world affairs.

Abstract:: Representatives from the social sciences and cultural studies continue to exhibit mutual reservations and sensitivities when they encounter each other in the field of area studies. This is particularly so with regard to research on East and Southeast Asia. Given this background and with the intention of deriving a productive definition of area studies, this article attempts to assess the current state of Asia-related area studies by reviewing and comparing the debates within the social sciences and cultural studies in the Anglo-Saxon and German-language spheres on the changing role of the discipline. In this text, region is defined as an ongoing process involving the communicative construction of social relations. Various approaches to describing the regions of East and Southeast Asia illustrate that this process is subject to dialectical movements of de- and reterritorialization, which should be examined as issues of equal empirical rank. In view of a growing focus primarily on transnational and transregional entanglements, this text suggests using the term “reflexive essentialism” and proposes more extensive reflection on the new and essentialist self-assurances, limitations, and entrenchments at the regional, national, and subnational levels.

Abstract:: The aim of this paper is to contribute to the ongoing discussion about the design of a post-2015 development framework by proposing indicators to monitor employment outcomes. Our analysis of the current MDG employment indicators shows that measurement problems, the inappropriate use of aggregate statistics, ambiguous interpretability, and assumptions that often do not hold true in the context of developing countries are major shortcomings of the current indicators. Based on this critique, we develop a new set of indicators for productive employment and decent work. We propose four indicators: (i) the growth of labor value added per worker, (ii) the working poverty rate, (iii) (a) the share of workers receiving less than an absolute labor income and (b) the share of workers receiving less than 60 percent of the median labor income. We demonstrate the empirical application of these indicators using the country cases of Uganda and Peru.

Abstract:: In this paper, I assume that global intergovernmental organizations (GIGOs) function as “enablers” of interstate liberal politics by way of their multilateral institutional frameworks. To support this view, I recall and adapt the classical concept of “polyarchy,” coined in the early 1950s by Robert A. Dahl. It consists of a two-dimensional theoretical construct applicable for measuring the level of liberalization in modern political societies. It follows that the more actors who take part in politics, and the more that institutions allow political opposition, the more open a society (of states) is likely to be. I thus wish to assess and rate the level of “polyarchization” of 23 GIGOs that cover various issue areas and fit some specific criteria (for example, more than one hundred member states from at least three different continents). The methodology section includes a scorecard that I have specially developed to help achieve these research objectives.

Abstract:: Despite earning the inauspicious title in recent years as the shipping corridor with the highest number of piracy attacks in the world, regional responses to piracy and maritime security threats in the Gulf of Guinea, have been fragmentary. Maritime domain awareness remains low, interagency coordination is limited, and intra-regional coordination mechanisms that have been established are often underfunded. The highly fungible nature of maritime threats means that this challenge cannot be addressed solely by individual states but requires cohesive regional security cooperation. While progress has been made, stronger political commitments are needed at the national, regional, and international levels if the worsening trend of maritime insecurity in the Gulf of Guinea is to be reversed.

Abstract:: This article discusses the ongoing transformation of international organizations law. It first provides an overview (an anatomy) of the paradigmatic theory concerning the law of international organizations: the theory of functionalism. Subsequently, it investigates how functionalism came about and how, from the 1960s onwards, its flaws increasingly became visible. The argument, in a nutshell, is that functionalism, as a theory concerned with relations between international organizations and their member states, has little or nothing to say about the effects of international organizations on third parties – non-member states, individuals and others. Moreover, it is often applied to entities that can hardly be deemed 'functional' in accordance with the theory. All of this is increasingly viewed as problematic and forces functionalism to adapt. Whether it can do so is questionable, though, since some of its problems are structural rather than contingent. Things are illustrated by the invocation of the United Nations's possible responsibility for causing (or failing to prevent) the outbreak of cholera in Haiti.

Abstract:: This article introduces three ways in which a state at war can attempt to accommodate the often contradictory demands of military necessity and humanitarianism – three 'logics' of waging war. The logics of sufficiency, efficiency and moral liability differently distribute the harm and destruction that waging war inevitably causes. International law demands belligerents follow the logic of sufficiency. Contemporary strategic imperatives, to the contrary, put a premium on waging war efficiently. Cross-culturally shared expectations of proper state conduct, however, mean killing in war ought to fit the logic of moral liability. The latter proves entirely impracticable. Hence, a belligerent faces a choice: (i) renounce the right and capacity to use large-scale collective force in order to meet public expectations of morally appropriate state conduct (logic of liability); (ii) defy those expectations as well as international law and follow strategic imperatives (logic of efficiency) and (iii) follow international law (logic of sufficiency), which is inefficient and will be perceived as illegitimate. This is the 21st-century belligerent's trilemma.

Abstract:: This article questions the conventional histories of international humanitarian law, which view international humanitarian law as the heir to a long continuum of codes of warfare. It demonstrates instead that the term international humanitarian law first appeared in the 1970s, as the product of work done by various actors pursuing different ends. The new idea of an international humanitarian law was codified in the 1977 Additional Protocols to the Geneva Conventions. Nevertheless, many of the provisions of the Protocols remained vague and contested, and their status, together with the humanitarian vision of the law they outlined, was uncertain for some time. It was only at the end of the 20th century that international lawyers, following the lead of human rights organizations, declared Additional Protocol I to be authoritative and the law of war to be truly humanitarian. As such, this article concludes that international humanitarian law is not simply an ahistorical code, managed by states and promoted by the International Committee of the Red Cross. Rather, it is a relatively new and historically contingent field that has been created, shaped and dramatically reinterpreted by a variety of actors, both traditional and unconventional.

Abstract:: When a peace process involves contention over land boundaries, parties may consent to resolve their dispute through arbitration. Yet while tribunals resolve disputes on paper, their awards often fail to bring peace in practice. Initial consent to arbitration does not guarantee a successful outcome: once granted, consent can wax and wane, it can be delivered under duress and it can be withdrawn as fast as it is given. This article explores the consent management dynamics that shape – and are shaped by – the arbitral process. Drawing on scholarship from peacekeeping and relational contract theory, it develops a model that explains why consent to arbitration differs from consent to a peace process. It then applies the model to examine strategies that tribunals have used to bridge this gap. Case studies involving the BrÄko District in Bosnia and Herzegovina, the Eritrea–Ethiopia Boundary Commission and the Abyei arbitration demonstrate how arbitrators manipulate procedural and substantive law to maintain consent. The three cases also offer insights into the varying success of consent management strategies. The article plots these cases onto the model to draw lessons for future arbitrations on the basis of one simple but crucial question: 'Who should consent to what?'

Abstract:: Although treaty interpretation is undoubtedly an activity governed by international law, and by Articles 31–33 of the 1969 Vienna Convention on the Law of Treaties (VCLT) in particular, some commentators continue repeating the pre-Vienna adage that treaty interpretation is a matter of art and not science, the implication of which is that no understanding of a treaty provision can ever be explained rationally. As the present article argues, this idea of interpretation must be rejected. While, sometimes, an assumed meaning of a treaty cannot be justified based on international law simpliciter, many times it can still be explained based on the structural framework of Articles 31–33 of the VCLT. Consequently, any characterization of treaty interpretation in the abstract as either art or science is misplaced. Whether treaty interpretation is an art or a science remains a question of fact inextricably tied to the approach taken by each and every law-applying agent in particular cases.

Abstract:: Building on the heightened attention that the optic of judicial selection receives in the world of international courts, this article focuses its attention on one particular criterion that is gaining in importance in that respect: gender. By choosing the European Court of Human Rights as a case in point, the article provides a unique analysis of the history of the 2004 Resolution of the Council of Europe's parliamentary assembly that formulated a rule of gender balance on the list of candidates presented by states for the post of judge at the Court. It first unearths the dynamics that allowed the adoption of the rule as well as all of the fierce opposition it triggered as well as the ways in which counter-mobilization eventually prevailed and watered down the initial rule, with the help of states, the Committee of Ministers and the Court itself (which delivered its first advisory opinion on the topic in 2008). It then looks beyond the static analysis of the rule as a mere constraint and addresses in a more dynamic fashion the multiple interpretations, strategies and, ultimately, politics it opens up. By providing a unique qualitative, comparative and exhaustive analysis of the curriculum vitae of all the 120-odd women who were ever listed as candidates to the Strasbourg judicial bench (1959–2012), the article delivers original data and analyses both the features that women candidates put forth when listed for the job and the strategies of states with regard to the gender criterion. It concludes that while there is a strong proportion of candidates that support the notion that states do not differentiate according to gender or require different qualities from men and women candidates, there is a comparable proposition that contrarily indicates that the world of international judicial appointments is far from gender neutral.

Abstract:: Having spent almost 14 years as a judge at the European Court of Human Rights, the author responds to and shares the critical view expressed by Hennette Vauchez in her article on the presence of women judges at the European Court of Human Rights. Some steps forward have admittedly been made through the voluntary action of the Council of Europe Parliamentary Assembly, but there has also been resistance in the implementation of these new rules. The gains are fragile and there are risks of regression. This situation confirms Kenney's analysis: women's progress is not natural, inevitable nor irreversible. A reaction is all the more necessary and urgent since, in the coming months of 2015 and subsequently, many elections of judges to the Court will take place, due in particular to the non-renewable nine-year term of office of judges introduced by Protocol No. 14 to the European Convention on Human Rights.

Abstract:: This article responds to a thoughtful intervention by Stéphanie Hennette Vauchez documenting the selection process for women seeking judicial appointment to the European Court of Human Rights. Written in the context of the author's experience as candidate for appointment to the Court, the analysis concentrates on the gendered dimensions of international institutional cultures, habits and practices that frame selection to judicial office as much as any formally applicable rules. I explore the ways in which ostensible access to international judicial bodies conceals the manifold ways in which Courts are coded masculine, and how female candidacy requires careful deliberation on performance, presentation and identity. Drawing on 'new institutionalism' theory, I underscore that female presence alone rarely undoes embedded institutional practices. Rather, transforming institutional practices and values must parallel female presence, thereby redefining the institution and the forms of power it exercises. The article concludes by reflecting on the importance of feminist judging, and argues that it is precisely the transformative political and legal changes sought by self-defined feminists that may stand the best chance of undoing the structures, habits and practices that continue to exclude women from being appointed and from engaging on terms of full equality when they arrive.

35730. Holocaust Denial before the European Court of Human Rights: Evolution of an Exceptional Regime

Abstract:: Litigation concerning domestic restrictions on Holocaust denial has produced a 30-year-long jurisprudence of the European Court and European Commission of Human Rights. In spite of solemnly declared principles on free speech, the Strasbourg organs have progressively developed an exceptional regime in this regard based on the 'abuse clause' envisaged under Article 17. Had this detrimental treatment remained confined to its original sphere, it could have perhaps been considered as a negligible issue. However, the scope of the abuse clause was extended to encompass a growing class of utterances, including the denial of historical facts other than the Nazi genocide. This piece begins by examining the Strasbourg case law on Holocaust denial, with a view to enucleating the effects, scope and conditions of applicability of the special regime based upon Article 17. Once the shortcomings implied by this detrimental discipline have been exposed, it shall be argued that all expressions should be dealt with under the ordinary necessity test, in which the abuse clause ought to operate as an interpretative principle. In the alternative, and as a minimum, the Court should pay due regard to the political and social context of the country where restrictions on free speech were enforced, setting aside the uniquely harsh treatment reserved for Holocaust denial.

35731. Shining Cities on the Hill? The Global City, Climate Change, and International Law

Abstract:: Cities are beginning to assert themselves as internationally relevant actors. This is particularly noticeable in the climate change context. This development has so far not been accorded a great deal of attention by international lawyers. The review essay discusses four new books by political scientists which offer us a closer look at the political dimension of 'global cities', a term originally coined by sociologist Saskia Sassen. The four books under review as well as this essay pay particular attention to the C40 association – a movement of self-styled city leaders in climate change governance. This group of cities has developed numerous ties with international organizations and private corporations. The review essay analyses how cooperative endeavours such as C40 challenge our understanding of the relationship between the city and the state and assesses how international law as a discipline could come to terms with these developments. It is argued that international law should fulfil two functions in this regard: recognition and contestation. Whereas cities may not yet be recognized subjects of international law, they are moving closer to this illustrious circle. In any case, their law-making processes are beginning to have a significant impact on processes of global governance.

Abstract:: Anne Peters' most recent book is an equally important and topical contribution to the international law discourse. At the core of her voluminous œuvre lies, as the subtitle indicates, the question of the 'legal status of the individual in public international law'. At the same time, the title Beyond Human Rights conveys the idea that the co-director of the Max Planck Institute for Comparative Public Law and International Law in Heidelberg and former president of the European Society of International Law does not cover the subject matter in its entirety but, rather, has opted to leave aside, or rather to presuppose, the very area of international law where one would be inclined to look first for insight and inspiration, namely international human rights law. As the author acknowledges herself, international human rights are 'the pivotal and completely undisputed element of the international legal status of the individual' (at 27). In contrast, Peters' own study sets out for the more open and uncharted territory of so-called 'simple' rights and duties. It is with this peculiar perspective that the book seeks to tackle its guiding question – that is, how the phenomenon of a strongly increasing number of individual rights and duties that may be observed in contemporary international law 'can be described, systematised, and evaluated in a legally sound manner' (at 2).

Abstract:: Mass protests in Maidan, the central square of Kyiv, during the bitter cold winter of 2013-2014, known as 'Euromaidan' or 'Revolution of Dignity' were non-violent for more than two months. The demonstrations began when, under Russian pressure, former President Viktor Yanukovych abruptly resisted in signing the long promised Association Agreement with the EU. However, when President Yanukovych, reputed for his corruption and authoritarian style, responded to the peaceful protests by violent repression, Euromaidan quickly moved beyond its initial slogans and demanded the president's resignation. In February 2014, after security forces started to shoot protesters, Ukraine became one of the only countries in the world where a hundred people died “under the EU flags” defending democracy and the European choice. In this context, according to the agreement signed on February 21, 2014, between the opposition and President Yanukovych, the parliament returned to the 2004 constitutional reform and, consequently, combined a parliamentary-presidential form of government. The 2004 constitutional reform had previously been unconstitutionally abolished by President Yanukovych in 2010 and its restoration was among the main demands of the Euromaidan.

Abstract:: At the conclusion of the summer 2014 Gaza War Israel, Hamas, and the P.A. agreed to meet in Cairo, Egypt to discuss a long-term ceasefire. The goal of this summit was to allow for Gaza to rebuild itself, and for political changes associated with June's Unity Government deal between the P.A. and Hamas to take effect. The summit has since been postponed. However, Gaza still requires significant financial and material aid in order to function and provide for its people. This work examines the economic and security benefits to all parties involved of a long-term ceasefire between Israel, and Hamas. An economically open Gaza benefits Israel, the P.A. and Hamas, with few associated costs and creates an opportunity to reinvigorate final status negotiations.

Abstract:: The growing flow of international migration to Turkey has serious implications for the social, economic and spatial transformation of recipient cities across the country. This paper highlights some of these implications by discussing findings from an ethnographic case study carried out in an inner-city locality of Istanbul. It raises four main points: 1) urban localities of migrant settlement are not accidental; 2) they are often highly diverse in new and complex ways; 3) space and difference are intricately intertwined in such urban localities; and 4) migration and diversification at the local scale can produce conflicted space narratives and governance systems. This paper aims to emphasize the importance of acknowledging the position and impact of migration to Turkey in the framework of larger processes of urban and societal transformation.

Abstract:: This article is a summary of the study “Syrians in Turkey: Social Acceptance and Integration,” which was conducted by the Hacettepe University Migration and Politics Research Center-HUGO in six cities based on interviews with Syrians and locals and analysis of the media and NGOs. Over 1.8 million Syrians arrived in Turkey and accepted under “temporary protection” status between April 2011 and December 2014. The efforts of the Turkish government and society has spent 5-5,5 billion dollars on the crisis. Turkish society has been overwhelmingly accepting of Syrians. However, concerns and objections are increasing as the permanency of Syrians in Turkey becomes more visible. Therefore, it is essential to develop strategies on permanency with the support of Turkish society.

Abstract:: This analysis offers an evaluation of the last three elections of the Kurdistan Regional Government (KRG) in Iraq. These three elections included the regional parliamentary elections in September 2013, and the local and federal elections held simultaneously in April 2014. The KRG, as a federal region, exists in the north of Iraq where Kurds have managed their own affairs through a regional government since 1992. The KRG elections have very little in common with elections in the rest of Iraq. Compared to the rest of Iraq, the “region” has experienced a very different trajectory during the last two decades. As a postwar region, the KRG strives to solidify a stable democracy in a landlocked region, which suffers from minimal economic capital and weak democratic culture.

Abstract:: This article argues that Turkey is going through a paradigm transition regarding its migration characteristics and has changed from an emigration to an immigration country. It briefly reviews the history of immigration of mostly ethnic Turks or other Muslims to Turkey, but then concentrates on contemporary non-Turkic and non-Muslim immigrants. In the first part, it distinguishes between flows of travelers and migrants and stock of immigrants. Notably, it illustrates national diversity, assesses the quantitative level of immigration to Turkey, including estimates on irregular immigration, and addresses the geographic dispersal of immigrants across the country. In the second part, it analyzes the macro-level economic, political and social factors and discrepancies between Turkey, its neighbors and other countries in the wider region, which represent the structural determinants of migration. It concludes that immigration to Turkey is still comparably low but that due to macro-level factors, it could grow. In order to develop adequate policy responses, more research must be done.

Abstract:: Turkey in the recent years has become a destination for individuals from various regions, migration histories and experiences, with an explicit increase observed in the number of those coming from the Commonwealth of Independent States (CIS). Migrant groups coming to Turkey gather geographically in certain cities such as Antalya, a touristic city that has become an important migration destination, particularly for Russians and Azerbaijanis. The study aims to be acquainted with these migrants, who have been the subject of very few analyses, and to understand why they have immigrated to Antalya, substantially within framework of “Who are They?” and “Why are they Here?” It is based on data obtained from a comprehensive questionnaire applied to 418 Russian and Azerbaijani respondents. Moreover, the data is supported by observations, in-depth interviews and media analysis.

Abstract:: In conversation with recent work on transnational social fields, this article explores how Germany and Turkey are linked through a “set of multiple, interlocking, networks of social relationships” . The article examines how the social field affects migrants returning from Germany to Turkey. Specifically, it describes how the transnational social field emerges through a concrete set of economic, political and cultural exchanges. It also illustrates that the social field is a space of imaginations of Germany and Turkey, reflecting and producing citizens' uncertainties about the “Europeanness”. For German-Turkish return migrants, the transnational social field exacerbates conflicts with non-migrants and fosters anxieties about migrants' “Germanization” and loss of “Turkishness.” Ultimately, this research shows that Turkish citizens remain deeply concerned about the meaning of modernity, Muslim citizenship in Germany, and Turkey's current and future position in Europe.

Abstract:: Many Afghans, often male, in Pakistan are migrating (again) and increasingly toward 'new' destinations such as Turkey. Transnational lives are not unusual for Afghans as a method of survival, as well as a space for 'self-making'. However, these migrations are also the result of Turkey's own regional ambitions and projection of itself as a modern neoliberal 'Muslim' state. Moreover, increased migration is also a result of the historic role that cheap labor migrants, particularly from Central/South Asia, have played in the development of rising neoliberal economies. Thus in the 2000s and 2010s, as Turkey's 'star' rises, so too does Turkey find itself shifting from a migrant sending to a migrant receiving state.

Abstract:: This paper discusses EU-Turkey relations with a specific reference to regional developments in the Middle East after the Arab Spring. In the last decade, the Turkish government has tried to intensify Turkey's influence in the region. However, increasing activism in Turkey's foreign policy toward the region was not accompanied by a parallel commitment in its relations with the EU. In the meantime, the EU was caught unprepared by the Arab Spring in the middle of the Euro-zone crisis, and now its strategic interests are being threatened by regional instability. Both sides have been faced with the task of adapting their policies to the political transitions in the region. After an analysis of their contemporary regional policies, this article argues that even though their strategies are not totally in line with each other, Turkey follows the same objectives that the EU neighborhood policy has pursued towards the Middle East.

Abstract:: Recently, there has been a growing body of literature on the multifaceted relationship between religion, politics and security in both national and global contexts, with a special emphasis on church-state relations and/or secularism. Various aspects and influences of religion on a variety of thematic issues occupy columns, journals and books. However, one might argue that the same does not apply for the study of religious freedom. The violation of religious freedom is a phenomenon that has been observed not only under authoritarian regimes or Third World countries, but also in democratic and so-called civilized nations. Authoritarian regimes, restrictive state policies, intolerant and hostile societies as well as security-oriented (inter)national political legitimations have tried to control, restrict or suppress the rights of religious groups and minorities and religion per se in the public sphere. In The Future of Religious Freedom, the different reasons for controlling religion through restrictive laws and policies are elaborated from a variety of perspectives.

Abstract:: he recent book edited by A.C.S. Peacock and Sara Nur Yıldız, The Seljuks of Anatolia: Court and Society in the Medieval Middle East, demonstrates how a cognizance of historiography affords the ability to reexamine a historical period. The book, which emerged out of a workshop held in Istanbul in 2009, reinvigorates the study of the Seljuk Empire. Its authors, in order to compensate for the paucity of Muslim sources on medieval Anatolia, draw from a number of “untapped” sources such as Greek and Armenian texts, epigraphy, poetry and letters sent to the court. More significantly, they employ innovative frameworks that test standard perceptions of the Sultanate of Rūm (c. 1081 -1308) and emphasize its religious, cultural, and linguistic diversity. Thus, while the cited aim of the book is to “explore how court and society interacted and shaped one [an]other,” moving “beyond the more purely political history that has dominated to date” (p. 4), its larger purpose of questioning entrenched views of the Seljuk dynasty and medieval Anatolia, and the methods that it uses to offer up new avenues of research make this book a benchmark in the field.

With a selection of six intellectuals, the first chapter gives an overview of the Kemalist ideology and its sociocultural impact on both the private and public spheres in the newly-formed Turkish state. In the second, third and fourth chapters, more details are given about the lives and thoughts of the selected intellectuals, followed by a comparison with their counterparts in the Arab/Muslim world and the old Islamic intellectuals in Turkey. Overall, the book compiles the views of Islamic intellectuals regarding the secularization process in Turkey since the conception of the state; however, the book has weaknesses that prevent the ignition of the reader's curiosity and leaves one wondering what the author intended to contribute to existing literature.

Freedman\'s edited volume, Israel and the United States: Six Decades of U.S.-Israeli Relations, is a compilation of an interesting assortment of essays by Israeli and American scholars from various fields, contending with different aspects of a complicated and multilayered relationship that comprises not only diplomatic and economic links, but also religious, legal, military and strategic connections as well as common beliefs. The first section of the book articulates the political ties between the United States and Israel since 1948. It contends with U.S.-Israeli diplomatic relations, an enquiry of the progression of the pro-Israeli lobby in the United States, and an analysis of the evolution of U.S. public attitudes toward Israel. David Makovsky\'s essay, which deals with the U.S. and the Arab–Israeli conflict, emphasizes that the U.S.\'s relationship with Israel and the Arab world is not a zero-sum game and that the United States can maintain good ties with both sides. The essay reiterates that Israel has been an asset for the United States rather than a liability, which has been suggested by the likes of John Mearsheimer and Stephen Walt. Robert Freedman, in contending with the policies of George Bush and Barack Obama towards the Arab-Israeli conflict, brings to the fore the similarities in their approaches as well as the significant differences, with the former pursuing an episodic approach while the latter has adopted a more continuous line. In his essay on the pro-Israeli lobby in the United States, Dov Waxman discusses the ruptures and fissures that have emerged within the lobby and concludes that there is no single organization that can persuasively claim to exemplify the vast majority of American Jews; as such, its clout/influence is expected to wane. Amnon Cavari\'s essay deconstructs the shifting trends in American support for Israel, contending that a decline in support among college-educated Americans along with an upsurge in support among evangelical Christians could weaken bipartisan backing for Israel.

Abstract:: The relationship between Islam and foreign policy has become the subject of a number of volumes in recent years as scholars seek to understand the role that political Islam plays in determining foreign policy. This is more often than not accompanied by the assumption that Islam is fundamentally incompatible with modernity. Turkey, with its complex history of modernity and the transition from its Ottoman past, remains an interesting case for the study of the causal relationship between the construction of a modern nation state, secular identity and nationalized foreign policy. The rediscovery of Turkey's regional interests and affinities from the 'Balkans to Western China' – areas that had been largely absent from Turkish foreign policy debates since the foundation of the Republic – have emphasized the significance of the state's internal evolution in determining its external policy. In her book, Turkey Facing East: Islam, Modernity and Foreign Policy, Ayla Gol critically analyzes Turkey's engagement with modernity in the course of its transformation from the Ottoman structure into a modern nation state in order to understand Turkey's foreign policy towards its eastern neighbours between 1918 and 1921. This is a clear and important departure from studies that tend to examine this transition period in terms of Turkey's engagement with the West.

Abstract:: The use of the concept of agency in relation to Africa's foreign relations has, up to now, been very limited. This has often related to the actions of individual pivotal states, such as South Africa or Libya. Indeed, there has not yet been an in depth examination of African agency in international relations, making this volume a welcome addition. Admittedly, this is an enormous subject, one that has grown in significance and relevance given the deepened involvement of actors such as China on the continent since the end of the last century. Questions started to be asked about how African states could structure their engagement with an actor so obviously superior in economic and political power. However, this is not the first time that African agency has been addressed, as these questions were previously inspired by the post-colonial experience and the analysis of enduring Great Power involvement in African affairs, during and after the Cold War.

Abstract:: When we talk about “China in Africa”, we should always remember to differentiate between the various actors and scales that are too often conflated and hidden behind such large and all-encompassing labels like “China” or “Africa”. Common containers and the homogenizing of diversity seldom help to broaden our knowledge or deepen our understanding of the various phenomena which can be observed at the various scales of the multiple relationships that have evolved between this East Asian country and the African continent. Moreover, it is necessary to specify the point in time or particular period we are covering in our scholarly work and that from which we draw our conclusions. Quite a few of the publications addressing China–Africa relations have succumbed to broad generalizations, neglected diversity and specificity and overlooked the temporal dimension. The last couple of years, however, have seen the emergence of a growing body of well-informed case studies on the Chinese presence across the African continent that stress the particularity and the situatedness of Chinese–African encounters and interactions in Africa. We now can rely on thick descriptions of various Chinese actors' realities on the ground in Africa that more often than not defy and counter longstanding and still very common stereotypes, such as that of China's grand strategy in the scramble for Africa or of the generally exploitative and belligerent character of Chinese economic endeavours across the African continent.

Abstract:: Chinese migrant entrepreneurs in Ghana perceive themselves as vulnerable, as regularly they encounter problems and their businesses fail. The adaption experiences of Chinese entrepreneurs in Africa, especially non-traders, remain largely unstudied. By looking at the interactions of newly arrived and established Chinese migrants with institutional actors, partners, local employees and other Chinese in Ghana, this paper shows the multiple dimensions of how Chinese entrepreneurs' migration adaptation evolves, and how they create social capital to develop their businesses in Ghana. From the Chinese perspective, established entrepreneurs condemn the recent numerous “new” Chinese in Ghana as part of the root cause of problems, on account of their “poor quality and bad behaviour”; by comparison, the newly arrived Chinese attribute their challenges to deficiencies in the local people and institutions of the host country. The negative experiences of Chinese entrepreneurs in Ghana provide further evidence for, not only African, but also local Chinese agency from below, and suggest that the rising Chinese presence does not necessarily improve the social status of Chinese entrepreneurs or create a stronger, more unified Chinese community on the continent.

Abstract:: Chinese economic activities in Africa have gained increased visibility in parallel to the recent acceleration of Sino-African relations. This paper, which is framed from a geographical perspective that is often absent or neglected in studies covering China–Africa, focuses on the spatial forms and dynamics. It depicts the way in which two contrasting Chinese economic entities – a state-owned company in Chad and privately owned commercial malls in Johannesburg, South Africa – engage with their respective host environments. While drawing on concepts of “liminality” as well as “heterotopias”, I argue that the modalities of the Chinese footprint are characterised both by closure and interaction, creating a dynamic tension that produces its own set of unique practices. This ambivalence between enclave and active linkages with host societies is not only perceivable from a spatial point of view, but also emerges with regard to economic strategies. In the midst of a transitional period, along with a launching and a consolidating phase, the Chinese economic entities in both case studies show signs of change in terms of behaviour and territorial foothold.

Abstract:: The burgeoning interstate relation between China and Nigeria is in fact hiding the vulnerable condition of transnational Chinese petty entrepreneurship. Small-scale Chinese entrepreneurs in Nigeria are faced with everyday corruption practised by both Nigerian authorities and ordinary Nigerian people, the dominance of self-interest over cohesion and mutual support among the Chinese compatriots, and variations in state policies due to dynamic and changing interstate relations. To overcome their position of weakness, small-scale Chinese entrepreneurs strategize their interactions with both Nigerian and Chinese nationals. Informality is a characteristic of such interactions. Economic informality is primarily embodied in the documentation service businesses that are indebted to those popular corrupt practices in Nigeria; while social informality takes place in cyberspace. Interaction via the Internet among Chinese involved in Chinese–Nigerian businesses helps small-scale Chinese entrepreneurs to cope with fluctuations in interstate links at the macro-level and to develop a sense of community.

Abstract:: China's non-interference policy has come under scrutiny in regards to its growing and deepening relations in Africa. The policy has come to represent an about-face from conditional assistance and investment associated with the Washington Consensus. Although often well received in much of the global South, this policy has drawn a lot of criticism from the West and others. These commentators have perceived non-interference as an opportunistic and often inconsistent instrument for enabling China's increasing access to African resources and markets. This article suggests that despite some consistent support for the rhetoric of non-interference, China's implementation of the policy has become increasingly varied and contextualized in reaction to Africa's ever-more diversified political and economic landscape since the early 2000s.

Abstract:: This article contextualises the art practice of Beijing-based artist Liu Bolin and examines ways in which his artworks illuminate the sociopolitical conditions that regulate the everyday reality of underprivileged social groups amid China's spectacular urban transformation in the 2000s. The tension between individual existence and the force of urbanization underlays Liu's most important work, entitled Hiding in the City. This performance photographic series, in which Liu covered his body thoroughly with paint so that he “disappeared” into the background, was initiated as a response towards the demolition of an artist village in Beijing where the artist resided and worked. The series has since been developed into an ambitious and years-long project in which the artist surveys the disparate urban living environment of the city, bringing to the surface dominant forces that render the existence of the individuals “invisible”.

35767. Congo: Is Democratic Change Possible?

Abstract:: The presidential and legislative polls scheduled for 2016 are a potential watershed for the Democratic Republic of Congo (DRC); th ey could be the first elections held with- out an incumbent protecting his position. The prospect of these elections is testing nerves on all sides of the Congolese political spectrum and has already caused deadly violence. There is an urgent need for President Joseph Kabila to commit to the two- term limit contained within the constitution and ready himself to leave power. Consensus is also needed on key electoral decisions, in particular regarding the calendar and the voter roll. This will require high-level donor and international engagement. Absent agreement and clarity on the election process, or should there be significant delays, international partners should review their support to the government. The fragmented governing majority is running out of options to avoid the 2016 deadline. The government's attempts to amen d both the constitution to allow Joseph Kabila to run for a third term and election laws face strong, including internal, opposition, as was evident in the January 2015 mini political crisis over proposed changes to the electoral law. This mini-crisis, which triggered deadly violence and repression against pro-democracy activists, gave a first hint of what could be in store for 2016. In this tense domestic context, engagement by international actors is met with an increasing insistence on national sovereignty that affects in particular the UN Organization Stabilization Mission in the DRC (MONUSCO). Local and provincial polls planned for 2015, despite a technically insufficient and non-consensual voter list, could undermine credible national elections in 2016. In addition to an overly ambitious and costly electoral calendar, the government is hastily pushing through an under-resourced and ill- prepared decentralisation process, including the division of eleven provinces into 26 as provided for in the 2006 constitution. It aims to finalise in six months what was not achieved during nine years. Trying to pursue decentralisation while implementing the electoral calendar could aggravate local tensions, trigger security troubles ahead of next year's polls and make the country highly unstable. For the government, buying time by capitalising on potential delays seems to be the highest attainable objective it can presently agree on. The disjointed opposition is incapable of forming a united front, but there is a broad agreement to oppose any political manoeuvring to extend President Kabila's rule beyond 2016. In addition to President Kabila's ambiguous signals about whether he will respect his two-term limit, problems experienced during the 2011 elections remain; they include a lack of confidence in the Independent National Electoral Commission (CENI) and a disputed voter list. The democratisation process launched a decade ago is reaching its moment of truth, as the excessive hopes raised by the 2006 elections have not materialised. These were the first, and so far only, reasonably free and fair democratic polls to take place since the country's independence. In their wake, reform of the nature of politics and government in DRC has been limited. However, at this stage, delaying the 2016 presidential and legislative elections would be equivalent to an unconstitutional extension of the regime. The January 2015 violence in Kinshasa was a clear demonstration of the Congolese population's aspirations for political change. If the electoral process is not allowed to move forward unhindered, international actors, with a large UN mission in place, risk supporting a regime with even less legitimacy than is currently the case. All efforts have to focus on creating conditions for credible polls in 2016. To that end, Congolese political actors and the CENI should revise the electoral calendar and delay local elections until decentralisation has been fine-tuned, and provincial polls should be organised to closely coincide or be combined with the national elections. A serious conflict prevention and dispute resolution strategy is required, in particular at the local level. Such efforts cannot be only with the electoral horizon in mind. Successful elections do not equal democracy and good governance; the transformation of the Congolese political system has a long way to go and requires a change in governance practices that will be the work of many years.

Abstract:: The purpose of this report is to provide a framework for doing research on the problem of bias in science, especially bias induced by Federal funding of research. In recent years the issue of bias in science has come under increasing scrutiny, including within the scientific community. Much of this scrutiny is focused on the potential for bias induced by the commercial funding of research. However, relatively little attention has been given to the potential role of Federal funding in fostering bias. The research question is clear: does biased funding skew research in a preferred direction, one that supports an agency mission, policy or paradigm? Federal agencies spend many billion dollars a year on scientific research. Most of this is directly tied to the funding agency mission and existing policies. The issue is whether these financial ties lead to bias in favor of the existing policies, as well as to promoting new policies. Is the government buying science or support?

The reasons the economist gave consisted of various (supposed) financial-market failures. Said the colleague to me later: “I just wanted to stand up and shout, 'That's got nothing to do with it!'” I relate this because some readers may otherwise fail to appreciate the importance of a work whose chief revelation is that financial legislation — and consequently the general structure of financial systems — are shaped by politics. My colleague didn't need to be told, but others, including many economists, evidently do. In Fragile by Design: The Political Origins of Banking Crises Scarce Credit, Charles Calomiris and Stephen Haber tell them. Banking arrangements, they argue, are “not a passive response to some efficiency criterion but rather the product of political deals that determine which laws are passed” (pp. 13 and 38). What's more, the laws such deals give rise to are, more often than not, detrimental to bank safety and soundness. In few words, banking instability has its roots, not in any fragility inherent to commercial banking, but in deals struck between governments and various interest groups. Fragile by Design is at once an alternative interpretation of the history of banking and a contribution to the debate on the causes of the recent crisis. Though other reviewers have tended to focus their attention on the latter contribution, many of Fragile by Design's most important insights, as well as many of its more serious flaws, are independent of its take on the subprime crisis. Abstract:: We now have a 100-year history by which to judge the Federal Reserve's performance. On balance, the Fed has not increased economic stability relative to the pre-Fed era. The Great Depression, the great stagflation, and the 2008 financial crisis have all occurred on the Fed's watch. Even excluding the Great Depression, business cycles have not become appreciably milder, nor have recessions become less frequent or measurably shorter. The Fed has strayed so far from the classic prescription for a lender of last resort—to provide short-term funds to solvent institutions at penalty rates—it strains all reason to suggest that it has successfully fulfilled that function. Its regulatory failures are numerous. It failed even to see the 2008 financial crisis coming. Perhaps the best that can be said about the Fed is that the variability in inflation has declined since 1984.

Abstract:: Many more girls are going to school than ever before, thanks in large part to the Education for All movement (EFA),14 the Millennium Development Goals and international and national programs that have increased access to school for all children. Legislation to make primary education free of charge in many African and Asian countries has greatly contributed to the decrease in the number of primary-school-age girls who are out of school, even as the population of schoolage children has continued to increase. At the primary level, the share of girls in the out-of-school population dropped from 58 percent in 2000 to 53 percent in 2012.15

Abstract:: Morocco has so far been a success story in the Arab world. It has followed a gradual approach to political reforms and democratization, which led to the adoption of a new constitution and the holding of free parliamentary elections in 2011. At the same time, economic growth averaged 4.5 percent between 2000 and 2010, reached 5.0 percent in 2011, 2.7 percent in 2012, and 4.4 percent in 2013. That is, Morocco has avoided the political upheavals and economic meltdowns that plagued other Arab Countries in Transition (ACTs). Maintaining this record of success will require continued political and economic reforms.

35774. Using the Internet to promote services exports by small- and medium-sized enterprises

Abstract:: SMEs are the main drivers of U.S. employment, and the majority of the employment is in SME services firms. Services are also a growing portion of U.S. exports. U.S. services exports are 34 percent of total exports. Including services used in the production of goods for export increases services exports to 50 percent of total U.S. exports. The U.S. runs a services trade surplus and has a competitive advantage in high-skill, high-paying services. The U.S. trade surplus in 2013 was $213 billion. Services exports supported 4.2 million jobs in the U.S. in 2013. Services SMEs are under-represented in U.S. exports. Only 5 percent of high-skilled services companies export, compared to 25 percent in the manufacturing sector. The global growth in Internet access is providing new opportunities for SMEs to export services to customers globally. The Internet also gives SMEs access to services as inputs, which increases the productivity of all SMEs and their ability to compete in overseas markets. Export Promotion Agencies (EPAs) assist SMEs to export. However, EPAs have not developed a comprehensive approach that takes full advantage of the opportunities the Internet provides for growing SME services exports. Some countries have developed new ways to use the Internet to assist SME exports. For example, in the U.S., businessusa.gov collects on a single website relevant trade data and provides information on the export assistance provided by various government agencies. In the U.K., opentoexport.com provides trade data, information on exporting and opportunities to blog and interact with experts. Matchsme.com in Denmark goes further and connects local businesses with local service suppliers. Connectamericas.com is also focused on Latin America and uses the Internet to match customers and suppliers. These different approaches and their successes provide insights into how to scale up an online program that could have a significant impact on SME services exports. The following are the main elements of such a program: Develop an Internet platform. Such a platform would connect services SMEs with overseas buyers and facilitate the transaction through to the export and payment. Build public-private partnerships. The Internet platform should involve the government and the private sector, drawing on their respective expertise. Develop trust in the Internet platform. This is needed if the platform is to succeed. There are various ways to build trust. This could include developing a rating system that is accepted across borders and incorporates into the platform existing trust-building mechanisms. Give services SMEs access to better information. The Internet platform should include all relevant information for services SMEs, including trade data, timely and relevant information on markets, barriers and regulations. Develop online networking opportunities. The Internet platform should allow services SMEs to meet customers and suppliers online. This would also increase the flow of timely information amongst participants on the platform. Such networks can also be used to vet potential business partners, thereby building trust in the Internet platform. Improve access to finance. A lack of finance is a barrier for services SMEs going global. An Internet platform should include information on financing opportunities and innovative financing approaches such as crowd funding. Create opportunities for soft landing in export markets. The ability for services SMEs to have face time with potential customers remains important for achieving export success. An Internet platform could build on the approach of CDMN in Canada and give SMEs opportunities to spend time overseas in start-up incubators or building contacts.

35775. Investing in Early Childhood Development: What is Being Spent, And What Does it Cost?

Abstract:: In the developing world, more than 200 million children under the age of five years are at risk of not reaching their full human potential because they suffer from the negative consequences of poverty, nutritional deficiencies and inadequate learning opportunities. Given these risks, there is a strong case for early childhood development (ECD) interventions in nutrition, health, education and social protection, which can produce long-lasting benefits throughout the life cycle. The results from the 2012 round of the Program for International Student Assessment (PISA)—an international, large-scale assessment that measures 15-year-olds\' performance in mathematics, reading and science literacy—demonstrate the benefits of ECD: Students in the countries that belong to the Organization for Economic Cooperation and Development (OECD) who had the benefit of being enrolled for more than one year in preprimary school scored 53 points higher in mathematics (the equivalent of more than one year of schooling), compared with students who had not attended preprimary school. Although there is much evidence that ECD programs have a great impact and are less costly than educational interventions later in life, very few ECD initiatives are being scaled up in developing countries. For example, in 2010, only 15 percent of children in low-income countries—compared with 48 percent worldwide—were enrolled in preprimary education programs. Furthermore, even though the literature points to larger beneficial effects of ECD for poorer children, within developing countries, disadvantaged families are even less likely to be among those enrolled in ECD programs. For instance, in Ghana, children from wealthy families are four times more likely than children from poor households to be enrolled in preschool programs.

While these pro-government militias can play important security roles, they have limited military capacity and reliability. Transitioning militia fighters into national guard forces with formal ties to the national command structure can overcome some of these limitations, but the shift must be accompanied by a wider commitment to security sector reform and political power sharing.

Abstract:: The South African government is currently discussing various alternative approaches to the further expansion of antiretroviral treatment (ART) in public-sector facilities. Alternatives under consideration include the criteria under which a patient would be eligible for free care, the level of coverage with testing and care, how much of the care will be delivered in small facilities located closer to the patients, and how to assure linkage to care and subsequent adherence by ART patients. We used the EMOD-HIV model to generate 12 epidemiological scenarios. The EMOD-HIV model is a model of HIV transmission which projects South African HIV incidence and prevalence and ARV treatment by age group for alternative combinations of treatment eligibility criteria and testing. We treat as sunk costs the projected future cost of one of these 12 scenarios, the baseline scenario characterizing South Africa's 2013 policy to treat people with CD4 counts less than 350. We compute the cost and benefits of the other 11 scenarios relative to this baseline. Starting with our own bottom-up cost analyses in South Africa, we separate outpatient cost into non-scale-dependent costs (drugs and laboratory tests) and scale-dependent cost (staff, space, equipment and overheads) and model the cost of production according to the expected future number and size of clinics. On the demand side, we include the cost of creating and sustaining the projected incremental demand for testing and treatment. Previous research with EMOD-HIV has shown that more vigorous recruitment of patients with CD4 counts less than 350 appears to be an advantageous policy over a five-year horizon. Over 20 years, however, the model assumption that a person on treatment is 92 percent less infectious improves the cost-effectiveness of higher eligibility thresholds over more vigorous recruitment at the lower threshold of 350, averting HIV infections for between $1,700 and $2,800 (under our central assumptions), while more vigorous expansion under the current guidelines would cost more than $7,500 per incremental HIV infection averted. Granular spatial models of demand and cost facilitate the optimal targeting of new facility construction and outreach services. Based on analysis of the sensitivity of the results to 1,728 alternative parameter combinations at each of four discount rates, we conclude that better knowledge of the behavioral elasticities would be valuable, reducing the uncertainty of cost estimates by a factor of 4 to 10.

Abstract:: Since 2001, an aid consortium known as Gavi has accounted for over half of vaccination expenditure in the 75 eligible countries with an initial per capita GNI below $1,000. Regression discontinuity (RD) estimates show aid significantly displaced other immunization efforts and failed to increase vaccination rates for diseases covered by cheap, existing vaccines. For some newer and more expensive vaccines, i.e., Hib and rotavirus, we found large effects on vaccination and limited fungibility, though statistical significance is not robust. These RD estimates apply to middle-income countries near Gavi's eligibility threshold, and cannot rule out differential effects for the poorest countries.

Abstract:: Guatemala is one of the most unequal countries in Latin America and has the highest incidence of poverty. The indigenous population is more than twice as likely to be poor than the nonindigenous group. Fiscal incidence analysis based on the 2009-2010 National Survey of Family Income and Expenditures shows that taxes and transfers do almost nothing to reduce inequality and poverty overall or along ethnic and rural-urban lines. Persistently low tax revenues are the main limiting factor. Tax revenues are not only low but also regressive. Consumption taxes are regressive enough to offset the benefits of cash transfers: poverty after taxes and cash transfers is higher than market income poverty.

A discrepant replication, in current usage of the term, can signal anything from an unremarkable disagreement over methods to scientific incompetence or misconduct. This paper proposes an unambiguous definition of replication, one that reflects currently common but unstandardized use. It contrasts this definition with decades of unsuccessful attempts to standardize terminology, and argues that many prominent results described as replication tests should not be described as such. Abstract:: The growth-inequality nexus has long been debated by researchers, social commentators and politicians. Despite being controversial, there is growing evidence of multi-dimensional inequality in developing countries, including Pakistan. Oxfam has carried out research on multiple inequalities in Pakistan in collaboration with the Lahore University of Management Sciences (LUMS), the findings of which are presented in this report. The research focused on multi-dimensional inequality in Pakistan to highlight the nature and dimensions of inequality; identify the inequality traps that exacerbate multi-dimensional inequality; examine strategies for mitigating multi-dimensional inequality; and to discuss the policy implications of these findings. This is an effort to generate a sound knowledge base around multiple inequalities in Pakistan and to initiate a national discourse on the impact of inequalities on poverty reduction efforts.

Abstract:: Sahrawi refugees are forced to live in very insecure humanitarian conditions. This situation in and of itself is a source of serious concern. It is, however, the exceptionally long duration of this crisis and the total lack of any prospects which is making this situation all the more unbearable for the men and women living in the Sahrawi refugee camps. The Sahrawi refugees – especially the young – are desperate to take control of their own lives. Even if they are particularly well informed and well educated, their options are severely limited. The frustration which stems from this is exacerbated by the sheer uncertainty of what their future holds. The words of young Sahrawis are growing sharper, and their views more critical, faced with an international community they consider incapable of ensuring that their rights will be respected. The majority we have spoken to are openly questioning whether their cause would not make more progress if they took up arms once again. Much of the responsibility for reaching a just and lasting resolution lies with the parties of the conflict, the Kingdom of Morocco and the Polisario Front. However, in view of the two parties‟ inability to find such a solution, the cards are now in the hands of the international community, in particular the United Nations (UN) and the member states of the UN Security Council. Today, these bodies must demonstrate to the Sahrawi refugees that they are fully engaged in defending their rights. This report calls attention to the responsibility of the international community. The Security Council and members of the Group of Friends must do more to foster conditions conducive to bringing the decolonization process to an end and finding a solution to the conflict, in accordance with international law. They must also persuade the parties in the conflict to make changes to their positions, which are currently irreconcilable. Only a solution such as this can put an end to the refugee crisis and strengthen stability in the region.

This was the third such major military operation in six years, further complicating recovery for a civilian population sealed off by a blockade and separated economically, socially and politically from Palestinians in the West Bank. Shortly after Israel and Palestinian armed groups agreed to a temporary ceasefire, donors from around the world gathered in Cairo to pledge $3.5bn for the reconstruction of Gaza. Six months later, there has been no accountability to address violations of international law, only 26.8 percent of the money has been released, reconstruction and recovery have barely begun, and people in Gaza remain in dire straits. This paper outlines an achievable course of action that, if implemented, could make significant progress in addressing the root causes of the recurrent conflict and towards the realization of a just, durable peace that would benefit Israelis and Palestinians alike. By directly addressing the different actors that have distinct responsibilities towards Gaza – from Israel and the international community to the Palestinian Authority and Hamas – the signatories to this report outline what each party can and must do to end the conflict and ensure Palestinians in Gaza can realize their rights. It is time for these actors to work together effectively to change the course for Gaza before it is too late.

Abstract:: Tax dodging is receiving increasing political attention in Europe. From corporate transparency legislation to early reflections on a European wealth tax, European institutions are promoting tax reforms that have the potential to reduce economic inequality in Europe and beyond - if they are well designed and implemented. The need to find financial resources to restore European growth, combined with recent media scandals, have opened up opportunities for progressive reforms to fight tax evasion and tax avoidance which costs the European Union around €1 trillion a year. Abstract:: A conscious neglect of school education in the initial decades of independent India is termed by Dreze and Sen (2013) as a 'home-grown folly'. Public services like education are key to nurture participatory growth as well as to ensure that growth improves peoples' living conditions. However, India's highly privatised and compartmentalised education system - largely unaccountable to the public-offers very different opportunities for various social groups and perpetuates social inequalities, instead of reducing them. Three out of four children currently out of school in India are either Dalit (32.4%), Muslim (25.7%) or Adivasi (16.6%). Enactment of the landmark RTE legislation has triggered significant improvements, but evidence shows that quality has often been neglected. While concerns regarding privatisation of education remain, RTE Act offers a first step towards an educational system in India that offers access, equity, and inclusion of all children.

35800. Rock Glaciers and Climate Change in the Bolivian Andes: Mapping new water resources

Abstract:: Reduced water security is projected for the Bolivian Andes due to both an expected increase in demand and a decline in the supply of water. This will result in negative impacts on water availability, and therefore on food security, power generation and livelihoods. Rising temperatures due to climate change are associated with glacier retreat across the Andes, which is one factor affecting the supply of water. Therefore it is important to gather information about other sources of high altitude water in the Bolivian Andes and other similarly arid high mountain regions facing similar stresses. Rock glaciers are masses of ice that are covered by a thick layer of rock. Because of their ice content, they are potentially important water sources, especially in arid regions. However, little is known about their spatial distribution and nature. They are smaller, occur at lower altitudes and are less obvious than regular ice glaciers. With the purpose of better informing future water management in Bolivia, this research, which was conducted with the assistance of Oxfam and Agua Sustentable, has created the first rock glacier inventory for the country (15–22°S) and has established the number, size and distribution of these rock glaciers. In total, 94 rock glaciers were discovered in the Bolivian Andes, of which 54 are estimated to contain ice and are therefore active sources of water. It was possible to make an estimation of their importance as water stores for local communities, in comparison with regular glaciers. Climate change impacts on glaciers and other water resources are occurring at a rapid rate in the Bolivian Andes and Bolivia can be used as an early warning indicator of problems in arid regions worldwide. The rock cover on rock glaciers will insulate them to some extent and as temperatures rise, will make them more resilient to melting than ice glaciers. In highlighting the presence of rock glaciers and in setting out methods for identifying them, this research seeks to contribute to improving the knowledge of water resources in the Bolivian Andes and to make a contribution to similar studies elsewhere. It also highlights the need to prioritize the preservation of areas where rock glaciers are located in the interests of water security for vulnerable populations.
